Sunan Ibn Majah 2564
It was narrated from Ibn`Abbas that the Messenger of Allah (SAW) said:
“Whoever has intercourse with a Mahram relative, kill him; and whoever has intercourse with an animal, kill him, and kill the animal.”

Narrated Ibn 'Abbas:
That the Messenger of Allah (saws) said: "Whomever you see having relations with an animal then kill him and kill animal." So it was said to Ibn 'Abbas: "What is the case of the animal?" He said: "I did not hear anything from the Messenger of Allah (saws) about this, but I see that the Messenger of Allah (saws) disliked eating its meat or using it, due to the fact that such a (heinous) thing has been done with that animal."
حَدَّثَنَا مُحَمَّدُ بْنُ عَمْرٍو السَّوَّاقُ، حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ عَمْرِو بْنِ أَبِي عَمْرٍو، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ مَنْ وَجَدْتُمُوهُ وَقَعَ عَلَى بَهِيمَةٍ فَاقْتُلُوهُ وَاقْتُلُوا الْبَهِيمَةَ ‏"‏ ‏.‏ فَقِيلَ لاِبْنِ عَبَّاسٍ مَا شَأْنُ الْبَهِيمَةِ قَالَ مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم فِي ذَلِكَ شَيْئًا وَلَكِنْ أُرَى رَسُولَ اللَّهِ كَرِهَ أَنْ يُؤْكَلَ مِنْ لَحْمِهَا أَوْ يُنْتَفَعَ بِهَا وَقَدْ عُمِلَ بِهَا ذَلِكَ الْعَمَلُ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ لاَ نَعْرِفُهُ إِلاَّ مِنْ حَدِيثِ عَمْرِو بْنِ أَبِي عَمْرٍو عَنْ عِكْرِمَةَ عَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏

Mishkat al-Masabih 4074
Ibn ‘Umar told that he heard God’s messenger prohibit keeping an animal or anything else* waiting to be killed. *The word translated animal is bahima, which indicates a quadruped. “Anything else” means other creatures which are killed for food. The prohibition is said to refer either to keeping such animals without food and drink, or to imprisoning them and using them as targets. (Bukhari and Muslim.)

Ibn 'Abbas (RAA) narrated that the Messenger of Allah (PBUH) said, "Whoever you find doing as the people of Lot did (i.e. homosexuality), kill the one who does it and the one to whom it is done, and if you find anyone having sexual intercourse with animal, kill him and kill the animal." Related by Ahmad and the four Imams with a trustworthy chain of narrators.
وَعَنْ اِبْنِ عَبَّاسٍ رَضِيَ اَللَّهُ عَنْهُمَا; أَنَّ اَلنَّبِيَّ ‏- صلى الله عليه وسلم ‏-قَالَ: { مَنْ وَجَدْتُمُوهُ يَعْمَلُ عَمَلَ قَوْمِ لُوطٍ, فَاقْتُلُوا اَلْفَاعِلَ وَالْمَفْعُولَ بِهِ, وَمَنْ وَجَدْتُمُوهُ وَقَعَ عَلَى بَهِيمَةٍ, فَاقْتُلُوهُ وَاقْتُلُوا اَلْبَهِيمَةَ } ".‏ رَوَاهُ أَحْمَدُ وَالْأَرْبَعَةُ, 1‏ وَرِجَالُهُ مُوَثَّقُونَ, إِلَّا أَنَّ فِيهِ اِخْتِلَافًا 2‏ .‏

Narrated Adi bin Hatim:

I said, "O Allah's Apostle! We let loose our trained hounds after a game?" He said, "Eat what they hunt for you." I said, "Even if they killed (the game)?" He replied, 'Even if they killed (the game)." I said, 'We also hit (the game) with the Mi'rad?" He said, "Eat of the animal which the Mi'rad kills by piercing its body, but do not eat of the animal which is killed by the broad side of the Mi'rad.''

Ibn Abbas said:

The apostle of allah (may peace be upon him) forbade drinking from the mouth of a water-skin, and riding the animal which feeds on filth and eating the animal which is killed in confinement.

Abu Dawud said: Jallalah means an animal which eats filth and impurities.

Shaddad bin Aus (RAA) narrated that the Messenger of Allah (PBUH) said, "Verily, Allah has prescribed proficiency in all things. Thus, if you kill, kill in the least painful manner you can; and when you slaughter an animal, do it in the best possible way; and any of you should sharpen his blade so that the animal may be spared from the suffering of the slaughtering."
وَعَنْ شَدَّادِ بْنِ أَوْسٍ ‏- رضى الله عنه ‏- قَالَ: قَالَ رَسُولُ اَللَّهِ ‏- صلى الله عليه وسلم ‏-{ " إِنَّ اَللَّهَ كَتَبَ اَلْإِحْسَانَ عَلَى كُلِّ شَيْءٍ, فَإِذَا قَتَلْتُمْ فَأَحْسِنُوا اَلْقِتْلَةَ, وَإِذَا ذَبَحْتُمْ فَأَحْسِنُوا اَلذِّبْحَةَ, وَلْيُحِدَّ أَحَدُكُمْ شَفْرَتَهُ, وَلْيُرِحْ (1756)‏ ذَبِيحَتَهُ" } رَوَاهُ مُسْلِمٌ (1757)‏ .‏

Narrated Abu Huraira:

Allah's Apostle said, "There is no Diya for persons killed by animals or for the one who has been killed accidentally by falling into a well or for the one killed in a mine. And one-fifth of Rikaz (treasures buried before the Islamic era) is to be given to the state."

Narrated Abdullah ibn Abbas:

The Prophet (saws) said: If anyone has sexual intercourse with an animal, kill him and kill it along with him. I (Ikrimah) said: I asked him (Ibn Abbas): What offence can be attributed to the animal/ He replied: I think he (the Prophet) disapproved of its flesh being eaten when such a thing had been done to it.

Abu Dawud said: This is not a strong tradition.

It was narrated from Ibn ‘Umar that the Messenger of Allah (saw) said:
“There are five animals, for which there is no sin on a person if he kills them” – or he said: “if he kills them when in Ihram – the scorpion, the crow, the kite, the mouse and the vicious dog.”

Ibn ‘Abbas reported God’s Messenger as saying, “If anyone has sexual intercourse with an animal, kill him and kill it along with him.” Ibn ‘Abbas was asked what offence could be attributed to the animal and replied, “I did not hear anything about that from God’s Messenger, but I think he disapproved of its flesh being eaten or of any use being made of it when such a thing had been done to it.” Tirmidhi, Abu Dawud and Ibn Majah transmitted it.
وَعَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ أَتَى بَهِيمَةً فَاقْتُلُوهُ وَاقْتُلُوهَا مَعَهُ» . قِيلَ لِابْنِ عَبَّاسٍ: مَا شَأْنُ الْبَهِيمَةِ؟ قَالَ: مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ شَيْئا وَلَكِن أره كَرِهَ أَنْ يُؤْكَلَ لَحْمُهَا أَوْ يُنْتَفَعَ بِهَا وَقَدْ فُعِلَ بِهَا ذَلِكَ. رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُد وَابْن مَاجَه

Sunan Abi Dawud 4765

Narrated AbuSa'id al-Khudri ; Anas ibn Malik:

The Prophet (saws) said: Soon there will appear disagreement and dissension in my people; there will be people who will be good in speech and bad in work. They recite the Qur'an, but it does not pass their collar-bones. They will swerve from the religion as an animal goes through the animal shot at. They will not return to it till the arrow comes back to its notch. They are worst of the people and animals. Happy is the one who kills them and they kill him. They call to the book of Allah, but they have nothing to do with it. He who fights against them will be nearer to Allah than them (the rest of the people). The people asked: What is their sign? He replied: They shave the head.

