Sunan an-Nasa'i 2835
It was narrated from Salim that his father said:
"The Prophet said: 'There are five kinds of animals for which there is no sin on the one who kills them, whether he is in Ihram or not: Mice, kites, crows, scorpions and vicious dogs.'"
أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ يَزِيدَ الْمُقْرِئُ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَالِمٍ، عَنْ أَبِيهِ، قَالَ قَالَ النَّبِيُّ صلى الله عليه وسلم ‏ "‏ خَمْسٌ مِنَ الدَّوَابِّ لاَ جُنَاحَ فِي قَتْلِهِنَّ عَلَى مَنْ قَتَلَهُنَّ فِي الْحَرَمِ وَالإِحْرَامِ الْفَأْرَةُ وَالْحِدَأَةُ وَالْغُرَابُ وَالْعَقْرَبُ وَالْكَلْبُ الْعَقُورُ ‏"‏ ‏.‏

Sunan an-Nasa'i 3986
It was narrated that 'Abdullah bin 'Amr bin Al-'As said:
"The Messenger of Allah [SAW] said: 'By the One in Whose Hand is my soul, killing a believer is more grievous before Allah than the extinction of the whole world.'"

Sunan an-Nasa'i 4308
It was narrated that 'Adiyy bin Htim said:
"I asked the Messenger of Allah about hunting with Mirad and he said: 'If the sharp edge hits (the game), then eat, but if the broad edge of it strikes it, then it has been killed by a blow."'

It was narrated that Ibn Al-Musayyab said:
"Qasamah existed during the Jahiliyyah, then the Messenger of Allah confirmed it in the case of an Ansari who was found slain in the dry well of the jews, and Ansar said: "The Jews kill our companion."'

"Indeed the accidental killing, which seems intentional, with a whip or a stick, (the Diyah) is one hundred camels, of which forty should be (she-camels) with their young in their wombs."
أَخْبَرَنِي يَحْيَى بْنُ حَبِيبِ بْنِ عَرَبِيٍّ، قَالَ أَنْبَأَنَا حَمَّادٌ، عَنْ خَالِدٍ، - يَعْنِي الْحَذَّاءَ - عَنِ الْقَاسِمِ بْنِ رَبِيعَةَ، عَنْ عُقْبَةَ بْنِ أَوْسٍ، عَنْ عَبْدِ اللَّهِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَلاَ وَإِنَّ قَتِيلَ الْخَطَإِ شِبْهِ الْعَمْدِ مَا كَانَ بِالسَّوْطِ وَالْعَصَا مِائَةٌ مِنَ الإِبِلِ أَرْبَعُونَ فِي بُطُونِهَا أَوْلاَدُهَا ‏"‏ ‏.‏

Sunan Abi Dawud 2696

Narrated Ali ibn AbuTalib:

Ali separated between a slave-girl and her child. The Prophet (saws) prohibited it and made the sale transactions withdrawn.

Abu Dawud said: The narrator Maimun (b. Abi Shaib) did not meet 'Ali. He (Maimun) was killed in the battle of Jamajim in 83 A.H.

Abu Dawud said: The battle of Harrah took place in 63 A.H., and Ibn al-Zubair was killed in 73 A.H.

Narrated Abdullah ibn Abbas:

The Prophet (saws) said: If anyone has sexual intercourse with an animal, kill him and kill it along with him. I (Ikrimah) said: I asked him (Ibn Abbas): What offence can be attributed to the animal/ He replied: I think he (the Prophet) disapproved of its flesh being eaten when such a thing had been done to it.

Abu Dawud said: This is not a strong tradition.

Ibn Mas'ud told that when Ibn an-Nawwaha and Ibn Uthal, Musailima’s messengers, came to the Prophet he asked them whether they testified that he was God’s Messenger. On their replying, "We testify that Musailima is God’s messenger,” he said, "I believe in God and His Messenger. If it was my custom to kill a messenger I would kill you.” ‘Abdallah (i.e. Ibn Mas'ud) said that the sunna that a messenger should not be killed then came into force. Ahmad transmitted it.
عَنِ ابْنِ مَسْعُودٍ قَالَ: جَاءَ ابْنُ النَّوَّاحَةِ وَابْنُ أُثَالٍ رَسُولَا مُسَيْلِمَةَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَقَالَ لَهُمَا: «أَتَشْهَدَانِ أَنِّي رَسُولُ اللَّهِ؟» فَقَالَا: نَشْهَدُ أَنَّ مُسَيْلِمَةَ رَسُولَ اللَّهِ فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «آمَنْتُ بِاللَّهِ وَرَسُولِهِ وَلَوْ كُنْتُ قَاتِلًا رَسُولًا لَقَتَلْتُكُمَا» . قَالَ عَبْدُ اللَّهِ: فَمَضَتِ السُّنَّةُ أَنَّ الرَّسول لَا يُقتَلُ. رَوَاهُ أَحْمد

Al-Mughira b. Shu'ba reported:

