Narrated Abu Huraira:

The Prophet said, "When an adulterer commits illegal sexual intercourse, then he is not a believer at the time, he is doing it, and when a drinker of an alcoholic liquor drinks it, then he is not a believer at the time of drinking it, and when a thief steals, then he is not a believer at the time of stealing, and when a robber robs, and the people look at him, then he is not a believer at the time of doing robbery.

Sunan Abi Dawud 3316

'Imran b. Husain said:

'Adba belonged to a man of Banu 'Aqil. It used to go ahead of pligrims. The man was then captivated. He was brought in chains to the Prophet (saws). The Prophet (saws) was riding on a donkey with a blanket on him. He said: Muhammad, why do you arrest me and capture the one (i.e. the she-camel) which goes ahead of the pilgrims. He replied: We are arresting you on account of the crime committed by your allies Thaqid. Thaqif captivated two persons from among the Companions of the Prophet (saws). He said (whatever he said) I am a Muslim, or he said: I have embraced Islam. When the Prophet (saws) went ahead, he called him: O Muhammed, O Muhammed. Abu Dawud said: I learnt it from the version of the narrator Muhammad b. 'Isa. The Prophet (saws) was compassionate and kind hearted. So he returned to him, and asked: What is the matter with you ? He replied: I am a Muslim. He said: Had you said it when the matter was in your hand, you would have succeeded completely. Abu Dawud said: I then returned to the version of the narrator Sulaiman (b. Harb). He said: Muhammad, I am hungry, so feed me. I am thirsty, so give me water. The Prophet (saws) said: This is your need, or he said: This is his need (the narrator is doubtful). Later on the man was taken back (by Thaqif) as a ransom for the two men (of the Companions of the Prophet). The Prophet (saws) retained 'Adba for his journey. The narrator said: The polytheists raided the pasturing animals of Medina and they took away 'Adba. When they took away 'Adba, they also captivated a Muslim woman. They used to leave their camels in the fields for rest at night. One night they slept and the (Muslim) woman stood up. Any camel on which she put her hand brayed until she came to 'Adba. She came to a she-camel which was docile and experienced. She then rode on her and vowed to Allah that if He saved her, she would sacrifice it. When she came to Medina, the people recognized the she-camel of the Prophet (saws). The Prophet (saws) was then informed about it and he sent for her. She was brought to him and she informed him about her vow. He said: It is a bad return that you have given it. Allah has not saved you, on its (back) that you now sacrifice it. A vow to do an act of disobedience must not be fulfilled, or to do something over which one has no control.

Abu Dawud said: This woman was the wife of Abu Dharr.

Then the Prophet said to us, “Do you think this woman will cast her child into the fire?” We replied, “No, so long as is she in a position not to do so.” He said, “God is more merciful to His servants than this woman is to her child.” (Bukhari and Muslim.)

Ibn ‘Abbas reported the Prophet as saying, “A woman without a husband has more right to her person than her guardian, and a virgin’s permission must be asked about herself, her permission being her silence.” In a version he said, “A woman who has been previously married* has more right to her person than her guardian, and a virgin must be consulted, her permission consisting in her saying nothing.” In another version he said, “A woman who has been previously married has more right to her person than her guardian” and a virgin’s father must ask her permission about herself, her permission being her silence.” * Thayyib. This means a woman previously married who has no husband. In view of the context it is argued that ayyim is used above in this sense. Muslim transmitted it.

Yahya related to me from Malik that he had heard that Said ibn al-Musayyab and Sulayman ibn Yasar and Ibn Shihab all said that a woman who divorced for a compensation had the same idda as a divorced woman - three periods.

Malik said that a woman who ransomed herself could not return to her husband except by a new marriage. If someone married her and then separated from her before he had intercourse with her, there was no idda against her from the recent marriage, and she rested on her first idda.

Malik said, "That is the best that I have heard on the matter."

Malik said, "If, when a woman offers to compensate her husband, he divorces her straightaway, then that compensation is confirmed for him. If he makes no response, and then at a later date, does divorce her, he is not entitled to that compensation."