حَدَّثَنَا نَصْرُ بْنُ عَاصِمٍ الأَنْطَاكِيُّ، حَدَّثَنَا الْوَلِيدُ، وَمُبَشِّرٌ، - يَعْنِي ابْنَ إِسْمَاعِيلَ الْحَلَبِيَّ عَنْ أَبِي عَمْرٍو، قَالَ - يَعْنِي الْوَلِيدَ - حَدَّثَنَا أَبُو عَمْرٍو، قَالَ حَدَّثَنِي قَتَادَةُ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، وَأَنَسِ بْنِ مَالِكٍ، عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ ‏:‏ ‏"‏ سَيَكُونُ فِي أُمَّتِي اخْتِلاَفٌ وَفُرْقَةٌ، قَوْمٌ يُحْسِنُونَ الْقِيلَ وَيُسِيئُونَ الْفِعْلَ وَيَقْرَءُونَ الْقُرْآنَ لاَ يُجَاوِزُ تَرَاقِيَهُمْ، يَمْرُقُونَ مِنَ الدِّينِ مُرُوقَ السَّهْمِ مِنَ الرَّمِيَّةِ لاَ يَرْجِعُونَ حَتَّى يَرْتَدَّ عَلَى فُوقِهِ هُمْ شَرُّ الْخَلْقِ وَالْخَلِيقَةِ طُوبَى لِمَنْ قَتَلَهُمْ وَقَتَلُوهُ، يَدْعُونَ إِلَى كِتَابِ اللَّهِ وَلَيْسُوا مِنْهُ فِي شَىْءٍ، مَنْ قَاتَلَهُمْ كَانَ أَوْلَى بِاللَّهِ مِنْهُمْ ‏"‏ ‏.‏ قَالُوا ‏:‏ يَا رَسُولَ اللَّهِ مَا سِيمَاهُمْ قَالَ ‏:‏ ‏"‏ التَّحْلِيقُ ‏"‏ ‏.‏

It was narrated that Ibn Umar said:
"A man said: "O Messenger of Allah, what animals may we kill when we are in Ihram?' He said: "there are five for which there is no sin in killing them: Kites, crows, mice, scorpions and vicious dogs.'"

Yahya related to me from Malik from Hisham ibn Urwa that his father used to kill his sacrificial animals while they were standing.

Malik said, "No-one is permitted to shave his head until he has killed his sacrificial animal, and no-one must sacrifice before dawn on the day of sacrifice. The things that should be done on the day of sacrifice are slaughtering, donning clothes, grooming the body generally (at-tafath) and shaving the head, and none of this may be done before the day of sacrifice."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، أَنَّ أَبَاهُ، كَانَ يَنْحَرُ بُدْنَهُ قِيَامًا ‏.‏ قَالَ مَالِكٌ لاَ يَجُوزُ لأَحَدٍ أَنْ يَحْلِقَ رَأْسَهُ حَتَّى يَنْحَرَ هَدْيَهُ وَلاَ يَنْبَغِي لأَحَدٍ أَنْ يَنْحَرَ قَبْلَ الْفَجْرِ يَوْمَ النَّحْرِ وَإِنَّمَا الْعَمَلُ كُلُّهُ يَوْمَ النَّحْرِ الذَّبْحُ وَلُبْسُ الثِّيَابِ وَإِلْقَاءُ التَّفَثِ وَالْحِلاَقُ لاَ يَكُونُ شَىْءٌ مِنْ ذَلِكَ يُفْعَلُ قَبْلَ يَوْمِ النَّحْرِ ‏.‏

He reported him as saying, “There is no prescribed punishment for one who has intercourse with an animal." Tirmidhi and Abu Dawud transmitted it. Tirmidhi quoted Sufyan ath-Thauri as saying that this is sounder than the first tradition, “Kill him who has intercourse with an animal," (Cf. p. 763) and that the learned act according to this one.

The Prophet (saws) was asked which of the creatures a pilgrim in sacred state could kill. He replied: The snake, the scorpion, the rat; he should drive away the pied crow, but should not kill it; the biting dog, the kite, and any wild animal which attacks (man).

They will come out from the religion as an arrow does from the animal it is aimed at. Wherever you meet them kill them, for a reward for killing them will be given on the day of resurrection to those who kill them.” (Bukhari and Muslim.)

Yahya related to me from Malik from Nafi that Abdullah ibn Umar used to say, "A woman in ihram should not comb her hair when she leaves ihram until she has cut some of the tresses of her hair, and if she has an animal for sacrifice with her she should not cut off any of her hair until the animal has been killed."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ، كَانَ يَقُولُ الْمَرْأَةُ الْمُحْرِمَةُ إِذَا حَلَّتْ لَمْ تَمْتَشِطْ حَتَّى تَأْخُذَ مِنْ قُرُونِ رَأْسِهَا وَإِنْ كَانَ لَهَا هَدْىٌ لَمْ تَأْخُذْ مِنْ شَعْرِهَا شَيْئًا حَتَّى تَنْحَرَ هَدْيَهَا ‏.‏ وَحَدَّثَنِي عَنْ مَالِكٍ أَنَّهُ سَمِعَ بَعْضَ أَهْلِ الْعِلْمِ يَقُولُ لاَ يَشْتَرِكُ الرَّجُلُ وَامْرَأَتُهُ فِي بَدَنَةٍ وَاحِدَةٍ لِيُهْدِ كُلُّ وَاحِدٍ بَدَنَةً بَدَنَةً ‏.‏ وَسُئِلَ مَالِكٌ عَمَّنْ بُعِثَ مَعَهُ بِهَدْىٍ يَنْحَرُهُ فِي حَجٍّ وَهُوَ مُهِلٌّ بِعُمْرَةٍ هَلْ يَنْحَرُهُ إِذَا حَلَّ أَمْ يُؤَخِّرُهُ حَتَّى يَنْحَرَهُ فِي الْحَجِّ وَيُحِلُّ هُوَ مِنْ عُمْرَتِهِ فَقَالَ بَلْ يُؤَخِّرُهُ حَتَّى يَنْحَرَهُ فِي الْحَجِّ وَيُحِلُّ هُوَ مِنْ عُمْرَتِهِ ‏.‏ قَالَ مَالِكٌ وَالَّذِي يُحْكَمُ عَلَيْهِ بِالْهَدْىِ فِي قَتْلِ الصَّيْدِ أَوْ يَجِبُ عَلَيْهِ هَدْىٌ فِي غَيْرِ ذَلِكَ فَإِنَّ هَدْيَهُ لاَ يَكُونُ إِلاَّ بِمَكَّةَ كَمَا قَالَ اللَّهُ تَبَارَكَ وَتَعَالَى ‏{‏هَدْيًا بَالِغَ الْكَعْبَة‏}‏ وَأَمَّا مَا عُدِلَ بِهِ الْهَدْىُ مِنَ الصِّيَامِ أَوِ الصَّدَقَةِ فَإِنَّ ذَلِكَ يَكُونُ بِغَيْرِ مَكَّةَ حَيْثُ أَحَبَّ صَاحِبُهُ أَنْ يَفْعَلَهُ فَعَلَهُ ‏.‏

‘Adi b. Hatim reported the Prophet as saying, “Eat whatever is caught for you by a dog or a hawk which you have trained and set off when you have mentioned God’s name.” He asked whether that applied if it killed the animal and he replied, “When it kills it without eating any of it, for it caught it only for you.” Abu Dawud transmitted it.
وَعَن عدي بن حَاتِم أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَا عَلَّمْتَ مِنْ كَلْبٍ أَوْ بَازٍ ثُمَّ أَرْسَلْتَهُ وَذَكَرْتَ اسْمَ اللَّهِ فَكُلْ مِمَّا أَمْسَكَ عَلَيْكَ» . قُلْتُ: وَإِنْ قَتَلَ؟ قَالَ: «إِذَا قَتَلَهُ وَلَمْ يَأْكُلْ مِنْهُ شَيْئًا فَإِنَّمَا أَمْسَكَهُ عَلَيْكَ» . رَوَاهُ أَبُو دَاوُد

A’ishah (RAA) narrated ‘The Messenger of Allah (P.B.U.H.) said, "Five kinds of animals are vicious and harmful, and they may be killed outside or inside the sacred area of Ihram (Sanctuary). These are:
the scorpion, the kite, the crow, the mouse, and the rabid dog.” Agreed upon.

Narrated Ibn `Umar:

that he entered upon Yahya bin Sa`id while one of Yahya's sons was aiming at a hen after tying it. Ibn `Umar walked to it and untied it. Then he brought it and the boy and said. "Prevent your boys from tying the birds for the sake of killing them, as I have heard the Prophet forbidding the killing of an animal or other living thing after tying them."

حَدَّثَنَا أَحْمَدُ بْنُ يَعْقُوبَ، أَخْبَرَنَا إِسْحَاقُ بْنُ سَعِيدِ بْنِ عَمْرٍو، عَنْ أَبِيهِ، أَنَّهُ سَمِعَهُ يُحَدِّثُ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ أَنَّهُ دَخَلَ عَلَى يَحْيَى بْنِ سَعِيدٍ وَغُلاَمٌ مِنْ بَنِي يَحْيَى رَابِطٌ دَجَاجَةً يَرْمِيهَا، فَمَشَى إِلَيْهَا ابْنُ عُمَرَ حَتَّى حَلَّهَا، ثُمَّ أَقْبَلَ بِهَا وَبِالْغُلاَمِ مَعَهُ فَقَالَ ازْجُرُوا غُلاَمَكُمْ عَنْ أَنْ يَصْبِرَ هَذَا الطَّيْرَ لِلْقَتْلِ، فَإِنِّي سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم نَهَى أَنْ تُصْبَرَ بَهِيمَةٌ أَوْ غَيْرُهَا لِلْقَتْلِ‏.‏

Narrated Rafi` bin Khadij:

I said, "O Allah's Apostle! We are going to face the enemy tomorrow and we do not have knives." He said, "Hurry up (in killing the animal). If the killing tool causes blood to flow out, and if Allah's Name is mentioned, eat (of the slaughtered animal). But do not slaughter with a tooth or a nail. I will tell you why: As for the tooth, it is a bone; and as for the nail, it is the knife of Ethiopians." Then we got some camels and sheep as war booty, and one of those camels ran away, whereupon a man shot it with an arrow and stopped it. Allah's Apostle said, "Of these camels there are some which are as wild as wild beasts, so if one of them (runs away and) makes you tired, treat it in this manner."