A woman killed her fellow-wife with a tent-pole. Her case was brought to Allah's Messenger (may peace be upon him), and he gave judgment that blood-wit should be paid by the relatives (of the offender) on the father's side. And as she was pregnant, he decided regarding her unborn child that a male or a female slave of good quality be given. Some of her offender's) relatives said: Should we make compensation for one who never ate, nor drank, nor made any noise, who was like a nonentity? Thereupon Allah's Messenger (may peace be upon him) said: He was talking rhymed phrases like the rhymed phrases of desert Arabs.
وَحَدَّثَنِي مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا يَحْيَى بْنُ آدَمَ، حَدَّثَنَا مُفَضَّلٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، ‏.‏ أَنَّ امْرَأَةً، قَتَلَتْ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍ فَأُتِيَ فِيهِ رَسُولُ اللَّهِ صلى الله عليه وسلم فَقَضَى عَلَى عَاقِلَتِهَا بِالدِّيَةِ وَكَانَتْ حَامِلاً فَقَضَى فِي الْجَنِينِ بِغُرَّةٍ ‏.‏ فَقَالَ بَعْضُ عَصَبَتِهَا أَنَدِي مَنْ لاَ طَعِمَ وَلاَ شَرِبَ وَلاَ صَاحَ فَاسْتَهَلَّ وَمِثْلُ ذَلِكَ يُطَلُّ قَالَ فَقَالَ ‏"‏ سَجْعٌ كَسَجْعِ الأَعْرَابِ ‏" ‏ ‏.‏

It has been narrated on the authority of Ibn Umar that the Jews of Banu Nadir and Banu Quraiza fought against the Messenger of Allah (may peace be upon him) who expelled Banu Nadir, and allowed Quraiza to stay on, and granted favour to them until they too fought against him Then he killed their men, and distributed their women, children and properties among the Muslims, except that some of them had joined the Messenger of Allah (may peace be upon him) who granted them security. They embraced Islam. The Messenger of Allah (may peace be upon him) turned out all the Jews of Medina. Banu Qainuqa' (the tribe of 'Abdullah b. Salim) and the Jews of Banu Haritha and every other Jew who was in Medina.

وَحَدَّثَنِي مُحَمَّدُ بْنُ رَافِعٍ، وَإِسْحَاقُ بْنُ مَنْصُورٍ، قَالَ ابْنُ رَافِعٍ حَدَّثَنَا وَقَالَ، إِسْحَاقُ أَخْبَرَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، عَنْ مُوسَى بْنِ عُقْبَةَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّالله عليه وسلم فَأَجْلَى رَسُولُ اللَّهِ صلى الله عليه وسلم بَنِي النَّضِيرِ وَأَقَرَّ قُرَيْظَةَ وَمَنَّ عَلَيْهِمْ حَتَّى حَارَبَتْ قُرَيْظَةُ بَعْدَ ذَلِكَ فَقَتَلَ رِجَالَهُمْ وَقَسَمَ نِسَاءَهُمْ وَأَوْلاَدَهُمْ وَأَمْوَالَهُمْ بَيْنَ الْمُسْلِمِينَ إِلاَّ أَنَّ بَعْضَهُمْ لَحِقُوا بِرَسُولِ اللَّهِ صلى الله عليه وسلم فَآمَنَهُمْ وَأَسْلَمُوا وَأَجْلَى رَسُولُ اللَّهِ صلى الله عليه وسلم يَهُودَ الْمَدِينَةِ كُلَّهُمْ بَنِي قَيْنُقَاعَ - وَهُمْ قَوْمُ عَبْدِ اللَّهِ بْنِ سَلاَمٍ - وَيَهُودَ بَنِي حَارِثَةَ وَكُلَّ يَهُودِيٍّ كَانَ بِالْمَدِينَةِ ‏.‏

Asma' b. 'Ubaid reported about a person who was called as-Sa'ib having said:

We visited Abu Sa'id Khudri. When we had been sitting (with him) we heard a stir under his bed. When we looked we found a big snake, the rest of the hadith is the same. And in this Allah's Messenger (may peace be upon him) is reported to have said: Verily in these houses there live aged (snakes), so when you see one of them, make life hard for it for three days, and if it goes away (well and good), otherwise kill it for (in that case) it would be a nonbeliever. And he (the Holy Prophet) said (to his Companions): Go and bury your companion (who had died by the snake bite).
وَحَدَّثَنِي مُحَمَّدُ بْنُ رَافِعٍ، حَدَّثَنَا وَهْبُ بْنُ جَرِيرِ بْنِ حَازِمٍ، حَدَّثَنَا أَبِي قَالَ، سَمِعْتُ أَسْمَاءَ بْنَ عُبَيْدٍ، يُحَدِّثُ عَنْ رَجُلٍ، يُقَالُ لَهُ السَّائِبُ - وَهُوَ عِنْدَنَا أَبُو السَّائِبِ - قَالَ دَخَلْنَا عَلَى أَبِي سَعِيدٍ الْخُدْرِيِّ فَبَيْنَمَا نَحْنُ جُلُوسٌ إِذْ سَمِعْنَا تَحْتَ، سَرِيرِهِ حَرَكَةً فَنَظَرْنَا فَإِذَا حَيَّةٌ ‏.‏ وَسَاقَ الْحَدِيثَ بِقِصَّتِهِ نَحْوَ حَدِيثِ مَالِكٍ عَنْ صَيْفِيٍّ وَقَالَ فِيهِ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّ لِهَذِهِ الْبُيُوتِ عَوَامِرَ فَإِذَا رَأَيْتُمْ شَيْئًا مِنْهَا فَحَرِّجُوا عَلَيْهَا ثَلاَثًا فَإِنْ ذَهَبَ وَإِلاَّ فَاقْتُلُوهُ فَإِنَّهُ كَافِرٌ ‏"‏ ‏.‏ وَقَالَ لَهُمُ ‏"‏ اذْهَبُوا فَادْفِنُوا صَاحِبَكُمْ ‏"‏ ‏.‏

