Yahya said that he heard Malik speak about a man who bought goods - animals or clothes or wares, and the sale was found not to be permitted so it was revoked and the one who had taken the goods was ordered to return the owner his goods. Malik said, "The owner of the goods only has their value on the day they were taken from him, and not on the day they are returned to him. That is because the man is liable for them from the day he took them and whatever loss is in them after that is against him. For that reason, their increase and growth are also his. A man may take the goods at a time when they are selling well and are in demand, and then have to return them at a time when they have fallen in price and no one wants them. For instance, the man may take the goods from the other man, and sell them for ten dinars or keep them while their price is that. Then he may have to return them while their price is only a dinar. He should not go off with nine dinars from the man's property. Or perhaps they are taken by the man, and he sells them for a dinar or keeps them, while their price is only a dinar, then he has to return them, and their value on the day he returns them is ten dinars. The one who took them does not have to pay nine dinars from his property to the owner. He is only obliged to pay the value of what he took possession of on the day it was taken ."

He said, "Part of what clarifies this is that when a thief steals goods, only their price on the day he stole them is looked at. If cutting off the hand is necessary because of it, that is done. If the cutting off is delayed, either because the thief is imprisoned until his situation is examined or he flees and then is caught, the delay of the cutting off of the hand does not make the hadd, which was obliged for him on the day he stole, fall from him even if those goods become cheap after that. Nor does delay oblige cutting off the hand if it was not obliged on the day he took those goods, even if they become expensive after that."

AbuMajidah said:

I cut the ear of a boy, or he cut my ear (the narrator is doubtful). AbuBakr then came to us to perform hajj and we got together with him. But he referred us to Umar ibn al-Khattab. Umar (ibn al-Khattab) said: This reached the extent of retaliation. Call a cupper to me so that he may retaliate. When the cupper was called, he (Umar) said: I heard the Messenger of Allah (saws) say: I gave a boy to my maternal aunt, and I hope that she will be blessed in respect of him. I said to her: Do not entrust him to a supper, nor to a goldsmith, nor to a butcher.

Jabir told that a thief was brought to the Prophet and he said, "Maim him,* so this was done. He was brought a second time and he said, "Maim him,” so this was done. He was brought a third time and he said, "Maim him,” so this was done. He was brought a fourth time and he said, "Maim him,” so this was done. He was brought a fifth time and he said, "Kill him,” so they took him away and killed him. They then dragged him and cast him into a well and threw stones over him. Abu Dawud and Nasa’i transmitted it. In Sharh as-sunna the Prophet is reported as saying regarding the maiming of a thief, "Maim him, then cauterise him." * Where there has been one offence I have translated 'cut off the hand’, but here, where the verb 'to cut off’ is used without an object, I have found it more convenient to use a general word. In the previous tradition the hands and feet were mentioned in the Arabic.

Narrated At-Taimi:

From Jabir bin 'Abdullah and Anas bin Malik who said: "When the Messenger of Allah (saws) supplicated against locusts he would say: 'O Allah! Destroy the locusts, kill the large among him, and destroy the small, spoil his core, and cut off his rear. Take their mouths from our livelihood and our sustenance. Verily, You indeed listen to the supplication!' So a man said: 'O Messenger of Allah! How is it that you supplicate against one of the Allah's armies that He cut off their rear?'" He said: "So the Messenger of Allah (saws) said: 'They are bit scattered from a fish in the ocean.'"

Ibn 'Abbas (Allah be pleased with him) reported Allah's Messenger (may peace be upon him) as saying on the Day of Victory over Mecca:

There is no Hijra (emigration) but only Jihad and good intention; and when you are called to battle, then go forth. He also said on the Day of Victory over Mecca: Allah made this town sacred on the day He created the earth and the heavens; so it is -sacred by the sacred- ness conferred on it by Allah until the Day of Resurrection and fighting in it was not lawful to anyone before me, and it was made lawful for me only during an hour on one day, for it is sacred by the sacredness conferred on it by Allah until the Day of Resurrection. Its thorns are not to be cut, its game is not to be molested, and the things dropped are to be picked up only by one who makes a public announcement of it, and its fresh herbage is not to be cut. Abbas (Allah be pleased with him) said: Messenger of Allah, exception may be made in case of rush, for it is useful for their blacksmiths and for their houses. He (the Holy Prophet) conceding the suggestion of 'Abbas) said: Except rush.

