Narrated Abu Huraira and Zaid bin Khalid:

Allah's Apostle was asked about the slave-girl, if she was a virgin and committed illegal sexual intercourse. The Prophet said, "If she committed illegal sexual intercourse, lash her, and if she did it a second time, then lash her again, and if she repeated the third time, then sell her even for a hair rope." Ibn Shihab said, "I don't know whether to sell her after the third or fourth offense."

حَدَّثَنَا إِسْمَاعِيلُ، قَالَ حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ، عَنْ أَبِي هُرَيْرَةَ، وَزَيْدِ بْنِ خَالِدٍ ـ رضى الله عنهما ـ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم سُئِلَ عَنِ الأَمَةِ إِذَا زَنَتْ وَلَمْ تُحْصِنْ قَالَ ‏ "‏ إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَاجْلِدُوهَا، ثُمَّ إِنْ زَنَتْ فَبِيعُوهَا وَلَوْ بِضَفِيرٍ ‏"‏‏.‏ قَالَ ابْنُ شِهَابٍ لاَ أَدْرِي بَعْدَ الثَّالِثَةِ، أَوِ الرَّابِعَةِ‏.‏

that while he was sitting with Allah's Apostle he said, "O Allah's Apostle! We get female captives as our share of booty, and we are interested in their prices, what is your opinion about coitus interrupt us?" The Prophet said, "Do you really do that? It is better for you not to do it. No soul that which Allah has destined to exist, but will surely come into existence.

حَدَّثَنَا أَبُو الْيَمَانِ، أَخْبَرَنَا شُعَيْبٌ، عَنِ الزُّهْرِيِّ، قَالَ أَخْبَرَنِي ابْنُ مُحَيْرِيزٍ، أَنَّ أَبَا سَعِيدٍ الْخُدْرِيَّ ـ رضى الله عنه ـ أَخْبَرَهُ أَنَّهُ، بَيْنَمَا هُوَ جَالِسٌ عِنْدَ النَّبِيِّ صلى الله عليه وسلم قَالَ يَا رَسُولَ اللَّهِ إِنَّا نُصِيبُ سَبْيًا، فَنُحِبُّ الأَثْمَانَ، فَكَيْفَ تَرَى فِي الْعَزْلِ فَقَالَ ‏ "‏ أَوَإِنَّكُمْ تَفْعَلُونَ ذَلِكَ لاَ عَلَيْكُمْ أَنْ لاَ تَفْعَلُوا ذَلِكُمْ، فَإِنَّهَا لَيْسَتْ نَسَمَةٌ كَتَبَ اللَّهُ أَنْ تَخْرُجَ إِلاَّ هِيَ خَارِجَةٌ ‏"‏‏.‏

Allah's Apostle sent us in a mission (i.e., an army-unit) and said, "If you find so-and-so and so-and-so, burn both of them with fire." When we intended to depart, Allah's Apostle said, "I have ordered you to burn so-and-so and so-and-so, and it is none but Allah Who punishes with fire, so, if you find them, kill them (i.e., don't burn them)."

'A'isha (Allah be pleased with her) reported that the Quraish used to fast on the day of Ashura during the pre-Islamic days. The Messenger of Allah (may peace be upon him) then commanded to fast on that day till (fasting) in Ramadan became obligatory. Then the Messenger of Allah (may peace be upon him) said:

He who wishes to fast should do so, and he who wishes to break it may do so.

Yahya related to me from Malik that he had heard that a man came to Abdullah ibn Masud and said, "I have divorced my wife by saying I divorce you eight times." Ibn Masud said to him, "What have people told you?" He replied, "I have been told that I have to part absolutely from her." Ibn Masud said, "They have spoken the truth. A person who divorces as Allah has commanded, Allah makes it clear for him, and a person who obscures himself in error, we make stay by his error. So do not confuse yourselves and pull us into your confusion. It is as they have said."

وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ رَجُلاً، جَاءَ إِلَى عَبْدِ اللَّهِ بْنِ مَسْعُودٍ فَقَالَ إِنِّي طَلَّقْتُ امْرَأَتِي ثَمَانِيَ تَطْلِيقَاتٍ ‏.‏ فَقَالَ ابْنُ مَسْعُودٍ فَمَاذَا قِيلَ لَكَ قَالَ قِيلَ لِي إِنَّهَا قَدْ بَانَتْ مِنِّي ‏.‏ فَقَالَ ابْنُ مَسْعُودٍ صَدَقُوا مَنْ طَلَّقَ كَمَا أَمَرَهُ اللَّهُ فَقَدْ بَيَّنَ اللَّهُ لَهُ وَمَنْ لَبَسَ عَلَى نَفْسِهِ لَبْسًا جَعَلْنَا لَبْسَهُ مُلْصَقًا بِهِ لاَ تَلْبِسُوا عَلَى أَنْفُسِكُمْ وَنَتَحَمَّلَهُ عَنْكُمْ هُوَ كَمَا يَقُولُونَ ‏.‏

Malik related to me from Ibn Shihab from Ubaydullah ibn Abdullah ibn Utba ibn Masud from Abu Hurayra and Zayd ibn Khalid al-Juhani that the Messenger of Allah, may Allah bless him and grant him peace, was asked about a slave-girl who committed fornication and was not muhsana. He said, "If she commits fornication, then flog her. If she commits fornication again, then flog her, and if she commits fornication again, then sell her, if only for a rope."

Ibn Shihab added, "I don't know whether it was three or four times."

Yahya related to me from Malik from Nafi from Abdullah ibn Umar that some men from Iraq said to him, "Abu Abd ar-Rahman, we buy the fruit of the palm and grapes and we squeeze them into wine and we sell it." Abdullah ibn Umar said, "I call on Allah and His angels and whoever hears of jinn and men to testify to you that I order you not to buy it nor sell it nor to press it nor to drink it nor to give it to people to drink. It is something impure from the work of Shaytan."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّ رِجَالاً، مِنْ أَهْلِ الْعِرَاقِ قَالُوا لَهُ يَا أَبَا عَبْدِ الرَّحْمَنِ إِنَّا نَبْتَاعُ مِنْ ثَمَرِ النَّخْلِ وَالْعِنَبِ فَنَعْصِرُهُ خَمْرًا فَنَبِيعُهَا ‏.‏ فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ إِنِّي أُشْهِدُ اللَّهَ عَلَيْكُمْ وَمَلاَئِكَتَهُ وَمَنْ سَمِعَ مِنَ الْجِنِّ وَالإِنْسِ أَنِّي لاَ آمُرُكُمْ أَنْ تَبِيعُوهَا وَلاَ تَبْتَاعُوهَا وَلاَ تَعْصِرُوهَا وَلاَ تَشْرَبُوهَا وَلاَ تَسْقُوهَا فَإِنَّهَا رِجْسٌ مِنْ عَمَلِ الشَّيْطَانِ ‏.‏

He said, "Yes " The man said, "I live with her in the house". The Messenger of Allah, may Allah bless him and grant him peace, said "Ask her permission." The man said, "I am her servant." The Messenger of Allah. may Allah bless him and grant him peace, said, "Ask her permission. Do you want to see her naked?" He said, "No." He said, "Then ask her permission."

حَدَّثَنِي مَالِكٌ، عَنْ صَفْوَانَ بْنَ سُلَيْمٍ، عَنْ عَطَاءِ بْنِ يَسَارٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم سَأَلَهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ أَسْتَأْذِنُ عَلَى أُمِّي فَقَالَ ‏"‏ نَعَمْ ‏"‏ ‏.‏ قَالَ الرَّجُلُ إِنِّي مَعَهَا فِي الْبَيْتِ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ اسْتَأْذِنْ عَلَيْهَا ‏"‏ ‏.‏ فَقَالَ الرَّجُلُ إِنِّي خَادِمُهَا ‏.‏ فَقَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ اسْتَأْذِنْ عَلَيْهَا أَتُحِبُّ أَنْ تَرَاهَا عُرْيَانَةً ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَاسْتَأْذِنْ عَلَيْهَا ‏"‏ ‏.‏

Malik related to me from al-Walid ibn Abdullah ibn Sayyad that al-Muttalib ibn Abdullah ibn Hantab al-Makhzumi informed him that a man asked the Messenger of Allah, may Allah bless him and grant him peace, "What is backbiting?" The Messenger of Allah, may Allah bless him and grant him peace, said, "It is to mention about a man what he does not want to hear." He said, "Messenger of Allah! Even if it is true?" The Messenger of Allah, may Allah bless him and grant him peace, said, "If you utter something false, then it is slander."

Aishah narrated:
"The Prophet delayed the visiting Tawaf until the night."
حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، حَدَّثَنَا سُفْيَانُ، عَنْ أَبِي الزُّبَيْرِ، عَنِ ابْنِ عَبَّاسٍ، وَعَائِشَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم أَخَّرَ طَوَافَ الزِّيَارَةِ إِلَى اللَّيْلِ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَقَدْ رَخَّصَ بَعْضُ أَهْلِ الْعِلْمِ فِي أَنْ يُؤَخَّرَ طَوَافُ الزِّيَارَةِ إِلَى اللَّيْلِ وَاسْتَحَبَّ بَعْضُهُمْ أَنْ يَزُورَ يَوْمَ النَّحْرِ وَوَسَّعَ بَعْضُهُمْ أَنْ يُؤَخَّرَ وَلَوْ إِلَى آخِرِ أَيَّامِ مِنًى ‏.‏

Abu Qilabah AL-Jarmi narrated that Abu Umayyah Ad-Damri told them that:
he came to the Messenger of Allah from a journey and he said: "Come and have a meal for breakfast, O Abu Umayyah." I said: 'I am fasting; He said: 'Come close and I will tell you about the traveler. Allah, most high, has waived fasting and half of the prayer for him."'
أَخْبَرَنِي شُعَيْبُ بْنُ شُعَيْبِ بْنِ إِسْحَاقَ، قَالَ حَدَّثَنَا عَبْدُ الْوَهَّابِ، قَالَ حَدَّثَنَا شُعَيْبٌ، قَالَ حَدَّثَنِي الأَوْزَاعِيُّ، قَالَ حَدَّثَنِي يَحْيَى، قَالَ حَدَّثَنِي أَبُو قِلاَبَةَ الْجَرْمِيُّ، أَنَّ أَبَا أُمَيَّةَ الضَّمْرِيَّ، حَدَّثَهُمْ أَنَّهُ، قَدِمَ عَلَى رَسُولِ اللَّهِ صلى الله عليه وسلم مِنْ سَفَرٍ فَقَالَ ‏"‏ انْتَظِرِ الْغَدَاءَ يَا أَبَا أُمَيَّةَ ‏"‏ ‏.‏ قُلْتُ إِنِّي صَائِمٌ ‏.‏ قَالَ ‏"‏ ادْنُ أُخْبِرْكَ عَنِ الْمُسَافِرِ إِنَّ اللَّهَ وَضَعَ عَنْهُ الصِّيَامَ وَنِصْفَ الصَّلاَةِ ‏"‏ ‏.‏