We were walking with Allah's Messenger (may peace be upon him) that Ibn Sayyad happened to pass by him. Allah's Messenger (may peace be upon him) said to him: I have concealed for you (something to test you, so tell me that). He said: It is Dukh. Thereupon Allah's Messenger (may peace be upon him) said to him: Be off. You cannot get farther than your rank, whereupon 'Umar said: Allah's Messenger, permit me to strike his neck. Thereupon Allah's Messenger (may peace be upon him) said: Leave him; if he is that one (Dajjal) whom you apprehend, you will not be able to kill him.

Sa'id b. Jubair reported:

I said to Ibn Abbas: Will the repentance of that person be accepted who kills a believer intentionally? He said: No. I recited to him this verse of Sura al-Furqan (xix.):" And those who call not upon another god with Allah and slay not the soul which Allah has forbidden except in the cause of justice" to the end of the verse. He said: This is a Meccan verse which has been abrogated by a verse revealed at Medina:" He who slays a believer intentionally, for him is the requital of Hell-Fire where he would abide for ever," and in the narration of Ibn Hisham (the words are): I recited to him this verse of Sura al-Furqan:" Except one who made repentance."

That the Messenger of Allah (saws) said: "If it were not that dogs were part of a nation among the nations, then I would order to that all of them be killed. So kill every one of them that is all black."
حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا هُشَيْمٌ، أَخْبَرَنَا مَنْصُورُ بْنُ زَاذَانَ، وَيُونُسُ بْنُ عُبَيْدٍ، عَنِ الْحَسَنِ، عَنْ عَبْدِ اللَّهِ بْنِ مُغَفَّلٍ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ لَوْلاَ أَنَّ الْكِلاَبَ أُمَّةٌ مِنَ الأُمَمِ لأَمَرْتُ بِقَتْلِهَا كُلِّهَا فَاقْتُلُوا مِنْهَا كُلَّ أَسْوَدَ بَهِيمٍ ‏" ‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ وَجَابِرٍ وَأَبِي رَافِعٍ وَأَبِي أَيُّوبَ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ عَبْدِ اللَّهِ بْنِ مُغَفَّلٍ حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَيُرْوَى فِي بَعْضِ الْحَدِيثِ ‏"‏ أَنَّ الْكَلْبَ الأَسْوَدَ الْبَهِيمَ شَيْطَانٌ ‏"‏ ‏.‏ وَالْكَلْبُ الأَسْوَدُ الْبَهِيمُ الَّذِي لاَ يَكُونُ فِيهِ شَيْءٌ مِنَ الْبَيَاضِ ‏.‏ وَقَدْ كَرِهَ بَعْضُ أَهْلِ الْعِلْمِ صَيْدَ الْكَلْبِ الأَسْوَدِ الْبَهِيمِ ‏.‏

It was narrated that Anas said:
"Eighty men from 'Ukl came to the Messenger of Allah [SAW]" and he (the narrator) mentioned a similar report up to the words: "And he did not have (their wounds) cauterized." And he said: "They killed the herdsman."

