Yahya related to me from Malik from Zayd ibn Aslam from Ata ibn Yasar that the Messenger of Allah, may Allah bless him and grant him peace, said, "When the slave is ill, Allah ta'ala sends two angels to him." He said, "They look at what he says to his visitors. If he praises Allah and lauds Him, when they come to him, they take that up to Allah, the Mighty, the Majestic, and He knows best, and He says, 'If I make my slave die, I will make him enter the Garden. If I heal him, I will replace his flesh with better flesh and his blood with better blood and I will efface his evil actions.'"

Malik related to me from Safwan ibn Sulaym from Ata ibn Yasar that the Messenger of Allah, may Allah bless him and grant him peace, was questioned by a man who said, "Messenger of Allah, shall I ask permission of my mother to enter?" He said, "Yes " The man said, "I live with her in the house". The Messenger of Allah, may Allah bless him and grant him peace, said "Ask her permission." The man said, "I am her servant." The Messenger of Allah. may Allah bless him and grant him peace, said, "Ask her permission. Do you want to see her naked?" He said, "No." He said, "Then ask her permission."

Uyainah bin Abdur-Rahman narrated:
"My father narrated to me: 'The Night of Al-Qadr was mentioned in the presence of Abu Bakrah, so he said: "I do not search for it due to something that I heard from the Messenger of Allah, except for during the last ten (nights); for indeed I heard him say: 'Search for it when nine remain, or; when seven remain, or; when five remain, or; during the last three nights.'" He (Uyainah) said: "During the twenty (nights) of Ramadan, Abu Bakrah used to perform Salat just as he performed Salat during the rest of the year. But when the (last) ten began, he would struggle (performing more Salat during the night)."

Abu Hurairah narrated that the Messenger of Allah said:
“Allah said: ‘I have prepared for My righteous worshippers, what no eye has seen, nor ear has hear, and no human heart has conceived.’ So recite if you wish: No person knows what is kept hidden for them of delights of the eyes as a reward for what they used to do. And in Paradise there is a tree under whose shade a rider can travel for one hundred years without stopping. Recite if you wish: And in shade extended. And the space occupied by a whip in Paradise is better than the world and whatever is in it. Recite if you wish: And whoever is removed away from the Fire and admitted to Paradise, he indeed is successful. The life of this world is only the enjoyment of deception.”

Narrated 'Umair, the freed slave of Abil-Lahm:

"I participated at Khaibar with my masters. They spoke about me to the Messenger of Allah (saws) and told him that I was a slave." He said: "So he ordered me to take up the sword, and I found myself dragging it, so he ordered that I be given something from the goods. I presented a Ruqyah that I used to treat the possessed with, so he ordered me leave some of it and keep some of it."

There is something on this topic from Ibn 'Abbas.

This Hadith is Hasan Sahih. This is acted upon according to the some of the people of knowledge. A complete portion is not given to slave, but something is conferred upon him. This is the view of Ath-Thawri, Ash-Shafi'i, Ahmad, and Ishaq.

narrated from his father, from his grandfather that the Prophet (SAW) said to Bilal bin Al-Harith: "Know." He said: "I am ready to know O Messenger of Allah!" He (SAW) said: "That indeed whoever revives a Sunnah from my Sunnah which has died after me, then for him is a reward similar to whoever acts upon it without diminishing anything from their rewards. And whoever introduces an erroneous innovation which Allah is not pleased with, nor His Messenger, then he shall receive sins similar to whoever acts upon it, without that diminishing anything from the sins of the people.'"

"When these Ayat were revealed to the Prophet (SAW): 'Allah only wishes to remove the Rijs from you, O members of the family, and to purify you with a thorough purification...' These are the people of my house, so remove the Rijs from them, and purify them with a thorough purification.' So Umm Salamah said: 'And am I with them O Messenger of Allah?' He said, "In that case, the martyrs among my people would be few." The Companions asked: "O Messenger of Allah! Then who are the martyrs?" He said: `He is in Paradise.` Then the Messenger of Allah (ﷺ) said: `The believers and their children will be in Paradise and the mushrikeen and their children will be in Hell.” Then the Messenger of Allah (ﷺ) recited: “And those who believe and whose offspring follow them in Faith, - to them shall We join their offspring...” [At-Toor 52:25].