It was narrated from 'Irak bin Malik that Zainab bint Abi Salamah told him, that Umm Habibah said to the Messenger of Allah:
"We have been saying that you want to marry Durrah bint Abi Salamah." The Messenger of Allah said: "As a co-wife to Umm Salamah? Even if I were not married to Umm Salamah, she would not be permissible to me, for her father is my brother through breast-feeding."
أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا اللَّيْثُ، عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ عِرَاكِ بْنِ مَالِكٍ، أَنَّ زَيْنَبَ بِنْتَ أَبِي سَلَمَةَ، أَخْبَرَتْهُ أَنَّ أُمَّ حَبِيبَةَ قَالَتْ لِرَسُولِ اللَّهِ صلى الله عليه وسلم إِنَّا قَدْ تَحَدَّثْنَا أَنَّكَ نَاكِحٌ دُرَّةَ بِنْتَ أَبِي سَلَمَةَ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ أَعَلَى أُمِّ سَلَمَةَ لَوْ أَنِّي لَمْ أَنْكِحْ أُمَّ سَلَمَةَ مَا حَلَّتْ لِي إِنَّ أَبَاهَا أَخِي مِنَ الرَّضَاعَةِ ‏"‏ ‏.‏

It was narrated from Bashir bin Sa'd that he brought An-Nu'man to the Prophet and said:
"I want to give this son of mine a slave as a present, and if you think that I should go ahead with it, I will go ahead." The Messenger of Allah said: "Have you given a present to all your children?" He said: "No." He said: "Then take (your present) back."
أَخْبَرَنَا عَمْرُو بْنُ عُثْمَانَ بْنِ سَعِيدٍ، قَالَ حَدَّثَنَا الْوَلِيدُ، عَنِ الأَوْزَاعِيِّ، عَنِ الزُّهْرِيِّ، أَنَّ مُحَمَّدَ بْنَ النُّعْمَانِ، وَحُمَيْدَ بْنَ عَبْدِ الرَّحْمَنِ، حَدَّثَاهُ عَنْ بَشِيرِ بْنِ سَعْدٍ، أَنَّهُ جَاءَ إِلَى النَّبِيِّ صلى الله عليه وسلم بِالنُّعْمَانِ بْنِ بَشِيرٍ فَقَالَ إِنِّي نَحَلْتُ ابْنِي هَذَا غُلاَمًا فَإِنْ رَأَيْتَ أَنْ تُنْفِذَهُ أَنْفَذْتُهُ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَكُلَّ بَنِيكَ نَحَلْتَهُ ‏"‏ ‏.‏ قَالَ لاَ ‏.‏ قَالَ ‏"‏ فَارْدُدْهُ ‏"‏ ‏.‏

Salih narrated from Ibn Shihab, that Abu Salamah informed him from Jabir, that the Messenger of Allah said:
"Any man who gives a lifelong gift to another man, it belongs to him (the recipient) and his descendants. He said: 'I have given it to you and to your descendants so long as any of you are still alive.' So it belongs to the one to whom it was given, and it cannot revert to the first owner, since he has given it as a gift, and as such, it becomes subject to the same ruling as the estate."
أَخْبَرَنَا أَبُو دَاوُدَ، سُلَيْمَانُ بْنُ سَيْفٍ قَالَ حَدَّثَنَا يَعْقُوبُ، قَالَ حَدَّثَنَا أَبِي، عَنْ صَالِحٍ، عَنِ ابْنِ شِهَابٍ، أَنَّ أَبَا سَلَمَةَ، أَخْبَرَهُ عَنْ جَابِرٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَيُّمَا رَجُلٍ أَعْمَرَ رَجُلاً عُمْرَى لَهُ وَلِعَقِبِهِ قَالَ قَدْ أَعْطَيْتُكَهَا وَعَقِبَكَ مَا بَقِيَ مِنْكُمْ أَحَدٌ فَإِنَّهَا لِمَنْ أُعْطِيَهَا وَإِنَّهَا لاَ تَرْجِعُ إِلَى صَاحِبِهَا مِنْ أَجْلِ أَنَّهُ أَعْطَاهَا عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ ‏"‏ ‏.‏

It was narrated that Huthaifah said:
"When the Messenger of Allah (PBUH) met a man from among his Companions, he would shake hands with him and supplicate for him. I saw him one day in the early morning, and I tried to avoid him, then I came to him later in the day. He said: 'I saw you but you were avoiding me.' I said: 'I was Junub and I was afraid that you would touch me.' The Messenger of Allah (PBUH) said: 'The Muslim is not made impure (Najis).'"
أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، قَالَ أَنْبَأَنَا جَرِيرٌ، عَنِ الشَّيْبَانِيِّ، عَنْ أَبِي بُرْدَةَ، عَنْ حُذَيْفَةَ، قَالَ كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم إِذَا لَقِيَ الرَّجُلَ مِنْ أَصْحَابِهِ مَاسَحَهُ وَدَعَا لَهُ - قَالَ - فَرَأَيْتُهُ يَوْمًا بُكْرَةً فَحِدْتُ عَنْهُ ثُمَّ أَتَيْتُهُ حِينَ ارْتَفَعَ النَّهَارُ فَقَالَ ‏"‏ إِنِّي رَأَيْتُكَ فَحِدْتَ عَنِّي ‏"‏ ‏.‏ فَقُلْتُ إِنِّي كُنْتُ جُنُبًا فَخَشِيتُ أَنْ تَمَسَّنِي ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّ الْمُسْلِمَ لاَ يَنْجُسُ ‏"‏ ‏.‏

"There is no soul on Earth that dies, and is in a good position before Allah, that would like to come back to you, even if it had all this world, except the one who is killed (in the cause of Allah); he wishes that he could come back and be killed again."

Al-Hasan Al-Basri said:
"An old woman came to the Prophet (Allah bless him and give him peace) and said: 'O Messenger of Allah, beseech Allah to let me enter the Garden of Paradise!' He replied: 'O Mother of So-and-so, no old woman will enter the Garden of Paradise!' She turned away weeping, so he said: 'Tell her that she will not enter it as an old woman, for Allah says: ‘We have created them a new creation, and made them virgins, loving, equal in age [inna ansha’na-hunna insha’a: fa-ja'alna-hunna abkara 'uruban atraba].’” (Al-Qur'an; 56:35-37)
حَدَّثَنَا عَبْدُ بْنُ حُمَيْدٍ، قَالَ‏:‏ حَدَّثَنَا مُصْعَبُ بْنُ الْمِقْدَامِ، قَالَ‏:‏ حَدَّثَنَا الْمُبَارِكُ بْنُ فَضَالَةَ، عَنِ الْحَسَنِ، قَالَ‏:‏ أَتَتْ عَجُوزٌ إِلَى النَّبِيِّ صلى الله عليه وسلم، فَقَالَتْ‏:‏ يَا رَسُولَ اللهِ، ادْعُ اللَّهَ أَنْ يُدْخِلَنِي الْجَنَّةَ، فَقَالَ‏:‏ يَا أُمَّ فُلانٍ، إِنَّ الْجَنَّةَ لا تَدْخُلُهَا عَجُوزٌ، قَالَ‏:‏ فَوَلَّتْ تَبْكِي، فَقَالَ‏:‏ أَخْبِرُوهَا أَنَّهَا لا تَدْخُلُهَا وَهِيَ عَجُوزٌ إِنَّ اللَّهَ تَعَالَى، يَقُولُ‏:‏ إِنَّا أَنْشَأْنَاهُنَّ إِنْشَاءً، فَجَعَلْنَاهُنَّ أَبْكَارًا، عُرُبًا أَتْرَابًا‏.‏

He said: (The Prophet said:) I forgot to order you to cover the two horns (of the lamb), for it is not advisable that there should be anything in the House (the Ka'bah) which diverts the attention of the man at prayer. Ibn as-Sarh said: The name of my maternal uncle is Musafi' ibn Shaybah.

I swear by Allah, I heard the Messenger of Allah (saws) say: The happy man is he who avoids dissensions: happy is the man who avoids dissensions; happy is the man who avoids dissensions: but how fine is the man who is afflicted and shows endurance.

Narrated AbuShurayh al-Khuza'i:

The Prophet (saws) said: If a relative of anyone is killed, or if he suffers khabl, which means a wound, he may choose one of the three things: he may retaliate, or forgive, or receive compensation. But if he wishes a fourth (i.e. something more), hold his hands. After this whoever exceeds the limits shall be in grave penalty.

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا حَمَّادٌ، أَخْبَرَنَا مُحَمَّدُ بْنُ إِسْحَاقَ، عَنِ الْحَارِثِ بْنِ فُضَيْلٍ، عَنْ سُفْيَانَ بْنِ أَبِي الْعَوْجَاءِ، عَنْ أَبِي شُرَيْحٍ الْخُزَاعِيِّ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ أُصِيبَ بِقَتْلٍ أَوْ خَبْلٍ فَإِنَّهُ يَخْتَارُ إِحْدَى ثَلاَثٍ إِمَّا أَنْ يَقْتَصَّ وَإِمَّا أَنْ يَعْفُوَ وَإِمَّا أَنْ يَأْخُذَ الدِّيَةَ فَإِنْ أَرَادَ الرَّابِعَةَ فَخُذُوا عَلَى يَدَيْهِ وَمَنِ اعْتَدَى بَعْدَ ذَلِكَ فَلَهُ عَذَابٌ أَلِيمٌ ‏"‏ ‏.‏

Narrated Anas b. Malik :

The Messenger of Allah (saws) saw a man that he was supported between his sons. He asked about him, and (the people) said: He has taken a vow to walk (on foot). Thereupon he said: Allah has no need that this man should punish himself, and he ordered him to ride.

Abu Dawud said: 'Amr b. Abi 'Amir has also narrated a similar tradition from al-A'raj on the authority of Abu Hurairah from the Prophet (saws).

