Sahih al-Bukhari 1754

Narrated `Abdur-Rahman bin Al-Qasim:

I heard my father who was the best man of his age, saying, "I heard `Aisha saying, 'I perfumed Allah's Apostle with my own hands before finishing his Ihram while yet he has not performed Tawaf-al- Ifada.' She spread her hands (while saying so.)"

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ الْقَاسِمِ، أَنَّهُ سَمِعَ أَبَاهُ ـ وَكَانَ أَفْضَلَ أَهْلِ زَمَانِهِ ـ يَقُولُ سَمِعْتُ عَائِشَةَ ـ رضى الله عنها ـ تَقُولُ طَيَّبْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم بِيَدَىَّ هَاتَيْنِ حِينَ أَحْرَمَ، وَلِحِلِّهِ حِينَ أَحَلَّ، قَبْلَ أَنْ يَطُوفَ‏.‏ وَبَسَطَتْ يَدَيْهَا‏.‏

أَخْبَرَنَا عُبَيْدُ اللَّهِ بْنُ سَعْدِ بْنِ إِبْرَاهِيمَ، قَالَ حَدَّثَنَا عَمِّي، قَالَ حَدَّثَنَا أَبِي، عَنْ صَالِحٍ، عَنِ ابْنِ شِهَابٍ، قَالَ أَخْبَرَنِي نَافِعُ بْنُ أَنَسٍ، أَنَّ أَبَاهُ، حَدَّثَهُ أَنَّهُ، سَمِعَ أَبَا هُرَيْرَةَ، يَقُولُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ إِذَا دَخَلَ رَمَضَانُ فُتِّحَتْ أَبْوَابُ الْجَنَّةِ وَغُلِّقَتْ أَبْوَابُ جَهَنَّمَ وَسُلْسِلَتِ الشَّيَاطِينُ ‏"‏ ‏.‏

It was narrated from 'Aishah that the Prophet said:
"You will be gathered (one the Day of Resurrection) barefoot and naked." I said: "Men and women looking at one another?" he said: "The matter will be too difficult for people to pay attention to that."

It was narrated that Anas said:
"The last time I saw the Messenger of Allah, he drew back the curtain when the people were in rows behind Abu Bakr, may Allah be pleased with him. Abu Bakr wanted to step back, but he gestured to them to stay as they were, and let the curtain drop. He died at the end of that day, and that was a Monday."
أَخْبَرَنَا قُتَيْبَةُ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ أَنَسٍ، قَالَ آخِرُ نَظْرَةٍ نَظَرْتُهَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم كَشَفَ السِّتَارَةَ وَالنَّاسُ صُفُوفٌ خَلْفَ أَبِي بَكْرٍ رضى الله عنه فَأَرَادَ أَبُو بَكْرٍ أَنْ يَرْتَدَّ فَأَشَارَ إِلَيْهِمْ أَنِ امْكُثُوا وَأَلْقَى السِّجْفَ وَتُوُفِّيَ مِنْ آخِرِ ذَلِكَ الْيَوْمِ وَذَلِكَ يَوْمُ الاِثْنَيْنِ ‏.‏

'Uthman bin 'Affan, may Allah be pleased with him, narrated that the Prophet said:
"The Muhrim should not get married, arrange a marriage for someone else, nor propose marriage."

It was narrated from An-Nu'man bin Salim that:
A man said to him: "The Messenger of Allah [SAW] came to us while we were in a tent inside the Masjid of Al-Al-Madinah, and he said to us: 'It has been revealed to me that I should fight the people until they say La ilaha illallah.'" A similar narration.

It was narrated from Jabir bin 'Abdullah that:
the Messenger of Allah forbade eating the meat of the sacrificial animals after three days then he said: "Eat, take some with you (if traveling). And store some." ( Sahih)

It was narrated from 'Abdullah bin Buraidah that:
A man from among the Companions of the Prophet [SAW] who was called 'Ubaid said: "The Messenger of Allah [SAW] used to forbid too much of Al-Irfah." Ibn Buraidah was asked what too much of Al-Irfah meant, and he said: "It includes combing the hair."

It was narrated from Ibn 'Abbas that:
A man came to the Prophet [SAW] and said: "My father is an old man, can I perform Hajj on his behalf?" He said: "Yes. Don't you think that if he owed a debt and you paid it off, that would suffice him?"

It was narrated from Umm Salamah that:
When the Prophet [SAW] went out of his house, he said: "Bismillahi Rabbi. A'udhu bika min an azilla aw adilla aw azlima aw uzlama, aw ajhala aw yujhala 'alayya (In the name of Allah my Lord, I seek refuge in You from falling into error or going astray, or wronging (others) or being wronged, and from behaving or being treated in an ignorant manner.)"
أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ، قَالَ حَدَّثَنَا عَبْدُ الرَّحْمَنِ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنْ مَنْصُورٍ، عَنِ الشَّعْبِيِّ، عَنْ أُمِّ سَلَمَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم كَانَ إِذَا خَرَجَ مِنْ بَيْتِهِ قَالَ ‏ "‏ بِسْمِ اللَّهِ رَبِّ أَعُوذُ بِكَ مِنْ أَنْ أَزِلَّ أَوْ أَضِلَّ أَوْ أَظْلِمَ أَوْ أُظْلَمَ أَوْ أَجْهَلَ أَوْ يُجْهَلَ عَلَىَّ ‏"‏ ‏.‏

It was narrated that Ibn Shubrumah said:
"Talhah said to the people of Al-Kufah concerning Nabidh: 'It is a test whereby a young man may benefit but an old man may be harmed.' If there was a wedding among them, Talhah and Zubaid would offer milk and honey to drink. It was said to Talhah: 'Why don't you offer Nabidh?' He said: 'I would not like a Muslim to become intoxicated because of me.'"
أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، قَالَ أَنْبَأَنَا جَرِيرٌ، عَنِ ابْنِ شُبْرُمَةَ، قَالَ قَالَ طَلْحَةُ لأَهْلِ الْكُوفَةِ فِي النَّبِيذِ فِتْنَةٌ يَرْبُو فِيهَا الصَّغِيرُ وَيَهْرَمُ فِيهَا الْكَبِيرُ قَالَ وَكَانَ إِذَا كَانَ فِيهِمْ عُرْسٌ كَانَ طَلْحَةُ وَزُبَيْرٌ يَسْقِيَانِ اللَّبَنَ وَالْعَسَلَ ‏.‏ فَقِيلَ لِطَلْحَةَ أَلاَ تَسْقِيهِمُ النَّبِيذَ قَالَ إِنِّي أَكْرَهُ أَنْ يَسْكَرَ مُسْلِمٌ فِي سَبَبِي ‏.‏

It was narrated from Bashir that he gave his son a slave as a present, then he came to the Prophet and he wanted the Prophet to bear witness to that. He said:
"Have you given a similar present to all of your children?" He said: "No." He said: "Then take (your present) back."

Thabit bin Ad-Dahhak narrated that the Messenger of Allah said:
"Whoever swears by a religion other than Islam, telling a lie, will be as he said, and whoever kills himself with something will be punished with it in the Hereafter."
أَخْبَرَنِي مَحْمُودُ بْنُ خَالِدٍ، قَالَ حَدَّثَنَا الْوَلِيدُ، قَالَ حَدَّثَنَا أَبُو عَمْرٍو، عَنْ يَحْيَى، أَنَّهُ حَدَّثَهُ قَالَ حَدَّثَنِي أَبُو قِلاَبَةَ، قَالَ حَدَّثَنِي ثَابِتُ بْنُ الضَّحَّاكِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ حَلَفَ بِمِلَّةٍ سِوَى الإِسْلاَمِ كَاذِبًا فَهُوَ كَمَا قَالَ وَمَنْ قَتَلَ نَفْسَهُ بِشَىْءٍ عُذِّبَ بِهِ فِي الآخِرَةِ ‏"‏ ‏.‏

Sunan an-Nasa'i 210
It was narrated from 'Aishah that Umm Habibah bint Jahsh used to suffer from Istihadah (non-menstrual vaginal bleeding) for seven years. She asked the Prophet (PBUH) and he said:
"That is not menstruation, rather it is a vein. Tell her not to pray for the amount of time that her period used to last, then let her perform Ghusl and pray.' She used to perform Ghusl for every prayer.
أَخْبَرَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، قَالَ حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ عَمْرَةَ، عَنْ عَائِشَةَ، أَنَّ أُمَّ حَبِيبَةَ بِنْتَ جَحْشٍ، كَانَتْ تُسْتَحَاضُ سَبْعَ سِنِينَ فَسَأَلَتِ النَّبِيَّ صلى الله عليه وسلم فَقَالَ ‏ "‏ لَيْسَتْ بِالْحَيْضَةِ إِنَّمَا هُوَ عِرْقٌ ‏"‏ ‏.‏ فَأَمَرَهَا أَنْ تَتْرُكَ الصَّلاَةَ قَدْرَ أَقْرَائِهَا وَحَيْضَتِهَا وَتَغْتَسِلَ وَتُصَلِّيَ فَكَانَتْ تَغْتَسِلُ عِنْدَ كُلِّ صَلاَةٍ ‏.‏

Narrated Ibn Shihab:

Yunus asked Ibn Shihab about the address of the Messenger of Allah (saws) on Friday. He mentioned it in like manner. He added: Anyone who disobeys them (Allah and His Apostle) goes astray. We beseech Allah, our Lord, to make us from those who obey Him and obey His Apostle, and follow what He likes, and abstain from His anger; we are due to Him and we belong to Him.

The townsman'should not sell for a man from the desert (with a view to taking advantage of his ignorance of the market conditions of the city). And Zuhair reported from the Holy Prophet (may peace be upon him) that he forbade the townsman to sell on behalf of the man from the desert.

I met 'A'isha and asked her (about the utensils in which) Nabidh (may be prepared). She narrated to me that a group of 'Abd al-Qais came to Allah's Apostle (may peace be upon him) and asked: Allah's Apostle (may peace be upon him) about Nabidh. He (the Holy Prophet) forbade them to prepare Nabidh in varnished jar, hollow stumps and gourd and green pitcher.

Narrated Bajalah:

That 'Umar would not take the Jizyah from the Zoroastrians until 'Abdur-Rahman bin 'Awf informed him that the Prophet (saws) took Jizyah from the Zoroastrians of Hajar."

There is more dialogue in the Hadith than this. And this Hadith is Hasan Sahih.

Ibn Mas'ud reported that a person came to Allah's Messenger (may peace be upon him) and told him that he had kissed a woman or touched her with his hand or did something like this. He inquired of him about its expiation. It was (on this occasion) that Allah, the Exalted and Glorious, revealed this verse (as mentioned above).

Allah's Apostle forbade the sale called 'Habal-al-Habala which was a kind of sale practiced in the Pre- Islamic Period of ignorance. One would pay the price of a she-camel which was not born yet would be born by the immediate offspring of an extant she-camel.

Aisha wanted to buy a slave-girl in order to manumit her. The girl's masters stipulated that her Wala' would be for them. Allah's Apostle said (to `Aisha), "What they stipulate should not stop you, for the Wala' is for the liberator."

The Prophet took a camel of special age from somebody on credit. Its owner came and demanded it back (harshly). The Prophet said, "No doubt, he who has a right, can demand it." At that time their faces were towards Sham (Jerusalem) so they turned towards the Ka`ba (at Mecca).