حَدَّثَنَا عَمْرُو بْنُ عَلِيٍّ، حَدَّثَنَا يَحْيَى، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا أَبِي، عَنْ عَبَايَةَ بْنِ رِفَاعَةَ بْنِ رَافِعِ بْنِ خَدِيجٍ، عَنْ رَافِعِ بْنِ خَدِيجٍ، قَالَ قُلْتُ يَا رَسُولَ اللَّهِ إِنَّا لاَقُو الْعَدُوِّ غَدًا، وَلَيْسَتْ مَعَنَا مُدًى فَقَالَ ‏"‏ اعْجَلْ أَوْ أَرِنْ مَا أَنْهَرَ الدَّمَ وَذُكِرَ اسْمُ اللَّهِ فَكُلْ، لَيْسَ السِّنَّ وَالظُّفُرَ، وَسَأُحَدِّثُكَ، أَمَّا السِّنُّ فَعَظْمٌ، وَأَمَّا الظُّفُرُ فَمُدَى الْحَبَشَةِ ‏"‏‏.‏ وَأَصَبْنَا نَهْبَ إِبِلٍ وَغَنَمٍ فَنَدَّ مِنْهَا بَعِيرٌ، فَرَمَاهُ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّ لِهَذِهِ الإِبِلِ أَوَابِدَ كَأَوَابِدِ الْوَحْشِ، فَإِذَا غَلَبَكُمْ مِنْهَا شَىْءٌ، فَافْعَلُوا بِهِ هَكَذَا ‏"‏‏.‏

On the authority of Abu Ya’la Shaddad bin Aws (may Allah be pleased with him), that the Messenger of Allah (peace and blessings of Allah be upon him) said:

Verily Allah has prescribed ihsan (proficiency, perfection) in all things. So if you kill then kill well; and if you slaughter, then slaughter well. Let each one of you sharpen his blade and let him spare suffering to the animal he slaughters.” [Muslim]

عَنْ أَبِي يَعْلَى شَدَّادِ بْنِ أَوْسٍ رَضِيَ اللهُ عَنْهُ عَنْ رَسُولِ اللَّهِ صلى الله عليه و سلم قَالَ: "إنَّ اللَّهَ كَتَبَ الْإِحْسَانَ عَلَى كُلِّ شَيْءٍ، فَإِذَا قَتَلْتُمْ فَأَحْسِنُوا الْقِتْلَةَ، وَإِذَا ذَبَحْتُمْ فَأَحْسِنُوا الذِّبْحَةَ، وَلْيُحِدَّ أَحَدُكُمْ شَفْرَتَهُ، وَلْيُرِحْ ذَبِيحَتَهُ". Yahya related to me from Malik that he had heard that Abdullah ibn Abbas used to say, "The least difficult thing acceptable as a sacrificial animal is a sheep."

Malik said, "That is what I like most out of what I have heard about the matter, because Allah, the Blessed and Exalted, says in His Book, 'O you who trust, do not kill game while you are in ihram. Whoever of you kills it intentionally, there shall be repayment the like of what he has slain, from livestock, as shall be judged by two men of justice among you, a sacrificial animal which will reach the Kaba, or food for poor people, or the equivalent of that in fasting,' (Sura 5 ayat 95) and a sheep is one of the animals which is judged to be acceptable as a sacrifice. Allah has called it a sacrificial animal, and there is no dispute among us about the matter. How, indeed, could anyone be in doubt about the matter? A sheep is the kaffara for anything which does not reach the extent of something for which a camel or a cow would be the kaffara, and the kaffara for something which does not reach the extent of something for which a sheep would be the kaffara is fasting, or feeding poor people."

Rafi‘ b. Khadij told that he said, “Messenger of God, we shall meet the enemy tomorrow and we have no knives; may we kill animals with canes?”* He replied, “When God’s name is mentioned you may eat what is killed by anything which causes the blood to flow, except tooth and claw. I shall tell you about it. The tooth is a bone and the claw is the knife of the Abyssinians.” We got some camels and sheep as booty, and when one of the camels ran away a man shot an arrow at it and prevented it from escaping, whereupon God’s messenger said, “Among camels there are some which bolt like wild animals, so when any of them get the better of you do thus to them.” (Bukhari and Muslim.)

Abu Sa'id al-Khudri and Anas b Malik reported God’s Messenger as saying, “Disagreement and division will arise among my people. Some will speak well but do evil; they will recite the Qur’an but it will go no farther than their throats; they will swerve from the religion as an arrow goes through the animal shot at and will not return till an arrow comes back to the place where it was strung. They are the worst of men and animals. Blessed are they who kill them and are killed by them! They summon people to God’s Book, but they have no part with us. He who fights with them is nearer to God than they.” God’s Messenger was asked what mark they had, and said it was shaving.* Abu Dawud transmitted it. * Tahliq is here explained as going to extremes in shaving the head and taking the hair out by the roots.

It was narrated that 'Adiyy bin Hatim said:
"I asked the Messenger of Allah about hunting with the Mirad. He said: 'whatever is struck with the sharp edge, eat, and whatever is hit with its broad side, it is an animal killed by a blow. "" He said: "And I asked him about hunting dogs. He said: 'If you release your dog and mention the name of Allah over it, then eat.,' I said: 'Even it he kills it?' He said: 'Even if he kills it?" He said: 'Even if he kills it. But if he has eaten some of it, then do not eat. And if you find another dog with your dog and he has killed (the game), then do not eat, for you only said the name of Allah over your dog, not over your dog, not over any other."'

Abu Ya'la Shaddad bin 'Aus (May Allah be pleased with him) reported:
Messenger of Allah (PBUH) said, "Verily Allah has prescribed Ihsan (kindness) for everything. So when you kill, you must make the killing in the best manner; when you slaughter, make your slaughter in the best manner. Let one of you sharpen his knife and give ease to his animal (in order to reduce his pain)."

Narrated Abaya bin Rifaa:

My grandfather, Rafi` said, "We were in the company of the Prophet at DhulHulaifa, and the people suffered from hunger. We got some camels and sheep (as booty) and the Prophet was still behind the people. They hurried and put the cooking pots on the fire. (When he came) he ordered that the cooking pots should be upset and then he distributed the booty (amongst the people) regarding ten sheep as equal to one camel then a camel fled and the people chased it till they got tired, as they had a few horses (for chasing it). So a man threw an arrow at it and caused it to stop (with Allah's Permission). On that the Prophet said, 'Some of these animals behave like wild beasts, so, if any animal flee from you, deal with it in the same way." My grandfather asked (the Prophet ), "We hope (or are afraid) that we may meet the enemy tomorrow and we have no knives. Can we slaughter our animals with canes?" Allah's Apostle replied, "If the instrument used for killing causes the animal to bleed profusely and if Allah's Name is mentioned on killing it, then eat its meat (i.e. it is lawful) but won't use a tooth or a nail and I am telling you the reason: A tooth is a bone (and slaughtering with a bone is forbidden ), and a nail is the slaughtering instrument of the Ethiopians."

Narrated Adi ibn Hatim:

The Prophet (saws) said: Eat what ever is caught for you by a dog or a hawk you have trained and set off when you have mentioned Allah's name. I said: (Does this apply) if it killed (the animal)? He said: When it kills it without eating any of it, for it caught it only for you.

Abu Dawud said: If a hawk eats any of it, there is no harm (in eating it). If a dog eats it, it is disapproved (to eat the meat). If it drinks blood, there is no harm (in eating it).

There are two characteristics that I heard the Messenger of Allah (saws) say: Allah has decreed that everything should be done in a good way, so when you kill use a good method. The version of the narrators other than Muslim says: "So kill in a good manner." And when you slaughter, you should use a good method, for one of you should sharpen his knife, and give the animal as little pain as possible.

Yahya related to me from Malik that he had heard one of the people of knowledge say, "A man and wife should not share in one sacrificial animal. Each should sacrifice an animal separately."