It is narrated on the authority of Miqdad b. Aswad that he said. Messenger of Allah, you just see (here is a point):

If I encountered a person amongst the infidels (in the battlefield) and he attacked me and struck me and cut off one of my hands with the sword. Then he (in order to protect himself from me) took shelter of a tree and said: I become Muslim for Allah's sake. Messenger of Allah, can I kill him after he had uttered this? The Messenger of Allah (may peace be upon him) said: Do not kill him. I (the narrator) said: Messenger of Allah, he cut off my hand and uttered this after amputating it; should I then kill him? The Messenger of Allah (may peace be upon him) said: Don't kill him, for I you kill him, verily he would be in a position where you had been before killing him and verily you would be in a position where he had been before uttering (kalima).

Narrated AbuBakr:

AbuBarzah said: I was with AbuBakr. He became angry at a man and uttered hot words. I said: Do you permit me, Caliph of the Messenger of Allah (saws), that I cut off his neck? These words of mine removed his anger; he stood and went in. He then sent for me and said: What did you say just now? I said: (I had said:) Permit me that I cut off his neck. He said: Would you do it if I ordered you? I said: Yes. He said: No, I swear by Allah, this is not allowed for any man after Muhammad (saws).

Abu Dawud said: This is Yazid's version. Ahmad bin Hanbal said: That is, Abu Bakr has no powers to slay a man except for three reasons which the Messenger of Allah (saws) had mentioned: disbelief after belief, fornication after marriage, or killing a man without (murdering) any man by him. The Prophet (saws) had powers to kill.

It has been transmitted by al-Laith from Yunus on the authority of Ibn Shihab through his chain of narrators. He said in this version: A woman borrowed goods. Ibn ‘Abbas reported God’s messenger as saying on the day of the conquest of Mecca, “There is no hijra, but only jihad and intention ; and when you are called to battle, go forth.’’ He also said on the day of the conquest of Mecca, “God made this town sacred on the day He created the heavens and the earth, so it is sacred by the sacredness conferred on it by God till the day of resurrection. Fighting in it has not been lawful to anyone before me and it has been made lawful for me only during one hour on one day, so it is sacred by the sacredness conferred on it by God till the day of resurrection. Its thorns are not to be cut, its game is not to be molested, things dropped are to be picked up only by one who publicly announces it, and its fresh herbage is not to be cut.” Ibn ‘Abbas made the suggestion, “Except the rush, messenger of God, for it is useful for their blacksmiths and for their houses.” He then said, “Except the rush.” (Bukhari and Muslim.) A version by Abu Huraira has, “Its trees are not to be lopped, and only one who announces it may pick up anything which falls in it.”

Thauban told that when God’s messenger went on a journey the last member of his family he saw was Fatima and the first he visited on his return was Fatima. Once when he returned from an expedition she had hung up a hair-cloth, or a curtain, at her door and adorned al-Hasan and al-Husain with silver bracelets, so when he arrived he did not enter. Thinking that he had been prevented from entering by what he had seen she tore down the curtain, unfastened the bracelets from the boys and cut them off them. They went weeping to God's messenger, and when he had taken them from them he said, “Take this to so and so’s family, Thauban. It was narrated from 'Abdur-Rahman bin Tarafah, from 'Arafah bin As'ad bin Karib, who was his grandfather- saying that he saw his grandfather, and he said:
"His nose had been cut off at the battle of Al-Kulab during the Jahiliyyah, so he wore a nose made of silver, but it began to rot on him, so the Prophet [SAW] told him to wear a nose made of gold."

Abu Ad-Darda' narrated that the Messenger of Allah (s.a.w) said:
"Shall I not inform you of what is more virtuous than the rank of fasting, Salat, and charity?" They said: "But of course!" He said: "Making peace between each other. For indeed spoiling relations with each other is the Haliqah."

It has been related that the Prophet SAW said: "It is the Haliqah, I do not speak of what cuts hair, but it severs the religion."

Mishkat al-Masabih 5399
Abu Musa reported the Prophet as saying, "Before the last hour there will be commotions like pieces of a dark night in which a man will be a believer in the morning and an infidel in the evening, or a believer in the evening and an infidel in the morning. He who sits during them will be better than he who gets up and he who walks during them will be better than he who runs. So, break your bows during them, cut your bowstrings during them, and strike your swords on stones. If people then come in to one of you, let him be like the better of Adam's sons[*]." A version by him has the same up to "better than he who runs." It then says the people asked what he ordered them to do and he replied, "Keep to your houses". *The reference is to Abel who was killed by his brother Cain. Abu Dawud transmitted it. Tirmidhi's version states that God's messenger said about the commotion, "Break your bows during it, cut your bowstrings during it, keep to the inside of your houses during it, and be like Adam's son." Tirmidhi transmitted it. He said this is a sahih gharib tradition.
