Sahih Muslim 393

Mutarrif reported:

I and 'Imran b. Husain said prayer behind 'Ali b. Abu, Talib. He recited takbir when he prostrated, and he recited takbir when he raised his head and he recited takbir while rising up (from the sitting position at the end of two rak'ahs). When we had finished our prayer, 'Imran caught hold of my hand and said: He (Hadrat Ali) has led prayer like Muhammad (may peace be upon him) or he said: He in fact recalled to my mind the prayer of Muhammad (may peace be upon him.)

Sunan Abi Dawud 2851

Narrated Adi ibn Hatim:

The Prophet (saws) said: Eat what ever is caught for you by a dog or a hawk you have trained and set off when you have mentioned Allah's name. I said: (Does this apply) if it killed (the animal)? He said: When it kills it without eating any of it, for it caught it only for you.

Abu Dawud said: If a hawk eats any of it, there is no harm (in eating it). If a dog eats it, it is disapproved (to eat the meat). If it drinks blood, there is no harm (in eating it).

`Imran bin Husain and I offered the prayer behind `Ali bin Abi Talib. When `Ali prostrated, he said the Takbir, when he raised his head, he said the Takbir and when he got up for the third rak`a he said the Takbir. Narrated Nafi`:

Ibn `Umar said, "When Allah's Apostle performed the first Tawaf he did Ramal in the first three rounds and then walked in the remaining four rounds (of Tawaf of the Ka`ba), where as in performing Tawaf between Safa and Marwa he used to run in the midst of the rainwater passage," I asked Nafi`, "Did `Abdullah (bin `Umar) use to walk steadily on reaching the Yemenite Corner?" Khalid ibn 'Umair and Shuwais Abur-Ruqad said:
“'Umar ibn al-Khattab dispatched 'Utba ibn Ghazwan, and he said: ‘Go away, you and whoever is with you, until you reach the most remote countries of the Arabs and the nearest countries of the non-Arabs!’ They therefore advanced until, when they reached al-Mirbad, they found this soft stone-like clay, so they said: ‘What is this?’ They were told: ‘This is Basra,’ so they traveled until they were in the vicinity of the small bridge. They said: ‘Here is our appointed destination,’ so they alighted and related the story from beginning to end. 'Utba ibn Ghazwan said: ‘I found myself the seventh of seven with Allah’s Messenger (Allah bless him and give him peace). We ate nothing but tree-leaves until the corners of our mouths were covered with ulcers, so I picked up a garment which I divided between me and Sa'd, for there was not one of us among those seven who was not the governor of a city, and you will put the governors to the test after us.”

Yahya related to me from Malik that he heard Ibn Shihab say, "The precedent of the sunna when a man injures a woman is that he must pay the blood- money for that injury and there is no retaliation against him."

Malik said, "That is an accidental injury, when a man strikes a woman and hits with a blow what he did not intend, for instance, if he struck her with a whip and cut her eye open and the like of that."

Malik said about a woman who has a husband and children who are not from her paternal relatives or her people, that since he is from another tribe, there is no blood-money against her husband for her criminal action, nor any against her children if they are not from her people, nor any against her maternal brothers when they are not from her paternal relations or her people. These are entitled to her inheritance but only the paternal relations have paid blood-money from since the time of the Messenger of Allah, may Allah bless him and grant him peace. Until today it is like that with the mawla of a woman. The inheritance they leave goes to the children of the woman even if they are not from her tribe, but the blood-money of the criminal act of the mawla is only against her tribe."