`Adi took a white rope (or thread) and a black one, and when some part of the night had passed, he looked at them but he could not distinguish one from the other. The next morning he said, "O Allah's Apostle! I put (a white thread and a black thread) underneath my pillow." The Prophet said, "Then your pillow is too wide if the white thread (of dawn) and the black thread (of the night) are underneath your pillow! "

The tradition mentioned above has also transmitted by ‘Abd al-Wahhab through a different chain of narrators in a similar manner. This version has :
When a man is placed in his grave and his friends leave him, he hears the beat of their sandals. Then two angles come and speak to him. He then mentioned the rest of the tradition nearly similar to the previous one. It goes : As for the infidel and hypocrite they say to them. This version adds the word “hypocrite”. And he said : those who are near him will hear (his shout) with the exception of men and jinn.

Narrated Jabir bin ‘Abdullah :

The wife of Sa'd b. al-Rabi said: Messenger of Allah, Sa'd died and left two daughters. He then narrated the rest of the tradition in a similar way.

Abu Dawud said: This is the most correct tradition.

Ubayy b. Ka’b said :

The verdict that water (bath) is necessary when there is emission given by the people (in the early days of Islam) was due to the concession granted by the Messenger of Allah in the beginning of Islam. He then commanded to take a bath (in such a case).

Abu Dawud said : By Abu Ghassan is meant Muhammad b. mutarrif.

A man told the Messenger of Allah (saws) that he was being deceived in business transactions. The Messenger of Allah (saws) then said: When you make a bargain, say: There is no attempt to deceive. So when the man made a bargain, he said: There is no attempt to deceive.

Laqit b. Sabirah reported that he was the leader of Banu’l-Muntafiq (name of a tribe). He came to ‘A’ishah. He then narrated the tradition in a similar manner. He said:
The Prophet (saws) then came shortly with rapid strides inclining forward. The narrator used the word ‘asidah (name of a dish) in this version instead of Khazirah.

Abu Huraira told that God's Messenger sent some horsemen to Najd and they brought a man of the B. Hanifa called Thumama b. Uthal who was the chief of the people of al-Yamama and bound him to one of the pillars of the mosque. God’s Messenger came out to him and said, “What are you expecting, Thumama?” He replied, “I expect good, Muhammad. If you kill me you will kill one whose blood will be avenged, if you show favour you will show it to one who is grateful, and if you want property and ask you will be given as much of it as you wish.” God’s Messenger left him till the next day, and asked him, “What are you expecting, Thumama?” He replied, “I am expecting what I said to you. If you show favour you will show it to one who is grateful, if you kill me you will kill one whose blood will be avenged, and if you want property and ask you will be given as much of it as you wish.” God's Messenger left him till the following day, and asked him, “What are you expecting, Thumama?” He replied, “I am expecting what I said to you. If you show favour you will show it to one who is grateful, if you kill me you will kill one whose blood will be avenged, and if you want property and ask you will be given as much of it as you wish.” God’s Messenger then said, “Set Thumama free.” He went off to some palm-trees near the mosque, and after bathing he entered the mosque and said, “I testify that there is no god but God, and I testify that Muhammad is His servant and Messenger. I swear by God, Muhammad, that there was no face on the face of the earth more hateful to me than yours, but your face has become the dearest of all to me. I swear by God that there was no religion more hateful to me than yours, but your religion has become the dearest of all to me. I swear by God that there was no town more hateful to me than yours, but your town has become the dearest of all to me. Your cavalry seized me when I was on my way to perform the umra, so what do you think I should do? God’s Messenger congratulated him and told him to perform the umra. When he came to Mecca someone asked him whether he had turned to folly* and he replied, “No, but I have accepted Islam along with God’s Messenger. I swear by God that not one grain of wheat will come to you from al-Yamama till God’s Messenger gives permission for it.” *Sabaut. The verb saba has as one of its meanings to turn to folly. Anas (RAA) narrated that Abu Bakr As-Siddiq (RAA) wrote him this letter, “This is the obligatory Zakah, which the Messenger of Allah (P.B.U.H.) made obligatory for every Muslim, and which Allah, the Almighty had commanded him to observe. ‘For each twenty-four camels, or less, their Zakah is to be paid as sheep; for every live camels, their Zakah is one sheep. When the amount of camels is between twenty -five to thirty- five, the due Zakah is one she-camel ‘bint makhad’ (a camel which is one year old and just starting the second year) or a male camel ‘ibn labun’(a young male camel which is two years old and already starting the third year). However, when the amount of camels reaches thirty-six, the due Zakah is a young she-camel 'bint labun’ (a young female camel, which is two years old and already starting the third year). When they reach forty six to sixty camels, their due Zakah is a she camel ‘hiqqah’ (which is three years old and starting the fourth). When they reach sixty-one to seventy-five, one ‘Jaz'ah’ (a four year old camel already starting its fifth year). When their number is between seventy-six to ninety camels, their due Zakah is two young she camels ‘bint labun’. When they are in the range between ninety-one to one hundred and twenty camels, the Zakah is two young she camels 'hiqqah’. If they are over a hundred and twenty camels, on every forty camels, one 'bint labun’ is due. And for every fifty camels (over one hundred and twenty) a young she-camel ‘hiqqah’ is due, And anyone, who has got only four camels, does not have to pay Zakah unless he (the owner of the camels) wants to give something voluntarily. Regarding the Zakah of grazing sheep, if they are between forty and one hundred and twenty, one sheep is due as Zakah. lf they are between 120 and 200, two sheep are due. If they are between 200 and 300, three sheep are due. If they exceed three hundred sheep, then one sheep is due for every extra hundred grazing heads. If the grazing sheep are less than forty, (even if they are 39) then no Zakah is due on them, unless he (the owner of the camels) wants to give something voluntarily. One should not combine (i.e. gather young animals together) or separate them for fear of paying Zakah. When there is a mixture of cattle shared between two partners, and Zakah is paid jointly between them, then they have to calculate it equally among them (depending on the share of each). We were seated around God's messenger, Abu Bakr, ‘Umar and some others being with us, when God's messenger got up and left us. He delayed for some time, which made us fear that he might be attacked by some enemy when we were not with him; so being alarmed we got up. I was the first to be alarmed. I therefore went out to look for God's messenger and came to a garden belonging to the B. an-Najjar, a section of the Ansar, I went round it looking for a gate, but failed to find one. Seeing a rabi’ (i.e. a streamlet) flowing into the garden from a well outside, I drew myself together and went in to where God's messenger was. He said, “Is it Abu Huraira?" I replied, “Yes, messenger of God." He said, “What do you want?" I replied, “You were among us, but got up and went away and delayed for a time, so fearing that you might be attacked by some enemy when we were not with you, we became alarmed. I was the first to be alarmed, so when I came to this garden I drew myself together as a fox does; and these people are following me." Addressing me by name he gave me his sandals and said, “Take away these sandals of mine, and when you meet anyone outside this garden who testifies that there is no god but God, being assured of it in his heart, gladden him by announcing that he will go to paradise." Now the first one I met was ‘Umar. He asked, “What are these sandals, Abu Huraira?” and I replied, “These are God’s messenger’s sandals with which he has sent me to gladden anyone I met who testified that there is no god but God, being assured of it in his heart, with the announcement that he would go to paradise.” Thereupon ‘Umar struck me on the breast and I fell down on my seat.” He then said, “Go back, Abu Huraira”; so I went back to God’s messenger, and I was ready to weep. ‘Umar followed me closely, and there he was behind me. God’s messenger said, “What is the matter with you, Abu Huraira?” I replied, “I met ‘Umar and conveyed to him your message, whereupon he gave me a blow on the breast which made me fall down on my seat and ordered me to go back.” God’s messenger said, “What induced you, ‘Umar, to do what you did?” He replied, “Messenger of God, for whom I would give my father and mother as ransom, did you send Abu Huraira with your sandals to gladden anyone he met who testified that there is no god but God, being assured of it in his heart, with the announcement that he would go to paradise?” ...

Narrated Zahdam al-Jarmi:

We were sitting with Abu Musa Al-Ash'sari, and as there were ties of friendship and mutual favors between us and his tribe. His meal was presented before him and there was chicken meat in it. Among those who were present there was a man from Bani Taimillah having a red complexion as a non-Arab freed slave, and that man did not approach the meal. Abu Musa said to him, "Come along! I have seen Allah's Apostle eating of that (i.e., chicken)." The man said, "I have seen it (chickens) eating something I regarded as dirty, and so I have taken an oath that I shall not eat (its meat) chicken." Abu Musa said, "Come along! I will inform you about it (i.e., your oath). Once we went to Allah's Apostle in company with a group of Ash'airiyin, asking him for mounts while he was distributing some camels from the camels of Zakat. (Aiyub said, "I think he said that the Prophet was in an angry mood at the time.") The Prophet said, 'By Allah! I will not give you mounts, and I have nothing to mount you on.' After we had left, some camels of booty were brought to Allah's Apostle and he said, "Where are those Ash`ariyin? Where are those Ash`ariyin?" So we went (to him) and he gave us five very fat good-looking camels. We mounted them and went away, and then I said to my companions, 'We went to Allah's Apostle to give us mounts, but he took an oath that he would not give us mounts, and then later on he sent for us and gave us mounts, perhaps Allah's Apostle forgot his oath. By Allah, we will never be successful, for we have taken advantage of the fact that Allah's Apostle forgot to fulfill his oath. So let us return to Allah's Apostle to remind him of his oath.' We returned and said, 'O Allah's Apostle! We came to you and asked you for mounts, but you took an oath that you would not give us mounts) but later on you gave us mounts, and we thought or considered that you have forgotten your oath.' The Prophet said, 'Depart, for Allah has given you Mounts. By Allah, Allah willing, if I take an oath and then later find another thing better than that, I do what is better, and make expiation for the oath.' "