Malik was asked about whether someone who had been entrusted with an animal for him to sacrifice on hajj, who went into ihram for umra, should sacrifice it when he came out of ihram or postpone it so that he sacrificed it at the time of the hajj while in the meantime he came out of ihram from his umra. He said, "He should postpone it so that he may sacrifice it at the time of the hajj, and meanwhile come out of ihram from his umra."

Malik said, "If it is judged that some- one must offer an animal for having killed game, or for any other reason, this animal can only be sacrificed at Makka, since Allah, the Blessed and Exalted, says, 'a sacrificial animal which will reach the Kaba.' The fasting or sadaqa that is considered equivalent to offering a sacrifice can be done outside Makka, and the person who is doing it can do it wherever he likes."

Yahya related to me from Malik from Ibn Shihab that Umar ibn al- Khattab told people to kill snakes in the Haram.

Malik said, about the "wild dogs" which people were told to kill in the Haram, that any animals that wounded, attacked, or terrorised men, such as lions, leopards, Iynxes and wolves, were counted as"wild dogs." However, someone who was in ihram should not kill beasts of prey that did not attack (people), such as hyenas, foxes, cats and anything else like them, and if he did then he had to pay a forfeit for it. Similarly, someone in ihram should not kill any predatory birds except the kinds that the Prophet, may Allah bless him and grant him peace, specified, namely crows and kites. If someone in ihram killed any other kind of bird he had to pay a forfeit for it.

Yahya related to me from Malik from Nafi from Abdullah ibn Umar that the Messenger of Allah, may Allah bless him and grant him peace, said, "There are five kinds of animal which it is not wrong for some one in ihram to kill:

He said he told God’s messenger that he set off trained dogs, and he replied, “Eat what they catch for you.” He asked if that applied even if they killed the game, and he replied that it did. He told him that he shot featherless arrows (mi'rad)* and he replied, “Eat what they pierce, but what they strike with the middle part and kill is beaten to death, so do not eat it.” *The mi'rad was thick in the middle and slender at the ends. It was liable to strike the animal with its middle part. (Bukhari and Muslim.)

‘Ali said:
When I mention a tradition to you from the Messenger of Allah (May peace be upon him), it is dearer to me that I fall from the heaven than I lie on him. But when I talk to you about matters between me and you, then war is a deception. I heard the Messenger of Allah (May peace be upon him) say: Towards the end of the time there will be people who are young in age and from Islam as an arrow goes through the animal aimed at, and their faith will not pass their throats. Wherever you meet them kill them, for their killing will bring a reward for him who kills them on the day of Resurrection.
حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ، أَخْبَرَنَا سُفْيَانُ، حَدَّثَنَا الأَعْمَشُ، عَنْ خَيْثَمَةَ، عَنْ سُوَيْدِ بْنِ غَفَلَةَ، قَالَ قَالَ عَلِيٌّ ‏:‏ إِذَا حَدَّثْتُكُمْ عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم حَدِيثًا فَلأَنْ أَخِرَّ مِنَ السَّمَاءِ أَحَبُّ إِلَىَّ مِنْ أَنْ أَكْذِبَ عَلَيْهِ وَإِذَا حَدَّثْتُكُمْ فِيمَا بَيْنِي وَبَيْنَكُمْ فَإِنَّمَا الْحَرْبُ خُدْعَةٌ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏:‏ ‏ "‏ يَأْتِي فِي آخِرِ الزَّمَانِ قَوْمٌ حُدَثَاءُ الأَسْنَانِ سُفَهَاءُ الأَحْلاَمِ، يَقُولُونَ مِنْ قَوْلِ خَيْرِ الْبَرِيَّةِ يَمْرُقُونَ مِنَ الإِسْلاَمِ كَمَا يَمْرُقُ السَّهْمُ مِنَ الرَّمِيَّةِ، لاَ يُجَاوِزُ إِيمَانُهُمْ حَنَاجِرَهُمْ، فَأَيْنَمَا لَقِيتُمُوهُمْ فَاقْتُلُوهُمْ، فَإِنَّ قَتْلَهُمْ أَجْرٌ لِمَنْ قَتَلَهُمْ يَوْمَ الْقِيَامَةِ ‏"‏ ‏.‏

Yahya related to me from Malik that he had heard some of the people of knowledge say that when falcons, eagles, and hawks and their like, understood as trained dogs understood, there was no harm in eating what they had killed in the course of hunting, if the name of Allah had been mentioned when they were sent out.

Malik said, "The best of what I have heard about retrieving game from the falcon's talons or from the dog's fangs and then waiting until it dies, is that it is not halal to eat it."

Malik said, "The same applies to anything which could have been slaughtered by the hunter when it was in the talons of the falcon or the fangs of the dog. If the hunter leaves it until the falcon or dog has killed it, it is not halal to eat it either". He continued, "The same thing applies to any game hit by a hunter and caught while still alive, which he neglects to slaughter before it dies."

Malik said, "It is generally agreed among us that it is halal to eat the game that a hunting-dog belonging to magians hunts or kills, if it is sent out by a muslim and the animal is trained. There is no harm in it even if the muslim does not actually slaughter it.

It is the same as a muslim using a magian's knife to slaughter with or using his bow and arrows to shoot and kill with. The game he shot and the animal he slaughters are halal. There is no harm in eating them. If a magian sends out a muslim's hunting dog for game, and it catches it, the game is not to be eaten unless it is slaughtered by a muslim. That is like a magian using a muslim's bow and arrow to hunt game with, or like his using a muslim's knife to slaughter with. It is not halal to eat anything killed like that.

Ibn ‘Abbas said that in the year of al-Hudaibiya the Prophet included among his sacrificial animals a camel with a silver (a version has gold) nose-ring which had belonged to Abu Jahl,( A chief of Quraish who had been hostile to the Prophet. He was killed at Badr) thereby enraging the polytheists. Abu Dawud transmitted it.

Yahya related to me from Malik from Ibn Shihab that Said ibn al- Musayyab said, "If someone dedicates an animal voluntarily and then it is injured and he kills it and gives everyone a free hand in eating it, he owes nothing. If, however, he eats some of it himself, or tells certain other people to eat it, then he owes compensation."

It was narrated from Saeed bin Al-Musayyab that:
a woman enter upon Aishah, and in her hand was an iron-footed stick. She said: "What is this?" she (Aishah) Said: "It is for these geckos, because the Prophet of Allah told us, that there was nothing that did not try to extinguish the fire for Ihram except for this animals, so he told us to kill it. And he forbade us to kill harmless snakes, except for the snake with two lines on its back, and the snake with a short tail, for the snatch away the eyesight and cause tat which is in women's wombs to be miscarried.
أَخْبَرَنِي أَبُو بَكْرِ بْنُ إِسْحَاقَ، قَالَ حَدَّثَنَا إِبْرَاهِيمُ بْنُ مُحَمَّدِ بْنِ عَرْعَرَةَ، قَالَ حَدَّثَنَا مُعَاذُ بْنُ هِشَامٍ، قَالَ حَدَّثَنِي أَبِي، عَنْ قَتَادَةَ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ امْرَأَةً، دَخَلَتْ عَلَى عَائِشَةَ وَبِيَدِهَا عُكَّازٌ فَقَالَتْ مَا هَذَا فَقَالَتْ لِهَذِهِ الْوَزَغِ لأَنَّ نَبِيَّ اللَّهِ صلى الله عليه وسلم حَدَّثَنَا ‏ "‏ أَنَّهُ لَمْ يَكُنْ شَىْءٌ إِلاَّ يُطْفِئُ عَلَى إِبْرَاهِيمَ عَلَيْهِ السَّلاَمُ إِلاَّ هَذِهِ الدَّابَّةُ ‏"‏ ‏.‏ فَأَمَرَنَا بِقَتْلِهَا وَنَهَى عَنْ قَتْلِ الْجِنَّانِ إِلاَّ ذَا الطُّفْيَتَيْنِ وَالأَبْتَرَ فَإِنَّهُمَا يُطْمِسَانِ الْبَصَرَ وَيُسْقِطَانِ مَا فِي بُطُونِ النِّسَاءِ ‏.‏

Narrated Adi bin Hatim:

The Prophet said, "If you let loose your hound after a game and mention Allah's Name on sending it, and the hound catches the game and kills it, then you can eat of it. But if the hound eats of it, then you should not eat thereof, for the hound has caught it for itself. And if along with your hound, joined other hounds, and Allah's Name was not mentioned at the time of their sending, and they catch an animal and kill it, you should not eat of it, for you will not know which of them has killed it. And if you have thrown an arrow at the game and then find it (dead) two or three days later and, it bears no mark other than the wound inflicted by your arrow, then you can eat of it. But if the game is found (dead) in water, then do not eat of it."

