Sunan Abi Dawud 583

The version of this tradition narrated through a different chain by Shu’bah has the words:

“A man should not lead the another man in prayer.

Abu Dawud said: Yahya al-Qattan narrated from Shu’bah in a similar way, i.e. the earliest of them in recitation.

Sunan Abi Dawud 1570
Ibn Shihab (Al Zuhri) said This is the copy of the letter of the Messenger of Allah(saws), which he had written about sadaqah(zakat). This was in the custody of the descendants of ‘Umar bin Al Khattab. Ibn Shihab said Salim bin Abdallah bin Umar read it to me and I memorized it properly. Umar bin Abdul Aziz got it copied from ‘Abdallah, ‘Abdallah bin Umar and Salim bin ‘Abdallah bin ‘Umar. He (Ibn Shihab) then narrated the tradition like the former(i.e., up to one hundred and twenty camels). He further said if they (the camels) reach one hundred and twenty one to one hundred and twenty nine, three she camels in their third year are to be given. When they reach one hundred and thirty to one hundred and thirty nine, two she camels in their third year and one she Camel in her fourth year are to be given. When they reach one hundred and forty to one hundred and forty nine, two she camels in their fourth year and one she Camel in her third year are to be given. When they reach one hundred and fifty to one hundred and fifty nine, three she camels in their fourth year are to be given. When they reach one hundred and sixty to one hundred and sixty nine four she camels in their fourth year are to be given. When they reach one hundred and seventy to one hundred and seventy nine, three she camels in their third year and one she Camel in her fourth year are to be given. When they reach one hundred and eighty to one hundred and eighty nine, two she camels in their fourth year and two she Camel in their third year are to be given. When they reach one hundred and ninety to one hundred and ninety nine, three she camels in their fourth year and one she Camel in her third year are to be given. When they reach two hundred, four she camels in their fourth year or five she Camels in their third year, camels of whichever age are available, are to be accepted.

For the pasturing goats, he narrated the tradition similar to that transmitted by Sufyan bin Husain. This version adds “An old goat, one with defect in the eye or a male goat is not to be accepted in sadaqah(zakat) unless the collector wishes.”

أَخْبَرَنَا مُحَمَّدُ بْنُ حُمَيْدٍ ، حَدَّثَنَا هَارُونُ بْنُ الْمُغِيرَةِ ، عَنْ عَنْبَسَةَ بْنِ سَعِيدٍ ، عَنْ خَالِدِ بْنِ زَيْدٍ الْأَنْصَارِيِّ ، عَنْ عَقَّارِ بْنِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، عَنْ أَبِيهِ الْمُغِيرَةِ بْنِ شُعْبَةَ ، قَالَ : نَشَدَ عُمَرُ النَّاسَ : أَسَمِعَ مِنْ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَحَدٌ مِنْكُمْ فِي الْجَنِينِ؟ فَقَامَ الْمُغِيرَةُ بْنُ شُعْبَةَ، فَقَالَ : قَضَى فِيهِ عَبْدًا أَوْ أَمَةً، فَنَشَدَ النَّاسَ أَيْضًا : فَقَامَ الْمَقْضِيُّ لَهُ ، فَقَالَ : " قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِي بِهِ عَبْدًا أَوْ أَمَةً " فَنَشَدَ النَّاسَ أَيْضًا : فَقَامَ الْمَقْضِيُّ عَلَيْهِ ، فَقَالَ : قَضَى النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ " عَلَيَّ غُرَّةً عَبْدًا أَوْ أَمَةً "، فَقُلْتُ : أَتَقْضِي عَلَيَّ فِيهِ فِيمَا لَا أَكَلَ، وَلَا شَرِبَ، وَلَا اسْتَهَلَّ، وَلَا نَطَقَ؟ أَنْ تُطِلَّهُ فَهُوَ أَحَقُّ مَا يُطَلُّ " فَهَمَّ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِلَيْهِ بِشَيْءٍ مَعَهُ "، فَقَالَ :" أَشِعْرٌ؟ "، فَقَالَ عُمَرُ : لَوْلَا مَا بَلَغَنِي مِنْ قَضَاءِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لَجَعَلْتُهُ دِيَةً بَيْنَ دِيَتَيْنِ

أَخْبَرَنَا عُثْمَانُ بْنُ مُحَمَّدٍ ، حَدَّثَنَا جَرِيرٌ ، عَنْ إِدْرِيسَ الْأَوْدِيِّ ، عَنْ أَبِي إِسْحَاق ، عَنْ أَبِي الْأَحْوَصِ : أَنَّ عَبْدَ اللَّهِ يَرْفَعُ الْحَدِيثَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ :" إِنَّ شَرَّ الرَّوَايَا رَوَايَا الْكَذِبِ، وَلَا يَصْلُحُ مِنْ الْكَذِبِ جِدٌّ وَلَا هَزْلٌ. وَلَا يَعِدُ الرَّجُلُ ابْنَهُ ثُمَّ لَا يُنْجِزُ لَهُ : إِنَّ الصِّدْقَ يَهْدِي إِلَى الْبِرِّ، وَإِنَّ الْبِرَّ يَهْدِي إِلَى الْجَنَّةِ، وَإِنَّ الْكَذِبَ يَهْدِي إِلَى الْفُجُورِ، وَإِنَّ الْفُجُورَ يَهْدِي إِلَى النَّارِ، وَإِنَّهُ يُقَالُ لِلصَّادِقِ : صَدَقَ وَبَرَّ، وَيُقَالُ لِلْكَاذِبِ : كَذَبَ وَفَجَرَ. وَإِنَّ الرَّجُلَ لَيَصْدُقُ حَتَّى يُكْتَبَ عِنْدَ اللَّهِ صِدِّيقًا، وَيَكْذِبُ حَتَّى يُكْتَبَ عِنْدَ اللَّهِ كَذَّابًا ". وَإِنَّهُ قَالَ : " لَنَا هَلْ أُنَبِّئُكُمْ مَا الْعَضْهُ؟ وَإِنَّ الْعَضْهَ : هِيَ النَّمِيمَةُ الَّتِي تُفْسِدُ بَيْنَ النَّاسِ "