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، عَنْ حُمَيْدٍ الطَّوِيلِ، عَنْ ثَابِتٍ الْبُنَانِيِّ، عَنْ أَنَسِ بْنِ مَالِكٍ، ‏:‏ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم رَأَى رَجُلاً يُهَادَى بَيْنَ ابْنَيْهِ فَسَأَلَ عَنْهُ فَقَالُوا ‏:‏ نَذَرَ أَنْ يَمْشِيَ ‏.‏ فَقَالَ ‏:‏ ‏ "‏ إِنَّ اللَّهَ لَغَنِيٌّ عَنْ تَعْذِيبِ هَذَا نَفْسَهُ ‏"‏ ‏.‏ وَأَمَرَهُ أَنْ يَرْكَبَ ‏.‏ قَالَ أَبُو دَاوُدَ ‏:‏ رَوَاهُ عَمْرُو بْنُ أَبِي عَمْرٍو عَنِ الأَعْرَجِ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَهُ ‏.‏

“Lest they become as those who received the Scripture before, and the term was prolonged for them and so their hearts were hardened? And many of them were rebellious.” [57:16]

It was narrated from Anas bin Malik that the Messenger of Allah (saw) said:
“This fire of yours is one-seventieth part of the fire of Hell. Were it not that its heat has been reduced by water twice, you would not have been able to benefit from it. And it is praying to Allah, asking Allah not to return it (to its original level of heat).”
حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ، حَدَّثَنَا أَبِي وَيَعْلَى، قَالاَ حَدَّثَنَا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنْ نُفَيْعٍ أَبِي دَاوُدَ، عَنْ أَنَسِ بْنِ مَالِكٍ، قَالَ قَالَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ ‏ "‏ إِنَّ نَارَكُمْ هَذِهِ جُزْءٌ مِنْ سَبْعِينَ جُزْءًا مِنْ نَارِ جَهَنَّمَ وَلَوْلاَ أَنَّهَا أُطْفِئَتْ بِالْمَاءِ مَرَّتَيْنِ مَا انْتَفَعْتُمْ بِهَا وَإِنَّهَا لَتَدْعُو اللَّهَ عَزَّ وَجَلَّ أَنْ لاَ يُعِيدَهَا فِيهَا ‏"‏ ‏.‏

Abu Dharr told that he asked God’s Messenger to make him a governor, but he struck him on his shoulder with his hand and said, “You are weak, Abu Dharr, and it is a trust which will be a cause of shame and regret on the day of resurrection except for him who undertakes it as it ought to be undertaken and fulfils his duty in it.” In a version he said to him, “I see that you are weak, Abu Dharr, and I wish for you what I wish for myself. Do not accept rule over two people and do not become guardian of an orphan’s property.” Muslim transmitted it.
وَعَنْ أَبِي ذَرٍّ قَالَ: قُلْتُ: يَا رَسُولَ اللَّهِ أَلَا تَسْتَعْمِلُنِي؟ قَالَ: فَضَرَبَ بِيَدِهِ عَلَى مَنْكِبِي ثُمَّ قَالَ: «يَا أَبَا ذَرٍّ إِنَّكَ ضَعِيفٌ وَإِنَّهَا أَمَانَةٌ وَإِنَّهَا يَوْمَ الْقِيَامَةِ خِزْيٌ وَنَدَامَةٌ إِلَّا مَنْ أَخَذَهَا بِحَقِّهَا وَأَدَّى الَّذِي عَلَيْهِ فِيهَا» . وَفِي رِوَايَةٍ: قَالَ لَهُ: «يَا أَبَا ذَرٍّ إِنِّي أَرَاكَ ضَعِيفًا وَإِنِّي أُحِبُّ لَكَ مَا أُحِبُّ لِنَفْسِي لَا تَأَمَّرَنَّ عَلَى اثْنَيْنِ وَلَا تَوَلَّيَنَّ مَالَ يَتِيمٍ» . رَوَاهُ مُسْلِمٌ

Buraida said that when he was sitting with the Prophet a woman came to him and said, “Messenger of God, I gave a slavegirl as sadaqa to my mother who has now died.” He replied. “Your reward is sure, and the inheritance has given her back to you.” She said, "Messenger of God, a month's fast was due from her; may I fast on her behalf ?” He replied, “Fast on her behalf.” She said, “She never performed the pilgrimage, so may I do so on her behalf ?” He replied, “Yes, perform the pilgrimage on her behalf.” Muslim transmitted it.
وَعَنْ بُرَيْدَةَ قَالَ: كُنْتُ جَالِسًا عِنْدَ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذْ أَتَتْهُ امْرَأَةٌ فَقَالَت يَا رَسُول الله إِنِّي كنت تَصَدَّقْتُ عَلَى أُمِّي بِجَارِيَةٍ وَإِنَّهَا مَاتَتْ قَالَ: «وَجَبَ أَجَرُكِ وَرَدَّهَا عَلَيْكِ الْمِيرَاثُ» . قَالَتْ يَا رَسُولَ اللَّهِ إِنَّهُ كَانَ عَلَيْهَا صَوْمُ شَهْرٍ أفأصوم عَنْهَا قَالَ: «صومي عَنْهَا» . قَالَت يَا رَسُول الله إِنَّهَا لَمْ تَحُجَّ قَطُّ أَفَأَحُجُّ عَنْهَا قَالَ: «نعم حجي عَنْهَا» . رَوَاهُ مُسلم

Abu Bakr reported that a man was mentioned in the presence of the Prophet, may Allah bless him and grant him peace, and someone praised him. The Prophet, may Allah bless him and grant him peace, said, "Woe to you! You have cut off the head of your companion!" and he repeated that several times. He went on, "If one of you must praise someone, he should say, 'I consider that so-and-so is such-and-such.' Allah is the One who will take account of him if he thinks that he is indeed like that, No one can appropriate Allah's right to attest to someone's character."
حَدَّثَنَا مُحَمَّدٍ، قَالَ‏:‏ حَدَّثَنَا آدَمُ، قَالَ‏:‏ حَدَّثَنَا شُعْبَةُ، عَنْ خَالِدٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي بَكْرَةَ، عَنْ أَبِيهِ، أَنَّ رَجُلاً ذُكِرَ عِنْدَ النَّبِيِّ صلى الله عليه وسلم فَأَثْنَى عَلَيْهِ رَجُلٌ خَيْرًا، فَقَالَ النَّبِيُّ صلى الله عليه وسلم‏:‏ وَيْحَكَ قَطَعْتَ عُنُقَ صَاحِبِكَ، يَقُولُهُ مِرَارًا، إِنْ كَانَ أَحَدُكُمْ مَادِحًا لاَ مَحَالَةَ فَلْيَقُلْ‏:‏ أَحْسَبُ كَذَا وَكَذَا، إِنْ كَانَ يَرَى أَنَّهُ كَذَلِكَ، وَحَسِيبُهُ اللَّهُ، وَلاَ يُزَكِّي عَلَى اللهِ أَحَدًا‏.‏

Narrated Ibn 'Umar (RA):
In the time of Allah's Messenger (SAW), he divorced his wife while she was menstruating, so 'Umar asked Allah's Messenger (SAW) about that and he replied, "Command him to take her back and keep her till she is purified (from menses), has another period, and is then purified. If he then wishes he may keep her and if he wishes he may divorce her before having intercourse with her. That is the 'Iddah (period of waiting) which Allah commanded for the divorce of women." [Agreed upon].
وَعَنِ اِبْنِ عُمَرَ ‏- رَضِيَ اَللَّهُ عَنْهُمَا { أَنَّهُ طَلَّقَ اِمْرَأَتَهُ ‏- وَهِيَ حَائِضٌ ‏- فِي عَهْدِ رَسُولِ اَللَّهِ ‏- صلى الله عليه وسلم ‏-فَسَأَلَ عُمَرُ رَسُولَ اَللَّهِ ‏- صلى الله عليه وسلم ‏-عَنْ ذَلِكَ ? فَقَالَ : " مُرْهُ فَلْيُرَاجِعْهَا , ثُمَّ لْيُمْسِكْهَا حَتَّى تَطْهُرَ , ثُمَّ تَحِيضَ , ثُمَّ تَطْهُرَ , ثُمَّ إِنْ شَاءَ أَمْسَكَ بَعْدُ , وَإِنْ شَاءَ طَلَّقَ بَعْدَ أَنْ يَمَسَّ , فَتِلْكَ اَلْعِدَّةُ اَلَّتِي أَمَرَ اَللَّهُ أَنْ تُطَلَّقَ لَهَا اَلنِّسَاءُ } مُتَّفَقٌ عَلَيْهِ 1‏ .‏

Narrated Yusuf bin Mahik:

I was in the house of `Aisha, the mother of the Believers. She said, "This revelation: "Nay, but the Hour is their appointed time (for their full recompense); and the Hour will be more previous and most bitter." (54.46) was revealed to Muhammad at Mecca while I was a playfull little girl."

The Prophet said, "A matron should not be given in marriage except after consulting her; and a virgin should not be given in marriage except after her permission." The people asked, "O Allah's Apostle! How can we know her permission?" He said, "Her silence (indicates her permission).

Narrated Nafi`:

Whenever Ibn `Umar was asked about marrying a Christian lady or a Jewess, he would say: "Allah has made it unlawful for the believers to marry ladies who ascribe partners in worship to Allah, and I do not know of a greater thing, as regards to ascribing partners in worship, etc. to Allah, than that a lady should say that Jesus is her Lord although he is just one of Allah's slaves."

Yahya related to me from Malik from Nafi from Abdullah ibn Umar that Hafsa, the wife of the Prophet, may Allah bless him and grant him peace, told him that the Messenger of Allah, may Allah bless him and grant him peace, used to pray two quick rakas when the muadhdhin had finished the adhan for the subh prayer, before the iqama was said for the prayer.

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّ حَفْصَةَ، زَوْجَ النَّبِيِّ صلى الله عليه وسلم أَخْبَرَتْهُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَ إِذَا سَكَتَ الْمُؤَذِّنُ عَنِ الأَذَانِ لِصَلاَةِ الصُّبْحِ صَلَّى رَكْعَتَيْنِ خَفِيفَتَيْنِ قَبْلَ أَنْ تُقَامَ الصَّلاَةُ ‏.‏

Yahya related to me from Malik that he had heard that Said ibn Abi Waqqas used to pass in front of some of the rows while the prayer was in progress.

Malik said, "I consider that it is permissible to do that if the iqama for the prayer has been said and the imam has said the initial takbir and a man cannot find any way into the mosque except by going between the rows."

وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ سَعْدَ بْنَ أَبِي وَقَّاصٍ، كَانَ يَمُرُّ بَيْنَ يَدَىْ بَعْضِ الصُّفُوفِ وَالصَّلاَةُ قَائِمَةٌ ‏.‏ قَالَ مَالِكٌ وَأَنَا أَرَى ذَلِكَ وَاسِعًا إِذَا أُقِيمَتِ الصَّلاَةُ وَبَعْدَ أَنْ يُحْرِمَ الإِمَامُ وَلَمْ يَجِدِ الْمَرْءُ مَدْخَلاً إِلَى الْمَسْجِدِ إِلاَّ بَيْنَ الصُّفُوفِ ‏.‏

Yahya related to me from Malik, from Zayd ibn Aslam, that Ata ibn Yasar had told him, from Abu Qatada, the same hadith about the wild ass as that of Abu'n-Nadr, except that in the hadith of Zayd ibn Aslam the Messenger of Allah, may Allah bless him and grant him peace, said, "Do you still have any of its meat?"

Yahya related to me from Malik from Nafi that Abdullah ibn Umar used to say, "Someone who does not stand at Arafa on the night of Muzdalifa before the dawn breaks has missed the hajj, and someone who stands at Arafa on the night of Muzdalifa before the dawn breaks has caught the hajj."

Yahya related to me from Malik that he had heard that Talha ibn Ubaydullah used to send his family and children from Muzdalifa to Mina ahead of him.

وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ طَلْحَةَ بْنَ عُبَيْدِ اللَّهِ، كَانَ يُقَدِّمُ نِسَاءَهُ وَصِبْيَانَهُ مِنَ الْمُزْدَلِفَةِ إِلَى مِنًى ‏.‏ وَحَدَّثَنِي عَنْ مَالِكٍ أَنَّهُ سَمِعَ بَعْضَ أَهْلِ الْعِلْمِ يَكْرَهُ رَمْىَ الْجَمْرَةِ حَتَّى يَطْلُعَ الْفَجْرُ مِنْ يَوْمِ النَّحْرِ وَمَنْ رَمَى فَقَدْ حَلَّ لَهُ النَّحْرُ ‏.‏

A woman asked the Prophet saying, "0 Allah's Apostle! My daughter got measles and her hair fell out. Now that I got her married, may I let her use false hair?" He said (to her), "Allah has cursed the lady who lengthens hair artificially and the one who gets her hair lengthened artificially."