Narrated Abu Sa`id Al-Khudri:

Allah's Apostle said, "The thing I am afraid of most for your sake, is the worldly blessings which Allah will bring forth to you." It was said, "What are the blessings of this world?" The Prophet said, "The pleasures of the world." A man said, "Can the good bring forth evil?" The Prophet kept quiet for a while till we thought that he was being inspired divinely. Then he started removing the sweat from his forehead and said," Where is the questioner?" That man said, "I (am present)." Abu Sa`id added: We thanked the man when the result (of his question) was such. The Prophet said, "Good never brings forth but good. This wealth (of the world) is (like) green and sweet (fruit), and all the vegetation which grows on the bank of a stream either kills or nearly kills the animal that eats too much of it, except the animal that eats the Khadira (a kind of vegetation). Such an animal eats till its stomach is full and then it faces the sun and starts ruminating and then it passes out dung and urine and goes to eat again. This worldly wealth is (like) sweet (fruit), and if a person earns it (the wealth) in a legal way and spends it properly, then it is an excellent helper, and whoever earns it in an illegal way, he will be like the one who eats but is never satisfied."

حَدَّثَنَا إِسْمَاعِيلُ، قَالَ حَدَّثَنِي مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي سَعِيدٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّ أَكْثَرَ مَا أَخَافُ عَلَيْكُمْ مَا يُخْرِجُ اللَّهُ لَكُمْ مِنْ بَرَكَاتِ الأَرْضِ ‏"‏‏.‏ قِيلَ وَمَا بَرَكَاتُ الأَرْضِ قَالَ ‏"‏ زَهْرَةُ الدُّنْيَا ‏"‏‏.‏ فَقَالَ لَهُ رَجُلٌ هَلْ يَأْتِي الْخَيْرُ بِالشَّرِّ فَصَمَتَ النَّبِيُّ صلى الله عليه وسلم حَتَّى ظَنَنَّا أَنَّهُ يُنْزَلُ عَلَيْهِ، ثُمَّ جَعَلَ يَمْسَحُ عَنْ جَبِينِهِ فَقَالَ ‏"‏ أَيْنَ السَّائِلُ ‏"‏‏.‏ قَالَ أَنَا‏.‏ قَالَ أَبُو سَعِيدٍ لَقَدْ حَمِدْنَاهُ حِينَ طَلَعَ ذَلِكَ‏.‏ قَالَ ‏"‏ لاَ يَأْتِي الْخَيْرُ إِلاَّ بِالْخَيْرِ، إِنَّ هَذَا الْمَالَ خَضِرَةٌ حُلْوَةٌ، وَإِنَّ كُلَّ مَا أَنْبَتَ الرَّبِيعُ يَقْتُلُ حَبَطًا أَوْ يُلِمُّ، إِلاَّ آكِلَةَ الْخَضِرَةِ، أَكَلَتْ حَتَّى إِذَا امْتَدَّتْ خَاصِرَتَاهَا اسْتَقْبَلَتِ الشَّمْسَ، فَاجْتَرَّتْ وَثَلَطَتْ وَبَالَتْ، ثُمَّ عَادَتْ فَأَكَلَتْ، وَإِنَّ هَذَا الْمَالَ حُلْوَةٌ، مَنْ أَخَذَهُ بِحَقِّهِ وَوَضَعَهُ فِي حَقِّهِ، فَنِعْمَ الْمَعُونَةُ هُوَ، وَمَنْ أَخَذَهُ بِغَيْرِ حَقِّهِ، كَانَ الَّذِي يَأْكُلُ وَلاَ يَشْبَعُ ‏"‏‏.‏

If you find another dog with yours and the game has been killed, do not eat, for you do not know which of them killed the animal. When you shoot your arrow, mention Allah's Name and if the game goes out of sight for a day and you find it without any marks except for that arrow, eat if you wish, but if you find it drowned in water do not eat it." Narrated Rafi` bin Khadij:

We were with the Prophet in Dhul-Hulaifa and there the people were struck with severe hunger. Then we got camels and sheep as war booty (and slaughtered them). The Prophet was behind all the people. The people hurried and fixed the cooking pots (for cooking) but the Prophet came there and ordered that the cooking pots be turned upside down. Then he distributed the animals, regarding ten sheep as equal to one camel. One of the camels ran away and there were a few horses with the people. They chased the camel but they got tired, whereupon a man shot it with an arrow whereby Allah stopped it. The Prophet said, "Among these animals some are as wild as wild beasts, so if one of them runs away from you, treat it in this way." I said. "We hope, or we are afraid that tomorrow we will meet the enemy and we have no knives, shall we slaughter (our animals) with canes?" The Prophet said, "If the killing tool causes blood to gush out and if Allah's Name is mentioned, eat (of the slaughterer animal). But do not slaughter with a tooth or a nail. I am telling you why: A tooth is a bone, and the nail is the knife of Ethiopians."

حَدَّثَنِي مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ سَعِيدِ بْنِ مَسْرُوقٍ، عَنْ عَبَايَةَ بْنِ رِفَاعَةَ بْنِ رَافِعٍ، عَنْ جَدِّهِ، رَافِعِ بْنِ خَدِيجٍ قَالَ كُنَّا مَعَ النَّبِيِّ صلى الله عليه وسلم بِذِي الْحُلَيْفَةِ، فَأَصَابَ النَّاسَ جُوعٌ، فَأَصَبْنَا إِبِلاً وَغَنَمًا، وَكَانَ النَّبِيُّ صلى الله عليه وسلم فِي أُخْرَيَاتِ النَّاسِ، فَعَجِلُوا فَنَصَبُوا الْقُدُورَ، فَدُفِعَ إِلَيْهِمُ النَّبِيُّ صلى الله عليه وسلم فَأَمَرَ بِالْقُدُورِ فَأُكْفِئَتْ، ثُمَّ قَسَمَ فَعَدَلَ عَشَرَةً مِنَ الْغَنَمِ بِبَعِيرٍ، فَنَدَّ مِنْهَا بَعِيرٌ، وَكَانَ فِي الْقَوْمِ خَيْلٌ يَسِيرَةٌ فَطَلَبُوهُ فَأَعْيَاهُمْ، فَأَهْوَى إِلَيْهِ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ اللَّهُ فَقَالَ النَّبِيُّ صلى الله عليه وسلم ‏"‏ إِنَّ لِهَذِهِ الْبَهَائِمِ أَوَابِدَ كَأَوَابِدِ الْوَحْشِ، فَمَا نَدَّ عَلَيْكُمْ فَاصْنَعُوا بِهِ هَكَذَا ‏"‏‏.‏ قَالَ وَقَالَ جَدِّي إِنَّا لَنَرْجُو ـ أَوْ نَخَافُ ـ أَنْ نَلْقَى الْعَدُوَّ غَدًا، وَلَيْسَ مَعَنَا مُدًى، أَفَنَذْبَحُ بِالْقَصَبِ فَقَالَ ‏"‏ مَا أَنْهَرَ الدَّمَ وَذُكِرَ اسْمُ اللَّهِ عَلَيْهِ فَكُلْ، لَيْسَ السِّنَّ وَالظُّفُرَ، وَسَأُخْبِرُكُمْ عَنْهُ، أَمَّا السِّنُّ عَظْمٌ وَأَمَّا الظُّفُرُ فَمُدَى الْحَبَشَةِ ‏"‏‏.‏

Shaddad b. Aus reported God’s messenger as saying, “God who is blessed and exalted has decreed that everything should be done in a good way, so when you kill use a good method, and when you cut an animal’s throat you should use a good method, for each of you should sharpen his knife and give the animal as little pain as possible.” Muslim transmitted it.

Hatim told that God’s messenger said to him, “When you set off your dog mention God's name, and if it catches anything for you and you come up to it while it is still alive cut its throat; if you come up to it when the dog has killed it but not eaten any of it eat it; but if it has eaten any of it do not eat, for it has caught it only for itself. If you find another dog with yours and a kill has been made, do not eat, for you do not know which of them killed the animal. When you shoot your arrow mention God’s name and if the game goes out of your sight for a day and you find in it only the mark of your arrow eat if you wish, but if you find it drowned in water do not eat.” (Bukhari and Muslim.)

Ibn Umar (Allah be pleased with them) reported that Allah's Messenger (may peace be, upon him) ordered the killing of dogs except the dog tamed for hunting, or watching of the herd of sheep or other domestic animals. It was said to Ibn Umar (Allah be pleased with them) that Abu Huraira (Allah be pleased with him) talks of (exception) about the dog for watching the field, whereupon he said:

Since Abu Huraira (Allah be pleased with him) possessed land.

Malik said, "Allah, the Blessed and Exalted, says, 'O you who trust, do not kill game while you are in ihram. Whoever of you kills game intentionally has to pay a forfeit commensurate with what he has killed in cattle which two men from among you shall judge, a sacrificial animal which reaches the Kaba, or else he makes a kaffara of either feeding poor people or the equivalent of that in fasting, so that he may taste the consequences of what he has done.' " (Sura 5 ayat 95).

