Sahih Muslim 581 a

Abu Ma'mar reported:

There was an Amir in Mecca who pronounced taslim twice. Abdullah said: Where did he get this sunnah? Al-Hakam said: There is a hadith to the effect that the Messenger of Allah (may peace be upon him) did like It.

It was narrated from Tha'labah bin Zahdam that:
'Ali appointed Abu Mas'ud over the people, then went out on the day of 'Eid and said: 'O people, it is not part of the sunnah to pray before the imam.'"

Yahya related to me from Malik from Nafi from Abdullah ibn Umar that Hafsa, the wife of the Prophet, may Allah bless him and grant him peace, told him that the Messenger of Allah, may Allah bless him and grant him peace, used to pray two quick rakas when the muadhdhin had finished the adhan for the subh prayer, before the iqama was said for the prayer.

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّ حَفْصَةَ، زَوْجَ النَّبِيِّ صلى الله عليه وسلم أَخْبَرَتْهُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَ إِذَا سَكَتَ الْمُؤَذِّنُ عَنِ الأَذَانِ لِصَلاَةِ الصُّبْحِ صَلَّى رَكْعَتَيْنِ خَفِيفَتَيْنِ قَبْلَ أَنْ تُقَامَ الصَّلاَةُ ‏.‏

It was narrated from Salim, from his father that the Prophet said:
"Whoever buys a date-palm tree after it has been pollinated, its fruits belong to the seller, unless the purchaser has stipulated otherwise. And whoever buys a slave who has wealth, his wealth belongs to the seller, unless the purchaser has stipulated otherwise. "(sahih)

It was narrated that 'Aishah said:
"If the Messenger of Allah (PBUH) wanted to sleep while he was Junub, he would perform Wudu' as for prayer before sleeping."

It was narrated that ‘Aishah said:
“The wives of the Prophet (SAW) gathered together and not one of them lagged behind. Fatimah came, and her gait was like that of the Messenger of Allah (SAW). He said, ‘Welcome to my daughter.’ Then he made her sit to his left, and he whispered something to her, and she smiled. I said to her: ‘What made you weep?’ She said: ‘I will not disclose the secret of the Messenger of Allah (SAW).’ I said: ‘I never saw joy so close to grief as I saw today.’ When she wept I said: ‘Did the Messenger of Allah (SAW) tell you some special words that were not for us, then you wept?’ And I asked her about what he had said. She said: ‘I will not disclose the secret of the Messenger of Allah (SAW).’ After he died I asked her what he had said, and she said: ‘He told me that Jibra’il used to review the Qur’an with him once each year, but he had reviewed it with him twice that year, (and he said:) “I do not think but that my time is near. You will be the first of my family to join me, and what a good predecessor I am for you.” So I wept. Then he whispered to me and said: “Will you not be pleased to be the leader of the women of this Ummah?” So I smiled.’”
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ نُمَيْرٍ، عَنْ زَكَرِيَّا، عَنْ فِرَاسٍ، عَنْ عَامِرٍ، عَنْ مَسْرُوقٍ، عَنْ عَائِشَةَ، قَالَتِ اجْتَمَعْنَ نِسَاءُ النَّبِيِّ ـ صلى الله عليه وسلم ـ فَلَمْ تُغَادِرْ مِنْهُنَّ امْرَأَةٌ فَجَاءَتْ فَاطِمَةُ كَأَنَّ مِشْيَتَهَا مِشْيَةُ رَسُولِ اللَّهِ ـ صلى الله عليه وسلم ـ فَقَالَ: ‏"‏ مَرْحَبًا بِابْنَتِي ‏"‏ ‏.‏ ثُمَّ أَجْلَسَهَا عَنْ شِمَالِهِ ثُمَّ إِنَّهُ أَسَرَّ إِلَيْهَا حَدِيثًا فَبَكَتْ فَاطِمَةُ. ثُمَّ إِنَّهُ سَارَّهَا. فَضَحِكَتْ أَيْضًا فَقُلْتُ لَهَا: مَا يُبْكِيكِ؟ قَالَتْ: مَا كُنْتُ لأُفْشِيَ سِرَّ رَسُولِ اللَّهِ ـ صلى الله عليه وسلم ـ ‏.‏ فَقُلْتُ: مَا رَأَيْتُ كَالْيَوْمِ فَرَحًا أَقْرَبَ مِنْ حُزْنٍ ‏.‏ فَقُلْتُ لَهَا حِينَ بَكَتْ: أَخَصَّكِ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ بِحَدِيثٍ دُونَنَا ثُمَّ تَبْكِينَ؟ وَسَأَلْتُهَا عَمَّا قَالَ ‏.‏ فَقَالَتْ: مَا كُنْتُ لأُفْشِيَ سِرَّ رَسُولِ اللَّهِ -صلى الله عليه وسلم - ‏.‏ حَتَّى إِذَا قُبِضَ سَأَلْتُهَا عَمَّا قَالَ. فَقَالَتْ: إِنَّهُ كَانَ يُحَدِّثُنِي أَنَّ جِبْرَائِيلَ كَانَ يُعَارِضُهُ بِالْقُرْآنِ فِي كُلِّ عَامٍ مَرَّةً وَأَنَّهُ عَارَضَهُ بِهِ الْعَامَ مَرَّتَيْنِ ‏"‏ وَلاَ أُرَانِي إِلاَّ قَدْ حَضَرَ أَجَلِي وَأَنَّكِ أَوَّلُ أَهْلِي لُحُوقًا بِي وَنِعْمَ السَّلَفُ أَنَا لَكِ ‏"‏ ‏.‏ فَبَكَيْتُ ثُمَّ إِنَّهُ سَارَّنِي فَقَالَ: ‏"‏ أَلاَ تَرْضَيْنَ أَنْ تَكُونِي سَيِّدَةَ نِسَاءِ الْمُؤْمِنِينَ - أَوْ نِسَاءِ هَذِهِ الأُمَّةِ - ‏"‏ ‏.‏ فَضَحِكْتُ لِذَلِكَ ‏.‏

It was narrated from Salim from his father that whilst ‘Umar bin al Khattab was addressing the people on a Friday, one of the companions of the Messenger of Allah ﷺ came in, 'Umar called out to him:
What time is this? He said: I was busy today and I did not go back to my family when I heard the call to prayer, so I did no more than doing wudoo’. ʼUmar said: Just wudooʼ, when you know that the Messenger of Allah (ﷺ) used to enjoin ghus!?
حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ سَالِمٍ، عَنْ أَبِيهِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللَّهُ عَنْهُ بَيْنَا هُوَ قَائِمٌ يَخْطُبُ يَوْمَ الْجُمُعَةِ فَدَخَلَ رَجُلٌ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَنَادَاهُ عُمَرُ رَضِيَ اللَّهُ عَنْهُ أَيَّةُ سَاعَةٍ هَذِهِ فَقَالَ إِنِّي شُغِلْتُ الْيَوْمَ فَلَمْ أَنْقَلِبْ إِلَى أَهْلِي حَتَّى سَمِعْتُ النِّدَاءَ فَلَمْ أَزِدْ عَلَى أَنْ تَوَضَّأْتُ فَقَالَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ الْوُضُوءَ أَيْضًا وَقَدْ عَلِمْتُمْ وَفِي مَوْضِعٍ آخَرَ وَقَدْ عَلِمْتَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَأْمُرُ بِالْغُسْلِ‏.‏

I heard Allah's Messenger (may peace be upon him) as saying: So far as Lailat-ul-Qadr is concerned. some persons among you have seen it (in a dream) in the first week and some persons among you have been shown that it is in the last week; so seek it in the last ten (nights).
وَحَدَّثَنِي حَرْمَلَةُ بْنُ يَحْيَى، أَخْبَرَنَا ابْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، أَخْبَرَنِي سَالِمُ بْنُ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّ أَبَاهُ، - رضى الله عنه - قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ لِلَيْلَةِ الْقَدْرِ ‏ "‏ إِنَّ نَاسًا مِنْكُمْ قَدْ أُرُوا أَنَّهَا فِي السَّبْعِ الأُوَلِ وَأُرِيَ نَاسٌ مِنْكُمْ أَنَّهَا فِي السَّبْعِ الْغَوَابِرِ فَالْتَمِسُوهَا فِي الْعَشْرِ الْغَوَابِرِ ‏"‏ ‏.‏

It was narrated that Ibn ‘Abbas said:
Duba’ah bint Zubair bin ‘Abdul- Muttalib came to the Messenger of Allah (saw) and said: “I am a heavy woman and I want to go for Hajj. How should I enter Ihram?” He said: “Enter Ihram and stipulate the condition that you will exit Ihram from the point where you are prevented.”
حَدَّثَنَا أَبُو بِشْرٍ، بَكْرُ بْنُ خَلَفٍ حَدَّثَنَا أَبُو عَاصِمٍ، عَنِ ابْنِ جُرَيْجٍ، أَخْبَرَنِي أَبُو الزُّبَيْرِ، أَنَّهُ سَمِعَ طَاوُسًا، وَعِكْرِمَةَ، يُحَدِّثَانِ عَنِ ابْنِ عَبَّاسٍ، قَالَ جَاءَتْ ضُبَاعَةُ بِنْتُ الزُّبَيْرِ بْنِ عَبْدِ الْمُطَّلِبِ رَسُولَ اللَّهِ ـ صلى الله عليه وسلم ـ فَقَالَتْ إِنِّي امْرَأَةٌ ثَقِيلَةٌ وَإِنِّي أُرِيدُ الْحَجَّ فَكَيْفَ أُهِلُّ قَالَ ‏ "‏ أَهِلِّي وَاشْتَرِطِي أَنَّ مَحِلِّي حَيْثُ حَبَسْتَنِي ‏"‏ ‏.‏

Riyad as-Salihin 375
Anas bin Malik (May Allah be pleased with him) reported:
The Prophet (PBUH) said, "There are three qualities whoever has them, will taste the sweetness of Iman: To love Allah and His Messenger (PBUH) more than anyone else; to love a slave (of Allah) only for (the sake of) Allah; and to abhor returning to infidelity after Allah has saved him from it as he would abhor to be thrown into the fire (of Hell)".

وعن أنس رضي الله عنه عن النبي صلى الله عليه وسلم قال‏:‏ ‏ "‏ثلاث من كن فيه وجد بهن حلاوة الإيمان‏:‏ أن يكون الله ورسوله أحب إليه مما سواهما، وأن يحب المرء لا يحبه إلا لله، وأن يكره أن يعود في الكفر بعد أن أنقذه الله منه، كما يكره أن يقذف في النار‏"‏ ‏(‏‏(‏متفق عليه‏)‏‏)‏ ‏.‏

Narrated Abu Sa'id Al Khudri:
Allah's Messenger (saws) said, "If a person embraces Islam sincerely, then Allah shall forgive all his past sins, and after that starts the settlement of accounts, the reward of his good deeds will be ten times to seven hundred times for each good deed and one evil deed will be recorded as it is unless Allah forgives it."
قَالَ مَالِكٌ أَخْبَرَنِي زَيْدُ بْنُ أَسْلَمَ، أَنَّ عَطَاءَ بْنَ يَسَارٍ، أَخْبَرَهُ أَنَّ أَبَا سَعِيدٍ الْخُدْرِيَّ أَخْبَرَهُ أَنَّهُ، سَمِعَ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ إِذَا أَسْلَمَ الْعَبْدُ فَحَسُنَ إِسْلاَمُهُ يُكَفِّرُ اللَّهُ عَنْهُ كُلَّ سَيِّئَةٍ كَانَ زَلَفَهَا، وَكَانَ بَعْدَ ذَلِكَ الْقِصَاصُ، الْحَسَنَةُ بِعَشْرِ أَمْثَالِهَا إِلَى سَبْعِمِائَةِ ضِعْفٍ، وَالسَّيِّئَةُ بِمِثْلِهَا إِلاَّ أَنْ يَتَجَاوَزَ اللَّهُ عَنْهَا ‏"‏‏.‏

Yahya related to me from Malik from Nafi that Abdullah ibn Umar said that the Messenger of Allah, may Allah bless him and grant him peace, said, "When you die, your place will be shown to you in the morning and the evening. If you are one of the people of the Garden, then you will be with the people of the Garden, and if you are one of the people of the Fire, then you will be with the people of the Fire. You will be told, 'This is your place of waiting until Allah raises you on the day of rising.' "

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ، قَالَ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ إِنَّ أَحَدَكُمْ إِذَا مَاتَ عُرِضَ عَلَيْهِ مَقْعَدُهُ بِالْغَدَاةِ وَالْعَشِيِّ إِنْ كَانَ مِنْ أَهْلِ الْجَنَّةِ فَمِنْ أَهْلِ الْجَنَّةِ وَإِنْ كَانَ مِنْ أَهْلِ النَّارِ فَمِنْ أَهْلِ النَّارِ يُقَالُ لَهُ هَذَا مَقْعَدُكَ حَتَّى يَبْعَثَكَ اللَّهُ إِلَى يَوْمِ الْقِيَامَةِ ‏"‏ ‏.‏

It was narrated that 'Abdullah said:
"I said: 'O Messenger of Allah, which sin is most grievous?' He said: 'Setting up a rival to Allah while it is He that created you.' I said: 'Then what?' He said: 'Killing your child so that he will not eat with you.' I said: 'Then what?' He said: 'Committing adultery with your neighbor's wife.'"

Nubaih b Wahb reported that the eyes of Umar b. Ubaidnllah b. Ma'mar were swollen, and he decided to use antimony. Aban b. 'Uthman forbade him to do so and commanded him to apply aloes on them, and reported on the authority of 'Uthman b. Affan that the Apostle of Allah (may peace be upon him) had done that.

Narrated Sa`d (bin Abi Waqqas):

Allah's Apostle distributed something (from the resources of Zakat) amongst a group of people while I was sitting amongst them, but he left a man whom I considered the best of the lot. So, I went up to Allah's Apostle and asked him secretly, "Why have you left that person? By Allah! I consider him a believer." The Prophet said, "Or merely a Muslim (Who surrender to Allah)." I remained quiet for a while but could not help repeating my question because of what I knew about him. I said, "O Allah's Apostle! Why have you left that person? By Allah! I consider him a believer. " The Prophet said, "Or merely a Muslim." I remained quiet for a while but could not help repeating my question because of what I knew about him. I said, "O Allah's Apostle! Why have you left that person? By Allah! I consider him a believer." The Prophet said, "Or merely a Muslim." Then Allah's Apostle (p.b.u.h) said, "I give to a person while another is dearer to me, for fear that he may be thrown in the Hell-fire on his face (by reneging from Islam)."