Sahl bin Sa'd As-Sa'idi narrated that 'Uwaimir Al-'Ajlani came to 'Asim bin 'Adiy and said:
"What do you think, O 'Asim! If a man finds another man with his wife, should he kill him, and be killed in retaliation, or what should he do? O 'Asim! Ask the Messenger of Allah about that for me." So 'Asim asked the Messenger of Allah about that, and the Messenger of Allah disapproved of the question, and criticized the asking of too many questions until 'Asim felt upset. When 'Asim went back to his people, 'Uwaimir came to him and said: "O 'Asim, what did the Messenger of Allah say to you?" 'Asim said: "You have not brought me any good. The Messenger of Allah disapproved of the question you asked." 'Uwaimir said: "By Allah, I will go and ask the Messenger of Allah." So he went to the Messenger of Allah and found him in the midst of the people. He said: "O Messenger of Allah, what do you think if a man finds another man with his wife -should he kill him, and be killed in retaliation or what should he do?" The Messenger of Allah said: "Something has been revealed concerning you and your wife, so go and bring her here." Sahl said: "So they engaged in the procedure of Li'an, and I was among the people in the presence of the Messenger of Allah. When 'Uwaimir finished he said: "I would have been telling lies about her, O Messenger of Allah, if I keep her." So he divorced her thrice before the Messenger of Allah told him to do so."
أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، قَالَ حَدَّثَنَا ابْنُ الْقَاسِمِ، عَنْ مَالِكٍ، قَالَ حَدَّثَنِي ابْنُ شِهَابٍ، أَنَّ سَهْلَ بْنَ سَعْدٍ السَّاعِدِيَّ، أَخْبَرَهُ أَنَّ عُوَيْمِرًا الْعَجْلاَنِيَّ جَاءَ إِلَى عَاصِمِ بْنِ عَدِيٍّ فَقَالَ أَرَأَيْتَ يَا عَاصِمُ لَوْ أَنَّ رَجُلاً وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً أَيَقْتُلُهُ فَيَقْتُلُونَهُ أَمْ كَيْفَ يَفْعَلُ سَلْ لِي يَا عَاصِمُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْ ذَلِكَ ‏.‏ فَسَأَلَ عَاصِمٌ رَسُولَ اللَّهِ صلى الله عليه وسلم فَكَرِهَ رَسُولُ اللَّهِ صلى الله عليه وسلم الْمَسَائِلَ وَعَابَهَا حَتَّى كَبُرَ عَلَى عَاصِمٍ مَا سَمِعَ مِنْ رَسُولِ اللَّهِ صلى الله عليه وسلم فَلَمَّا رَجَعَ عَاصِمٌ إِلَى أَهْلِهِ جَاءَهُ عُوَيْمِرٌ فَقَالَ يَا عَاصِمُ مَاذَا قَالَ لَكَ رَسُولُ اللَّهِ صلى الله عليه وسلم فَقَالَ عَاصِمٌ لِعُوَيْمِرٍ لَمْ تَأْتِنِي بِخَيْرٍ قَدْ كَرِهَ رَسُولُ اللَّهِ صلى الله عليه وسلم الْمَسْأَلَةَ الَّتِي سَأَلْتَ عَنْهَا ‏.‏ فَقَالَ عُوَيْمِرٌ وَاللَّهِ لاَ أَنْتَهِي حَتَّى أَسْأَلَ عَنْهَا رَسُولَ اللَّهِ صلى الله عليه وسلم ‏.‏ فَأَقْبَلَ عُوَيْمِرٌ حَتَّى أَتَى رَسُولَ اللَّهِ صلى الله عليه وسلم ...

It was narrated from Abu Bakr bin Muhammad bin 'Amr bin Hazm, from his father from his grandfather, that:
the Messenger of Allah wrote a letter to the people of Yemen, included in which were the rules of inheritance, the sunan and the (rules concerning) blood money. He sent it with 'Arm bin Hazm and it was read to the people of Yemen, Its contents were as follows: "From Muhammad the Prophet to Shurahbil bin 'Abd Kulal, Nu'aim bin 'Abd Kulal, Al-Harith bin' Abd Kulal, Qail dhil-Ru'ain, Mu'afir and Hamdan. To precede" - And in this letter it said that whoevewrkills a believer for no just reason is to be killed in return, unless the heirs of the victim agree to pardon him. For killing a person, the Diyah is one hundred camels. For the nose, if it is cut off completely, diyah must be paid, for the tongue, diyah must be paid; for the lips, Diyah must be paid; for the testicles, Diyah must be paid; for the ends, Diyah must be paid; for the backbone, Dynamist be paid; for the eyes, Diyah must be paid; for one leg, half the Diyah must be paid; for a blow to the head that reaches the brain, one-third of thediyah must be paid; for a stab wound that penetrates deeply into the body, one-third of the diyah must be paid; for a blow that breaks the bone, fifteen camels must be given; for every digit of the hands or feet, ten camels must be given; for a tooth five camels must be given; for an injury that exposes the bone, five camels must be given. A man may be killed in return for (killing) a woman and those who deal in gold must pay one thousand dinars. (Daif)

Narrated Abdullah ibn Umar:

AbdurRahman ibn Samurah said: I was holding the hand of Ibn Umar on one of the ways of Medina. He suddenly came to a hanging head. He said: Unhappy is the one who killed him. When he proceeded, he said: I do not consider him but unfortunate. I heard the Messenger of Allah (saws) say: If anyone goes to a man of my community in order to kill him, he should say in this way, the one who kills will go to Hell and the one who is killed will go to Paradise.

Abu Dawud said: Al-Thawri has transmitted it from 'Awn from 'Abd al-Rahman b. Sumair or Sumairah ; and Laith b. Abu Sulaim transmitted it from 'Awn from 'Abd al-Rahman b. Sumairah.

Abu Dawud said: Al-Hasan b. 'Ali said to me: Abu al-Walid transmitted this tradition to us from Abu 'Awanah, and said: It (the name Ibn Samurah) is in my notebook Ibn Sabrah. The people also transmitted it as Samurah and Sumairah. These are wordings of Abu al-Walid.

a man came to the Prophet and said: "O Messenger of Allah, I have trained dogs; advise me concerning them." He said: "Whatever your dogs catch for you, eat," I side: "Even if they kill it?" He said: "Even if they kill it. " He said: "Advise me about my bow. "He said: "Whatever your arrow returns to you, eat." He said: "Even if it gets away from you, so long as you do not find the mark of an arrow other than yours on it, or you find that it has gone rotten."(Another chain).