Wa'il bin Hujr narrated:
"I heard the Prophet recite: (Not (the way) of those who earned Your anger, nor those who went astray) and he said: 'Amin.' And he stretched it out with his voice."
حَدَّثَنَا بُنْدَارٌ، مُحَمَّدُ بْنُ بَشَّارٍ حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، وَعَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، قَالاَ حَدَّثَنَا سُفْيَانُ، عَنْ سَلَمَةَ بْنِ كُهَيْلٍ، عَنْ حُجْرِ بْنِ عَنْبَسٍ، عَنْ وَائِلِ بْنِ حُجْرٍ، قَالَ سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم قَرَأَ‏:‏ ‏(‏غَيْرِ الْمَغْضُوبِ عَلَيْهِمْ وَلاَ الضَّالِّينَ ‏)‏ فَقَالَ ‏"‏ آمِينَ ‏"‏ ‏.‏ وَمَدَّ بِهَا صَوْتَهُ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ عَلِيٍّ وَأَبِي هُرَيْرَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ وَائِلِ بْنِ حُجْرٍ حَدِيثٌ حَسَنٌ ‏.‏ وَبِهِ يَقُولُ غَيْرُ وَاحِدٍ مِنْ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَالتَّابِعِينَ وَمَنْ بَعْدَهُمْ يَرَوْنَ أَنَّ الرَّجُلَ يَرْفَعُ صَوْتَهُ بِالتَّأْمِينِ وَلاَ يُخْفِيهَا ‏.‏ وَبِهِ يَقُولُ الشَّافِعِيُّ وَأَحْمَدُ وَإِسْحَاقُ ‏.‏ وَرَوَى شُعْبَةُ هَذَا الْحَدِيثَ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ عَنْ حُجْرٍ أَبِي الْعَنْبَسِ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ عَنْ أَبِيهِ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَرَأَ ‏:‏ ‏(‏ غَيْرِ الْمَغْضُوبِ عَلَيْهِمْ وَلاَ الضَّالِّينَ ‏)‏ فَقَالَ ‏"‏ آمِينَ ‏"‏ ‏.‏ وَخَفَضَ بِهَا صَوْتَهُ ‏.‏ قَالَ أَبُو عِيسَى وَسَمِعْتُ مُحَمَّدًا يَقُولُ حَدِيثُ سُفْيَانَ أَصَحُّ مِنْ حَدِيثِ شُعْبَةَ فِي هَذَا وَأَخْطَأَ شُعْبَةُ فِي مَوَاضِعَ مِنْ هَذَا الْحَدِيثِ فَقَالَ عَنْ حُجْرٍ أَبِي الْعَنْبَسِ وَإِنَّمَا هُوَ حُجْرُ بْنُ عَنْبَسٍ وَيُكْنَى أَبَا السَّكَنِ ‏.‏ وَزَادَ فِيهِ عَنْ عَلْقَمَةَ بْنِ وَائِلٍ وَلَيْسَ فِيهِ عَنْ عَلْقَمَةَ وَإِنَّمَا هُوَ عَنْ حُجْرِ بْنِ عَنْبَسٍ عَنْ وَائِلِ بْنِ حُجْرٍ وَقَالَ وَخَفَضَ بِهَا صَوْتَهُ وَإِنَّمَا هُوَ وَمَدَّ بِهَا صَوْتَهُ ‏.‏ قَالَ أَبُو عِيسَى وَسَأَلْتُ أَبَا زُرْعَةَ عَنْ هَذَا الْحَدِيثِ فَقَالَ حَدِيثُ سُفْيَانَ فِي هَذَا أَصَحُّ مِنْ حَدِيثِ شُعْبَةَ ‏.‏ قَالَ وَرَوَى الْعَلاَءُ بْنُ صَالِحٍ الأَسَدِيُّ عَنْ سَلَمَةَ بْنِ كُهَيْلٍ نَحْوَ رِوَايَةِ سُفْيَانَ ‏.‏

'Auf bin Malik (May Allah be pleased with him) said:
'Aishah (May Allah be pleased with her) as told that 'Abdullah bin Az-Zubair (May Allah be pleased with them) had said in respect of selling of a gift which was presented to her: "By Allah! If 'Aishah does not stop this kind of thing, I will declare her incompetent to administer her property." 'Aishah (May Allah be pleased with her) asked: "Did He ('Abdullah bin Az-Zubair) say so?" The people said: "Yes." 'Aishah (May Allah be pleased with her) said: "I vow it before Allah that I will never speak to Ibn Az-Zubair." When this desertion lasted long, 'Abdullah bin Az-Zubair sought intercession with her, but she said: "By Allah I will not accept the intercession of anyone for him, and I will not commit a sin of breaking my vow." When this state of affairs was prolonged, Ibn Az-Zubair felt it hard on him. He said to Al-Miswar bin Makhramah and 'Abdur-Rahman bin Al-Aswad bin Yaghut: "I beseech you in the Name of Allah that you should take me to 'Aishah because it is unlawful for her to vow to sever relations with me." So Al-Miswar and 'Abdur-Rahman took him with them. They sought her permission, saying: "As-salamu 'alaika wa rahmatullahi wa barakatuhu! Shall we come in?" 'Aishah (May Allah be pleased with her) said: "Come in," They asked: "All of us?" She said: "All of you," not knowing that Ibn Az-Zubair was also with them. So, when they entered, Ibn Az-Zubair entered the screened place and got hold of 'Aishah (May Allah be pleased with her), his aunt. He was requesting her to forgive him and wept. Al-Miswar and 'Abdur-Rahman also pleaded on his behalf and requested her to speak to him and to accept his repentance. They said to her: "The Prophet (PBUH) forbade to cut off relationship because it is unlawful for any Muslim not to talk to his (Muslim) brother (or sister, for that matter) for more than three (days)." So when they persisted in urging and reminding her of the superiority of having good relation with kith and kin, she began to weep, saying: "I have made a vow which is a matter of very serious nature." They persisted in their appeal till she spoke with 'Abdullah bin Az-Zubair, and she freed forty slaves as an expiation for breaking her vow. Later on, whenever she remembered her vow, she would weep so much that her veil would become wet with tears.

وعن عوف بن مالك بن الطفيل أن عائشة رضي الله عنها حدثت أن عبد الله بن الزبير رضي الله عنهما قال في بيع أو عطاء أعطته عائشة رضي الله عنها‏:‏ والله لتنتهين عائشة، أو لأحجرن عليها، قالت أهو قال هذا ‏؟‏ قالو‏:‏ نعم، قالت‏:‏ هو لله علي نذر أن لا أكلم ابن الزبير أبدا، فاستشفع بن الزبير إليها حين طالت الهجرة، فقالت‏:‏ لا والله لا أشفع فيه أبداً، ولا أتحنث إلى نذري فلما طال ذلك على ابن الزبير كلم المسور ابن مخرمة، وعبد الرحمن بن الأسود بن عبد يغوث وقال لهما‏:‏ أنشدكما الله لما أدخلتماني على عائشة رضي الله عنها، فإنها لا يحل لها أن تنذر قطيعتى، فأقبل به المسور، وعبد الرحمن حتى استأذنا على عائشة، فقالا‏:‏ السلام عليك ورحمة الله وبركاته، أندخل‏؟‏ قالت عائشة‏:‏ ادخلوا، قالوا‏:‏ كلنا‏؟‏ قالت‏:‏ نعم ادخلوا كلكم، ولا تعلم أن معهما ابن الزبير، فلما دخلوا ، دخل ابن الزبير الحجاب، فاعتنق عائشة رضي الله عنها، وطفق يناشدها ويبكي، وطفق المسور، وعبد الرحمن يناشدانها إلا كلمته وقبلت منه، ويقولان ‏:‏ إن النبي صلى الله عليه وسلم نها عما قد علمت من الهجرة، ولا يحل لمسلم أن يهجر أخاه فوق ثلاث ليال، فلما أكثروا على عائشة من التذكرة والتحريج، طفقت تذكرهما وتبكي ، وتقول‏:‏ إني نذرت والنذر شديد ، فلم يزالا بها حتى كلمت ابن الزبير، وأعتقت في نذرها ذلك أربعين رقبة، وكانت تذكر نذرها بعد ذلك فتبكي حتى تبل دموعها خمارها‏.‏ ‏(‏‏(‏رواه البخاري‏)‏‏)‏‏.‏

‘Abd al-Muttalib b. Rabi'a reported God’s messenger as saying, “These sadaqat are only people’s impurities,* and they are not lawful for Muhammad or Muhammad’s family.” Muslim transmitted it. * i.e. an atonement for their sins.

Ibn ‘Abbas said that the Prophet asked some people whether they would like him to tell them who was in the worst position, and when they replied that they would, he said, “The one who is asked for something in God’s name and does not give it in His name.” Ahmad transmitted it.