He said, "The Prophet passed by her while she was weeping over a grave, and he said to her, 'Be afraid of Allah and be patient.' The woman said (to the Prophet). 'Go away from me, for you do not know my calamity.'" Anas added, "The Prophet left her and proceeded. A man passed by her and asked her, 'What has Allah's Apostle said to you?' She replied, 'I did not recognize him.' The man said, 'He was Allah's Apostle."' Anas added, "So that woman came to the gate of the Prophet and she did not find a gate-keeper there, and she said, 'O Allah's Apostle! By Allah. I did not recognize you!' The Prophet said, 'No doubt, patience is at the first stroke of a calamity.'"

Yahya related to me from Malik that he heard Ibn Shihab say that if a man said to his wife, "You are free of me, and I am free of you, " it counted as three pronouncements of divorce as if it were an 'irrevocable' divorce.

Malik said that if a man made any strong statement such as these to his wife, it counted as three pronouncements of divorce for a woman whose marriage had been consummated, or it was written as one of three for a woman whose marriage had not been consummated, whichever the man wished. If he said he intended only one divorce he swore to it and he became one of the suitors because, whereas a woman whose marriage had been consummated was made inaccessible by three pronouncements of divorce, the woman whose marriage had not been consummated was made inaccessible by only one pronouncement.

Malik said, "That is the best of what I have heard."

The man will be brought forth on the Day of Resurrection, and the command will be given: “Show him his minor sins, and let his major sins be hidden from him!” He will therefore be told: “On such-and-such a day, you committed such-and-such and such-and-such sins!” He will acknowledge [his sins] and not disavow them and he will be fearful of those sins that are major offenses, so the command will be given: “In place of every bad deed he committed, grant him a good deed!” He will therefore say: “I am guilty of sins that I do not see here!” Abu Dharr said: “I saw Allah’s Messenger (Allah bless him and give him peace) smile so broadly that his molar teeth showed!”

The Prophet of Allah (saws) disliked ten things: Yellow colouring, meaning khaluq, dyeing grey hair, trailing the lower garment, wearing a gold signet-ring, a woman decking herself before people who are not within the prohibited degrees, throwing dice, using spells except with the Mu'awwidhatan, wearing amulets, withdrawing the penis before the semen is discharged, in the case of a woman who is wife or not a wife, and having intercourse with a woman who is suckling a child; but he did not declare them to be prohibited.

Abu Sa'id reported that a person belonging to the clan of Aslam, who was called Ma, iz b. Malik, came to Allah's Messenger (may peace be upon him) and said:

I have committed immorality (adultery), so inflict punishment upon me. Allah's Apostle (may peace be upon him) turned him away again and again. He then asked his people (about the state of his mind). They said: We do not know of any ailment of his except that he has committed something about which he thinks that he would not be able to relieve himself of its burden but with the Hadd being imposed upon him. He (Ma'iz) came back to Allah's Apostle (may peace be upon him) and he commanded us to stone him. We took him to the Baqi' al-Gharqad (the graveyard of Medina). We neither tied him nor dug any ditch for him. We attacked him with bones, with clods and pebbles. He ran away and we ran after him until he came upon the ston ground (al-Harra) and stopped there and we stoned him with heavy stones of the Harra until he became motionless (lie died). He (the Holy Prophet) then addressed (us) in the evening saying Whenever we set forth on an expedition in the cause of Allah, some one of those connected with us shrieked (under the pressure of sexual lust) as the bleating of a male goat. It is essential that if a person having committed such a deed is brought to me, I should punish him. He neither begged forgiveness for him nor cursed him.

Narrated `Aisha:

Regarding the Verse:--"If a woman fears cruelty or desertion on her husband's part." (4.128) It is about a man who has a woman (wife) and he does not like her and wants to divorce her but she says to him, "I make you free as regards myself." So this Verse was revealed in this connection.