حَدَّثَنَا الْحُمَيْدِيُّ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا هِشَامٌ، أَنَّهُ سَمِعَ فَاطِمَةَ بِنْتَ الْمُنْذِرِ، تَقُولُ سَمِعْتُ أَسْمَاءَ، قَالَتْ سَأَلَتِ امْرَأَةٌ النَّبِيَّ صلى الله عليه وسلم فَقَالَتْ يَا رَسُولَ اللَّهِ إِنَّ ابْنَتِي أَصَابَتْهَا الْحَصْبَةُ، فَامَّرَقَ شَعَرُهَا، وَإِنِّي زَوَّجْتُهَا أَفَأَصِلُ فِيهِ فَقَالَ ‏ "‏ لَعَنَ اللَّهُ الْوَاصِلَةَ وَالْمَوْصُولَةَ ‏"‏‏.‏

Narrated Ibn `Umar:

That Aisha, the mother of the Believers, intended to buy a slave girl in order to manumit her. The slave girl's master said, "We are ready to sell her to you on the condition that her Wala should be for us." Aisha mentioned that to Allah's Apostle who said, "This (condition) should not prevent you from buying her, for the Wala is for the one who manumits (the slave)."

When I mentioned it (i.e. the narration of Rafi` 'bin Khadij: no. 532) to Tawus, he said, "It is permissible to rent the land for cultivation, for Ibn `Abbas said, 'The Prophet did not forbid that, but said: One had better give the land to one's brother gratis rather than charge a certain amount for it.' "

Malik related to me from Nafi from Abdullah ibn Umar that A'isha umm al-muminin wanted to buy a slave-girl and set her free. Her people said, "We will sell her to you provided that her wala' is ours." She mentioned that to the Messenger of Allah, may Allah bless him and grant him peace, and he said, "Don't let that hinder you, for the wala' only belongs to the one who sets free."

Narrated AbuHurayrah:

The Prophet (saws) used to say: "O Allah, I seek refuge in Thee from poverty", lack and abasement, and I seek refuge in Thee lest I cause or suffer wrong."

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا حَمَّادٌ، أَخْبَرَنَا إِسْحَاقُ بْنُ عَبْدِ اللَّهِ، عَنْ سَعِيدِ بْنِ يَسَارٍ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم كَانَ يَقُولُ ‏ "‏ اللَّهُمَّ إِنِّي أَعُوذُ بِكَ مِنَ الْفَقْرِ وَالْقِلَّةِ وَالذِّلَّةِ وَأَعُوذُ بِكَ مِنْ أَنْ أَظْلِمَ أَوْ أُظْلَمَ ‏"‏ ‏.‏

‘Ata’ said, “If one rinses his mouth and ejects the water in it, swallowing his saliva and anything that remains in it does him no harm; but one should not chew gum, for although I do not say that he breaks his fast [if] he swallows the saliva produced by the gum, he is nevertheless prohibited from doing it.” Bukhari transmitted it in a chapter heading.

Hamza b. ‘Amr al-Aslami told God’s messenger that he found himself strong enough to fast while travelling and asked whether it would be wrong for him to do so. He was told that licence had been given by God who is great and glorious, so that if anyone acted upon this he did well, but if anyone wished to fast he would not be guilty of sin. Muslim transmitted it.
وَعَن حَمْزَة بن عَمْرو السّلمِيّ أَنَّهُ قَالَ: يَا رَسُولَ اللَّهِ إِنِّي أَجِدُ بِي قُوَّةً عَلَى الصِّيَامِ فِي السَّفَرِ فَهَلْ عَلَيَّ جُنَاحٌ؟ قَالَ: «هِيَ رُخْصَةٌ مِنَ اللَّهِ عَزَّ وَجَلَّ فَمَنْ أَخَذَ بِهَا فَحَسَنٌ وَمَنْ أَحَبَّ أَنْ يَصُومَ فَلَا جُنَاحَ عَلَيْهِ» . رَوَاهُ مُسلم

Al-Irbād b. Sāriya said the Prophet used to recite al-Musabbihāt* before going to sleep, and say they contained a verse which is better than a thousand verses. *These are said to be sūras 57, 59, 61, 62, 64, 87 which begin with the perfect, imperfect, or imperative of the verb sabbaha ('to glorify'). Tirmidhī and Abū Dāwūd transmitted it, and Dārimī transmitted it in mursal form on the authority of Khalid b. Ma'dān. Tirmidhī said this is a hasan gharīb tradition.
وَعَنِ الْعِرْبَاضِ بْنِ سَارِيَةَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَقْرَأُ الْمُسَبِّحَاتِ قَبْلَ أَنْ يَرْقُدَ يَقُولُ: «إِنَّ فِيهِنَّ آيَةٌ خَيْرٌ مِنْ أَلْفِ آيَةٍ» . رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُدَ.

وَرَوَاهُ الدَّارِمِيُّ عَنْ خَالِدِ بْنِ مَعْدَانَ مُرْسَلًا. وَقَالَ التِّرْمِذِيُّ: هَذَا حَدِيثٌ حَسَنٌ غَرِيبٌ

Ibn ‘Umar reported God’s Messenger as saying, “If anyone buys palm-trees after they have been fecundated the fruit belongs to the seller unless the buyer makes a proviso; and if anyone buys a slave who possesses property his property belongs to the seller unless the buyer makes a proviso." Muslim transmitted it and Bukhari transmitted something to the same effect as the first part alone.
عَنِ ابْنِ عُمَرَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنِ ابْتَاعَ نَخْلًا بَعْدَ أَنْ تُؤَبَّرَ فَثَمَرَتُهَا لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ وَمَنِ ابْتَاعَ عَبْدًا وَلَهُ مَالٌ فَمَالُهُ لِلْبَائِعِ إِلَّا أَنْ يَشْتَرِطَ الْمُبْتَاعُ» . رَوَاهُ مُسلم وروى البُخَارِيّ الْمَعْنى الأول وَحده

عَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " لَوْ أَنَّ أَحَدَكُمْ إِذَا أَرَادَ أَنْ يَأْتِيَ أَهْلَهُ قَالَ: بِسْمِ اللَّهِ اللَّهُمَّ جَنِّبْنَا الشَّيْطَانَ وَجَنِّبِ الشَّيْطَانَ مَا رَزَقْتَنَا فَإِنَّهُ إِنْ يُقَدَّرْ بَيْنَهُمَا وَلَدٌ فِي ذَلِكَ لَمْ يَضُرَّهُ شَيْطَانٌ أَبَدًا "

وَعَنِ ابْنِ عَبَّاسٍ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَقُولُ: «اللَّهُمَّ لَكَ أَسْلَمْتُ وَبِكَ آمَنْتُ وَعَلَيْكَ تَوَكَّلْتُ وَإِلَيْكَ أَنَبْتُ وَبِكَ خَاصَمْتُ اللَّهُمَّ إِنِّي أَعُوذُ بِعِزَّتِكَ لَا إِلَهَ إِلَّا أَنْتَ أَنْ تُضِلَّنِي أَنْتَ الْحَيُّ الَّذِي لَا يَمُوتُ وَالْجِنُّ وَالْإِنْسُ يموتون»

Abu Sa'id reported the Prophet as saying, "Abraham declared Mecca sacred and made it a sacred area, and I declare Medina to be sacred throughout the area between its two mountain paths, so that no blood may be shed in it, weapons may not be carried in it for fighting, and leaves may not be beaten off trees in it except for fodder." Muslim transmitted it.
وَعَنْ أَبِي سَعِيدٍ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِنَّ إِبْرَاهِيمَ حَرَّمَ مَكَّةَ فَجَعَلَهَا حَرَامًا وَإِنِّي حَرَّمْتُ الْمَدِينَةَ حَرَامًا مَا بَيْنَ مَأْزِمَيْهَا أَنْ لَا يُهْرَاقَ فِيهَا دَمٌ وَلَا يُحْمَلَ فِيهَا سلاحٌ لقتالٍ وَلَا تُخبَطَ فِيهَا شجرةٌ إِلَّا لعلف» . رَوَاهُ مُسلم

Ibn ‘Umar said :
Is the sunna of God’s messenger not enough for you ? If any of you is detained from the pilgrimage he should perform the circumambulation of the House and go between as-Safa, and al-Marwa, then come right out of the sacred state and perform the pilgrimage the following year. He should sacrifice an animal, or fast if he cannot get any. Bukhari transmitted it.
وَعَن ابنِ عمَرَ أَنَّهُ قَالَ: أَلَيْسَ حَسْبُكُمْ سُنَّةِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ؟ إِنْ حُبِسَ أَحَدُكُمْ عَنِ الْحَجِّ طَافَ بِالْبَيْتِ وَبِالصَّفَا وَالْمَرْوَةِ ثُمَّ حَلَّ مِنْ كُلِّ شَيْءٍ حَتَّى يَحُجَّ عَامًا قَابِلًا فَيَهْدِيَ أَوْ يَصُومَ إِنْ لَمْ يَجِدْ هَديا. رَوَاهُ البُخَارِيّ

وَعَنْ أَبِي أَيُّوبَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «الْوَتْرُ حَقٌّ عَلَى كُلِّ مُسْلِمٍ فَمَنْ أَحَبَّ أَنْ يُوتِرَ بِخَمْسٍ فَلْيَفْعَلْ وَمَنْ أَحَبَّ أَنْ يُوتِرَ بِثَلَاثٍ فَلْيَفْعَلْ وَمَنْ أَحَبَّ أَنْ يُوتِرَ بِوَاحِدَةٍ فَلْيَفْعَلْ» . رَوَاهُ أَبُو دَاوُد وَالنَّسَائِيّ وَابْن مَاجَه

Ibn ‘Umar told that God's Messenger stood up, i.e. on the day of Badr, and said, ‘Uthman has gone off on the business of God and His Messenger and I shall take the oath of allegiance on his behalf. God’s Messenger then appointed him a share, but did not do so for anyone else who was absent. Abu Dawud transmitted it.
وَعَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَامَ يَعْنِي يَوْمَ بَدْرٍ فَقَالَ: «إِنَّ عُثْمَانَ انْطَلَقَ فِي حَاجَةِ اللَّهِ وَحَاجَةِ رَسُولِهِ وَإِنِّي أُبَايِعُ لَهُ» فَضَرَبَ لَهُ رسولُ الله بِسَهْمٍ وَلَمْ يَضْرِبْ بِشَيْءٍ لِأَحَدٍ غَابَ غَيْرَهُ. رَوَاهُ أَبُو دَاوُد

Umm ad-Darda' reported that a man came up to her and said, "A man has said bad things about you in the presence of 'Abdu'l-Malik.' She said, "We are suspected of something which we did not do. How often we have been praised for what we did not do!"