Sunan an-Nasa'i 4729
It was narrated from 'Alqamah bin Wa'il that:
his father told them that a man who had killed another man was brought to the Prophet and he handed him over to their of the victim to kill him. Then the Prophet said to those who were sitting with him: "The killer and the slain will both be in Fire. "A man went after him and told him that, and when he told him that, he left him (let him go). He (the narrator) said: "I saw him dragging his string when he let him go. I mentioned that the Habib and he said: 'Sa'eed bin Ashwa' told me that the Prophet commanded the man to forgive him."'
أَخْبَرَنَا مُحَمَّدُ بْنُ مَعْمَرٍ، قَالَ حَدَّثَنَا يَحْيَى بْنُ حَمَّادٍ، عَنْ أَبِي عَوَانَةَ، عَنْ إِسْمَاعِيلَ بْنِ سَالِمٍ، عَنْ عَلْقَمَةَ بْنِ وَائِلٍ، أَنَّ أَبَاهُ، حَدَّثَهُمْ أَنَّ النَّبِيَّ صلى الله عليه وسلم أُتِيَ بِرَجُلٍ قَدْ قَتَلَ رَجُلاً فَدَفَعَهُ إِلَى وَلِيِّ الْمَقْتُولِ يَقْتُلُهُ فَقَالَ النَّبِيُّ صلى الله عليه وسلم لِجُلَسَائِهِ ‏ "‏ الْقَاتِلُ وَالْمَقْتُولُ فِي النَّارِ ‏"‏ ‏.‏ قَالَ فَاتَّبَعَهُ رَجُلٌ فَأَخْبَرَهُ فَلَمَّا أَخْبَرَهُ تَرَكَهُ ‏.‏ قَالَ فَلَقَدْ رَأَيْتُهُ يَجُرُّ نِسْعَتَهُ حِينَ تَرَكَهُ يَذْهَبُ ‏.‏ فَذَكَرْتُ ذَلِكَ لِحَبِيبٍ فَقَالَ حَدَّثَنِي سَعِيدُ بْنُ أَشْوَعَ قَالَ وَذَكَرَ أَنَّ النَّبِيَّ صلى الله عليه وسلم أَمَرَ الرَّجُلَ بِالْعَفْوِ ‏.‏

Yahya related to me from Malik from Abu'z-Zinad from al-Araj from Abu Hurayra that the Messenger of Allah, may Allah bless him and grant him peace, said, "By He in whose hand my self is! I would like to fight in the way of Allah and be killed, then be brought to life again so I could be killed, and then be brought to life again so I could be killed." Abu Hurayra said three times, "I testify to it by Allah!"

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ أَبِي الزِّنَادِ، عَنِ الأَعْرَجِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ وَالَّذِي نَفْسِي بِيَدِهِ لَوَدِدْتُ أَنِّي أُقَاتِلُ فِي سَبِيلِ اللَّهِ فَأُقْتَلُ ثُمَّ أُحْيَا فَأُقْتَلُ ثُمَّ أُحْيَا فَأُقْتَلُ ‏"‏ ‏.‏ فَكَانَ أَبُو هُرَيْرَةَ يَقُولُ ثَلاَثًا أَشْهَدُ بِاللَّهِ ‏.‏

'Amr b. Shu'aib, on his father’s authority, said his grandfather reported God’s Messenger as saying, “If anyone kills a man deliberately he is to be handed over to the relatives of the one who has been killed. If they wish they may kill him, but if they wish they may accept blood wit, which is thirty she-camels in their fourth year, thirty in their fifth year, and forty pregnant she-camels. Any arrangement they make with him is for them to decide.” Tirmidhi transmitted it.
وَعَنْ عَمْرِو بْنِ شُعَيْبٍ عَنْ أَبِيهِ عَنْ جَدِّهِ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " مَنْ قَتَلَ مُتَعَمِّدًا دُفِعَ إِلَى أولياءِ المقتولِ فإِنْ شاؤوا قَتَلوا وإِنْ شَاؤوا أَخَذُوا الدِّيَةَ: وَهِيَ ثَلَاثُونَ حِقَّةً وَثَلَاثُونَ جَذَعَةً وَأَرْبَعُونَ خَلِفَةً وَمَا صَالَحُوا عَلَيْهِ فَهُوَ لَهُمْ ". رَوَاهُ التِّرْمِذِيّ

Abu Huraira reported God’s Messenger as saying, “He who throws himself from a mountain and kills himself will be thrown down in the fire of jahannam and remain in it for ever and ever; he who sips poison and kills himself will have his poison in his hand and sip it for ever and ever in the fire of jahannam; and he who kills himself with a piece of iron will have his piece of iron in his hand and will be stabbed with it in his belly in the fire of jahannam for ever and ever.” (Bukhari and Muslim.)
عَنْ أَبِي هُرَيْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ تَرَدَّى مِنْ جَبَلٍ فَقَتَلَ نَفْسَهُ فَهُوَ فِي نَارِ جَهَنَّمَ يَتَرَدَّى فِيهَا خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا وَمَنْ تَحَسَّى سُمًّا فَقَتَلَ نَفْسَهُ فَسُمُّهُ فِي يَدِهِ يَتَحَسَّاهُ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا فِيهَا أَبَدًا وَمَنْ قَتَلَ نَفْسَهُ بِحَدِيدَةٍ فَحَدِيدَتُهُ فِي يَدِهِ يَتَوَجَّأُ بِهَا فِي بَطْنِهِ فِي نَارِ جهنَّمَ خَالِدا مخلَّداً فِيهَا أبدا»