I said: 'O Messenger of Allah, may my father and mother be ransomed for you! Teach it to me.' He said: 'You should not learn it, O 'Aishah.' So I moved aside and sat for a while, then I got up and kissed his head, then I said: 'O Messenger of Allah, teach it to me.' He said: 'You should not learn it, O 'Aishah, and I should not teach it to you, for you should not ask for any worldly things thereby.'" She said: "So I got up and performed ablution, then I prayed two Rak'ah, then I said: 'O Allah, I call upon Allah, and I call upon You, Ar-Rahman (the Most Gracious), and I call upon You, Al-Barr Ar-Rahim (The Most Kind, the Most Merciful), and I call upon You by all Your beautiful Names, those that I know and those that I do not know, (asking) that You forgive me and have mercy on me.' Al-Hasan ibn 'Ali said (may Allah the Exalted be well pleased with him and his father):
“I said to my maternal uncle, Hind ibn Abi Hala, who was skilled at describing people: ‘Describe for me the manner of speech Allah’s Messenger (Allah bless him and give him peace)!’ He said: Allah’s Messenger (Allah bless him and give him peace) was constantly sympathetic with sorrows, persistent in thought, having no repose, prolonged in silence. He would not speak unnecessarily. He would introduce and conclude his speech with: 'Bismillahi ta'ala [In the Name of Allah, Exalted is He]!' He would speak using simple words bearing many profound meanings [bi-jawami'i ’l-kalim]. His speech was concise, neither excessive nor abridged. It was neither uncouth nor contemptible. He would extol a blessing, however small, and he would not find fault with any aspect of it. He neither condemned nor praised those who enjoyed food and drink, and he would not be angered by this world. If the truth were overstepped, he would be so furious that he could do nothing but right the wrong. He would not be angry for his own sake or come to his own defense. When he beckoned, he beckoned with the whole of the palm of his hand, and when he was astonished, he turned it over, and when he spoke, he gestured with his hands, and placed his right palm over the base of his left thumb. When he was angry, he turned away and averted his face, and when he was happy, he lowered his gaze. Most of his laughter was in the form of a smile that revealed teeth as white as hailstones'.”

When they saw a cloud formation coming towards their valleys they said it was a cloud formation which would give them rain.” A version says that when he saw rain he would say, “Make it a blessing.” (Bukhari and Muslim.)

Then they will be given Hamim with meat hooks, so when it comes toward their faces it melts their faces, and when it enters their insides it cuts up what is inside of them. So (some of them) say: 'Call the keepers of Hell' so they say: Did there not come to you your Messengers with clear signs? They say: 'Yes!' They say: 'Then call as you like.' And the invocation of the disbelievers is nothing but in vain." He said: "They will say: 'Call Malik.' So they say: O Malik! Let your Lord make an end of us!'" He said: "So he answers them: Verily you shall abide forever. Al-A'mash said: "I was informed that there is a thousand years between their calling him, and Malik's answering them." He said: "They say: 'Call your Lord, for there is none better than your Lord.' So they will say: Our Lord! Our wretchedness over came us, and we were (an) erring people. Our Lord! Bring us out of this. If we ever return (to evil), indeed we shall be wrong doers."He said: "So the reply to them is: You remain in it in ignominy! And do not speak to Me." He said: "So with that, they loose hope of any good, and with that they are taken to moaning, despair and severe ruin."

Narrated Al-Bara:

When the Prophet intended to perform `Umra in the month of Dhul-Qada, the people of Mecca did not let him enter Mecca till he settled the matter with them by promising to stay in it for three days only. When the document of treaty was written, the following was mentioned: 'These are the terms on which Muhammad, Allah's Apostle agreed (to make peace).' They said, "We will not agree to this, for if we believed that you are Allah's Apostle we would not prevent you, but you are Muhammad bin `Abdullah." The Prophet said, "I am Allah's Apostle and also Muhammad bin `Abdullah." Then he said to `Ali, "Rub off (the words) 'Allah's Apostle' ", but `Ali said, "No, by Allah, I will never rub off your name." So, Allah's Apostle took the document and wrote, 'This is what Muhammad bin `Abdullah has agreed upon: No arms will be brought into Mecca except in their cases, and nobody from the people of Mecca will be allowed to go with him (i.e. the Prophet ) even if he wished to follow him and he (the Prophet ) will not prevent any of his companions from staying in Mecca if the latter wants to stay.' When the Prophet entered Mecca and the time limit passed, the Meccans went to `Ali and said, "Tell your Friend (i.e. the Prophet ) to go out, as the period (agreed to) has passed." So, the Prophet went out of Mecca. The daughter of Hamza ran after them (i.e. the Prophet and his companions), calling, "O Uncle! O Uncle!" `Ali received her and led her by the hand and said to Fatima, "Take your uncle's daughter." Zaid and Ja`far quarreled about her. `Ali said, "I have more right to her as she is my uncle's daughter." Ja`far said, "She is my uncle's daughter, and her aunt is my wife." Zaid said, "She is my brother's daughter." The Prophet judged that she should be given to her aunt, and said that the aunt was like the mother. He then said to 'All, "You are from me and I am from you", and said to Ja`far, "You resemble me both in character and appearance", and said to Zaid, "You are our brother (in faith) and our freed slave."