Abu Musa al-Ash'ari reported God's messenger as saying:
When a man's child dies God most high asks His angels whether they have taken His servant's child and they reply that they have. He then asks whether they have taken the fruit of his heart (This is said by some to mean either children or grandchildren, and a basis for that meaning is found in Qur’an, ii, 155, where the plural ath-thamarat is interpreted that way), and when they reply that they have, He asks what His servant said. On their replying that he praised God and said, “We belong to God and to Him do we return,” God says, “Build a house in paradise for my servant and call it the house of praise.” Ahmad and Tirmidhi transmitted it.

Hudhaifa reported God’s Messenger as saying, “Before your time there was a man to whom the angel came to take his spirit, and he was asked whether he had done anything good. On his replying that he did not know, he was told to consider, and then said that the only thing he knew was that he used to have business dealings with people in the world and would demand his rights from them, giving the rich time to pay and letting the poor off. So God brought him into paradise.” In a version by Muslim there is something similar on the authority of ‘Uqba b. ‘Amir and Abu Mas'ud al-Ansari. God said, “I have more right to do this than you. Forgive my servant.” (Bukhari and Muslim).

Son of Adam, if your sins were so numerous as to reach the lofty regions of the sky, then you asked my forgiveness, I would forgive you, and I do not care. Son of Adam, if you were to meet me with enough sins to fill the earth, then met me not associating anything with me, I would bring you as much pardon as would fill the earth.” Tirmidhi transmitted it, and Ahmad and Darimi transmitted it from Abu Dharr. They have nothing to do with me and I have nothing to do with them, and they will never come down to me at the Pond. Malik said, "Another example of that is that the Messenger of Allah, may Allah bless him and grant him peace, forbade the sale called muzabana and granted an indulgence in the ariya for computing the equivalent in dates. It was distinguished between them that the muzabana-sale was based on shrewdness and trade, and the ariya sale was based on a favour rendered, and there was no shrewdness in it."

Malik said, "A man must not buy food for a fourth, a third, or a fraction of a dirham on the basis that he be given that food on credit. There is no harm in a man buying food for a fraction of a dirham on credit and then he gives a dirham and takes goods with what remains of his dirham because he gave the fraction he owed as silver, and took goods to make up the rest of his dirham. There is no harm in that transaction."

Malik said, "There is no harm in a man placing a dirham with another man and then taking from him known goods for a fourth, third, or a known fraction. If there was not a known price on the goods and the man said, 'I will take them from you for the price of each day,' this is not halal because there is uncertainty. It might be less one time, and more another time, and they would not part with a known sale."

Malik said, "If someone sells some food without measuring precisely and does not exclude any of it from the sale and then it occurs to him to buy some of it, it is not good for him to buy any of it except what it would be permitted for him to exclude from it. That is a third or less. If it is more than a third, it becomes muzabana and is disapproved. He must only purchase from what he would be permitted to exclude, and he is only permitted to exclude a third or less than that. This is the way of doing things in which there is no dispute with us."

Malik related to me from Yahya ibn Said that Abu'd-Darda wrote to Salman al-Farsi, "Come immediately to the holy land." Salman wrote back to him, "Land does not make anyone holy. Man's deeds make him holy. I have heard that you were put up as a doctor to treat and cure people. If you are innocent, then may you have delight! If you are a quack, then beware lest you kill a man and enter the Fire!" When Abu'd-Darda judged between two men, and they turned from him to go, he would look at them and say, "Come back to me, and tell me your story again. A quack! By Allah!"

Yahya said that he heard Malik say, "If someone makes use of a slave, without permission of its master, in anything important to him, whose like has a fee, he is liable for what befalls the slave if anything befalls him. If the slave is safe and his master asks for his wage for what he has done, that is the master's right. This is what is done in our community."

Yahya said that he heard Malik say about a slave who is part free and part enslaved, "His property is suspended in his hand and he cannot begin anything with it. He eats from it and clothes himself in an approved fashion. If he dies, his property belongs to the one to whom he is in slavery."

Yahya said that he heard Malik say, "The way of doing things in our community is that a parent can take his child to account for what he spends on him from the day the child has property, cash or goods, if the parent wants that."