Sahih Muslim 1695 b

'Abdullah b. Buraida reported on the authority of his father that Ma'iz b. Malik al-Aslami came to Allah's Messenger (may peace be upon him) and said:

Allah's Messenger, I have wronged myself; I have committed adultery and I earnestly desire that you should purify me. He turned him away. On the following day, he (Ma'iz) again came to him and said: Allah's Messenger, I have committed adultery. Allah's Messenger (may peace be upon him) turned him away for the second time, and sent him to his people saying: Do you know if there is anything wrong with his mind. They denied of any such thing in him and said: We do not know him but as a wise good man among us, so far as we can judge. He (Ma'iz) came for the third time, and he (the Holy Prophet) sent him as he had done before. He asked about him and they informed him that there was nothing wrong with him or with his mind. When it was the fourth time, a ditch was dug for him and he (the Holy Prophet) pronounced judg- ment about him and he wis stoned. He (the narrator) said: There came to him (the Holy Prophet) a woman from Ghamid and said: Allah's Messenger, I have committed adultery, so purify me. He (the Holy Prophet) turned her away. On the following day she said: Allah's Messenger, Why do you turn me away? Perhaps, you turn me away as you turned away Ma'iz. By Allah, I have become pregnant. He said: Well, if you insist upon it, then go away until you give birth to (the child). When she was delivered she came with the child (wrapped) in a rag and said: Here is the child whom I have given birth to. He said: Go away and suckle him until you wean him. When she had weaned him, she came to him (the Holy Prophet) with the child who was holding a piece of bread in his hand. She said: Allah's Apostle, here is he as I have weaned him and he eats food. He (the Holy Prophet) entrusted the child to one of the Muslims and then pronounced punishment. And she was put in a ditch up to her chest and he commanded people and they stoned her. Khalid b Walid came forward with a stone which he flung at her head and there spurted blood on the face of Khalid and so he abused her. Allah's Apostle (may peace be upon him) heard his (Khalid's) curse that he had huried upon her. Thereupon he (the Holy Prophet) said: Khalid, be gentle. By Him in Whose Hand is my life, she has made such a repentance that even if a wrongful tax-collector were to repent, he would have been forgiven. Then giving command regarding her, he prayed over her and she was buried.

I did not know what to say, so I got up and went to the house of Ibn 'Umar and said: "O Abu 'Abdur-Rahman, should the two who engage in Li'an be separated?" He said: "Yes, Subhan Allah! The first one who asked about that was so-and-so the son of so-and-so who said: 'O Messenger of Allah, what do you think if a man among us sees his wife committing immoral actions, and if he speaks of it, he will be speaking of a grave matter, but if he keeps quiet, he will be keeping quiet about a grave matter?' He did not answer him, then after that, he came to him and said: 'I was tried with the matter that I asked you about, so Allah, the Mighty and Sublime, revealed these Verses in Surat An-Nur.: 'And for those who accuse their wives' until he reached: 'And the fifth (testimony) should be that the Wrath of Allah be upon her if he (her husband) speaks the truth.' So he started with the man, exhorting him, reminding him, and telling him that the punishment in this world was less severe than the punishment in the Hereafter. He said: 'By the One Who sent you with the truth, I am not lying.' Then he turned to the woman and exhorted her and reminded her. She said: 'By the One Who sent you with the truth, he is lying.' So he started with the man, and he bore witness four times by Allah that he was telling the truth, and the fifth time (he invoked) the curse of Allah upon himself if he was lying. Then he turned to the woman and she bore witness four times by Allah that he was lying, and the fifth time (she invoked) the wrath of Allah upon herself if he was telling the truth. Then he separated them."'"

Yahya related to me from Malik that he heard Ibn Shihab say, "The precedent of the sunna when a man injures a woman is that he must pay the blood- money for that injury and there is no retaliation against him."

Malik said, "That is an accidental injury, when a man strikes a woman and hits with a blow what he did not intend, for instance, if he struck her with a whip and cut her eye open and the like of that."

Malik said about a woman who has a husband and children who are not from her paternal relatives or her people, that since he is from another tribe, there is no blood-money against her husband for her criminal action, nor any against her children if they are not from her people, nor any against her maternal brothers when they are not from her paternal relations or her people. These are entitled to her inheritance but only the paternal relations have paid blood-money from since the time of the Messenger of Allah, may Allah bless him and grant him peace. Until today it is like that with the mawla of a woman. The inheritance they leave goes to the children of the woman even if they are not from her tribe, but the blood-money of the criminal act of the mawla is only against her tribe."