Al-Hasan narrated:
A man came to az-Zubair bin al-’Awwam (رضي الله عنه) and said: “Shall I kill `Ali for you?” He said: “No; how can you kill him when he has the troops with him?” He said: “I will catch up with him and assassinate him.” He said: “No. The Messenger of Allah (ﷺ) said: Faith prohibits assassination; no believer should resort to that.” Al-Hasan said: A man came to az-Zubair bin al-`Awwam (رضي الله عنه) and said: “Shall I not kill `Ali for you?” He said: “How can you kill him when he has people with him?” (and he narrated a similar report.)

It was narrated that 'Ubaidullah bin Abi Bakr said:
"I heard Anas say: 'The Messenger of Allah [SAW] said: The major sins are: Associating others with Allah (Shirk), disobeying one's parents, killing a soul (murder) and speaking falsely.'"

It was narrated that Abu Barzah Al-Aslami said:
"A man spoke harshly to Abu Bakr As-Siddiq, and I said: 'Shall I kill him?' He told me off, and said: 'That is not for anyone after the Messenger of Allah [SAW].'"

It was narrated from Sa'eed bin Zaid that:
The Prophet [SAW] said: "Whoever fights to protect his wealth and is killed, he is a martyr. Whoever fights to protect himself, he is a martyr. Whoever fights to protect his family is a martyr."

During the Farewell Pilgrimage, the Messenger of Allah [SAW] asked the people to be quiet and listen, and said: "Do not revert to disbelievers after I am gone, striking the necks of one another (killing one another)."

It was narrated from 'Abdullah bin Mughaffal that the Messenger of Allah (PBUH) commanded that dogs be killed, but he made an exception for hunting dogs and sheepdogs and said:
"If a dog licks a vessel then wash it seven times and rub it the eighth time with dust."
أَخْبَرَنَا مُحَمَّدُ بْنُ عَبْدِ الأَعْلَى، قَالَ حَدَّثَنَا خَالِدٌ، - يَعْنِي ابْنَ الْحَارِثِ - عَنْ شُعْبَةَ، عَنْ أَبِي التَّيَّاحِ، قَالَ سَمِعْتُ مُطَرِّفًا، عَنْ عَبْدِ اللَّهِ بْنِ مُغَفَّلٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم أَمَرَ بِقَتْلِ الْكِلاَبِ وَرَخَّصَ فِي كَلْبِ الصَّيْدِ وَالْغَنَمِ وَقَالَ ‏"‏ إِذَا وَلَغَ الْكَلْبُ فِي الإِنَاءِ فَاغْسِلُوهُ سَبْعَ مَرَّاتٍ وَعَفِّرُوهُ الثَّامِنَةَ بِالتُّرَابِ ‏"‏ ‏.‏

Abu Said Khudri reported that 'Ali (Allah be pleased with him) sent some gold alloyed with dust to the Messenger of Allah (may peace be upon him), and the Messenger of Allah (may peace be upon him) distributed that among four men, al-Aqra b. Habis Hanzali and Uyaina b. Badr al-Fazari and 'Alqama b. 'Ulatha al-'Amiri, then to one person of the tribe of Kilab and to Zaid al-Khair al-Ta'l, and then to one person of the tribe of Nabhan. Upon this the people of Quraish felt angry and said:

He (the Holy Prophet) gave to the chiefs of Najd and ignored us. Upon this the Messenger of Allah (may peace be upon him) said: I have done it with a view to conciliating between them. Then there came a person with thick beard, prominent cheeks, deep sunken eyes and protruding forehead and shaven head. He said: Muhammad, fear Allah. Upon this the Messenger of Allah (may peace be upon him) said: "If I disobey Allah, who would then obey Him? Have I not been (sent as the) most trustworthy among the people of the world? But you do not repose trust in me." That person then went back. A person among the people then sought permission (from the Holy Prophet) for his murder. According to some, it was Khalid b. Walid who sought the permission. Upon this the Messenger of Allah (may peace be upon him), said: From this very person's posterity there would arise people who would recite the Qur'an, but it would not go beyond their throat; they would kill the followers of Islam and would spare the idol-worshippers. They would glance through the teachings of Islam so hurriedly just as the arrow passes through the pray. If I were to ever find them I would kill them like 'Ad.
حَدَّثَنَا هَنَّادُ بْنُ السَّرِيِّ، حَدَّثَنَا أَبُو الأَحْوَصِ، عَنْ سَعِيدِ بْنِ مَسْرُوقٍ، عَنْ عَبْدِ الرَّحْمَنِ، بْنِ أَبِي نُعْمٍ عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، قَالَ بَعَثَ عَلِيٌّ - رضى الله عنه - وَهُوَ بِالْيَمَنِ بِذَهَبَةٍ فِي تُرْبَتِهَا إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَسَمَهَا رَسُولُ اللَّهِ صلى الله عليه وسلم بَيْنَ أَرْبَعَةِ نَفَرٍ الأَقْرَعُ بْنُ حَابِسٍ الْحَنْظَلِيُّ وَعُيَيْنَةُ بْنُ بَدْرٍ الْفَزَارِيُّ وَعَلْقَمَةُ بْنُ عُلاَثَةَ الْعَامِرِيُّ ثُمَّ أَحَدُ بَنِي كِلاَبٍ وَزَيْدُ الْخَيْرِ الطَّائِيُّ ثُمَّ أَحَدُ بَنِي نَبْهَانَ - قَالَ - فَغَضِبَتْ قُرَيْشٌ فَقَالُوا أَتُعْطِي صَنَادِيدَ نَجْدٍ وَتَدَعُنَا فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنِّي إِنَّمَا فَعَلْتُ ذَلِكَ لأَتَأَلَّفَهُمْ ‏"‏ فَجَاءَ رَجُلٌ كَثُّ اللِّحْيَةِ مُشْرِفُ الْوَجْنَتَيْنِ غَائِرُ الْعَيْنَيْنِ نَاتِئُ الْجَبِينِ مَحْلُوقُ الرَّأْسِ فَقَالَ اتَّقِ اللَّهَ يَا مُحَمَّدُ ‏.‏ - قَالَ - فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ فَمَنْ يُطِعِ اللَّهَ إِنْ عَصَيْتُهُ أَيَأْمَنُنِي عَلَى أَهْلِ الأَرْضِ وَلاَ تَأْمَنُونِي ...

Abu Huraira reported Allah's Messenger (may peace be upon him) as saying:

The Last Hour would not come until the Romans would land at al-A'maq or in Dabiq. An army consisting of the best (soldiers) of the people of the earth at that time will come from Medina (to counteract them). When they will arrange themselves in ranks, the Romans would say: Do not stand between us and those (Muslims) who took prisoners from amongst us. Let us fight with them; and the Muslims would say: Nay, by Allah, we would never get aside from you and from our brethren that you may fight them. They will then fight and a third (part) of the army would run away, whom Allah will never forgive. A third (part of the army) which would be constituted of excellent martyrs in Allah's eye, would be killed and the third who would never be put to trial would win and they would be conquerors of Constantinople. And as they would be busy in distributing the spoils of war (amongst themselves) after hanging their swords by the olive trees, the Satan would cry: The Dajjal has taken your place among your family. They would then come out, but it would be of no avail. And when they would come to Syria, he would come out while they would be still preparing themselves for battle drawing up the ranks. Certainly, the time of prayer shall come and then Jesus (peace be upon him) son of Mary would descend and would lead them. When the enemy of Allah would see him, it would (disappear) just as the salt dissolves itself in water and if he (Jesus) were not to confront them at all, even then it would dissolve completely, but Allah would kill them by his hand and he would show them their blood on his lance (the lance of Jesus Christ).
حَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ، حَدَّثَنَا مُعَلَّى بْنُ مَنْصُورٍ، حَدَّثَنَا سُلَيْمَانُ بْنُ بِلاَلٍ، حَدَّثَنَا سُهَيْلٌ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ لاَ تَقُومُ السَّاعَةُ حَتَّى يَنْزِلَ الرُّومُ بِالأَعْمَاقِ أَوْ بِدَابِقَ فَيَخْرُجُ إِلَيْهِمْ جَيْشٌ مِنَ الْمَدِينَةِ مِنْ خِيَارِ أَهْلِ الأَرْضِ يَوْمَئِذٍ فَإِذَا تَصَافُّوا قَالَتِ الرُّومُ خَلُّوا بَيْنَنَا وَبَيْنَ الَّذِينَ سَبَوْا مِنَّا نُقَاتِلْهُمْ ‏.‏ فَيَقُولُ الْمُسْلِمُونَ لاَ وَاللَّهِ لاَ نُخَلِّي بَيْنَكُمْ وَبَيْنَ إِخْوَانِنَا ‏.‏ فَيُقَاتِلُونَهُمْ فَيَنْهَزِمُ ثُلُثٌ لاَ يَتُوبُ اللَّهُ عَلَيْهِمْ أَبَدًا وَيُقْتَلُ ثُلُثُهُمْ أَفْضَلُ الشُّهَدَاءِ عِنْدَ اللَّهِ وَيَفْتَتِحُ الثُّلُثُ لاَ يُفْتَنُونَ أَبَدًا فَيَفْتَتِحُونَ قُسْطُنْطِينِيَّةَ فَبَيْنَمَا هُمْ يَقْتَسِمُونَ الْغَنَائِمَ قَدْ عَلَّقُوا سُيُوفَهُمْ بِالزَّيْتُونِ إِذْ صَاحَ فِيهِمُ الشَّيْطَانُ إِنَّ الْمَسِيحَ قَدْ خَلَفَكُمْ فِي أَهْلِيكُمْ ‏.‏ فَيَخْرُجُونَ وَذَلِكَ بَاطِلٌ ...