Narrated [Ibn 'Abbas (RA)]:
A man had vowed to make his wife like his mother (i.e. forbidden for him). Then he had intercourse with her, so he went to the Prophet (SAW) and said, "I had intercourse with her before making the atonement." He replied, "Do not go near her till you do what Allah has commanded you to do." Reported by al-Arba'a. at-Tirmidhi graded it Sahih (authentic) but an-Nasa'i held that the stronger view is that it is Mursal (missing link after the Tabi'i)].
وَعَنْهُ رَضِيَ اَللَّهُ تَعَالَى عَنْهُمَا; { أَنَّ رَجُلًا ظَاهَرَ مِنِ اِمْرَأَتِهِ, ثُمَّ وَقَعَ عَلَيْهَا, فَأَتَى اَلنَّبِيَّ ‏- صلى الله عليه وسلم ‏-فَقَالَ: إِنِّي وَقَعْتُ عَلَيْهَا قَبْلَ أَنْ أُكَفِّرَ, قَالَ: "فَلَا تَقْرَبْهَا حَتَّى تَفْعَلَ مَا أَمَرَكَ اَللَّهُ".‏ } رَوَاهُ اَلْأَرْبَعَةُ وَصَحَّحَهُ اَلتِّرْمِذِيُّ, وَرَجَّحَ النَّسَائِيُّ إِرْسَالَه ُ 1‏ .‏

Narrated Abu Hurairah (RA):
The Prophet (SAW) said, "He who prays a Rak'a of the Fajr prayer before the sun rises, has offered the dawn prayer in its time, and he who prays a Rak'a of the 'Asr prayer before the sun sets has offered the afternoon prayer." [Agreed upon].

Allāhumma innī as'aluka 'l-`afwa wal-`āfiyah fid-dunyā wal-ākhirah, Allāhumma innī as'aluka 'l-`afwa wal-`āfiyah fī dīnī wa dunyāya, wa ahlī, wa mālī, Allāhummastur `awrātī, wa āmin raw`ātī, Allāhummaḥfaẓnī min bayni yadayya, wa min khalfī, wa `an yamīnī, wa `an shimālī, wa min fawqī, wa a`ūdhu bi`aẓamatika an 'ughtāla min taḥtī. O Allah, I seek Your forgiveness and Your protection in this world and the next. O Allah, I seek Your forgiveness and Your protection in my religion, in my worldly affairs, in my family and in my wealth. O Allah, conceal my secrets and preserve me from anguish. O Allah, guard me from what is in front of me and behind me, from my left, and from my right, and from above me. I seek refuge in Your Greatness from being struck down from beneath me. Malik related to me from Yahya ibn Said that he heard Muhammad ibn al-Munkadir say, "Allah loves his slave who is generous when he sells, and generous when he buys, generous when he repays, and generous when he is repaid."

Malik said about a man who bought camels or sheep or dry goods or slaves or any goods without measuring precisely, "There is no buying without measuring precisely in anything which can be counted . "

Malik said about a man who gave a man goods to sell for him and set their price saying, "If you sell them for this price as I have ordered you to do, you will have a dinar (or something which he has specified, which they are both satisfied with), if you do not sell them, you will have nothing," "There is no harm in that when he names a price to sell them at and names a known fee. If he sells the goods, he takes the fee, and if he does not sell them, he has nothing."

Malik said, "This is like saying to another man, 'If you capture my runaway slave or bring my stray camel, you will have such-and-such.' This is from the category of reward, and not from the category of giving a wage. Had it been from the category of giving a wage, it would not be good."

Malik said, "As for a man who is given goods and told that if he sells them he will have a named percentage for every dinar, that is not good because whenever he is a dinar less than the price of the goods, he decreases the due which was named for him. This is an uncertain transaction. He does not know how much he will be given."

وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ سَمِعَ مُحَمَّدَ بْنَ الْمُنْكَدِرِ، يَقُولُ أَحَبَّ اللَّهُ عَبْدًا سَمْحًا إِنْ بَاعَ سَمْحًا إِنِ ابْتَاعَ سَمْحًا إِنْ قَضَى سَمْحًا إِنِ اقْتَضَى ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يَشْتَرِي الإِبِلَ أَوِ الْغَنَمَ أَوِ الْبَزَّ أَوِ الرَّقِيقَ أَوْ شَيْئًا مِنَ الْعُرُوضِ جِزَافًا إِنَّهُ لاَ يَكُونُ الْجِزَافُ فِي شَىْءٍ مِمَّا يُعَدُّ عَدًّا ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يُعْطِي الرَّجُلَ السِّلْعَةَ يَبِيعُهَا لَهُ وَقَدْ قَوَّمَهَا صَاحِبُهَا قِيمَةً فَقَالَ إِنْ بِعْتَهَا بِهَذَا الثَّمَنِ الَّذِي أَمَرْتُكَ بِهِ فَلَكَ دِينَارٌ - أَوْ شَىْءٌ يُسَمِّيهِ لَهُ يَتَرَاضَيَانِ عَلَيْهِ - وَإِنْ لَمْ تَبِعْهَا فَلَيْسَ لَكَ شَىْءٌ إِنَّهُ لاَ بَأْسَ بِذَلِكَ إِذَا سَمَّى ثَمَنًا يَبِيعُهَا بِهِ وَسَمَّى أَجْرًا مَعْلُومًا إِذَا بَاعَ أَخَذَهُ وَإِنْ لَمْ يَبِعْ فَلاَ شَىْءَ لَهُ ‏.‏ قَالَ مَالِكٌ وَمِثْلُ ذَلِكَ أَنْ يَقُولَ الرَّجُلُ لِلرَّجُلِ إِنْ قَدَرْتَ عَلَى غُلاَمِي الآبِقِ أَوْ جِئْتَ بِجَمَلِي الشَّارِدِ فَلَكَ كَذَا ‏.‏ فَهَذَا مِنْ بَابِ الْجُعْلِ وَلَيْسَ مِنْ بَابِ الإِجَارَةِ وَلَوْ كَانَ مِنْ بَابِ الإِجَارَةِ لَمْ يَصْلُحْ ‏.‏ قَالَ مَالِكٌ فَأَمَّا الرَّجُلُ يُعْطَى السِّلْعَةَ فَيُقَالُ لَهُ بِعْهَا وَلَكَ كَذَا وَكَذَا فِي كُلِّ دِينَارٍ ‏.‏ لِشَىْءٍ يُسَمِّيهِ فَإِنَّ ذَلِكَ لاَ يَصْلُحُ لأَنَّهُ كُلَّمَا نَقَصَ دِينَارٌ مِنْ ثَمَنِ السِّلْعَةِ نَقَصَ مِنْ حَقِّهِ الَّذِي سَمَّى لَهُ فَهَذَا غَرَرٌ لاَ يَدْرِي كَمْ جَعَلَ لَهُ ‏.‏

It was narrated from Ibn 'Abbas that:
Hilal bin Umayyah accused his wife in the presence of the Prophet (SAW) of (committing adultery) with Sharik bin Sahma'. The Prophet said: "Bring proof or you will feel the Hadd (punishment) on your back." Hilal bin Umayyah said: "By the One Who sent you with the truth, I am telling the truth, and Allah will send down revelation concerning my situation which will spare my back." Then the following was revealed: "And for those who accuse their wives, but have no witnesses except themselves, let the testimony of one of them be four testimonies (i.e., testifies four times) by Allah that he is one of those who speak the truth. And the fifth (testimony should be) the invoking of the curse of Allah on him if he be of those who tell a lie (against her). But it shall avert the punishment (of stoning to death) from her, it she bears witness four times by Allah, that he (her husband) is telling a lie. And the fifth (testimony) should be that the wrath of Allah be upon her if he (her husband) speaks the truth." The Prophet (SAW), turned and sent for them, and they came. Hilal bin Umayyah stood up and bore witness, and the Prophet (SAW) said: "Allah knows that one of you is lying. Will either of you repent?" Then she stood up and affirmed her innocence. On the fifth time, meaning that the wrath of Allah be upon her if he (her husband) speaks the truth, they said to her: "It will invoke the wrath of Allah." Ibn 'Abbas said: "She hesitated and backed up, until we thought that she was going to recant. Then she said: 'By Allah, I cannot dishonor my people for ever.' Then the Prophet (SAW) said: 'Wait and see. If she gives birth to a child with black eyes, fleshy buttocks and big calves, then he is the son of Sharik bin Sahma'.' And she gave birth to such a child. Then the Prophet (SAW) said: 'Had it not the matter been settled by the Book of Allah, I would have punished her severely.' "
حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ، قَالَ أَنْبَأَنَا هِشَامُ بْنُ حَسَّانَ، حَدَّثَنَا عِكْرِمَةُ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ هِلاَلَ بْنَ أُمَيَّةَ، قَذَفَ امْرَأَتَهُ عِنْدَ النَّبِيِّ ـ صلى الله عليه وسلم ـ بِشَرِيكِ بْنِ سَحْمَاءَ فَقَالَ النَّبِيُّ ـ صلى الله عليه وسلم ـ ‏"‏ الْبَيِّنَةُ أَوْ حَدٌّ فِي ظَهْرِكَ ‏"‏ ‏.‏ فَقَالَ هِلاَلُ بْنُ أُمَيَّةَ وَالَّذِي بَعَثَكَ بِالْحَقِّ إِنِّي لَصَادِقٌ وَلَيُنْزِلَنَّ اللَّهُ فِي أَمْرِي مَا يُبَرِّئُ ظَهْرِي ‏.‏ قَالَ فَنَزَلَتْ ‏{‏وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلاَّ أَنْفُسُهُمْ‏}‏ ‏.‏ حَتَّى بَلَغَ ‏{‏وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ‏}‏ ‏.‏ فَانْصَرَفَ النَّبِيُّ ـ صلى الله عليه وسلم ـ فَأَرْسَلَ إِلَيْهِمَا فَجَاءَا فَقَامَ هِلاَلُ بْنُ أُمَيَّةَ فَشَهِدَ وَالنَّبِيُّ ـ صلى الله عليه وسلم ـ يَقُولُ ‏"‏ إِنَّ اللَّهَ يَعْلَمُ أَنَّ أَحَدَكُمَا كَاذِبٌ فَهَلْ مِنْ تَائِبٍ ‏"‏ ‏.‏ ثُمَّ قَامَتْ فَشَهِدَتْ فَلَمَّا كَانَ عِنْدَ الْخَامِسَةِ ‏{‏أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ‏}‏ ‏.‏ قَالُوا لَهَا إِنَّهَا الْمُوجِبَةُ ‏.‏ قَالَ ابْنُ عَبَّاسٍ فَتَلَكَّأَتْ وَنَكَصَتْ حَتَّى ظَنَنَّا أَنَّهَا سَتَرْجِعُ فَقَالَتْ وَاللَّهِ لاَ أَفْضَحُ قَوْمِي سَائِرَ الْيَوْمِ ‏.‏ فَقَالَ النَّبِيُّ ـ صلى الله عليه وسلم ـ ‏"‏ انْظُرُوهَا فَإِنْ جَاءَتْ بِهِ أَكْحَلَ الْعَيْنَيْنِ سَابِغَ الأَلْيَتَيْنِ خَدَلَّجَ السَّاقَيْنِ فَهُوَ لِشَرِيكِ بْنِ سَحْمَاءَ ‏"‏ ‏.‏ فَجَاءَتْ بِهِ كَذَلِكَ فَقَالَ النَّبِيُّ ـ صلى الله عليه وسلم ـ ‏"‏ لَوْلاَ مَا مَضَى مِنْ كِتَابِ اللَّهِ لَكَانَ لِي وَلَهَا شَأْنٌ ‏"‏ ‏.‏

That Al-Miqdad bin `Amr Al-Kindi, who was an ally of Bani Zuhra and one of those who fought the battle of Badr together with Allah's Apostle told him that he said to Allah's Apostle, "Suppose I met one of the infidels and we fought, and he struck one of my hands with his sword and cut it off and then took refuge in a tree and said, "I surrender to Allah (i.e. I have become a Muslim),' could I kill him, O Allah's Apostle, after he had said this?" Allah's Apostle said, "You should not kill him." Al- Miqdad said, "O Allah's Apostle! But he had cut off one of my two hands, and then he had uttered those words?" Allah's Apostle replied, "You should not kill him, for if you kill him, he would be in your position where you had been before killing him, and you would be in his position where he had been before uttering those words."