Fatimah bint Qais narrated that Allah's Prophet(s.a.w) ascended the Minbar, he laughed, and said:
"Verily, Tamim Ad-Dari narrated a story to me, and it made me happy, so I wanted to narrate it to you[what he narrated to me]. Some people among the inhabitants of Palestine traveled by boat in the sea, taking them here and there, until it cast them on an island among the islands at sea. There they found a beast, clothed with its hair flowing out. They said: 'What are you?' It said: 'I am Al-Jassasah.' They said: 'Give us some news.' It said: 'I shall not give you any news, nor do I want any of your news. But go to the furthest village, for there is someone who will give you news and seek your news.' So we went to the furthest village, and there was a man fettered with chains. He said: 'Inform me about the spring of Zughar.' We said: ' It is full and flowing.' He said: 'Inform me about Al-Buhairah.' We said,'It is full and flowing.' He said: 'Inform me about the date groves of Baysan which is between Jordan and Palestine, do they produce food?' We said: 'Yes.' He said: 'Inform me about the Prophet, has he been sent?' We said: 'Yes.' He said: 'Inform me how the people came to him.' We said: 'Quickly.' He leaped up to try and escape.' We said: 'What are you?' He said: 'I am the Dajjal.'" (The Prophet(s.a.w) said) "He will enter all of the lands except At-Taibah, and At-Taibah is Al-Madinah."

Abu Ad-Darda' narrated that the Messenger of Allah (s.a.w) said:
"The inhabitants of the Fire will suffer from a hunger equal to the punishment they experience, so they will seek relief, and be given to eat of Dari; which will neither nourish nor avail against hunger. So they will (again) seek food to relieve (their hunger), and they will be given to eat of a food that causes one to choke. Then they will remember that they used remedy for choking in the world by drinking something. So they will seek relief from drink. Then they will be given Hamim with meat hooks, so when it comes toward their faces it melts their faces, and when it enters their insides it cuts up what is inside of them. So (some of them) say: 'Call the keepers of Hell' so they say: Did there not come to you your Messengers with clear signs? They say: 'Yes!' They say: 'Then call as you like.' And the invocation of the disbelievers is nothing but in vain." He said: "They will say: 'Call Malik.' So they say: O Malik! Let your Lord make an end of us!'" He said: "So he answers them: Verily you shall abide forever. Al-A'mash said: "I was informed that there is a thousand years between their calling him, and Malik's answering them." He said: "They say: 'Call your Lord, for there is none better than your Lord.' So they will say: Our Lord! Our wretchedness over came us, and we were (an) erring people. Our Lord! Bring us out of this. If we ever return (to evil), indeed we shall be wrong doers."He said: "So the reply to them is: You remain in it in ignominy! And do not speak to Me." He said: "So with that, they loose hope of any good, and with that they are taken to moaning, despair and severe ruin."

Ibn `Umar said:
“Rarely would the Messenger of Allah (saws) stand from a sitting until he supplicated with these words for his Companions: ‘O Allah, apportion for us, fear of You, that shall come between us and disobedience of You, and of obedience to You, which shall cause us to obtain Your Paradise, and of certainty, which shall make the afflictions of the world easy for us, and enjoyment of our hearing, and our seeing, and our strength as long as You keep us alive, and make it the inheritor of us. And let our vengeance be upon those who have wronged us, and aid us against those who show enmity towards us, and do not make our affliction in our religion, and do not make this world our greatest concern, nor the limit of our knowledge, and do not give power over us to those who will not have mercy on us. Narrated Zirr bin Hubaish:
"I said to Hudhaifah bin Al-Yaman: 'Did the Messenger of Allah (SAW) perform Salat in Bait Al-Maqdis?' He said: 'No.' I said: 'But he did.' He said: 'You say that, O bald one! Based upon what do you say that?' I said: 'Based upon the Qur'an, (the Judge) between you and I is the Qur'an.' So Hudhaifah said: 'Whoever argues using the Qur'an, then he has indeed succeeded.'" (One of the narrators) Sufyan said: "He means: 'He has indeed proven'" - and perhaps he (Sufyan) said: "He triumphed." He (Zirr) said: "Glorified is He Who took His slave for a journey by night from Al-Masjid Al-Haram to Al-Masjid Al-Aqsa (17:1).' He (Hudhaifah) said: 'Do you see (this proves that) he (SAW) performed Salat in it?' I said: 'No.' He said: 'If he had performed Salat in it, then it would have been required upon you that you perform Salat in it, just as it is required that you perform Salat in Al-Masjid Al-Haram.' Hudhaifah said: 'The Messenger of Allah (SAW) was brought a beast with a long back - stretching out like this - one stride of it, is as far as his vision. So, the two of them remained upon the back of Al-Buraq until they saw Paradise and the Fire, and all of what has been prepared for the Hereafter, then they returned back to where they began.' He said: 'They say that he was fettered, but for what? Because he might flee? The Knower of the unseen and the witness subdued him.'"