Mu'awiya reported God’s messenger as saying, "Emigration will not come to an end* till repentance comes to an end and repentance will not come to an end till the sun rises in-the place where it sets.” *This probably means that people will continue to leave districts in which it is difficult for them to observe their religion. Ahmad Abu Dawud and Darimi transmitted it.

Yahya related to me from Malik that he had heard that Abdullah ibn Umar and Abu Hurayra were asked about a man who gave his wife power over herself, and she returned it to him without doing anything with it. They said that there was no divorce. (i.e. The man's giving his wife power over herself was not interpreted as a desire for divorce on his part.)

"He used: 'Not purify them ; grievously will be their penalty.'"

He said about (selling) the goods: I swear by Allah, I was given (the price) so and so for it. The other man considered it to be correct and bought it.

86 Malik related to me from Musa ibn Maysara that he heard a man ask Said ibn al-Musayyab, "I am a man who sells for a debt." Said said, "Do not sell except for what you take to your camel."

Malik spoke about a person who bought goods from a man provided that he provide him with those goods by a specific date, either in time for a market in which he hoped for their saleability, or to fulfil a need at the time he stipulated. Then the seller failed him about the date, and the buyer wanted to return those goods to the seller. Malik said, "The buyer cannot do that, and the sale is binding on him. If the seller does bring the goods before the completion of the term, the buyer cannot be forced to take them."

Malik spoke about a person who bought food and measured it. Then some one came to him to buy it and he told him that he had measured it for himself and taken it in full. The new buyer wanted to trust him and accept his measure. Malik said, "Whatever is sold in this way for cash has no harm in it but whatever is sold in this way on delayed terms is disapproved of until the new buyer measures it out for himself. The sale with delayed terms is disapproved of because it leads to usury and it is feared that it will be circulated in this way without weight or measure. If the terms are delayed it is disapproved of and there is no disagreement about that with us."

Malik said, "One should not buy a debt owed by a man whether present or absent, without the confirmation of the one who owes the debt, nor should one buy a debt owed to a man by a dead person even if one knows what the deceased man has left. That is because to buy that is an uncertain transaction and one does not know whether the transaction will be completed or not completed."

He said, "The explanation of what is disapproved of in buying a debt owed by someone absent or dead, is that it is not known what unknown debtor may be connected to the dead person. If the dead person is liable for another debt, the price which the buyer gave on strength of the debt may become worthless."

Malik said, "There is another fault in that as well. He is buying something which is not guaranteed for him, and so if the deal is not completed, what he paid becomes worthless. This is an uncertain transaction and it is not good."

Malik said, "One distinguishes between a man who is only selling what he actually has and a man who is being paid in advance for something which ...

وَحَدَّثَنِي مَالِكٌ، عَنْ مُوسَى بْنِ مَيْسَرَةَ، أَنَّهُ سَمِعَ رَجُلاً، يَسْأَلُ سَعِيدَ بْنَ الْمُسَيَّبِ فَقَالَ إِنِّي رَجُلٌ أَبِيعُ بِالدَّيْنِ ‏.‏ فَقَالَ سَعِيدٌ لاَ تَبِعْ إِلاَّ مَا آوَيْتَ إِلَى رَحْلِكَ ‏.‏ قَالَ مَالِكٌ فِي الَّذِي يَشْتَرِي السِّلْعَةَ مِنَ الرَّجُلِ عَلَى أَنْ يُوَفِّيَهُ تِلْكَ السِّلْعَةَ إِلَى أَجَلٍ مُسَمًّى إِمَّا لِسُوقٍ يَرْجُو نَفَاقَهَا فِيهِ وَإِمَّا لِحَاجَةٍ فِي ذَلِكَ الزَّمَانِ الَّذِي اشْتَرَطَ عَلَيْهِ ثُمَّ يُخْلِفُهُ الْبَائِعُ عَنْ ذَلِكَ الأَجَلِ فَيُرِيدُ الْمُشْتَرِي رَدَّ تِلْكَ السِّلْعَةِ عَلَى الْبَائِعِ إِنَّ ذَلِكَ لَيْسَ لِلْمُشْتَرِي وَإِنَّ الْبَيْعَ لاَزِمٌ لَهُ وَإِنَّ الْبَائِعَ لَوْ جَاءَ بِتِلْكَ السِّلْعَةِ قَبْلَ مَحِلِّ الأَجَلِ لَمْ يُكْرَهِ الْمُشْتَرِي عَلَى أَخْذِهَا ‏.‏ قَالَ مَالِكٌ فِي الَّذِي يَشْتَرِي الطَّعَامَ فَيَكْتَالُهُ ثُمَّ يَأْتِيهِ مَنْ يَشْتَرِيهِ مِنْهُ فَيُخْبِرُ الَّذِي يَأْتِيهِ أَنَّهُ قَدِ اكْتَالَهُ لِنَفْسِهِ وَاسْتَوْفَاهُ فَيُرِيدُ الْمُبْتَاعُ أَنْ يُصَدِّقَهُ وَيَأْخُذَهُ بِكَيْلِهِ إِنَّ مَا بِيعَ عَلَى هَذِهِ الصِّفَةِ بِنَقْدٍ فَلاَ بَأْسَ بِهِ وَمَا بِيعَ عَلَى هَذِهِ الصِّفَةِ إِلَى أَجَلٍ فَإِنَّهُ مَكْرُوهٌ حَتَّى يَكْتَالَهُ الْمُشْتَرِي الآخَرُ لِنَفْسِهِ وَإِنَّمَا كُرِهَ الَّذِي إِلَى أَجَلٍ لأَنَّهُ ذَرِيعَةٌ إِلَى الرِّبَا وَتَخَوُّفٌ أَنْ يُدَارَ ذَلِكَ عَلَى هَذَا الْوَجْهِ بِغَيْرِ كَيْلٍ وَلاَ وَزْنٍ فَإِنْ كَانَ إِلَى أَجَلٍ فَهُوَ مَكْرُوهٌ وَلاَ اخْتِلاَفَ فِيهِ عِنْدَنَا ‏.‏ قَالَ مَالِكٌ لاَ يَنْبَغِي أَنْ يُشْتَرَى دَيْنٌ عَلَى رَجُلٍ غَائِبٍ وَلاَ حَاضِرٍ إِلاَّ بِإِقْرَارٍ مِنَ الَّذِي عَلَيْهِ الدَّيْنُ وَلاَ عَلَى مَيِّتٍ وَإِنْ عَلِمَ الَّذِي تَرَكَ الْمَيِّتُ وَذَلِكَ أَنَّ اشْتِرَاءَ ذَلِكَ غَرَرٌ لاَ يُدْرَى أَيَتِمُّ أَمْ لاَ يَتِمُّ ‏.‏ قَالَ وَتَفْسِيرُ مَا كُرِهَ مِنْ ذَلِكَ أَنَّهُ إِذَا اشْتَرَى دَيْنًا عَلَى غَائِبٍ أَوْ مَيِّتٍ أَنَّهُ لاَ يُدْرَى مَا يَلْحَقُ الْمَيِّتَ مِنَ الدَّيْنِ الَّذِي لَمْ يُعْلَمْ بِهِ فَإِنْ لَحِقَ الْمَيِّتَ دَيْنٌ ذَهَبَ الثَّمَنُ الَّذِي أَعْطَى الْمُبْتَاعُ بَاطِلاً ‏.‏ قَالَ مَالِكٌ وَفِي ذَلِكَ أَيْضًا عَيْبٌ آخَرُ أَنَّهُ اشْتَرَى شَيْئًا لَيْسَ بِمَضْمُونٍ لَهُ وَإِنْ لَمْ يَتِمَّ ذَهَبَ ثَمَنُهُ بَاطِلاً فَهَذَا غَرَرٌ لاَ يَصْلُحُ ‏.‏ قَالَ مَالِكٌ وَإِنَّمَا فُرِقَ بَيْنَ أَنْ لاَ يَبِيعَ الرَّجُلُ إِلاَّ مَا عِنْدَهُ وَأَنْ يُسَلِّفَ الرَّجُلُ فِي شَىْءٍ لَيْسَ عِنْدَهُ أَصْلُهُ أَنَّ صَاحِبَ الْعِينَةِ إِنَّمَا يَحْمِلُ ذَهَبَهُ الَّتِي يُرِيدُ أَنْ يَبْتَاعَ بِهَا فَيَقُولُ هَذِهِ عَشَرَةُ دَنَانِيرَ فَمَا تُرِيدُ أَنْ أَشْتَرِيَ لَكَ بِهَا فَكَأَنَّهُ يَبِيعُ عَشَرَةَ دَنَانِيرَ نَقْدًا بِخَمْسَةَ عَشَرَ دِينَارًا إِلَى أَجَلٍ فَلِهَذَا كُرِهَ هَذَا وَإِنَّمَا تِلْكَ الدُّخْلَةُ وَالدُّلْسَةُ ‏.‏