Malik said, "Someone who hunts game when he is not in ihram and then kills it while he is in ihram is in the same position as someone who buys game while he is in ihram and then kills it. Allah has forbidden killing it, and so a man who does so has to pay a forfeit for it. The position that we go by in this matter is that a forfeit is assessed for anyone who kills game while he is in ihram."

Yahya said that Malik said, "The best that I have heard about someone who kills game and is assessed for it is that the game which he has killed is assessed and its value in food is estimated and with that food he feeds each poor man a mudd, or fasts a day in place of each mudd. The number of poor men is considered, and if it is ten then he fasts ten days, and if it is twenty he fasts twenty days, according to how many people there are to be fed, even if there are more than sixty."

Malik said, "I have heard that a forfeit is assessed for someone who kills game in the Haram while he is not in ihram in the same way that it is assessed for some one who kills game in the Haram while he is in ihram ."

Malik said, I still hear that when a person in ihram kills an ostrich, a camel is due."

Malik said, "I think that for an ostrich egg, one tenth of the price of a camel is due in the same way that there is a newly-born male or female slave for the unborn child of a free woman. The value of the newly-born slave is fifty dinars, and that is one-tenth of what the blood-money for the mother would be.

"Birds from the eagle family, eagles or falcons or vultures count as game for which a price is paid just as a price is paid for any game which a person in ihram kills. For everything for which a penalty is paid, the assessment is the same, whether the animal is old or young. The analogy of that is that the blood-money for the young and the old freeman, are considered to be the same."

It was narrated that `Adiyy bin Abi Hatim said:
"I asked the Messenger of Allah about hunting with a Mi`rad. He said: 'If you strike (the game) with its sharp point, then eat, but if you strike it with its broad side, then the animal has been killed with a blow.' I asked him about dogs and he said: 'If you release your dog and he catches (the game) but does not eat it, then eat, because his catching it is its slaughter. If you find another dog with your dog and you fear that it caught (the game) with him and killed it, then do not eat, for you said the name of Allah over your dog, but you did not say His name over the other one.'"

Narrated Rafi' b. Khadij:
I came to the Messenger of Allah (saws) and said: Messenger of Allah, we shall meet the enemy tomorrow and we have no knives with us. May we kill with a sharp-edged white stone (flint) and with splinter of a staff ? The Messenger of Allah (saws) said: Hasten in slaughtering it. When Allah's name is mentioned you may eat what is killed by anything which causes the blood to flow except tooth and claw. I shall tell you about it. The tooth is a bone, and the claw is the knife of Abyssinians. Some people hastened and went forward, they made haste and got booty, while the Messenger of Allah (saws) was in the rear and they setup cooking pots. The Messenger of Allah (saws) passed by over the cooking pots. He ordered to turn them over. He then divided (the spoils of war) between them, and gave them a camel for ten goats in equation. One of the camels of the people ran away, and they had no horses with them at that time. A man shot an arrow at it, and Allah prevented it from escaping. The Prophet (saws) said: Among animals (i.e. camels) there are some which bolt like wild animals ; so when any of them does so, do with it like this.

Narrated `Adi bin Hatim:

I said, "O Allah's Apostle! I let loose my hound after a game and mention Allah's Name on sending it." The Prophet said, "If you let loose your hound after a game and you mention Allah's Name on sending it and the hound catches and kills the game and eats of it, then you should not eat of it, for it has killed it for itself." I said, "Sometimes when I send my hound after a game, I find another hound along with it and I do not know which of them has caught the game." He said, "You must not eat of it because you have not mentioned, the Name of Allah except on sending your own hound, and you did not mention it on the other hound." Then I asked him about the game hunted with a Mi'rad (i.e. a sharp edged piece of wood or a piece of wood provided with a sharp piece of iron used for hunting). He said, "If the game is killed with its sharp edge, you can eat of it, but if it is killed by its broad side (shaft), you cannot eat of it, for then it is like an animal beaten to death with a piece of wood."

He told that God's messenger asked advice when they heard of the approach of Abu Sufyan, and Sa`d b. `Ubada got up and said, "Messenger of God, by Him in whose hand my soul is, if you were to command us to plunge our animals[1] into the sea we would do so, and if you were to command us to drive them as vigorously as possible to Bark al-Ghimad[2] we would do so." God's messenger then invited the people, and they went off till they alighted at Badr. God's messenger then said, "This is where so and so will be killed," putting his hand on the ground here and there. Anas said that none of them[3] left the place indicated by God's messenger's hand. 1. 'Literally, "to plunge them ". The context makes it clear that the reference is to animals. 2. A place in the Yemen. 3. This is explained as referring to the infidels the place of whose death the Prophet had foretold. Muslim transmitted it.

Allah's Apostle ascended the pulpit and said, "Nothing worries me as to what will happen to you after me, except the temptation of worldly blessings which will be conferred on you." Then he mentioned the worldly pleasures. He started with the one (i.e. the blessings) and took up the other (i.e. the pleasures). A man got up saying, "O Allah's Apostle! Can the good bring about evil?" The Prophet remained silent and we thought that he was being inspired divinely, so all the people kept silent with awe. Then the Prophet wiped the sweat off his face and asked, "Where is the present questioner?" "Do you think wealth is good?" he repeated thrice, adding, "No doubt, good produces nothing but good. Indeed it is like what grows on the banks of a stream which either kills or nearly kills the grazing animals because of gluttony except the vegetation-eating animal which eats till both its flanks are full (i.e. till it gets satisfied) and then stands in the sun and defecates and urinates and again starts grazing. This worldly property is sweet vegetation. How excellent the wealth of the Muslim is, if it is collected through legal means and is spent in Allah's Cause and on orphans, poor people and travelers. But he who does not take it legally is like an eater who is never satisfied and his wealth will be a witness against him on the Day of Resurrection."

حَدَّثَنَا مُحَمَّدُ بْنُ سِنَانٍ، حَدَّثَنَا فُلَيْحٌ، حَدَّثَنَا هِلاَلٌ، عَنْ عَطَاءِ بْنِ يَسَارٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ ـ رضى الله عنه ـ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَامَ عَلَى الْمِنْبَرِ فَقَالَ ‏"‏ إِنَّمَا أَخْشَى عَلَيْكُمْ مِنْ بَعْدِي مَا يُفْتَحُ عَلَيْكُمْ مِنْ بَرَكَاتِ الأَرْضِ ‏"‏‏.‏ ثُمَّ ذَكَرَ زَهْرَةَ الدُّنْيَا، فَبَدَأَ بِإِحْدَاهُمَا وَثَنَّى بِالأُخْرَى، فَقَامَ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ أَوَيَأْتِي الْخَيْرُ بِالشَّرِّ فَسَكَتَ عَنْهُ النَّبِيُّ صلى الله عليه وسلم قُلْنَا يُوحَى إِلَيْهِ‏.‏ وَسَكَتَ النَّاسُ كَأَنَّ عَلَى رُءُوسِهِمِ الطَّيْرَ، ثُمَّ إِنَّهُ مَسَحَ عَنْ وَجْهِهِ الرُّحَضَاءَ، فَقَالَ ‏"‏ أَيْنَ السَّائِلُ آنِفًا أَوَخَيْرٌ هُوَ ـ ثَلاَثًا ـ إِنَّ الْخَيْرَ لاَ يَأْتِي إِلاَّ بِالْخَيْرِ، وَإِنَّهُ كُلُّ مَا يُنْبِتُ الرَّبِيعُ مَا يَقْتُلُ حَبَطًا أَوْ يُلِمُّ كُلَّمَا أَكَلَتْ، حَتَّى إِذَا امْتَلأَتْ خَاصِرَتَاهَا اسْتَقْبَلَتِ الشَّمْسَ، فَثَلَطَتْ وَبَالَتْ ثُمَّ رَتَعَتْ، وَإِنَّ هَذَا الْمَالَ خَضِرَةٌ حُلْوَةٌ، وَنِعْمَ صَاحِبُ الْمُسْلِمِ لِمَنْ أَخَذَهُ بِحَقِّهِ، فَجَعَلَهُ فِي سَبِيلِ اللَّهِ وَالْيَتَامَى وَالْمَسَاكِينِ، وَمَنْ لَمْ يَأْخُذْهُ بِحَقِّهِ فَهْوَ كَالآكِلِ الَّذِي لاَ يَشْبَعُ، وَيَكُونُ عَلَيْهِ شَهِيدًا يَوْمَ الْقِيَامَةِ ‏"‏‏.‏