حَدَّثَنَا أَبُو عَاصِمٍ، عَنِ ابْنِ جُرَيْجٍ، عَنِ الزُّهْرِيِّ، عَنْ عَطَاءِ بْنِ يَزِيدَ، عَنْ عُبَيْدِ اللَّهِ بْنِ عَدِيٍّ، عَنِ الْمِقْدَادِ بْنِ الأَسْوَدِ، حَدَّثَنِي إِسْحَاقُ، حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ بْنِ سَعْدٍ، حَدَّثَنَا ابْنُ أَخِي ابْنِ شِهَابٍ، عَنْ عَمِّهِ، قَالَ أَخْبَرَنِي عَطَاءُ بْنُ يَزِيدَ اللَّيْثِيُّ، ثُمَّ الْجُنْدَعِيُّ أَنَّ عُبَيْدَ، اللَّهِ بْنَ عَدِيِّ بْنِ الْخِيَارِ أَخْبَرَهُ أَنَّ الْمِقْدَادَ بْنَ عَمْرٍو الْكِنْدِيَّ، وَكَانَ حَلِيفًا لِبَنِي زُهْرَةَ، وَكَانَ مِمَّنْ شَهِدَ بَدْرًا مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم أَخْبَرَهُ أَنَّهُ قَالَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم أَرَأَيْتَ إِنْ لَقِيتُ رَجُلاً مِنَ الْكُفَّارِ فَاقْتَتَلْنَا، فَضَرَبَ إِحْدَى يَدَىَّ بِالسَّيْفِ فَقَطَعَهَا، ثُمَّ لاَذَ مِنِّي بِشَجَرَةٍ فَقَالَ أَسْلَمْتُ لِلَّهِ‏.‏ آأَقْتُلُهُ يَا رَسُولَ اللَّهِ بَعْدَ أَنْ قَالَهَا فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ لاَ تَقْتُلْهُ ‏"‏‏.‏ فَقَالَ يَا رَسُولَ اللَّهِ، إِنَّهُ قَطَعَ إِحْدَى يَدَىَّ، ثُمَّ قَالَ ذَلِكَ بَعْدَ مَا قَطَعَهَا‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ لاَ تَقْتُلْهُ، فَإِنْ قَتَلْتَهُ فَإِنَّهُ بِمَنْزِلَتِكَ قَبْلَ أَنْ تَقْتُلَهُ، وَإِنَّكَ بِمَنْزِلَتِهِ قَبْلَ أَنْ يَقُولَ كَلِمَتَهُ الَّتِي قَالَ ‏"‏‏.‏

Narrated Az-Zuhri:

`Urwa said, "Aisha told me that Allah's Apostle used to examine the women emigrants. We have been told also that when Allah revealed the order that the Muslims should return to the pagans what they had spent on their wives who emigrated (after embracing Islam) and that the Muslims should not keep unbelieving women as their wives, `Umar divorced two of his wives, Qariba, the daughter of Abu Umayyah and the daughter of Jarwal Al-Khuza`i. Later on Mu`awiya married Qariba and Abu Jahm married the other." When the pagans refused to pay what the Muslims had spent on their wives, Allah revealed: "And if any of your wives have gone from you to the unbelievers and you have an accession (by the coming over of a woman from the other side) (then pay to those whose wives have gone) the equivalent of what they had spent (on their Mahr)." (60.11) So, Allah ordered that the Muslim whose wife has gone, should be given, as a compensation of the Mahr he had given to his wife, from the Mahr of the wives of the pagans who had emigrated deserting their husbands. We do not know any of the women emigrants who deserted Islam after embracing it. We have also been told that Abu Basir bin Asid Ath-Thaqafi came to the Prophet as a Muslim emigrant during the truce. Al-Akhnas bin Shariq wrote to the Prophet requesting him to return Abu Basir.

وَقَالَ عُقَيْلٌ عَنِ الزُّهْرِيِّ، قَالَ عُرْوَةُ فَأَخْبَرَتْنِي عَائِشَةُ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَ يَمْتَحِنُهُنَّ، وَبَلَغَنَا أَنَّهُ لَمَّا أَنْزَلَ اللَّهُ تَعَالَى أَنْ يَرُدُّوا إِلَى الْمُشْرِكِينَ مَا أَنْفَقُوا عَلَى مَنْ هَاجَرَ مِنْ أَزْوَاجِهِمْ، وَحَكَمَ عَلَى الْمُسْلِمِينَ، أَنْ لاَ يُمَسِّكُوا بِعِصَمِ الْكَوَافِرِ، أَنَّ عُمَرَ طَلَّقَ امْرَأَتَيْنِ قَرِيبَةَ بِنْتَ أَبِي أُمَيَّةَ، وَابْنَةَ جَرْوَلٍ الْخُزَاعِيِّ، فَتَزَوَّجَ قَرِيبَةَ مُعَاوِيَةُ، وَتَزَوَّجَ الأُخْرَى أَبُو جَهْمٍ، فَلَمَّا أَبَى الْكُفَّارُ أَنْ يُقِرُّوا بِأَدَاءِ مَا أَنْفَقَ الْمُسْلِمُونَ عَلَى أَزْوَاجِهِمْ، أَنْزَلَ اللَّهُ تَعَالَى ‏{‏وَإِنْ فَاتَكُمْ شَىْءٌ مِنْ أَزْوَاجِكُمْ إِلَى الْكُفَّارِ فَعَاقَبْتُمْ‏}‏ وَالْعَقِبُ مَا يُؤَدِّي الْمُسْلِمُونَ إِلَى مَنْ هَاجَرَتِ امْرَأَتُهُ مِنَ الْكُفَّارِ، فَأَمَرَ أَنْ يُعْطَى مَنْ ذَهَبَ لَهُ زَوْجٌ مِنَ الْمُسْلِمِينَ مَا أَنْفَقَ مِنْ صَدَاقِ نِسَاءِ الْكُفَّارِ اللاَّئِي هَاجَرْنَ، وَمَا نَعْلَمُ أَحَدًا مِنَ الْمُهَاجِرَاتِ ارْتَدَّتْ بَعْدَ إِيمَانِهَا‏.‏ وَبَلَغَنَا أَنَّ أَبَا بَصِيرِ بْنَ أَسِيدٍ الثَّقَفِيَّ قَدِمَ عَلَى النَّبِيِّ صلى الله عليه وسلم مُؤْمِنًا مُهَاجِرًا فِي الْمُدَّةِ، فَكَتَبَ الأَخْنَسُ بْنُ شَرِيقٍ إِلَى النَّبِيِّ صلى الله عليه وسلم يَسْأَلُهُ أَبَا بَصِيرٍ، فَذَكَرَ الْحَدِيثَ‏.‏

Narrated Hisham Ibn `Urwa from his father who said:

While I was a youngster, I asked `Aisha the wife of the Prophet. "What about the meaning of the Statement of Allah; "Verily! (the mountains) As-Safa and Al Marwa, are among the symbols of Allah. So, it is not harmful if those who perform Hajj or `Umra of the House (Ka`ba at Mecca) to perform the going (Tawaf) between them? (2.158) I understand (from that) that there is no harm if somebody does not perform the Tawaf between them." `Aisha replied, "No, for if it were as you are saying, then the recitation would have been like this: 'It is not harmful not to perform Tawaf between them.' This verse was revealed in connection with the Ansar who used to assume the Ihram for the idol Manat which was put beside a place called Qudaid and those people thought it not right to perform the Tawaf of As- Safa and Al-Marwa. When Islam came, they asked Allah's Apostle about that, and Allah revealed:-- "Verily! (the mountains) As-Safa and Al-Marwa Are among the symbols of Allah. So, it is not harmful of those who perform Hajj or `Umra of the House (Ka`ba at Mecca) to perform the going (Tawaf) between them." (2.158) Sufyan and Abu Muawiya added from Hisham (from `Aisha): "The Hajj or `Umra of the person who does not perform the going (Tawaf) between As-Safa and Al-Marwa is incomplete in Allah's sight.

Abu Huraira (Allah be pleased with him) reported:

The people of the Khuza'ah tribe killed a man of the tribe of Laith in the Year of Victory as a retaliation for one whom they had killed (whom the people of the tribe of Laith had killed). It was reported to Allah's Messenger (may peace be upon him). He mounted his camel and delivered this address: Verily Allah, the Exalted and Majestic, held back the Ele- phants from Mecca, and gave its domination to His Messenger and believers. Behold, it was not violable for anyone before me and it will not be violable for anyone after me. Behold, it was made violable for me for an hour of a day; and at this very hour it has again been made inviolable (for me as well as for others). So its thorns are not to be cut, its trees are not to be lopped, and (no one is allowed to) pick up a thing dropped, but the one who makes an announcement of it. And one whose fellow is killed is allowed to opt between two alternatives: either he should receive blood-money or get the life of the (murderer) in return. He (the narrator said): A person from the Yemen, who was called Abu Shah, came to him and said: Messenger of Allah, write it down for me, whereupon he (Allah's Messenger) said: Write it down for Abu Shah. One of the persons from among the Quraish also said: Except Idhkhir, for we use it in our houses ant our graves. Thereupon Allah's Messenger (may peace be upon him) said: Except Idhkhir.
حَدَّثَنِي إِسْحَاقُ بْنُ مَنْصُورٍ، أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنْ شَيْبَانَ، عَنْ يَحْيَى، أَخْبَرَنِي أَبُو سَلَمَةَ، أَنَّهُ سَمِعَ أَبَا هُرَيْرَةَ، يَقُولُ إِنَّ خُزَاعَةَ قَتَلُوا رَجُلاً مِنْ بَنِي لَيْثٍ عَامَ فَتْحِ مَكَّةَ بِقَتِيلٍ مِنْهُمْ قَتَلُوهُ فَأُخْبِرَ بِذَلِكَ رَسُولُ اللَّهِ صلى الله عليه وسلم فَرَكِبَ رَاحِلَتَهُ فَخَطَبَ فَقَالَ ‏"‏ إِنَّ اللَّهَ عَزَّ وَجَلَّ حَبَسَ عَنْ مَكَّةَ الْفِيلَ وَسَلَّطَ عَلَيْهَا رَسُولَهُ وَالْمُؤْمِنِينَ أَلاَ وَإِنَّهَا لَمْ تَحِلَّ لأَحَدٍ قَبْلِي وَلَنْ تَحِلَّ لأَحَدٍ بَعْدِي أَلاَ وَإِنَّهَا أُحِلَّتْ لِي سَاعَةً مِنَ النَّهَارِ أَلاَ وَإِنَّهَا سَاعَتِي هَذِهِ حَرَامٌ لاَ يُخْبَطُ شَوْكُهَا وَلاَ يُعْضَدُ شَجَرُهَا وَلاَ يَلْتَقِطُ سَاقِطَتَهَا إِلاَّ مُنْشِدٌ وَمَنْ قُتِلَ لَهُ قَتِيلٌ فَهُوَ بِخَيْرِ النَّظَرَيْنِ إِمَّا أَنْ يُعْطَى - يَعْنِي الدِّيَةَ - وَإِمَّا أَنْ يُقَادَ أَهْلُ الْقَتِيلِ ‏"‏ ‏.‏ قَالَ فَجَاءَ رَجُلٌ مِنْ أَهْلِ الْيَمَنِ يُقَالُ لَهُ أَبُو شَاهٍ فَقَالَ اكْتُبْ لِي يَا رَسُولَ اللَّهِ ‏.‏ فَقَالَ ‏"‏ اكْتُبُوا لأَبِي شَاهٍ ‏"‏ ‏.‏ فَقَالَ رَجُلٌ مِنْ قُرَيْشٍ إِلاَّ الإِذْخِرَ فَإِنَّا نَجْعَلُهُ فِي بُيُوتِنَا وَقُبُورِنَا ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِلاَّ الإِذْخِرَ ‏"‏ ‏.‏