Ibn ‘Umar said A man invoked curses on his wife (charging her of adultery) during the time of Apostle of Allaah(saws) and disowned the child. The Apostle of Allaah(saws) therefore separated them and attributed the child to the woman. Abu Dawud said “The words narrated by Malik alone are “and he attributed the child to the woman.”"

Abu Dawud said:

The words narrated by Malik alone are: "and he attributed the child to the woman."

Yunus narrated from Al Zuhri on the authority of Sahl bin Sa’d in the tradition regarding li’an(invoking curses). He disowned her conception hence her child was attributed to her.

The Qur’anic verse goes: “If any of your woman are guilty of lewdness, take the evidence of four (reliable) witnesses from amongst you against them, and if they testify, Confine them to houses until death do chain them or Allah ordains for them some (other) way. Allah then mentioned man after woman and combined them in another verse : “If two men among you are guilty of lewdness, punish them both. If they repent and amend, leave them alone. This command was abrogated by the verse relating to flogging : “The woman and the man guilty of adultery or fornication – flog each of them with one hundred stripes.

Abu Huraira told that God’s Messenger gave judgment, when the child of a woman of the B. Lihyan was born dead,* that a male or female slave of the best quality be paid in compensation. Then the woman against whom he had given this judgment died, and God’s Messenger gave judgment that her sons and husband should inherit from her and that the compensation should be paid by her relatives on her father’s side. (Bukhari and Muslim.) * Lihyan were a section of the tribe of Hudhail, so this tradition may be explained by what is said in the next ones. It was not merely an instance of a child being born dead; this was due to the injury caused by another woman.

Abu Huraira said that God’s messenger told of a man who expressed his intention to give sadaqa, and who when he took it out placed it in a thief’s hand. In the morning the people were talking and saying, “Sadaqa was given to a thief last night.” The man said, “O God, to Thee be the praise—to a thief!’’ He then expressed his intention to give sadaqa and when he took it out he placed it in a prostitute’s hand. In the morning the people were talking and saying, “Sadaqa was given to a prostitute last night." The man said, "O God, to Thee be the praise— to a prostitute!" He then expressed his intention to give sadaqa and when he took it out he placed it in a rich man’s hand. In the morning the people were talking and saying, “Sadaqa was given to a rich man last night." The man said, “O God, to Thee be the praise—to a thief, a prostitute and a rich man!” He then had a vision in which he was told that his sadaqa to a thief might result in his refraining from his theft, the prostitute might perhaps refrain from her immorality, and the rich man might perhaps pay heed and spend from what God had given him. Malik related to me from Ibn Shihab that Abd al-Malik ibn Marwan gave a judgment that the rapist had to pay the raped woman her bride- price.

Yahya said that he heard Malik say, "What is done in our community about the man who rapes a woman, virgin or non-virgin, if she is free, is that he must pay the bride-price of the like of her. If she is a slave, he must pay what he has diminished of her worth. The hadd-punishment in such cases is applied to the rapist, and there is no punishment applied to the raped woman. If the rapist is a slave, that is against his master unless he wishes to surrender him."

A tradition called mahfuz is one which is considered superior when compared with a shadhdh tradition (cf. p. xii).

Yahya related to me from Malik from Nafi that Abdullah ibn Umar said that statements like "I cut myself off from you",or"You are abandoned", were considered as three pronouncements of divorce.

Malik said that any strong statements such as these or others were considered as three pronouncements of divorce for a woman whose marriage had been consummated. In the case of a woman whose marriage had not been consummated, the man was asked to make an oath on his deen, as to whether he had intended one or three pronouncements of divorce. If he had intended one pronouncement, he was asked to make an oath by Allah to confirm it, and he became a suitor among other suitors, because a woman whose marriage had been consummated, required three pronouncements of divorce to make her inaccessible for the husband, whilst only one pronouncement was needed to make a woman whose marriage had not been consummated inaccessible.

Malik added, "That is the best of what I have heard about the matter."