Narrated 'Ubaidullah bin Abi Rafi`:

I heard `Ali saying, "Allah's Apostle sent me, Az-Zubair and Al-Miqdad somewhere saying, 'Proceed till you reach Rawdat Khakh. There you will find a lady with a letter. Take the letter from her.' " So, we set out and our horses ran at full pace till we got at Ar-Rawda where we found the lady and said (to her). "Take out the letter." She replied, "I have no letter with me." We said, "Either you take out the letter or else we will take off your clothes." So, she took it out of her braid. We brought the letter to Allah's Apostle and it contained a statement from Hatib bin Abi Balta a to some of the Meccan pagans informing them of some of the intentions of Allah's Apostle. Then Allah's Apostle said, "O Hatib! What is this?" Hatib replied, "O Allah's Apostle! Don't hasten to give your judgment about me. I was a man closely connected with the Quraish, but I did not belong to this tribe, while the other emigrants with you, had their relatives in Mecca who would protect their dependents and property . So, I wanted to recompense for my lacking blood relation to them by doing them a favor so that they might protect my dependents. I did this neither because of disbelief not apostasy nor out of preferring Kufr (disbelief) to Islam." Allah's Apostle, said, "Hatib has told you the truth." `Umar said, O Allah's Apostle! Allow me to chop off the head of this hypocrite." Allah's Apostle said, "Hatib participated in the battle of Badr, and who knows, perhaps Allah has already looked at the Badr warriors and said, 'Do whatever you like, for I have forgiven you."

Abu Dharr said:
One day I was riding behind God's messenger on a donkey, and when we had got beyond the houses of Medina he asked, "How will you do, Abu Dharr, when there is famine in Medina and you get up from your bed but do not reach your mosque before being overcome by hunger?" When I replied that God and His messenger knew best, he said, "Restrain yourself, Abu Dharr." He then asked, "How will you do, Abu Dharr, when there will be death in Medina and a house[1] will reach the value of a slave so that a grave will be sold for a slave?" When I replied that God and His messenger knew best he said, "You must show endurance, Abu Dharr." He then asked, "How will you do, Abu Dharr, when there is slaughter in Medina and. Ahjar az Zait[2] will be covered with blood?" When I replied that God and His messenger knew best he said, "You must go to those who are like-minded with you." I asked whether I should arm myself and replied, "You would then associate yourself with the people." So I asked God's messenger how I should act and he replied, "If you are afraid the gleam of the sword may dazzle you put the end of your garment over your face in order that [the one who kills you may bear the punishment of your sin and his." Used figuratively for a grave, the meaning being made more explicit in the words which follow. Ahjar Az-Zait, an area outside of Al Madinah. Abu Dawud transmitted it.

Yahya related to me from Malik that he asked Ibn Shihab about the one-eyed man who gouged out the eye of a healthy person. Ibn Shihab said, "If the healthy person wants to take retaliation from him, he can have his retaliation. If he prefers, he has blood-money of one thousand dinars, twelve thousand dirhams."

Yahya related to me from Malik that he heard that full blood- money was payable for both of a pair of anything in a man that occurred in pairs, and the tongue had full blood-money. The ears, when their hearing departed, had full blood-money, whether or not they were cut off, and a man's penis had full blood-money and the testicles had full blood-money.

Yahya related to me from Malik that he heard that the breasts of a woman had full blood-money.

Malik said, "The least of that are the eyebrows and a man's breasts."

Malik said, "What is done in our community when a man is injured in his extremities to an extent that obliges payment of more than the amount of his full blood-money, is that it is his right. If his hands, feet, and eyes are all injured, he has three full blood-moneys."

Malik said about the sound eye of a one-eyed man when it is accidentally gouged out, "The full blood-money is payable for it."