Yahya related to me from Malik that he had heard that Marwan ibn al-Hakam decided about a man who had made a vow to abstain from intercourse with his wife, that when four months had passed, it was a divorce and he could return to her as long as she was in her idda.

Malik added, "That was also the opinion of Ibn Shihab."

Malik said that if a man made a vow to abstain from intercourse with his wife and at the end of four months he declared his intent to continue to abstain, he was divorced. He could go back to his wife, but if he did not have intercourse with her before the end of her idda, he had no access to her and he could not go back to her unless he had an excuse - illness, imprisonment, or a similar excuse. His return to her maintained her as his wife. If her idda passed and then he married her after that and did not have intercourse with her until four months had passed and he declared his intent to continue to abstain, divorce was applied to him by the first vow. If four months passed, and he had not returned to her, he had no idda against her nor access because he had married her and then divorced her before touching her.

Malik said that a man who made a vow to abstain from intercourse with his wife and continued to abstain after four months and so divorced her, but then returned and did not touch her and four months were completed before her idda was completed, did not have to declare his intent and divorce did not befall him. If he had intercourse with her before the end of her idda, he was entitled to her. If her idda passed before he had intercourse with her, he had no access to her. This is what Malik preferred of what he had heard on the subject.

Malik said that if a man made a vow to abstain from intercourse with his wife and then divorced her, and the four months of the vow were completed before completion of the idda of the divorce, it counted as two pronouncements of divorce. If he declared his intention to continue to abstain and the idda of the divorce finished before the four months the vow of abstention was not a divorce. That was because the four months had passed and she was not his on that day.

Malik said, "If someone makes a vow not to have intercourse with his wife for a day or a month and then waits until more than four months have passed, it is not ila. Ila only applies to someone who vows more than four months. As for the one who vows not to have intercourse with his wife for four ...

وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ مَرْوَانَ بْنَ الْحَكَمِ، كَانَ يَقْضِي فِي الرَّجُلِ إِذَا آلَى مِنِ امْرَأَتِهِ أَنَّهَا إِذَا مَضَتِ الأَرْبَعَةُ الأَشْهُرِ فَهِيَ تَطْلِيقَةٌ وَلَهُ عَلَيْهَا الرَّجْعَةُ مَا دَامَتْ فِي عِدَّتِهَا ‏.‏ قَالَ مَالِكٌ وَعَلَى ذَلِكَ كَانَ رَأْىُ ابْنِ شِهَابٍ ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يُولِي مِنِ امْرَأَتِهِ فَيُوقَفُ فَيُطَلِّقُ عِنْدَ انْقِضَاءِ الأَرْبَعَةِ الأَشْهُرِ ثُمَّ يُرَاجِعُ امْرَأَتَهُ أَنَّهُ إِنْ لَمْ يُصِبْهَا حَتَّى تَنْقَضِيَ عِدَّتُهَا فَلاَ سَبِيلَ لَهُ إِلَيْهَا وَلاَ رَجْعَةَ لَهُ عَلَيْهَا إِلاَّ أَنْ يَكُونَ لَهُ عُذْرٌ مِنْ مَرَضٍ أَوْ سِجْنٍ أَوْ مَا أَشْبَهَ ذَلِكَ مِنَ الْعُذْرِ فَإِنَّ ارْتِجَاعَهُ إِيَّاهَا ثَابِتٌ عَلَيْهَا فَإِنْ مَضَتْ عِدَّتُهَا ثُمَّ تَزَوَّجَهَا بَعْدَ ذَلِكَ فَإِنَّهُ إِنْ لَمْ يُصِبْهَا حَتَّى تَنْقَضِيَ الأَرْبَعَةُ الأَشْهُرِ وَقَفَ أَيْضًا فَإِنْ لَمْ يَفِئْ دَخَلَ عَلَيْهِ الطَّلاَقُ بِالإِيلاَءِ الأَوَّلِ إِذَا مَضَتِ الأَرْبَعَةُ الأَشْهُرِ وَلَمْ يَكُنْ لَهُ عَلَيْهَا رَجْعَةٌ لأَنَّهُ نَكَحَهَا ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يَمَسَّهَا فَلاَ عِدَّةَ لَهُ عَلَيْهَا وَلاَ رَجْعَةَ ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يُولِي مِنِ امْرَأَتِهِ فَيُوقَفُ بَعْدَ الأَرْبَعَةِ الأَشْهُرِ فَيُطَلِّقُ ثُمَّ يَرْتَجِعُ وَلاَ يَمَسُّهَا فَتَنْقَضِي أَرْبَعَةُ أَشْهُرٍ قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا إِنَّهُ لاَ يُوقَفُ وَلاَ يَقَعُ عَلَيْهِ طَلاَقٌ وَإِنَّهُ إِنْ أَصَابَهَا قَبْلَ أَنْ تَنْقَضِيَ عِدَّتُهَا كَانَ أَحَقَّ بِهَا وَإِنْ مَضَتْ عِدَّتُهَا قَبْلَ أَنْ يُصِيبَهَا فَلاَ سَبِيلَ لَهُ إِلَيْهَا وَهَذَا أَحْسَنُ مَا سَمِعْتُ فِي ذَلِكَ ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يُولِي مِنِ امْرَأَتِهِ ثُمَّ يُطَلِّقُهَا فَتَنْقَضِي الأَرْبَعَةُ الأَشْهُرِ قَبْلَ انْقِضَاءِ عِدَّةِ الطَّلاَقِ قَالَ هُمَا تَطْلِيقَتَانِ إِنْ هُوَ وُقِفَ وَلَمْ يَفِئْ وَإِنْ مَضَتْ عِدَّةُ الطَّلاَقِ قَبْلَ الأَرْبَعَةِ الأَشْهُرِ فَلَيْسَ الإِيلاَءُ بِطَلاَقٍ وَذَلِكَ أَنَّ الأَرْبَعَةَ الأَشْهُرِ الَّتِي كَانَتْ تُوقَفُ بَعْدَهَا مَضَتْ وَلَيْسَتْ لَهُ يَوْمَئِذٍ بِامْرَأَةٍ ‏.‏ قَالَ مَالِكٌ وَمَنْ حَلَفَ أَنْ لاَ يَطَأَ امْرَأَتَهُ يَوْمًا أَوْ شَهْرًا ثُمَّ مَكَثَ حَتَّى يَنْقَضِيَ أَكْثَرُ مِنَ الأَرْبَعَةِ الأَشْهُرِ فَلاَ يَكُونُ ذَلِكَ إِيلاَءً وَإِنَّمَا يُوقَفُ فِي الإِيلاَءِ مَنْ حَلَفَ عَلَى أَكْثَرَ مِنَ الأَرْبَعَةِ الأَشْهُرِ فَأَمَّا مَنْ حَلَفَ أَنْ لاَ يَطَأَ امْرَأَتَهُ أَرْبَعَةَ أَشْهُرٍ أَوْ أَدْنَى مِنْ ذَلِكَ فَلاَ أَرَى عَلَيْهِ إِيلاَءً لأَنَّهُ إِذَا دَخَلَ الأَجَلُ الَّذِي يُوقَفُ عِنْدَهُ خَرَجَ مِنْ يَمِينِهِ وَلَمْ يَكُنْ عَلَيْهِ وَقْفٌ ‏.‏ قَالَ مَالِكٌ مَنْ حَلَفَ لاِمْرَأَتِهِ أَنْ لاَ يَطَأَهَا حَتَّى تَفْطِمَ وَلَدَهَا فَإِنَّ ذَلِكَ لاَ يَكُونُ إِيلاَءً ‏.‏