حَدَّثَنَا مُحَمَّدُ بْنُ غُرَيْرٍ الزُّهْرِيُّ، حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ، عَنْ أَبِيهِ، عَنْ صَالِحِ بْنِ كَيْسَانَ، عَنِ ابْنِ شِهَابٍ، قَالَ أَخْبَرَنِي عَامِرُ بْنُ سَعْدٍ، عَنْ أَبِيهِ، قَالَ أَعْطَى رَسُولُ اللَّهِ صلى الله عليه وسلم رَهْطًا وَأَنَا جَالِسٌ فِيهِمْ قَالَ فَتَرَكَ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْهُمْ رَجُلاً لَمْ يُعْطِهِ، وَهُوَ أَعْجَبُهُمْ إِلَىَّ، فَقُمْتُ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَارَرْتُهُ فَقُلْتُ مَا لَكَ عَنْ فُلاَنٍ وَاللَّهِ إِنِّي لأُرَاهُ مُؤْمِنًا‏.‏ قَالَ ‏"‏ أَوْ مُسْلِمًا ‏"‏ قَالَ فَسَكَتُّ قَلِيلاً ثُمَّ غَلَبَنِي مَا أَعْلَمُ فِيهِ فَقُلْتُ يَا رَسُولَ اللَّهِ‏.‏ مَا لَكَ عَنْ فُلاَنٍ وَاللَّهِ إِنِّي لأُرَاهُ مُؤْمِنًا‏.‏ قَالَ ‏"‏ أَوْ مُسْلِمًا ‏"‏‏.‏ قَالَ فَسَكَتُّ قَلِيلاً ثُمَّ غَلَبَنِي مَا أَعْلَمُ فِيهِ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا لَكَ عَنْ فُلاَنٍ وَاللَّهِ إِنِّي لأُرَاهُ مُؤْمِنًا‏.‏ قَالَ ‏"‏ أَوْ مُسْلِمًا ـ يَعْنِي فَقَالَ ـ إِنِّي لأُعْطِي الرَّجُلَ وَغَيْرُهُ أَحَبُّ إِلَىَّ مِنْهُ، خَشْيَةَ أَنْ يُكَبَّ فِي النَّارِ عَلَى وَجْهِهِ ‏"‏‏.‏ وَعَنْ أَبِيهِ عَنْ صَالِحٍ عَنْ إِسْمَاعِيلَ بْنِ مُحَمَّدٍ أَنَّهُ قَالَ سَمِعْتُ أَبِي يُحَدِّثُ هَذَا فَقَالَ فِي حَدِيثِهِ فَضَرَبَ رَسُولُ اللَّهِ صلى الله عليه وسلم بِيَدِهِ فَجَمَعَ بَيْنَ عُنُقِي وَكَتِفِي ثُمَّ قَالَ ‏"‏ أَقْبِلْ أَىْ سَعْدُ إِنِّي لأُعْطِي الرَّجُلَ ‏"‏‏.‏ قَالَ أَبُو عَبْدِ اللَّهِ ‏{‏فَكُبْكِبُوا‏}‏ قُلِبُوا ‏{‏مُكِبًّا‏}‏ أَكَبَّ الرَّجُلُ إِذَا كَانَ فِعْلُهُ غَيْرَ وَاقِعٍ عَلَى أَحَدٍ، فَإِذَا وَقَعَ الْفِعْلُ قُلْتَ كَبَّهُ اللَّهُ لِوَجْهِهِ، وَكَبَبْتُهُ أَنَا‏.‏

Abdullah b. Mas'ud reported:

The Messenger of Allah (may peace be upon him) addressing us said: Aren't you pleased that you should constitute one-fourth of the inhabitants of Paradise? He (the narrator) said: We glorified (our Lord, i. e. we called aloud Allah-o Akbar, Allah is the Greatest). He, then, again said: Aren't you pleased that you should constitute one-third of the inhabitants of Paradise? He (the narrator) said: We glorified (our Lord) and he (the Holy Prophet) then again said: I hope that you would constitute half of the inhabitants of Paradise and I shall explain to you its (reason). The believers among the unbelievers would not be more than a white hair on (the body of a) black ox or a black hair on (the body of a) white ox.

It was narrated from `Uthman bin `Affan (رضي الله عنه). `Abdullah bin az-Zubair said to him when he was besieged:
I have camels that I have prepared for you; do you want to go to Makkah, then whoever wants to see you can come and see you? He said: No, I heard the Messenger of Allah (ﷺ) say: `A ram of Quraish whose name is ‘Abdullah will seek to commit profanity and wrongdoing in Makkah; he will have half of the burden of mankind`s sins.”

Malik related to me from Yahya ibn Said from Sulayman ibn Yasar from Abu Waqid al-Laythi that a man came to Umar ibn al-Khattab while he was in ash-Sham . He mentioned to him that he had found a man with his wife Umar sent Abu Waqid al-Laythi to the wife to question her about that. He came to her while there were women around her and mentioned to her what her husband had mentioned to Umar ibn al- Khattab, and informed her that she would not be punished on his word and began to suggest to her by that, that she should retract. She refused to retract and held firm to confession. Umar gave the order and she was stoned.

حَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ أَبِي وَاقِدٍ اللَّيْثِيِّ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، أَتَاهُ رَجُلٌ وَهُوَ بِالشَّامِ فَذَكَرَ لَهُ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً فَبَعَثَ عُمَرُ بْنُ الْخَطَّابِ أَبَا وَاقِدٍ اللَّيْثِيَّ إِلَى امْرَأَتِهِ يَسْأَلُهَا عَنْ ذَلِكَ فَأَتَاهَا وَعِنْدَهَا نِسْوَةٌ حَوْلَهَا فَذَكَرَ لَهَا الَّذِي قَالَ زَوْجُهَا لِعُمَرَ بْنِ الْخَطَّابِ وَأَخْبَرَهَا أَنَّهَا لاَ تُؤْخَذُ بِقَوْلِهِ وَجَعَلَ يُلَقِّنُهَا أَشْبَاهَ ذَلِكَ لِتَنْزِعَ فَأَبَتْ أَنْ تَنْزِعَ وَتَمَّتْ عَلَى الاِعْتِرَافِ فَأَمَرَ بِهَا عُمَرُ فَرُجِمَتْ ‏.‏

Yahya related to me from Malik from Zayd ibn Aslam from Ata ibn Yasar that the Messenger of Allah, may Allah bless him and grant him peace, said, "When the slave is ill, Allah ta'ala sends two angels to him." He said, "They look at what he says to his visitors. If he praises Allah and lauds Him, when they come to him, they take that up to Allah, the Mighty, the Majestic, and He knows best, and He says, 'If I make my slave die, I will make him enter the Garden. If I heal him, I will replace his flesh with better flesh and his blood with better blood and I will efface his evil actions.'"

حَدَّثَنِي عَنْ مَالِكٍ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ إِذَا مَرِضَ الْعَبْدُ بَعَثَ اللَّهُ تَعَالَى إِلَيْهِ مَلَكَيْنِ فَقَالَ انْظُرَا مَاذَا يَقُولُ لِعُوَّادِهِ ‏.‏ فَإِنْ هُوَ - إِذَا جَاءُوهُ - حَمِدَ اللَّهَ وَأَثْنَى عَلَيْهِ رَفَعَا ذَلِكَ إِلَى اللَّهِ عَزَّ وَجَلَّ - وَهُوَ أَعْلَمُ - فَيَقُولُ لِعَبْدِي عَلَىَّ إِنْ تَوَفَّيْتُهُ أَنْ أُدْخِلَهُ الْجَنَّةَ وَإِنْ أَنَا شَفَيْتُهُ أَنْ أُبْدِلَ لَهُ لَحْمًا خَيْرًا مِنْ لَحْمِهِ وَدَمًا خَيْرًا مِنْ دَمِهِ وَأَنْ أُكَفِّرَ عَنْهُ سَيِّئَاتِهِ ‏"‏ ‏.‏

Entered upon her and there were two girls with her beating the duff and singing, and the Messenger of Allah (SAW) was covered with his garment. He uncovered his face and said: "Let them be there, O Abu Bakr, for these are the days of 'Eid." Those were the days of Mina and the Messenger of Allah (SAW) was in Al-Madinah on that day."

‘Abd Allah bin Umar said that he divorced his wife while she was menstruating during the time of the Apostle of Allaah(saws). So ‘Umar bin Al Khattab asked the Apostle of Allaah(saws) about this matter. The Apostle of Allaah(saws) said “Order him, he must take her back and keep her back till she is purified, then has another menstrual period and is purified. Thereafter if he desires he may divorce her before having intercourse with her, for that is the period of waiting which Allaah the Glorified has commanded for the divorce of women.”
حَدَّثَنَا الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّهُ طَلَّقَ امْرَأَتَهُ وَهِيَ حَائِضٌ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلَ عُمَرُ بْنُ الْخَطَّابِ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْ ذَلِكَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ مُرْهُ فَلْيُرَاجِعْهَا ثُمَّ لْيُمْسِكْهَا حَتَّى تَطْهُرَ ثُمَّ تَحِيضَ ثُمَّ تَطْهُرَ ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدَ ذَلِكَ وَإِنْ شَاءَ طَلَّقَ قَبْلَ أَنْ يَمَسَّ فَتِلْكَ الْعِدَّةُ الَّتِي أَمَرَ اللَّهُ سُبْحَانَهُ أَنْ تُطَلَّقَ لَهَا النِّسَاءُ ‏"‏ ‏.‏

Sunan Ibn Majah 2084
It was narrated from Humaid bin Nafi' that:
he heard Zainab the daughter of Umm Salamah narrating that she heard Umm Salamah and Umm Habibah mention that a woman came to the Prophet (SAW) and said that her daughter's husband had died, and she was suffering from an eye disease, and she wanted to apply kohl to her eyes (as a remedy). The Messenger of Allah (SAW) said: "One of you would throw a she-camel's dropping when a year had passed (since the death of her husband. Rather it is four months and ten (days)."
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، أَنْبَأَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ حُمَيْدِ بْنِ نَافِعٍ، ‏.‏ أَنَّهُ سَمِعَ زَيْنَبَ ابْنَةَ أُمِّ سَلَمَةَ، تُحَدِّثُ أَنَّهَا سَمِعَتْ أُمَّ سَلَمَةَ، وَأُمَّ حَبِيبَةَ تَذْكُرَانِ أَنَّ امْرَأَةً أَتَتِ النَّبِيَّ ـ صلى الله عليه وسلم ـ فَقَالَتْ إِنَّ ابْنَةً لَهَا تُوُفِّيَ عَنْهَا زَوْجُهَا فَاشْتَكَتْ عَيْنُهَا فَهِيَ تُرِيدُ أَنْ تَكْحَلَهَا ‏.‏ فَقَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ "‏ قَدْ كَانَتْ إِحْدَاكُنَّ تَرْمِي بِالْبَعْرَةِ عِنْدَ رَأْسِ الْحَوْلِ وَإِنَّمَا هِيَ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ‏"‏ ‏.‏

Malik related to me from Ibn Shihab from Said ibn al-Musayyab that Uthman ibn Affan said, "If someone gives something to his small child who is not old enough to look after it himself, and in order that his gift might be permitted he makes the gift public and has it witnessed, the gift is permitted, even if the father keeps charge of it."

Malik said, "What is done in our community is that if a man gives his small child some gold or silver and then dies and he has it in his own keeping, the child has none of it unless the father set it aside in coin or placed it with a man to keep for the son. If he does that, it is permitted for the son."

حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ عُثْمَانَ بْنَ عَفَّانَ، قَالَ مَنْ نَحَلَ وَلَدًا لَهُ صَغِيرًا لَمْ يَبْلُغْ أَنْ يَحُوزَ نُحْلَهُ فَأَعْلَنَ ذَلِكَ لَهُ وَأَشْهَدَ عَلَيْهَا فَهِيَ جَائِزَةٌ وَإِنْ وَلِيَهَا أَبُوهُ ‏.‏ قَالَ مَالِكٌ الأَمْرُ عِنْدَنَا أَنَّ مَنْ نَحَلَ ابْنًا لَهُ صَغِيرًا ذَهَبًا أَوْ وَرِقًا ثُمَّ هَلَكَ وَهُوَ يَلِيهِ إِنَّهُ لاَ شَىْءَ لِلاِبْنِ مِنْ ذَلِكَ إِلاَّ أَنْ يَكُونَ الأَبُ عَزَلَهَا بِعَيْنِهَا أَوْ دَفَعَهَا إِلَى رَجُلٍ وَضَعَهَا لاِبْنِهِ عِنْدَ ذَلِكَ الرَّجُلِ فَإِنْ فَعَلَ ذَلِكَ فَهُوَ جَائِزٌ لِلاِبْنِ ‏.‏

`Aisha added, "I argued with Allah's Apostle repeatedly about that matter (i.e. his order that Abu Bakr should lead the people in prayer in his place when he was ill), and what made me argue so much, was, that it never occurred to my mind that after the Prophet, the people would ever love a man who had taken his place, and I felt that anybody standing in his place, would be a bad omen to the people, so I wanted Allah's Apostle to give up the idea of choosing Abu Bakr (to lead the people in prayer).
أَخْبَرَنِي عُبَيْدُ اللَّهِ، أَنَّ عَائِشَةَ، قَالَتْ لَقَدْ رَاجَعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فِي ذَلِكَ، وَمَا حَمَلَنِي عَلَى كَثْرَةِ مُرَاجَعَتِهِ إِلاَّ أَنَّهُ لَمْ يَقَعْ فِي قَلْبِي أَنْ يُحِبَّ النَّاسُ بَعْدَهُ رَجُلاً قَامَ مَقَامَهُ أَبَدًا، وَلاَ كُنْتُ أُرَى أَنَّهُ لَنْ يَقُومَ أَحَدٌ مَقَامَهُ إِلاَّ تَشَاءَمَ النَّاسُ بِهِ، فَأَرَدْتُ أَنْ يَعْدِلَ ذَلِكَ رَسُولُ اللَّهِ صلى الله عليه وسلم عَنْ أَبِي بَكْرٍ‏.‏ رَوَاهُ ابْنُ عُمَرَ وَأَبُو مُوسَى وَابْنُ عَبَّاسٍ ـ رضى الله عنهم ـ عَنِ النَّبِيِّ صلى الله عليه وسلم‏.‏

While I was sitting in the company of Ibn 'Umar, a person came to him and said: Is it right for me to circumambulate the House before I come to stay (at 'Arafat)? Ibn 'Umar said: Yes. whereupon he said: Ibn Abbas, however, says: Do not circumambulate the House until you come to stay at 'Arafat. Thereupon Ibn 'Umar said: Allah's Messenger (may peace be upon him) Performed the Hajj and circumambulated the House before coming to stay (at 'Arafat). If you say the Truth, is it more rightful to follow the saying of the Prophet (may peace be upon him) or the words of Ibn Abbas?
حَدَّثَنَا يَحْيَى بْنُ يَحْيَى، أَخْبَرَنَا عَبْثَرٌ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي خَالِدٍ، عَنْ وَبَرَةَ، قَالَ كُنْتُ جَالِسًا عِنْدَ ابْنِ عُمَرَ فَجَاءَهُ رَجُلٌ فَقَالَ أَيَصْلُحُ لِي أَنْ أَطُوفَ بِالْبَيْتِ قَبْلَ أَنْ آتِيَ الْمَوْقِفَ ‏.‏ فَقَالَ نَعَمْ ‏.‏ فَقَالَ فَإِنَّ ابْنَ عَبَّاسٍ يَقُولُ لاَ تَطُفْ بِالْبَيْتِ حَتَّى تَأْتِيَ الْمَوْقِفَ ‏.‏ فَقَالَ ابْنُ عُمَرَ فَقَدْ حَجَّ رَسُولُ اللَّهِ صلى الله عليه وسلم فَطَافَ بِالْبَيْتِ قَبْلَ أَنْ يَأْتِيَ الْمَوْقِفَ فَبِقَوْلِ رَسُولِ اللَّهِ صلى الله عليه وسلم أَحَقُّ أَنْ تَأْخُذَ أَوْ بِقَوْلِ ابْنِ عَبَّاسٍ إِنْ كُنْتَ صَادِقًا

We were sitting at the door of Abdullah (b. Mas'ud) waiting for him (to come out and deliver a sermon to us). It was at this time that there happened to pass by us Yazid b. Mu'awiya an-Nakha'i. We said: Inform him ('Abdullah b. Mas'ud) of our presence here. He went in and Abdullah b. Mas'ud lost no time in coming out to us and said: I was informed of your presence here but nothing hindered me to come out to you but the fact that I did not like to bore you (by stuffing your minds with sermons) as Allah's Messenger (may peace be upon him) did not deliver us sermon on certain days fearing that it might prove to be boring for us.