Abu Hurairah (May Allah be pleased with him) reported:
Messenger of Allah (PBUH) said, "Allah has divided mercy into one hundred parts; and He retained with Him ninety-nine parts, and sent down to earth one part. Through this one part creatures deal with one another with compassion, so much so that an animal lifts its hoof over its young lest it should hurt it".

[Al-Bukhari and Muslim]

Another narration is: Messenger of Allah (PBUH) said, "Allah has one hundred mercies, out of which He has sent down only one for jinn, mankind, animals and insects, through which they love one another and have compassion for one another; and through it, wild animals care for their young. Allah has retained ninety-nine mercies to deal kindly with His slaves on the Day of Resurrection."

[Al-Bukhari and Muslim].

Another narration in Muslim is reported: by Salman Al-Farisi: Messenger of Allah (PBUH) said, "Allah has hundred mercies, out of which one mercy is used by his creation for mutual love and affection. Ninety-nine mercies are kept for the Day of Resurrection."

Another narration is: Messenger of Allah (PBUH) said, "Allah created one hundred units of mercy on the Day He created the heavens and the earth. Each one of them can contain all that is between the heaven and the earth. Of them, he put one on earth, through which a mother has compassion for her children and animals and birds have compassion for one another. On the Day of Resurrection, He will perfect and complete His Mercy". (That is He will use all the hundred units of mercy for his slaves on that Day).

Abu Huraira reported God's messenger as saying, "The last hour will not come before two parties which make the same profession fight together and a great slaughter results, before about thirty lying dajjals are sent forth each of them asserting that he is God's messenger, before knowledge is withheld, earthquakes are abundant, the time becomes short, dissensions appear, and there is much harj, which means slaughter, before wealth is abundant and overflowing among you, before one who possesses property is anxious to find someone who will accept his sadaqa, before he offers it and the one to whom it is offered says he has no need of it, before people try to outstrip one another in building, before a man passes another's grave and expresses the desire that he were in his place, and before the sun rises in its place of setting. Then when it rises and people see it, they will all believe, but that is a time when a soul will not be benefited by faith it did not have before, or acquire any good from its faith. The last hour will certainly come when two men have spread out their garment between them, but they will not complete the transaction or fold up the garment; the last hour will certainly come when a man has gone off with the milk of his milch camel, but he will not taste it; the last hour will certainly come when a man is repairing his tank, but he will not water his camels from it; and the last hour will certainly come when one has raised his food to his mouth, but he will not taste it." Abu Huraira reported God's messenger as saying, "The last hour will not come before the Byzantines alight in al-A`maq or in Dabiq[1], and an army consisting of the best people in the earth at that time will come forth from Medina against them. When the lines are drawn up the Byzantines will say, `Let us get at those who took captives from us and fight them,' but the Muslims will reply, `We swear by God that we will not let you get at our brethren.' They will then fight and a third whom God will never forgive will be routed, a third who will be the most excellent martyrs in God's sight will be killed, and a third who will never be subjected to trials will be victorious. They will then conquer Constantinople, but while they are dividing the spoils, having hung their swords on olive-trees, the devil will cry among them, `The dajjal has taken your place among your families;' so they will go out, but that will prove to be false. Then when they come to Syria he will come forth, and while they are preparing for battle and arranging the ranks the time for prayer will come and Jesus, son of Mary will descend and lead them in prayer. When God's enemy sees him, he will dissolve like salt in water, and if he[2] were to leave him he would dissolve completely; but God will kill him by his hand and he will show them his blood on his spear." Mirqat, 5:159. quotes the view that al-A'maq is on the outskirts of Medina and that L'abiq (or Dabaq) is a market-place in Medina. Yaqut, iii, 513. says Dabiq is a village near Aleppo, and (1:316) al-A'maq is a district near Dabiq between Aleppo and Antioch. i.e., Jesus. Muslim transmitted it.