Yahya related to me from Malik that Yahya ibn Said al-Ansari said that Muhammad ibn Ibrahim ibn al-Harith at-Taymi told him from Isa ibn Talha ibn Ubaydullah, fromUmayr ibn Salama ad-Damri, from al-Bahzi, that the Messenger of Allah, may Allah bless him and grant him peace, set out once for Makka while in ihram. When they had reached ar-Rawha, they unexpectedly came upon a wounded wild ass. Someone mentioned it to the Messenger of Allah, may Allah bless him and grant him peace, and hesaid, "Leave it. The man to whom it belongs is about to come." Then al-Bahzi, who was the man, came to the Prophet, may Allah bless him and grant him peace, and said, "Messenger of Allah, do whatever you want with this ass,' and the Messenger of Allah, may Allah bless him and grant him peace, told Abu Bakr to divide it up among the company. Then they went on until they came to the well of al-Uthaba, which was between ar-Ruwaytha and al-Arj (between Makka and Madina), where they unexpectedly came upon a gazelle with an arrow in it, Iying on its side in some shade. He claimed that the Messenger of Allah, may Allah bless him and grant him peace, told someone to stand by it to make sure no one disturbed it until everyone had passed by.

‘A’isha said that God’s Messenger used to begin prayer with the takbir1 and the recitation of “Praise be to God, the Lord of the universe.”2 When he bowed he neither kept his head up nor bent it down, but kept it between these extremes; when he raised his head after bowing he did not prostrate himself till he had stood erect; when he raised head after a prostration he did not prostrate himself again till he had sat up. At the end of every two rak'as he said the tahiya;3 and he used to bend his left foot and raise up the right; he prohibited the devil’s way of sitting on the heels, and he forbade people to spread out their arms like a wild beast. And he used to finish the prayer with the taslim4. Muslim transmitted it. 1. i.e. saying Allahu Akbar (God is most great). 2. Al-Qur’an; 1. 3. This is a part of the prayers which comes at the end of every two rak'as, beginning with at-tahiyat lillah and ending with the testimony that there is no god but God and that Muhammad is His servant and Messenger. Tahiyat is the plural of tahiya and the phrase quoted above is variously explained as meaning that endless existence, or dominion, or kingship, or freedom from all evils, or freedom from all causes of cessation of existence belong to God. Alternatively it is taken in its usual meaning of salutations. 4. Saying, “The peace and mercy of God be upon you,” first with the head turned to the right and then with the head turned to the left. This is said at the end of the prayers.

Abu Huraira reported God’s Messenger as saying, “Say Amen when the imam says it, for if anyone’s utterance of Amen synchronises with that of the angels, he will be forgiven his past sins. ’ (Bukhari and Muslim.) In a version he said, “When the imam says, ‘Not of those with whom Thou art angry nor of those who go astray’, say Amen, for if anyone’s words synchronise with those of the angels he will be forgiven his past sins.” This is Bukhari’s wording, and Muslim has something similar. In another version by Bukhari he said, “Say Amen when the reciter (i.e. the imam) says it, for the angels do so, and if anyone’s utterance of Amen synchronises with that of the angels, he will be forgiven his past sins.”

Abu Musa al-Ash‘ari reported God’s Messenger as saying:
When you pray make your rows straight and let one of your number act as your imam. If you say the takbir when he says it and say Amen when he says “Not of those with whom Thou art angry nor of those who go astray”, God will accept your prayer. When he says the takbir and bows, say it and bow, for the imam bows before you and raises himself before you. Then God’s Messenger said, “The one is equivalent to the other.”* And he said: If you say, “O God our Lord, to Thee be the praise,” when he says, “God listens to him who praises him,” God will listen to you. * Although the imam begins and ends his bowing before you do, your bow lasts the same length of time as his. Muslim transmitted it. In a version by him from Abu Huraira and Qatada the words occur, “And when he recites listen silently.”

If he is uncertain as to whether he has prayed two or three, let him assume it is two. If he is uncertain as to whether he has prayed three or four, let him assume it is three. Yahya related to me from Malik from Yahya ibn Said from Sulayman ibn Yasar that Zayd ibn Thabit used to say, "When the eye remains but the sight is lost, one hundred dinars are payable for it."

Yahya said, "Malik was asked about cutting off the lower lid of the eye and the bone around the eye. He said, 'There is only ijtihad in that unless the vision of the eye is impaired. He is entitled to an amount that is compatible to the extent the vision of the eye has been impaired."