Sa'id ibn Abi Waqqas said:
"Four ayats were revealed about me. The first was when my mother swore she would neither eat nor drink until I left Muhammad, may Allah bless him and grant him peace. Allah Almighty revealed, 'But if they try to make you associate something with Me about which you have no knowledge, do not obey them. Keep company with them correctly and courteously in this world' (31:15) The second was when I took a sword that I admired and said, 'Messenger of Allah, give me this!' Then the ayat was revealed: 'They will ask you about booty.' (8:1) The third was when I was ill and the Messenger of Allah, may Allah bless him and grant him peace, came to me and I said, 'Messenger of Allah, I want to divide my property. Can I will away a half?' He said, 'No.' 'A third?' I asked. He was silent and so after that it was allowed to will away a third. The fourth was when I had been drinking wine with some of the Ansar. One of them hit my nose with the jawbone of a camel. I went to the Prophet, may Allah bless him and grant him peace, and Allah Almighty revealed the prohibition of wine."
حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، قَالَ‏:‏ حَدَّثَنَا إِسْرَائِيلُ، قَالَ‏:‏ حَدَّثَنَا سِمَاكٌ، عَنْ مُصْعَبِ بْنِ سَعْدٍ، عَنْ أَبِيهِ سَعْدِ بْنِ أَبِي وَقَّاصٍ قَالَ‏:‏ نَزَلَتْ فِيَّ أَرْبَعُ آيَاتٍ مِنْ كِتَابِ اللهِ تَعَالَى‏:‏ كَانَتْ أُمِّي حَلَفَتْ أَنْ لاَ تَأْكُلَ وَلاَ تَشْرَبَ حَتَّى أُفَارِقَ مُحَمَّدًا صلى الله عليه وسلم، فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ‏:‏ ‏{‏وَإِنْ جَاهَدَاكَ عَلَى أَنْ تُشْرِكَ بِي مَا لَيْسَ لَكَ بِهِ عِلْمٌ فَلاَ تُطُعْهُمَا وَصَاحِبْهُمَا فِي الدُّنْيَا مَعْرُوفًا‏}‏‏.‏ وَالثَّانِيَةُ‏:‏ أَنِّي كُنْتُ أَخَذْتُ سَيْفًا أَعْجَبَنِي، فَقُلْتُ‏:‏ يَا رَسُولَ اللهِ، هَبْ لِي هَذَا، فَنَزَلَتْ‏:‏ ‏{‏يَسْأَلُونَكَ عَنِ الأَنْفَالِ‏}‏‏.‏ وَالثَّالِثَةُ‏:‏ أَنِّي مَرِضْتُ فَأَتَانِي رَسُولُ اللهِ صلى الله عليه وسلم، فَقُلْتُ‏:‏ يَا رَسُولَ اللهِ، إِنِّي أُرِيدُ أَنْ أَقْسِمَ مَالِي، أَفَأُوصِي بِالنِّصْفِ‏؟‏ فَقَالَ‏:‏ لاَ، فَقُلْتُ‏:‏ الثُّلُثُ‏؟‏ فَسَكَتَ، فَكَانَ الثُّلُثُ بَعْدَهُ جَائِزًا‏.‏ وَالرَّابِعَةُ‏:‏ إِنِّي شَرِبْتُ الْخَمْرَ مَعَ قَوْمٍ مِنَ الأَنْصَارِ، فَضَرَبَ رَجُلٌ مِنْهُمْ أَنْفِي بِلَحْيِ جَمَلٍ، فَأَتَيْتُ النَّبِيَّ صلى الله عليه وسلم فَأَنْزَلَ عَزَّ وَجَلَّ تَحْرِيمَ الْخَمْرِ‏.‏

Sa'id ibn al-'As reported that 'Uthman and 'A'isha told him that Abu Bakr asked for permission to come in to the Messenger of Allah, may Allah bless him and grant him peace, while he was lying of 'A'isha's bed, wearing 'A'isha's woollen shirt. He gave Abu Bakr permission to enter while he was like that. he gave him what he needed and then Abu Bakr left. Then 'Umar, may Allah be pleased with him, asked for permission to come in and he gave him permission to come in while he was like that. He gave him what he needed and then 'Umar left. 'Uthman said, "Then I asked for permission to come in and he sat up and told 'A'isha, 'Take your garment.' I told him what I needed and then I left.' 'A'isha asked, 'Messenger of Allah, why did I see that you did not do for Abu Bakr and 'Umar what you did for 'Uthman?' The Messenger of Allah, may Allah bless him and grant him peace, said, ''Uthman is a modest man and I feared that if I gave him permission to come in while I was in that state he would not tell me what he needed.'"
حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ اللهِ، قَالَ‏:‏ حَدَّثَنَا إِبْرَاهِيمُ بْنُ سَعْدٍ، عَنْ صَالِحٍ، عَنِ ابْنِ شِهَابٍ قَالَ‏:‏ أَخْبَرَنِي يَحْيَى بْنُ سَعِيدِ بْنِ الْعَاصِ، أَنَّ سَعِيدَ بْنَ الْعَاصِ أَخْبَرَهُ، أَنَّ عُثْمَانَ وَعَائِشَةَ، حَدَّثَاهُ، أَنَّ أَبَا بَكْرٍ اسْتَأْذَنَ عَلَى رَسُولِ اللهِ صلى الله عليه وسلم، وَهُوَ مُضْطَجِعٌ عَلَى فِرَاشِ عَائِشَةَ لاَبِسًا مِرْطَ عَائِشَةَ، فَأَذِنَ لأَبِي بَكْرٍ وَهُوَ كَذَلِكَ، فَقَضَى إِلَيْهِ حَاجَتَهُ، ثُمَّ انْصَرَفَ‏.‏ ثُمَّ اسْتَأْذَنَ عُمَرُ رَضِيَ اللَّهُ عَنْهُ، فَأَذِنَ لَهُ وَهُوَ كَذَلِكَ، فَقَضَى إِلَيْهِ حَاجَتَهُ، ثُمَّ انْصَرَفَ‏.‏ قَالَ عُثْمَانُ‏:‏ ثُمَّ اسْتَأْذَنْتُ عَلَيْهِ، فَجَلَسَ وَقَالَ لِعَائِشَةَ‏:‏ اجْمَعِي إِلَيْكِ ثِيَابَكِ، قَالَ‏:‏ فَقَضَيْتُ إِلَيْهِ حَاجَتِي، ثُمَّ انْصَرَفْتُ، قَالَ‏:‏ فَقَالَتْ عَائِشَةُ‏:‏ يَا رَسُولَ اللهِ، لَمْ أَرَكَ فَزِعْتَ لأَبِي بَكْرٍ وَعُمَرَ رَضِيَ اللَّهُ عَنْهُمَا كَمَا فَزِعْتَ لِعُثْمَانَ‏؟‏ قَالَ رَسُولُ اللهِ صلى الله عليه وسلم‏:‏ إِنَّ عُثْمَانَ رَجُلٌ حَيِيٌّ، وَإِنِّي خَشِيتُ إِنْ أَذِنْتُ لَهُ، وَأَنَا عَلَى تِلْكَ الْحَالِ، أَنْ لاَ يَبْلُغَ إِلَيَّ فِي حَاجَتِهِ‏.‏

Narrated Abu Huraira and Zaid bin Khalid:

Two men had a dispute in the presence of Allah's Apostle. One of them said, "O Allah's Apostle! Judge between us according to Allah's Laws." The other who was wiser, said, "Yes, O Allah's Apostle! Judge between us according to Allah's Laws and allow me to speak. The Prophet said, "Speak." He said, "My son was a laborer serving this (person) and he committed illegal sexual intercourse with his wife, The people said that my son is to be stoned to death, but I ransomed him with one-hundred sheep and a slave girl. Then I asked the learned people, who informed me that my son should receive one hundred lashes and will be exiled for one year, and stoning will be the lot for the man's wife." Allah's Apostle said, "Indeed, by Him in Whose Hand my soul is, I will judge between you according to Allah's Laws: As for your sheep and slave girl, they are to be returned to you." Then he scourged his son one hundred lashes and exiled him for one year. Then Unais Al- Aslami was ordered to go to the wife of the second man, and if she confessed (the crime), then stone her to death. She did confess, so he stoned her to death.

حَدَّثَنَا إِسْمَاعِيلُ، قَالَ حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ، أَنَّهُمَا أَخْبَرَاهُ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ‏.‏ وَقَالَ الآخَرُ وَهْوَ أَفْقَهُهُمَا أَجَلْ يَا رَسُولَ اللَّهِ فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ، وَائْذَنْ لِي أَنْ أَتَكَلَّمَ‏.‏ قَالَ ‏"‏ تَكَلَّمْ ‏"‏‏.‏ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا ـ قَالَ مَالِكٌ وَالْعَسِيفُ الأَجِيرُ ـ زَنَى بِامْرَأَتِهِ، فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَجَارِيَةٍ لِي، ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ، أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ عَلَيْكَ ‏"‏‏.‏ وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا، وَأُمِرَ أُنَيْسٌ الأَسْلَمِيُّ أَنْ يَأْتِيَ امْرَأَةَ الآخَرِ، فَإِنِ اعْتَرَفَتْ رَجَمَهَا، فَاعْتَرَفَتْ فَرَجَمَهَا‏.‏

Two men had a dispute in the presence of Allah's Apostle. One of them said, "Judge us according to Allah's Laws." The other who was more wise said, "Yes, Allah's Apostle, judge us according to Allah's Laws and allow me to speak (first)" The Prophet said to him, 'Speak " He said, "My son was a laborer for this man, and he committed illegal sexual intercourse with his wife, and the people told me that my son should be stoned to death, but I have given one-hundred sheep and a slave girl as a ransom (expiation) for my son's sin. Then I asked the religious learned people (about It), and they told me that my son should he flogged one-hundred stripes and should be exiled for one year, and only the wife of this man should be stoned to death " Allah's Apostle said, "By Him in Whose Hand my soul is, I will judge you according to Allah's Laws: O man, as for your sheep and slave girl, they are to be returned to you." Then the Prophet had the man's son flogged one hundred stripes and exiled for one year, and ordered Unais Al-Aslami to go to the wife of the other man, and if she confessed, stone her to death. She confessed and was stoned to death.

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، أَخْبَرَنَا مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ بْنِ مَسْعُودٍ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ، أَنَّهُمَا أَخْبَرَاهُ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ‏.‏ وَقَالَ الآخَرُ وَهْوَ أَفْقَهُهُمَا أَجَلْ يَا رَسُولَ اللَّهِ فَاقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ، وَأْذَنْ لِي أَنْ أَتَكَلَّمَ‏.‏ قَالَ ‏"‏ تَكَلَّمْ ‏"‏‏.‏ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا ـ قَالَ مَالِكٌ وَالْعَسِيفُ الأَجِيرُ ـ فَزَنَى بِامْرَأَتِهِ، فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ، فَافْتَدَيْتُ مِنْهُ بِمِائَةِ شَاةٍ وَبِجَارِيَةٍ لِي، ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّ مَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ، وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَمَا وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ، أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ عَلَيْكَ ‏"‏‏.‏ وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا، وَأَمَرَ أُنَيْسًا الأَسْلَمِيَّ أَنْ يَأْتِيَ امْرَأَةَ الآخَرِ، فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا، فَاعْتَرَفَتْ فَرَجَمَهَا‏.‏

Narrated Al-Miqdad bin `Amr Al-Kindi:

An ally of Bani Zuhra who took part in the battle of Badr with the Prophet, that he said, "O Allah's Apostle! If I meet an unbeliever and we have a fight, and he strikes my hand with the sword and cuts it off, and then takes refuge from me under a tree, and says, 'I have surrendered to Allah (i.e. embraced Islam),' may I kill him after he has said so?" Allah's Apostle said, "Do not kill him." Al- Miqdad said, "But O Allah's Apostle! He had chopped off one of my hands and he said that after he had cut it off. May I kill him?" The Prophet said. "Do not kill him for if you kill him, he would be in the position in which you had been before you kill him, and you would be in the position in which he was before he said the sentence." The Prophet also said to Al-Miqdad, "If a faithful believer conceals his faith (Islam) from the disbelievers, and then when he declares his Islam, you kill him, (you will be sinful). Remember that you were also concealing your faith (Islam) at Mecca before."

حَدَّثَنَا عَبْدَانُ، حَدَّثَنَا عَبْدُ اللَّهِ، حَدَّثَنَا يُونُسُ، عَنِ الزُّهْرِيِّ، حَدَّثَنَا عَطَاءُ بْنُ يَزِيدَ، أَنَّ عُبَيْدَ اللَّهِ بْنَ عَدِيٍّ، حَدَّثَهُ أَنَّ الْمِقْدَادَ بْنَ عَمْرٍو الْكِنْدِيَّ حَلِيفَ بَنِي زُهْرَةَ حَدَّثَهُ وَكَانَ، شَهِدَ بَدْرًا مَعَ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ قَالَ يَا رَسُولَ اللَّهِ إِنْ لَقِيتُ كَافِرًا فَاقْتَتَلْنَا، فَضَرَبَ يَدِي بِالسَّيْفِ فَقَطَعَهَا، ثُمَّ لاَذَ بِشَجَرَةٍ وَقَالَ أَسْلَمْتُ لِلَّهِ‏.‏ آقْتُلُهُ بَعْدَ أَنْ قَالَهَا قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ لاَ تَقْتُلْهُ ‏"‏‏.‏ قَالَ يَا رَسُولَ اللَّهِ فَإِنَّهُ طَرَحَ إِحْدَى يَدَىَّ، ثُمَّ قَالَ بَعْدَ مَا قَطَعَهَا، آقْتُلُهُ قَالَ ‏"‏ لاَ تَقْتُلْهُ، فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ، وَأَنْتَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ ‏"‏‏.‏ وَقَالَ حَبِيبُ بْنُ أَبِي عَمْرَةَ عَنْ سَعِيدٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ النَّبِيُّ صلى الله عليه وسلم لِلْمِقْدَادِ ‏"‏ إِذَا كَانَ رَجُلٌ مُؤْمِنٌ يُخْفِي إِيمَانَهُ مَعَ قَوْمٍ كُفَّارٍ، فَأَظْهَرَ إِيمَانَهُ، فَقَتَلْتَهُ، فَكَذَلِكَ كُنْتَ أَنْتَ تُخْفِي إِيمَانَكَ بِمَكَّةَ مِنْ قَبْلُ ‏"‏‏.‏

It was narrated from Yahya bin Sa'eed that :
'Amrah told him that Aishah told her that a Jewish woman came to her and said: "May Allah protect you from the torment of the grave." Aishah said: "O Messenger of Allah, will people be tormented in the graves?" The Messenger of Allah (SAW) sought refuge with Allah. 'Aishah said: "The Prophet (SAW) went out, and the sun became eclipsed. We went out to another room and the women gathered with us. The Messenger of Allah (SAW) came to us and that was at the time of forenoon. He stood for a long time, then he bowed for a long time, then he raises his head and stood for a shorter time than the first one; then he bowed for a shorter time than the first one. Then he prostrated, then he stood up for the second (rak'ah) and did the same again, except that his bowing an prostrating were shorter than in the first rak'ah. Then he prostrated, and the eclipse had ended. When he had finished, he sat on the minbar and one of the things he said was: 'The people will be tried in their graves like the trial of the Dajjal.' Aishah siad: 'After that, we used to hear him seeking refuge with Allah (SWT) from the torment of the grave."

A'isha, the wife of Allah's Apostle (mav peace be upon him), and Uthman both reported that Abu Bakr sought permission from Allah's Messenger (may peace be upon him) for entrance (in his apartment) as he had been lying on his bed covered with the bed-sheet of A'isha, and he gave permission to Abu Bakr in that very state and he, having his need fulfilled, went back. Then Umar sought permission and it was given to him in that very state and, after having his need fulfilled, he went back. And 'Uthman reported:

Then I sought permission from him and he got up and raid to A'isha: Wrap yourself well with your cloth, then I got my need fulfilled and came back. And A'isha said: Allah's Messenger, why is it that I did not see you feeling any anxiety in case of dressing properly in the presence of Abu Bakr and 'Umar (Allah be pleased with them) as you showed in case of 'Uthman. Thereupon Allah's Messenger (may peace be upon him) said: Verily Uthman is a person who is very modest and I was afraid that if I permitted him to enter in this very state he would not inform me of his need.

