Sunan Abi Dawud 2721

Narrated Awf ibn Malik al-Ashja'i ; Khalid ibn al-Walid:

The Messenger of Allah (saws) gave judgement that the killer should have what was taken from the man he killed, and did not make this subject to division into fifths.

Sunan an-Nasa'i 3349
It was narrated that Abu Al-'Ajfa' said:
"Umar bin Al-Khattab said: 'Do not go to extremes with regard to the dowries of women, for if that were a sign of honor and dignity in this world, or a sign of piety before Allah, the Mighty and Sublime, then Muhammad would have done that before you. But he did not give any of his wives, and none of his daughters were given, more than twelve Uqiyyah. A man may increase the dowry until he feels resentment against her and says: You cost me everything I own ('Alaqul-Qirbah)'" "And I was a man born among the 'Arabs, but I did not know the meaning of 'Alaqul-Qirbah' and others of you are saying -about those killed in this or that battle of yours, or who died: 'So-and-so was martyred' or 'so and so died as a martyr.' While perhaps he merely overloaded the backside of his beast, or lined his saddle with gold or silver seeking trade. So do not say that, rather say as the Prophet said: 'Whoever is killed in the cause of Allah, or dies, then he is in Paradise.'"

It was narrated from Sahl bin Ab Hathmah and Rafi bin Khadij that:
Muhayysah bin Mas'ud and 'Abdullah bin Sahl went to Khaibar for some need they had there, and they parted among the palm trees. 'Abdullah bin Sahl was killed, and 'Abdullah bin Sahl was killed, and his brother 'Abdur-Rahman bin Shl, and Huwayysah, and Musayysah, his paternal cousins, came to the Messenger of Allah. 'Abdur-Rahan spoke about his brother's case, but he was the youngest of them, so the Messenger of Allah said: "Let the elders speak first." So they spoke about their companions, and the Messenger of Allah said: Let fifty of your swear an oath." The said: "O Messenger of Allah, it is something that we did not witness: how can we swear an oath?" He said: "Then let the Jews swear fifty oaths to their innocence." They said: "O Messenger of Allah, they area) a disbelieving people," So the Messenger of Allah paid the blood money himself Sahl said: "I entered a Mirbad of theirs, and one of those camels kicked me."

Sunan Abi Dawud 2724

Abu Hurairah said “I came to Madeenah when the Abu Apostle of Allaah(saws) was in Khaibar, after it was captured. I asked him to give me a share from the booty. A son of Sa’id bin Al ‘As spoke and said “Do not give him any share, Apostle of Allaah(saws). I said “This is the killer of Ibn Qauqal.” (The son of) Sa’id bin Al ‘As said “Oh, how wonderful! A Wabr who came down to us from the peak of Dal blames me of having killed a Muslim whom Allaah honored at my hands and did not disgrace me at his hands.

Abu Dawud said “They were about ten persons. Six of them were killed and the remaining returned.

Sunan Ibn Majah 2736
It was narrated from ‘Abdullah bin ‘Amr that the Messenger of Allah (saw) stood up, on the day of the conquest of Makkah, and said:
“A woman inherits from the blood money and wealth of her husband, and he inherits from her blood money and wealth, so long as one of them did not kill the other. If one of them killed the other deliberately, then he or she inherits nothing from the blood money or wealth. If one of them killed the other by mistake, he or she inherits from the other’s wealth, but not from the blood money.”
حَدَّثَنَا عَلِيُّ بْنُ مُحَمَّدٍ، وَمُحَمَّدُ بْنُ يَحْيَى، قَالاَ حَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ مُوسَى، عَنِ الْحَسَنِ بْنِ صَالِحٍ، عَنْ مُحَمَّدِ بْنِ سَعِيدٍ، - وَقَالَ مُحَمَّدُ بْنُ يَحْيَى عَنْ عُمَرَ بْنِ سَعِيدٍ، - عَنْ عَمْرِو بْنِ شُعَيْبٍ، حَدَّثَنِي أَبِي، عَنْ جَدِّي عَبْدِ اللَّهِ بْنِ عَمْرٍو، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَامَ يَوْمَ فَتْحِ مَكَّةَ فَقَالَ ‏ "‏ الْمَرْأَةُ تَرِثُ مِنْ دِيَةِ زَوْجِهَا وَمَالِهِ وَهُوَ يَرِثُ مِنْ دِيَتِهَا وَمَالِهَا مَا لَمْ يَقْتُلْ أَحَدُهُمَا صَاحِبَهُ فَإِذَا قَتَلَ أَحَدُهُمَا صَاحِبَهُ عَمْدًا لَمْ يَرِثْ مِنْ دِيَتِهِ وَمَالِهِ شَيْئًا وَإِنْ قَتَلَ أَحَدُهُمَا صَاحِبَهُ خَطَأً وَرِثَ مِنْ مَالِهِ وَلَمْ يَرِثْ مِنْ دِيَتِهِ ‏"‏ ‏.‏

Jundub bin 'Abdullah (May Allah be pleased with him) reported:
Messenger of Allah (PBUH) dispatched a contingent of the Muslims to a tribe of the polytheists. The two sides met (in combat) at one place. A man among the polytheists was so dashing that, whenever he intended to kill a man from Muslims, he killed him. Amongst the Muslims, too, was a man looking forward to (an opportunity of) his (polytheist's) unmindfulness. He (the narrator) said: We talked that he was Usamah bin Zaid (May Allah be pleased with him). When he raised his sword, he (the soldier of the polytheists) uttered: "La ilaha illallah (There is no true god except Allah)." But he (Usamah bin Zaid) killed him. When the good news of victory reached Messenger of Allah (PBUH) he asked him (about the events of the battle), and he informed him about the man (Usamah) and what he had done. He (Messenger of Allah (PBUH)) sent for him and asked him why he had killed him. He (Usamah) said, "O Messenger of Allah, he struck the Muslims and killed such and such of them." And he named some of them. (He continued): "I attacked him and when he saw the sword he said: 'La ilaha illallah."' Messenger of Allah (PBUH) said, "Did you kill him?" He (Usamah) replied in the affirmative. The Messenger of Allah then remarked, "What would you do with regard to (the utterance): La ilaha illallah, when it comes (before you) on the Day of Resurrection?" He (Usamah) said, "O Messenger of Allah! Beg forgiveness for me". He (the Prophet (PBUH)) said, "What would you do with regard to (the utterance): La ilaha illallah, when it comes (before you) on the Day of Resurrection?" He (Messenger of Allah (PBUH)) added nothing to it but kept repeating, "What would you do with regard to (the utterance): La ilaha illallah, when it comes (before you) on the Day of Resurrection?".

