"We set out as pilgrims and came to Al-Madinah intending to perform Hajj. While we were in our camping place unloading our mounts, someone came to us and said: 'The people have gathered in the Masjid and there is panis.' So we set out and found the people gathered around a group in the middle of the Masjid, among whom were 'Ali, Zubayr, Talhah and Sa'd bin Abi Waqas. While we were like that, 'Uthman, may Allah be pleased with him, came, wearing a yellow cloak with which he had covered his head. He said: 'Is Talhah here? Is Az-Zubair here? Is Sa'd here?' They said: 'Yes.' He said: 'I adjure you be the One beside Whom there is none worthy of worship, din't the Messenger of Allah (PBUH) say: Whoever buys the Mirbad [1] of Banu so-and so, Allah will forgive him, and I bought it for twenty or twenty-five thousand, then I came to the Messenger of Allah (PBUH) and told him, and he said: Add it to our Masjid and the reward for it will be yours?' They said: 'By Allah, yes.' He said: 'I adjure you by the One beside Whom there is none worthy of worship, didn't the Messenger of Allah (PBUH) say: Whoever buys the well of Rumah, Allah will forgive him, so I bought it for such and such and amount, then I came to the Messenger of Allah (PBUH) and told him, and he said: Give it to provide water for the Muslims, and the reward for it will be yours?' that he was with some people on a journey, and a man among the people sneezed and he said: "As-Salamu Alaikum (peace be upon you)." So he (Salim) said: "'Alaika Wa 'Ala Ummik (upon you and upon your mother)." It seemed as if that bothered the man, so he said: "Indeed I have not said except what the Prophet (SAW) said; a man sneezed in the presence of the Prophet (SAW) and said: 'As-Salamu 'Alaikum (peace be upon you)' so the Prophet (SAW) said: ''Alaika Wa 'Ala Ummik (upon you and upon your mother). While we were in the city of Hims (in Syria), Ibn Mas`ud recited Surat Yusuf. A man said to him), "It was not revealed in this way." Then Ibn Mas`ud said, "I recited it in this way before Allah's Apostle and he confirmed my recitation by saying, 'Well done!' " Ibn Mas`ud detected the smell of wine from the man's mouth, so he said to him, "Aren't you ashamed of telling a lie about Allah's Book and (along with this) you drink alcoholic liquors too?" Then he lashed him according to the law.

Sulaiman bin Buraidah narrated on the authority of his father on the authority of 'A’ishah (RAA), “Whenever Allah’s Messenger appointed a commander over an army or a Sariyah, he would instruct him to fear Allah in his own behavior and consider the welfare of the Muslims who were with him. He then used to say “Go out for Jihad in Allah’s name, in the Cause of Allah, and fight those who disbelieve in Allah. Go out for Jihad and do not indulge in Ghulul, or be treacherous or mutilate (dead bodies) or kill a child. When you meet your enemy, or the polytheists, invite them to three courses of action, and accept whichever of them they are willing to agree to, and withhold from doing anything else:
Call them to Islam, and if they agree accept it from them. Then invite them to migrate from their land to the land of the Emigrants (i.e. al-Madinah), if they refuse, then tell them they will be like the Muslim desert Arabs, thus they will have no right in the Ghanimah or Fai’ unless they participate in Jihad with the Muslims. If they refuse (to accept Islam) order them to pay the Jizyah and if they agree, accept it from them. If they refuse, seek Allah, the Most High’s help against them and fight them. When you besiege a fortress, and its people wish you to grant them the protection of Allah and His Prophet, grant them neither but grant them your protection, for it is less serious (a lesser guilt) to break your guarantee of protection than to break that of Allah’s. And if they offer to capitulate under the condition that they are subjected to the judgment of Allah, do not grant them this, but judge according to your own command, for you do not know whether or not you will be able to carry out Allah, the Most High’s Judgment regarding them.” Related by Muslim.