Narrated `Urwa bin Az-Zubair:

Hakim bin Hizam said, "I asked Allah's Apostle for something, and he gave me, and I asked him again and he gave me and said, 'O Hakim! This wealth is green and sweet (i.e. as tempting as fruits), and whoever takes it without greed then he is blessed in it, and whoever takes it with greediness, he is not blessed in it and he is like one who eats and never gets satisfied. The upper (i.e. giving) hand is better than the lower (i.e. taking) hand." Hakim added, "I said, O Allah's Apostle! By Him Who has sent you with the Truth I will never demand anything from anybody after you till I die." Afterwards Abu Bakr used to call Hakim to give him something but he refused to accept anything from him. Then `Umar called him to give him (something) but he refused. Then `Umar said, "O Muslims! I offered to him (i.e. Hakim) his share which Allah has ordained for him from this booty and he refuses to take it." Thus Hakim did not ask anybody for anything after the Prophet, till he died--may Allah bestow His mercy upon him.

حَدَّثَنَا مُحَمَّدُ بْنُ يُوسُفَ، حَدَّثَنَا الأَوْزَاعِيُّ، عَنِ الزُّهْرِيِّ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، وَعُرْوَةَ بْنِ الزُّبَيْرِ، أَنَّ حَكِيمَ بْنَ حِزَامٍ ـ رضى الله عنه ـ قَالَ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَأَعْطَانِي، ثُمَّ سَأَلْتُهُ فَأَعْطَانِي ثُمَّ قَالَ لِي ‏ "‏ يَا حَكِيمُ، إِنَّ هَذَا الْمَالَ خَضِرٌ حُلْوٌ، فَمَنْ أَخَذَهُ بِسَخَاوَةِ نَفْسٍ بُورِكَ لَهُ فِيهِ، وَمَنْ أَخَذَهُ بِإِشْرَافِ نَفْسٍ لَمْ يُبَارَكْ لَهُ فِيهِ، وَكَانَ كَالَّذِي يَأْكُلُ وَلاَ يَشْبَعُ، وَالْيَدُ الْعُلْيَا خَيْرٌ مِنَ الْيَدِ السُّفْلَى ‏"‏‏.‏ قَالَ حَكِيمٌ فَقُلْتُ يَا رَسُولَ اللَّهِ، وَالَّذِي بَعَثَكَ بِالْحَقِّ لاَ أَرْزَأُ أَحَدًا بَعْدَكَ شَيْئًا حَتَّى أُفَارِقَ الدُّنْيَا‏.‏ فَكَانَ أَبُو بَكْرٍ يَدْعُو حَكِيمًا لِيُعْطِيَهُ الْعَطَاءَ فَيَأْبَى أَنْ يَقْبَلَ مِنْهُ شَيْئًا، ثُمَّ إِنَّ عُمَرَ دَعَاهُ لِيُعْطِيَهُ فَيَأْبَى أَنْ يَقْبَلَهُ فَقَالَ يَا مَعْشَرَ الْمُسْلِمِينَ، إِنِّي أَعْرِضُ عَلَيْهِ حَقَّهُ الَّذِي قَسَمَ اللَّهُ لَهُ مِنْ هَذَا الْفَىْءِ فَيَأْبَى أَنْ يَأْخُذَهُ‏.‏ فَلَمْ يَرْزَأْ حَكِيمٌ أَحَدًا مِنَ النَّاسِ بَعْدَ النَّبِيِّ صلى الله عليه وسلم حَتَّى تُوُفِّيَ رَحِمَهُ اللَّهُ‏.‏

I give him (i.e. Hakim) his right which Allah has assigned to him) from this Fai '(booty), but he refuses to take it." So Hakim never took anything from anybody after the Prophet till he died.

Narrated Zaid bin Khalid Al-Juhani:

I asked `Uthman bin `Affan about a man who engaged in the sexual intercourse with his wife but did not discharge. `Uthman replied, "He should perform ablution like that for the prayer after washing his private parts." `Uthman added, "I heard that from Allah's Apostle." I asked `Ali bin Abi Talib, Az- Zubair bin Al-`Awwam, Talha bin 'Ubaidullah and Ubai bin Ka`b and they gave the same reply. (Abu Aiyub said that he had heard that from Allah's Apostle ) (This order was canceled later on so one has to take a bath. See, Hadith No. 180).

حَدَّثَنَا أَبُو مَعْمَرٍ، حَدَّثَنَا عَبْدُ الْوَارِثِ، عَنِ الْحُسَيْنِ، قَالَ يَحْيَى وَأَخْبَرَنِي أَبُو سَلَمَةَ، أَنَّ عَطَاءَ بْنَ يَسَارٍ، أَخْبَرَهُ أَنَّ زَيْدَ بْنَ خَالِدٍ الْجُهَنِيَّ أَخْبَرَهُ أَنَّهُ، سَأَلَ عُثْمَانَ بْنَ عَفَّانَ فَقَالَ أَرَأَيْتَ إِذَا جَامَعَ الرَّجُلُ امْرَأَتَهُ فَلَمْ يُمْنِ‏.‏ قَالَ عُثْمَانُ يَتَوَضَّأُ كَمَا يَتَوَضَّأُ لِلصَّلاَةِ، وَيَغْسِلُ ذَكَرَهُ‏.‏ قَالَ عُثْمَانُ سَمِعْتُهُ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم‏.‏ فَسَأَلْتُ عَنْ ذَلِكَ عَلِيَّ بْنَ أَبِي طَالِبٍ وَالزُّبَيْرَ بْنَ الْعَوَّامِ وَطَلْحَةَ بْنَ عُبَيْدِ اللَّهِ وَأُبَىَّ بْنَ كَعْبٍ ـ رضى الله عنهم ـ فَأَمَرُوهُ بِذَلِكَ‏.‏ قَالَ يَحْيَى وَأَخْبَرَنِي أَبُو سَلَمَةَ أَنَّ عُرْوَةَ بْنَ الزُّبَيْرِ أَخْبَرَهُ أَنَّ أَبَا أَيُّوبَ أَخْبَرَهُ أَنَّهُ سَمِعَ ذَلِكَ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم‏.‏

‘Ata’ b. Abu Rabah said Ibn ‘Abbas asked whether he would like him to show him a woman who would go to paradise. When he replied that he certainly would, he said:
This black woman came to the Prophet and said, “Messenger of God, I am subject to fits and become uncovered, so make supplication to God for me.” He replied, “If you wish you may endure it and be rewarded with paradise, but if your wish I shall make supplication to God to cure you.” She said, “I shall endure it.” Then she added, “But since I become uncovered, make supplication to God that that may not happen.” He then made supplication for her. (Bukhari and Muslim.)
وَعَنْ عَطَاءِ بْنِ أَبِي رَبَاحٍ قَالَ: قَالَ لي ابْن عَبَّاس رَضِي الله عَنهُ: أَلا أريك امْرَأَة من أهل الْجنَّة؟ فَقلت: بَلَى. قَالَ: هَذِهِ الْمَرْأَةُ السَّوْدَاءُ أَتَتِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَتْ: إِنِّي أصرع وَإِنِّي أتكشف فَادع الله تَعَالَى لي. قَالَ: «إِنْ شِئْتِ صَبَرْتِ وَلَكِ الْجَنَّةُ وَإِنْ شِئْتِ دَعَوْت الله تَعَالَى أَنْ يُعَافِيَكَ» فَقَالَتْ: أَصْبِرُ فَقَالَتْ: إِنِّي أَتَكَشَّفُ فَادْعُ اللَّهَ أَنْ لَا أَتَكَشَّفَ فَدَعَا لَهَا

Yahya related to me from Malik that he had heard that Ali ibn Abi Talib said about the two arbiters about whom Allah, the Exalted, said,"If you fear a breach between the two, appoint an arbiter from his people, and an arbiter from her people. If they desire to set things aright, Allah will make peace between them, surely Allah is Knowing, Aware," (Sura 4 ayat 35), that the separation and the joining were overseen by the two of them.

Malik said, "That is the best of what I have heard from the people of knowledge. Whatever the two arbiters say concerning separation or joining is taken into consideration "

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ عَلِيَّ بْنَ أَبِي طَالِبٍ، قَالَ فِي الْحَكَمَيْنِ اللَّذَيْنِ قَالَ اللَّهُ تَعَالَى ‏{‏وَإِنْ خِفْتُمْ شِقَاقَ بَيْنِهِمَا فَابْعَثُوا حَكَمًا مِنْ أَهْلِهِ وَحَكَمًا مِنْ أَهْلِهَا إِنْ يُرِيدَا إِصْلاَحًا يُوَفِّقِ اللَّهُ بَيْنَهُمَا إِنَّ اللَّهَ كَانَ عَلِيمًا خَبِيرًا‏}إِنَّ إِلَيْهِمَا الْفُرْقَةَ بَيْنَهُمَا وَالاِجْتِمَاعَ ‏.‏ قَالَ مَالِكٌ وَذَلِكَ أَحْسَنُ مَا سَمِعْتُ مِنْ أَهْلِ الْعِلْمِ أَنَّ الْحَكَمَيْنِ يَجُوزُ قَوْلُهُمَا بَيْنَ الرَّجُلِ وَامْرَأَتِهِ فِي الْفُرْقَةِ وَالاِجْتِمَاعِ ‏.‏

It was narrated from Bishr bin Suhaim that:
The Prophet [SAW] commanded him to call out on the days of At-Tashriq that no one would enter Paradise except a believer, and that these were the days of eating and drinking.

Yahya related to me from Malik from Abu'z-Zinad from al-Araj that Abu Hurayra said, "The Messenger of Allah, may Allah bless him and grant him peace, forbade two sales. Mulamasa, in which a man is obliged to buy whatever he touches without any choice in the matter, and munabadha, in which two men throw their garment to each other without either seeing the other's garment. He also forbade two ways of dressing. One in which a man sits with his legs drawn up to his chest wrapped in one garment that does not cover his genitals, and the other in which a man wraps a single garment over one arm and shoulder restricting them."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّهُ قَالَ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَنْ لِبْسَتَيْنِ وَعَنْ بَيْعَتَيْنِ عَنِ الْمُلاَمَسَةِ وَعَنِ الْمُنَابَذَةِ وَعَنْ أَنْ يَحْتَبِيَ الرَّجُلُ فِي ثَوْبٍ وَاحِدٍ لَيْسَ عَلَى فَرْجِهِ مِنْهُ شَىْءٌ وَعَنْ أَنْ يَشْتَمِلَ الرَّجُلُ بِالثَّوْبِ الْوَاحِدِ عَلَى أَحَدِ شِقَّيْهِ ‏.‏

Sunan Abi Dawud 2289

Abu Salamah reported on the authority of Fatimah daughter of Qays who said to him that she was the wife of AbuHafs ibn al-Mughirah who divorced her by three pronouncements. She said that she came to the Messenger of Allah (saws) and sought his opinion about her going out from her house. He commanded her to shift to (the house of )Ibn Umm Maktum who was blind. Marwan denied to confirm the tradition of Fatimah about the going out of a divorced woman from her house. Urwah said:

Aisha objected to Fatimah daughter of Qays.

Abu Dawud said: Salih b. Kaisan, Ibn Juraij, and Shu'aib b. Abi Hamzah -- all of them narrated on the authority of al-Zuhru in a similar way.

Abu Dawud said: Shu'aibn b. Abi Hamzah the name of Abu Hamzah is Dinar. He is a client of Ziyad.

حَدَّثَنَا يَزِيدُ بْنُ خَالِدٍ الرَّمْلِيُّ، حَدَّثَنَا اللَّيْثُ، عَنْ عُقَيْلٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، عَنْ فَاطِمَةَ بِنْتِ قَيْسٍ، أَنَّهَا أَخْبَرَتْهُ أَنَّهَا، كَانَتْ عِنْدَ أَبِي حَفْصِ بْنِ الْمُغِيرَةِ وَأَنَّ أَبَا حَفْصِ بْنَ الْمُغِيرَةِ طَلَّقَهَا آخِرَ ثَلاَثِ تَطْلِيقَاتٍ فَزَعَمَتْ أَنَّهَا جَاءَتْ رَسُولَ اللَّهِ صلى الله عليه وسلم فَاسْتَفْتَتْهُ فِي خُرُوجِهَا مِنْ بَيْتِهَا فَأَمَرَهَا أَنْ تَنْتَقِلَ إِلَى ابْنِ أُمِّ مَكْتُومٍ الأَعْمَى فَأَبَى مَرْوَانُ أَنْ يُصَدِّقَ حَدِيثَ فَاطِمَةَ فِي خُرُوجِ الْمُطَلَّقَةِ مِنْ بَيْتِهَا ‏.‏ قَالَ عُرْوَةُ وَأَنْكَرَتْ عَائِشَةُ - رضى الله عنها - عَلَى فَاطِمَةَ بِنْتِ قَيْسٍ ‏.‏ قَالَ أَبُو دَاوُدَ وَكَذَلِكَ رَوَاهُ صَالِحُ بْنُ كَيْسَانَ وَابْنُ جُرَيْجٍ وَشُعَيْبُ بْنُ أَبِي حَمْزَةَ كُلُّهُمْ عَنِ الزُّهْرِيِّ ‏.‏ قَالَ أَبُو دَاوُدَ وَشُعَيْبُ بْنُ أَبِي حَمْزَةَ وَاسْمُ أَبِي حَمْزَةَ دِينَارٌ وَهُوَ مَوْلَى زِيَادٍ ‏.‏

Narrated Muhammad bin Jubair bin Mut`im:

That while he was included in a delegation of Quraish staying with Muawiya, Muawiya heard that `Abdullah bin `Amr had said that there would be a king from Qahtan tribe, whereupon he became very angry. He stood up, and after glorifying and praising Allah as He deserved, said, "To proceed, I have come to know that some of you men are narrating things which are neither in Allah's Book, nor has been mentioned by Allah's Apostle . Such people are the ignorant among you. Beware of such vain desires that mislead those who have them. I have heard Allah's Apostle saying, 'This matter (of the caliphate) will remain with the Quraish, and none will rebel against them, but Allah will throw him down on his face as long as they stick to the rules and regulations of the religion (Islam).'"

حَدَّثَنَا أَبُو الْيَمَانِ، أَخْبَرَنَا شُعَيْبٌ، عَنِ الزُّهْرِيِّ، قَالَ كَانَ مُحَمَّدُ بْنُ جُبَيْرِ بْنِ مُطْعِمٍ يُحَدِّثُ أَنَّهُ بَلَغَ مُعَاوِيَةَ وَهْوَ عِنْدَهُ فِي وَفْدٍ مِنْ قُرَيْشٍ أَنَّ عَبْدَ اللَّهِ بْنَ عَمْرٍو يُحَدِّثُ أَنَّهُ سَيَكُونُ مَلِكٌ مِنْ قَحْطَانَ فَغَضِبَ، فَقَامَ فَأَثْنَى عَلَى اللَّهِ بِمَا هُوَ أَهْلُهُ، ثُمَّ قَالَ أَمَّا بَعْدُ فَإِنَّهُ بَلَغَنِي أَنَّ رِجَالاً مِنْكُمْ يُحَدِّثُونَ أَحَادِيثَ لَيْسَتْ فِي كِتَابِ اللَّهِ، وَلاَ تُؤْثَرُ عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم وَأُولَئِكَ جُهَّالُكُمْ، فَإِيَّاكُمْ وَالأَمَانِيَّ الَّتِي تُضِلُّ أَهْلَهَا، فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ إِنَّ هَذَا الأَمْرَ فِي قُرَيْشٍ، لاَ يُعَادِيهِمْ أَحَدٌ إِلاَّ كَبَّهُ اللَّهُ عَلَى وَجْهِهِ مَا أَقَامُوا الدِّينَ ‏"‏‏.‏ تَابَعَهُ نُعَيْمٌ عَنِ ابْنِ الْمُبَارَكِ عَنْ مَعْمَرٍ عَنِ الزُّهْرِيِّ عَنْ مُحَمَّدِ بْنِ جُبَيْرٍ‏.‏

Narrated Sa'd:

Allah's Apostle distributed (Zakat) amongst (a group of) people while I was sitting there but Allah's Apostle left a man whom I thought the best of the lot. I asked, "O Allah's Apostle! Why have you left that person? By Allah I regard him as a faithful believer." The Prophet commented: "Or merely a Muslim." I remained quiet for a while, but could not help repeating my question because of what I knew about him. And then asked Allah's Apostle, "Why have you left so and so? By Allah! He is a faithful believer." The Prophet again said, "Or merely a Muslim." And I could not help repeating my question because of what I knew about him. Then the Prophet said, "O Sa'd! I give to a person while another is dearer to me, for fear that he might be thrown on his face in the Fire by Allah."