Anas bin Malik narrated that :
Umm Sulaim came upon the Prophet and said: "Teach me some words that I can say in my Salat." So he said: "Mention Allah's Greatness (saying: Allahu Akbar) ten times, mention Allah's Glory (saying: Subhan Allah) ten times, and mention Allah's praise (saying: Al-Hamdulilah) ten times. Then ask as you like, (for which) He says: 'Yes. Yes.'"
حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ مُوسَى، أَخْبَرَنَا عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ، أَخْبَرَنَا عِكْرِمَةُ بْنُ عَمَّارٍ، حَدَّثَنِي إِسْحَاقُ بْنُ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ، عَنْ أَنَسِ بْنِ مَالِكٍ، أَنَّ أُمَّ سُلَيْمٍ، غَدَتْ عَلَى النَّبِيِّ صلى الله عليه وسلم فَقَالَتْ عَلِّمْنِي كَلِمَاتٍ أَقُولُهُنَّ فِي صَلاَتِي ‏.‏ فَقَالَ ‏"‏ كَبِّرِي اللَّهَ عَشْرًا وَسَبِّحِي اللَّهَ عَشْرًا وَاحْمَدِيهِ عَشْرًا ثُمَّ سَلِي مَا شِئْتِ يَقُولُ نَعَمْ نَعَمْ ‏"‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنِ ابْنِ عَبَّاسٍ وَعَبْدِ اللَّهِ بْنِ عَمْرٍو وَالْفَضْلِ بْنِ عَبَّاسٍ وَأَبِي رَافِعٍ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَنَسٍ حَدِيثٌ حَسَنٌ غَرِيبٌ ‏.‏ وَقَدْ رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم غَيْرُ حَدِيثٍ فِي صَلاَةِ التَّسْبِيحِ وَلاَ يَصِحُّ مِنْهُ كَبِيرُ شَيْءٍ ‏.‏ وَقَدْ رَأَى ابْنُ الْمُبَارَكِ وَغَيْرُ وَاحِدٍ مِنْ أَهْلِ الْعِلْمِ صَلاَةَ التَّسْبِيحِ وَذَكَرُوا الْفَضْلَ فِيهِ ‏.‏ حَدَّثَنَا أَحْمَدُ بْنُ عَبْدَةَ حَدَّثَنَا أَبُو وَهْبٍ قَالَ سَأَلْتُ عَبْدَ اللَّهِ بْنَ الْمُبَارَكِ عَنِ الصَّلاَةِ الَّتِي يُسَبَّحُ فِيهَا فَقَالَ يُكَبِّرُ ثُمَّ يَقُولُ سُبْحَانَكَ اللَّهُمَّ وَبِحَمْدِكَ وَتَبَارَكَ اسْمُكَ وَتَعَالَى جَدُّكَ وَلاَ إِلَهَ غَيْرُكَ ثُمَّ يَقُولُ خَمْسَ عَشْرَةَ مَرَّةً سُبْحَانَ اللَّهِ وَالْحَمْدُ لِلَّهِ وَلاَ إِلَهَ إِلاَّ اللَّهُ وَاللَّهُ أَكْبَرُ ثُمَّ يَتَعَوَّذُ وَيَقْرَأُ ‏(‏بِسمِ الله الرَّحْمَنِ الرَّحِيمِ‏)‏ وَفَاتِحَةَ الْكِتَابِ وَسُورَةً ثُمَّ يَقُولُ عَشْرَ مَرَّاتٍ سُبْحَانَ اللَّهِ وَالْحَمْدُ لِلَّهِ وَلاَ إِلَهَ إِلاَّ اللَّهُ وَاللَّهُ أَكْبَرُ ثُمَّ يَرْكَعُ فَيَقُولُهَا عَشْرًا ‏.‏ ثُمَّ يَرْفَعُ رَأْسَهُ مِنَ الرُّكُوعِ فَيَقُولُهَا عَشْرًا ثُمَّ يَسْجُدُ فَيَقُولُهَا عَشْرًا ثُمَّ يَرْفَعُ رَأْسَهُ فَيَقُولُهَا عَشْرًا ثُمَّ يَسْجُدُ الثَّانِيَةَ فَيَقُولُهَا عَشْرًا يُصَلِّي أَرْبَعَ رَكَعَاتٍ عَلَى هَذَا فَذَلِكَ خَمْسٌ وَسَبْعُونَ تَسْبِيحَةً فِي كُلِّ رَكْعَةٍ يَبْدَأُ فِي كُلِّ رَكْعَةٍ بِخَمْسَ عَشْرَةَ تَسْبِيحَةً ثُمَّ يَقْرَأُ ثُمَّ يُسَبِّحُ عَشْرًا فَإِنْ صَلَّى لَيْلاً فَأَحَبُّ إِلَىَّ أَنْ يُسَلِّمَ فِي الرَّكْعَتَيْنِ وَإِنْ صَلَّى نَهَارًا فَإِنْ شَاءَ سَلَّمَ وَإِنْ شَاءَ لَمْ يُسَلِّمْ ‏.‏ قَالَ أَبُو وَهْبٍ وَأَخْبَرَنِي عَبْدُ الْعَزِيزِ بْنُ أَبِي رِزْمَةَ عَنْ عَبْدِ اللَّهِ أَنَّهُ قَالَ يَبْدَأُ فِي الرُّكُوعِ بِسُبْحَانَ رَبِّيَ الْعَظِيمِ وَفِي السُّجُودِ بِسُبْحَانَ رَبِّيَ الأَعْلَى ثَلاَثًا ثُمَّ يُسَبِّحُ التَّسْبِيحَاتِ ‏.‏ قَالَ أَحْمَدُ بْنُ عَبْدَةَ وَحَدَّثَنَا وَهْبُ بْنُ زَمْعَةَ قَالَ أَخْبَرَنِي عَبْدُ الْعَزِيزِ وَهُوَ ابْنُ أَبِي رِزْمَةَ قَالَ قُلْتُ لِعَبْدِ اللَّهِ بْنِ الْمُبَارَكِ إِنْ سَهَا فِيهَا يُسَبِّحُ فِي سَجْدَتَىِ السَّهْوِ عَشْرًا عَشْرًا قَالَ لاَ إِنَّمَا هِيَ ثَلاَثُمِائَةِ تَسْبِيحَةٍ ‏.‏