وعن جندب بن عبد الله، رضي الله عنه ، أن رسول الله صلى الله عليه وسلم، بعث بعثاً من المسلمين إلى قوم من المشركين، وأنهم التقوا فكان رجلاً من المشركين إذا شاء أن يقصد إلى رجل من المسلمين قصد له فقتله، وأن رجلاً من المسلمين قصد غفلته، وكنا نتحدث أنه أسامة بن زيد، فلما رفع عليه السيف ، قال‏:‏ لا إله إلا الله، فقتله، فجاء البشير إلى رسول الله ، صلى الله عليه وسلم فسأله ، وأخبره، حتى أخبره خبر الرجل كيف صنع ، فدعاه فسأله، فقال‏:‏ ‏"‏لم قتلته‏؟‏ فقال‏:‏ يا رسول الله أوجع في المسلمين، وقتل فلانا وفلانا -وسمى له نفراً- وإني حملت عليه، فلما رأى السيف قال‏:‏ لا إله إلا الله‏.‏ قال رسول الله صلى الله عليه وسلم‏:‏ ‏"‏اقتلته‏؟‏‏"‏ قال نعم ‏:‏ قال‏:‏ ‏"‏فكيف تصنع بلا إله إلا الله، إذا جاءت يوم القيامة‏؟‏ قال‏:‏ يا رسول الله استغفر لي‏.‏ قال‏:‏ ‏"‏وكيف تصنع بلا إله إلا الله إذا جاءت يوم القيامة‏؟‏ ‏"‏ فجعل لا يزيد على أن يقول‏:‏ ‏"‏ كيف تصنع بلا إله إلا الله إذا جاءت يوم القيامة‏"‏ ‏(‏‏(‏رواه مسلم‏)‏‏)‏‏.‏

It was narrated from Yazid bin Al-Bara' that his father said:
"I met my maternal uncle who was carrying a flag (for an expedition) and I said: 'Where are you going?' He said: 'The Messenger of Allah is sending me to a man who has married his father's wife, and he has commanded me to strike his neck (kill him) and seize his wealth.'"

Narrated Al-Bara' (bin 'Azib):

When the Prophet came to Medina, he stayed first with his grandfathers or maternal uncles from Ansar. He offered his prayers facing Baitul-Maqdis (Jerusalem) for sixteen or seventeen months, but he wished that he could pray facing the Ka'ba (at Mecca). The first prayer which he offered facing the Ka'ba was the 'Asr prayer in the company of some people. Then one of those who had offered that prayer with him came out and passed by some people in a mosque who were bowing during their prayers (facing Jerusalem). He said addressing them, "By Allah, I testify that I have prayed with Allah's Apostle facing Mecca (Ka'ba).' Hearing that, those people changed their direction towards the Ka'ba immediately. Jews and the people of the scriptures used to be pleased to see the Prophet facing Jerusalem in prayers but when he changed his direction towards the Ka'ba, during the prayers, they disapproved of it.

Al-Bara' added, "Before we changed our direction towards the Ka'ba (Mecca) in prayers, some Muslims had died or had been killed and we did not know what to say about them (regarding their prayers.) Allah then revealed: And Allah would never make your faith (prayers) to be lost (i.e. the prayers of those Muslims were valid).' " (2:143).

حَدَّثَنَا عَمْرُو بْنُ خَالِدٍ، قَالَ حَدَّثَنَا زُهَيْرٌ، قَالَ حَدَّثَنَا أَبُو إِسْحَاقَ، عَنِ الْبَرَاءِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم كَانَ أَوَّلَ مَا قَدِمَ الْمَدِينَةَ نَزَلَ عَلَى أَجْدَادِهِ ـ أَوْ قَالَ أَخْوَالِهِ ـ مِنَ الأَنْصَارِ، وَأَنَّهُ صَلَّى قِبَلَ بَيْتِ الْمَقْدِسِ سِتَّةَ عَشَرَ شَهْرًا، أَوْ سَبْعَةَ عَشَرَ شَهْرًا، وَكَانَ يُعْجِبُهُ أَنْ تَكُونَ قِبْلَتُهُ قِبَلَ الْبَيْتِ، وَأَنَّهُ صَلَّى أَوَّلَ صَلاَةٍ صَلاَّهَا صَلاَةَ الْعَصْرِ، وَصَلَّى مَعَهُ قَوْمٌ، فَخَرَجَ رَجُلٌ مِمَّنْ صَلَّى مَعَهُ، فَمَرَّ عَلَى أَهْلِ مَسْجِدٍ، وَهُمْ رَاكِعُونَ فَقَالَ أَشْهَدُ بِاللَّهِ لَقَدْ صَلَّيْتُ مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم قِبَلَ مَكَّةَ، فَدَارُوا كَمَا هُمْ قِبَلَ الْبَيْتِ، وَكَانَتِ الْيَهُودُ قَدْ أَعْجَبَهُمْ إِذْ كَانَ يُصَلِّي قِبَلَ بَيْتِ الْمَقْدِسِ، وَأَهْلُ الْكِتَابِ، فَلَمَّا وَلَّى وَجْهَهُ قِبَلَ الْبَيْتِ أَنْكَرُوا ذَلِكَ‏.‏ قَالَ زُهَيْرٌ حَدَّثَنَا أَبُو إِسْحَاقَ عَنِ [narrator id="1157" ...

Once the Prophet sat on a pulpit and we sat around him. Then he said, "The things I am afraid of most for your sake (concerning what will befall you after me) is the pleasures and splendors of the world and its beauties which will be disclosed to you." Somebody said, "O Allah's Apostle! Can the good bring forth evil?" The Prophet remained silent for a while. It was said to that person, "What is wrong with you? You are talking to the Prophet (p.b.u.h) while he is not talking to you." Then we noticed that he was being inspired divinely. Then the Prophet wiped off his sweat and said, "Where is the questioner?" It seemed as if the Prophet liked his question. Then he said, "Good never brings forth evil. Indeed it is like what grows on the banks of a water-stream which either kill or make the animals sick, except if an animal eats its fill the Khadira (a kind of vegetable) and then faces the sun, and then defecates and urinates and grazes again. No doubt this wealth is sweet and green. Blessed is the wealth of a Muslim from which he gives to the poor, the orphans and to needy travelers. (Or the Prophet said something similar to it) No doubt, whoever takes it illegally will be like the one who eats but is never satisfied, and his wealth will be a witness against him on the Day of Resurrection."

Narrated Husain bin `Ali:

`Ali bin Abi Talib said: "I got a she-camel as my share of the war booty on the day (of the battle) of Badr, and Allah's Apostle gave me another she-camel. I let both of them kneel at the door of one of the Ansar, intending to carry Idhkhir on them to sell it and use its price for my wedding banquet on marrying Fatima. A goldsmith from Bani Qainqa' was with me. Hamza bin `Abdul-Muttalib was in that house drinking wine and a lady singer was reciting: "O Hamza! (Kill) the (two) fat old she camels (and serve them to your guests). So Hamza took his sword and went towards the two she-camels and cut off their humps and opened their flanks and took a part of their livers." (I said to Ibn Shihab, "Did he take part of the humps?" He replied, "He cut off their humps and carried them away.") `Ali further said, "When I saw that dreadful sight, I went to the Prophet and told him the news. The Prophet came out in the company of Zaid bin Haritha who was with him then, and I too went with them. He went to Hamza and spoke harshly to him. Hamza looked up and said, 'Aren't you only the slaves of my forefathers?' The Prophet retreated and went out. This incident happened before the prohibition of drinking."