Narrated Sa'd bin 'Ubaidah:
That Ibn 'Umar heard a man saying: "No by the Ka'bah" so Ibn 'Umar said: "Nothing is sworn by other than Allah, for I heard the Messenger of Allah (saws) say: 'Whoever swears by other than Allah, he has committed disbelief or shirk.'"
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا أَبُو خَالِدٍ الأَحْمَرُ، عَنِ الْحَسَنِ بْنِ عُبَيْدِ اللَّهِ، عَنْ سَعْدِ بْنِ عُبَيْدَةَ، أَنَّ ابْنَ عُمَرَ، سَمِعَ رَجُلاً، يَقُولُ لاَ وَالْكَعْبَةِ ‏.‏ فَقَالَ ابْنُ عُمَرَ لاَ يُحْلَفُ بِغَيْرِ اللَّهِ فَإِنِّي سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏"‏ مَنْ حَلَفَ بِغَيْرِ اللَّهِ فَقَدْ كَفَرَ أَوْ أَشْرَكَ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ ‏.‏ وَفُسِّرَ هَذَا الْحَدِيثُ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ أَنَّ قَوْلَهُ ‏"‏ فَقَدْ كَفَرَ أَوْ أَشْرَكَ ‏"‏ عَلَى التَّغْلِيظِ ‏.‏ وَالْحُجَّةُ فِي ذَلِكَ حَدِيثُ ابْنِ عُمَرَ أَنَّ النَّبِيَّ صلى الله عليه وسلم سَمِعَ عُمَرَ يَقُولُ وَأَبِي وَأَبِي ‏.‏ فَقَالَ ‏"‏ أَلاَ إِنَّ اللَّهَ يَنْهَاكُمْ أَنْ تَحْلِفُوا بِآبَائِكُمْ ‏"‏ ‏.‏ وَحَدِيثُ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ قَالَ ‏"‏ مَنْ قَالَ فِي حَلِفِهِ وَاللاَّتِ وَالْعُزَّى فَلْيَقُلْ لاَ إِلَهَ إِلاَّ اللَّهُ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا مِثْلُ مَا رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ قَالَ ‏"‏ إِنَّ الرِّيَاءَ شِرْكٌ ‏"‏ ‏.‏ وَقَدْ فَسَّرَ بَعْضُ أَهْلِ الْعِلْمِ هَذِهِ الآيَة ‏:‏ ‏(‏ وَمَنْ كَانَ يَرْجُو لِقَاءَ رَبِّهِ فَلْيَعْمَلْ عَمَلاً صَالِحًا ‏)‏ الآيَةَ قَالَ لاَ يُرَائِي ‏.‏

Malik related to me that he heard the like of that from Sulayman ibn Yasar.

Malik spoke about a man who bought out one of the partners in a shared property, by paying the man with an animal, a slave, a slave-girl, or the equivalent of that in goods. Then another partner decided to exercise his right of pre-emption after that, and he found that the slave or slave-girl had died, and no one knew what her value had been. The buyer claimed, "The value of the slave or slave-girl was 100 dinars." The partner with the right of pre-emption claimed, "The value was 50 dinars."

Malik said, "The buyer takes an oath that the value of what he payed was 100 dinars. Then if the one with the right of pre-emption wishes, he can compensate him, or else he can leave it, unless he can bring a clear proof that the slave or slave-girl's value is less than what the buyer said. If someone gives away his portion of a shared house or land and the recipient repays him for it by cash or goods, the partners can take it by pre-emption if they wish and pay off the recipient the value of what he gave in dinars or dirhams. If someone makes a gift of his portion of a shared house or land, and does not take any remuneration and does not seek to, and a partner wants to take it for its value, he cannot do so as long as the original partner has not been given recompense for it. If there is any recompense, the one with the right of pre-emption can have it for the price of the recompense."

Malik spoke about a man who bought into a piece of shared land for a price on credit, and one of the partners wanted to possess it by right of pre-emption . Malik said, "If it seems likely that the partner can meet the terms, he has right of pre-emption for the same credit terms. If it is feared that he will not be able to meet the terms, but he can bring a wealthy and reliable guarantor of equal standing to the one who bought into the land, he can also take possession."

Malik said, "A person's absence does not sever his right of pre-emption. Even if he is a way for a long time, there is no time limit after which the right of preemption is cut off."

Malik said that if a man left land to a number of his children, then one of them who had a child died and the child of the deceased sold his right in that land, the brother of the seller was more entitled to pre-empt him than his paternal uncles, the partners of his father.