Narrated Hafsa:

(On `Id) We used to forbid our virgins to go out (for `Id prayer). A lady came and stayed at the fortress of Bani Khalaf. She mentioned that her sister was married to one of the companions of Allah's Apostle who participated in twelve Ghazawats along with Allah's Apostle and her sister was with him in six of them. She said, "We used to dress the wounded and look after the patients." She (her sister) asked Allah's Apostle , "Is there any harm for a woman to stay at home if she doesn't have a veil?" He said, "She should cover herself with the veil of her companion and she should take part in the good deeds and in the religious gatherings of the believers." When Um 'Atiyya came, I asked her. "Did you hear anything about that?" Um 'Atiyya said, "Bi Abi" and she never mentioned the name of Allah's Apostle without saying "Bi Abi" (i.e. 'Let my father be sacrificed for you'). We asked her, "Have you heard Allah's Apostle saying so and so (about women)?" She replied in the affirmative and said, "Let my father be sacrificed for him. He told us that unmarried mature virgins who stay often screened or unmarried young virgins and mature girls who stay often screened should come out and take part in the good deeds and in the religious gatherings of the believers. But the menstruating women should keep away from the Musalla (praying place)." I asked her, "The menstruating women?" She replied, "Don't they present themselves at `Arafat and at such and such places?"

Sahl b. Sa'd reported:

An Arab woman was mentioned before Allah's Messenger (may peace be upon him). He commanded Abu Usaid to send a message to her and he (accordingly) sent a message to her. She came and stayed in the fortresses of Banu Sa'idah. Allah's Messenger (may peace be upon him) went out until he came to her while she was (at that time) sitting with her head downcast. When Allah's Messenger (may peace be upon him) talked to her, she said: I seek refuge with Allah from you. Thereupon he said: I (have decided to) keep you away from me. They (the people near her) said: Do you know who he is? She said: No. They said: He is the Messenger of Allah (may peace be upon him). He came to you in order to give you the proposal of marriage. She said: Then I am the most unfortunate woman because of this (i. e. my defiance). Sahl said: Allah's. Messenger (may peace be upon him) then set forth on that day until he sat in the Saqifa of Banu Sa'idah along with his Companions. He then said to Sahl: Serve us drink. Sunan Abi Dawud 2612

Sulaiman bin Buraidah reported on the authority of his father. When the Apostle of Allaah(saws) appointed a Commander over an Army or a detachment, he instructed him to fear Allaah himself and consider the welfare of the Muslims who were with him. He then said “When you meet the polytheists who are your enemy, summon them tone of three things and accept whichever of them they are willing to agree to, and refrain from them. Summon them to Islam and if they agree, accept it from them and refrain from them. Then summon them to leave their territory and transfer to the abode of the Emigrants and tell them that if they do so, they will have the same rights and responsibilities as the Emigrants, but if they refuse and choose their own abode, tell them that they will be like the desert Arabs who are Muslims subject to Allaah’s jurisdiction which applies to the believers, but will have no spoil or booty unless they strive with the Muslims. If they refuse demand jizyah (poll tax) from them, if they agree accept it from them and refrain from them. But if they refuse, seek Alaah’s help and fight with them. When you invade the fortress and they (its people) offer to capitulate and have the matter referred to Allaah’s jurisdiction, do not grant this, for you do not know whether or not you will hit on Allaah’s jurisdiction regarding them. But let them capitulate and have the matter refereed to your jurisdiction and make a decision about them later on as you wish.

Sufyan (bin ‘Uyainah) said thah ‘Alqamah said “I mentioned this tradition to Muqatil bin Habban, He said “Muslim narrated it to me.” Abu Dawud said “He is Ibn Haidam narrated from Al Nu’man in Muqqarin from the Prophet (saws) like the tradition of Sulaiman bin Buraidah.

Yahya related to me from Malik from Said ibn Abi Said al-Maqburi from Abu Shurayh al-Kabi that the Messenger of Allah, may Allah bless him and grant him peace, said, "Whoever believes in Allah and the Last Day should speak good or be silent. Whoever believes in Allah and the Last Day should be generous to his neighbour. Whoever believes in Allah and the Last Day, should be generous to his guest. His welcome is for a day and a night, and his hospitality is for three days. Whatever is more than that is sadaqa. It is not halal for a guest to stay with a man until he becomes a burden."

Narrated Anas (bin Malik):

Ar-Rubai (the paternal aunt of Anas bin Malik) broke the incisor tooth of young Ansari girl. Her family demanded the Qisas and they came to the Prophet who passed the judgment of Qisas. Anas bin An-Nadr (the paternal uncle of Anas bin Malik) said, "O Allah's Apostle! By Allah, her tooth will not be broken." The Prophet said, "O Anas! (The law prescribed in) Allah's Book is Qisas." But the people (i.e. the relatives of the girl) gave up their claim and accepted a compensation. On that Allah's Apostle said, "Some of Allah's worshippers are such that if they take an oath, Allah will fulfill it for them."

Malik said, "It is not halal to eat any game that has been hunted in the Haram, or has had a dog set after it in the Haram and then been killed outside the Haram. Anyone that does that has to pay a forfeit for what has been hunted. However, some one that sets his dog after game outside the Haram and then follows it until it is hunted down in the Haram does not have to pay any forfeit, unless he set the dog after the game near to the Haram. The game should not be eaten, however. If he set the dog loose near the Haram then he has to pay a forfeit for the game."

It was narrated that An-Nu'man bin Bashir said:
"I heard the Messenger of Allah [SAW] say: 'That which is lawful is clear and that which is unlawful is clear, but between them there are matters which are doubtful.'" And sometimes he said: "But between them are matters that are not as clear. I will describe the likeness of that for you. Allah, the Mighty and Sublime, has a sanctuary and the sanctuary of Allah is that which He has forbidden. Whoever grazes around the sanctuary will soon transgress into the sanctuary. And whoever approaches a matter that is unclear, he will soon wind up in the sanctuary." And sometimes he said: "He will soon transgress, and indeed whoever mixes in doubt, he will soon cross into it."

Ibn Abbas narrated:
“I entered with the Messenger of Allah (saws), I and Khalid bin Al-Walid, upon Maimunah so she brought us a vessel of milk. The Messenger of Allah (saws) drank from it. I was upon his right and Khalid was upon left, so he said to me: ‘The (turn to) drink is for you, so if you wish, you could choose to grant it to Khalid.’ So I said: ‘I would not prefer anyone (above myself) for your leftovers.’ Then the Messenger of Allah (saws) said: ‘Whoever Allah feeds some food, then let him say: “O Allah, bless it for us, and feed us better than it, (Allāhumma bārik lanā fīhi wa aṭ`imnā khairan minhu)” and whomsoever Allah gives milk to drink, then let him say: “O Allah bless it for us, and grant us increase in it (Allāhumma bārik lanā fīhi wa zidnā minhu).” And the Messenger of Allah (saws) said, ‘There is nothing that suffices in the place of food and drink except for milk.’”

Yahya related to me from Malik that he had heard the same as that from al-Qasim ibn Muhammad from Ibn Muayqib ad-Dawsi.

Malik said, "This is the way of doing things among us . "

Malik said, "The generally agreed on way of doing things among us is that wheat is not sold for wheat, dates for dates, wheat for dates, dates for raisins, wheat for raisins, nor any kind of food sold for food at all, except from hand to hand. If there is any sort of delayed terms in the transaction, it is not good. It is haram. Condiments are not bartered except from hand to hand."

Malik said, "Food and condiments are not bartered when they are the same type, two of one kind for one of the other. A mudd of wheat is not sold for two mudds of wheat, nor a mudd of dates for two mudds of dates, nor a mudd of raisins for two mudds of raisins, nor is anything of that sort done with grains and condiments when they are of one kind, even if it is hand to hand.

"This is the same position as silver for silver and gold for gold. No increase is halal in the transaction, and only like for like, from hand to hand is halal."

Malik said, "If there is a clear difference in foodstuffs which are measured and weighed, there is no harm in taking two of one kind for one of another, hand to hand. There is no harm in taking a sa of dates for two sa of wheat, and a sa of dates for two sa of raisins, and a sa of wheat for two sa of ghee. If the two sorts in the transaction are different, there is no harm in two for one or more than that from hand to hand. If delayed terms enter into the sale, it is not halal ."

Malik said, "It is not halal to trade a heap of wheat for a heap of wheat. There is no harm in a heap of wheat for a heap of dates, from hand to hand. That is because there is no harm in buying wheat with dates without precise measurement."

Malik said, "With kinds of foods and condiments that differ from each other, and the difference is clear, there is no harm in bartering one kind for another, without precise measurement from hand to hand. If delayed terms enter into the sale, there is no good in it. Bartering such things without precise measurement is like buying it with gold and silver without measuring precisely."

Malik said, "That is because you buy wheat with silver without measuring precisely, and dates with gold without measuring precisely, and it is halal. There is no harm in it."

Malik said, "It is not good for someone to make a heap of food, knowing its measure and then to sell it as if it had not been measured precisely, concealing its measure from the buyer. If the buyer wants to return that food to the seller, he can, because he concealed its measure and so it is an uncertain transaction. This is done with any kind of food or other goods whose measure and number the seller knows, and which he then sells without measurement and the buyer does not know that. If the buyer wants to return that to the seller, he can return t. The people of knowledge still forbid such a transaction."

Malik said, "There is no good in selling one round loaf of bread for two round loaves, nor large for small when some of them are bigger than others. When care is taken that they are like for like, there is no harm in the sale, even if they are not weighed."

Malik said, "It is not good to sell a mudd of butter and a mudd of milk for two mudds of butter. This is like what we described of selling dates when two sa of kabis and a sa of poor quality dates were sold for three sa of ajwa dates after the buyer had said to the seller, 'Two sa of kabis dates for three sa of ajwa dates is not good,' and then he did that to make the transaction possible. The owner of the milk puts the milk with his butter so that he can use the superiority of his butter over the butter of the other party to put his milk in with it."

Malik said, "Flour for wheat is like for like, and there is no harm in that. That is if he does not mix up anything with the flour and sell it for wheat, like for like. Had he put half a mudd of flour and half of wheat, and then sold that for a mudd of wheat, it would be like what we described, and it would not be good because he would want to use the superiority of his good wheat to put flour along with it. Such a transaction is not good."

Narrated AbuSa'id al-Khudri:

The Messenger of Allah (saws) related a tradition in which he mentioned the words "Jibril and Mikal" and he pronounced them "Jibra'ila wa Mika'ila."

Abu Dawud said: Khalaf said: I did not put the pen aside from writing letters (huruf) for forty years: nothing tired me (or made me incapable of writing), even Jibril and Mika'il did not tire me.

When anyone of you begins eating, say:
Bismillāh. And if you forget then when you remember, say: Bismillāhi fī awwalihi wa ākhirih. When anyone of you begins eating, say: With the Name of Allah. And if you forget then, when you remember, say: With the Name of Allah, in the beginning, and in the end. Reference: Abu Dawud 3/347, At-Tirmidhi 4/288. See Al- Albani's Sahih At-Tirmidhi 2/167.

It was narrated that Farwah bin Nawfal said:
"I asked 'Aishah about a supplication that the Messenger of Allah (saas) used to say. She said that he used to say: 'Allahumma inni a'udhu bika min sharri ma 'amiltu, wa min sharri ma lam a'mal (O Allah, I seek refuge with You from the evil of that which I have done and the evil of that which I have not done).'"
