Sahih al-Bukhari 6947

Narrated Jabir:

A man from the Ansar made his slave, a Mudabbar. And apart from that slave he did not have any other property. This news reached Allah's Apostle and he said, "Who will buy that slave from me?" So Nu'aim bin An-Nahham bought him for 800 Dirham. Jabir added: It was a coptic (Egyptian) slave who died that year.

حَدَّثَنَا أَبُو النُّعْمَانِ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ جَابِرٍ ـ رضى الله عنه ـ أَنَّ رَجُلاً، مِنَ الأَنْصَارِ دَبَّرَ مَمْلُوكًا، وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ، فَبَلَغَ ذَلِكَ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقَالَ ‏ "‏ مَنْ يَشْتَرِيهِ مِنِّي ‏"‏‏.‏ فَاشْتَرَاهُ نُعَيْمُ بْنُ النَّحَّامِ بِثَمَانِمِائَةِ دِرْهَمٍ‏.‏ قَالَ فَسَمِعْتُ جَابِرًا يَقُولُ عَبْدًا قِبْطِيًّا مَاتَ عَامَ أَوَّلَ‏.‏

Asma' reported:

I performed the household duties of Zubair and he had a horse; I used to look after it. Nothing was more burdensome for me than looking after the horse I used to bring grass for it and looked after it, then I got a servant as Allah's Apustle (may peace be upon him) had some prisoners of war in his possession. He gave me a female servant. She (the female servant) then began to look after the horse and thus relieved me of this burden. A person came and he said: Mother of 'Abdullah, I am a destitute person and I intend that I should start business under the shadow of your house. I (Asma') said: If I grant you permission, Zubair may not agree to that, so you come and make a demand of it when Zubair is also present there. He came accordingly find said: Mother of 'Abdullah. I am a destitute person. I intend to start t mall business in the shadow of your house. I said: Is there not in Medina (any place for starting the business) except my house? Zubair said: Why is it that you prohibit the destitute man to start business here? So he started business and he (earned so much) that we sold our slave-girl to him There came Zubair to me while the money was in my lap. He said: Give this to me. I said: (I intend) to spend it as charity.
حَدَّثَنَا مُحَمَّدُ بْنُ عُبَيْدٍ الْغُبَرِيُّ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَيُّوبَ، عَنِ ابْنِ أَبِي مُلَيْكَةَ، أَنَّ أَسْمَاءَ، قَالَتْ كُنْتُ أَخْدُمُ الزُّبَيْرَ خِدْمَةَ الْبَيْتِ وَكَانَ لَهُ فَرَسٌ وَكُنْتُ أَسُوسُهُ فَلَمْ يَكُنْ مِنَ الْخِدْمَةِ شَىْءٌ أَشَدَّ عَلَىَّ مِنْ سِيَاسَةِ الْفَرَسِ كُنْتُ أَحْتَشُّ لَهُ وَأَقُومُ عَلَيْهِ وَأَسُوسُهُ ‏.‏ قَالَ ثُمَّ إِنَّهَا أَصَابَتْ خَادِمًا جَاءَ النَّبِيَّ صلى الله عليه وسلم سَبْىٌ فَأَعْطَاهَا خَادِمًا ‏.‏ قَالَتْ كَفَتْنِي سِيَاسَةَ الْفَرَسِ فَأَلْقَتْ عَنِّي مَئُونَتَهُ فَجَاءَنِي رَجُلٌ فَقَالَ يَا أُمَّ عَبْدِ اللَّهِ إِنِّي رَجُلٌ فَقِيرٌ أَرَدْتُ أَنْ أَبِيعَ فِي ظِلِّ دَارِكِ ‏.‏ قَالَتْ إِنِّي إِنْ رَخَّصْتُ لَكَ أَبَى ذَاكَ الزُّبَيْرُ فَتَعَالَ فَاطْلُبْ إِلَىَّ وَالزُّبَيْرُ شَاهِدٌ فَجَاءَ فَقَالَ يَا أُمَّ عَبْدِ اللَّهِ إِنِّي رَجُلٌ فَقِيرٌ أَرَدْتُ أَنْ أَبِيعَ فِي ظِلِّ دَارِكِ ‏.‏ فَقَالَتْ مَا لَكَ بِالْمَدِينَةِ إِلاَّ دَارِي فَقَالَ لَهَا الزُّبَيْرُ مَا لَكِ أَنْ تَمْنَعِي رَجُلاً فَقِيرًا يَبِيعُ فَكَانَ يَبِيعُ إِلَى أَنْ كَسَبَ فَبِعْتُهُ الْجَارِيَةَ فَدَخَلَ عَلَىَّ الزُّبَيْرُ وَثَمَنُهَا فِي حَجْرِي ‏.‏ فَقَالَ هَبِيهَا لِي ‏.‏ قَالَتْ إِنِّي قَدْ تَصَدَّقْتُ بِهَا ‏.‏

Sunan an-Nasa'i 4736
It was narrated from Samurah that the Messenger of Allah said:
"Whoever kills his slave, we will kill him: whoever mutilates (his slave). We will mutilate him, and whoever castrates (his slave), we will castrate him."
أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلاَنَ، - هُوَ الْمَرْوَزِيُّ - قَالَ حَدَّثَنَا أَبُو دَاوُدَ الطَّيَالِسِيُّ، قَالَ حَدَّثَنَا هِشَامٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَهُ جَدَعْنَاهُ وَمَنْ أَخْصَاهُ أَخْصَيْنَاهُ ‏"‏ ‏.‏

Yahya related to me from Malik that Yahya ibn Said said that Abu Bakr ibn Muhammad ibn Amr ibn Hazm informed him that he had taken a Nabatean who had stolen some iron rings and jailed him in order to cut off his hand. Amra bint Abd ar-Rahman sent a girl mawla to him called Umayya. Abu Bakr said that she had come to him while he was among the people and said that his aunt Amra sent word to him saying, "Son of my brother! You have taken a Nabatean for something insignificant which was mentioned to me. Do you want to cut off his hand?" He had said, "Yes." She said, ''Amra says to you not to cut off the hand except for a quarter of a dinar and upwards."

Abu Bakr added, "So I let the Nabatean go."

Malik said, "The generally agreed on way of doing things among us about the confession of slaves is that if a slave confesses something against himself, the hadd and punishment for it is inflicted on his body. His confession is accepted from him and one does not suspect that he would inflict something on himself."

Malik said, "As for the one of them who confesses to a matter which will incur damages agains this master, his confession is not accepted against his master."

Malik said, "One does not cut off the hand of a hireling or a man who is with some people to serve them, if he robs them, because his state is not the state of a thief. His state is the state of a treacherous one. The treacherous one does not have his hand cut off."

Malik said about a person who borrows something and then denies it, "His hand is not cut off. He is like a man who owes a debt to another man and denies it. He does not have his hand cut off for what he has denied."

Malik said, "The generally agreed-on way of dealing among us, with the thief who is found in a house and has gathered up goods and has not taken them out, is that his hand is not cut off. That is like the man who places wine before him to drink it and does not do it. The hadd is not imposed on him. That is like a man who sits with a woman and desires to have haram intercourse with her and does not do it and he does not reach her. There is no hadd against that either."

Malik said, "The generally agreed-on way of doing things among us is that there is no cutting off the hand for what is taken by chance, openly and in haste, whether or not its price reaches that for which the hand is cut off."

Yahya related to me from Malik from Hisham ibn Urwa that his father said that a man who pronounced a dhihar from his four wives in one statement, had only to do one kaffara. Yahya related the same as that to me from Malik from Rabia ibn Abi Abd ar-Rahman.

Malik said, "That is what is done among us. Allah, the Exalted said about the kaffara for pronouncing dhihar, 'It is to free a slave before they touch one another. If he does not find the means to do that, then fasting for two consecutive months before they touch one another. If he cannot do that, it is to feed sixty poor people. ' " (Sura 58 ayats 4,5).

Malik said that a man who pronounced dhihar from his wife on various occasions had only to do one kaffara. If he pronounced dhihar, and then did kaffara, and then pronounced dhihar after he had done the kaffara, he had to do kaffara again.

Malik said, "Some one who pronounces dhihar from his wife and then has intercourse with her before he has done kaffara, only has to do one kaffara. He must abstain from her until he does kaffara and ask forgiveness of Allah. That is the best of what I have heard. "

Malik said, "It is the same with dhihar using any prohibited relations of fosterage and ancestry."

Malik said, "Women have no dhihar."

Malik said that he had heard that the commentary on the word of Allah, the Blessed, the Exalted, "Those of you who pronounce the dhihar about their wives, and then retract what they have said," (Sura 56 ayat 3), was that a man pronounced dhihar on his wife and then decided to keep her and have intercourse with her. If he decided on that, he must do kaffara. If he divorced her and did not decide to retract his dhihar of her and to keep her and have intercourse with her, there would be no kaffara incumbent on him.

Maliksaid, "If he marries her after that, he does not touch her until he has completed the kaffara of pronouncing dhihar."

Malik said that if a man who pronounced dhihar from his slave-girl wanted to have intercourse with her, he had to do the kaffara of the dhihar before he could sleep with her.

Malik said, "There is no ila in a man's dhihar unless it is evident that he does not intend to retract his dhihar."

It was narrated from Ibn `Umar (رضي الله عنه) that the Messenger of Allah (ﷺ) said:
“If a person frees his share of a slave, and has enough Money to pay the full price of the slave, a fair price should be worked out for the slave, and his partners should be given their shares, then he may free the slave, otherwise he has freed only what he has freed.”

Narrated Ibn `Umar:

Allah's Apostle said, "Whoever manumits his share of a slave, then it is essential for him to get that slave manumitted' completely as long as he has the money to do so. If he has not sufficient money to pay the price of the other shares (after the price of the slave is evaluated justly), the manumitted manumits the slave partially in proportion to his share.

`Ubaidullah narrated as above in brief.

حَدَّثَنَا عُبَيْدُ بْنُ إِسْمَاعِيلَ، عَنْ أَبِي أُسَامَةَ، عَنْ عُبَيْدِ اللَّهِ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ مَنْ أَعْتَقَ شِرْكًا لَهُ فِي مَمْلُوكٍ فَعَلَيْهِ عِتْقُهُ كُلِّهِ، إِنْ كَانَ لَهُ مَالٌ يَبْلُغُ ثَمَنَهُ، فَإِنْ لَمْ يَكُنْ لَهُ يُقَوَّمُ عَلَيْهِ قِيمَةَ عَدْلٍ، فَأُعْتِقَ مِنْهُ مَا أَعْتَقَ ‏"‏‏.‏

'Amra reported that 'A'isha had made one of her slavegirls a mudabbar (one who would be set free after her death). Then 'A'isha became ill and her nephews consulted a gypsy doctor. He said, "You are asking me for information about a bewitched woman. A slavegirl of hers has bewitched her." 'A'isha was told and asked the girl, "Have you put a spell on me?" "Yes," she replied. "Why?' she asked. "Because you will never free me," she answered. Then 'A'isha said, "Sell her to the worst masters among the Arabs."

It was narrated from 'Amr bin Sulaim Az-Zuraqi that he heard Abu Qatadah say:
"While we were sitting in the Masjid. The Messenger of Allah (PBUH) came out to us carrying Umamah bint Abi Al-'As bin Ar-Rabi', whose mother was Zainab, the daughter of the Messenger of Allah (PBUH). She was a little girl and he was carrying her. The Messenger of Allah (PBUH) prayed with her on his shoulder, putting her down when he bowed and picking her up again when he stood up, until he completed his prayer."
أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا اللَّيْثُ، عَنْ سَعِيدِ بْنِ أَبِي سَعِيدٍ، عَنْ عَمْرِو بْنِ سُلَيْمٍ الزُّرَقِيِّ، أَنَّهُ سَمِعَ أَبَا قَتَادَةَ، يَقُولُ بَيْنَا نَحْنُ جُلُوسٌ فِي الْمَسْجِدِ إِذْ خَرَجَ عَلَيْنَا رَسُولُ اللَّهِ صلى الله عليه وسلم يَحْمِلُ أُمَامَةَ بِنْتَ أَبِي الْعَاصِ بْنِ الرَّبِيعِ وَأُمُّهَا زَيْنَبُ بِنْتُ رَسُولِ اللَّهِ صلى الله عليه وسلم وَهِيَ صَبِيَّةٌ يَحْمِلُهَا فَصَلَّى رَسُولُ اللَّهِ صلى الله عليه وسلم وَهِيَ عَلَى عَاتِقِهِ يَضَعُهَا إِذَا رَكَعَ وَيُعِيدُهَا إِذَا قَامَ حَتَّى قَضَى صَلاَتَهُ يَفْعَلُ ذَلِكَ بِهَا ‏.‏

Jabir bin Abdullah narrated:
"I married a woman and went to the Prophet, he said: 'O Jabir! Have you married?' I said: 'Yes.' He said: 'A virgin or a matron?' I said: 'A matron.' He said: 'Why didn't you marry a young girl, so that you may play with her and she with you?' I said: 'O Messenger of Allah! Abdullah (his father) died and left behind seven - or nine - daughter, so I have brought someone who can look after them.'" (He said:) "So he supplicated for me."

Narrated Anas:
that a girl went out in Al-Madinah wearing some silver ornaments. A Jew grabbed her and fractured her head with a stone, and he took the jewelry she had on. He said: "She was found with some spark of life in her, and was brought to the Prophet (saws) and he said: 'Did such and such person strike you?' She nodded 'no' with her head. He said: 'Such and such?' until he named the Jew and she nodded 'yes' with her head." He said: "He was brought and recognized so the Messenger of Allah (saws) ordered that his head be crushed between two stones."

Mishkat al-Masabih 2815
Jabir told that a slave came and swore allegiance to the Prophet promising to emigrate, but he did not know that he was a slave. When his master came in search of him the Prophet said to him, ‘Sell him to me," and he bought him for two black slaves. Afterwards he never took an oath of allegiance from anyone without asking him whether he was a slave or free. Muslim transmitted it.
وَعَنْ جَابِرٍ قَالَ: جَاءَ عَبْدٌ فَبَايَعَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَلَى الْهِجْرَةِ وَلَمْ يَشْعُرْ أَنَّهُ عَبْدٌ فَجَاءَ سَيِّدُهُ يُرِيدُهُ فَقَالَ لَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ «بِعَيْنِه» فَاشْتَرَاهُ بِعَبْدَيْنِ أَسْوَدَيْنِ وَلَمْ يُبَايِعْ أَحَدًا بَعْدَهُ حَتَّى يَسْأَلَهُ أَعَبْدٌ هُوَ أَوْ حُرٌّ. رَوَاهُ مُسلم

Muhammad bin Abd Allah bin Quhzādh narrated to me, he said I heard Abd Allah bin Uthmān bin Jabalah saying, I said to Abd Allah bin al-Mubārak:
‘Who is this man from whom you transmit the Ḥadīth of Abd Allah bin Amr, ‘The day of Fitr is the day of prizes…’?’ [Abd Allah] said: ‘Sulaymān bin al-Hajjāj. Look at what I placed in your hands [of praise] about him’.

Ibn Quhzādh said I heard Wahb bin Zam’ah mentioning about Sufyān bin Abd il-Mālik, he said, Abd Allah –meaning Ibn al-Mubārak- said: ‘I saw Rawh bin Ghutayf, the companion of blood the amount of a Dirham , and I took a seat in one of his audiences. Then I began to become ashamed for my companions to see me sitting with him while his Ḥadīth are disapproved of.’

قَالَ ابْنُ قُهْزَاذَ وَسَمِعْتُ وَهْبَ بْنَ زَمْعَةَ، يَذْكُرُ عَنْ سُفْيَانَ بْنِ عَبْدِ الْمَلِكِ، قَالَ قَالَ عَبْدُ اللَّهِ يَعْنِي ابْنَ الْمُبَارَكِ رَأَيْتُ رَوْحَ بْنَ غُطَيْفٍ صَاحِبَ ‏"‏ الدَّمِ قَدْرِ الدِّرْهَمِ ‏"‏ وَجَلَسْتُ إِلَيْهِ مَجْلِسًا فَجَعَلْتُ أَسْتَحْيِي مِنْ أَصْحَابِي أَنْ يَرَوْنِي جَالِسًا مَعَهُ كُرْهَ حَدِيثِهِ ‏.‏

I heard Abu-l-Qasim (the Prophet) saying, "If somebody slanders his slave and the slave is free from what he says, he will be flogged on the Day of Resurrection unless the slave is really as he has described him."

The Prophet came to know that one of his companions had given the promise of freeing his slave after his death, but as he had no other property than that slave, the Prophet sold that slave for 800 dirhams and sent the price to him.

Narrated Jabir bin `Abdullah:

A man pledged that his slave would be manumitted after his death. The Prophet asked, "Who will buy the slave from me?" Nu'aim bin `Abdullah bought the slave and the Prophet took its price and gave it to the owner.

It was narrated that Jabir said:
“A slave came and gave his pledge to the Prophet (saw), pledging to emigrate, and the Prophet (saw) did not realize that he was a slave. Then his master came looking for him, and the Prophet (saw) said: ‘Sell him to me,’ and he brought him in exchange for two black slaves. Then after that he did not accept the pledge from anyone until he had asked whether he was a slave.”

Yahya related to me that Malik said, "A man does not have to pay zakat for the slaves of his slaves, or for some one employed by him, or for his wife's slaves, except for anyone who serves him and whose services are indispensable to him, in which case he must pay zakat. He does not have to pay zakat for any of his slaves that are kafir and have not become muslim, whether they be for trade or otherwise."

Narrated Abu Hurairah:
"The Messenger of Allah (saws) judged that a Ghurrah male slave or female slave be given in the case of a fetus. The one of the judgement was made against said: 'Should we give something for one who did not drink, not eat, nor cry out to shed a tear, the likes of which is useless?' So the Prophet (saws) said: 'This is the speech of a poet. Rather it requires a Ghurrah: a male slave or a female slave.'"

Malik said, "A master who frees a slave of his and settles his emancipation so that his testimony is permitted, his inviolability complete, and his right to inherit confirmed, cannot impose stipulations on him like what he imposes on a slave about property or service, nor get him to do anything of slavery, because the Messenger of Allah, may Allah bless him and grant him peace, said, "If a man frees his share of a slave and has enough money to cover the full price of the slave justly evaluated for him, he must give his partners their shares so the slave is completely free."

Malik commented, "If he owns the slave completely, it is more proper to free him completely and not mingle any slavery with it."

Abu Hurairah (RAA) narrated that the Messenger of Allah (P.B.U.H.) said, “Cursed is he, who is the slave of the Dinar, the slave of the Dirham, and the slave of the cloak bordered with silk. If he is given anything he would be satisfied, but if he is not given anything he is displeased.” Related by Al-Bukhari.

‘Abd ar-Rahman b. Abu ‘Amra al-Ansari told that his mother had intended to emancipate a slave, but she postponed it till the morning, and she died. ‘Abd ar-Rahman said he asked al-Qasim b. Muhammad whether it would benefit her if he emancipated the slave on her behalf, and al-Qasim told him that Sa'd b. ‘Ubada had gone to God’s Messenger saying his mother had died and asking whether it would benefit her if he set free a slave on her behalf, and that God’s Messenger had replied that it would. Malik transmitted it.
عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَمْرَةَ الْأَنْصَارِيِّ: أَنَّ أُمَّهُ أَرَادَتْ أَنْ تَعْتِقَ فَأَخَّرَتْ ذَلِكَ إِلَى أَنْ تُصْبِحَ فَمَاتَتْ قَالَ عَبْدُ الرَّحْمَنِ: فَقُلْتُ لِلْقَاسِمِ بْنِ مُحَمَّدٍ: أَيَنْفَعُهَا أَنْ أَعْتِقَ عَنْهَا؟ فَقَالَ الْقَاسِمُ: أَتَى سَعْدُ بْنُ عُبَادَةَ رَسُول الله صلى الله عَلَيْهِ وَسلم فَقَالَ: " إِنَّ أُمِّي هَلَكَتْ فَهَلْ يَنْفَعُهَا أَنْ أَعْتِقَ عَنْهَا؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «نعم» . رَوَاهُ مَالك

Yahya said that he heard Malik say, "The sunna with us about the crime of slaves is that the hand is not cut off for any harm that a slave causes a man, or something he pilfers, or something guarded which he steals, or hanging dates he cuts down or ruins, or steals. That is against the slave's person and does not exceed the price of the slave whether it is little or much. If his master wishes to give the value of what the slave took or ruined, or pay the blood-price for the injury, he pays it and keeps his slave. If he wishes to surrender him, he surrenders him, and none of that is against him. The master has the option in that."

Narrated 'Urwa:

that he asked `Aisha regarding the Verse: 'If you fear that you shall not be able to deal justly with the orphans (4.3) She said, "O my nephew! This Verse refers to the orphan girl who is under the guardianship of her guardian who likes her beauty and wealth and wishes to (marry her and) curtails her Mahr. Such guardians have been forbidden to marry them unless they do justice by giving them their full Mahr, and they have been ordered to marry other than them. The people asked for the verdict of Allah's Apostle after that, so Allah revealed: 'They ask your instruction concerning the women . . . whom you desire to marry.' (4.127) So Allah revealed to them that if the orphan girl had beauty and wealth, they desired to marry her and for her family status. They can only marry them if they give them their full Mahr. And if they had no desire to marry them because of their lack of wealth and beauty, they would leave them and marry other women. So, as they used to leave them, when they had no interest, in them, they were forbidden to marry them when they had such interest, unless they treated them justly and gave them their full Mahr Apostle said, 'If at all there is evil omen, it is in the horse, the woman and the house." a lady is to be warded off. And the Statement of Allah: 'Truly, among your wives and your children, there are enemies for you (i.e may stop you from the obedience of Allah)' (64.14)

Narrated Az-Zuhri:

`Urwa bin Az-Zubair said that he asked `Aisha about the meaning of the Qur'anic Verse:-- "And if you fear that you will not deal fairly with the orphan girls then marry (other) women of your choice." (4.2-3) Aisha said, "It is about a female orphan under the guardianship of her guardian who is inclined towards her because of her beauty and wealth, and likes to marry her with a Mahr less than what is given to women of her standard. So they (i.e. guardians) were forbidden to marry the orphans unless they paid them a full appropriate Mahr (otherwise) they were ordered to marry other women instead of them. Later on the people asked Allah's Apostle about it. So Allah revealed the following Verse:-- "They ask your instruction (O Muhammad!) regarding women. Say: Allah instructs you regarding them..." (4.127) and in this Verse Allah indicated that if the orphan girl was beautiful and wealthy, her guardian would have the desire to marry her without giving her an appropriate Mahr equal to what her peers could get, but if she was undesirable for lack of beauty or wealth, then he would not marry her, but seek to marry some other woman instead of her. So, since he did not marry her when he had no inclination towards her, he had not the right to marry her when he had an interest in her, unless he treated her justly by giving her a full Mahr and securing all her rights.

Malik related to me that he had heard that Marwan ibn al-Hakam gave a decision about a slave who was injured that the person who injured him had to pay what he had diminished of the value of the slave.

Malik said, "What is done in our community is that for the head wound of a slave that bares the bone, there is a twentieth of his price. The head wound which splinters the bone is three twentieths of his price. Both the wound to the brain and the belly wound are a third of his price. Besides these four, any other types of injury that decrease the price of the slave are considered after the slave is better and well, and one sees what the value of the slave is after his injury and what his value whole was before he had the injury. Then the one who injured him pays the difference between the two values."

Yahya related to me from Malik from Abd ar-Rahman ibn al-Qasim from his father that A'isha, the wife of the Prophet, may Allah bless him and grant him peace, gave Hafsa bint Abd arRahman in marriage to al-Mundhir ibn az-Zubayr while Abd ar-Rahman was away in Syria. When Abd ar-Rahman arrived, he said, "Shall someone like me have this done to him? Am I the kind of man to have something done to him without his consent?" A'isha spoke to al-Mundhir ibn az-Zubayr, and al-Mundhir said, "It is in the hands of Abd ar-Rahman." Abd ar-Rahman said, "I won't oppose something that you have already completed." Hafsa was confirmed with al-Mundhir, and there was no divorce.

Abu As-Sa'ib- the freed slave of Hisham bin Zuhrah-said:
"I heard Abu Hurairah say: 'The Messenger of Allah (SAW) said: "Whoever offers a prayer in which he does not recite Umm Al-Quran (Al Fatihah), it is deficient, it is deficient, it is deficient, incomplete." I (Abu As-Sa'ib) said: 'O Abu Hurairah, sometimes I am behind the Imam.' He poked me in the arm and said: 'Recite it to yourself, O Persian! For I heard the Messenger of Allah (SAW) say: "Allah says: "I have divided prayer between Myself and My slave into two halves, and My slave shall have what he has asked for.'" The Messenger of Allah (SAW) said: "Recite, for when the slave says: All the praises and thanks be to Allah, the Lord of all that exists, Allah says: 'My slave has praised Me.' And when he says: The Most Gracious, the Most Merciful, Allah says: 'My slave has extolled Me.' And when he says: The Only Owner (and the Only Ruling Judge) of the Day of Recompense (i.e. the Day of Resurrection), Allah says: 'My slave has glorified Me' . And when he says: You (alone) we worship, and You (alone) we ask for help (for each and everything), He says: 'This is between Me and My slave, and My slave shall have what he has asked for.' And when he says: 'Guide us to the straight way, the way of those on whom You have bestowed Your grace, not (the way) of those who earned Your anger, nor of those who went astray, He says: 'This is for My slave, and My slave shall have what he asked for.'"

'A'isha bint Talha said, "I spoke to 'A'isha when I was under her protection. people used to visit her from all places. Shaykhs used visit me because of my place with her. Young men used to treat me as a sister and give me presents and write to me from their cities. I said to 'A'isha, 'Aunt, this is a letter from so-and-so and his gift.' 'A'isha told me, 'My girl, answer him and reward him. If you do not have anything to give, I will give you something.' She told her to give it to her."

Ibn ‘Abbas said:
‘A’isha gave a woman relative of hers among the Ansar in marriage and God’s Messenger came and said, “Have you escorted the girl to her husband?” On being told that they had, he asked whether they had sent someone along with her to sing, and when she replied that they had not, he said, “The Ansar are a people who give a place to love songs. I wish you had sent with her someone to say, ‘We have come to you, we have come to you; so may God preserve us and preserve you’.” Ibn Majah transmitted it.
وَعَن ابْن عَبَّاس قَالَ: أنكحت عَائِشَة ذَات قَرَابَةٍ لَهَا مِنَ الْأَنْصَارِ فَجَاءَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «أَهَدَيْتُمُ الْفَتَاةَ؟» قَالُوا: نعم قَالَ: «أرسلتم مَعهَا من تغني؟» قَالَتْ: لَا فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " إِنَّ الْأَنْصَارَ قَوْمٌ فِيهِمْ غَزَلٌ فَلَوْ بَعَثْتُمْ مَعَهَا مَنْ يَقُولُ: أَتَيْنَاكُمْ أَتَيْنَاكُمْ فحيانا وحياكم ". رَوَاهُ ابْن مَاجَه

Judama daughter of Wahb said:
I was with God’s Messenger along with some people when he was saying, “I intended to prohibit suckling during pregnancy* but I considered the Greeks and the Persians and saw that they suckled their children during pregnancy without any injury being caused to their children thereby.” Then they asked him about withdrawing the penis and God’s Messenger replied, “That is the secret burying alive” and reference is made to it in the words, “When the girl buried alive will be asked (Al-Qur’an 81:8).” *(Ghila. It means either suckling during pregnancy, or intercourse with a woman while she is suckling a child. Muslim transmitted it.

Narrated Anas bin Malik:

A girl wearing ornaments, went out at Medina. Somebody struck her with a stone. She was brought to the Prophet while she was still alive. Allah's Apostle asked her, "Did such-and-such a person strike you?" She raised her head, denying that. He asked her a second time, saying, "Did so-and-so strike you?" She raised her head, denying that. He said for the third time, "Did so-and-so strike you?" She lowered her head, agreeing. Allah's Apostle then sent for the killer and killed him between two stones.

"A girl came to her and said: 'My father married me to his brother's son so that he might raise his own status thereby, and I was unwilling.' She said: 'Sit here until the Prophet comes.' Then the Messenger of Allah came, and I told him (what she had said). He sent word to her father, calling him, and he left the matter up to her. She said: 'O Messenger of Allah, I accept what my father did, but I wanted to know whether women have any say in the matter.'"

It was narrated that Anas bin Malik said:
"A girl went out wearing some jewelry and a Jew caught her, crushed her head between two rocks and took the jewelry that she was wearing. She was found as she was breathing her last, and she was brought to the Messenger of Allah who said: 'Who killed you? Was it so and so?' She gestured no with her head, and he continued asking until he named the Jew, and she gestured yes with her head. He was caught and he confessed (to his crime), then the Messenger of Allah ordered that his head be crushed between two rocks."

Anas b. Malik reported that a Jew killed a girl with a stone for her silver ornaments. She was brought to Allah's Messenger (may peace be upon him) when there was yet some life in her. He (the Holy Prophet) said to her:

Has so and so killed you? She indicated with the nod of her head: No. He said for the second time, and she again said: No with the nod of her head. He asked for the third time, and she said: Yes with the nod of her head and Allah's Messenger (may peace be upon him) commanded to crush his head between two stones.

Ibrahim bin Maisarah reported from his maternal aunt who reported on the authority of a woman called Mussaddaqah (a truthful woman). She said “In pre Islamic days, when my father participated in a battle the feet of the people burnt due to intense heat. Thereupon a man said “Who gives me his shoes, I shall marry him to my first daughter born to me. My father took off his shoes and there them before him. A girl was thereafter born to him and came of age.” The narrator then mentioned a similar story. But he did not mention that she had grown old.

Narrated AbuHurayrah:

AbuNadrah reported: An old man of Tufawah said to me: I was a guest of AbuHurayrah at Medina. I did not find any one of the companions of the Prophet (saws) more devoted to worship and more hospitable than AbuHurayrah.

One day I was with him when he was sitting on his bed. He had a purse which contained pebbles or kernels. A black slave-girl of his was sitting below. Counting them he was glorifying Allah. When the pebbles or the kernels in the purse were finished, she gathered them and put them again in the purse, and gave it to him. He said: Should I not tell you about me and about the Messenger of Allah (saws)?

I said: Yes. He said: Once when I was laid up with fever in the mosque, the Messenger of Allah (saws) came and entered the mosque, and said: Who saw the youth of ad-Daws. He said this three times.

A man said: Messenger of Allah, there he is, laid up with fever on one side of the mosque. He moved, walking forward till he reached me. He placed his hand on me. He had a kind talk with me, and I rose. He then began to walk till he reached the place where he used to offer his prayer. He paid his attention to the people. There were two rows of men and one row of women, or two rows of women and one row of men (the narrator is doubtful).

He then said: If Satan makes me forget anything during the prayer, the men should glorify Allah, and the women should clap their hands. The Messenger of Allah (saws) then prayed and he did not forget anything during the prayer.

He said: Be seated in your places, be seated in your places. The narrator, Musa, added the word "here". He then praised Allah and exalted Him, and said: Now to our topic.

The agreed version begins: He then said: Is there any man among you who approaches his wife, closes the door, covers himself with a curtain, and he is concealed with the curtain of Allah?

They replied: Yes. He said: later he sits and says: I did so-and-so; I did so-and-so. The people kept silence. He then turned to the women and said (to them): Is there any woman among you who narrates it? They kept silence. Then a girl fell on one of her knees. The narrator, Mu'ammil, said in his version: a buxom girl. She raised her head before the Messenger of Allah (saws) so that he could see her and listen to her.

She said: Messenger of Allah, they (the men) describe the secrets (of intercourse) and they (the women) also describe the secrets (of intercourse) to the people.

He said: Do you know what the similitude is? He said: The likeness of this act is the likeness of a female Satan who meets the male Satan on the roadside; he fulfils his desire with her while the people are looking at him. Beware! The perfume of men is that whose smell becomes visible and its colour does not appear. Beware! The perfume of women is that whose colour becomes visible and whose smell is not obvious.

AbuDawud said: From here I remembered this tradition from Mu'ammil and Musa: Beware! No man should lie with another man, no woman should lie with another woman except with one's child or father. He also mentioned a third which I have forgotten. This has been mentioned in the version of Musaddad, but I do not remember it as precisely as I like.

The narrator, Musa, said: Hammad narrated this tradition from al-Jarir from AbuNadrah from at-Tufawi.

“The Messenger of Allah (saw) passed by me when I was riding a donkey, and said: ‘O Mu’adh, do you know what Allah’s right over His slaves is and what His slaves’ right over Allah is?’ I said: ‘Allah and His Messenger know best.’ He said: ‘The right of Allah over His slaves is that they should worship Him and not associate anything with Him. And the right of the slaves over Allah, if they do that, is that He should not punish them.’”

Malik related to me from Amr ibn Yahya al-Mazini that his father said, "There was a stream in my grand-father's garden belonging to Abd ar-Rahman ibn Awf Abd ar-Rahman ibn Awf wanted to transfer it to a corner of the garden nearer to his land, and the owner of the garden prevented him. Abd ar-Rahman ibn Awf spoke to Umar ibn al-Khattab about it, and he gave a judgement to Abd ar-Rahman ibn Awf that he should transfer it."

'Abd bin Zam'ah said: 'He is the son of my father's slave woman who was born on my father's bed.' The Messenger of Allah saw that he resembled 'Utbah, but he said: 'The child is the bed's. Veil yourself from him, O Sawdah.'"

Narrated Abu Huraira:

The Prophet said, "Whoever manumits his share of a jointly possessed slave, it is essential for him to manumit the slave completely if he has sufficient money. Otherwise he should look for some work for the slave (to earn what would enable him to emancipate himself), without overburdening him with work."

Malik related to me that he had heard that Abdullah ibn Umar was asked whether a slave could be bought on the specific condition that it was to be used to fulfil the obligation of freeing a slave, and he said, "No."

Malik said, "That is the best of what I have heard on the obligation of freeing slaves. Someone who has to set a slave free because of an obligation on him, may not buy one on the condition that he sets it free because if he does that, whatever he buys is not completely a slave because he has reduced its price by the condition he has made of setting it free."

Malik added, "There is no harm, however, in someone buying a person expressly to set him free."

Malik said, "The best of what I have heard on the obligation of freeing slaves is that it is not permitted to free a christian or a jew to fulfil it, and one does not free a mukatab or a mudabbar or an umm walad or a slave to be freed after a certain number of years, or a blind person. There is no harm in freeing a christian, jew, or magian voluntarily, because Allah, the Blessed, the Exalted, said in His Book, 'either as a favour then or by ransom,' (Sura 47 ayat 4) The favour is setting free."

Malik said, "As for obligations of freeing slaves which Allah has mentioned in the Book, one only frees a mumin slave for them."

Malik said, "It is like that in feeding poor people for kaffara. One must only feed muslims and one does not feed anyone outside of the deen of Islam."

Sahih Muslim 330 b

This hadith has been narrated by Amr al-Naqid, Yazid b. Harun, 'Abd b. Humaid, Abd al-Razzaq, Thauri, Ayyub b. Musa, with the same chain of transmitters. In hadith narrated by Abd al-Razzaq there is a mention of the menstruation and of the sexual intercourse. The rest of the hadith has been transmitted like that of Ibn 'Uyaina.

Al-Hasan, on Samura’s authority, quoted God’s Messenger as saying, “If anyone kills his slave we will kill him, and if anyone maims his slave we will maim him.” Tirmidhi, Abu Dawud, Ibn Majah and Darimi transmitted it, and Nasa’i added in another version, “If anyone castrates his slave we will castrate him.”

It was narrated that 'Aishah said:
Ibn Zam'ah and Sa'd (Ibn Abu Waqqas) referred a dispute to the Prophet concerning the son of Zam'ah's slave woman. Sa'd said : " O Messenger of Allah my brother (Utbah bin Abu Waqqas) left instructions in his will that when I come to Makkah, I should look for the son of the slave woman of Zam'ah and take him into my care." 'Abd bin Zam’ah said: "He is my brother and the son of the slave woman of my father; he was born on my father's bed." The Prophet ffi saw that he resembled 'Utbah, and said: "He belongs to you, O 'Abd bin Zam'ah. The child is for the bed. Observe Hijab before him, O Saudah." (sahih)

Malik related to me that he heard Ibn Shihab say, "The precedent of the sunna is that when a slave is freed, his property follows him."

Malik said, "One thing which makes clear that the property of a slave follows him when he is freed is that when the contract (mukatab) is written for his freedom, his property follows him even if he did not stipulate it. That is because the bond of kitaba is the bond of wala' when it is complete. The property of a slave and a mukatab is not treated in the same way as any children they may have. Their children are only treated in the same way as their own slaves, not in the same way as their property. This is because the sunna, in which there is no dispute, is that when a slave is freed, his property follows him and his children do not follow him, and when a mukatab writes the contract for his freedom, his property follows him and his children do not follow him."

Malik said, "One thing which makes that clear is that when a slave or a mukatab are bankrupt, their property is taken but the mothers of their children and their children are not taken because they are not their property."

Malik said, "Another thing which makes it clear is that when a slave is sold and the person who buys him stipulates the inclusions of his property, his children are not included in his property."

Malik said, "Another thing which makes it clear is that when a slave does injure some one, he and his property are taken, and his children are not taken."

ahya related to me from Malik that he asked Ibn Shihab about the dhihar of a slave. He said, "It is like the dhihar of a free man."

Malik said, "He meant that the same conditions were applied in both cases."

Malik said, "The dhihar of the slave is incumbent on him, and the fasting of the slave in the dhihar is two months. "

Malik said that there was no ila for a slave who pronounced a dhihar from his wife. That was because if he were to fast the kaffara for pronouncing a dhihar, the divorce of the ila would come to him before he had finished the fast.

There came a slave and pledg- ed allegiance to Allah's Apostle (may peace be upon him) on migration; he (the Holy Prophet) did not know that he was a slave. Then there came his master and demanded him back, whereupon Allah's Apostle (may peace be upon him) said: Sell him to me. And he bought him for two black slaves, and he did not afterwards take allegiance from anyone until he had asked him whether he was a slave (or a free man)

Narrated Abu Huraira:

When I came to the Prophet said on my way, "O what a long tedious tiresome night; nevertheless, it has rescued me from the place of Heathenism." A slave of mine ran away on the way. When I reached the Prophet I gave him the oath of allegiance (for Islam), and while I was sitting with him, suddenly the slave appeared. The Prophet said to me. "O Abu Huraira! Here is your slave," I said, "He (i.e. the slave) is (free) for Allah's Sake," and manumitted him.

حَدَّثَنِي مُحَمَّدُ بْنُ الْعَلاَءِ، حَدَّثَنَا أَبُو أُسَامَةَ، حَدَّثَنَا إِسْمَاعِيلُ، عَنْ قَيْسٍ، عَنْ أَبِي هُرَيْرَةَ، قَالَ لَمَّا قَدِمْتُ عَلَى النَّبِيِّ صلى الله عليه وسلم قُلْتُ فِي الطَّرِيقِ:

وَأَبَقَ غُلاَمٌ لِي فِي الطَّرِيقِ، فَلَمَّا قَدِمْتُ عَلَى النَّبِيِّ صلى الله عليه وسلم فَبَايَعْتُهُ، فَبَيْنَا أَنَا عِنْدَهُ إِذْ طَلَعَ الْغُلاَمُ، فَقَالَ لِي النَّبِيُّ صلى الله عليه وسلم ‏"‏ يَا أَبَا هُرَيْرَةَ هَذَا غُلاَمُكَ ‏"‏‏.‏ فَقُلْتُ هُوَ لِوَجْهِ اللَّهِ تَعَالَى‏.‏ فَأَعْتَقْتُهُ‏.‏

It was narrated that Abu ‘Uqbah, who was the freed slave of some Persian people, said:
“I was present with the Prophet (saw) on the Day of Uhud. I struck a man from among the idolaters and said: ‘Take that! And I am a Persian slave!’ News of that reached the Prophet (saw) and he said: ‘Why did you not say: “Take that! And I am an Ansari slave!?”

Yahya related to me from Malik from Nafi that Sulayman ibn Yasar told him that one time the fodder of the animals of Abd ar-Rahman ibn al-Aswad ibn Abd Yaghuth was finished so he said to his slave, "Take some of your family's wheat as food and buy with it barley, and take only a like quantity.' "

Narrated Abu Huraira:

The Prophet said, "Whoever manumits his share of a jointly possessed slave, it is imperative for him to get that slave manumitted completely by paying the remaining price, and if he does not have sufficient money to manumit him, then the price of the slave should be estimated justly, and he is to be allowed to work and earn the amount that will manumit him (without overburdening him)".

"Whoever kills his slave, we will kill him, and whoever mutilates his slave, we will mutilate him."

Narrated Al-Bara:

The first of the companions of the Prophet who came to us (in Medina), were Mus`ab bin `Umar and Ibn Um Maktum, and they started teaching us the Qur'an. Then came `Ammar, Bilal and Sa`d. Afterwards `Umar bin Al-Kkattab came along with a batch of twenty (men): and after that the Prophet came. I never saw the people of Medina so pleased with anything as they were with his arrival, so that even the little boys and girls were saying, "This is Allah's Apostle who has come." He (the Prophet ) did not come (to Medina) till I had learnt Surat Al-Ala and also other similar Suras.

حَدَّثَنَا عَبْدَانُ، قَالَ أَخْبَرَنِي أَبِي، عَنْ شُعْبَةَ، عَنْ أَبِي إِسْحَاقَ، عَنِ الْبَرَاءِ ـ رضى الله عنه ـ قَالَ أَوَّلُ مَنْ قَدِمَ عَلَيْنَا مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم مُصْعَبُ بْنُ عُمَيْرٍ وَابْنُ أُمِّ مَكْتُومٍ فَجَعَلاَ يُقْرِئَانِنَا الْقُرْآنَ، ثُمَّ جَاءَ عَمَّارٌ وَبِلاَلٌ وَسَعْدٌ ثُمَّ جَاءَ عُمَرُ بْنُ الْخَطَّابِ فِي عِشْرِينَ ثُمَّ جَاءَ النَّبِيُّ صلى الله عليه وسلم فَمَا رَأَيْتُ أَهْلَ الْمَدِينَةِ فَرِحُوا بِشَىْءٍ فَرَحَهُمْ بِهِ، حَتَّى رَأَيْتُ الْوَلاَئِدَ وَالصِّبْيَانَ يَقُولُونَ هَذَا رَسُولُ اللَّهِ قَدْ جَاءَ‏.‏ فَمَا جَاءَ حَتَّى قَرَأْتُ ‏{‏سَبِّحِ اسْمَ رَبِّكَ الأَعْلَى‏}‏ فِي سُوَرٍ مِثْلِهَا‏.‏

Narrated Aisha":

(regarding) the Verse: 'And if you fear that you shall not be able to deal justly with the orphans...' (4.3) It is about the orphan girl who is in the custody of a man who is her guardian, and he intends to marry her because of her wealth, but he treats her badly and does not manage her property fairly and honestly. Such a man should marry women of his liking other than her, two or three or four. 'Prohibited to you (for marriage) are: ...your foster-mothers (who suckled you).' (4.23) Marriage is prohibited between persons having a foster suckling relationship corresponding to a blood relationship which renders marriage unlawful.

حَدَّثَنَا مُحَمَّدٌ، أَخْبَرَنَا عَبْدَةُ، عَنْ هِشَامٍ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، ‏{‏وَإِنْ خِفْتُمْ أَنْ لاَ، تُقْسِطُوا فِي الْيَتَامَى‏}‏‏.‏ قَالَتِ الْيَتِيمَةُ تَكُونُ عِنْدَ الرَّجُلِ وَهْوَ وَلِيُّهَا، فَيَتَزَوَّجُهَا عَلَى مَالِهَا، وَيُسِيءُ صُحْبَتَهَا، وَلاَ يَعْدِلُ فِي مَالِهَا، فَلْيَتَزَوَّجْ مَا طَابَ لَهُ مِنَ النِّسَاءِ سِوَاهَا مَثْنَى وَثُلاَثَ وَرُبَاعَ‏.‏

Narrated `Abdur-Rahman bin Yazid and Majammi bin Yazid:

The same ,Hadith above: A man called Khidam married a daughter of his (to somebody) against her consent. 'If you fear that you shall not be able to deal justly with the orphan girls then marry (other) women of your choice.' (4.3) And if somebody says to the guardian (of a woman), "Marry me to soand- so," and the guardian remained silent or said to him, "What have you got?" And the other said, "I have so much and so much (Mahr)," or kept quiet, and then the guardian said, "I have married her to you," then the marriage is valid (legal). This narration was told by Sahl on the authority of the Prophet.

Narrated Um Khalid bint Khalid:

The Prophet was given some clothes including a black Khamisa. The Prophet said, "To whom shall we give this to wear?" The people kept silent whereupon the Prophet said, "Fetch Um Khalid for me." I (Um Khalid) was brought carried (as I was small girl at that time). The Prophet took the Khamisa in his hands and made me wear it and said, "May you live so long that your dress will wear out and you will mend it many times." On the Khamisa there were some green or pale designs (The Prophet saw these designs) and said, "O Um Khalid! This is Sanah." (Sanah in a Ethiopian word meaning beautiful).

حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا إِسْحَاقُ بْنُ سَعِيدٍ، عَنْ أَبِيهِ، سَعِيدِ بْنِ فُلاَنٍ ـ هُوَ عَمْرُو بْنُ سَعِيدِ بْنِ الْعَاصِ ـ عَنْ أُمِّ خَالِدٍ بِنْتِ خَالِدٍ، أُتِيَ النَّبِيُّ صلى الله عليه وسلم بِثِيَابٍ فِيهَا خَمِيصَةٌ سَوْدَاءُ صَغِيرَةٌ فَقَالَ ‏"‏ مَنْ تَرَوْنَ نَكْسُو هَذِهِ ‏"‏‏.‏ فَسَكَتَ الْقَوْمُ قَالَ ‏"‏ ائْتُونِي بِأُمِّ خَالِدٍ ‏"‏‏.‏ فَأُتِيَ بِهَا تُحْمَلُ فَأَخَذَ الْخَمِيصَةَ بِيَدِهِ فَأَلْبَسَهَا وَقَالَ ‏"‏ أَبْلِي وَأَخْلِقِي ‏"‏‏.‏ وَكَانَ فِيهَا عَلَمٌ أَخْضَرُ أَوْ أَصْفَرُ فَقَالَ ‏"‏ يَا أُمَّ خَالِدٍ هَذَا سَنَاهْ ‏"‏‏.‏ وَسَنَاهْ بِالْحَبَشِيَّةِ حَسَنٌ‏.‏

Humaid bin Nafi narrated that :
Zainab bint Abi Salamah said: "I entered upon Umm Habibah, the wife of the Prophet when her father Sufyan bin Harb died. So she asked for some perfume that had something yellow saffron or something else, so a girl applied it to her and put some on her cheeks. Then she said: 'By Allah! I have no need for perfume except that I heard the Messenger of Allah saying: "It is not lawful for a woman who believers in Allah and the Last Day to mourn for the dead more than three days, except for her husband (in which case it is) four months and ten days."
حَدَّثَنَا الأَنْصَارِيُّ، حَدَّثَنَا مَعْنُ بْنُ عِيسَى، أَنْبَأَنَا مَالِكُ بْنُ أَنَسٍ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ حُمَيْدِ بْنِ نَافِعٍ، عَنْ زَيْنَبَ بِنْتِ أَبِي سَلَمَةَ، أَنَّهَا أَخْبَرَتْهُ بِهَذِهِ الأَحَادِيثِ الثَّلاَثَةِ، قَالَ قَالَتْ زَيْنَبُ دَخَلْتُ عَلَى أُمِّ حَبِيبَةَ زَوْجِ النَّبِيِّ صلى الله عليه وسلم حِينَ تُوُفِّيَ أَبُوهَا أَبُو سُفْيَانَ بْنُ حَرْبٍ فَدَعَتْ بِطِيبٍ فِيهِ صُفْرَةُ خَلُوقٍ أَوْ غَيْرُهُ فَدَهَنَتْ بِهِ جَارِيَةً ثُمَّ مَسَّتْ بِعَارِضَيْهَا ثُمَّ قَالَتْ وَاللَّهِ مَا لِي بِالطِّيبِ مِنْ حَاجَةٍ غَيْرَ أَنِّي سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ لاَ يَحِلُّ لاِمْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الآخِرِ أَنْ تُحِدَّ عَلَى مَيِّتٍ فَوْقَ ثَلاَثَةِ أَيَّامٍ إِلاَّ عَلَى زَوْجٍ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ‏"‏ ‏.‏

Narrated Abdullah ibn AbulHamsa':

I bought something from the Prophet (saws) before he received his Prophetic commission, and as there was something still due to him I promised him that I would bring it to him at his place, but I forgot. When I remembered three days later, I went to that place and found him there. He said: You have vexed me, young man. I have been here for three days waiting for you.

Abu Dawud said: Muhammad b. Yahya said : This is, in our opinion, 'Abd al-Karim b. 'Abd Allah b. Shaqiq (instead of "from 'Abd al-Karim from 'Abd Allah b. Shaqiq").

Abu Dawud said: In a similar way I have been informed by 'Ali b. 'Abd Allah.

Abu Dawud said: I have been told that Bishr b. al-Sarri transmitted it from 'Abd Allah b. Shaqiq.

Yahya related that Malik heard al-Ala ibn Abd ar-Rahman say, "Sadaqa does not decrease property, and Allah only increases a slave in worth for his restraint, and no slave is humble but that Allah raises him."

Malik said, "I do not know whether this hadith goes back to the Prophet, may Allah bless him and grant him peace, or not."

It was narrated that Salamah bin Al-Muhabbaq said:
"The Prophet passed judgment concerning a man who had intercourse with his wife's slave woman: 'If he forced her, then she is free, and he has to give her mistress a similar slave as a replacement; if she obeyed him in that, then she belongs to him, and he has to give her mistress a similar slave as a replacement.'"

Ibn `Umar said, "Allah's Apostle said, 'If one manumits his share of a jointly possessed slave, and can afford the price of the other shares according to the adequate price of the slave, the slave will be completely manumitted; otherwise he will be partially manumitted.' " (Aiyub, a sub-narrator is not sure whether the saying " ... otherwise he will be partially manumitted" was said by Nafi` or the Prophet.)

Abu Bakra reported God's messenger as saying, "Some of my people will alight in low-lying ground which they will call al-Basra beside a river called the Tigris over which there is a bridge. Its people will be numerous and it will be one of the capital cities of the Muslims. At the end of time the descendants of Qantura'[*] will come with broad faces and small eyes and alight on the bank of the river. The town's inhabitants will then separate into three sections, one of which will follow cattle into the desert and perish, another of which will seek security for themselves and perish, but a third will put their children behind their backs and fight with the invaders, and they will be the martyrs." Abu Dawud transmitted it. * The common explanation by Arabic writers is that Qantura' was a slave girl of Abraham from whom the Turks were descended. (Cf. Genesis, 25:1, which says that Abraham took a wife named Keturah -- in Hebrew Qeturah.) Ibn al-Athir, an-Nihaya fi gharib al-hadith, 3:314, says the Turks and Chinese were descended from the offspring of Qanturs'. Lisan al-'Arab, 6:432, says her offspring were the Turks, and some say the negroes. Mirqat, 5:166 f., finds a difficulty because Abraham was a descendant of Shem and the Turks were descended from Japheth. It suggests that Qantura' was a descendant of Abraham who married a descendant of Japheth. Dr. J.A. Boyle of Manchester University has drawn my attention to an article in the Harvard Journal of Asiatic Studies, 12:287, which quotes an Armenian historian, Grigor of Akner (1250-1335 A.D.), as saying that Kendura, a handmaiden of Abraham, bore Imran who became the ancestor of the Parthians.
وَعَن أبي بكرَة أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " يَنْزِلُ أُنَاسٌ مِنْ أُمَّتِي بِغَائِطٍ يُسَمُّونَهُ الْبَصْرَةَ عِنْدَ نَهْرٍ يُقَالُ لَهُ: دِجْلَةُ يَكُونُ عَلَيْهِ جِسْرٌ يَكْثُرُ أَهْلُهَا وَيَكُونُ مِنْ أَمْصَارِ الْمُسْلِمِينَ وَإِذَا كَانَ فِي آخِرِ الزَّمَانِ جَاءَ بَنُو قَنْطُورَاءَ عِرَاضُ الْوُجُوهِ صِغَارُ الْأَعْيُنِ حَتَّى يَنْزِلُوا عَلَى شَطِّ النَّهْرِ فَيَتَفَرَّقُ أَهْلُهَا ثَلَاثَ فِرَقٍ فِرْقَةٌ يَأْخُذُونَ فِي أَذْنَابِ الْبَقَرِ وَالْبَرِّيَّةِ وَهَلَكُوا وَفِرْقَةٌ يَأْخُذُونَ لِأَنْفُسِهِمْ وَهَلَكُوا وَفِرْقَةٌ يَجْعَلُونَ ذَرَارِيَّهُمْ خَلْفَ ظُهُورِهِمْ وَيُقَاتِلُونَهُمْ وَهُمُ الشُّهَدَاءُ ". رَوَاهُ أَبُو دَاوُد

'Ali b. Abu Talib reported; There fell to my lot along with Allah's Messenger (may peace be upon him) an old she-camel from the spoils of Badr. Allah's Messenger (may peace be upon him) granted me another camel. I made them kneel down one day at the door of an Ansari, and I wanted to carry on them Idhkhir (a kind of grass) in order to sell that. There was with me a goldsmith of the tribe of Qainuqa'. I saught to give a wedding feast (on the occasion of marriage with) Fatima with the help of that (the price accrued from the sale of this grass). And Hamza b. 'Abd al-Muttalib was busy in drinking in that house in the company of a singing girl who was singing to him. She said:

Hamza, get up for slaughtering the fat she-camels. Hamza attacked them with the sword and cut off their humps and ripped their haunches, and then took out their livers. I said to Ibn Shihab: Did he take out anything from the hump? He said: He cut off the humps altogether. Ibn Shihab reported 'Ali having said: I saw this (horrible) sight and it shocked me, and I came to Allah's Apostle (may peace be upon him) and there was Zaid b, Haritha with him and communicated to him this news. He came in the company of Zaid and I also went along with him and he went to Hamza and he expressed anger with him. Hamza raised his eyes and said: Are you (not) but the servants of my father? Allah's Messenger (may peace be upon him) turned back on his heels (on hearing this) until he went away from them.

A man from Banu 'Amir said:

I embraced Islam and my (ignorance of the) religion made me anxious (to learn the essentials). I came to Abu Dharr. Abu Dharr said: The climate of Medina did not suit me. The Messenger of Allah (saws) ordered me to have a few camels and goats. He said to me: Drink their milk. (The narrator Hammad said): I doubt whether he (the Prophet) said: "their urine." Abu Dharr said: I was away from the watering place and I had my family with me. I would have sexual defilement and pray without purification. I came to the Messenger of Allah (saws) at noon. He was resting in the shade of the mosque along with a group of Companions. He (the Prophet) said: Abu Dharr. I said: Yes, I am ruined, Messenger of Allah. He said: What ruined you ? I said: I was away from the watering place and I had family with me. I used to be sexually defiled and pray without purification. He commanded (to bring) water for me. Then a black slave-girl brought a vessel of water that was shaking as the vessel was not full. I concealed myself behind a camel and took bath and them came (to the Prophet). The Messenger of Allah (saws) said: Abu Dharr, clean earth is a means of ablution, even if you do not find water for ten years. When you find water, you should make it touch your skin.

Abu Dawud said: This is transmitted by Hammad b. Zaid from Ayyub. This version does not mention the words "their urine." This is not correct. The words "their urine" occur only in the version reported by Anas and transmitted only by the people of Basrah.

Yahya related to me from Malik from Abd ar-Rahman ibn al-Qasim from his father that A'isha, umm al-muminin, proposed to Qurayba bint Abi Umayya on behalf of Abd ar-Rahman ibn Abi Bakr. They married her to him and her people found fault with Abd ar-Rahman and said, "We only gave in marriage because of A'isha." A'isha therefore sent for Abd ar-Rahman and told him about it. He gave Qurayba authority over herself and she chose her husband and so there was no divorce.

'Amir b. Sa'd reported that Sa'd rode to his castle in al-'Aqiq and found a slave cutting down the trees, or beating off their leaves, so he stripped him off his belongings. When Sa'd returned, there came to him the masters of the slave and negotiated with him asking him to return to their slave or to them what he had taken from their slave, whereupon he said:

God forbid that I should return anything which Allah's Messenger (may peace be upon him) has given me as spoil, and refused to return anything to them.

Narrated Jabir:

"A slave came to give the pledge to the Prophet (saws) for Hijrah, but the Prophet (saws) did not realize that he was a slave. So his master came, and the Prophet (saws) said: 'Sell him to me.' So he purchased him for two black slaves. After this he (saws) would not take the pledge from anyone until he asked him if he was a slave."

[He said:] There is something on this topic from Ibn 'Abbas.

[Abu 'Eisa said:] The Hadith of Jabir is Hasan Gharib Sahih, we do not know of it except as a narration of Abu Az-Zubair.

It was narrated from Abu Dharr that he reached Rabadhah when the Iqamah for the prayer had already been given, and there was a slave leading them in prayer. It was said:
“This is Abu Dharr,” so he (the slave) started to move back. But Abu Dharr said: “My close friend (i.e., the Prophet (saw)) told me to listen and obey, even if (the leader was) an Ethiopian slave with amputated limbs.”

‘So-and-so narrated to me like this-and-that’. He said: ‘If your companion is trustworthy, then take from him.’

If anyone emancipates his share ina slave and has enough money to pay the full price for him, a fair price for the slave should be fixed, his partners given their shares, and the slave be thus emancipated, otherwise he is emancipated only to the extent of the first man's share.

Anas (Allah be pleased with him) reported that Allah's Messenger (may peace be upon him) set out on an expedition to Khaibar and we observed our morning prayer in early hours of the dawn. The Messenger of Allah (may peace be upon him) then mounted and so did Abu Talha ride, and I was seating myself behind Abu Talha. Allah's Apostle (may peace be upon him) moved in the narrow street of Khaibar (and we rode so close to each other in the street) that my knee touched the leg of Allah's Apostle (may peace be upon him). (A part of the) lower garment of Allah's Apostle (may peace be upon him) slipped from his leg and I could see the whiteness of the leg of Allah's Apostle (may peace be upon him). As he entered the habitation he called:

Allahu Akbar (Allah is the Greatest). Khaibar is ruined. And when we get down in the valley of a people evil is the morning of the warned ones. He repeated it thrice. In the meanwhile the people went out for their work, and said: By Allah, Muhammad (has come). Abd al-'Aziz or some of our companions said: Muhammad and the army (have come). He said: We took it (the territory of Khaibar) by force, and there were gathered the prisoners of war. There came Dihya and he said: Messenger of Allah, bestow upon me a girl from among the prisoners. He said: Go and get any girl. He made a choice for Safiyya daughter of Huyayy (b. Akhtab). There came a person to Allah's Apostle (may peace be upon him) and said: Apostle of Allah, you have bestowed Safiyya bint Huyayy, the chief of Quraiza and al-Nadir, upon Dihya and she is worthy of you only. He said: Call him along with her. So he came along with her. When Allah's Apostle (may peace be upon him) saw her he said: Take any other woman from among the prisoners. He (the narrator) said: He (the Holy Prophet) then granted her emancipation and married her. Thabit said to him: Abu Hamza, how much dower did he (the Holy Prophet) give to her? He said: He granted her freedom and then married her. On the way Umm Sulaim embellished her and then sent her to him (the Holy Prophet) at night. Allah's Apostle (may peace be upon him) appeared as a bridegroom in the morning. He (the Holy Prophet) said: He who has anything (to eat) should bring that. Then the cloth was spread. A person came with cheese, another came with dates, and still another came with refined butter, and they prepared hais and that was the wedding feast of Allah's Messenger (may peace be upon him)
حَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ، حَدَّثَنَا إِسْمَاعِيلُ، - يَعْنِي ابْنَ عُلَيَّةَ - عَنْ عَبْدِ الْعَزِيزِ، عَنْ أَنَسٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم غَزَا خَيْبَرَ قَالَ فَصَلَّيْنَا عِنْدَهَا صَلاَةَ الْغَدَاةِ بِغَلَسٍ فَرَكِبَ نَبِيُّ اللَّهِ صلى الله عليه وسلم وَرَكِبَ أَبُو طَلْحَةَ وَأَنَا رَدِيفُ أَبِي طَلْحَةَ فَأَجْرَى نَبِيُّ اللَّهِ صلى الله عليه وسلم فِي زُقَاقِ خَيْبَرَ وَإِنَّ رُكْبَتِي لَتَمَسُّ فَخِذَ نَبِيِّ اللَّهِ صلى الله عليه وسلم وَانْحَسَرَ الإِزَارُ عَنْ فَخِذِ نَبِيِّ اللَّهِ صلى الله عليه وسلم فَإِنِّي لأَرَى بَيَاضَ فَخِذِ نَبِيِّ اللَّهِ صلى الله عليه وسلم فَلَمَّا دَخَلَ الْقَرْيَةَ قَالَ ‏"‏ اللَّهُ أَكْبَرُ خَرِبَتْ خَيْبَرُ إِنَّا إِذَا نَزَلْنَا بِسَاحَةِ قَوْمٍ فَسَاءَ صَبَاحُ الْمُنْذَرِينَ ‏"‏ ‏.‏ قَالَهَا ثَلاَثَ مَرَّاتٍ قَالَ وَقَدْ خَرَجَ الْقَوْمُ إِلَى أَعْمَالِهِمْ فَقَالُوا مُحَمَّدٌ وَاللَّهِ ‏.‏ قَالَ عَبْدُ الْعَزِيزِ وَقَالَ بَعْضُ أَصْحَابِنَا مُحَمَّدٌ وَالْخَمِيسُ ‏.‏ قَالَ وَأَصَبْنَاهَا عَنْوَةً وَجُمِعَ السَّبْىُ فَجَاءَهُ دِحْيَةُ فَقَالَ يَا رَسُولَ اللَّهِ أَعْطِنِي جَارِيَةً مِنَ السَّبْىِ ‏.‏ فَقَالَ ‏"‏ اذْهَبْ فَخُذْ جَارِيَةً ‏"‏ ‏.‏ فَأَخَذَ صَفِيَّةَ بِنْتَ حُيَىٍّ فَجَاءَ رَجُلٌ إِلَى نَبِيِّ اللَّهِ صلى الله عليه وسلم فَقَالَ يَا نَبِيَّ اللَّهِ أَعْطَيْتَ دِحْيَةَ صَفِيَّةَ بِنْتَ حُيَىٍّ سَيِّدِ قُرَيْظَةَ وَالنَّضِيرِ مَا تَصْلُحُ ...

Narrated 'Amr b. Shu'aib:

On his father's authority, told that his grandfather reported the Prophet (saws) said: If any slave entered into an agreement to buy his freedom for one hundred uqiyahs and he pays them all but ten, he remains a slave (until he pays the remaining ten); and if a slave entered into an agreement to purchase his freedom for one hundred dinars, and he pays them all but ten dinars, he remains a slave (until he pays the remaining ten).

Abu Dawud said: This narrator 'Abbas al-Jariri is not the same person. They said: It is misunderstanding. He is some other narrator.

Al-‘Adda’ b. Khalid b. Haudha brought out a document to this effect:
This is what al-‘Adda’ b. Khalid b. Haudha brought from Muhammad, God’s Messenger. He bought from him a slave, or a slave woman, with no disease or wickedness, or anything unlawful*, a transaction between two Muslims. Tirmidhi transmitted it, saying this is a gharib tradition. * This might be bad character on the part of the slave or unlawful enslavement.
وَعَنِ الْعَدَّاءِ بْنِ خَالِدِ بْنِ هَوْذَةَ أَخْرَجَ كِتَابًا: هَذَا مَا اشْتَرَى الْعَدَّاءُ بْنُ خَالِدِ بْنِ هَوْذَةَ مِنْ مُحَمَّدٍ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ اشْترى مِنْهُ عبدا أَو أمة لَا دَاءَ وَلَا غَائِلَةَ وَلَا خِبْثَةَ بَيْعَ الْمُسْلِمِ الْمُسْلِمَ. رَوَاهُ التِّرْمِذِيُّ وَقَالَ: هَذَا حَدِيثٌ غَرِيبٌ

Jarir reported God’s Messenger as saying, “When a slave runs away his prayer is not accepted.” In a version on his authority he said, “If any slave runs away protection does not apply to him.” In another version on his authority he said, “If any slave runs away from his masters he has become an infidel till he returns to them.” Muslim transmitted it.
وَعَنْ جَرِيرٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِذَا أَبَقَ الْعَبْدُ لَمْ تُقْبَلْ لَهُ صَلَاةٌ» . وَفِي رِوَايَةٍ عَنْهُ قَالَ: «أَيّمَا عبد أبق فقد بَرِئت مِنْهُ الذِّمَّةُ» . وَفِي رِوَايَةٍ عَنْهُ قَالَ: «أَيُّمَا عَبْدٍ أَبَقَ مِنْ مَوَالِيهِ فَقَدْ كَفَرَ حَتَّى يَرْجِعَ إِلَيْهِم» . رَوَاهُ مُسلم

When the Prophet heard of that, he said (to his companions), "Who wants to buy him (i.e., the slave) for me?" Nu'aim bin An-Nahham bought him for eight hundred Dirhams. I heard Jabir saying, "That was a coptic slave who died in the same year."

حَدَّثَنَا أَبُو النُّعْمَانِ، أَخْبَرَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ عَمْرٍو، عَنْ جَابِرٍ، أَنَّ رَجُلاً، مِنَ الأَنْصَارِ دَبَّرَ مَمْلُوكًا لَهُ، وَلَمْ يَكُنْ لَهُ مَالٌ غَيْرُهُ فَبَلَغَ النَّبِيَّ صلى الله عليه وسلم فَقَالَ ‏ "‏ مَنْ يَشْتَرِيهِ مِنِّي ‏"‏‏.‏ فَاشْتَرَاهُ نُعَيْمُ بْنُ النَّحَّامِ بِثَمَانِمِائَةِ دِرْهَمٍ، فَسَمِعْتُ جَابِرَ بْنَ عَبْدِ اللَّهِ يَقُولُ عَبْدًا قِبْطِيًّا مَاتَ عَامَ أَوَّلَ‏.‏

Sunan an-Nasa'i 3364
It was narrated from Salamah bin Al-Muhabbaq that a man had intercourse with a slave woman belonging to his wife, and was brought to the Messenger of Allah. He said:
"If he forced her, then she is free at his expense and he has to give her mistress a similar slave as a replacement. If she obeyed him in that, then she belongs to her mistress, and he has to give her mistress a similar slave as well."
أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ بَزِيعٍ، قَالَ حَدَّثَنَا يَزِيدُ، قَالَ حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَلَمَةَ بْنِ الْمُحَبَّقِ، أَنَّ رَجُلاً، غَشِيَ جَارِيَةً لاِمْرَأَتِهِ فَرُفِعَ ذَلِكَ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ ‏ "‏ إِنْ كَانَ اسْتَكْرَهَهَا فَهِيَ حُرَّةٌ مِنْ مَالِهِ وَعَلَيْهِ الشَّرْوَى لِسَيِّدَتِهَا وَإِنْ كَانَتْ طَاوَعَتْهُ فَهِيَ لِسَيِّدَتِهَا وَمِثْلُهَا مِنْ مَالِهِ ‏"‏ ‏.‏