`Adi b. Hatim said:
While I was with the Prophet a man came to him and complained to him of poverty; then another came to him and complained to him of highway robbery. He then said, "Have you seen al-Hira, `Adi? If you live long enough you will certainly see a woman travelling from al-Hira to go round the Ka'ba, fearing no one but God; if you live long enough the treasures of Kisra will certainly be conquered; if you live long enough you will certainly see a man coming out with a handful of gold or silver looking for someone to accept it but finding no one to accept it from him.[1] One of you will certainly meet God on the day he meets Him with no one between them to interpret for him. He will then certainly say, `Did I not send you a messenger who was conveying the message to you?' He will reply, `Certainly.' He will then say, `Did I not give you property and show favour to you?' He will reply, `Certainly;' then he will look to his right and see only Jahannam, and he will look to his left and see only Jahannam. Guard against hell, even though it be with half a date;[2] and if anyone cannot get so much, he should do it with a good word." `Adi said: I have seen a woman travelling from al-Hira to go round the Ka'ba, fearing no one but God; I was among those who conquered the treasures of Kisra, son of Hurmuz; and if you live long enough you will see what the Prophet Abul Qasim said, one coming out with his hand full. Because there will be no poor at that time. As alms. Bukhari transmitted it.

Abu Dharr reported that the Prophet, may Allah bless him and grant him peace, reported that Allah, the Blessed and Exalted, said:
"My slaves! I have forbidden injustice for Myself and I have made it forbidden among you, so do not wrong one another. "My slaves! You err by night and day and I forgive wrong actions and do not care. Ask me for forgiveness and I will forgive you. "My slaves! All of you are hungry unless I have fed you, so ask Me to feed you, and I will feed you. All of you are naked unless I have clothed you, so ask Me to clothe you and I will clothe you. "My slaves! If all of you, the first of you and the last of you, the jinn among you and the men among you, were to be as godfearing as the most godfearing heart of any one of you, that would not add anything to My kingdom. If they were to be as corrupt as the most corrupt heart of any one of you, that would not decrease anything in My kingdom. If they were to join together in one place and then ask of Me, and I gave every man among them what he asked for that, that would not reduce My kingdom at all, except as the sea is decreased if a needle is dipped into it. "My slaves! It is only your actions which I have appointed for you. Whoever finds good should praise Allah. Whoever finds other than that should only blame himself.'"