Abu Hurairah (May Allah be pleased with him) reported:
The Messenger of Allah (PBUH) put me in charge of charity of Ramadan (Sadaqat-ul- Fitr). Somebody came to me and began to take away some food-stuff. I caught him and said, "I must take you to the Messenger of Allah (PBUH)." He said, "I am a needy man with a large family, and so I have a pressing need." I let him go. When I saw the Messenger of Allah (PBUH) next morning, he asked me, "O Abu Hurairah! What did your captive do last night?" I said, "O Messenger of Allah! He complained of a pressing need and a big family. I felt pity for him so I let him go." He (PBUH) said, "He told you a lie and he will return." I was sure, according to the saying of the Messenger of Allah (PBUH) that he would return. I waited for him. He sneaked up again and began to steal food-stuff from the Sadaqah. I caught him and said; "I must take you to the Messenger of Allah (PBUH)." He said, "Let go of me, I am a needy man. I have to bear the expenses of a big family. I will not come back." So I took pity on him and let him go. I went at dawn to the Messenger of Allah (PBUH) who asked me, "O Abu Hurairah! What did your captive do last night?" I replied, "O Messenger of Allah! He complained of a pressing want and the burden of a big family. I took pity on him and so I let him go." He (PBUH) said, "He told you a lie and he will return." (That man) came again to steal the food-stuff. I arrested him and said, "I must take you to the Messenger of Allah (PBUH), and this is the last of three times. You promised that you would not come again but you did." He said, "Let go of me, I shall teach you some words with which Allah may benefit you." I asked, "What are those words?" He replied, "When you go to bed, recite Ayat-ul- Kursi (2:255) for there will be a guardian appointed over you from Allah, and Satan will not be able to approach you till morning." So I let him go. Next morning the Messenger of Allah (PBUH) asked me, "What did your prisoner do last night." I answered, "He promised to teach me some words which he claimed will benefit me before Allah. So I let him go." The Messenger of Allah (PBUH) asked, "What are those words that he taught you?" I said, "He told me: 'When you go to bed, recite Ayat- ul-Kursi from the beginning to the end i.e.,[ Allah! none has the right to be worshipped but He, the Ever Living, the One Who sustains and protects all that exists. وعن أبي هريرة رضي الله عنه قال‏:‏ وكلني رسول الله صلى الله عليه وسلم بحفظ زكاة رمضان، فأتاني آتٍ، فجعل يحثو من الطعام، فأخذته فقلت‏:‏ لأرفعنك إلى رسول الله صلى الله عليه وسلم قال‏:‏ إني محتاج، وعلي عيال، وبي حاجة شديدة، فخليت عنه، فأصبحت، فقال رسول الله صلى الله عليه وسلم ‏:‏‏"‏ يا أبا هريرة، ما فعل أسيرك البارحة‏؟‏‏"‏ قلت‏:‏ يا رسول الله شكا حاجة وعيالا، فرحمته، فخليت سبيله‏.‏ فقال‏:‏ ‏"‏ أما إنه قد كذبك وسيعود‏"‏ فعرفت أنه سيعود لقول رسول الله صلى الله عليه وسلم فرصدته، فجاء يحثو من الطعام، فقلت‏:‏ لأرفعنك إلى رسول الله صلى الله عليه وسلم، قال‏:‏ دعني فإني محتاج، وعلي عيال لا أعود، فرحمته فخليت سبيله، فأصبحت فقال لي رسول الله صلى الله عليه وسلم‏:‏ ‏"‏يا أبا هريرة، ما فعل أسيرك البارحة‏؟‏‏"‏ قلت‏:‏ يا رسول الله شكا حاجة وعيالا فرحمته، فخليت سبيله، فقال‏:‏ ‏"‏إنه قد كذبك وسيعود‏"‏ فرصدته الثالثة‏.‏ فجاء يحثو من الطعام، فأخذته، فقلت‏:‏ لأرفعنك إلى رسول الله صلى الله عليه وسلم، وهذا آخر ثلاث أنك تزعم أنك لا تعود، ثم تعود‏!‏ فقال‏:‏ دعني فإني أعلمك كلمات ينفعك الله بها، قلت‏:‏ ما هن‏؟‏ قال‏:‏ إذا أويت إلى فراشك فاقرأ آية الكرسي، فإنه لن يزال عليك من الله حافظ، ولا يقربك شيطان حتى تصبح، فخليت سبيله فأصبحت، فقال لي رسول الله صلى الله عليه وسلم‏:‏ ‏"‏ما فعل أسيرك البارحة‏؟‏ ‏"‏ قلت‏:‏ يا رسول الله زعم أنه يعلمني كلمات ينفعني الله بها، فخليت سبيله‏.‏ قال‏:‏ ‏"‏ما هي‏؟‏‏"‏ قلت‏:‏ قال لي‏:‏ إذا أويت إلى فراشك فاقرأ آية الكرسي من أولها حتى تختم الآية‏:‏ ‏{‏الله لا إله إلا هو الحي القيوم‏}‏ وقال لي‏:‏ لا يزال عليك من الله حافظ، ولن يقربك شيطان حتى تصبح، فقال النبي صلى الله عليه وسلم‏:‏ ‏"‏أما إنه قد صدقك وهو كذوب، تعلم من تخاطب منذ ثلاث يا أبا هريرة ‏"‏ ‏؟‏ قلت‏:‏ لا، قال‏:‏ ‏"‏ذاك شيطان‏"‏ ‏(‏‏(‏رواه البخاري‏)‏‏)‏‏.‏

Yahya related to me from Malik from Ziyad ibn Sad that Ibn Shihab said, "Neither jurur, nor musran al-fara, nor adhq ibn hubayq should be taken as zakat from dates. They should be included in the assessment but not taken as zakat. "

Malik said, "This is the same as with sheep and goats, whose young are included in the assessment but are not (actually) taken as zakat. There are also certain kinds of fruit which are not taken as zakat, such as burdi dates (one of the finest kinds of dates), and similar varieties.

Neither the lowest quality (of any property) nor the highest should be taken. Rather, zakat should be taken from average quality property."

Malik said, "The position that we are agreed upon concerning fruit is that only dates and grapes are estimated while on the tree. They are estimated when their usability is clear and they are halal to sell. This is because the fruit of date-palms and vines is eaten straightaway in the form of fresh dates and grapes, and so the assessment is done by estimation to make things easier for people and to avoid causing them trouble. Their produce is estimated and then they are given a free hand in using their produce as they wish, and later they pay the zakat on it according to the estimation that was made."

Malik said, "crops which are not eaten fresh, such as grains and seeds, which are only eaten after they have been harvested, are not estimated. The owner, after he has harvested, threshed and sifted the crop, so that it is then in the form of grain or seed, has to fulfil his trust himself and deduct the zakat he owes if the amount is large enough for him to have to pay zakat. This is the position that we are all agreed upon here (in Madina)."

Malik said, "The position that we are all agreed upon here (in Madina) is that the produce of date palms is estimated while it is still on the tree, after it has ripened and become halal to sell, and the zakat on it is deducted in the form of dried dates at the time of harvest. If the fruit is damaged after it has been estimated and the damage affects all the fruit then no zakat has to be paid. If some of the fruit remains unaffected, and this fruit amounts to five awsuq or more using the sa of the Prophet, may Allah bless him and grant him peace, then zakat is deducted from it. Zakat does not have to be paid, however, on the fruit that was damaged . Grapevines are dealt with in the same way.

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ زِيَادِ بْنِ سَعْدٍ، عَنِ ابْنِ شِهَابٍ، أَنَّهُ قَالَ لاَ يُؤْخَذُ فِي صَدَقَةِ النَّخْلِ الْجُعْرُورُ وَلاَ مُصْرَانُ الْفَارَةِ وَلاَ عَذْقُ ابْنِ حُبَيْقٍ ‏.‏ قَالَ وَهُوَ يُعَدُّ عَلَى صَاحِبِ الْمَالِ وَلاَ يُؤْخَذُ مِنْهُ فِي الصَّدَقَةِ ‏.‏ قَالَ مَالِكٌ وَإِنَّمَا مِثْلُ ذَلِكَ الْغَنَمُ تُعَدُّ عَلَى صَاحِبِهَا بِسِخَالِهَا وَالسَّخْلُ لاَ يُؤْخَذُ مِنْهُ فِي الصَّدَقَةِ وَقَدْ يَكُونُ فِي الأَمْوَالِ ثِمَارٌ لاَ تُؤْخَذُ الصَّدَقَةُ مِنْهَا مِنْ ذَلِكَ الْبُرْدِيُّ وَمَا أَشْبَهَهُ لاَ يُؤْخَذُ مِنْ أَدْنَاهُ كَمَا لاَ يُؤْخَذُ مِنْ خِيَارِهِ ‏.‏ قَالَ وَإِنَّمَا تُؤْخَذُ الصَّدَقَةُ مِنْ أَوْسَاطِ الْمَالِ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّهُ لاَ يُخْرَصُ مِنَ الثِّمَارِ إِلاَّ النَّخِيلُ وَالأَعْنَابُ فَإِنَّ ذَلِكَ يُخْرَصُ حِينَ يَبْدُو صَلاَحُهُ وَيَحِلُّ بَيْعُهُ وَذَلِكَ أَنَّ ثَمَرَ النَّخِيلِ وَالأَعْنَابِ يُؤْكَلُ رُطَبًا وَعِنَبًا فَيُخْرَصُ عَلَى أَهْلِهِ لِلتَّوْسِعَةِ عَلَى النَّاسِ وَلِئَلاَّ يَكُونَ عَلَى أَحَدٍ فِي ذَلِكَ ضِيقٌ فَيُخْرَصُ ذَلِكَ عَلَيْهِمْ ثُمَّ يُخَلَّى بَيْنَهُمْ وَبَيْنَهُ يَأْكُلُونَهُ كَيْفَ شَاءُوا ثُمَّ يُؤَدُّونَ مِنْهُ الزَّكَاةَ عَلَى مَا خُرِصَ عَلَيْهِمْ ‏.‏ قَالَ مَالِكٌ فَأَمَّا مَا لاَ يُؤْكَلُ رَطْبًا وَإِنَّمَا يُؤْكَلُ بَعْدَ حَصَادِهِ مِنَ الْحُبُوبِ كُلِّهَا فَإِنَّهُ لاَ يُخْرَصُ وَإِنَّمَا عَلَى أَهْلِهَا فِيهَا إِذَا حَصَدُوهَا وَدَقُّوهَا وَطَيَّبُوهَا وَخَلُصَتْ حَبًّا فَإِنَّمَا عَلَى أَهْلِهَا فِيهَا الأَمَانَةُ يُؤَدُّونَ زَكَاتَهَا إِذَا بَلَغَ ذَلِكَ مَا تَجِبُ فِيهِ الزَّكَاةُ وَهَذَا الأَمْرُ الَّذِي لاَ اخْتِلاَفَ فِيهِ عِنْدَنَا ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّ النَّخْلَ يُخْرَصُ عَلَى أَهْلِهَا وَثَمَرُهَا فِي رُءُوسِهَا إِذَا طَابَ وَحَلَّ بَيْعُهُ وَيُؤْخَذُ مِنْهُ صَدَقَتُهُ تَمْرًا عِنْدَ الْجِدَادِ فَإِنْ أَصَابَتِ الثَّمَرَةَ جَائِحَةٌ بَعْدَ أَنْ تُخْرَصَ عَلَى أَهْلِهَا وَقَبْلَ أَنْ تُجَذَّ فَأَحَاطَتِ الْجَائِحَةُ بِالثَّمَرِ كُلِّهِ فَلَيْسَ عَلَيْهِمْ صَدَقَةٌ فَإِنْ بَقِيَ مِنَ الثَّمَرِ شَىْءٌ يَبْلُغُ خَمْسَةَ أَوْسُقٍ فَصَاعِدًا بِصَاعِ النَّبِيِّ صلى الله عليه وسلم أُخِذَ مِنْهُمْ زَكَاتُهُ وَلَيْسَ عَلَيْهِمْ فِيمَا أَصَابَتِ الْجَائِحَةُ زَكَاةٌ وَكَذَلِكَ الْعَمَلُ فِي الْكَرْمِ أَيْضًا وَإِذَا كَانَ لِرَجُلٍ قِطَعُ أَمْوَالٍ مُتَفَرِّقَةٌ أَوِ اشْتِرَاكٌ فِي أَمْوَالٍ مُتَفَرِّقَةٍ لاَ يَبْلُغُ مَالُ كُلِّ شَرِيكٍ أَوْ قِطَعُهُ مَا تَجِبُ فِيهِ الزَّكَاةُ وَكَانَتْ إِذَا جُمِعَ بَعْضُ ذَلِكَ إِلَى بَعْضٍ يَبْلُغَ مَا تَجِبُ فِيهِ الزَّكَاةُ فَإِنَّهُ يَجْمَعُهَا وَيُؤَدِّي زَكَاتَهَا ‏.‏

It was narrated that Malik bin Aws bin Al-Hadathan said:
"Al-Abbas and Ali came to 'Umar with a dispute. Al-Abbas said: 'Pass judgment between him and I.' the people said: 'Pass judgment between them.' 'Umar said: 'I will not pass judgment between them. They know that the Messenger of Allah said: We are not inherited from, what we leave behind is charity. He said: And (in this narration of it) Az-Zuhri said: 'It (the Khumus) was under the control of the Messenger of Allah , and he took provision for himself and for his family from it, and disposed to the rest of it as he disposed of other wealth (belonging to the Muslims). Then Abu Bakr took control of it, then I took control of it after Abu Bakr, and I did with it what he sued to do. Then these two came to me and asked me to give it to them so that they could dispose of it as the Messenger of Allah disposed of it, and as Abu Bakr disposed of it, and as I disposed of it. So I gave it to them and I took promises from them that they would take proper care of it. Then they came to me and this one said. Give me my share from my brothers son: and this one said: Give me my share from my wife. If they want me to give it to them on the condition that they would dispose of it in the same manner as the Messenger of Allah did, and as Abu Bakr did, and as I did, I would give it to them, but if they refuse, then they do not have to worry about it.' Then he said: 'And know that whatever of spoils of war that you may gain, verily, one-fifth of it is assigned to Allah, and to the Messenger, and to the near relatives (of the Messenger (Muhammad), (and also) the orphans, Al-Masakin (the poor) and the wayfarer' (Al-Anfal 8:41) this if for them. 'As-Sadaqat (here it means Zakah) are only for the Fuqara (poor), and Al-Masakin (the poor) and those employed to collect (the funds); and to attract the hearts of those who have been inclined (toward Islam); and to free the captives; and for those in debt; and for Allah's cause (I.e. for Mujahidun - those fighting in a holy battle)' - this is for them. 'And what Allah gave as booty (Fay') to His Messenger (Muhammad) from them - for this you made no expeditin with either cavalry or camels.' Az-Zuhri said: This applies exclusively to the Messenger of Allah and refers to an 'Arab village called Fadak, and so on. It was narrated that Abu Hurairah and Abu Dharr said:
"The Messenger of Allah [SAW] would sit among his Companions and if a stranger came, he would not know which of them was he (the Prophet [SAW]) until he asked. So we suggested to the Messenger of Allah [SAW] that we should make a dais for him so that any stranger would know him if he came to him. So we built for him a bench made of clay on which he used to sit. (One day) we were sitting and the Messenger of Allah [SAW] was sitting in his spot, when a man came along who was the most handsome and good-smelling of all people, and it was as if no dirt had ever touched his garments. He came near the edge of the rug and greeted him, saying: 'Peace be upon you, O Muhammad!' He returned the greeting, and he said: 'Shall I come closer, O Muhammad?' He came a little closer, and he kept telling him to come closer, until he put his hands on the knees of the Messenger of Allah [SAW]. He said: 'O Muhammad, tell me, what is Islam?' He said: 'Islam means to worship Allah and not associate anything with Him; to establish Salah, to pay Zakah, to perform Hajj to the House, and to fast Ramadan.' He said: 'If I do that, will I have submitted (be a Muslim)?' He said: 'Yes.' He said: 'You have spoken the truth,' we found it odd. He said: 'O Muhammad, tell me, what is faith?' He said: 'To believe in Allah [SWT], His Angels, the Book, the Prophets, and to believe in the Divine Decree.' He said: 'If I do that, will I have believed?' The Messenger of Allah [SAW] said: 'Yes.' He said: 'You have spoken the truth.' He said: 'O Muhammad, tell me, what is Al-Ihsan?' He said: 'To worship Allah [SWT] as if you can see Him, for although you cannot see Him, He can see you.' He said: 'You have spoken the truth.' He said: 'O Muhammad, tell me about the Hour.' He lowered his head and did not answer. Then he repeated the question, and he did not answer. Then he repeated the question (a third time) and he did not answer. Then he raised his head and said: 'The one who is being asked does not know more than the one who is asking. But it has signs, by which it may be known. When you see the herdsmen competing in building tall buildings, when you see the barefoot and naked ruling the Earth, when you see a woman giving birth to her mistress. Five things which no one knows except Allah [SWT]. Verily, Allah, with Him (alone) is the knowledge of the Hour up to His saying: 'Verily, Allah is All-Knower, All-Aware (of things).' أَخْبَرَنَا مُحَمَّدُ بْنُ قُدَامَةَ، عَنْ جَرِيرٍ، عَنْ أَبِي فَرْوَةَ، عَنْ أَبِي زُرْعَةَ، عَنْ أَبِي هُرَيْرَةَ، وَأَبِي، ذَرٍّ قَالاَ كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَجْلِسُ بَيْنَ ظَهْرَانَىْ أَصْحَابِهِ فَيَجِيءُ الْغَرِيبُ فَلاَ يَدْرِي أَيُّهُمْ هُوَ حَتَّى يَسْأَلَ فَطَلَبْنَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم أَنْ نَجْعَلَ لَهُ مَجْلِسًا يَعْرِفُهُ الْغَرِيبُ إِذَا أَتَاهُ فَبَنَيْنَا لَهُ دُكَّانًا مِنْ طِينٍ كَانَ يَجْلِسُ عَلَيْهِ وَإِنَّا لَجُلُوسٌ وَرَسُولُ اللَّهِ صلى الله عليه وسلم فِي مَجْلِسِهِ إِذْ أَقْبَلَ رَجُلٌ أَحْسَنُ النَّاسِ وَجْهًا وَأَطْيَبُ النَّاسِ رِيحًا كَأَنَّ ثِيَابَهُ لَمْ يَمَسَّهَا دَنَسٌ حَتَّى سَلَّمَ فِي طَرَفِ الْبِسَاطِ فَقَالَ السَّلاَمُ عَلَيْكَ يَا مُحَمَّدُ ‏.‏ فَرَدَّ عَلَيْهِ السَّلاَمَ قَالَ أَدْنُو يَا مُحَمَّدُ قَالَ ‏"‏ ادْنُهْ ‏"‏ ‏.‏ فَمَا زَالَ يَقُولُ أَدْنُو مِرَارًا وَيَقُولُ لَهُ ‏"‏ ادْنُ ‏"‏ ‏.‏ حَتَّى وَضَعَ يَدَهُ عَلَى رُكْبَتَىْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ يَا مُحَمَّدُ أَخْبِرْنِي مَا الإِسْلاَمُ قَالَ ‏"‏ الإِسْلاَمُ أَنْ تَعْبُدَ اللَّهَ وَلاَ تُشْرِكَ بِهِ شَيْئًا وَتُقِيمَ الصَّلاَةَ وَتُؤْتِيَ الزَّكَاةَ وَتَحُجَّ الْبَيْتَ وَتَصُومَ رَمَضَانَ ‏"‏ ‏.‏ قَالَ إِذَا فَعَلْتُ ذَلِكَ فَقَدْ أَسْلَمْتُ قَالَ ‏"‏ نَعَمْ ‏"‏ ‏.‏ قَالَ صَدَقْتَ ‏.‏ فَلَمَّا سَمِعْنَا قَوْلَ الرَّجُلِ صَدَقْتَ أَنْكَرْنَاهُ قَالَ يَا مُحَمَّدُ أَخْبِرْنِي مَا الإِيمَانُ قَالَ ‏"‏ الإِيمَانُ بِاللَّهِ وَمَلاَئِكَتِهِ وَالْكِتَابِ وَالنَّبِيِّينَ وَتُؤْمِنُ بِالْقَدَرِ ‏"‏ ‏.‏ قَالَ فَإِذَا فَعَلْتُ ذَلِكَ فَقَدْ آمَنْتُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ نَعَمْ ‏"‏ ‏.‏ قَالَ صَدَقْتَ ‏.‏ قَالَ يَا مُحَمَّدُ أَخْبِرْنِي مَا الإِحْسَانُ قَالَ ‏"‏ أَنْ تَعْبُدَ اللَّهَ كَأَنَّكَ تَرَاهُ فَإِنْ لَمْ تَكُنْ تَرَاهُ فَإِنَّهُ يَرَاكَ ‏"‏ ‏.‏ قَالَ صَدَقْتَ ‏.‏ قَالَ يَا مُحَمَّدُ أَخْبِرْنِي مَتَى السَّاعَةُ قَالَ فَنَكَسَ فَلَمْ يُجِبْهُ شَيْئًا ثُمَّ أَعَادَ فَلَمْ يُجِبْهُ شَيْئًا ثُمَّ أَعَادَ فَلَمْ يُجِبْهُ شَيْئًا وَرَفَعَ رَأْسَهُ فَقَالَ ‏"‏ مَا الْمَسْئُولُ عَنْهَا بِأَعْلَمَ مِنَ السَّائِلِ وَلَكِنْ لَهَا عَلاَمَاتٌ تُعْرَفُ بِهَا إِذَا رَأَيْتَ الرِّعَاءَ الْبُهُمَ يَتَطَاوَلُونَ فِي الْبُنْيَانِ وَرَأَيْتَ الْحُفَاةَ الْعُرَاةَ مُلُوكَ الأَرْضِ وَرَأَيْتَ الْمَرْأَةَ تَلِدُ رَبَّهَا خَمْسٌ لاَ يَعْلَمُهَا إِلاَّ اللَّهُ ‏{‏ إِنَّ اللَّهَ عِنْدَهُ عِلْمُ السَّاعَةِ ‏}‏ إِلَى قَوْلِهِ ‏{‏ إِنَّ اللَّهَ عَلِيمٌ خَبِيرٌ ‏}‏ ‏"‏ ‏.‏ ثُمَّ قَالَ ‏"‏ لاَ وَالَّذِي بَعَثَ مُحَمَّدًا بِالْحَقِّ هُدًى وَبَشِيرًا مَا كُنْتُ بِأَعْلَمَ بِهِ مِنْ رَجُلٍ مِنْكُمْ وَإِنَّهُ لَجِبْرِيلُ عَلَيْهِ السَّلاَمُ نَزَلَ فِي صُورَةِ دِحْيَةَ الْكَلْبِيِّ ‏"‏ ‏.‏

Narrated Hakim b. Hizam:

That the Messenger of Allah (saws) said: "Both the buyer and the seller retain the option as long as they have not separated. If they spoke the truth and clarified (any defects or conditions), then they would be blessed in their sale, and if they hid something and lied then their sale would be deprived of blessings."

And this is a Sahih Hadith.

This is how it was reported from Abu Barzah Al-Aslami, that two men came disputing to him after the sale of a horse, and they were on a ship, so he said: "I did not see the two of your separate, and the Messenger of Allah (saws) said: 'The buyer and the seller retain the choice as long as they did not separate.'"

Some of the people of knowledge, among the people of Al-Kufah and others, held the view that the separation refers to speech. This is the saying of [Sufyan] Ath-Thawri. This has been reported from Malik bin Anas, and it has been reported from Ibn al-Mubarak that he said: "How could this be refuted ?" And the Hadith about it from the Prophet (saws) is Sahih, and it strenghtens this view.

And the meaning of the saying of the Prophet (saws): "Except for the optional sale" is, that (while they are still together) the seller gives the buyer the option to cancel after the conclusion of the sale. If he chooses to agree to the sale, then he does not have the choice to cancel the sale after then, even if they did not separate. This is how Ash-Shafi'i and others explained it. And what strenghtens the view of those who said that the separation refers to them parting, (and) it does not refer to speech, is the (following) Hadith of 'Abdullah bin 'Amr from the Prophet (saws).