Yahya said that Malik said, "What is done in our community about removing the bad eye of a one-eyed man when it has already been blinded and still remains there in its place and the paralyzed hand when it is cut off, is that there is only ijtihad in that, and there is no prescribed blood-money."

Ash-Sha'bi said:

A Muslim was about to die at Daquqa', but he did not find any Muslim to call him for witness to his will. So he called two men of the people of the Book for witness. Then they came to Kufah, and approaching AbuMusa al-Ash'ari they informed him (about his) will. They brought his inheritance and will. Al-Ash'ari said: This is an incident (like) which happened in the time of the Messenger of Allah (saws) and never occurred after him. So he made them to swear by Allah after the afternoon prayer to the effect that they had not misappropriated, nor told a lie, nor changed, nor concealed, nor altered, and that it was the will of the man and his inheritance. He then executed their witness.

Narrated Abdullah ibn Mas'ud:

The Prophet of Allah (saws) disliked ten things: Yellow colouring, meaning khaluq, dyeing grey hair, trailing the lower garment, wearing a gold signet-ring, a woman decking herself before people who are not within the prohibited degrees, throwing dice, using invocations except with the Mu'awwidhatan, wearing amulets, withdrawing the penis before the semen is discharged, in the case of a woman who is wife or not a wife, and having intercourse with a woman who is suckling a child; but he did not declare them to be prohibited.

Abu Dawud said: Only the transmitters of Basrah have transmitted this tradition.

Muhammad b. Qais b. Makhrama said that God’s messenger addressed the people as follows, “The people of pre-Islamic times used to return from 'Arafa when the sun before setting was shining in their faces like men’s turbans, and from al-Muzdalifa after the sun rose when it was shining in their faces like men’s turbans; (When the sun is low it shines only on men’s foreheads, and this is here likened to a turban) but we do not return from ‘Arafa till the sun sets, and we return from al-Muzdalifa before the sun rises. Our guidance differs from that of the worshippers of idols and those who attribute partners to God.” Baihaqi transmitted it in Shu'ab al-iman, saying “He addressed us . . .” and then going on, with the tradition to similar effect.

Al-Irbad b. Sariya told that on the day of Khaibar God's messenger forbade every carnivorous beast which had a fang, every bird which had a claw, the flesh of domestic asses, the mujaththama, the khalisa, and sexual intercourse with pregnant wbmen till they have given birth to a child. Muhammad b. Yahya* said that Abu ‘Asim was asked about the mujaththama and said it meant a bird or something else being set up and shot at. He was asked about the khalisa and said it was an animal taken from a wolf or a beast of prey by a man who has caught up on it, but which dies in his hand before he can slaughter it. *Tirmidhi’s immediate authority. Mujammi' b. Jariya said:
Khaibar was divided among those who had been at al-Hudaibiya, and God’s Messenger divided it into eighteen portions. The army was one thousand five hundred of which three hundred were cavalry, and he gave two shares to a horseman and one to a footman. Abu Dawud transmitted it, saying Ibn ‘Umar’s tradition1 is sounder, and it is the one which is followed. The error in the tradition of Mujammi’ was because he said three hundred horsemen when there were only two hundred. Habib b. Maslama al-Fihri said he saw the Prophet give a quarter of the spoil on the outward journey and a third on the return journey.2 1. I have available two editions of Abu Dawud’s Sunan (Cairo, 1280 and 1348 A .H.). Both give Ibn Mu'awiya in place of Ibn 'Umar. See Jihad, 144. 2. This tradition and the following one are explained as referring to a section of the army which comes in contact with the enemy. The greater amount granted them when this happens on the return journey is because there is more difficulty and danger in fighting after having gone through the campaign. The second tradition is more explicit by making it clear that the fifth was deducted. Abu Dawud transmitted it.

Ibn ‘Umar told that ‘Umar b. al-Khattab deported the Jews and the Christians from the land of the Hijaz and when God’s Messenger got supremacy over the people of Khaibar he intended to expel the Jews from it, for when the land was conquered it belonged to God, His Messenger and the Muslims. But the Jews asked God’s Messenger to leave them on condition that they should do all the cultivation and have half the produce, and he replied, “We shall confirm you on that condition as long as we wish.” So they were confirmed till ‘Umar deported them during his period of rule to Taima and Jericho. Those who dwell in heaven and those who dwell on earth will be pleased with him. The sky will not cease to give any of its rain, but will pour it forth copiously and the earth will not cease to produce any of its plants, but will bring them forth so that the living will wish the dead were alive in that period of seven, eight, or nine years." Apostle of Allah, you took an oath that you would not come to us for a month, whereupon he said: The month may also consist of twenty-nine days.