حَدَّثَنَا أَبُو الْيَمَانِ، قَالَ أَخْبَرَنَا شُعَيْبٌ، عَنِ الزُّهْرِيِّ، قَالَ أَخْبَرَنِي عَامِرُ بْنُ سَعْدِ بْنِ أَبِي وَقَّاصٍ، عَنْ سَعْدٍ، رضى الله عنه أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم أَعْطَى رَهْطًا وَسَعْدٌ جَالِسٌ، فَتَرَكَ رَسُولُ اللَّهِ صلى الله عليه وسلم رَجُلاً هُوَ أَعْجَبُهُمْ إِلَىَّ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا لَكَ عَنْ فُلاَنٍ فَوَاللَّهِ إِنِّي لأَرَاهُ مُؤْمِنًا‏.‏ فَقَالَ ‏"‏ أَوْ مُسْلِمًا ‏"‏‏.‏ فَسَكَتُّ قَلِيلاً، ثُمَّ غَلَبَنِي مَا أَعْلَمُ مِنْهُ فَعُدْتُ لِمَقَالَتِي فَقُلْتُ مَا لَكَ عَنْ فُلاَنٍ فَوَاللَّهِ إِنِّي لأَرَاهُ مُؤْمِنًا فَقَالَ ‏"‏ أَوْ مُسْلِمًا ‏"‏‏.‏ ثُمَّ غَلَبَنِي مَا أَعْلَمُ مِنْهُ فَعُدْتُ لِمَقَالَتِي وَعَادَ رَسُولُ اللَّهِ صلى الله عليه وسلم ثُمَّ قَالَ ‏"‏ يَا سَعْدُ، إِنِّي لأُعْطِي الرَّجُلَ وَغَيْرُهُ أَحَبُّ إِلَىَّ مِنْهُ، خَشْيَةَ أَنْ يَكُبَّهُ اللَّهُ فِي النَّارِ ‏"‏‏.‏ وَرَوَاهُ يُونُسُ وَصَالِحٌ وَمَعْمَرٌ وَابْنُ أَخِي الزُّهْرِيِّ عَنِ الزُّهْرِيِّ‏.‏

the Prophet said: "Fast the Day of Ashura, for indeed I anticipate that Allah will forgive (the sins of) the year before it."
حَدَّثَنَا قُتَيْبَةُ، وَأَحْمَدُ بْنُ عَبْدَةَ الضَّبِّيُّ، قَالاَ حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ غَيْلاَنَ بْنِ جَرِيرٍ، عَنْ عَبْدِ اللَّهِ بْنِ مَعْبَدٍ الزِّمَّانِيِّ، عَنْ أَبِي قَتَادَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏"‏ صِيَامُ يَوْمِ عَاشُورَاءَ إِنِّي أَحْتَسِبُ عَلَى اللَّهِ أَنْ يُكَفِّرَ السَّنَةَ الَّتِي قَبْلَهُ ‏"‏ ‏.‏ وَفِي الْبَابِ عَنْ عَلِيٍّ وَمُحَمَّدِ بْنِ صَيْفِيٍّ وَسَلَمَةَ بْنِ الأَكْوَعِ وَهِنْدِ بْنِ أَسْمَاءَ وَابْنِ عَبَّاسٍ وَالرُّبَيِّعِ بِنْتِ مُعَوِّذِ بْنِ عَفْرَاءَ وَعَبْدِ الرَّحْمَنِ بْنِ سَلَمَةَ الْخُزَاعِيِّ عَنْ عَمِّهِ وَعَبْدِ اللَّهِ بْنِ الزُّبَيْرِ ذَكَرُوا عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم أَنَّهُ حَثَّ عَلَى صِيَامِ يَوْمِ عَاشُورَاءَ ‏.‏ قَالَ أَبُو عِيسَى لاَ نَعْلَمُ فِي شَيْءٍ مِنَ الرِّوَايَاتِ أَنَّهُ قَالَ ‏"‏ صِيَامُ يَوْمِ عَاشُورَاءَ كَفَّارَةُ سَنَةٍ ‏"‏ ‏.‏ إِلاَّ فِي حَدِيثِ أَبِي قَتَادَةَ ‏.‏ وَبِحَدِيثِ أَبِي قَتَادَةَ يَقُولُ أَحْمَدُ وَإِسْحَاقُ ‏.‏

Narrated Abu Wail:

Somebody said to Usama, "Will you go to so-and-so (i.e. `Uthman) and talk to him (i.e. advise him regarding ruling the country)?" He said, "You see that I don't talk to him. Really I talk to (advise) him secretly without opening a gate (of affliction), for neither do I want to be the first to open it (i.e. rebellion), nor will I say to a man who is my ruler that he is the best of all the people after I have heard something from Allah s Apostle ." They said, What have you heard him saying? He said, "I have heard him saying, "A man will be brought on the Day of Resurrection and thrown in the (Hell) Fire, so that his intestines will come out, and he will go around like a donkey goes around a millstone. The people of (Hell) Fire will gather around him and say: O so-and-so! What is wrong with you? Didn't you use to order us to do good deeds and forbid us to do bad deeds? He will reply: Yes, I used to order you to do good deeds, but I did not do them myself, and I used to forbid you to do bad deeds, yet I used to do them myself."

حَدَّثَنَا عَلِيٌّ، حَدَّثَنَا سُفْيَانُ، عَنِ الأَعْمَشِ، عَنْ أَبِي وَائِلٍ،، قَالَ قِيلَ لأُسَامَةَ لَوْ أَتَيْتَ فُلاَنًا فَكَلَّمْتَهُ‏.‏ قَالَ إِنَّكُمْ لَتَرَوْنَ أَنِّي لاَ أُكَلِّمُهُ إِلاَّ أُسْمِعُكُمْ، إِنِّي أُكُلِّمُهُ فِي السِّرِّ دُونَ أَنْ أَفْتَحَ بَابًا لاَ أَكُونُ أَوَّلَ مَنْ فَتَحَهُ، وَلاَ أَقُولُ لِرَجُلٍ أَنْ كَانَ عَلَىَّ أَمِيرًا إِنَّهُ خَيْرُ النَّاسِ بَعْدَ شَىْءٍ سَمِعْتُهُ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم‏.‏ قَالُوا وَمَا سَمِعْتَهُ يَقُولُ قَالَ سَمِعْتُهُ يَقُولُ ‏ "‏ يُجَاءُ بِالرَّجُلِ يَوْمَ الْقِيَامَةِ فَيُلْقَى فِي النَّارِ، فَتَنْدَلِقُ أَقْتَابُهُ فِي النَّارِ، فَيَدُورُ كَمَا يَدُورُ الْحِمَارُ بِرَحَاهُ، فَيَجْتَمِعُ أَهْلُ النَّارِ عَلَيْهِ، فَيَقُولُونَ أَىْ فُلاَنُ، مَا شَأْنُكَ أَلَيْسَ كُنْتَ تَأْمُرُنَا بِالْمَعْرُوفِ وَتَنْهَى عَنِ الْمُنْكَرِ قَالَ كُنْتُ آمُرُكُمْ بِالْمَعْرُوفِ وَلاَ آتِيهِ، وَأَنْهَاكُمْ عَنِ الْمُنْكَرِ وَآتِيهِ ‏"‏‏.‏ رَوَاهُ غُنْدَرٌ عَنْ شُعْبَةَ عَنِ الأَعْمَشِ‏.‏

Sunan Ibn Majah 4179
It was narrated from ‘Iyad bin Himar that the Prophet (saw) addressed them and said:
“Allah has revealed to me that you should be humble towards one another so that none of you boasts to another.”
حَدَّثَنَا أَحْمَدُ بْنُ سَعِيدٍ، حَدَّثَنَا عَلِيُّ بْنُ الْحُسَيْنِ بْنِ وَاقِدٍ، حَدَّثَنَا أَبِي، عَنْ مَطَرٍ، عَنْ قَتَادَةَ، عَنْ مُطَرِّفٍ، عَنْ عِيَاضِ بْنِ حِمَارٍ، عَنِ النَّبِيِّ ـ صلى الله عليه وسلم ـ أَنَّهُ خَطَبَهُمْ فَقَالَ ‏ "‏ إِنَّ اللَّهَ عَزَّ وَجَلَّ أَوْحَى إِلَىَّ أَنْ تَوَاضَعُوا حَتَّى لاَ يَفْخَرَ أَحَدٌ عَلَى أَحَدٍ ‏"‏ ‏.‏

Yahya related to me from Malik from Yahya ibn Said from al-Qasim ibn Muhammad that A'isha, the wife of the Prophet, may Allah bless him and grant him peace, said when asked whether it was permissible for a man to marry again a wife he had divorced irrevocably if she had married another man who divorced her before consummating the marriage, "Not until she has tasted the sweetness of intercourse."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، عَنْ عَائِشَةَ، زَوْجِ النَّبِيِّ صلى الله عليه وسلم أَنَّهَا سُئِلَتْ عَنْ رَجُلٍ طَلَّقَ امْرَأَتَهُ الْبَتَّةَ فَتَزَوَّجَهَا بَعْدَهُ رَجُلٌ آخَرُ فَطَلَّقَهَا قَبْلَ أَنْ يَمَسَّهَا هَلْ يَصْلُحُ لِزَوْجِهَا الأَوَّلِ أَنْ يَتَزَوَّجَهَا فَقَالَتْ عَائِشَةُ لاَ حَتَّى يَذُوقَ عُسَيْلَتَهَا ‏.‏

Narrated `Abis bin Rabi`a:

`Umar came near the Black Stone and kissed it and said "No doubt, I know that you are a stone and can neither benefit anyone nor harm anyone. Had I not seen Allah's Apostle kissing you I would not have kissed you."

It was narrated that Hamzah said:
"I asked the Messenger of Allah about fasting while traveling. He said: 'If you wish to fast then fast, and if you wish not to fast then do not fast."'
أَخْبَرَنَا سُوَيْدُ بْنُ نَصْرٍ، قَالَ أَنْبَأَنَا عَبْدُ اللَّهِ، عَنْ عَبْدِ الْحَمِيدِ بْنِ جَعْفَرٍ، عَنْ عِمْرَانَ بْنِ أَبِي أَنَسٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ حَمْزَةَ، قَالَ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنِ الصَّوْمِ فِي السَّفَرِ قَالَ ‏ "‏ إِنْ شِئْتَ أَنْ تَصُومَ فَصُمْ وَإِنْ شِئْتَ أَنْ تُفْطِرَ فَأَفْطِرْ ‏"‏ ‏.‏

Abu Huraira (Allah be pleased with him) reported that a person said to Allah's Apostle (may peace be upon him):

My father died and left behind property without making any will regarding it. Would he be relieved of the burden of his sins if I give sadaqa on his behalf? He (the Holy Prophet) said: Yes.

It was narrated from Sa'd bin 'Ubadah that he came to the Prophet and said:
"My mother has died and she had a vow to fulfill. Will it suffice if I free a slave on her behalf?" He said: "Free a slave on behalf of your mother."

It was narrated from Zirr that 'Abdullah said:
When the Messenger of Allah ﷺ died, the Ansar said: A leader from among us and a leader from among you. ‘Umar went to them and said: O Ansar, do you not know that the Messenger of Allah ﷺ ordered Abu Bakr to lead the people in prayer? Which of you would like himself to be given precedence over Abu Bakr? The Ansar said: We seek refuge with Allah from being given precedence over Abu Bakr.
حَدَّثَنَا مُعَاوِيَةُ بْنُ عَمْرٍو، حَدَّثَنَا زَائِدَةُ، حَدَّثَنَا عَاصِمٌ، وَحُسَيْنُ بْنُ عَلِيٍّ، عَنْ زَائِدَةَ، عَنْ عَاصِمٍ، عَنْ زِرٍّ، عَنْ عَبْدِ اللَّهِ، قَالَ لَمَّا قُبِضَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَتْ الْأَنْصَارُ مِنَّا أَمِيرٌ وَمِنْكُمْ أَمِيرٌ فَأَتَاهُمْ عُمَرُ رَضِيَ اللَّهُ عَنْهُ فَقَالَ يَا مَعْشَرَ الْأَنْصَارِ أَلَسْتُمْ تَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ أَمَرَ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ أَنْ يَؤُمَّ النَّاسَ فَأَيُّكُمْ تَطِيبُ نَفْسُهُ أَنْ يَتَقَدَّمَ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ فَقَالَتْ الْأَنْصَارُ نَعُوذُ بِاللَّهِ أَنْ نَتَقَدَّمَ أَبَا بَكْرٍ رَضِيَ اللَّهُ عَنْهُ‏.‏