I took a letter from Thumamah bin ‘Abd Allah bin Anas. He presumed that Abu Bakr had written it for Anas when he sent him (to Al Bahrain) as a collector of zakat. This (letter) was stamped with the stamp of the Messenger of Allah(saws) and was written by Abu Bakr for him(Anas). This letter goes “This is the obligatory sadaqah(zakat) which the Messenger of Allah(saws) imposed on Muslims which Allah commanded his Prophet(saws) to impose. Those Muslims who are asked for the proper amount must give it, but those who are asked for more than that must not give it. For less than twenty five Camels a goat is to be given for every five Camels. When they reach twenty five to thirty five, a she Camel in her second year is to be given. If there is no she Camel in her second year, a male Camel in its third year is to be given. When they reach thirty six to forty five, a she Camel in her third year is to be given. When they reach forty six to sixty , a she Camel in her fourth year which is ready to be covered by a stallion is to be given. When they reach sixty one to seventy five, a she Camel in her fifth year is to be given. When they reach seventy six to ninety, two she Camel in their third year are to be given. When they reach ninety one to a hundred and twenty, two she Camels in their fourth year are ready to be covered by a stallion are to be given. When they exceed a hundred and twenty, a she Camel in her third year is to be given for every forty and a she Camel in her fourth year for every fifty(Camels). In case the ages of the Camel vary in the payment of obligatory sadaqah(zakat) If anyone whose Camels reach the number on which a she Camel in her fifth year is payable does not possess one but possess one in her fourth year, that will be accepted from him along with two goats if he can conveniently give them, or else twenty dirhams. If anyone whose Camels reach the number on which a she Camel in her fourth year is payable does not possess but possesses one in her fifth year, that will be accepted from him, and the collector must give him twenty dirhams or two goats. If anyone whose Camels reach the number on which a she Camel in her fourth year is payable possesses only one in her third year, that will be accepted from him.”

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا حَمَّادٌ، قَالَ أَخَذْتُ مِنْ ثُمَامَةَ بْنِ عَبْدِ اللَّهِ بْنِ أَنَسٍ كِتَابًا زَعَمَ أَنَّ أَبَا بَكْرٍ، كَتَبَهُ لأَنَسٍ وَعَلَيْهِ خَاتَمُ رَسُولِ اللَّهِ صلى الله عليه وسلم حِينَ بَعَثَهُ مُصَدِّقًا وَكَتَبَهُ لَهُ فَإِذَا فِيهِ ‏"‏ هَذِهِ فَرِيضَةُ الصَّدَقَةِ الَّتِي فَرَضَهَا رَسُولُ اللَّهِ صلى الله عليه وسلم عَلَى الْمُسْلِمِينَ الَّتِي أَمَرَ اللَّهُ عَزَّ وَجَلَّ بِهَا نَبِيَّهُ صلى الله عليه وسلم فَمَنْ سُئِلَهَا مِنَ الْمُسْلِمِينَ عَلَى وَجْهِهَا فَلْيُعْطِهَا وَمَنْ سُئِلَ فَوْقَهَا فَلاَ يُعْطِهِ فِيمَا دُونَ خَمْسٍ وَعِشْرِينَ مِنَ الإِبِلِ الْغَنَمُ فِي كُلِّ خَمْسِ ذَوْدٍ شَاةٌ ‏.‏ فَإِذَا بَلَغَتْ خَمْسًا وَعِشْرِينَ فَفِيهَا بِنْتُ مَخَاضٍ إِلَى أَنْ تَبْلُغَ خَمْسًا وَثَلاَثِينَ فَإِنْ لَمْ يَكُنْ فِيهَا بِنْتُ مَخَاضٍ فَابْنُ لَبُونٍ ذَكَرٌ فَإِذَا بَلَغَتْ سِتًّا وَثَلاَثِينَ فَفِيهَا بِنْتُ لَبُونٍ إِلَى خَمْسٍ وَأَرْبَعِينَ فَإِذَا بَلَغَتْ سِتًّا وَأَرْبَعِينَ فَفِيهَا حِقَّةٌ طَرُوقَةُ الْفَحْلِ إِلَى سِتِّينَ فَإِذَا بَلَغَتْ إِحْدَى وَسِتِّينَ فَفِيهَا جَذَعَةٌ إِلَى خَمْسٍ وَسَبْعِينَ فَإِذَا بَلَغَتْ سِتًّا وَسَبْعِينَ فَفِيهَا ابْنَتَا لَبُونٍ إِلَى تِسْعِينَ فَإِذَا بَلَغَتْ إِحْدَى وَتِسْعِينَ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْفَحْلِ إِلَى عِشْرِينَ وَمِائَةٍ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِي كُلِّ أَرْبَعِينَ بِنْتُ لَبُونٍ وَفِي كُلِّ خَمْسِينَ حِقَّةٌ فَإِذَا تَبَايَنَ أَسْنَانُ الإِبِلِ فِي فَرَائِضِ الصَّدَقَاتِ فَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْجَذَعَةِ وَلَيْسَتْ عِنْدَهُ جَذَعَةٌ وَعِنْدَهُ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ وَأَنْ يَجْعَلَ مَعَهَا شَاتَيْنِ - إِنِ اسْتَيْسَرَتَا لَهُ - أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْحِقَّةِ وَلَيْسَتْ عِنْدَهُ حِقَّةٌ وَعِنْدَهُ جَذَعَةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْحِقَّةِ وَلَيْسَ عِنْدَهُ حِقَّةٌ وَعِنْدَهُ ابْنَةُ لَبُونٍ فَإِنَّهَا تُقْبَلُ مِنْهُ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ مِنْ هَا هُنَا لَمْ أَضْبِطْهُ عَنْ مُوسَى كَمَا أُحِبُّ ‏"‏ وَيَجْعَلُ مَعَهَا شَاتَيْنِ - إِنِ اسْتَيْسَرَتَا لَهُ - أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ بِنْتِ لَبُونٍ وَلَيْسَ عِنْدَهُ إِلاَّ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ ‏"‏ ‏.‏ قَالَ أَبُو دَاوُدَ إِلَى هَا هُنَا ثُمَّ أَتْقَنْتُهُ ‏"‏ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ ابْنَةِ لَبُونٍ وَلَيْسَ عِنْدَهُ إِلاَّ بِنْتُ مَخَاضٍ فَإِنَّهَا تُقْبَلُ مِنْهُ وَشَاتَيْنِ أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ ابْنَةِ مَخَاضٍ وَلَيْسَ عِنْدَهُ إِلاَّ ابْنُ لَبُونٍ ذَكَرٌ فَإِنَّهُ يُقْبَلُ مِنْهُ وَلَيْسَ مَعَهُ شَىْءٌ وَمَنْ لَمْ يَكُنْ عِنْدَهُ إِلاَّ أَرْبَعٌ فَلَيْسَ فِيهَا شَىْءٌ إِلاَّ أَنْ يَشَاءَ رَبُّهَا وَفِي سَائِمَةِ الْغَنَمِ إِذَا كَانَتْ أَرْبَعِينَ فَفِيهَا شَاةٌ إِلَى عِشْرِينَ وَمِائَةٍ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِيهَا شَاتَانِ إِلَى أَنْ تَبْلُغَ مِائَتَيْنِ فَإِذَا زَادَتْ عَلَى مِائَتَيْنِ فَفِيهَا ثَلاَثُ شِيَاهٍ إِلَى أَنْ تَبْلُغَ ثَلاَثَمِائَةٍ فَإِذَا زَادَتْ عَلَى ثَلاَثِمِائَةٍ فَفِي كُلِّ مِائَةِ شَاةٍ شَاةٌ وَلاَ يُؤْخَذُ فِي الصَّدَقَةِ هَرِمَةٌ وَلاَ ذَاتُ عَوَارٍ مِنَ الْغَنَمِ وَلاَ تَيْسُ الْغَنَمِ إِلاَّ أَنْ يَشَاءَ الْمُصَّدِّقُ وَلاَ يُجْمَعُ بَيْنَ مُفْتَرِقٍ وَلاَ يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ فَإِنْ لَمْ تَبْلُغْ سَائِمَةُ الرَّجُلِ أَرْبَعِينَ فَلَيْسَ فِيهَا شَىْءٌ إِلاَّ أَنْ يَشَاءَ رَبُّهَا وَفِي الرِّقَةِ رُبْعُ الْعُشْرِ فَإِنْ لَمْ يَكُنِ الْمَالُ إِلاَّ تِسْعِينَ وَمِائَةً فَلَيْسَ فِيهَا شَىْءٌ إِلاَّ أَنْ يَشَاءَ رَبُّهَا ‏"‏ ‏.‏