Narrated Anas:

The Prophet sent seventy men from the tribe of Bani Salim to the tribe of Bani Amir. When they reached there, my maternal uncle said to them, "I will go ahead of you, and if they allow me to convey the message of Allah's Apostle (it will be all right); otherwise you will remain close to me." So he went ahead of them and the pagans granted him security But while he was reporting the message of the Prophet , they beckoned to one of their men who stabbed him to death. My maternal uncle said, "Allah is Greater! By the Lord of the Ka`ba, I am successful." After that they attached the rest of the party and killed them all except a lame man who went up to the top of the mountain. (Hammam, a sub-narrator said, "I think another man was saved along with him)." Gabriel informed the Prophet that they (i.e the martyrs) met their Lord, and He was pleased with them and made them pleased. We used to recite, "Inform our people that we have met our Lord, He is pleased with us and He has made us pleased " Later on this Qur'anic Verse was cancelled. The Prophet invoked Allah for forty days to curse the murderers from the tribe of Ral, Dhakwan, Bani Lihyan and Bam Usaiya who disobeyed Allah and his Apostle.

حَدَّثَنَا حَفْصُ بْنُ عُمَرَ الْحَوْضِيُّ، حَدَّثَنَا هَمَّامٌ، عَنْ إِسْحَاقَ، عَنْ أَنَسٍ ـ رضى الله عنه ـ قَالَ بَعَثَ النَّبِيُّ صلى الله عليه وسلم أَقْوَامًا مِنْ بَنِي سُلَيْمٍ إِلَى بَنِي عَامِرٍ فِي سَبْعِينَ، فَلَمَّا قَدِمُوا، قَالَ لَهُمْ خَالِي أَتَقَدَّمُكُمْ، فَإِنْ أَمَّنُونِي حَتَّى أُبَلِّغَهُمْ عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم وَإِلاَّ كُنْتُمْ مِنِّي قَرِيبًا‏.‏ فَتَقَدَّمَ، فَأَمَّنُوهُ، فَبَيْنَمَا يُحَدِّثُهُمْ عَنِ النَّبِيِّ صلى الله عليه وسلم إِذْ أَوْمَئُوا إِلَى رَجُلٍ مِنْهُمْ، فَطَعَنَهُ فَأَنْفَذَهُ فَقَالَ اللَّهُ أَكْبَرُ، فُزْتُ وَرَبِّ الْكَعْبَةِ‏.‏ ثُمَّ مَالُوا عَلَى بَقِيَّةِ أَصْحَابِهِ فَقَتَلُوهُمْ، إِلاَّ رَجُلاً أَعْرَجَ صَعِدَ الْجَبَلَ‏.‏ قَالَ هَمَّامٌ فَأُرَاهُ آخَرَ مَعَهُ، فَأَخْبَرَ جِبْرِيلُ ـ عَلَيْهِ السَّلاَمُ ـ النَّبِيَّ صلى الله عليه وسلم أَنَّهُمْ قَدْ لَقُوا رَبَّهُمْ، فَرَضِيَ عَنْهُمْ وَأَرْضَاهُمْ، فَكُنَّا نَقْرَأُ أَنْ بَلِّغُوا قَوْمَنَا أَنْ قَدْ لَقِينَا رَبَّنَا فَرَضِيَ عَنَّا وَأَرْضَانَا‏.‏ ثُمَّ نُسِخَ بَعْدُ، فَدَعَا عَلَيْهِمْ أَرْبَعِينَ صَبَاحًا، عَلَى رِعْلٍ وَذَكْوَانَ وَبَنِي لِحْيَانَ وَبَنِي عُصَيَّةَ ...

Narrated Al-Miswar bin Makhrama and Marwan bin Al-Hakam:

(one of them said more than his friend): The Prophet set out in the company of more than onethousand of his companions in the year of Al-Hudaibiya, and when he reached Dhul-Hulaifa, he garlanded his Hadi (i.e. sacrificing animal), assumed the state of Ihram for `Umra from that place and sent a spy of his from Khuzaa'ah (tribe). The Prophet proceeded on till he reached (a village called) Ghadir-al-Ashtat. There his spy came and said, "The Quraish (infidels) have collected a great number of people against you, and they have collected against you the Ethiopians, and they will fight with you, and will stop you from entering the Ka`ba and prevent you." The Prophet said, "O people! Give me your opinion. Do you recommend that I should destroy the families and offspring of those who want to stop us from the Ka`ba? If they should come to us (for peace) then Allah will destroy a spy from the pagans, or otherwise we will leave them in a miserable state." On that Abu Bakr said, "O Allah Apostle! You have come with the intention of visiting this House (i.e. Ka`ba) and you do not want to kill or fight anybody. So proceed to it, and whoever should stop us from it, we will fight him." On that the Prophet said, "Proceed on, in the Name of Allah !"

Narrated Abu Qatada:

I was with the Prophet (on a journey) between Mecca and Medina, and all of them, (i.e. the Prophet and his companions) were in the state of Ihram, while I was not in that state. I was riding my horse and I used to be fond of ascending mountains. So while I was doing so I noticed that the people were looking at something. I went to see what it was, and behold it was an onager. I asked my companions, "What is that?" They said, "We do not know." I said, "It is an onager.' They said, "It is what you have seen." I had left my whip, so I said to them, "Hand to me my whip." They said, "We will not help you in that (in hunting the onager)." I got down, took my whip and chased the animal (on my horse) and did not stop till I killed it. I went to them and said, "Come on, carry it!" But they said, "We will not even touch it." At last I alone carried it and brought it to them. Some of them ate of it and some refused to eat of it. I said (to them), "I will ask the Prophet about it (on your behalf)." When I met the Prophet, I told him the whole story. He said to me, "Has anything of it been left with you?" I said, "Yes." He said, "Eat, for it is a meal Allah has offered to you."

Narrated Abu Shuraih Al-Ka'bi:
that the Messenger of Allah (saws) said: "Indeed Allah made Makkah sacred, it was not made sacred by the people. Whoever believes in Allah, and the Last Day, then let them not shed blood in it, nor cut down any of its trees. If one tries to make an excuse by saying: 'It was made lawful for the Messenger of Allah (saws)' then indeed Allah made it lawful for me but He did not make it lawful for the people, and it was only made lawful for me for an hour of a day. Then it is returned to being sacred until the Day of Judgement. Then, to you people of Khuza'ah who killed this man from Hudhail: I am his 'Aqil, so whomever (one of his relatives) is killed after today, then his people have two options; either they have him killed, or they take the blood-money from him.'"