Narrated Ibn 'Abbas:
"Hilal bin Umayyah went to the Prophet (SAW) and accused his wife of committing illegal sexual intercourse with Sharik bin Sahma. The Messenger of Allah (SAW) said: 'Either you produce proof, or you will receive the legal punishment on your back.'" He said: "Hilal said: 'O Messenger of Allah (SAW)! If one of us saw a man over his wife, should he go and search for witnesses?' The Prophet (SAW) kept on saying: 'Either you produce proof, or you will receive the legal punishment on your back.'" He said: "Hilal then said, 'By Him Who sent you with the Truth and Allah will reveal to you what will save my back from the legal punishment.' Then (the following) was revealed: And for those who accuse their wives, but have not witnesses except themselves, let the testimony of one of them be four testimonies by Allah that he is one of those who speak the truth (24:6-9). He recited it until he reached: 'And the fifth; should be that the wrath of Allah be upon her if he speaks the truth.' Then the Prophet (SAW) was saying: 'Allah knows that one of you is a liar, so, will either of you repent?' Then the woman got up and took the oaths, and when she was about to take the fifth one; That the wrath of Allah be upon her if he speaks the truth', the people stopped her and said to her: 'It will definitely bring about Allah's curse upon you (if you are guilty).'" Ibn 'Abbas said 'So she hesitated, and recoiled so much so, that we thought that she would withdraw her denial. But she said: 'I will not dishonor my family for the rest of their days.' The Prophet (SAW) then said: 'Watch her, if she delivers a child with eyes that appear to have Kuhl on them, big hips, and fat shins then it is Sharik bin Sahma's child.' (Later) she gave birth to a child fitting that description. So the Prophet (SAW) said: 'If it had not been settled in the Book of Allah [the Mighty and Sublime], I would punish her severely.'"
حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي عَدِيٍّ، حَدَّثَنَا هِشَامُ بْنُ حَسَّانَ، حَدَّثَنِي عِكْرِمَةُ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ هِلاَلَ بْنَ أُمَيَّةَ، قَذَفَ امْرَأَتَهُ عِنْدَ النَّبِيِّ صلى الله عليه وسلم بِشَرِيكِ بْنِ السَّحْمَاءِ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ الْبِيِّنَةَ وَإِلاَّ حَدٌّ فِي ظَهْرِكَ ‏"‏ ‏.‏ قَالَ فَقَالَ هِلاَلٌ يَا رَسُولَ اللَّهِ إِذَا رَأَى أَحَدُنَا رَجُلاً عَلَى امْرَأَتِهِ أَيَلْتَمِسُ الْبَيِّنَةَ فَجَعَلَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏"‏ الْبَيِّنَةَ وَإِلاَّ حَدٌّ فِي ظَهْرِكَ ‏"‏ ‏.‏ قَالَ فَقَالَ هِلاَلٌ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنِّي لَصَادِقٌ وَلَيَنْزِلَنَّ فِي أَمْرِي مَا يُبَرِّئُ ظَهْرِي مِنَ الْحَدِّ فَنَزَلَ ‏:‏ ‏(‏والَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلاَّ أَنْفُسُهُمْ ‏)‏ فَقَرَأَ حَتَّى بَلَغَ ‏:‏ ‏(‏ والْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ‏)‏ قَالَ فَانْصَرَفَ النَّبِيُّ صلى الله عليه وسلم فَأَرْسَلَ إِلَيْهِمَا فَجَاءَا فَقَامَ هِلاَلُ بْنُ أُمَيَّةَ فَشَهِدَ وَالنَّبِيُّ صلى الله عليه وسلم يَقُولُ ‏"‏ إِنَّ اللَّهَ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ فَهَلْ مِنْكُمَا تَائِبٌ ‏"‏ ‏.‏ ثُمَّ قَامَتْ فَشَهِدَتْ فَلَمَّا كَانَتْ عِنْدَ الْخَامِسَةِ ‏:‏ ‏(‏ أنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ‏)‏ قَالُوا لَهَا إِنَّهَا مُوجِبَةٌ فَقَالَ ابْنُ عَبَّاسٍ فَتَلَكَّأَتْ وَنَكَسَتْ حَتَّى ظَنَنَّا أَنْ سَتَرْجِعُ فَقَالَتْ لاَ أَفْضَحُ قَوْمِي سَائِرَ الْيَوْمِ ‏.‏ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ أَبْصِرُوهَا فَإِنْ جَاءَتْ بِهِ أَكْحَلَ الْعَيْنَيْنِ سَابِغَ الأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ السَّحْمَاءِ ‏"‏ ‏.‏ فَجَاءَتْ بِهِ كَذَلِكَ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ لَوْلاَ مَا مَضَى مِنْ كِتَابِ اللَّهِ عَزَّ وَجَلَّ لَكَانَ لَنَا وَلَهَا شَأْنٌ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ مِنْ هَذَا الْوَجْهِ مِنْ حَدِيثِ هِشَامِ بْنِ حَسَّانَ وَهَكَذَا رَوَى عَبَّادُ بْنُ مَنْصُورٍ هَذَا الْحَدِيثَ عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ وَرَوَاهُ أَيُّوبُ عَنْ عِكْرِمَةَ مُرْسَلاً وَلَمْ يَذْكُرْ فِيهِ عَنِ ابْنِ عَبَّاسٍ ‏.‏

Malik said he heard that God's Messenger used to command that no intercourse be had with slave women till they had had a menstrual period if they were of the number who had such periods, or till three months had passed in the case of those who did not, and forbid watering another man's water. Yahya related to me from Malik that Abu'z-Zinad heard Sa'id ibn al-Musayyab andSulayman ibn Yasar forbid a man to sell wheat for gold on delayed terms and then to buy dried dates with the gold before he had taken delivery of the gold.

Yahya related to me from Malik from Nafi, the mawla of Ibn Umar that a man from Egypt told him that Umar ibn al-Khattab recited Surat al-Hajj (Sura 22) and prostrated twice in it, and then said, "This sura has been given special preference by having two prostrations in it."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، مَوْلَى ابْنِ عُمَرَ أَنَّ رَجُلاً، مِنْ أَهْلِ مِصْرَ أَخْبَرَهُ أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَرَأَ سُورَةَ الْحَجِّ فَسَجَدَ فِيهَا سَجْدَتَيْنِ ثُمَّ قَالَ إِنَّ هَذِهِ السُّورَةَ فُضِّلَتْ بِسَجْدَتَيْنِ ‏.‏

It was narrated that ‘Urwah said:
My father az-Zubair (رضي الله عنه) told me that on the day of Uhud, a woman came running, and when she was about to reach where the slain were, the Prophet (ﷺ) did not want her to see them, and he said, `The woman, the woman!` az-Zubair (رضي الله عنه) said: “I thought that she was my mother Safiyyah, so I went running towards her and caught up with her before she reached the slain. She shoved me in the chest, and she was a tough woman.” She said: “Stay away from me, may you have no land!” I said: “The Messenger of Allah (ﷺ) is urging you (not to go and see them).” She stopped and took out two pieces of cloth that she had with her and said: “These are two pieces of cloth that I have brought for my brother Hamzah. I have heard that he has been killed; shroud him with them.” We brought the two pieces of cloth to shroud Hamzah with them, but we saw beside him one of the Ansar who had been killed, and the same had been done to him as to Hamzah. We did not feel it was appropriate to shroud Hamzah in two pieces of cloth and to leave the Ansari with no shroud, so we said: “One piece for Hamzah and one piece for the Ansari.” We measured (the pieces of cloth) and found that one of them was larger, so we drew lots between them and shrouded each of them in the piece of cloth that was selected for him.
حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ الْهَاشِمِيُّ، أَنْبَأَنَا عَبْدُ الرَّحْمَنِ يَعْنِي ابْنَ أَبِي الزِّنَادِ، عَنْ هِشَامٍ، عَنْ عُرْوَةَ، قَالَ أَخْبَرَنِي أَبِي الزُّبَيْرُ، رَضِيَ اللَّهُ عَنْهُ أَنَّهُ لَمَّا كَانَ يَوْمُ أُحُدٍ أَقْبَلَتْ امْرَأَةٌ تَسْعَى حَتَّى إِذَا كَادَتْ أَنْ تُشْرِفَ عَلَى الْقَتْلَى قَالَ فَكَرِهَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ تَرَاهُمْ فَقَالَ الْمَرْأَةَ الْمَرْأَةَ قَالَ الزُّبَيْرُ رَضِيَ اللَّهُ عَنْهُ فَتَوَسَّمْتُ أَنَّهَا أُمِّي صَفِيَّةُ قَالَ فَخَرَجْتُ أَسْعَى إِلَيْهَا فَأَدْرَكْتُهَا قَبْلَ أَنْ تَنْتَهِيَ إِلَى الْقَتْلَى قَالَ فَلَدَمَتْ فِي صَدْرِي وَكَانَتْ امْرَأَةً جَلْدَةً قَالَتْ إِلَيْكَ لَا أَرْضَ لَكَ قَالَ فَقُلْتُ إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَزَمَ عَلَيْكِ قَالَ فَوَقَفَتْ وَأَخْرَجَتْ ثَوْبَيْنِ مَعَهَا فَقَالَتْ هَذَانِ ثَوْبَانِ جِئْتُ بِهِمَا لِأَخِي حَمْزَةَ فَقَدْ بَلَغَنِي مَقْتَلُهُ فَكَفِّنُوهُ فِيهِمَا قَالَ فَجِئْنَا بِالثَّوْبَيْنِ لِنُكَفِّنَ فِيهِمَا حَمْزَةَ فَإِذَا إِلَى جَنْبِهِ رَجُلٌ مِنْ الْأَنْصَارِ قَتِيلٌ قَدْ فُعِلَ بِهِ كَمَا فُعِلَ بِحَمْزَةَ قَالَ فَوَجَدْنَا غَضَاضَةً وَحَيَاءً أَنْ نُكَفِّنَ حَمْزَةَ فِي ثَوْبَيْنِ وَالْأَنْصَارِيُّ لَا كَفَنَ لَهُ فَقُلْنَا لِحَمْزَةَ ثَوْبٌ وَلِلْأَنْصَارِيِّ ثَوْبٌ فَقَدَرْنَاهُمَا فَكَانَ أَحَدُهُمَا أَكْبَرَ مِنْ الْآخَرِ فَأَقْرَعْنَا بَيْنَهُمَا فَكَفَّنَّا كُلَّ وَاحِدٍ مِنْهُمَا فِي الثَّوْبِ الَّذِي صَارَ لَهُ‏.‏

The paternal uncle of Abu Al-Muhallab's name is 'Abdur Rahman bin 'Amr, and they also say it was Muhawiyah bin 'Amr. And Abu Qilabah's name is 'Abdullah bin Zaid Al-Jarmi (narrator in the chain)

This is acted upon according to most of the people of knowledge among the Companions of the Prophet(saws) and others. It is for the Imam to decide to be generous with whom he wills among the captives, or to kill whom he wills among them, or to ransom whom he wills among them. Some of the people of knowledge preferred killing over ransoming.

Al-Awzai' said: "It has been conveyed to me. that this Ayah is abrogated: Thereafter (is the time) either for generosity (to free them without ranson) or ransom (47:4). It was abrogated by: Kill them wherever you find them (2:191). This was narrated to us by Hannad (who said): "Ibn Al-Mubarak narrated to us, from Al-Awza'i."

Ishaq bin Mansur said: "I said to Ahmad: 'When the captives are captured' is killing or ransoming better to you?' He said: 'If they are able to ransom' then there is no harm in it. And if they kill, then I do not know of any harm in it.'" Ishaq said: "Wiping them out is better to me, unless it is someone well-known, so that it is hoped that a large amount will be obtained for him."

Al-Fadl bin Abbas narrated:
"A woman from Khath'am said: 'O Messenger of Allah! My father has lived until Allah has made Hajj obligatory, and he is an elderly man who is not able to sit on the back of a camel.' So he (pbuh) said: 'Perform Hajj for him.'"

Humaid b. 'Abd al-Rahman al-Himyari reported from three of the sons of Sa'd all of whom reported from their father that Allah's Apostle (may peace be upon him) visited Sa'd as he was ill in Mecca. He (Sa'd) wept. He (the Holy Prophet) said:

What makes you weep? He said: I am afraid I may die in the land from where I migrated as Sa'd b. Khaula had died. Thereupon Allah's Apostle (may peace be upon him) said: O Allah, grant health to Sa'd. O Allah, grant health to Sad. He repeated it three times. He (Sa'd) said: Allah's Messenger, I own a large property and I have only one daughter as my inheritor. Should I not will away the whole of my property? He (the Holy Prophet) said: No. He said: (Should I not will away, ) two-thirds of the property? he (the Holy Prophet) said: No. He (Sa'd) (again) said: (Should I not will away) half (of my property)? He said: No. He (Sa'd) said: Then one-third? Thereupon he (the Holy Prophet) said: (Yes), one-third, and one-third is quite substanial. And what you spend as charity from your property is Sadaqa and flour spending on your family is also Sadaqa, and what your wife eats from your property is also Sadaqa, and that you leave your heirs well off (or he said: prospreous) is better than to leave them (poor and) begging from people. He (the Holy Prophet) pointed this with his hands.
حَدَّثَنَا مُحَمَّدُ بْنُ أَبِي عُمَرَ الْمَكِّيُّ، حَدَّثَنَا الثَّقَفِيُّ، عَنْ أَيُّوبَ السَّخْتِيَانِيِّ، عَنْ عَمْرِو، بْنِ سَعِيدٍ عَنْ حُمَيْدِ بْنِ عَبْدِ الرَّحْمَنِ الْحِمْيَرِيِّ، عَنْ ثَلاَثَةٍ، مِنْ وَلَدِ سَعْدٍ كُلُّهُمْ يُحَدِّثُهُ عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم دَخَلَ عَلَى سَعْدٍ يَعُودُهُ بِمَكَّةَ فَبَكَى قَالَ ‏"‏ مَا يُبْكِيكَ ‏"‏ ‏.‏ فَقَالَ قَدْ خَشِيتُ أَنْ أَمُوتَ بِالأَرْضِ الَّتِي هَاجَرْتُ مِنْهَا كَمَا مَاتَ سَعْدُ ابْنُ خَوْلَةَ ‏.‏ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ اللَّهُمَّ اشْفِ سَعْدًا اللَّهُمَّ اشْفِ سَعْدًا ‏"‏ ‏.‏ ثَلاَثَ مِرَارٍ ‏.‏ قَالَ يَا رَسُولَ اللَّهِ إِنَّ لِي مَالاً كَثِيرًا وَإِنَّمَا يَرِثُنِي ابْنَتِي أَفَأُوصِي بِمَالِي كُلِّهِ قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قَالَ فَبِالثُّلُثَيْنِ قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قَالَ فَالنِّصْفُ قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قَالَ فَالثُّلُثُ قَالَ ‏"‏ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّ صَدَقَتَكَ مِنْ مَالِكَ صَدَقَةٌ وَإِنَّ نَفَقَتَكَ عَلَى عِيَالِكَ صَدَقَةٌ وَإِنَّ مَا تَأْكُلُ امْرَأَتُكَ مِنْ مَالِكَ صَدَقَةٌ وَإِنَّكَ أَنْ تَدَعَ أَهْلَكَ بِخَيْرٍ - أَوْ قَالَ بِعَيْشٍ - خَيْرٌ مِنْ أَنْ تَدَعَهُمْ يَتَكَفَّفُونَ النَّاسَ ‏"‏ ‏.‏ وَقَالَ بِيَدِهِ ‏.‏

"I heard Allah's Messenger reciting for Fajr: And tall date palms in the first Rak'ah.
حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا وَكِيعٌ، عَنْ مِسْعَرٍ، وَسُفْيَانَ، عَنْ زِيَادِ بْنِ عَلاَقَةَ، عَنْ عَمِّهِ، قُطْبَةَ بْنِ مَالِكٍ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقْرَأُ فِي الْفَجْرِ ‏:‏ ‏(‏وَالنَّخْلَ بَاسِقَاتٍ ‏)‏ فِي الرَّكْعَةِ الأُولَى ‏.‏ قَالَ وَفِي الْبَابِ عَنْ عَمْرِو بْنِ حُرَيْثٍ وَجَابِرِ بْنِ سَمُرَةَ وَعَبْدِ اللَّهِ بْنِ السَّائِبِ وَأَبِي بَرْزَةَ وَأُمِّ سَلَمَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ قُطْبَةَ بْنِ مَالِكٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَرُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ قَرَأَ فِي الصُّبْحِ بِالْوَاقِعَةِ ‏.‏ وَرُوِيَ عَنْهُ أَنَّهُ كَانَ يَقْرَأُ فِي الْفَجْرِ مِنْ سِتِّينَ آيَةً إِلَى مِائَةٍ ‏.‏ وَرُوِيَ عَنْهُ أَنَّهُ قَرَأَ ‏:‏ ‏(‏إِذََا الشَّمْسُ كُوِّرَتْ ‏)‏ ‏.‏ وَرُوِيَ عَنْ عُمَرَ أَنَّهُ كَتَبَ إِلَى أَبِي مُوسَى أَنِ اقْرَأْ فِي الصُّبْحِ بِطِوَالِ الْمُفَصَّلِ ‏.‏ قَالَ أَبُو عِيسَى وَعَلَى هَذَا الْعَمَلُ عِنْدَ أَهْلِ الْعِلْمِ وَبِهِ قَالَ سُفْيَانُ الثَّوْرِيُّ وَابْنُ الْمُبَارَكِ وَالشَّافِعِيُّ ‏.‏

Narrated Abu Hurairah:
that the Prophet (SAW) prohibited that one use his name and his Kunyah; naming themselves Muhammad Abul-Qasim.
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنِ ابْنِ عَجْلاَنَ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم نَهَى أَنْ يَجْمَعَ أَحَدٌ بَيْنَ اسْمِهِ وَكُنْيَتِهِ وَيُسَمَّى مُحَمَّدًا أَبَا الْقَاسِمِ ‏.‏ وَفِي الْبَابِ عَنْ جَابِرٍ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَقَدْ كَرِهَ بَعْضُ أَهْلِ الْعِلْمِ أَنْ يَجْمَعَ الرَّجُلُ بَيْنَ اسْمِ النَّبِيِّ صلى الله عليه وسلم وَكُنْيَتِهِ وَقَدْ فَعَلَ ذَلِكَ بَعْضُهُمْ ‏.‏ رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ سَمِعَ رَجُلاً، فِي السُّوقِ يُنَادِي يَا أَبَا الْقَاسِمِ فَالْتَفَتَ النَّبِيُّ صلى الله عليه وسلم فَقَالَ لَمْ أَعْنِكَ ‏.‏ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏ "‏ لاَ تَكْتَنُوا بِكُنْيَتِي ‏"‏ ‏.‏ حَدَّثَنَا بِذَلِكَ الْحَسَنُ بْنُ عَلِيٍّ الْخَلاَّلُ حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ عَنْ حُمَيْدٍ عَنْ أَنَسٍ عَنِ النَّبِيِّ صلى الله عليه وسلم بِهَذَا ‏.‏ وَفِي هَذَا الْحَدِيثِ مَا يَدُلُّ عَلَى كَرَاهِيَةِ أَنْ يُكْنَى أَبَا الْقَاسِمِ ‏.‏

Narrated Anas bin Malik:

Allah's Apostle said, "When (Allah's) slave is put in his grave and his companions return and he even hears their footsteps, two angels come to him and make him sit and ask, 'What did you use to say about this man (i.e. Muhammad)?' The faithful Believer will say, 'I testify that he is Allah's slave and His Apostle.' Then they will say to him, 'Look at your place in the Hell Fire; Allah has given you a place in Paradise instead of it.' So he will see both his places." (Qatada said, "We were informed that his grave would be made spacious." Then Qatada went back to the narration of Anas who said;) Whereas a hypocrite or a non-believer will be asked, "What did you use to say about this man." He will reply, "I do not know; but I used to say what the people used to say." So they will say to him, "Neither did you know nor did you take the guidance (by reciting the Qur'an)." Then he will be hit with iron hammers once, that he will send such a cry as everything near to him will hear, except Jinns and human beings. (See Hadith No. 422).