مَا اشْتَرَى بِهِ مِائَةُ دِينَارٍ ثُمَّ إِنْ شَاءَ أَنْ يَأْخُذَ صَاحِبُ الشُّفْعَةِ أَخَذَ أَوْ يَتْرُكَ إِلاَّ أَنْ يَأْتِيَ الشَّفِيعُ بِبَيِّنَةٍ أَنَّ قِيمَةَ الْعَبْدِ أَوِ الْوَلِيدَةِ دُونَ مِنْهَا وَلَمْ يَطْلُبْهَا فَأَرَادَ شَرِيكُهُ أَنْ يَأْخُذَهَا بِقِيمَتِهَا فَلَيْسَ ذَلِكَ لَهُ مَا لَمْ يُثَبْ عَلَيْهَا فَإِنْ أُثِيبَ فَهُوَ لِلشَّفِيعِ بِقِيمَةِ الثَّوَابِ ‏.‏ قَالَ مَالِكٌ فِي رَجُلٍ اشْتَرَى شِقْصًا فِي أَرْضٍ مُشْتَرَكَةٍ بِثَمَنٍ إِلَى أَجَلٍ فَأَرَادَ الشَّرِيكُ أَنْ يَأْخُذَهَا بِالشُّفْعَةِ ‏.‏ قَالَ مَالِكٌ إِنْ كَانَ مَلِيًّا فَلَهُ الشُّفْعَةُ بِذَلِكَ الثَّمَنِ إِلَى ذَلِكَ الأَجَلِ وَإِنْ كَانَ مَخُوفًا أَنْ لاَ يُؤَدِّيَ الثَّمَنَ إِلَى ذَلِكَ الأَجَلِ فَإِذَا جَاءَهُمْ بِحَمِيلٍ مَلِيٍّ ثِقَةٍ مِثْلِ الَّذِي اشْتَرَى مِنْهُ الشِّقْصَ فِي الأَرْضِ الْمُشْتَرَكَةِ فَذَلِكَ لَهُ ‏.‏ قَالَ مَالِكٌ لاَ تَقْطَعُ شُفْعَةَ الْغَائِبِ غَيْبَتُهُ وَإِنْ طَالَتْ غَيْبَتُهُ وَلَيْسَ لِذَلِكَ عِنْدَنَا حَدٌّ تُقْطَعُ إِلَيْهِ الشُّفْعَةُ ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يُوَرِّثُ الأَرْضَ نَفَرًا مِنْ وَلَدِهِ ثُمَّ يُولَدُ لأَحَدِ النَّفَرِ ثُمَّ يَهْلِكُ الأَبُ فَيَبِيعُ أَحَدُ وَلَدِ الْمَيِّتِ حَقَّهُ فِي تِلْكَ الأَرْضِ فَإِنَّ أَخَا الْبَائِعِ أَحَقُّ بِشُفْعَتِهِ مِنْ عُمُومَتِهِ شُرَكَاءِ أَبِيهِ ‏.‏ قَالَ مَالِكٌ وَهَذَا الأَمْرُ عِنْدَنَا ‏.‏ قَالَ مَالِكٌ الشُّفْعَةُ بَيْنَ الشُّرَكَاءِ عَلَى قَدْرِ حِصَصِهِمْ يَأْخُذُ كُلُّ إِنْسَانٍ مِنْهُمْ بِقَدْرِ نَصِيبِهِ إِنْ كَانَ قَلِيلاً فَقَلِيلاً وَإِنْ كَانَ كَثِيرًا فَبِقَدْرِهِ وَذَلِكَ إِنْ تَشَاحُّوا فِيهَا ‏.‏ قَالَ مَالِكٌ فَأَمَّا أَنْ يَشْتَرِيَ رَجُلٌ مِنْ رَجُلٍ مِنْ شُرَكَائِهِ حَقَّهُ فَيَقُولُ أَحَدُ الشُّرَكَاءِ أَنَا آخُذُ مِنَ الشُّفْعَةِ بِقَدْرِ حِصَّتِي ‏.‏ وَيَقُولُ الْمُشْتَرِي إِنْ شِئْتَ أَنْ تَأْخُذَ الشُّفْعَةَ كُلَّهَا أَسْلَمْتُهَا إِلَيْكَ وَإِنْ شِئْتَ أَنْ تَدَعَ فَدَعْ فَإِنَّ الْمُشْتَرِيَ إِذَا خَيَّرَهُ فِي هَذَا وَأَسْلَمَهُ إِلَيْهِ فَلَيْسَ لِلشَّفِيعِ إِلاَّ أَنْ يَأْخُذَ الشُّفْعَةَ كُلَّهَا أَوْ يُسْلِمَهَا إِلَيْهِ فَإِنْ أَخَذَهَا فَهُوَ أَحَقُّ بِهَا وَإِلاَّ فَلاَ شَىْءَ لَهُ ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يَشْتَرِي الأَرْضَ فَيَعْمُرُهَا بِالأَصْلِ يَضَعُهُ فِيهَا أَوِ الْبِئْرِ يَحْفِرُهَا ثُمَّ يَأْتِي رَجُلٌ فَيُدْرِكُ فِيهَا حَقًّا فَيُرِيدُ أَنْ يَأْخُذَهَا بِالشُّفْعَةِ إِنَّهُ لاَ شُفْعَةَ لَهُ فِيهَا إِلاَّ أَنْ يُعْطِيَهُ قِيمَةَ مَا عَمَرَ فَإِنْ أَعْطَاهُ قِيمَةَ مَا عَمَرَ كَانَ أَحَقَّ بِالشُّفْعَةِ وَإِلاَّ فَلاَ حَقَّ لَهُ فِيهَا ‏.‏ قَالَ مَالِكٌ مَنْ بَاعَ حِصَّتَهُ مِنْ أَرْضٍ أَوْ دَارٍ مُشْتَرَكَةٍ فَلَمَّا عَلِمَ أَنَّ صَاحِبَ الشُّفْعَةِ يَأْخُذُ بِالشُّفْعَةِ اسْتَقَالَ الْمُشْتَرِي فَأَقَالَهُ ‏.‏ قَالَ لَيْسَ ذَلِكَ لَهُ وَالشَّفِيعُ أَحَقُّ بِهَا بِالثَّمَنِ الَّذِي كَانَ بَاعَهَا بِهِ ‏.‏ قَالَ مَالِكٌ مَنِ اشْتَرَى شِقْصًا فِي دَارٍ أَوْ أَرْضٍ وَحَيَوَانًا وَعُرُوضًا فِي صَفْقَةٍ وَاحِدَةٍ فَطَلَبَ الشَّفِيعُ شُفْعَتَهُ فِي الدَّارِ أَوِ الأَرْضِ فَقَالَ الْمُشْتَرِي خُذْ مَا اشْتَرَيْتُ جَمِيعًا فَإِنِّي إِنَّمَا اشْتَرَيْتُهُ جَمِيعًا ‏.‏ قَالَ مَالِكٌ بَلْ يَأْخُذُ الشَّفِيعُ شُفْعَتَهُ فِي الدَّارِ أَوِ الأَرْضِ بِحِصَّتِهَا مِنْ ذَلِكَ الثَّمَنِ يُقَامُ كُلُّ شَىْءٍ اشْتَرَاهُ مِنْ ذَلِكَ عَلَى حِدَتِهِ عَلَى الثَّمَنِ الَّذِي اشْتَرَاهُ بِهِ ثُمَّ يَأْخُذُ الشَّفِيعُ شُفْعَتَهُ بِالَّذِي يُصِيبُهَا مِنَ الْقِيمَةِ مِنْ رَأْسِ الثَّمَنِ وَلاَ يَأْخُذُ مِنَ الْحَيَوَانِ وَالْعُرُوضِ شَيْئًا إِلاَّ أَنْ يَشَاءَ ذَلِكَ ‏.‏ قَالَ مَالِكٌ وَمَنْ بَاعَ شِقْصًا مِنْ أَرْضٍ مُشْتَرَكَةٍ فَسَلَّمَ بَعْضُ مَنْ لَهُ فِيهَا الشُّفْعَةُ لِلْبَائِعِ وَأَبَى بَعْضُهُمْ إِلاَّ أَنْ يَأْخُذَ بِشُفْعَتِهِ إِنَّ مَنْ أَبَى أَنْ يُسَلِّمَ يَأْخُذُ بِالشُّفْعَةِ كُلِّهَا وَلَيْسَ لَهُ أَنْ يَأْخُذَ بِقَدْرِ حَقِّهِ وَيَتْرُكَ مَا بَقِيَ ‏.‏ قَالَ مَالِكٌ فِي نَفَرٍ شُرَكَاءَ فِي دَارٍ وَاحِدَةٍ فَبَاعَ أَحَدُهُمْ حِصَّتَهُ وَشُرَكَاؤُهُ غُيَّبٌ كُلُّهُمْ إِلاَّ رَجُلاً فَعُرِضَ عَلَى الْحَاضِرِ أَنْ يَأْخُذَ بِالشُّفْعَةِ أَوْ يَتْرُكَ ‏.‏ فَقَالَ أَنَا آخُذُ بِحِصَّتِي وَأَتْرُكُ حِصَصَ شُرَكَائِي حَتَّى يَقْدَمُوا فَإِنْ أَخَذُوا فَذَلِكَ وَإِنْ تَرَكُوا أَخَذْتُ جَمِيعَ الشُّفْعَةِ ‏.‏ قَالَ مَالِكٌ لَيْسَ لَهُ إِلاَّ أَنْ يَأْخُذَ ذَلِكَ كُلَّهُ أَوْ يَتْرُكَ فَإِنْ جَاءَ شُرَكَاؤُهُ أَخَذُوا مِنْهُ أَوْ تَرَكُوا إِنْ شَاءُوا فَإِذَا عُرِضَ هَذَا عَلَيْهِ فَلَمْ يَقْبَلْهُ فَلاَ أَرَى لَهُ شُفْعَةً ‏.‏

Narrated Sa'eed bin Jubair:
"I was asked about those who were involved in the case of Li'an and if they are to be separated, during the leadership of Mus'ab bin Az-Zubair. I did not know what to say. So I went to the house of 'Abdullah bin 'Umar and I sought permission to enter. I was told he was taking a nap, but he heard me taking and he said: 'Is it Ibn Jubair? Enter. You would not have come except for a need.'" He said: "So I entered and found him laying on a saddlecloth from his mount. I said: 'O Abu 'Abdur-Rahman! Are those involved in Li'an separated?' He said: 'Glorious is Allah! Yes. The first who asked about hat was so-and-so the son of so-and-so. He came to the Prophet (SAW) and said "O Messenger of Allah! If one of us saw his wife committing adultery, what should he do? If he were to say anything, his statement would be a horrible matter, and if he were to remain silent, his silence about the matter would be horrible." He said: 'So the Prophet (SAW) remained silent and did not answer him. Afterwards he came to the Prophet (SAW) and said: "The one who asked you about it has been tried by it." So Allah revealed these Ayat from Surat An-Nur: 'And those who accuse their wives and have no witnesses except themselves, let the testimony of one of them be four testimonies by Allah (24:6-10)' - until the end of those Ayat. He said: 'So he called for the man and recited the Ayat to him and admonished him, reminded him, and he told him: "Indeed the punishment of the world is less than the punishment of the Hereafter." So he said: "Nay! By the One Who sent you with the Truth! I did not lie about her." Then he (SAW) did the same with the woman, admonishing her and reminding her and he told her: "Indeed the punishment of the world is less than the punishment of the Hereafter." She said: "Nay! By the One Who sent you with the Truth! He is not telling the truth.'" "He said: 'So he started with the man: He testified four times, by Allah that he is one of the truthful, and the fifth time that the curse of Allah be upon him if he was one of the liars. Then the same with the woman: She testified four times by Allah, that he was one of the liars, and the fifth time that the wrath of Allah be upon her if he was one of the truthful. Then he separated the two of them.'"
حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا عَبْدَةُ بْنُ سُلَيْمَانَ، عَنْ عَبْدِ الْمَلِكِ بْنِ أَبِي سُلَيْمَانَ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ سُئِلْتُ عَنِ الْمُتَلاَعِنَيْنِ، فِي إِمَارَةِ مُصْعَبِ بْنِ الزُّبَيْرِ أَيُفَرَّقُ بَيْنَهُمَا فَمَا دَرَيْتُ مَا أَقُولُ فَقُمْتُ مِنْ مَكَانِي إِلَى مَنْزِلِ عَبْدِ اللَّهِ بْنِ عُمَرَ فَاسْتَأْذَنْتُ عَلَيْهِ فَقِيلَ لِي إِنَّهُ قَائِلٌ فَسَمِعَ كَلاَمِي فَقَالَ لِي ابْنَ جُبَيْرٍ ادْخُلْ مَا جَاءَ بِكَ إِلاَّ حَاجَةٌ قَالَ فَدَخَلْتُ فَإِذَا هُوَ مُفْتَرِشٌ بَرْدَعَةَ رَحْلٍ لَهُ فَقُلْتُ يَا أَبَا عَبْدِ الرَّحْمَنِ الْمُتَلاَعِنَانِ أَيُفَرَّقُ بَيْنَهُمَا فَقَالَ سُبْحَانَ اللَّهِ نَعَمْ إِنَّ أَوَّلَ مَنْ سَأَلَ عَنْ ذَلِكَ فُلاَنُ بْنُ فُلاَنٍ أَتَى النَّبِيَّ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ أَرَأَيْتَ لَوْ أَنَّ أَحَدَنَا رَأَى امْرَأَتَهُ عَلَى فَاحِشَةٍ كَيْفَ يَصْنَعُ إِنْ تَكَلَّمَ تَكَلَّمَ بِأَمْرٍ عَظِيمٍ وَإِنْ سَكَتَ سَكَتَ عَلَى أَمْرٍ عَظِيمٍ قَالَ فَسَكَتَ النَّبِيُّ صلى الله عليه وسلم فَلَمْ يُجِبْهُ فَلَمَّا كَانَ بَعْدَ ذَلِكَ أَتَى النَّبِيَّ صلى الله عليه وسلم فَقَالَ إِنَّ الَّذِي سَأَلْتُكَ عَنْهُ قَدِ ابْتُلِيتُ بِهِ فَأَنْزَلَ اللَّهُ هَذِهِ الآيَاتِ فِي سُورَةِ النُّورِ ‏:‏ ‏(‏والَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُنْ لَهُمْ شُهَدَاءُ إِلاَّ أَنْفُسُهُمْ ‏)‏ حَتَّى خَتَمَ الآيَاتِ قَالَ فَدَعَا الرَّجُلَ فَتَلاَهُنَّ عَلَيْهِ وَوَعَظَهُ وَذَكَّرَهُ وَأَخْبَرَهُ أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الآخِرَةِ فَقَالَ لاَ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا كَذَبْتُ عَلَيْهَا ‏.‏ ثُمَّ ثَنَّى بِالْمَرْأَةِ وَوَعَظَهَا وَذَكَّرَهَا وَأَخْبَرَهَا أَنَّ عَذَابَ الدُّنْيَا أَهْوَنُ مِنْ عَذَابِ الآخِرَةِ فَقَالَتْ لاَ وَالَّذِي بَعَثَكَ بِالْحَقِّ مَا صَدَقَ ‏.‏ فَبَدَأَ بِالرَّجُلِ فَشَهِدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الصَّادِقِينَ وَالْخَامِسَةَ أَنَّ لَعْنَةَ اللَّهِ عَلَيْهِ إِنْ كَانَ مِنَ الْكَاذِبِينَ ثُمَّ ثَنَّى بِالْمَرْأَةِ فَشَهِدَتْ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِنْ كَانَ مِنَ الصَّادِقِينَ ثُمَّ فَرَّقَ بَيْنَهُمَا ‏.‏ وَفِي الْبَابِ عَنْ سَهْلِ بْنِ سَعْدٍ قَالَ وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏