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا يَحْيَى بْنُ سَعِيدٍ، عَنْ شُعْبَةَ، عَنْ قَتَادَةَ، عَنْ صَالِحٍ أَبِي الْخَلِيلِ، عَنْ عَبْدِ اللَّهِ بْنِ الْحَارِثِ، عَنْ حَكِيمِ بْنِ حِزَامٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا فَإِنْ صَدَقَا وَبَيَّنَا بُورِكَ لَهُمَا فِي بَيْعِهِمَا وَإِنْ كَتَمَا وَكَذَبَا مُحِقَتْ بَرَكَةُ بَيْعِهِمَا ‏"‏ ‏.‏ هَذَا حَدِيثٌ صَحِيحٌ ‏.‏ قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنْ أَبِي بَرْزَةَ وَحَكِيمِ بْنِ حِزَامٍ وَعَبْدِ اللَّهِ بْنِ عَبَّاسٍ وَعَبْدِ اللَّهِ بْنِ عَمْرٍو وَسَمُرَةَ وَأَبِي هُرَيْرَةَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ ابْنِ عُمَرَ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمْ وَهُوَ قَوْلُ الشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ وَقَالُوا الْفُرْقَةُ بِالأَبْدَانِ لاَ بِالْكَلاَمِ ‏.‏ وَقَدْ قَالَ بَعْضُ أَهْلِ الْعِلْمِ مَعْنَى قَوْلِ النَّبِيِّ صلى الله عليه وسلم ‏"‏ مَا لَمْ يَتَفَرَّقَا ‏"‏ ‏.‏ يَعْنِي الْفُرْقَةَ بِالْكَلاَمِ ‏.‏ وَالْقَوْلُ الأَوَّلُ أَصَحُّ لأَنَّ ابْنَ عُمَرَ هُوَ رَوَى عَنِ النَّبِيِّ صلى الله عليه وسلم وَهُوَ أَعْلَمُ بِمَعْنَى مَا رَوَى وَرُوِيَ عَنْهُ أَنَّهُ كَانَ إِذَا أَرَادَ أَنْ يُوجِبَ الْبَيْعَ مَشَى لِيَجِبَ لَهُ ‏.‏ وَهَكَذَا رُوِيَ عَنْ أَبِي بَرْزَةَ الأَسْلَمِيِّ أَنَّ رَجُلَيْنِ اخْتَصَمَا إِلَيْهِ فِي فَرَسٍ بَعْدَ مَا تَبَايَعَا ‏.‏ وَكَانُوا فِي سَفِينَةٍ فَقَالَ لاَ أَرَاكُمَا افْتَرَقْتُمَا وَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ الْبَيِّعَانِ بِالْخِيَارِ مَا لَمْ يَتَفَرَّقَا ‏"‏ ‏.‏ وَقَدْ ذَهَبَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ إِلَى أَنَّ الْفُرْقَةَ بِالْكَلاَمِ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَهَكَذَا رُوِيَ عَنْ مَالِكِ بْنِ أَنَسٍ ‏.‏ وَرُوِيَ عَنِ ابْنِ الْمُبَارَكِ أَنَّهُ قَالَ كَيْفَ أَرُدُّ هَذَا وَالْحَدِيثُ فِيهِ عَنِ النَّبِيِّ صلى الله عليه وسلم صَحِيحٌ ‏.‏ وَقَوَّى هَذَا الْمَذْهَبَ ‏.‏ وَمَعْنَى قَوْلِ النَّبِيِّ صلى الله عليه وسلم ‏"‏ إِلاَّ بَيْعَ الْخِيَارِ ‏"‏ ‏.‏ مَعْنَاهُ أَنْ يُخَيِّرَ الْبَائِعُ الْمُشْتَرِيَ بَعْدَ إِيجَابِ الْبَيْعِ فَإِذَا خَيَّرَهُ فَاخْتَارَ الْبَيْعَ فَلَيْسَ لَهُ خِيَارٌ بَعْدَ ذَلِكَ فِي فَسْخِ الْبَيْعِ وَإِنْ لَمْ يَتَفَرَّقَا ‏.‏ هَكَذَا فَسَّرَهُ الشَّافِعِيُّ وَغَيْرُهُ ‏.‏ وَمِمَّا يُقَوِّي قَوْلَ مَنْ يَقُولُ الْفُرْقَةُ بِالأَبْدَانِ لاَ بِالْكَلاَمِ حَدِيثُ عَبْدِ اللَّهِ بْنِ عَمْرٍو عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏

Muhammad b. 'Abd al-Rahman reported:

A person from Iraq said to him to inquire from 'Urwa b. Zubair for him whether a person who puts on Ihram for Hajj is allowed to put it off or not as he circumambulates the House. And if he says:" No, it can't be put off," then tell him that there is a person who makes such an assertion. He (Muhammad b. 'Abd al-Rahman) then said: I asked him ( Urwa b. Zubair), where- upon he said: The person who has entered into the state of Ihram for Hajj cannot get out of it unless he has, completed the Hajj I (further) said (to him): (What) if a person makes that assertion? Thereupon he said: It is indeed unfortunate that he makes such an assertion. That person ('Iraqi) then met me and he asked me and I narrated to him (the reply of 'Urwa), whereupon he (the Iraqi) said: Tell him ('Urwa) that a person had informed him that Allah's Messenger (may peace be upon him) had done that; and why is it that Asma' and Zubair have done like this? He (Muhammad b. 'Abd al-Rahman) said: I went to him and made a mention of that to him, whereupon he ('Urwa) said: Who is he (the 'Iraqi)? I said: I do not know, whereupon he said: What is the matter that he does not come to me himself and ask me? I suppose he is an 'Iraqi. I said: I do not know, whereupon he said: He has told a lie. Allah's Messenger (may peace be upon him) performed Hajj, and 'A'isha (Allah be pleased with her) has told me that the first thing with which he commenced (the rituals) when he arrived at Mecca was that he performed ablution and then circumambulated the Ka'ba. Then Abu Bakr performed Hajj and the first thing with which he commenced (the Hajj) as the circumambulation of the Ka'ba and nothing besides it. So did 'Umar. Then 'Uthman performed Hajj and I saw that the first thing with which he commenced the Hajj was the circumambulation of the Ka'ba and nothing besides it. Then Mu'awiya and Abdullah b. 'Umar did that. Then I performed Hajj with my father Zubair b. al-'Awwam, and the first thing with which he commenced (Hajj) was the circumambulation of the House. He then did nothing besides it. I then saw the emigrants (Muhajirin) and the helpers (Ansar) doing like this and nothing besides it. And the last one whom I saw doing like this was Ibn 'Umar. And he did not break it (the Hajj) after performing 'Umra. And Ibn 'Umar is with them. Why don't they ask him (to testify it)? حَدَّثَنِي هَارُونُ بْنُ سَعِيدٍ الأَيْلِيُّ، حَدَّثَنَا ابْنُ وَهْبٍ، أَخْبَرَنِي عَمْرٌو، - وَهُوَ ابْنُ الْحَارِثِ - عَنْ مُحَمَّدِ بْنِ عَبْدِ الرَّحْمَنِ، أَنَّ رَجُلاً، مِنْ أَهْلِ الْعِرَاقِ قَالَ لَهُ سَلْ لِي عُرْوَةَ بْنَ الزُّبَيْرِ عَنْ رَجُلٍ يُهِلُّ بِالْحَجِّ فَإِذَا طَافَ بِالْبَيْتِ أَيَحِلُّ أَمْ لاَ فَإِنْ قَالَ لَكَ لاَ يَحِلُّ ‏.‏ فَقُلْ لَهُ إِنَّ رَجُلاً يَقُولُ ذَلِكَ - قَالَ - فَسَأَلْتُهُ فَقَالَ لاَ يَحِلُّ مَنْ أَهَلَّ بِالْحَجِّ إِلاَّ بِالْحَجِّ ‏.‏ قُلْتُ فَإِنَّ رَجُلاً كَانَ يَقُولُ ذَلِكَ ‏.‏ قَالَ بِئْسَ مَا قَالَ فَتَصَدَّانِي الرَّجُلُ فَسَأَلَنِي فَحَدَّثْتُهُ فَقَالَ فَقُلْ لَهُ فَإِنَّ رَجُلاً كَانَ يُخْبِرُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَدْ فَعَلَ ذَلِكَ وَمَا شَأْنُ أَسْمَاءَ وَالزُّبَيْرِ فَعَلاَ ذَلِكَ ‏.‏ قَالَ فَجِئْتُهُ فَذَكَرْتُ لَهُ ذَلِكَ فَقَالَ مَنْ هَذَا فَقُلْتُ لاَ أَدْرِي ‏.‏ قَالَ فَمَا بَالُهُ لاَ يَأْتِينِي بِنَفْسِهِ يَسْأَلُنِي أَظُنُّهُ عِرَاقِيًّا ‏.‏ قُلْتُ لاَ أَدْرِي ‏.‏ قَالَ فَإِنَّهُ قَدْ كَذَبَ قَدْ حَجَّ رَسُولُ اللَّهِ صلى الله عليه وسلم فَأَخْبَرَتْنِي عَائِشَةُ - رضى الله عنها - أَنَّ أَوَّلَ شَىْءٍ بَدَأَ بِهِ حِينَ قَدِمَ مَكَّةَ أَنَّهُ تَوَضَّأَ ثُمَّ طَافَ بِالْبَيْتِ ثُمَّ حَجَّ أَبُو بَكْرٍ فَكَانَ أَوَّلَ شَىْءٍ بَدَأَ بِهِ الطَّوَافُ بِالْبَيْتِ ثُمَّ لَمْ يَكُنْ غَيْرُهُ ثُمَّ عُمَرُ مِثْلُ ذَلِكَ ثُمَّ حَجَّ عُثْمَانُ فَرَأَيْتُهُ أَوَّلُ شَىْءٍ بَدَأَ بِهِ الطَّوَافُ بِالْبَيْتِ ثُمَّ لَمْ يَكُنْ غَيْرُهُ ثُمَّ مُعَاوِيَةُ وَعَبْدُ اللَّهِ بْنُ عُمَرَ ثُمَّ حَجَجْتُ مَعَ أَبِي الزُّبَيْرِ بْنِ الْعَوَّامِ فَكَانَ أَوَّلَ شَىْءٍ بَدَأَ بِهِ الطَّوَافُ بِالْبَيْتِ ثُمَّ لَمْ يَكُنْ غَيْرُهُ ثُمَّ رَأَيْتُ الْمُهَاجِرِينَ وَالأَنْصَارَ يَفْعَلُونَ ذَلِكَ ثُمَّ لَمْ يَكُنْ غَيْرُهُ ثُمَّ آخِرُ مَنْ رَأَيْتُ فَعَلَ ذَلِكَ ابْنُ عُمَرَ ثُمَّ لَمْ يَنْقُضْهَا بِعُمْرَةٍ وَهَذَا ابْنُ عُمَرَ عِنْدَهُمْ أَفَلاَ يَسْأَلُونَهُ وَلاَ أَحَدٌ مِمَّنْ مَضَى مَا كَانُوا يَبْدَءُونَ بِشَىْءٍ حِينَ يَضَعُونَ أَقْدَامَهُمْ أَوَّلَ مِنَ الطَّوَافِ بِالْبَيْتِ ثُمَّ لاَ يَحِلُّونَ وَقَدْ رَأَيْتُ أُمِّي وَخَالَتِي حِينَ تَقْدَمَانِ لاَ تَبْدَآنِ بِشَىْءٍ أَوَّلَ مِنَ الْبَيْتِ تَطُوفَانِ بِهِ ثُمَّ لاَ تَحِلاَّنِ وَقَدْ أَخْبَرَتْنِي أُمِّي أَنَّهَا أَقْبَلَتْ هِيَ وَأُخْتُهَا وَالزُّبَيْرُ وَفُلاَنٌ وَفُلاَنٌ بِعُمْرَةٍ قَطُّ فَلَمَّا مَسَحُوا الرُّكْنَ حَلُّوا وَقَدْ كَذَبَ فِيمَا ذَكَرَ مِنْ ذَلِكَ ‏.‏

حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى، وَمُحَمَّدُ بْنُ رَافِعٍ النَّيْسَابُورِيُّ، وَمَحْمُودُ بْنُ غَيْلاَنَ، وَيَحْيَى بْنُ مُوسَى، قَالُوا حَدَّثَنَا عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ يَحْيَى بْنِ أَبِي كَثِيرٍ، عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ اللَّهِ بْنِ قَارِظٍ، عَنِ السَّائِبِ بْنِ يَزِيدَ، عَنْ رَافِعِ بْنِ خَدِيجٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏"‏ أَفْطَرَ الْحَاجِمُ وَالْمَحْجُومُ ‏"‏ ‏.‏ قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنْ عَلِيٍّ وَسَعْدٍ وَشَدَّادِ بْنِ أَوْسٍ وَثَوْبَانَ وَأُسَامَةَ بْنِ زَيْدٍ وَعَائِشَةَ وَمَعْقِلِ بْنِ سِنَانٍ وَيُقَالُ ابْنُ يَسَارٍ وَأَبِي هُرَيْرَةَ وَابْنِ عَبَّاسٍ وَأَبِي مُوسَى وَبِلاَلٍ ‏.‏ قَالَ أَبُو عِيسَى وَحَدِيثُ رَافِعِ بْنِ خَدِيجٍ حَدِيثٌ حَسَنٌ ‏.‏ وَذُكِرَ عَنْ أَحْمَدَ بْنِ حَنْبَلٍ أَنَّهُ قَالَ أَصَحُّ شَيْءٍ فِي هَذَا الْبَابِ حَدِيثُ رَافِعِ بْنِ خَدِيجٍ ‏.‏ وَذُكِرَ عَنْ عَلِيِّ بْنِ عَبْدِ اللَّهِ أَنَّهُ قَالَ أَصَحُّ شَيْءٍ فِي هَذَا الْبَابِ حَدِيثُ ثَوْبَانَ وَشَدَّادِ بْنِ أَوْسٍ لأَنَّ يَحْيَى بْنَ أَبِي كَثِيرٍ رَوَى عَنْ أَبِي قِلاَبَةَ الْحَدِيثَيْنِ جَمِيعًا حَدِيثَ ثَوْبَانَ وَحَدِيثَ شَدَّادِ بْنِ أَوْسٍ ‏.‏ وَقَدْ كَرِهَ قَوْمٌ مِنْ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم وَغَيْرِهِمُ الْحِجَامَةَ لِلصَّائِمِ حَتَّى أَنَّ بَعْضَ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم احْتَجَمَ بِاللَّيْلِ مِنْهُمْ أَبُو مُوسَى الأَشْعَرِيُّ وَابْنُ عُمَرَ وَبِهَذَا يَقُولُ ابْنُ الْمُبَارَكِ ‏.‏ قَالَ أَبُو عِيسَى سَمِعْتُ إِسْحَاقَ بْنَ مَنْصُورٍ يَقُولُ قَالَ عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ مَنِ احْتَجَمَ وَهُوَ صَائِمٌ فَعَلَيْهِ الْقَضَاءُ ‏.‏ قَالَ إِسْحَاقُ بْنُ مَنْصُورٍ وَهَكَذَا قَالَ أَحْمَدُ بْنُ حَنْبَلٍ وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ ‏.‏ وَقَالَ أَبُو عِيسَى وَأَخْبَرَنِي الْحَسَنُ بْنُ مُحَمَّدٍ الزَّعْفَرَانِيُّ قَالَ قَالَ الشَّافِعِيُّ قَدْ رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ احْتَجَمَ وَهُوَ صَائِمٌ وَرُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ قَالَ ‏"‏ أَفْطَرَ الْحَاجِمُ وَالْمَحْجُومُ ‏"‏ ‏.‏ وَلاَ أَعْلَمُ وَاحِدًا مِنْ هَذَيْنِ الْحَدِيثَيْنِ ثَابِتًا وَلَوْ تَوَقَّى رَجُلٌ الْحِجَامَةَ وَهُوَ صَائِمٌ كَانَ أَحَبَّ إِلَىَّ وَلَوِ احْتَجَمَ صَائِمٌ لَمْ أَرَ ذَلِكَ أَنْ يُفْطِرَهُ ‏.‏ قَالَ أَبُو عِيسَى هَكَذَا كَانَ قَوْلُ الشَّافِعِيِّ بِبَغْدَادَ وَأَمَّا بِمِصْرَ فَمَالَ إِلَى الرُّخْصَةِ وَلَمْ يَرَ بِالْحِجَامَةِ لِلصَّائِمِ بَأْسًا وَاحْتَجَّ بِأَنَّ النَّبِيَّ صلى الله عليه وسلم احْتَجَمَ فِي حَجَّةِ الْوَدَاعِ وَهُوَ مُحْرِمٌ صَائِمٌ ‏.‏

Kharasha b. Hurr reported:

I was sitting in a circle in the mosque of Medina and there was an old man, quite handsome. He was 'Abdullah b. Salim. He was telling good things to them (to the people sitting in that company). As he stood up (to depart) the people said: He who is desirous of looking at a person from amongst the people of Paradise should see him. I said: By Allah, I will follow him, and would try to know his residence. So I followed him and he walked on until he reached the outskirts of Medina. He then entered his house. I sought permission from him to get in, and he granted me the permission, saying: My nephew, what is the need (that has brought you here)? I said to him: As you stood up, I heard people say about you: He who is desirous of seeing a person from among the people of Paradise should look at him. So I became desirous of accompanying you. He ('Abdullah b. Salim) said: It is Allah Who knows best about the people of Paradise. I would, however, narrate to you as to why they said like it. (The story is) that while I was asleep (one night) there came to me a person (in the dream) who asked me to stand up. (So I stood up) and he caught hold of my hand and I walked along with him, and, lo, I found some paths on my left and I was about to set out upon them. Thereupon he said to me Do not set yourself on (them) for these are the paths of the leftists (denizens of Hell-fire). Then there were paths leading to the right side, whereupon he said: Set yourself on these paths. We came across a hill and he said to me: Climb up, and I attempted to climb up that I fell upon my buttocks. I made several attempts (but failed to succeed). He led until he came to a pillar (so high) that its upper end touched the sky and its base was in the earth. And there was a handhold at its upper end. He said to me Climb over it. I said: How can I climb upon it, as its upper end touches the sky? He cought hold of my hand and pushed me up and I found myself suspended with the handhold. He then struck the pillar and it fell down, but I remained attached to that handhold until it was morning (and the dream was thus over). I came to Allah's Apostle (may peace be upon him) and narrated it to him. He said: So far as the paths which you saw on your left are concerned, these are paths of the leftists (denizens of Hell) and the paths which you saw on your right, these are the paths of the rightists (the dwellers of Paradise) and the mountain represents the destination of the martyrs ...
حَدَّثَنَا قُتَيْبَةُ بْنُ سَعِيدٍ، وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ، - وَاللَّفْظُ لِقُتَيْبَةَ - حَدَّثَنَا جَرِيرٌ، عَنِ الأَعْمَشِ، عَنْ سُلَيْمَانَ بْنِ مُسْهِرٍ، عَنْ خَرَشَةَ بْنِ الْحُرِّ، قَالَ كُنْتُ جَالِسًا فِي حَلْقَةٍ فِي مَسْجِدِ الْمَدِينَةِ - قَالَ - وَفِيهَا شَيْخٌ حَسَنُ الْهَيْئَةِ وَهُوَ عَبْدُ اللَّهِ بْنُ سَلاَمٍ - قَالَ - فَجَعَلَ يُحَدِّثُهُمْ حَدِيثًا حَسَنًا - قَالَ - فَلَمَّا قَامَ قَالَ الْقَوْمُ مَنْ سَرَّهُ أَنْ يَنْظُرَ إِلَى رَجُلٍ مِنْ أَهْلِ الْجَنَّةِ فَلْيَنْظُرْ إِلَى هَذَا ‏.‏ قَالَ فَقُلْتُ وَاللَّهِ لأَتْبَعَنَّهُ فَلأَعْلَمَنَّ مَكَانَ بَيْتِهِ ‏.‏ قَالَ فَتَبِعْتُهُ فَانْطَلَقَ حَتَّى كَادَ أَنْ يَخْرُجَ مِنَ الْمَدِينَةِ ثُمَّ دَخَلَ مَنْزِلَهُ - قَالَ - فَاسْتَأْذَنْتُ عَلَيْهِ فَأَذِنَ لِي فَقَالَ مَا حَاجَتُكَ يَا ابْنَ أَخِي قَالَ فَقُلْتُ لَهُ سَمِعْتُ الْقَوْمَ يَقُولُونَ لَكَ لَمَّا قُمْتَ مَنْ سَرَّهُ أَنْ يَنْظُرَ إِلَى رَجُلٍ مِنْ أَهْلِ الْجَنَّةِ فَلْيَنْظُرْ إِلَى هَذَا ‏.‏ فَأَعْجَبَنِي أَنْ أَكُونَ مَعَكَ قَالَ اللَّهُ أَعْلَمُ بِأَهْلِ الْجَنَّةِ وَسَأُحَدِّثُكَ مِمَّ قَالُوا ذَاكَ إِنِّي بَيْنَمَا أَنَا نَائِمٌ إِذْ أَتَانِي رَجُلٌ فَقَالَ لِي قُمْ ‏.‏ فَأَخَذَ بِيَدِي فَانْطَلَقْتُ مَعَهُ - قَالَ - فَإِذَا أَنَا بِجَوَادَّ عَنْ شِمَالِي - قَالَ - فَأَخَذْتُ لآخُذَ فِيهَا فَقَالَ لِي لاَ تَأْخُذْ فِيهَا فَإِنَّهَا طُرُقُ أَصْحَابِ الشِّمَالِ - قَالَ - فَإِذَا جَوَادُّ مَنْهَجٌ عَلَى يَمِيِنِي فَقَالَ لِي خُذْ هَا هُنَا ‏.‏ فَأَتَى بِي جَبَلاً فَقَالَ لِي اصْعَدْ - قَالَ - فَجَعَلْتُ إِذَا أَرَدْتُ أَنْ أَصْعَدَ خَرَرْتُ عَلَى اسْتِي - قَالَ - حَتَّى فَعَلْتُ ذَلِكَ مِرَارًا - قَالَ - ثُمَّ انْطَلَقَ بِي حَتَّى أَتَى بِي عَمُودًا رَأْسُهُ فِي السَّمَاءِ وَأَسْفَلُهُ فِي الأَرْضِ فِي أَعْلاَهُ حَلْقَةٌ فَقَالَ لِيَ ‏.‏ اصْعَدْ فَوْقَ هَذَا ‏.‏ قَالَ قُلْتُ كَيْفَ أَصْعَدُ هَذَا وَرَأْسُهُ فِي السَّمَاءِ - قَالَ - فَأَخَذَ بِيَدِي فَزَجَلَ بِي - قَالَ - فَإِذَا أَنَا مُتَعَلِّقٌ بِالْحَلْقَةِ - قَالَ - ثُمَّ ضَرَبَ الْعَمُودَ فَخَرَّ - قَالَ - وَبَقِيتُ مُتَعَلِّقًا بِالْحَلْقَةِ حَتَّى أَصْبَحْتُ - قَالَ - فَأَتَيْتُ النَّبِيَّ صلى الله عليه وسلم فَقَصَصْتُهَا عَلَيْهِ فَقَالَ ‏ "‏ أَمَّا الطُّرُقُ الَّتِي رَأَيْتَ عَنْ يَسَارِكَ فَهِيَ طُرُقُ أَصْحَابِ الشِّمَالِ - قَالَ - وَأَمَّا الطُّرُقُ الَّتِي رَأَيْتَ عَنْ يَمِينِكَ فَهِيَ طُرُقُ أَصْحَابِ الْيَمِينِ وَأَمَّا الْجَبَلُ فَهُوَ مَنْزِلُ الشُّهَدَاءِ وَلَنْ تَنَالَهُ وَأَمَّا الْعَمُودُ فَهُوَ عَمُودُ الإِسْلاَمِ وَأَمَّا الْعُرْوَةُ فَهِيَ عُرْوَةُ الإِسْلاَمِ وَلَنْ تَزَالَ مُتَمَسِّكًا بِهَا حَتَّى تَمُوتَ ‏"‏ ‏.‏