Abu Sa`id al-Khudri said:
While we were with God's messenger when he was dividing portions, Dhul Khuwaisira, a man of the B. Tamim, came to him and said, "Act equitably, messenger of God." He replied, "Out upon you! Who will act equitably if I do not? You will be disappointed and losing if I do not act equitably." `Umar asked permission to cut off his head, but he replied, "Leave him alone, for he has companions[1] in comparison with whose prayers any of you would despise his, and in comparison, with whose fasting any of you would despise his. They recite the Quran but it does not pass their collarbones. They swerve from the religion as an arrow goes through the animal aimed at. Their look is directed to its head, on to the sinew on its socket, on to its nadi, which is its rod, on to its feathers, but there is no sign of excrement or blood on it[2]. They will be recognised by the presence of a black man one of whose upper arms quivers like a woman's breast, or like a piece of meat, and they will revolt against the best section of mankind[3]. Abu Sa'id said: I testify that I heard this tradition from God's messenger, and I testify that `Ali b. Abu Talib fought with them and that I was with him. He gave orders about that man who was sought for, and when he was brought in and I looked at him, he was exactly as the Prophet had described him. A version has: A man with deep-set eyes, a projecting brow, a thick beard, high cheekbones and a shaven head came forward and said, "Fear God, Muhammad." He replied, "Who will obey God if I disobey Him? God entrusts me with power over the inhabitants of the earth but you[4] do not." A man asked to be allowed to kill him but he prevented him. Then when the man turned away, he said, "From this one's stock there will be people who recite the Quran, yet it will not pass their throats. They will swerve from Islam as an arrow goes through the animal shot at. They will kill the followers of Islam and leave the worshippers of idols alone; but if I live to their time, I shall certainly kill them as `Ad were killed." 1. People like him, or people at a later period who will acquire a reputation for piety. The reference is to the Kharijites. 2. Just as an arrow can go through an animal without traces of excrement or blood, they will abandon Islam so quickly that no trace of it will be left in them. 3. `Ali and his party. 4. The pronoun is plural, indicating the man and his people. (Bukhari and Muslim.)

Yahya said that he heard Malik say, "What is done in our community about injury to a domestic animal, is that the one who injures it must pay the amount by which he has diminished the animal's price."

Yahya said that he heard Malik speak about a camel who attacked a man and he feared for himself and killed it or hamstrung it. He said, "If he has a clear proof that it was heading for him and had attacked him, there are no damages against him. If there is no clear proof except his word, he is responsible for the camel."

Narrated Rafi` bin Khadij:

that he said, "O Allah's Apostle! We have no knife." The Prophet said, "if the killing tool causes blood to gush out, and if Allah's Name is mentioned, eat (of the slaughtered animal). But do not slaughter with a nail or a tooth, for the nail is the knife of Ethiopians and a tooth is a bone." Suddenly a camel ran away and it was stopped (with an arrow). The Prophet then said, "Of these camels there are some which are as wild as wild beasts; so if one of them runs away from you and you cannot catch it, treat it in this manner (i.e. shoot it with an arrow).

It was narrated that Jabir bin 'Abdullah said:
"A thief was brought to the Messenger of Allah and he said: 'Kill him.' They said: 'O Messenger of Allah, he only stole.' He said: 'Cut off (his hand).' So his hand was cut off. Then he was brought a second time and he said: 'Kill him.' They said; 'O Messenger of Allah, he only stole.' He said: 'Cut off (his foot).' So his foot was cut off. He was brought to him a third time and he said: 'Kill him.' They said: 'O Messenger of Allah, he only stole. He said: 'Cut off (his other hand).' Then he was brought to him a fourth time and he said: Kill him.' They said: 'O Messenger of Allah, he only stole.' He said: 'Cut off (his other foot).' He was brought to him a fifth time and he said: "So we took him to an animal pen and attacked him. He lay down on his back then waved his arms and legs (in the air), and the camels ran away. Then they attacked him a second time and he did the same thing, then they attacked him a third time, and we threw stones at him and killed him, then we threw him into a well and threw stones on top of him." (Hasan) Abu 'Abdur-Rahman (An-Nasai) said: This Hadith is Munkar, Musab bin Thabit is not strong in Hadith.

"The Messenger of Allah commanded us to examine the eyes and ears (of animals) and not to Sacrifice and animal with a bad eye, nor an animal with its ears slit from the front, nor an animals with its ears slit form the back, nor an animal with a round hole in its ear.

It has been narrated on the authority of Abu Mas'ud al-Ansari who said:

A man came to the Messenger of Allah (may peace be upon him) and said: My riding beast has been killed, so give me some animal to ride upon. He (the Holy Prophet) said: I have none with me. A man said: Messenger of Allah, I can guide him to one who will provide him with a riding beast. The Messenger of Allah (may peace be upon him) said: One who guides to something good has a reward similar to that of its doer.

Yahya related to me from Malik from Ibn Shihab from Said ibn al- Musayyab and Abu Salama ibn Abd ar-Rahman from Abu Hurayra that the Messenger of Allah, may Allah bless him and grant him peace, said, "The wound of an animal is of no account and no compensation is due for it. The well is of no account and no compensation is due for it. The mine is of no account and no compensation is due for it and a fifth is due for buried treasures." (Al-kanz:

see Book 17).

Malik said, "Everyone leading an animal by the halter, driving it, and riding it is responsible for what the animal strikes unless the animal kicks out without anything being done to it to make it kick out. Umar ibn al-Khattab imposed the blood-money on a person who was exercising his horse."

Malik said, "It is more fitting that a person leading an animal by the halter, driving it, or riding it incur a loss than a person who is exercising his horse." (See hadith 4 of this book).

Malik said, "What is done in our community about a person who digs a well on a road or ties up an animal or does the like of that on a road used by muslims, is that since what he has done is included in that which he is not permitted to do in such a place, he is liable for whatever injury or other thing arises from that action. The blood-money of that which is less than a third of the full blood- money is owed from his own personal property. Whatever reaches a third or more, is owed by his tribe. Any such things that he does which he is permitted to do on the muslims' road are something for which he has no liability or loss. Part of that is a hole which a man digs to collect rain, and the beast from which the man alights for some need and leaves standing on the road. There is no penalty against anyone for this."

Malik spoke about a man who went down a well, and another man followed behind him, and the lower one pulled the higher one and they fell into the well and both died He said, "The tribe of the one who pulled him in is responsible for the blood-money."

Malik spoke about a child whom a man ordered to go down into a well or to climb a palm tree and he died as a result. He said, "The one who ordered him is liable for whatever befalls him, be it death or something else."

Malik said, "The way of doing things in our community about which there is no dispute is that women and children are not obliged to pay blood-money together with the tribe in the blood-moneys which the tribe must pay. The blood-money is only obligatory for a man who has reached puberty."

Malik said that the tribe could bind themselves to the blood-money of mawali if they wished. If they refused, they were people of the diwan or were cut off from their people. In the time of the Messenger of Allah, may Allah bless him and grant him peace, people paid the blood-money to each other as well as in the time of Abu Bakr as-Siddiq before there was a diwan. The diwan was in the time of Umar ibn al-Khattab. No one other than one's people and the ones holding the wala' paid blood- money for one because the wala' was not transferable and because the Prophet, may Allah bless him and grant him peace, said, "The wala' belongs to the one who sets free."

Malik said, "The wala' is an established relationship."

Malik said, "What is done in our community about animals that are injured is that the person who causes the injury pays whatever of their value has been diminished."

Malik said about a man condemned to death and one of the other hudud befell him, "He is not punished for it. That is because the killing overrides all of that, except for slander. The slander remains hanging over the one to whom it was said because it will be said to him, 'Why do you not flog the one who slandered you?' I think that the condemned man is flogged with the hadd before he is killed, and then he is killed. I do not think that any retaliation is inflicted on him for any injury except killing because killing overrides all of that."

Malik said, "What is done in our community is that when a murdered person is found among the main body of a people in a village or other place, the house or place of the nearest people to him is not responsible. That is because the murdered person can be slain and then cast at the door of some people to shame them by it. No one is responsible for the like of that."

Malik said about a group of people who fight with each other and when the fight is broken up, a man is found dead or wounded, and it is not known who did it, "The best of what is heard about that is that there is blood-money for him, and the blood-money is against the people who argued with him. If the injured or slain person is not from either of the two parties, his blood-money is against both of the two parties together."