On the authority of Abu Hurayrah (may Allah be pleased with him) that the Prophet (PBUH), from among the things he reports from his Lord (mighty and sublime be He), is that he said:
A servant [of Allah's] committed a sin and said: O Allah, forgive me my sin. And He (glorified and exalted be He) said: My servant has committed a sin and has known that he has a Lord who forgives sins and punishes for them. Then he sinned again and said: O Lord, forgive me my sin. And He (glorified and exalted be He) said: My servant has committed a sin and has known that he has a Lord who forgives sins and punishes for them. Then he sinned again and said: O Lord, forgive me my sin. And He (glorified and exalted be He) said: My servant has committed a sin and has known that he has a Lord who forgives sins and punishes for sins. Do what you wish, for I have forgiven you. Jami` at-Tirmidhi 3318
Ibn Abbas said:
“I was ever determined to ask Umar about the two women, among the wives of the Prophet, about whom Allah [the Mighty and Sublime] said: If you two turn in repentance, your hearts are indeed so inclined… until once when Umar performed Hajj, and I performed Hajj along with him. I poured water for his Wudu from a water holder, and I said: ‘O Commander of the Believers! Who are the two women among the wives of the Prophet, about whom Allah said: If your two turn in repentance, you hearts are indeed so inclined?’ He said to me: ‘I am astonished at you O Ibn Abbas!’” – Az-Zubair (one of the narrators) said: “By Allah! He disliked what he asked him, but he did not withhold it from him.” – “He said to me: ‘It was Aishah and Hafsah.’” He said: “Then he began narrating the Hadith to me. He said: ‘We, the people of the Quraish, used to have the upper hand over our women. So when we arrived in Al-Madinah, we found a people whose women had the upper hand over them. Our women began acquiring the habits of their women. One day I became angry with my wife when she started talking back to to me, she said: “What bothers you about that? By Allah! The wives of the Prophet talk back to him, and one of them may stay away from him a whole day until the night?’” “He said: ‘I said to myself: “Whoever among them has done that, then she has thwarted herself and lost.’” “He said: ‘My house was in Al-Awali among those of Banu Umayyah, and I had a neighbor among the Ansar, and he and I would take turns visiting the Messenger of Allah.’ He said: ‘One day I would visit him and bring the news of the Revealation, and other than that, and one day he would visit him and bring the same. We heard stories that Ghassan were preparing their horses to attack us. He said: ‘One day he came to me in the evening and knocked on my door, so I went out to him. He said: “A horrible thing has happened.” I said: “Ghassan has come?” He said: “Worse than that. The Messenger of Allah has divorced his wives.’” He said: ‘I said to myself: “Hafsah has thwarted herself and is a loser! I though this would happen some day.’” He said: ‘After we prayed Subh, I put on my clothes, then went to visit Hafsah. There I found her crying. I said: “Has the Messenger of Allah divorced (all of you)?” She said: “I do not know. He has secluded himself in the upper room.’” He said: ‘So I wen, and came upon a black slave, I said: “Seek permission for Umar.’” He said: ‘So he entered then came out to me. He said: “I mentioned you to him, but he did not say anything.’” He said: ‘So I went to the Masjid. There I found a group of people sitting around the Minhar weeping, so I sat down with them. Then it became too much for me, so I went to the slave and said: “Seek permission for Umar.” He went in, then he came out to me and said: “I mentioned you to him, but he did not say anything.’” He said: ‘So I went to the Masjid again, and sat there until I could not take it any more, and I went back to the slave and said: “Seek permission for Umar.” He went in, then he came out to me and said: “I mentioned you to him but he did not say anything.’” He said: ‘So I turned to leave, when the slave called me back. He said: “Enter for he has given you permission.’” He said: ‘So I entered, and found the Prophet reclining upon a woven mat, and I saw the marks it left on his side. I said: “O Messenger of Allah! Have you divorced your women?” He said: “No.” I said: “Allahu Akbar! IF you only saw us O Messenger of Allah! We the people of the Quraish used to have the upper hand over our women, but when we came to Al-Madinah we found a people whose women had the upper hand over them. Our women began acquiring the habits of their women. One day I became angry with my wife, so when she started talking back to me I rebuked her and she said: ‘What bothers you about that? By Allah! The wives of the Prophet talk back to him, and one of them may stay away from him a whole day until the night?’” He said: “I said to Hafsah: ‘Do you talk back to the Messenger of Allah?’ She said: ‘Yes, and one of us may stay away from him all day until the night.’” He said: “I said: ‘Whoever among them has done that, then she has thwarted herself and lost. So any of you feel so secure against Allah becoming angry with you because of the anger of the Messenger of Allah, then she will be ruined?’ He said: ‘So the Prophet smiled.’ He said: ‘So I said to Hafsah: “Do not talk back to the Messenger of Allah, and don’t ask him for anything. Ask me for whatever you want. And do not be tempted by the behavior of your companions, for she is more beautiful than you, and more loved by the Messenger of Allah.’” He said: ‘So he smiled again, I said: “O Messenger of Allah! May I speak candidily?” He said: “Yes.’” He said: ‘I raised my head and did not see in the house except for three hides. So I said: “O Messenger of Allah! Supplicate to Allah to make your followers prosperous. For verily, He has made the Persians and the Romans prosper, and they do not worship Him.” He then sat up and said: “Do you have some doubts O Ibn Al-Khattab? They are a people whose good has been hastened for them in this world’s life.’” He said: ‘He swore that he would not enter upon his women for a month. So Allah censured him for that, and he made the atonement of an oath.’” Az-Zuhri said: “Urwah informed me that Aishah said: “When twenty-nine days passed, the Prophet entered upon me first, and he said: “O Aishah! I am about to mention something to you, but do not be hasty in reply until you consult your parents.’” She said: ‘Then he recited this Ayah: “O Prophet! Say to your wives.” She said: ‘I knew by Allah! That my parents would not tell me to part with him.’ She said: ‘I said: “Is it about this that I should consult with my parents? Indeed I want Allah and His Messenger and the abode of the Hereafter.” Ma’mar (one of the narrators) said: “Ayyub informed me that Aishah said to him: ‘O Messenger of Allah! Do not inform your wives that I chose you.’ So the Prophet said: ‘Allah send me only as one who conveys (Muballigh), He did not send me as one causing hardship.’”

Malik related to me that he heard the like of that from Sulayman ibn Yasar.

Malik spoke about a man who bought out one of the partners in a shared property, by paying the man with an animal, a slave, a slave-girl, or the equivalent of that in goods. Then another partner decided to exercise his right of pre-emption after that, and he found that the slave or slave-girl had died, and no one knew what her value had been. The buyer claimed, "The value of the slave or slave-girl was 100 dinars." The partner with the right of pre-emption claimed, "The value was 50 dinars."

Malik said, "The buyer takes an oath that the value of what he payed was 100 dinars. Then if the one with the right of pre-emption wishes, he can compensate him, or else he can leave it, unless he can bring a clear proof that the slave or slave-girl's value is less than what the buyer said. If someone gives away his portion of a shared house or land and the recipient repays him for it by cash or goods, the partners can take it by pre-emption if they wish and pay off the recipient the value of what he gave in dinars or dirhams. If someone makes a gift of his portion of a shared house or land, and does not take any remuneration and does not seek to, and a partner wants to take it for its value, he cannot do so as long as the original partner has not been given recompense for it. If there is any recompense, the one with the right of pre-emption can have it for the price of the recompense."

Malik spoke about a man who bought into a piece of shared land for a price on credit, and one of the partners wanted to possess it by right of pre-emption . Malik said, "If it seems likely that the partner can meet the terms, he has right of pre-emption for the same credit terms. If it is feared that he will not be able to meet the terms, but he can bring a wealthy and reliable guarantor of equal standing to the one who bought into the land, he can also take possession."

Malik said, "A person's absence does not sever his right of pre-emption. Even if he is a way for a long time, there is no time limit after which the right of preemption is cut off."

Malik said that if a man left land to a number of his children, then one of them who had a child died and the child of the deceased sold his right in that land, the brother of the seller was more entitled to pre-empt him than his paternal uncles, the partners of his father.

Malik said, "This is what is done in our community."

Malik said, "Pre- emption is shared between partners according to their existing shares. Each of them takes according to his portion. If it is small, he has little. If it is great, it is according to that. That is if they are tenacious and contend with each other about it."

Malik said, "As for a man who buys out the share of one of his partners, and one of the other partners says, 'I will take a portion according to my share,' and the first partner says, 'If you wish to take all the preemption, I will give it up to you. If you wish to leave it, then leave it.' If the first partner gives him the choice and hands it over to him, the second partner can only take all the pre-emption or give it back. If he takes it, he is entitled to it. If not, he has nothing."

Malik spoke about a man who bought land, and developed it by planting trees or digging a well etc., and then someone came, and seeing that he had a right in the land, wanted to take possession of it by pre-emption. Malik said "He has no right of preemption unless he compensates the other for his expenditure. If he gives him the price of what he has developed, he is entitled to pre- emption . If not, he has no right in it."

Malik said that someone who sold off his portion of a shared house or land and then, on learning that some one with a right of pre-emption was to take possession by that right, asked the buyer to revoke the sale, and he did so, did not have the right to do that. The pre-emptor has more right to the property for the price for which he sold it.

In the case of some one who bought along with a section of a shared house or land, an animal and goods (that were not shared), so that when any one demanded his right of pre-emption in the house or land he said, "Take what I have bought altogether, for I bought it altogether," Malik said, "The pre-emptor need only take possession of the house or land. Each thing the man bought is assessed according to its share of the lump sum the man paid. Then the pre-emptor takes possession of his right for a price which is appropriate on that basis. He does not take any animals or goods unless he wants to do that."

Malik said, "If someone sells a section of shared land, and one of those who have the right of preemption surrenders it to the buyer and another refuses to do other than take his pre-emption, the one who refuses to surrender has to take all the preemption, and he cannot take according to his right and leave what remains.

In the case where one of a number of partners in one house sold his share when all his partners were away except for one man, the one present was given the choice of either taking the pre-emption or leaving it, and he said, 'I will take my portion and leave the portions of my partners until they are present. If they take it, that is that. If they leave it, I will take all the pre-emption,' Malik said, 'He can only take it all or leave it. If his partners come, they can take from him or leave it as they wish. If this is offered to him and he does not accept, I think that he has no pre-emption.' "