It was narrated from Anas bin Malik that Abu Bakar, may Allah be pleased with him, wrote to him:
"This is the obligation of Sadaqah which the Messenger of Allah enjoined upon the Muslims, as Allah commanded the Messenger of Allah Whoever is asked for it in the manner explained (in the letter of Abu Bakar), let him give it, and whoever is asked for more than that, let him not give it. When there are less than twenty-five camels, for every five camels, one sheep (is to be given). If the number reaches twenty-five, then a Bint Makhad (a one-year-old she-camel) is due, up to thirty-five. If a Bint Makhad (a one-year-old male camel). If the number reaches thirty-six, then a Bint Labun (a two-year-old she-camel) is due, up to forty five. If the number reaches forty-six, then a Hiqqah (a three year old she-camel) that was bred by a stallion camel is due, up to sixty. If the number reaches sixty-one, then a Jadh'ah (a four-year-old she-camel) is due, up to seventy-five. If the number reaches seventy-six, then two Bint Labun are due, up to ninety. If the number reaches ninety-one, then two Hiqqahs that have been bred by stallion camels are due, up to one hundred and twenty. If there are more than one hundred and twenty, then for every forty a Bint Labun and for every fifty a Hiqqah. In the event that a person does not have a camel of the age specified according to the Sadaqah regulation, then if a person owes a Jadh'ah but he has a Hiqqah, then the Hiqqah should be accepted from him and he should give two sheep along with it if they are available, or twenty Dirhams. If a person owes a Hiqqah as Sadaqah but he only has a Jadh'ah, then it shold be accepted from him, and the Zakah collector should give him twenty Dirhams or two sheep. If a person owes a Hiqqah and does not have one but he has a Bint Labun, it should be accepted from him, and he should give two sheep along with it, if they are available, or twenty Dirhams. If a person owes a Bint Labun as Sadaqah but he only has a Hiqqah, it should be accepted from him, and the Zakah collector should give him twenty Dirhams or two sheep. If a person owes a Bint Labun as Sadaqah and he does not have a Bint Labun, but he has a Bint Makhad. أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ الْمُبَارَكِ، قَالَ حَدَّثَنَا الْمُظَفَّرُ بْنُ مُدْرِكٍ أَبُو كَامِلٍ، قَالَ حَدَّثَنَا حَمَّادُ بْنُ سَلَمَةَ، قَالَ أَخَذْتُ هَذَا الْكِتَابَ مِنْ ثُمَامَةَ بْنِ عَبْدِ اللَّهِ بْنِ أَنَسِ بْنِ مَالِكٍ عَنْ أَنَسِ بْنِ مَالِكٍ أَنَّ أَبَا بَكْرٍ كَتَبَ لَهُمْ إِنَّ هَذِهِ فَرَائِضُ الصَّدَقَةِ الَّتِي فَرَضَ رَسُولُ اللَّهِ صلى الله عليه وسلم عَلَى الْمُسْلِمِينَ الَّتِي أَمَرَ اللَّهُ عَزَّ وَجَلَّ بِهَا رَسُولَهُ صلى الله عليه وسلم فَمَنْ سُئِلَهَا مِنَ الْمُسْلِمِينَ عَلَى وَجْهِهَا فَلْيُعْطِ وَمَنْ سُئِلَ فَوْقَ ذَلِكَ فَلاَ يُعْطِ فِيمَا دُونَ خَمْسٍ وَعِشْرِينَ مِنَ الإِبِلِ فِي كُلِّ خَمْسِ ذَوْدٍ شَاةٌ فَإِذَا بَلَغَتْ خَمْسًا وَعِشْرِينَ فَفِيهَا بِنْتُ مَخَاضٍ إِلَى خَمْسٍ وَثَلاَثِينَ فَإِنْ لَمْ تَكُنْ بِنْتُ مَخَاضٍ فَابْنُ لَبُونٍ ذَكَرٌ فَإِذَا بَلَغَتْ سِتًّا وَثَلاَثِينَ فَفِيهَا بِنْتُ لَبُونٍ إِلَى خَمْسٍ وَأَرْبَعِينَ فَإِذَا بَلَغَتْ سِتَّةً وَأَرْبَعِينَ فَفِيهَا حِقَّةٌ طَرُوقَةُ الْفَحْلِ إِلَى سِتِّينَ فَإِذَا بَلَغَتْ إِحْدَى وَسِتِّينَ فَفِيهَا جَذَعَةٌ إِلَى خَمْسٍ وَسَبْعِينَ فَإِذَا بَلَغَتْ سِتًّا وَسَبْعِينَ فَفِيهَا بِنْتَا لَبُونٍ إِلَى تِسْعِينَ فَإِذَا بَلَغَتْ إِحْدَى وَتِسْعِينَ فَفِيهَا حِقَّتَانِ طَرُوقَتَا الْفَحْلِ إِلَى عِشْرِينَ وَمِائَةٍ فَإِذَا زَادَتْ عَلَى عِشْرِينَ وَمِائَةٍ فَفِي كُلِّ أَرْبَعِينَ بِنْتُ لَبُونٍ وَفِي كُلِّ خَمْسِينَ حِقَّةٌ فَإِذَا تَبَايَنَ أَسْنَانُ الإِبِلِ فِي فَرَائِضِ الصَّدَقَاتِ فَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْجَذَعَةِ وَلَيْسَتْ عِنْدَهُ جَذَعَةٌ وَعِنْدَهُ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ الْحِقَّةُ وَيَجْعَلُ مَعَهَا شَاتَيْنِ إِنِ اسْتَيْسَرَتَا لَهُ أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْحِقَّةِ وَلَيْسَتْ عِنْدَهُ حِقَّةٌ وَعِنْدَهُ جَذَعَةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ إِنِ اسْتَيْسَرَتَا لَهُ وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ الْحِقَّةِ وَلَيْسَتْ عِنْدَهُ وَعِنْدَهُ بِنْتُ لَبُونٍ فَإِنَّهَا تُقْبَلُ مِنْهُ وَيَجْعَلُ مَعَهَا شَاتَيْنِ إِنِ اسْتَيْسَرَتَا لَهُ أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ ابْنَةِ لَبُونٍ وَلَيْسَتْ عِنْدَهُ إِلاَّ حِقَّةٌ فَإِنَّهَا تُقْبَلُ مِنْهُ وَيُعْطِيهِ الْمُصَدِّقُ عِشْرِينَ دِرْهَمًا أَوْ شَاتَيْنِ وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ ابْنَةِ لَبُونٍ وَلَيْسَتْ عِنْدَهُ بِنْتُ لَبُونٍ وَعِنْدَهُ بِنْتُ مَخَاضٍ فَإِنَّهَا تُقْبَلُ مِنْهُ وَيَجْعَلُ مَعَهَا شَاتَيْنِ إِنِ اسْتَيْسَرَتَا لَهُ أَوْ عِشْرِينَ دِرْهَمًا وَمَنْ بَلَغَتْ عِنْدَهُ صَدَقَةُ ابْنَةِ مَخَاضٍ وَلَيْسَ عِنْدَهُ إِلاَّ ابْنُ لَبُونٍ ذَكَرٌ فَإِنَّهُ يُقْبَلُ مِنْهُ وَلَيْسَ مَعَهُ شَىْءٌ وَمَنْ لَمْ يَكُنْ عِنْدَهُ إِلاَّ أَرْبَعٌ مِنَ الإِبِلِ فَلَيْسَ فِيهَا شَىْءٌ إِلاَّ أَنْ يَشَاءَ رَبُّهَا وَفِي صَدَقَةِ الْغَنَمِ فِي سَائِمَتِهَا إِذَا كَانَتْ أَرْبَعِينَ فَفِيهَا شَاةٌ إِلَى عِشْرِينَ وَمِائَةٍ فَإِذَا زَادَتْ وَاحِدَةٌ فَفِيهَا شَاتَانِ إِلَى مِائَتَيْنِ فَإِذَا زَادَتْ وَاحِدَةٌ فَفِيهَا ثَلاَثُ شِيَاهٍ إِلَى ثَلاَثِمِائَةٍ فَإِذَا زَادَتْ فَفِي كُلِّ مِائَةٍ شَاةٌ وَلاَ يُؤْخَذُ فِي الصَّدَقَةِ هَرِمَةٌ وَلاَ ذَاتُ عَوَارٍ وَلاَ تَيْسُ الْغَنَمِ إِلاَّ أَنْ يَشَاءَ الْمُصَّدِّقُ وَلاَ يُجْمَعُ بَيْنَ مُتَفَرِّقٍ وَلاَ يُفَرَّقُ بَيْنَ مُجْتَمِعٍ خَشْيَةَ الصَّدَقَةِ وَمَا كَانَ مِنْ خَلِيطَيْنِ فَإِنَّهُمَا يَتَرَاجَعَانِ بَيْنَهُمَا بِالسَّوِيَّةِ فَإِذَا كَانَتْ سَائِمَةُ الرَّجُلِ نَاقِصَةً مِنْ أَرْبَعِينَ شَاةٌ وَاحِدَةٌ فَلَيْسَ فِيهَا شَىْءٌ إِلاَّ أَنْ يَشَاءَ رَبُّهَا وَفِي الرِّقَةِ رُبُعُ الْعُشْرِ فَإِنْ لَمْ تَكُنْ إِلاَّ تِسْعِينَ وَمِائَةَ دِرْهَمٍ فَلَيْسَ فِيهَا شَىْءٌ إِلاَّ أَنْ يَشَاءَ رَبُّهَا ‏"‏ ‏.‏