Riyad as-Salihin 274
'Abdullah bin Zam'ah (May Allah be pleased with him) reported that he heard the Prophet (PBUH) giving a speech when he mentioned the she- camel (of Prophet Salih) and the man who had killed her. Messenger of Allah (PBUH) said:
"When the most wicked man among them went forth (to kill the she-camel).' (91:12) signifies that a distinguished, wicked and most powerful chief of the people jumped up to kill the she- camel." Then he (PBUH) made mention of women and said, "Some of you beat your wives as if they were slaves, and then lie with them at the end of the day".

Then he (PBUH) admonished them against laughing at another's passing of wind, saying, "Why does any of you laugh at another doing what he does himself"

وعن عبد الله بن زمعة رضي الله عنه ، أنه سمع النبي صلى الله عليه وسلم يخطب، وذكر الناقة والذي عقرها، فقال رسول الله صلى الله عليه وسلم ‏:‏ ‏(‏إذ انبعث أشقاها‏)‏ انبعث لها رجل عزيز، عارم منيع في رهطه‏"‏ ثم ذكر النساء، فوعظ فيهن، فقال ‏:‏ ‏"‏يعمد أحدكم فيجلد امرأته جلد العبد فلعله يضاجعها من آخر يومه‏"‏ ثم وعظهم في ضحكهم من الضرطة وقال‏:‏ ‏"‏لم يضحك أحدكم مما يفعل‏؟‏‏"‏ ‏(‏‏(‏متفق عليه‏)‏‏)‏‏.‏

I heard 'Umar bin al-Khattab say that he heard the Messenger of Allah ﷺ say: `The martyrs are three; a man who believes and has good faith, who meets the enemy and shows sincerity to Allah until he is killed ­ he is the one to whom people will raise their heads on the Day of Resurrection` ­ and the ­­Messenger of Allah ﷺ raised his head until his hat or Umar's hat fell off - ; `and a man who is a believer and has good faith, who meets the enemy and it is as if his skin was beaten with the thorns of an acacia tree, then a stray arrow comes and kills him - he will be in the second rank; and a man who is a believer and has good faith, but he mixes good and bad deeds, and he meets the enemy and shows sincerity to Allah until he is killed - he will be in the third rank.`
حَدَّثَنَا أَبُو سَعِيدٍ، حَدَّثَنَا ابْنُ لَهِيعَةَ، قَالَ سَمِعْتُ عَطَاءَ بْنَ دِينَارٍ، عَنْ أَبِي يَزِيدَ الْخَوْلَانِيِّ، أَنَّهُ سَمِعَ فَضَالَةَ بْنَ عُبَيْدٍ، يَقُولُ سَمِعْتُ عُمَرَ بْنَ الْخَطَّابِ، رَضِيَ اللَّهُ عَنْهُ أَنَّهُ سَمِعَ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ الشُّهَدَاءُ ثَلَاثَةٌ رَجُلٌ مُؤْمِنٌ جَيِّدُ الْإِيمَانِ لَقِيَ الْعَدُوَّ فَصَدَقَ اللَّهَ حَتَّى قُتِلَ فَذَلِكَ الَّذِي يَرْفَعُ إِلَيْهِ النَّاسُ أَعْنَاقَهُمْ يَوْمَ الْقِيَامَةِ وَرَفَعَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ رَأْسَهُ حَتَّى وَقَعَتْ قَلَنْسُوَتُهُ أَوْ قَلَنْسُوَةُ عُمَرَ وَرَجُلٌ مُؤْمِنٌ جَيِّدُ الْإِيمَانِ لَقِيَ الْعَدُوَّ فَكَأَنَّمَا يُضْرَبُ جِلْدُهُ بِشَوْكِ الطَّلْحِ أَتَاهُ سَهْمٌ غَرْبٌ فَقَتَلَهُ هُوَ فِي الدَّرَجَةِ الثَّانِيَةِ وَرَجُلٌ مُؤْمِنٌ جَيِّدُ الْإِيمَانِ خَلَطَ عَمَلًا صَالِحًا وَآخَرَ سَيِّئًا لَقِيَ الْعَدُوَّ فَصَدَقَ اللَّهَ حَتَّى قُتِلَ فَذَلِكَ فِي الدَّرَجَةِ الثَّالِثَةِ‏.‏

‘Adi b. Hatim told that God’s messenger said to him, “When you set off your dog mention God's name, and if it catches anything for you and you come up to it while it is still alive cut its throat; if you come up to it when the dog has killed it but not eaten any of it eat it; but if it has eaten any of it do not eat, for it has caught it only for itself. If you find another dog with yours and a kill has been made, do not eat, for you do not know which of them killed the animal. When you shoot your arrow mention God’s name and if the game goes out of your sight for a day and you find in it only the mark of your arrow eat if you wish, but if you find it drowned in water do not eat.” (Bukhari and Muslim.)
عَن عدِيِّ بنِ حاتِمٍ قَالَ: قَالَ لِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِذَا أَرْسَلْتَ كَلْبَكَ فَاذْكُرِ اسْمَ اللَّهِ فَإِنْ أَمْسَكَ عَلَيْكَ فَأَدْرَكْتَهُ حَيًّا فَاذْبَحْهُ وَإِنْ أَدْرَكْتَهُ قَدْ قَتَلَ وَلَمْ يَأْكُلْ مِنْهُ فَكُلْهُ وَإِنْ أَكَلَ فَلَا تَأْكُلْ فَإِنَّمَا أَمْسَكَ عَلَى نَفْسِهِ فَإِنْ وَجَدْتَ مَعَ كَلْبِكَ كَلْبًا غَيْرَهُ وَقَدْ قَتَلَ فَلَا تَأْكُلْ فَإِنَّكَ لَا تَدْرِي أَيُّهُمَا قَتَلَ. وَإِذَا رَمَيْتَ بِسَهْمِكَ فَاذْكُرِ اسْمَ اللَّهِ فَإِنْ غَابَ عَنْكَ يَوْمًا فَلَمْ تَجِدْ فِيهِ إِلَّا أَثَرَ سَهْمِكَ فَكُلْ إِنْ شِئْتَ وَإِنْ وَجَدْتَهُ غَرِيقًا فِي الْمَاءِ فَلَا تأكُلْ»

Abu Sa'id al-Khudri reported God's messenger as saying, "The dajjal will come but will not be allowed to enter the mountain passes of Medina, so he will alight in one of the salt tracts which are near Medina. A man who is the best (or, one of the best) of the people will go out to him, and will say he testifies that he is the dajjal the report of whom was given them by God's messenger. The dajjal will then ask the people to tell him whether, supposing he kills this man and brings him back to life, they will have any doubts about the matter, and when they reply that they will not he will kill him and afterwards bring him back to life. The man will then say, `I swear by God that I have had no clearer insight into your true nature than I have to-day.' The dajjal will therefore want to kill him, but will not be given power over him." (Bukhari and Muslim.)
وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " يَأْتِي الدَّجَّالُ وَهُوَ مُحَرَّمٌ عَلَيْهِ أَنْ يَدْخُلَ نِقَابَ الْمَدِينَةِ فَيَنْزِلُ بَعْضَ السِّبَاخِ الَّتِي تَلِي الْمَدِينَةَ فَيَخْرُجُ إِلَيْهِ رَجُلٌ وَهُوَ خَيْرُ النَّاسِ أَوْ مِنْ خِيَارِ النَّاسِ فَيَقُولُ: أَشْهَدُ أَنَّكَ الدَّجَّالُ الَّذِي حَدَّثَنَا رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ حَدِيثَهُ فَيَقُولُ الدَّجَّالُ: أَرَأَيْتُمْ إِنْ قَتَلْتُ هَذَا ثُمَّ أَحْيَيْتُهُ هَلْ تَشُكُّونَ فِي الْأَمْرِ؟ فَيَقُولُونَ: لَا فَيَقْتُلُهُ ثُمَّ يُحْيِيهِ فَيَقُولُ: وَاللَّهِ مَا كُنْتُ فِيكَ أَشَدَّ بَصِيرَةً مِنِّي الْيَوْمَ فَيُرِيدُ الدَّجَّالُ أَنْ يَقْتُلَهُ فَلَا يُسَلَّطُ عَلَيْهِ ". مُتَّفق عَلَيْهِ

Kill snakes, and kill Dhit-Tufytain* and the Abtar**, for they take away the sight and cause miscarriage.” *A snake that has two white stripes on its back. **A snake with a short or mutilated tail.

Narrated Abdullah ibn Abbas:

The Messenger of Allah (saws) said on the day of Badr: He who kills a man will get such-and-such, and he who captivates a man will get such-and-such. The narrator then transmitted the rest of the tradition in a similar manner. The tradition of Khalid is more perfect.

Ibn ‘Abbas reported God’s Messenger as saying, “If anyone has sexual intercourse with an animal, kill him and kill it along with him.” Ibn ‘Abbas was asked what offence could be attributed to the animal and replied, “I did not hear anything about that from God’s Messenger, but I think he disapproved of its flesh being eaten or of any use being made of it when such a thing had been done to it.” Tirmidhi, Abu Dawud and Ibn Majah transmitted it.
وَعَنِ ابْنِ عَبَّاسٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ أَتَى بَهِيمَةً فَاقْتُلُوهُ وَاقْتُلُوهَا مَعَهُ» . قِيلَ لِابْنِ عَبَّاسٍ: مَا شَأْنُ الْبَهِيمَةِ؟ قَالَ: مَا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي ذَلِكَ شَيْئا وَلَكِن أره كَرِهَ أَنْ يُؤْكَلَ لَحْمُهَا أَوْ يُنْتَفَعَ بِهَا وَقَدْ فُعِلَ بِهَا ذَلِكَ. رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُد وَابْن مَاجَه

'Abu Huraira reported God’s Messenger as saying, “Whom do you reckon to be the martyr among you?” His hearers replied, “The one who is killed in God’s path is the martyr, Messenger of God.” He said, “The martyrs among my people would then be few. He who is killed in God’s path is a martyr, he who dies in God’s path is a martyr, he who dies of plague is a martyr, and he who dies of a disease in the belly is a martyr.” Muslim transmitted it.
وَعَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَا تَعُدُّونَ الشَّهِيدَ فِيكُمْ؟» قَالُوا: يَا رَسُولَ اللَّهِ مَنْ قُتِلَ فِي سَبِيلِ اللَّهِ فَهُوَ شَهِيدٌ قَالَ: " إِنَّ شُهَدَاءَ أُمَّتِي إِذًا لِقَلِيلٌ: مَنْ قُتِلَ فِي سَبِيلِ اللَّهِ فَهُوَ شَهِيدٌ وَمَنْ مَاتَ فِي سَبِيلِ اللَّهِ فَهُوَ شَهِيدٌ وَمَنْ مَاتَ فِي الطَّاعُونِ فَهُوَ شَهِيدٌ وَمَنْ مَاتَ فِي الْبَطْنِ فهوَ شهيدٌ ". رَوَاهُ مُسلم

Jabir said:
Before the battle of Uhud began my father called me 1 during the night and said, "I feel that I shall be among the first of the Prophet's companions to be killed, and apart from God's messenger himself I shall leave no one dearer to me than you. I owe a debt, so pay it; and look after your sisters well." In the morning he was the first to be killed, and I buried him in a grave along with another. Bukhari transmitted it.
وَعَن جَابر قَالَ: لَمَّا حَضَرَ أُحُدٌ دَعَانِي أَبِي مِنَ اللَّيْلِ فَقَالَ مَا أُرَانِي إِلَّا مَقْتُولًا فِي أَوَّلِ مَنْ يُقْتَلُ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ وَإِنِّي لَا أَتْرُكُ بَعْدِي أَعَزَّ عَلَيَّ مِنْكَ غَيْرَ نَفْسِ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَإِنَّ عَلَيَّ دَيْنًا فَاقْضِ وَاسْتَوْصِ بِأَخَوَاتِكَ خَيْرًا فَأَصْبَحْنَا فَكَانَ أَوَّلَ قَتِيلٍ وَدَفَنْتُهُ مَعَ آخَرَ فِي قبر رَوَاهُ البُخَارِيّ

Sunan Abi Dawud 1076
‘Abd Allah b. ‘Umar said:
‘Umar b. al-Khattab saw a silken suit sold at the gate of the mosque. He said: Messenger of Allah, would that you purchase this suit and wear it on Friday and on the occasion when a delegation (from the outside) comes to you. The Messenger of Allah (may peace be upon him) said: One who has no share in the afterlife will put on this (suit). Afterwards suits of similar nature were brought to the Messenger of Allah (may peace be upon him). He gave ‘Umar b. al-Khattab one of these suits. ‘Umar said: Messenger of Allah, you are giving it to me for use while you had told me such-and-such about the suit of ‘Utarid (I.e. sold by ‘Utarid). The Messenger of Allah (may peace be upon him) said: I did not give it to you that you should wear it. Hence ‘Umar gave it to his brother who was a disbeliever at Mecca for wearing.
حَدَّثَنَا الْقَعْنَبِيُّ، عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، رَأَى حُلَّةً سِيَرَاءَ - يَعْنِي تُبَاعُ عِنْدَ بَابِ الْمَسْجِدِ - فَقَالَ يَا رَسُولَ اللَّهِ لَوِ اشْتَرَيْتَ هَذِهِ فَلَبِسْتَهَا يَوْمَ الْجُمُعَةِ وَلِلْوَفْدِ إِذَا قَدِمُوا عَلَيْكَ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّمَا يَلْبَسُ هَذِهِ مَنْ لاَ خَلاَقَ لَهُ فِي الآخِرَةِ ‏"‏ ‏.‏ ثُمَّ جَاءَتْ رَسُولَ اللَّهِ صلى الله عليه وسلم مِنْهَا حُلَلٌ فَأَعْطَى عُمَرَ بْنَ الْخَطَّابِ مِنْهَا حُلَّةً فَقَالَ عُمَرُ كَسَوْتَنِيهَا يَا رَسُولَ اللَّهِ وَقَدْ قُلْتَ فِي حُلَّةِ عُطَارِدَ مَا قُلْتَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنِّي لَمْ أَكْسُكَهَا لِتَلْبَسَهَا ‏"‏ ‏.‏ فَكَسَاهَا عُمَرُ أَخًا لَهُ مُشْرِكًا بِمَكَّةَ ‏.‏

“I heard Abu Dharr swearing that these verses were revealed concerning those six people on the Day of Badr: ‘These two opponents (believers and disbelievers) dispute with each other about their Lord.”[22:19] to the words “Verily, Allah does what he wills.’[22:14] (that is) Hamzah bin ‘Abdul-Muttalib, ‘Ali bin Abi Talib, ‘Ubaidah bin Al-Harith, ‘Utbah bin Rabi’ah, Shaibah bin Rabi’ah and Al-Walid bin ‘Utbah. They argued with one another on the Day of Badr.”

He stood up angrily and said: Is the Book of Allah being toyed with while I am still among you? Then a man stood up and said: 'O Messenger of Allah, shall I kill him?'"

It was narrated that 'Arfajah bin Shuraih Al-Ashja'I said:
"I saw the Prophet [SAW] on the Minbar addressing the people. He said: 'After me there will be many calamities and much evil behavior. Whoever you see splitting away from the Jama'ah or trying to create division among the Ummah of Muhammad [SAW], then kill him, for the Hand of Allah is with the Jama'ah, and the Shaitan is with the one who splits away from the Ummah, running with him.'"
أَخْبَرَنِي أَحْمَدُ بْنُ يَحْيَى الصُّوفِيُّ، قَالَ حَدَّثَنَا أَبُو نُعَيْمٍ، قَالَ حَدَّثَنَا يَزِيدُ بْنُ مَرْدَانْبَهْ، عَنْ زِيَادِ بْنِ عِلاَقَةَ، عَنْ عَرْفَجَةَ بْنِ شُرَيْحٍ الأَشْجَعِيِّ، قَالَ رَأَيْتُ النَّبِيَّ صلى الله عليه وسلم عَلَى الْمِنْبَرِ يَخْطُبُ النَّاسَ فَقَالَ ‏ "‏ إِنَّهُ سَيَكُونُ بَعْدِي هَنَاتٌ وَهَنَاتٌ فَمَنْ رَأَيْتُمُوهُ فَارَقَ الْجَمَاعَةَ أَوْ يُرِيدُ تَفْرِيقَ أَمْرِ أُمَّةِ مُحَمَّدٍ صلى الله عليه وسلم كَائِنًا مَنْ كَانَ فَاقْتُلُوهُ فَإِنَّ يَدَ اللَّهِ عَلَى الْجَمَاعَةِ فَإِنَّ الشَّيْطَانَ مَعَ مَنْ فَارَقَ الْجَمَاعَةَ يَرْكُضُ ‏"‏ ‏.‏

Sunan an-Nasa'i 4820
It was narrated from Sa'eed bin Al-Musayyab that:
the Messenger of Allah ruled that for a fetus which is killed in the mother's womb, a male or female slave be given (as Diyah). The one against whom he passed this ruling said: "How can I pay blood money for one who neither ate nor drank, or shouted or cried (at the moment of birth)? Such a one should be overlooked." The Messenger of Allah said: "This is one of the soothsayers."'
قَالَ الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ، عَنِ ابْنِ الْقَاسِمِ، قَالَ حَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَضَى فِي الْجَنِينِ يُقْتَلُ فِي بَطْنِ أُمِّهِ بِغُرَّةٍ عَبْدٍ أَوْ وَلِيدَةٍ فَقَالَ الَّذِي قَضَى عَلَيْهِ كَيْفَ أُغَرَّمُ مَنْ لاَ شَرِبَ وَلاَ أَكَلَ وَلاَ اسْتَهَلّ وَلاَ نَطَقَ فَمِثْلُ ذَلِكَ يُطَلّ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّمَا هَذَا مِنَ الْكُهَّانِ ‏"‏ ‏.‏

It was narrated from Al-Fari'ah bint Malik that her husband went out to pursue some slaves and they killed him. Shu'bah and Ibn Juraij said:
"She was in a remote house. She came with her brothers to the Messenger of Allah and told him (about the situation) and he granted her a concession. When she was leaving he called her back and said: 'Stay in your house until the term prescribed is fulfilled.'"

Sunan Abi Dawud 336
Jabir said:
We set out on a journey. One of our people was hurt by a stone, that injured his head. He then had a sexual dream. He asked his fellow travelers: Do you find a concession for me to perform tayammum? They said: We do not find any concession for you while you can use water. He took a bath and died. When we came to the Prophet (saws), the incident was reported to him. He said: They killed him, may Allah kill them! Could they not ask when they did not know? The cure for ignorance is inquiry. It was enough for him to perform tayammum and to pour some drops of water or bind a bandage over the wound (the narrator Musa was doubtful); then he should have wiped over it and washed the rest of his body.
حَدَّثَنَا مُوسَى بْنُ عَبْدِ الرَّحْمَنِ الأَنْطَاكِيُّ، حَدَّثَنَا مُحَمَّدُ بْنُ سَلَمَةَ، عَنِ الزُّبَيْرِ بْنِ خُرَيْقٍ، عَنْ عَطَاءٍ، عَنْ جَابِرٍ، قَالَ خَرَجْنَا فِي سَفَرٍ فَأَصَابَ رَجُلاً مِنَّا حَجَرٌ فَشَجَّهُ فِي رَأْسِهِ ثُمَّ احْتَلَمَ فَسَأَلَ أَصْحَابَهُ فَقَالَ هَلْ تَجِدُونَ لِي رُخْصَةً فِي التَّيَمُّمِ فَقَالُوا مَا نَجِدُ لَكَ رُخْصَةً وَأَنْتَ تَقْدِرُ عَلَى الْمَاءِ فَاغْتَسَلَ فَمَاتَ فَلَمَّا قَدِمْنَا عَلَى النَّبِيِّ صلى الله عليه وسلم أُخْبِرَ بِذَلِكَ فَقَالَ ‏"‏ قَتَلُوهُ قَتَلَهُمُ اللَّهُ أَلاَّ سَأَلُوا إِذْ لَمْ يَعْلَمُوا فَإِنَّمَا شِفَاءُ الْعِيِّ السُّؤَالُ إِنَّمَا كَانَ يَكْفِيهِ أَنْ يَتَيَمَّمَ وَيَعْصِرَ ‏"‏ ‏.‏ أَوْ ‏"‏ يَعْصِبَ ‏"‏ ‏.‏ شَكَّ مُوسَى ‏"‏ عَلَى جُرْحِهِ خِرْقَةً ثُمَّ يَمْسَحَ عَلَيْهَا وَيَغْسِلَ سَائِرَ جَسَدِهِ ‏"‏ ‏.‏

'A'isha reported that when the Messenger of Allah (may peace be upon him) was told that Ibn Haritha, Ja'far b. Abu Talib and Abdullah b. Rawaha were killed, he sat down, showing signs of grief. She (further) said:

I was looking (at him) through the crevice of the door. A man came to him and mentioned that Ja'far's women were lamenting. He (the Holy Prophet) commanded him to go and forbid them (to do so). So he went away but came back and told (him) that they did not obey (him). He commanded him a second time to go and forbid them (to do so). He again went but came back to him and said: I swear by God, Messenger of Allah, that they have overpowered us. She ('A'isha) said that she thought the Messenger of Allah (may peace be upon him) had told (her) to throw dust in their mouths. Thereupon 'A'isha said: May Allah humble you! You did not do what Allah's Messenger (may peace be upon him) ordered you, nor did you stop annoying Allah's Messenger (may peace be upon him).
وَحَدَّثَنَا ابْنُ الْمُثَنَّى، وَابْنُ أَبِي عُمَرَ، قَالَ ابْنُ الْمُثَنَّى حَدَّثَنَا عَبْدُ الْوَهَّابِ، قَالَ سَمِعْتُ يَحْيَى بْنَ سَعِيدٍ، يَقُولُ أَخْبَرَتْنِي عَمْرَةُ، أَنَّهَا سَمِعَتْ عَائِشَةَ، تَقُولُ لَمَّا جَاءَ رَسُولَ اللَّهِ صلى الله عليه وسلم قَتْلُ ابْنِ حَارِثَةَ وَجَعْفَرِ بْنِ أَبِي طَالِبٍ وَعَبْدِ اللَّهِ بْنِ رَوَاحَةَ جَلَسَ رَسُولُ اللَّهِ صلى الله عليه وسلم يُعْرَفُ فِيهِ الْحُزْنُ قَالَتْ وَأَنَا أَنْظُرُ مِنْ صَائِرِ الْبَابِ - شَقِّ الْبَابِ - فَأَتَاهُ رَجُلٌ فَقَالَ يَا رَسُولَ اللَّهِ إِنَّ نِسَاءَ جَعْفَرٍ وَذَكَرَ بُكَاءَهُنَّ فَأَمَرَهُ أَنْ يَذْهَبَ فَيَنْهَاهُنَّ فَذَهَبَ فَأَتَاهُ فَذَكَرَ أَنَّهُنَّ لَمْ يُطِعْنَهُ فَأَمَرَهُ الثَّانِيَةَ أَنْ يَذْهَبَ فَيَنْهَاهُنَّ فَذَهَبَ ثُمَّ أَتَاهُ فَقَالَ وَاللَّهِ لَقَدْ غَلَبْنَنَا يَا رَسُولَ اللَّهِ ‏.‏ قَالَتْ فَزَعَمَتْ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ اذْهَبْ فَاحْثُ فِي أَفْوَاهِهِنَّ مِنَ التُّرَابِ ‏" ‏ ‏.‏ قَالَتْ عَائِشَةُ فَقُلْتُ أَرْغَمَ اللَّهُ أَنْفَكَ وَاللَّهِ ...

Abu Qatada reported:

We went with the Messenger of Allah (may peace be upon him) till we reached al-Qaha (a place three stages away from Medina). Some of us were in the state of Ihram and some of us were not. I saw my companions looking towards something, and as I saw I found It to be a wild ass. I saddled my horse and took up my spear and then mounted upon (the horse) and my whip, fell down. I said to my companions as they were in the state of Ihram to pick up the whip for me but they said: By Allah, we cannot help you in any (such) thing (i. e. hunting). So i dismounted (the horse) and picked it (whip) up and mounted again and caught the wild ass after chasing it. It was behind a hillock and I attacked it with my spear and killed it. Then I brought it to my companions. Some of them said: Eat it, while others said: Do not eat it. The Apostle of Allah (may peace be upon him) was in front of us. I moved my horse and came to him (and asked him), whereupon he said: It is permissible, so eat it.

Hisham b. Urwa reported on the authority of his father (Allah be pleased with him) that Arwa bint Uwais disputed with Sa'id b. Zaid that he had seized some of the land belonging to her. She brought this dispute before Marwan b. al-Hakam. Sa'id said:

How could I take a part of her land, after what I heard from Allah's Messenger (may peace be upon'him)? He (Marwan) said: What did you hear from Allah's Messenger (may peace be upon him)? He said: I heard Allah's Messenger (may peace be upon him) say: He who wrongly took a span of land would be made to wear around his neck seven earths. Marwan said: I do not ask any evidence from you after this. He (Sa'id) said: O Allah, make her blind if she has told a lie and kill her in her own land. He (the narrator) said: She did not die until she had lost her eyesight, and (one day) as she was walking in her land, she fell down into a pit and died.
حَدَّثَنَا أَبُو الرَّبِيعِ الْعَتَكِيُّ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، أَنَّ أَرْوَى بِنْتَ أُوَيْسٍ، ادَّعَتْ عَلَى سَعِيدِ بْنِ زَيْدٍ أَنَّهُ أَخَذَ شَيْئًا مِنْ أَرْضِهَا فَخَاصَمَتْهُ إِلَى مَرْوَانَ بْنِ الْحَكَمِ ‏.‏ فَقَالَ سَعِيدٌ أَنَا كُنْتُ آخُذُ مِنْ أَرْضِهَا شَيْئًا بَعْدَ الَّذِي سَمِعْتُ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ وَمَا سَمِعْتَ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم قَالَ سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏"‏ مَنْ أَخَذَ شِبْرًا مِنَ الأَرْضِ ظُلْمًا طُوِّقَهُ إِلَى سَبْعِ أَرَضِينَ ‏"‏ ‏.‏ فَقَالَ لَهُ مَرْوَانُ لاَ أَسْأَلُكَ بَيِّنَةً بَعْدَ هَذَا ‏.‏ فَقَالَ اللَّهُمَّ إِنْ كَانَتْ كَاذِبَةً فَعَمِّ بَصَرَهَا وَاقْتُلْهَا فِي أَرْضِهَا ‏.‏ قَالَ فَمَا مَاتَتْ حَتَّى ذَهَبَ بَصَرُهَا ثُمَّ بَيْنَا هِيَ تَمْشِي فِي أَرْضِهَا إِذْ وَقَعَتْ فِي حُفْرَةٍ فَمَاتَتْ ‏.‏

Yahya related to me from Malik that Rabia ibn Abi Abd ar-Rahman said, "The slave of fair complexion and excellence is estimated at fifty dinars or six hundred dirhams. The blood-money of a free muslim woman is five hundred dinars or six thousand dirhams."

Malik said, "The blood-money of the foetus of a free woman is a tenth of her blood-money. The tenth is fifty dinars or six hundred dirhams."

Malik said, "I have not heard anyone dispute that there is no slave in compensation for the foetus until it leaves its mother's womb and falls still-born from her womb . "

Malik said, "I heard that if the foetus comes out of its mother's womb alive and then dies, the full blood-money is due for it."