“The Messenger of Allah (saw) stood up and addressed the people saying: ‘No, by Allah, I do not fear for you, O people, but I fear the attractions of this world that Allah brings forth for you.’ A man said to him: ‘O Messenger of Allah(saw), does good bring forth evil?’ The Messenger of Allah (saw) remained silent for a while, then he said: ‘What did you say?’ He said: ‘I said, does good bring forth evil?’ The Messenger of Allah (saw) said: ‘Good does not bring forth anything but good, but is it really good? Everything that grows on the banks of a stream may either kill if overeaten or (at least) make the animals sick, except if an animal eats its fill of Khadir* and then faces the sun, and then defecates and urinates, chews the cud and then returns to graze again. Whoever takes wealth in a lawful manner, it will be blessed for him, but whoever takes it in an unlawful manner, his likeness is that of one who eats and it never satisfied.’”
حَدَّثَنَا عِيسَى بْنُ حَمَّادٍ الْمِصْرِيُّ، أَنْبَأَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنْ سَعِيدٍ الْمَقْبُرِيِّ، عَنْ عِيَاضِ بْنِ عَبْدِ اللَّهِ، أَنَّهُ سَمِعَ أَبَا سَعِيدٍ الْخُدْرِيَّ، يَقُولُ قَامَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ فَخَطَبَ فَقَالَ ‏"‏ لاَ وَاللَّهِ مَا أَخْشَى عَلَيْكُمْ أَيُّهَا النَّاسُ إِلاَّ مَا يُخْرِجُ اللَّهُ لَكُمْ مِنْ زَهْرَةِ الدُّنْيَا ‏"‏ ‏.‏ فَقَالَ لَهُ رَجُلٌ يَا رَسُولَ اللَّهِ أَيَأْتِي الْخَيْرُ بِالشَّرِّ فَصَمَتَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ سَاعَةً ثُمَّ قَالَ ‏"‏ كَيْفَ قُلْتَ ‏"‏ ‏.‏ قَالَ قُلْتُ وَهَلْ يَأْتِي الْخَيْرُ بِالشَّرِّ فَقَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏"‏ إِنَّ الْخَيْرَ لاَ يَأْتِي إِلاَّ بِخَيْرٍ أَوَخَيْرٌ هُوَ إِنَّ كُلَّ مَا يُنْبِتُ الرَّبِيعُ يَقْتُلُ حَبَطًا أَوْ يُلِمُّ إِلاَّ آكِلَةَ الْخَضِرِ أَكَلَتْ حَتَّى إِذَا امْتَلأَتْ خَاصِرَتَاهَا اسْتَقْبَلَتِ الشَّمْسَ فَثَلَطَتْ وَبَالَتْ ثُمَّ اجْتَرَّتْ فَعَادَتْ فَأَكَلَتْ فَمَنْ يَأْخُذُ مَالاً بِحَقِّهِ يُبَارَكُ لَهُ وَمَنْ يَأْخُذُ مَالاً بِغَيْرِ حَقِّهِ فَمَثَلُهُ كَمَثَلِ الَّذِي يَأْكُلُ وَلاَ يَشْبَعُ ‏"‏ ‏.‏

Sahih al-Bukhari 5543

Narrated Rait' bin Khadij:

I said to the Prophet, "We will be facing the enemy tomorrow and we have no knives (for slaughtering)' He said, "If you slaughter the animal with anything that causes its blood to flow out, and if Allah's Name is mentioned on slaughtering it, eat of it, unless the killing instrument is a tooth or nail. I will tell you why: As for the tooth, it is a bone; and as for the nail, it is the knife of Ethiopians." The quick ones among the people got the war booty while the Prophet was behind the people. So they placed the cooking pots on the fire, but the Prophet ordered the cooking pots to be turned upside down. Then he distributed (the war booty) among them, considering one camel as equal to ten sheep. Then a camel belonging to the first party of people ran away and they had no horses with them, so a man shot it with an arrow whereby Allah stopped it. The Prophet said, "Of these animals there are some which are as wild as wild beasts. So, if anyone of them runs away like this, do like this (shoot it with an arrow).

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا أَبُو الأَحْوَصِ، حَدَّثَنَا سَعِيدُ بْنُ مَسْرُوقٍ، عَنْ عَبَايَةَ بْنِ رِفَاعَةَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، رَافِعِ بْنِ خَدِيجٍ قَالَ قُلْتُ لِلنَّبِيِّ صلى الله عليه وسلم إِنَّنَا نَلْقَى الْعَدُوَّ غَدًا، وَلَيْسَ مَعَنَا مُدًى‏.‏ فَقَالَ ‏"‏ مَا أَنْهَرَ الدَّمَ وَذُكِرَ اسْمُ اللَّهِ فَكُلُوا، مَا لَمْ يَكُنْ سِنٌّ وَلاَ ظُفُرٌ، وَسَأُحَدِّثُكُمْ عَنْ ذَلِكَ، أَمَّا السِّنُّ فَعَظْمٌ، وَأَمَّا الظُّفْرُ فَمُدَى الْحَبَشَةِ ‏"‏‏.‏ وَتَقَدَّمَ سَرَعَانُ النَّاسِ فَأَصَابُوا مِنَ الْغَنَائِمِ وَالنَّبِيُّ صلى الله عليه وسلم فِي آخِرِ النَّاسِ فَنَصَبُوا قُدُورًا فَأَمَرَ بِهَا فَأُكْفِئَتْ وَقَسَمَ بَيْنَهُمْ وَعَدَلَ بَعِيرًا بِعَشْرِ شِيَاهٍ، ثُمَّ نَدَّ بَعِيرٌ مِنْ أَوَائِلِ الْقَوْمِ وَلَمْ يَكُنْ مَعَهُمْ خَيْلٌ فَرَمَاهُ رَجُلٌ بِسَهْمٍ فَحَبَسَهُ اللَّهُ‏.‏ فَقَالَ ‏"‏ إِنَّ لِهَذِهِ الْبَهَائِمِ أَوَابِدَ كَأَوَابِدِ الْوَحْشِ فَمَا فَعَلَ مِنْهَا هَذَا فَافْعَلُوا مِثْلَ هَذَا ‏"‏‏.‏

Sunan an-Nasa'i 4372
It was narrated that 'Ali, may Allah be pleased with him, said:
"The Messenger of Allah commanded us to examine the eyes and ears (of animals), and no0t to sacrifice and animals with its ears slit from the front, and animal with its ears slit form the back, a animal with its tail cut, nor an animals with a round hole in its ear."
أَخْبَرَنِي مُحَمَّدُ بْنُ آدَمَ، عَنْ عَبْدِ الرَّحِيمِ، - وَهُوَ ابْنُ سُلَيْمَانَ - عَنْ زَكَرِيَّا بْنِ أَبِي زَائِدَةَ، عَنْ أَبِي إِسْحَاقَ، عَنْ شُرَيْحِ بْنِ النُّعْمَانِ، عَنْ عَلِيٍّ، رضى الله عنه قَالَ أَمَرَنَا رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ نَسْتَشْرِفَ الْعَيْنَ وَالأُذُنَ وَأَنْ لاَ نُضَحِّيَ بِمُقَابَلَةٍ وَلاَ مُدَابَرَةٍ وَلاَ بَتْرَاءَ وَلاَ خَرْقَاءَ ‏.‏

It was narrated that 'Ali bin Abi Talib, may Allah be please with him, said:
"The Messenger of Allah forbade sacrificing an animals with its ears slit form the front, and animals with its ears slit form the back, and animal with its ears slit lengthwise, an animals with a round hole in tits ear, or an animals with its nose cut off"
أَخْبَرَنَا أَحْمَدُ بْنُ نَاصِحٍ، قَالَ حَدَّثَنَا أَبُو بَكْرِ بْنُ عَيَّاشٍ، عَنْ أَبِي إِسْحَاقَ، عَنْ شُرَيْحِ بْنِ النُّعْمَانِ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ، رضى الله عنه قَالَ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ نُضَحِّيَ بِمُقَابَلَةٍ أَوْ مُدَابَرَةٍ أَوْ شَرْقَاءَ أَوْ خَرْقَاءَ أَوْ جَدْعَاءَ ‏.‏

It was narrated from 'Ali bin Abi Talib, may Allah be please wityh him, that the messenger of Allah said:
"Do not sacrifice and animal with its ears slit from the front, and animal with its ears slit from the back, an animals with its ears slit lengthwise, and animal with a round hole in its ears, or an animal with one bad eye."
أَخْبَرَنِي هَارُونُ بْنُ عَبْدِ اللَّهِ، قَالَ حَدَّثَنَا شُجَاعُ بْنُ الْوَلِيدِ، قَالَ حَدَّثَنِي زِيَادُ بْنُ خَيْثَمَةَ، قَالَ حَدَّثَنَا أَبُو إِسْحَاقَ، عَنْ شُرَيْحِ بْنِ النُّعْمَانِ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ، رضى الله عنه أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ يُضَحَّى بِمُقَابَلَةٍ وَلاَ مُدَابَرَةٍ وَلاَ شَرْقَاءَ وَلاَ خَرْقَاءَ وَلاَ عَوْرَاءَ ‏"‏ ‏.‏