حَدَّثَنَا عَيَّاشُ بْنُ الْوَلِيدِ، حَدَّثَنَا عَبْدُ الأَعْلَى، حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، عَنْ أَنَسِ بْنِ مَالِكٍ ـ رضى الله عنه ـ أَنَّهُ حَدَّثَهُمْ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ إِنَّ الْعَبْدَ إِذَا وُضِعَ فِي قَبْرِهِ، وَتَوَلَّى عَنْهُ أَصْحَابُهُ، وَإِنَّهُ لَيَسْمَعُ قَرْعَ نِعَالِهِمْ، أَتَاهُ مَلَكَانِ فَيُقْعِدَانِهِ فَيَقُولاَنِ مَا كُنْتَ تَقُولُ فِي الرَّجُلِ لِمُحَمَّدٍ صلى الله عليه وسلم‏.‏ فَأَمَّا الْمُؤْمِنُ فَيَقُولُ أَشْهَدُ أَنَّهُ عَبْدُ اللَّهِ وَرَسُولُهُ‏.‏ فَيُقَالُ لَهُ انْظُرْ إِلَى مَقْعَدِكَ مِنَ النَّارِ، قَدْ أَبْدَلَكَ اللَّهُ بِهِ مَقْعَدًا مِنَ الْجَنَّةِ، فَيَرَاهُمَا جَمِيعًا ‏"‏‏.‏ قَالَ قَتَادَةُ وَذُكِرَ لَنَا أَنَّهُ يُفْسَحُ فِي قَبْرِهِ‏.‏ ثُمَّ رَجَعَ إِلَى حَدِيثِ أَنَسٍ قَالَ ‏"‏ وَأَمَّا الْمُنَافِقُ وَالْكَافِرُ فَيُقَالُ لَهُ مَا كُنْتَ تَقُولُ فِي هَذَا الرَّجُلِ فَيَقُولُ لاَ أَدْرِي، كُنْتُ أَقُولُ مَا يَقُولُ النَّاسُ‏.‏ فَيُقَالُ لاَ دَرَيْتَ وَلاَ تَلَيْتَ‏.‏ وَيُضْرَبُ بِمَطَارِقَ مِنْ حَدِيدٍ ضَرْبَةً، فَيَصِيحُ صَيْحَةً يَسْمَعُهَا مَنْ يَلِيهِ، غَيْرَ الثَّقَلَيْنِ ‏"‏‏.‏

Sunan an-Nasa'i 5410
It was narrated from Abu Hurairah and Zaid bin Khalid Al-Juhani that:
Two men referred a dispute to the Messenger of Allah [SAW]. One of them said: "O Messenger of Allah, pass judgment between us according to the Book of Allah." The other, who was wiser, said: "Yes, O Messenger of Allah, and allow me to speak." He said: "My son was a laborer serving this man, and he committed Zina with his wife. They told me that my son was to be stoned to death, but I ransomed him with one hundred sheep and a slave girl of mine. Then I asked the people of knowledge, who told me that my son was to be given one hundred lashes and exiled for a year, and that his (the man's) wife was to be stoned to death." The Messenger of Allah [SAW] said: "By the One in Whose hand is my soul, I will pass judgment between you according to the Book of Allah. As for your sheep and your slave girl, take them back." Then he gave his son one hundred lashes, and exiled him for one year, and he ordered Unais to go to the wife of the other man and if she confessed, to stone her to death. She did confess, so he stoned her to death.
أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، قَالَ أَنْبَأَنَا عَبْدُ الرَّحْمَنِ بْنُ الْقَاسِمِ، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ عُتْبَةَ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ الْجُهَنِيِّ، أَنَّهُمَا أَخْبَرَاهُ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ أَحَدُهُمَا اقْضِ بَيْنَنَا بِكِتَابِ اللَّهِ ‏.‏ وَقَالَ الآخَرُ وَهُوَ أَفْقَهُهُمَا ‏.‏ أَجَلْ يَا رَسُولَ اللَّهِ وَائْذَنْ لِي فِي أَنْ أَتَكَلَّمَ ‏.‏ قَالَ إِنَّ ابْنِي كَانَ عَسِيفًا عَلَى هَذَا فَزَنَى بِامْرَأَتِهِ فَأَخْبَرُونِي أَنَّ عَلَى ابْنِي الرَّجْمَ فَافْتَدَيْتُ بِمِائَةِ شَاةٍ وَبِجَارِيَةٍ لِي ثُمَّ إِنِّي سَأَلْتُ أَهْلَ الْعِلْمِ فَأَخْبَرُونِي أَنَّمَا عَلَى ابْنِي جَلْدُ مِائَةٍ وَتَغْرِيبُ عَامٍ وَإِنَّمَا الرَّجْمُ عَلَى امْرَأَتِهِ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ وَالَّذِي نَفْسِي بِيَدِهِ لأَقْضِيَنَّ بَيْنَكُمَا بِكِتَابِ اللَّهِ أَمَّا غَنَمُكَ وَجَارِيَتُكَ فَرَدٌّ إِلَيْكَ ‏"‏ ‏.‏ وَجَلَدَ ابْنَهُ مِائَةً وَغَرَّبَهُ عَامًا وَأَمَرَ أُنَيْسًا أَنْ يَأْتِيَ امْرَأَةَ الآخَرِ ‏"‏ فَإِنِ اعْتَرَفَتْ فَارْجُمْهَا ‏"‏ ‏.‏ فَاعْتَرَفَتْ فَرَجَمَهَا ‏.‏

Narrated Salim al-Makki:

That a bedouin told him that he brought a milch she-camel in the time of the Messenger of Allah (saws). He alighted with Talhah ibn Ubaydullah (and wanted to sell his milch animal to him). He said: The Prophet (saws) forbade a townsman to sell for a man from the desert. But go to the market and see who buys from you. consult me thereafter, and then I shall ask you (to sell) or forbid you.

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا حَمَّادٌ، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، عَنْ سَالِمٍ الْمَكِّيِّ، أَنَّ أَعْرَابِيًّا، حَدَّثَهُ أَنَّهُ، قَدِمَ بِحَلُوبَةٍ لَهُ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَنَزَلَ عَلَى طَلْحَةَ بْنِ عُبَيْدِ اللَّهِ فَقَالَ إِنَّ النَّبِيَّ صلى الله عليه وسلم نَهَى أَنْ يَبِيعَ حَاضِرٌ لِبَادٍ وَلَكِنِ اذْهَبْ إِلَى السُّوقِ فَانْظُرْ مَنْ يُبَايِعُكَ فَشَاوِرْنِي حَتَّى آمُرَكَ أَوْ أَنْهَاكَ ‏.‏

Shaqiq bin Salamah reported:
Ibn Mas'ud (May Allah be pleased with him) used to preach to us once every Thursday. A man said to him: "O Abu 'Abdur-Rahman, we love your talk and we wish that you preach us every day." He said: "There is nothing to prevent me from doing so, but I don't lest I bore you. I follow the same method in preaching to you that Messenger of Allah (PBUH) adopted in preaching to us for fear of boredom."

Narrated Abu Wail:

`Abdullah used to give a religious talk to the people on every Thursday. Once a man said, "O Aba `Abdur-Rahman! (By Allah) I wish if you could preach us daily." He replied, "The only thing which prevents me from doing so, is that I hate to bore you, and no doubt I take care of you in preaching by selecting a suitable time just as the Prophet used to do with us, for fear of making us bored."

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، قَالَ حَدَّثَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ أَبِي وَائِلٍ، قَالَ كَانَ عَبْدُ اللَّهِ يُذَكِّرُ النَّاسَ فِي كُلِّ خَمِيسٍ، فَقَالَ لَهُ رَجُلٌ يَا أَبَا عَبْدِ الرَّحْمَنِ لَوَدِدْتُ أَنَّكَ ذَكَّرْتَنَا كُلَّ يَوْمٍ‏.‏ قَالَ أَمَا إِنَّهُ يَمْنَعُنِي مِنْ ذَلِكَ أَنِّي أَكْرَهُ أَنْ أُمِلَّكُمْ، وَإِنِّي أَتَخَوَّلُكُمْ بِالْمَوْعِظَةِ كَمَا كَانَ النَّبِيُّ صلى الله عليه وسلم يَتَخَوَّلُنَا بِهَا، مَخَافَةَ السَّآمَةِ عَلَيْنَا‏.‏

(the wife of the Prophet) The Prophet ordered all his wives to finish their Ihram during the year of Hajjat-ul-Wada`. On that, I asked the Prophet "What stops you from finishing your lhram?" He said, "I have matted my hair and garlanded my Hadi. So I will not finish my Ihram unless I have slaughtered my Hadi."

Ibn 'Abbas (May Allah be pleased with them) reported:
'Umar bin Al- Khattab (May Allah be pleased with him) set out for Ash-Sham (the region comprising Syria, Palestine, Lebanon and Jordan). As he reached at Sargh (a town by the side of Hijaz) he came across the governor of Al-Ajnad, Abu 'Ubaidah bin Al-Jarrah (May Allah be pleased with him) and his companions. They informed him that an had broken out in Syria. Ibn 'Abbas relates: 'Umar (May Allah be pleased with him) said to me: "Call to me the earliest Muhajirun (Emigrants)." So I called them. He sought their advice and told them that an epidemic had broken out in Ash-Sham. There was a difference of opinion whether they should proceed further or retreat to their homes in such a situation. Some of them said: "You have set forth to fight the enemy, and therefore you should not go back;" whereas some of them said: "As you have along with you many eminent Companions of Messenger of Allah (PBUH), we would not advice you to set forth to the place of the plague (and thus expose them deliberately to a danger)." 'Umar (May Allah be pleased with him) said: "You can now go away." He said: "Call to me the Ansar (the Helpers)." So I called them to him, and he consulted them and they differed in their opinions as well. He said: "Now, you may go." He again said: "Call the old (wise people) of the Quraish who had emigrated before the conquest of Makkah." I called them. 'Umar (May Allah be pleased with him) consulted them in this issue and not even two persons among them differed in the opinions. They said: "We think that you should go back along with the people and do not take them to this scourge. 'Umar (May Allah be pleased with him) made an announcement to the people, saying: "In the morning I intend to go back, and I want you to do the same." Abu 'Ubaidah bin Al-Jarrah (May Allah be pleased with him) said: "Are you going to run away from the Divine Decree?" Thereupon 'Umar (May Allah be pleased with him) said: "O Abu 'Ubaidah ! Had it been someone else to say this." ('Umar (May Allah be pleased with him) did not like to differ with him). He said: "Yes, we are running from the Divine Decree to the Divine Decree. What do you think if you have camels and you happen to get down a valley having two sides, one of them covered with foliage and the other being barren, will you not act according to the Divine Decree if you graze them in vegetative land? In case you graze them in the barren land, even then you will be doing ...
وعن ابن عباس رضي الله عنه أن عمر بن الخطاب رضي الله عنه خرج إلى الشام حتى إذا كان بسرغ لقيه أمراء الأجناد -أبو عبيدة بن الجراح وأصحابه- فأخبروه أن الوباء قد وقع بالشام، قال بن عباس‏:‏ فقال عمر‏:‏ ادع لي المهاجرين الأولين، فدعوتهم، فاستشارهم، وأخبرهم أن الوباء قد وقع بالشام، فاختلفوا، فقال بعضهم‏:‏ خرجت لأمر، ولا نرى أن ترجع عنه‏.‏ وقال بعضهم‏:‏ معك بقية الناس وأصحاب رسول الله صلى الله عليه وسلم ، ولا نرى أن تقدمهم على هذا الوباء‏.‏ فقال‏:‏ ارتفعوا عني، ثم قال‏:‏ ادع لي الأنصار، فدعوتهم، فاستشارهم، فسلكوا سبيل المهاجرين، واختلفوا كاختلافهم، فقال‏:‏ ارتفعوا عني، ثم قال‏:‏ ادع لي من كان ها هنا من مشيخة قريش من مهاجرة الفتح، فدعوتهم، فلم يختلف عليه منهم رجلان، فقالوا‏:‏ نرى أن ترجع بالناس، ولا تقدمهم على هذا الوباء، فنادى عمر رضي الله عنه في الناس‏:‏ إني مصبح على ظهر، فأصبحوا عليه فقال أبو عبيدة بن الجراح رضي الله عنه ‏:‏ أفرار من قدر الله‏؟‏ فقال عمر رضي الله عنه ‏:‏ لو غيرك قالها يا أبا عبيدة‏!‏ -وكان عمر يكره خلافه- نعم نفر من قدر الله إلى قدر الله، أرأيت لو كان لك إبل، فهبطت وادياً له عدوتان، إحداهما خصبة، والأخرى جدبة، أليس إن رعيت الخصبة رعيتها بقدر الله، وإن رعيت الجدبة رعيتها بقدر الله‏؟‏ قال‏:‏ فجاء عبد الرحمن بن عوف رضي الله عنه ، وكان متغيباً في بعض حاجته، فقال‏:‏ إن عندي من هذا علما، سمعت رسول الله صلى الله عليه وسلم يقول‏:‏ “إذا سمعتم به بأرض، فلا تقدموا عليه، وإذا وقع بأرض وأنتم بها، فلا تخرجوا فرارا منه‏"‏ فحمد الله تعالى عمر رضي الله عنه وانصرف‏.‏ ‏(‏‏(‏متفق عليه‏)‏‏)‏‏.‏

he said that two men laid claim to an animal, and neither of them had any proof, so the Prophet (SAW) commanded them to cast lots as to which of them should swear an oath.

Narrated Ibn `Umar:

The Prophet forbade that a man should be made to get up from his seat so that another might sit on it, but one should make room and spread out. Ibn `Umar disliked that a man should get up from his seat and then somebody else sit at his place.