Narrated `Ali:

I had a she-camel which I got in my share from the booty of the battle of Badr, and the Prophet had given me another she camel from the Khumus which Allah had bestowed on him that day. And when I intended to celebrate my marriage to Fatima, the daughter of the Prophet, I made an arrangement with a goldsmith from Bani Qainuqa 'that he should go with me to bring Idhkhir (i.e. a kind of grass used by gold-smiths) which I intended to sell to gold-smiths in order to spend its price on the marriage banquet. While I was collecting ropes and sacks of pack saddles for my two she-camels which were kneeling down beside an Ansari's dwelling and after collecting what I needed, I suddenly found that the humps of the two she-camels had been cut off and their flanks had been cut open and portions of their livers had been taken out. On seeing that, I could not help weeping. I asked, "Who has done that?" They (i.e. the people) said, "Hamza bin `Abdul Muttalib has done it. He is present in this house with some Ansari drinkers, a girl singer, and his friends. The singer said in her song, "O Hamza, get at the fat she-camels!" On hearing this, Hamza rushed to his sword and cut of the camels' humps and cut their flanks open and took out portions from their livers." Then I came to the Prophet, with whom Zaid bin Haritha was present. The Prophet noticed my state and asked, "What is the matter?" I said, "O Allah's Apostle, I have never experienced such a day as today! Hamza attacked my two she-camels, cut off their humps and cut their flanks open, and he is still present in a house along some drinkers." The Prophet asked for his cloak, put it on, and proceeded, followed by Zaid bin Haritha and myself, till he reached the house where Hamza was. He asked the permission to enter, and he was permitted. The Prophet started blaming Hamza for what he had done. Hamza was drunk and his eyes were red. He looked at the Prophet then raised his eyes to look at his knees and raised his eves more to look at his face and then said, "You are not but my father's slaves." When the Prophet understood that Hamza was drunk, he retreated, walking backwards went out and we left with him.

حَدَّثَنَا عَبْدَانُ، أَخْبَرَنَا عَبْدُ اللَّهِ، أَخْبَرَنَا يُونُسُ،‏.‏ حَدَّثَنَا أَحْمَدُ بْنُ صَالِحٍ، حَدَّثَنَا عَنْبَسَةُ، حَدَّثَنَا يُونُسُ، عَنِ الزُّهْرِيِّ، أَخْبَرَنَا عَلِيُّ بْنُ حُسَيْنٍ، أَنَّ حُسَيْنَ بْنَ عَلِيٍّ ـ عَلَيْهِمُ السَّلاَمُ ـ أَخْبَرَهُ أَنَّ عَلِيًّا قَالَ كَانَتْ لِي شَارِفٌ مِنْ نَصِيبِي مِنَ الْمَغْنَمِ يَوْمَ بَدْرٍ، وَكَانَ النَّبِيُّ صلى الله عليه وسلم أَعْطَانِي مِمَّا أَفَاءَ اللَّهُ عَلَيْهِ مِنَ الْخُمُسِ يَوْمَئِذٍ، فَلَمَّا أَرَدْتُ أَنْ أَبْتَنِيَ بِفَاطِمَةَ ـ عَلَيْهَا السَّلاَمُ ـ بِنْتِ النَّبِيِّ صلى الله عليه وسلم وَاعَدْتُ رَجُلاً صَوَّاغًا فِي بَنِي قَيْنُقَاعَ أَنْ يَرْتَحِلَ مَعِي فَنَأْتِيَ بِإِذْخِرٍ، فَأَرَدْتُ أَنْ أَبِيعَهُ مِنَ الصَّوَّاغِينَ فَنَسْتَعِينَ بِهِ فِي وَلِيمَةِ عُرْسِي، فَبَيْنَا أَنَا أَجْمَعُ لِشَارِفَىَّ مِنَ الأَقْتَابِ وَالْغَرَائِرِ وَالْحِبَالِ، وَشَارِفَاىَ مُنَاخَانِ إِلَى جَنْبِ حُجْرَةِ رَجُلٍ مِنَ الأَنْصَارِ، حَتَّى جَمَعْتُ مَا جَمَعْتُ فَإِذَا أَنَا بِشَارِفَىَّ قَدْ أُجِبَّتْ أَسْنِمَتُهَا، وَبُقِرَتْ خَوَاصِرُهُمَا، وَأُخِذَ مِنْ أَكْبَادِهِمَا، فَلَمْ أَمْلِكْ عَيْنَىَّ حِينَ رَأَيْتُ الْمَنْظَرَ، قُلْتُ مَنْ فَعَلَ هَذَا قَالُوا فَعَلَهُ حَمْزَةُ بْنُ عَبْدِ الْمُطَّلِبِ، وَهْوَ فِي هَذَا الْبَيْتِ، فِي شَرْبٍ مِنَ الأَنْصَارِ، عِنْدَهُ قَيْنَةٌ وَأَصْحَابُهُ فَقَالَتْ فِي غِنَائِهَا أَلاَ يَا حَمْزَ لِلشُّرُفِ النِّوَاءِ، فَوَثَبَ حَمْزَةُ إِلَى السَّيْفِ، فَأَجَبَّ أَسْنِمَتَهُمَا، وَبَقَرَ خَوَاصِرَهُمَا، وَأَخَذَ مِنْ أَكْبَادِهِمَا قَالَ عَلِيٌّ فَانْطَلَقْتُ حَتَّى أَدْخُلَ عَلَى النَّبِيِّ صلى الله عليه وسلم وَعِنْدَهُ زَيْدُ بْنُ حَارِثَةَ، وَعَرَفَ النَّبِيُّ صلى الله عليه وسلم الَّذِي لَقِيتُ فَقَالَ ‏ "‏ مَا لَكَ ‏"‏‏.‏ قُلْتُ يَا رَسُولَ اللَّهِ، مَا رَأَيْتُ كَالْيَوْمِ، عَدَا حَمْزَةُ عَلَى نَاقَتَىَّ، فَأَجَبَّ أَسْنِمَتَهُمَا، وَبَقَرَ خَوَاصِرَهُمَا وَهَا هُوَ ذَا فِي بَيْتٍ مَعَهُ شَرْبٌ، فَدَعَا النَّبِيُّ صلى الله عليه وسلم بِرِدَائِهِ، فَارْتَدَى ثُمَّ انْطَلَقَ يَمْشِي، وَاتَّبَعْتُهُ أَنَا وَزَيْدُ بْنُ حَارِثَةَ، حَتَّى جَاءَ الْبَيْتَ الَّذِي فِيهِ حَمْزَةُ، فَاسْتَأْذَنَ عَلَيْهِ فَأُذِنَ لَهُ، فَطَفِقَ النَّبِيُّ صلى الله عليه وسلم يَلُومُ حَمْزَةَ فِيمَا فَعَلَ، فَإِذَا حَمْزَةُ ثَمِلٌ مُحْمَرَّةٌ عَيْنَاهُ، فَنَظَرَ حَمْزَةُ إِلَى النَّبِيِّ صلى الله عليه وسلم ثُمَّ صَعَّدَ النَّظَرَ، فَنَظَرَ إِلَى رُكْبَتِهِ، ثُمَّ صَعَّدَ النَّظَرَ، فَنَظَرَ إِلَى وَجْهِهِ، ثُمَّ قَالَ حَمْزَةُ وَهَلْ أَنْتُمْ إِلاَّ عَبِيدٌ لأَبِي فَعَرَفَ النَّبِيُّ صلى الله عليه وسلم أَنَّهُ ثَمِلٌ، فَنَكَصَ رَسُولُ اللَّهِ صلى الله عليه وسلم عَلَى عَقِبَيْهِ الْقَهْقَرَى، فَخَرَجَ وَخَرَجْنَا مَعَهُ‏.‏

Ibn Shihab said:

'Umar b. 'Abdul 'Aziz was sitting on the pulpit and he somewhat postponed the afternoon prayer. 'Urwah b. al-Zubair said to him: "Gabriel informed Muhammed (saws) of the time of prayer". So 'Umar said to him: "Be sure of what you are saying". 'Urwah then replied: "I heard Bashir b. Abu Mas'ud say that he heard Abu Mas'ud al-Ansari say that he heard the Messenger of Allah (saws) say: 'Gabriel came down and informed me of the time of prayer, and I prayed along with him, then prayed along with him, then I prayed along with him, then I prayed along with him, then I prayed along with him, reckoning with his fingers five times of the prayer.' I saw the Messenger of Allah (saws) offering the Duhr prayer when the sun had passed the meridian. Sometimes he would delay it when it was sever heat ; and I witnessed that he prayer the 'Asr prayer when the sun was high and bright before the yellowness had overcome it; then a man could go off after the prayer and reach Dhu'l-Hulaifah before the sunset, and he would pray Maghrib when the sun had set ; and he would pray the 'Isha prayer when darkness prevailed over the horizon; sometime he would delay it until the people assembled; and once he prayer the fair prayer in the darkness of dawn and at another time he prayed it when it became fairly light; but later on he continued to pray in the darkness of dawn until his death; he never prayed it again in the light of the dawn."

Abu Dawud said: This tradition has been transmitted from al-Zuhri by Ma'mar, Malik, Ibn 'Uyainah, Shu'aib b. Abi Hamzah, and al-Laith b. Sa'd and others; but they did not mention the time in which he (the Prophet) had prayer, nor did they explain it. And similarly it has been narrated by Hisham b. 'Urwah and Habib b. Abu Mazruq from 'Urwah like the report of Ma'mar and his companions. But Habib did not make a mention of Bashir. And Wahb b. Kaisan reported on the authority of Jabir from the Prophet (saws) the time of the Maghrib prayer. He said: "Next day he (Gabriel) came to him at the time of the Maghrib prayer when the sun had already set. (He came both days) at the same time."

Abu Dawud said: Similarly, this tradition has been transmitted by Abu Hurairah from the Prophet (saws). He said: "Then he (Gabriel) led me in the sunset prayer next day at the same time."

Similarly, this tradition has been narrated through a different chain by 'Abd Allah b. 'Amr b. al-'As, through a chain from Hassan b. ...

حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ الْمُرَادِيُّ، حَدَّثَنَا ابْنُ وَهْبٍ، عَنْ أُسَامَةَ بْنِ زَيْدٍ اللَّيْثِيِّ، أَنَّ ابْنَ شِهَابٍ، أَخْبَرَهُ أَنَّ عُمَرَ بْنَ عَبْدِ الْعَزِيزِ كَانَ قَاعِدًا عَلَى الْمِنْبَرِ فَأَخَّرَ الْعَصْرَ شَيْئًا فَقَالَ لَهُ عُرْوَةُ بْنُ الزُّبَيْرِ أَمَا إِنَّ جِبْرِيلَ صلى الله عليه وسلم قَدْ أَخْبَرَ مُحَمَّدًا صلى الله عليه وسلم بِوَقْتِ الصَّلاَةِ فَقَالَ لَهُ عُمَرُ اعْلَمْ مَا تَقُولُ ‏.‏ فَقَالَ عُرْوَةُ سَمِعْتُ بَشِيرَ بْنَ أَبِي مَسْعُودٍ يَقُولُ سَمِعْتُ أَبَا مَسْعُودٍ الأَنْصَارِيَّ يَقُولُ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ نَزَلَ جِبْرِيلُ صلى الله عليه وسلم فَأَخْبَرَنِي بِوَقْتِ الصَّلاَةِ فَصَلَّيْتُ مَعَهُ ثُمَّ صَلَّيْتُ مَعَهُ ثُمَّ صَلَّيْتُ مَعَهُ ثُمَّ صَلَّيْتُ مَعَهُ ثُمَّ صَلَّيْتُ مَعَهُ ‏"‏ ‏.‏ يَحْسُبُ بِأَصَابِعِهِ خَمْسَ صَلَوَاتٍ فَرَأَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم صَلَّى الظُّهْرَ حِينَ تَزُولُ الشَّمْسُ وَرُبَّمَا أَخَّرَهَا حِينَ يَشْتَدُّ الْحَرُّ وَرَأَيْتُهُ يُصَلِّي الْعَصْرَ وَالشَّمْسُ مُرْتَفِعَةٌ بَيْضَاءُ قَبْلَ أَنْ تَدْخُلَهَا الصُّفْرَةُ فَيَنْصَرِفُ الرَّجُلُ مِنَ الصَّلاَةِ فَيَأْتِي ذَا الْحُلَيْفَةِ قَبْلَ غُرُوبِ الشَّمْسِ وَيُصَلِّي الْمَغْرِبَ حِينَ تَسْقُطُ الشَّمْسُ وَيُصَلِّي الْعِشَاءَ حِينَ يَسْوَدُّ الأُفُقُ وَرُبَّمَا أَخَّرَهَا حَتَّى يَجْتَمِعَ النَّاسُ وَصَلَّى الصُّبْحَ مَرَّةً بِغَلَسٍ ثُمَّ صَلَّى مَرَّةً أُخْرَى فَأَسْفَرَ بِهَا ثُمَّ كَانَتْ صَلاَتُهُ بَعْدَ ذَلِكَ التَّغْلِيسَ حَتَّى مَاتَ وَلَمْ يَعُدْ إِلَى أَنْ يُسْفِرَ ‏.‏ قَالَ أَبُو دَاوُدَ وَرَوَى هَذَا الْحَدِيثَ عَنِ الزُّهْرِيِّ مَعْمَرٌ وَمَالِكٌ وَابْنُ عُيَيْنَةَ وَشُعَيْبُ بْنُ أَبِي حَمْزَةَ وَاللَّيْثُ بْنُ سَعْدٍ وَغَيْرُهُمْ لَمْ يَذْكُرُوا الْوَقْتَ الَّذِي صَلَّى فِيهِ وَلَمْ يُفَسِّرُوهُ وَكَذَلِكَ أَيْضًا رَوَاهُ هِشَامُ بْنُ عُرْوَةَ وَحَبِيبُ بْنُ أَبِي مَرْزُوقٍ عَنْ عُرْوَةَ نَحْوَ رِوَايَةِ مَعْمَرٍ وَأَصْحَابِهِ إِلاَّ أَنَّ حَبِيبًا لَمْ يَذْكُرْ بَشِيرًا وَرَوَى وَهْبُ بْنُ كَيْسَانَ عَنْ جَابِرٍ عَنِ النَّبِيِّ صلى الله عليه وسلم وَقْتَ الْمَغْرِبِ قَالَ ثُمَّ جَاءَهُ لِلْمَغْرِبِ حِينَ غَابَتِ الشَّمْسُ - يَعْنِي مِنَ الْغَدِ - وَقْتًا وَاحِدًا ‏.‏ قَالَ أَبُو دَاوُدَ وَكَذَلِكَ رُوِيَ عَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ثُمَّ صَلَّى بِيَ الْمَغْرِبَ يَعْنِي مِنَ الْغَدِ وَقْتًا وَاحِدًا وَكَذَلِكَ رُوِيَ عَنْ عَبْدِ اللَّهِ بْنِ عَمْرِو بْنِ الْعَاصِ مِنْ حَدِيثِ حَسَّانَ بْنِ عَطِيَّةَ عَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ عَنِ النَّبِيِّ صلى الله عليه وسلم ‏.‏

It is narrated on the authority of Jarir that he heard (the Holy Prophet) saying, The slave who fled from his master committed an act of infidelity as long as he would not return to him. Mansur observed:

By God, this hadith was narrated from the Apostle (may peace and blessings be upon him), but I do not like that this should be narrated on my authority here in Basra.
حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ السَّعْدِيُّ، حَدَّثَنَا إِسْمَاعِيلُ، - يَعْنِي ابْنَ عُلَيَّةَ - عَنْ مَنْصُورِ بْنِ عَبْدِ الرَّحْمَنِ، عَنِ الشَّعْبِيِّ، عَنْ جَرِيرٍ، أَنَّهُ سَمِعَهُ يَقُولُ ‏ "‏ أَيُّمَا عَبْدٍ أَبَقَ مِنْ مَوَالِيهِ فَقَدْ كَفَرَ حَتَّى يَرْجِعَ إِلَيْهِمْ ‏"‏ ‏.‏ قَالَ مَنْصُورٌ قَدْ وَاللَّهِ رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم وَلَكِنِّي أَكْرَهُ أَنْ يُرْوَى عَنِّي هَا هُنَا بِالْبَصْرَةِ ‏.‏

The people said to the Apostle of Allah (may peace be upon him): Messenger of Allah I shall we see our Lord on the Day of Resurrection? The rest of the hadith was narrated according to the narration of Ibrahim b. Sa'd.

Abu Sa'id al-Khudri reported:

Verily, the Messenger of Allah (may peace be upon him) said: The least tormented of the inhabitants of the Fire would be he who would wear two shoes of Fire and his brain would boil on account of the heat of the shoes.

Ibn'Abbas reported on the authority of Maimuna that someone amongst the wives of the Messenger of Allah (may peace be upon him) had a domestic animal and it died. Upon this the Messenger of Allah (may peace be upon him) said:

Why did you not take off its skin and make use of that?
حَدَّثَنَا أَحْمَدُ بْنُ عُثْمَانَ النَّوْفَلِيُّ، حَدَّثَنَا أَبُو عَاصِمٍ، حَدَّثَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي عَمْرُو بْنُ دِينَارٍ، أَخْبَرَنِي عَطَاءٌ، مُنْذُ حِينٍ قَالَ أَخْبَرَنِي ابْنُ عَبَّاسٍ، أَنَّ مَيْمُونَةَ، أَخْبَرَتْهُ أَنَّ دَاجِنَةً كَانَتْ لِبَعْضِ نِسَاءِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَمَاتَتْ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ أَلاَّ أَخَذْتُمْ إِهَابَهَا فَاسْتَمْتَعْتُمْ بِهِ ‏"‏ ‏.‏

Narrated Mu'adh ibn Jabal:

When the Prophet (saws) sent him to the Yemen, he ordered him to take a male or a female calf a year old for every thirty cattle and a cow in its third year for every forty, and one dinar for every adult (unbeliever as a poll-tax) or cloths of equivalent value manufactured in the Yemen.

حَدَّثَنَا النُّفَيْلِيُّ، حَدَّثَنَا أَبُو مُعَاوِيَةَ، عَنِ الأَعْمَشِ، عَنْ أَبِي وَائِلٍ، عَنْ مُعَاذٍ، أَنَّ النَّبِيَّ صلى الله عليه وسلم لَمَّا وَجَّهَهُ إِلَى الْيَمَنِ أَمَرَهُ أَنْ يَأْخُذَ مِنَ الْبَقَرِ مِنْ كُلِّ ثَلاَثِينَ تَبِيعًا أَوْ تَبِيعَةً وَمِنْ كُلِّ أَرْبَعِينَ مُسِنَّةً وَمِنْ كُلِّ حَالِمٍ - يَعْنِي مُحْتَلِمًا - دِينَارًا أَوْ عِدْلَهُ مِنَ الْمَعَافِرِ ثِيَابٌ تَكُونُ بِالْيَمَنِ ‏.‏

A man of Banu Amir said: Messenger of Allah, my father is very old, he cannot perform hajj and umrah himself nor can be ride on a mount. He said: Perform hajj and umrah on behalf of your father.

Narrated Mutarrif ibn Abdullah:

Imran ibn Husayn was asked about a person who divorces his wife, and then has intercourse with her, but he does not call any witness to her divorce nor to her restoration. He said: You divorced against the sunnah and took her back against the sunnah. Call someone to bear witness to her divorce, and to her return in marriage, and do not repeat it.

حَدَّثَنَا بِشْرُ بْنُ هِلاَلٍ، أَنَّ جَعْفَرَ بْنَ سُلَيْمَانَ، حَدَّثَهُمْ عَنْ يَزِيدَ الرِّشْكِ، عَنْ مُطَرِّفِ بْنِ عَبْدِ اللَّهِ، أَنَّ عِمْرَانَ بْنَ حُصَيْنٍ، سُئِلَ عَنِ الرَّجُلِ، يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقَعُ بِهَا وَلَمْ يُشْهِدْ عَلَى طَلاَقِهَا وَلاَ عَلَى رَجْعَتِهَا فَقَالَ طَلَّقْتَ لِغَيْرِ سُنَّةٍ ‏.‏ وَرَاجَعْتَ لِغَيْرِ سُنَّةٍ أَشْهِدْ عَلَى طَلاَقِهَا وَعَلَى رَجْعَتِهَا وَلاَ تَعُدْ ‏.‏

Al-Qasim, the client of AbdurRahman, quoted one of the Companion of the Prophet (saws) as saying: We would eat a camel on an expedition without dividing it, and when we returned to our dwellings our saddle-bags would be full with its flesh.

Umar said while he was (sitting) on the pulpit: O people, the opinion from the Messenger of Allah (saws) was right, because Allah showed (i.e. inspired) him; but from us it is sheer conjecture and artifice.

Narrated Kabshah daughter of AbuBakrah:

(the narrator other than Musa said that Kayyisah daughter of AbuBakrah) She said that her father used to forbid his family to have themselves cupped on a Tuesday, and used to assert on the authority of the Messenger of Allah (saws) that Tuesday is the day of blood in which there is an hour when it does not stop.

Narrated Umm Salamah, Ummul Mu'minin:

Safinah said: I was a slave of Umm Salamah, and she said: I shall emancipate you, but I stipulate that you must serve the Messenger of Allah (saws) as long as you live. I said: Even if you do not make a stipulation, I shall not leave the Messenger of Allah (saws). She then emancipated me and made the stipulation with me.

حَدَّثَنَا مُسَدَّدُ بْنُ مُسَرْهَدٍ، حَدَّثَنَا عَبْدُ الْوَارِثِ، عَنْ سَعِيدِ بْنِ جُمْهَانَ، عَنْ سَفِينَةَ، قَالَ كُنْتُ مَمْلُوكًا لأُمِّ سَلَمَةَ فَقَالَتْ أُعْتِقُكَ وَأَشْتَرِطُ عَلَيْكَ أَنْ تَخْدُمَ رَسُولَ اللَّهِ صلى الله عليه وسلم مَا عِشْتَ ‏.‏ فَقُلْتُ إِنْ لَمْ تَشْتَرِطِي عَلَىَّ مَا فَارَقْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم مَا عِشْتُ فَأَعْتَقَتْنِي وَاشْتَرَطَتْ عَلَىَّ ‏.‏