Ibn ‘Abbas reported the Prophet as saying, “If anyone neglects the Friday prayer except in case of necessity, he will be inscribed as a hypocrite in a book which will not be obliterated or changed.” Some versions have “three times."* *Meaning that the Prophet said these words three times. Shafi‘i transmitted it.

He was asked about a man who divorces his wife, then takes her back without taking witnesses (on either). So he replied, "Get witnesses on her divorce, and on her return." [Abu Dawud reported it Mawquf (saying of a Companion), and its chain of narrators is Sahih (authentic)].

Allāhumma aslamtu nafsī ilayk, wa fawwaḍtu amrī ilayk, wa wajjahtu wajhī ilayk, wa alja'tu ẓahrī ilayk, raghbatan wa rahbatan ilayk, lā malja'a wa la manjā minka illā ilayk, āmantu bikitābika ‘l-ladhī anzalt, wa bi-nabiyyika ‘l-ladhī arsalt. O Allah,1 I submit myself to You, entrust my affairs to You, turn my face to You, and lay myself down depending upon You, hoping in You and fearing You. There is no refuge, and no escape, except to You. I believe in Your Book (the Qur'an) that You revealed, and the Prophet whom You sent. Allah's Messenger (SAW) said:
"O Abdullah bin Qais, should I not point you to one of the treasures of Paradise?" I said, "Yes, O Messenger of Allah." So he told me to say: Lā ḥawla wa lā quwwata 'illā billāh. Allah's Messenger (SAW) said: "O Abdullah bin Qais, should I not point you to one of the treasures of Paradise?" I said, "Yes, O Messenger of Allah." وَقَالَ صلى الله عليه وسلم: يَا عَبْدَ اللَّهِ بْنَ قَيْسٍ أَلاَ أَدُلُّكَ عَلَى كَنْزٍ مِنْ كُنُوزِ الْجَنَّةِ؟ فَقُلْتُ: بَلَى يَا رَسُولَ اللَّهِ، قَالَ: قُلْ (لاَ حَوْلَ وَلاَ قُوَّةَ إِلاَّ بِاللَّهِ).

Thauban reported God’s messenger as saying, “Keep to the straight path, which you will not be able to do, know that your best action is prayer and that only a believer observes ablution carefully." Malik, Ahmad, Ibn Majah and Darimi transmitted it.

Abu Huraira reported God’s Messenger as saying, “A woman without a husband* must not be married till she is consulted, and a virgin must not be married till her permission is asked.” When asked how her permission was indicated he replied that it was by her saying nothing. * Ayyim. This means a woman who has no husband. It may mean a woman who has not been married, whether a virgin or not, or a woman previously married who has no husband. See n. 2. (Bukhari and Muslim.)

Anas reported Allah's Messenger (may peace be upon him) as saying:

There is no transitive disease, no divination, but good omen pleases me, i. e. the good word or a good word.

-- The Prophet (SAW) said Allāhu Akbar (Allah is the Most Great) with each pebble he threw at the three pillars. Then he went forward, stood facing the Qiblah, and raised his hands and called upon Allah. That was after (stoning) the first and second pillars. As for the third, he stoned it and called out Allāhu Akbar with every pebble he threw, but when he was finished he left without standing at it (for supplications). Reference: Al-Bukhari, cf. Ibn Mas'ud reported God’s messenger as saying, “Do not cleanse yourselves with excrement or bones, for that is the provision of your brethren among the jinn.” Tirmidhi transmitted it, as also Nasa'i, but he did not mention “the provision of your brethren among the jinn.”

Abu Huraira reported God’s messenger as saying, “It is not allowable for a woman to fast when her husband is present without his permission,* and she may not allow anyone to enter his house without his permission.” *This refers not to Ramadan, but to a supererogatory fast. Muslim transmitted it.