Yahya related to me from Malik from Yahya ibn Said that Abu Nahshal ibn al-Aswad said to al-Qasim ibn Muhammad,"I saw a slave-girl of mine uncovered in the moonlight, and so I sat on her as a man sits on a woman. She said that she was menstruating, so I stood up and have not gone near her after that. Can I give her to my son to have intercourse with?" Al-Qasim forbade that.

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّ أَبَا نَهْشَلِ بْنَ الأَسْوَدِ، قَالَ لِلْقَاسِمِ بْنِ مُحَمَّدٍ إِنِّي رَأَيْتُ جَارِيَةً لِي مُنْكَشِفًا عَنْهَا وَهِيَ فِي الْقَمَرِ فَجَلَسْتُ مِنْهَا مَجْلِسَ الرَّجُلِ مِنِ امْرَأَتِهِ فَقَالَتْ إِنِّي حَائِضٌ فَقُمْتُ فَلَمْ أَقْرَبْهَا بَعْدُ أَفَأَهَبُهَا لاِبْنِي يَطَؤُهَا فَنَهَاهُ الْقَاسِمُ عَنْ ذَلِكَ ‏.‏

Yahya related to me from Malik from Jafar ibn Muhammad from his father that Ali ibn Abi Talib said, "When a man takes a vow to abstain from intercourse, divorce does not occur immediately. If four months pass, he must declare his intent and either he is divorced or he revokes his vow . "

Malik said, "That is what is done among us."

Sahih Muslim 150 e

Sa'd reported that the Messenger of Allah (may peace be upon him) bestowed (some gifts) upon a group of people and I was sitting amongst them. The Messenger of Allah (may peace be upon him), however, left a person and he did not give him anything. and he seemed to me the most excellent among them (and thus deserved the gifts more than anyone else). So I stood up before the Messenger of Allah (may peace be upon him) and said to him in undertone:

Messenger of Allah, what about so and so? By Allah, I find him a believer. He (the Messenger of Allah) said: He may be a Muslim. I kept quiet for a short while, and then what I knew of him urged me (to plead his case again) and I said: Messenger of Allah, what about so and so? By Allah, I find him a believer. Upon this he (the Holy Prophet) said: He may be a Muslim. I again remained quiet for a short while, and what I knew of him again urged me (to plead his case so I) said: Messenger of Allah, what about so and so? By Allah, I find him a believer. Upon this he (the Holy Prophet) said: He may be a Muslim. I often bestow (something) upon a person, whereas someone else is dearer to me than he, because of the fear that he may fall headlong into the fire. And in the hadith transmitted by Hulwani this statement was repeated twice.
حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ الْحُلْوَانِيُّ، وَعَبْدُ بْنُ حُمَيْدٍ، قَالاَ حَدَّثَنَا يَعْقُوبُ، - وَهُوَ ابْنُ إِبْرَاهِيمَ بْنِ سَعْدٍ - حَدَّثَنَا أَبِي، عَنْ صَالِحٍ، عَنِ ابْنِ شِهَابٍ، أَخْبَرَنِي عَامِرُ بْنُ سَعْدٍ، عَنْ أَبِيهِ، سَعْدٍ أَنَّهُ أَعْطَى رَسُولُ اللَّهِ صلى الله عليه وسلم رَهْطًا وَأَنَا جَالِسٌ فِيهِمْ قَالَ فَتَرَكَ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْهُمْ رَجُلاً لَمْ يُعْطِهِ وَهُوَ أَعْجَبُهُمْ إِلَىَّ فَقُمْتُ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَارَرْتُهُ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا لَكَ عَنْ فُلاَنٍ وَاللَّهِ إِنِّي لأَرَاهُ مُؤْمِنًا ‏.‏ قَالَ ‏"‏ أَوْ مُسْلِمًا ‏"‏ ‏.‏ فَسَكَتُّ قَلِيلاً ثُمَّ غَلَبَنِي مَا أَعْلَمُ مِنْهُ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا لَكَ عَنْ فُلاَنٍ فَوَاللَّهِ إِنِّي لأَرَاهُ مُؤْمِنًا ‏.‏ قَالَ ‏"‏ أَوْ مُسْلِمًا ‏"‏ ‏.‏ فَسَكَتُّ قَلِيلاً ثُمَّ غَلَبَنِي مَا أَعْلَمُ مِنْهُ فَقُلْتُ يَا رَسُولَ اللَّهِ مَا لَكَ عَنْ فُلاَنٍ فَوَاللَّهِ إِنِّي لأَرَاهُ مُؤْمِنًا ‏.‏ قَالَ ‏"‏ أَوْ مُسْلِمًا ‏"‏ ‏.‏ قَالَ ‏"‏ إِنِّي لأُعْطِي الرَّجُلَ ‏.‏ وَغَيْرُهُ أَحَبُّ إِلَىَّ مِنْهُ خَشْيَةَ أَنْ يُكَبَّ فِي النَّارِ عَلَى وَجْهِهِ ‏"‏ ‏.‏ وَفِي حَدِيثِ الْحُلْوَانِيِّ تَكْرَارُ الْقَوْلِ مَرَّتَيْنِ ‏.‏

Amir bin Sa'd bin Abi Waqqas narrated from his father, who said:
"I was ill during the year of the Conquest (of Makkah) with an illness bringing me to the brink of death. So The Messenger of Allah (S.A.W) came to visit me, and I said: 'O Messenger of Allah (S.A.W)! Indeed I have a great deal of wealth and I do not have any heirs except my daughter, so should I will all of my wealth?' He said: 'No.' I said: 'Then two-thirds of my wealth?' He said: 'No.' I said: 'Then half?' He said: 'No.' I said: 'Then a third' He said: 'No.' A third and a third is too much. If you leave your heirs without need it is better than to leave them in poverty begging from the people. Indeed you do not do any spending (on your family) except that you are rewarded for it, even the morsel of food you raise to your wife's mouth.'" He said: "I said: 'Will I be left behind from my emigration?' He said: 'You will not be left behind after me,and do righteous deeds intending Allah's Face, except that it will add to your elevation in rank. Perhaps you will remain until some people benefit from you and others will be harmed by you. O Allah! Complete the emigration of my companions and do not turn them on their heels. But the case of Sa'd bin Khawlah is sad.'" the Messenger of Allah (S.A.W) felt sorry for him dying in Makkah.
حَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ بْنُ عُيَيْنَةَ، عَنِ الزُّهْرِيِّ، عَنْ عَامِرِ بْنِ سَعْدِ بْنِ أَبِي وَقَّاصٍ، عَنْ أَبِيهِ، قَالَ مَرِضْتُ عَامَ الْفَتْحِ مَرَضًا أَشْفَيْتُ مِنْهُ عَلَى الْمَوْتِ فَأَتَانِي رَسُولُ اللَّهِ صلى الله عليه وسلم يَعُودُنِي فَقُلْتُ يَا رَسُولَ اللَّهِ إِنَّ لِي مَالاً كَثِيرًا وَلَيْسَ يَرِثُنِي إِلاَّ ابْنَتِي أَفَأُوصِي بِمَالِي كُلِّهِ قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قُلْتُ فَثُلُثَىْ مَالِي قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قُلْتُ فَالشَّطْرُ قَالَ ‏"‏ لاَ ‏"‏ ‏.‏ قُلْتُ فَالثُّلُثُ قَالَ ‏"‏ الثُّلُثُ وَالثُّلُثُ كَثِيرٌ إِنَّكَ إِنْ تَدَعْ وَرَثَتَكَ أَغْنِيَاءَ خَيْرٌ مِنْ أَنْ تَدَعَهُمْ عَالَةً يَتَكَفَّفُونَ النَّاسَ وَإِنَّكَ لَنْ تُنْفِقَ نَفَقَةً إِلاَّ أُجِرْتَ فِيهَا حَتَّى اللُّقْمَةَ تَرْفَعُهَا إِلَى فِي امْرَأَتِكَ ‏"‏ ‏.‏ قَالَ قُلْتُ يَا رَسُولَ اللَّهِ أُخَلَّفُ عَنْ هِجْرَتِي قَالَ ‏"‏ إِنَّكَ لَنْ تُخَلَّفَ بَعْدِي فَتَعْمَلَ عَمَلاً تُرِيدُ بِهِ وَجْهَ اللَّهِ إِلاَّ ازْدَدْتَ بِهِ رِفْعَةً وَدَرَجَةً وَلَعَلَّكَ أَنْ تُخَلَّفَ حَتَّى يَنْتَفِعَ بِكَ أَقْوَامٌ وَيُضَرَّ بِكَ آخَرُونَ اللَّهُمَّ أَمْضِ لأَصْحَابِي هِجْرَتَهُمْ وَلاَ تَرُدَّهُمْ عَلَى أَعْقَابِهِمْ لَكِنِ الْبَائِسُ سَعْدُ ابْنُ خَوْلَةَ يَرْثِي لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ مَاتَ بِمَكَّةَ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنِ ابْنِ عَبَّاسٍ ‏.‏ وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ هَذَا الْحَدِيثُ مِنْ غَيْرِ وَجْهٍ عَنْ سَعْدِ بْنِ أَبِي وَقَّاصٍ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ أَنَّهُ لَيْسَ لِلرَّجُلِ أَنْ يُوصِيَ بِأَكْثَرَ مِنَ الثُّلُثِ وَقَدِ اسْتَحَبَّ بَعْضُ أَهْلِ الْعِلْمِ أَنْ يَنْقُصَ مِنَ الثُّلُثِ لِقَوْلِ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏"‏ وَالثُّلُثُ كَثِيرٌ ‏"‏ ‏.‏

It was narrated from Aban bin `Uthman (رضي الله عنه) that he narrated from `Uthman (رضي الله عنه) that the Messenger of Allah (ﷺ) granted a concession, or said concerning the pilgrim in ihram, if he has a problem in his eyes, that he may apply aloes to them.

It was narrated from ‘Abdullah bin ‘Amr that the Prophet (saw) was asked about a man who slaughtered his sacrifice before shaving his head, or who shaved his head before slaughtering his sacrifice, and he said:
“There is no harm in that.”

Yahya related to me from Malik from Yunus ibn Yusuf from Said ibn al-Musayyab that Umar ibn al-Khattab passed by Hatab ibn Abi Baltaa who was underselling some of his raisins in the market. Umar ibn al- Khattab said to him, "Either increase the price or leave our market."

Narrated Ibn `Umar:

Allah's Apostle forbade Ash-Shighar, which means that somebody marries his daughter to somebody else, and the latter marries his daughter to the former without paying Mahr.

Yahya related to me from Malik from Yahya ibn Said from Adi ibn Thabit al-Ansari that Abdullah ibn Yazid al-Khatmi told him that Abu Ayyub al-Ansari told him that he prayed maghrib and isha together at Muzdalifa during the farewell hajj, with the Messenger of Allah, may Allah bless him and grant him peace.

A person came to the Messenger of Allah (may peace be upon him) and said: Messenger of Allah, what do you think if a man comes to me in order to appropriate my possession? He (the Holy Prophet) said: Don't surrender your possession to him. He (the inquirer) said: If he fights me? He (the Holy Prophet) remarked: Then fight (with him). He (the inquirer) again said: What do you think if I am killed? He (the Holy Prophet) observed: You would be a martyr. He (the inquirer) said: What do you think of him (Messenger of Allah) If I kill him. He (the Holy Prophet) said: he would be in the Fire.

It is transmitted in Sharh as-sunna that Safwan b. Umayya came to Medina and slept in the mosque, using his cloak as a pillow. A thief came and took his cloak and Safwan seized him and brought him to God’s Messenger who ordered that his hand should be cut off. Safwan then said, "This was not my intention. I give it to him as sadaqa.” God’s Messenger replied, "Why did you not do so before bringing him to me?” Ibn Majah transmitted something similar on the authority of ‘Abdallah b. Safwan who quoted his father’s authority, and Darimi did so also on the authority of Ibn ‘Abbas.
وَرُوِيَ فِي «شَرْحِ السُّنَّةِ» : أَنَّ صَفْوَانَ بْنَ أُمَيَّةَ قَدِمَ الْمَدِينَةَ فَنَامَ فِي الْمَسْجِدِ وَتَوَسَّدَ رِدَاءَهُ فَجَاءَ سَارِقٌ وَأَخَذَ رِدَاءَهُ فَأَخَذَهُ صَفْوَانُ فَجَاءَ بِهِ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَأَمَرَ أَنْ تُقْطَعَ يَدُهُ فَقَالَ صَفْوَانُ: إِنِّي لَمْ أُرِدْ هَذَا هُوَ عَلَيْهِ صَدَقَةٌ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «فَهَلا قبل أَن تَأتِينِي بِهِ» وَرَوَى نَحْوَهُ ابْنُ مَاجَهْ عَنْ عَبْدِ اللَّهِ بن صَفْوَان عَن أَبِيه والدارمي عَن ابْن عَبَّاس

‘Amr b. Shu'aib, on his father’s authority, said that his grandfather told of a woman who said, “Messenger of God, I have taken a vow to play the tambourine over you,” to which he replied, “Fulfil your vow.” Abu Dawud transmitted it. Razin added that she said, “And I have taken a vow to perform a sacrifice in such and such a place,” a place in which people had performed sacrifices in pre-Islamic times. He asked whether that place contained any idol worshipped in pre-Islamic times, and she replied that it did not. He asked whether any pre-Islamic festival was observed there, and she replied that none was. He then said, “Fulfil your vow.” Razin
وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جده رَضِي الله عَنهُ أَنَّ امْرَأَةً قَالَتْ: يَا رَسُولَ اللَّهِ إِنِّي نَذَرْتُ أَنْ أَضْرِبَ عَلَى رَأْسِكَ بِالدُّفِّ قَالَ: «أَوْفِي بِنَذْرِكِ» . رَوَاهُ أَبُو دَاوُدَ

وَزَادَ رَزِينٌ: قَالَتْ: وَنَذَرْتُ أَنْ أَذْبَحَ بِمَكَانِ كَذَا وَكَذَا مَكَانٌ يَذْبَحُ فِيهِ أَهْلُ الْجَاهِلِيَّةِ فَقَالَ: «هَلْ كَانَ بِذَلِكِ الْمَكَانِ وَثَنٌ مِنْ أَوْثَانِ الْجَاهِلِيَّةِ يُعْبَدُ؟» قَالَتْ: لَا قَالَ: «هَلْ كَانَ فِيهِ عِيدٌ مِنْ أَعْيَادِهِمْ؟» قَالَتْ: لَا قَالَ: «أَوْفِي بِنَذْرِك»

It was narrated that 'Ubaid bin 'Umair said:
"Aishah heard that 'Abdullah bin 'Amr was telling his wives to undo their braids (when they bathed). She said: 'How odd that Ibn 'Amr would do that! Why does he not tell them to shave their heads? The Messenger of Allah and I used to bathe from a single vessel, and I never did more than pour three handfuls of water over my head.'"
حَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا إِسْمَاعِيلُ ابْنُ عُلَيَّةَ، عَنْ أَيُّوبَ، عَنْ أَبِي الزُّبَيْرِ، عَنْ عُبَيْدِ بْنِ عُمَيْرٍ، قَالَ بَلَغَ عَائِشَةَ أَنَّ عَبْدَ، اللَّهِ بْنَ عَمْرٍو يَأْمُرُ نِسَاءَهُ إِذَا اغْتَسَلْنَ أَنْ يَنْقُضْنَ رُءُوسَهُنَّ فَقَالَتْ يَا عَجَبًا لاِبْنِ عَمْرٍو هَذَا أَفَلاَ يَأْمُرُهُنَّ أَنَّ يَحْلِقْنَ رُءُوسَهُنَّ لَقَدْ كُنْتُ أَنَا وَرَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ نَغْتَسِلُ مِنْ إِنَاءٍ وَاحِدٍ فَلاَ أَزِيدُ عَلَى أَنْ أُفْرِغَ عَلَى رَأْسِي ثَلاَثَ إِفْرَاغَاتٍ ‏.‏