Malik said, "The foetus is not alive unless it cries at birth. If it comes out of its mother's womb and cries out and then dies, the complete blood-money is due for it. We think that the slave- girl's foetus has a tenth of the price of the slave-girl."

Malik said, "When a woman murders a man or woman, and the murderess is pregnant, retaliation is not taken against her until she has given birth. If a woman who is pregnant is killed intentionally or unintentionally, the one who killed her is not obliged to pay anything for her foetus. If she is murdered, then the one who killed her is killed and there is no blood-money for her foetus. If she is killed accidentally, the tribe obliged to pay on behalf of her killer pays her blood-money, and there is no blood-money for the foetus."

Yahya related to me, "Malik was asked about the foetus of the christian or jewish woman which was aborted. He said, 'I think that there is a tenth of the blood-money of the mother for it.' "

I heard the Messenger of Allah (saws) as saying: Do not kill your children secretly, for the milk, with which a child is suckled while his mother is pregnant, overtakes the horseman and throws him from his horse.

Narrated Abdullah ibn Mas'ud:

Kill all the snakes except the little white one which looks like a silver wand.

Abu Dawud said: A man said to me: A white snake does not wind in its movement. If it is correct, that is a sign in it, if Allah wills.

حَدَّثَنَا عَمْرُو بْنُ عَوْنٍ، أَخْبَرَنَا أَبُو عَوَانَةَ، عَنْ مُغِيرَةَ، عَنْ إِبْرَاهِيمَ، عَنِ ابْنِ مَسْعُودٍ، أَنَّهُ قَالَ اقْتُلُوا الْحَيَّاتِ كُلَّهَا إِلاَّ الْجَانَّ الأَبْيَضَ الَّذِي كَأَنَّهُ قَضِيبُ فِضَّةٍ ‏.‏ قَالَ أَبُو دَاوُدَ فَقَالَ لِي إِنْسَانٌ الْجَانُّ لاَ يَنْعَرِجُ فِي مِشْيَتِهِ فَإِذَا كَانَ هَذَا صَحِيحًا كَانَتْ عَلاَمَةً فِيهِ إِنْ شَاءَ اللَّهُ ‏.‏

حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ الْمَلِكِ بْنِ أَبِي الشَّوَارِبِ، حَدَّثَنَا يَزِيدُ بْنُ زُرَيْعٍ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ عُرْوَةَ، عَنْ عَائِشَةَ، قَالَتْ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ خَمْسُ فَوَاسِقَ يُقْتَلْنَ فِي الْحَرَمِ الْفَأْرَةُ وَالْعَقْرَبُ وَالْغُرَابُ وَالْحُدَيَّا وَالْكَلْبُ الْعَقُورُ ‏" ‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنِ ابْنِ مَسْعُودٍ وَابْنِ عُمَرَ وَأَبِي هُرَيْرَةَ وَأَبِي سَعِيدٍ وَابْنِ عَبَّاسٍ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ عَائِشَةَ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏

The Prophet said: "The Muhrim may kill the wild beast of prey, the rabid dog, the mouse, the scorpion, the kite, and the crow."
حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا هُشَيْمٌ، أَخْبَرَنَا يَزِيدُ بْنُ أَبِي زِيَادٍ، عَنِ ابْنِ أَبِي نُعْمٍ، عَنْ أَبِي سَعِيدٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ يَقْتُلُ الْمُحْرِمُ السَّبُعَ الْعَادِيَ وَالْكَلْبَ الْعَقُورَ وَالْفَأْرَةَ وَالْعَقْرَبَ وَالْحِدَأَةَ وَالْغُرَابَ ‏" ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ ‏.‏ قَالُوا الْمُحْرِمُ يَقْتُلُ السَّبُعَ الْعَادِيَ ‏.‏ وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَالشَّافِعِيِّ ‏.‏ وَقَالَ الشَّافِعِيُّ كُلُّ سَبُعٍ عَدَا عَلَى النَّاسِ أَوْ عَلَى دَوَابِّهِمْ فَلِلْمُحْرِمِ قَتْلُهُ ‏.‏

11 Malik related to me from Yahya ibn Said from Urwa ibn az- Zubayr that a man of the Ansar called Uhayha ibn al-Julah had a young paternal uncle who was younger than him and who was living with his maternal uncles. Uhayha took him and killed him. His maternal uncles said, "We brought him up from a baby to a youth till he stood firm on his feet, and we have had the right of a man taken from us by his paternal uncle." Urwa said, "For that reason a killer does not inherit from the one he killed."

Malik said, "The way of doing things about which there is no dispute is that the intentional murderer does not inherit anything of the blood-money of the person he has murdered or any of his property. He does not stop anyone who has a share of inheritance from inheriting. The one who kills accidentally does not inherit anything of the blood-money and there is dispute as to whether or not he inherits from the dead person's property because there is no suspicion that he killed him for his inheritance and in order to take his property. I prefer that he inherit from the dead person's property and not inherit from the blood-money."

وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، أَنَّ رَجُلاً، مِنَ الأَنْصَارِ - يُقَالُ لَهُ أُحَيْحَةُ بْنُ الْجُلاَحِ - كَانَ لَهُ عَمٌّ صَغِيرٌ هُوَ أَصْغَرُ مِنْ أُحَيْحَةَ وَكَانَ عِنْدَ أَخْوَالِهِ فَأَخَذَهُ أُحَيْحَةُ فَقَتَلَهُ فَقَالَ أَخْوَالُهُ كُنَّا أَهْلَ ثُمِّهِ وَرُمِّهِ حَتَّى إِذَا اسْتَوَى عَلَى عُمَمِهِ غَلَبَنَا حَقُّ امْرِئٍ فِي عَمِّهِ ‏.‏ قَالَ عُرْوَةُ فَلِذَلِكَ لاَ يَرِثُ قَاتِلٌ مَنْ قَتَلَ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الَّذِي لاَ اخْتِلاَفَ فِيهِ عِنْدَنَا أَنَّ قَاتِلَ الْعَمْدِ لاَ يَرِثُ مِنْ دِيَةِ مَنْ قَتَلَ شَيْئًا وَلاَ مِنْ مَالِهِ وَلاَ يَحْجُبُ أَحَدًا وَقَعَ لَهُ مِيرَاثٌ وَأَنَّ الَّذِي يَقْتُلُ خَطَأً لاَ يَرِثُ مِنَ الدِّيَةِ شَيْئًا وَقَدِ اخْتُلِفَ فِي أَنْ يَرِثَ مِنْ مَالِهِ لأَنَّهُ لاَ يُتَّهَمُ عَلَى أَنَّهُ قَتَلَهُ لِيَرِثَهُ وَلِيَأْخُذَ مَالَهُ فَأَحَبُّ إِلَىَّ أَنْ يَرِثَ مِنْ مَالِهِ وَلاَ يَرِثُ مِنْ دِيَتِهِ ‏.‏