It was narrated that ‘Ubadah bin Samit said:
“The Messenger of Allah (saw) led us in prayer on the Day of Hunain, beside a camel that was part of the spoils of war. Then he took something from the camel, and extracted from it a hair, which he placed between two of his fingers. Then he said: ‘O people, this is part of your spoils of war. Hand over a needle and thread and anything greater than that or less than that. For stealing from the spoils of war will be a source of shame for those who do it, and ignominy and Fire, on the Day of Resurrection.’”

While the Prophet was delivering a sermon on a Friday, a man stood up and said, "O Allah's Apostle! Invoke Allah to bless us with rain." (The Prophet invoked Allah for rain.) So, the sky became overcast and it started raining till one could hardly reach one's home. It kept on raining till the next Friday when the same man or another man got up and said (to the Prophet), "Invoke Allah to withhold the rain from us, for we have been drowned (with heavy rain )." The Prophet said, "O Allah! Let it rain around us and not on us." Then the clouds started dispersing around Medina and rain ceased to fall on the people of Medina.

`Abdullah bin `Umar used to send the weak among his family early to Mina. So they used to depart from Al-Mash'ar Al-Haram (that is Al-Muzdalifa) at night (when the moon had set) and invoke Allah as much as they could, and then they would return (to Mina) before the Imam had started from Al- Muzdalifa to Mina. So some of them would reach Mina at the time of the Fajr prayer and some of them would come later. When they reached Mina they would throw pebbles on the Jamra (Jamrat-Al- `Aqaba) Ibn `Umar used to say, "Allah's Apostle gave the permission to them (weak people) to do so."

I mentioned that to the Prophet and he said: 'Eat it for it is charity for her and a gift for us.'"

It was narrated that 'Aishah said:
" "Some Bedouins came to Al-Madinah at the time of (Eid) Al-Adha and the Messenger of Allah said: 'Eat, and store (the meat) for three days.' After that they said: 'O Messenger of Allah, the people used to benefit form their sacrifices by melting down the fat, and (also) making water skins from them.' He said: 'Why are you asking?' He said: 'Because you forbade us form keeping the meat of the sacrificial animals.' He said: 'I only forbade that because of the Bedouins who came. (Now) eat it, store it and give it in charity," (Sahih )

Another chain with similar meaning.

[Abu 'Eisa said:

] This Hadith is Hasan Gharib, we only know of it as a narration of 'Abdur-Rahman bin Tarafah. Salm bin Zarir reported similar to the narration of Abu Al-Ashhab from 'Abdur-Rahman bin Taraqah - "from 'Abdur-Rahman bin Taraqah." It has been related about more than one of the people of knowledge that they would brace their teeth with gold, and in this Hadith there was a proof for them.

'Abdur-Rahman bin Mahdi said: "Salm bin Zarin" but that is an error, "Zarir" is more correct, and Abu Sa'd As-San'ani's (a narrator in this chain) name is Muhammad bin Muyassir.

He said: There are narration on this topic from 'Aishah and Abu Hurairah.

[Abu 'Eisa said:] We do not know of this Hadith except through the narration of 'Abdul-Karim. Some of the people of knowledge have criticized 'Abdul-Karim Al-Mu'allim because of his memory, Ayyub As-Sakhtiyani was among them.

[He said:] There are narrations on this topic from Ibn 'Umar, Ibn 'Abbas, Zaid bin Thabit, Sa'd, Jabir, Rafi' bin Khadij, and Abu Sa'eed.

[Abu 'Eisa said:] The Hadith of Abu Hurairah is a Hasan Sahih Hadith.

Muhaqalah is selling corps for wheat, and Muzabanah is selling dates that are on the date-palm for dried dates. This is acted upon according to the most of the people of knowledge, they disliked sales of Muhaqalah and Muzabanah.