'Abdullah reported:

I asked the Messenger of Allah (may peace be upon him): Which sin is the gravest in the eye of Allah? He (the Holy Prophet) replied: That you associate a partner with Allah (despite the fact) that He has created you. He (the reporter) said: I told him (the, Holy Prophet): Verily it is indeed grave. He (the reporter) said: I asked him what the next (gravest sin) was. He (the Holy Prophet) replied: That you kill your child out of fear that he shall join you in food. He (the reporter) said: I asked (him) what the next (gravest sin) was. He (the Holy Prophet) observed: Then (the next gravest sin) is that you commit adultery with the wife of your neighbour.

Khabbab al-Aratt reported:

We migrated with the Messenger of Allah (may peace be upon him) in the path of Allah seeking Allah's pleasure alone. Thus our reward was assured with Allah. And amongst us were those who spent life (in such a state of piety and austerity) that nothing consumed their reward. Mus'ab b. 'Umair was one of them. He was killed on the Day of Uhud, and nothing but a woollen cloak was found to shroud him. When we covered his head with it, his feet became uncovered, and when we covered his feet, his head was uncovered. Upon this the Messenger of Allah (may peace be upon him) said: Place it (this cloak) on the side of his head and cover his feet with grass. And there is one amongst us for whom the fruit is ripened and he enjoys it.

This hadith has been narrated through another chain of transmitters and (the narrator) made a mention of elevated forehead, but he made no mention of tucked-up loin cloth and made this addition:

" There stood up 'Umar b. Khattab (Allah be pleased with him), and said: Should I not strike his neck? Upon this he said: No. Then he turned away, and Khalid the Sword of Allah stood up against him, and said: Prophet of Allah. shall I not strike off his neck? He said, No, and then said: A people would rise from his progeny who would recite the Book of Allah glibly and fluently. 'Umar said: I think he (the Holy Prophet) also said this: If I find them I would certainly kill them like Thamud."

Sahih Muslim 1682 a

Al-Mughira b. Shu'ba reported that a woman struck her co-wife with a tent-pole and she was pregnant and she killed her. One of them belonged to the tribe of Lihyan. Allah's Messenger (may peace be upon him) made the relatives of the murderer responsible for the payment of blood-wit on her behalf, and fixed a slave or a female slave as the indemnity for what was in her womb. One of the persons amongst the relatives of the murderer said:

Should we pay indemnity for one who, neither ate, nor drank, nor made any noise, who was just like a nonentity? Thereupon Allah's Messenger (may peace be upon him) remarked: He speaks rhymed phrases like the people of the desert. He did impose indemnity upon them.
حَدَّثَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ الْحَنْظَلِيُّ، أَخْبَرَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ، عَنْ عُبَيْدِ بْنِ نُضَيْلَةَ الْخُزَاعِيِّ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، قَالَ ضَرَبَتِ امْرَأَةٌ ضَرَّتَهَا بِعَمُودِ فُسْطَاطٍ وَهِيَ حُبْلَى فَقَتَلَتْهَا - قَالَ - وَإِحْدَاهُمَا لِحْيَانِيَّةٌ - قَالَ - فَجَعَلَ رَسُولُ اللَّهِ صلى الله عليه وسلم دِيَةَ الْمَقْتُولَةِ عَلَى عَصَبَةِ الْقَاتِلَةِ وَغُرَّةً لِمَا فِي بَطْنِهَا ‏.‏ فَقَالَ رَجُلٌ مِنْ عَصَبَةِ الْقَاتِلَةِ أَنَغْرَمُ دِيَةَ مَنْ لاَ أَكَلَ وَلاَ شَرِبَ وَلاَ اسْتَهَلَّ فَمِثْلُ ذَلِكَ يُطَلُّ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَسَجْعٌ كَسَجْعِ الأَعْرَابِ ‏" ‏ ‏.‏ قَالَ وَجَعَلَ عَلَيْهِمُ الدِّيَةَ ‏.‏

'Adi b. Hatim reported:

I asked Allah's Messenger (may peace be upon him) about hunting the game with the help of Mi'rad, whereupon he said: If it strikes (the game) with its point, then eat it, but if it strikes flat, that is (the game is) beaten (into death), (then do not eat that) 'Adi further said: I asked him about hunting with the help of a dog, whereupon he said: If that (the dog) catches it (the game) for you and does not eat out of that, then you eat (the game) for Dhakat (slaughtering) of that is its being caught by it (by the dog). But if you find another dog besides it, and you fear that that dog (the second one) had caught it (the game) along with that (your dog) and killed it. then don't eat; for you recited the name of Allah on your dog and did not recite that on the other one (which joined your dog incidentally).
وَحَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ بْنِ نُمَيْرٍ، حَدَّثَنَا أَبِي، حَدَّثَنَا زَكَرِيَّاءُ، عَنْ عَامِرٍ، عَنْ عَدِيِّ بْنِ حَاتِمٍ، قَالَ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْ صَيْدِ الْمِعْرَاضِ فَقَالَ ‏"‏ مَا أَصَابَ بِحَدِّهِ فَكُلْهُ وَمَا أَصَابَ بِعَرْضِهِ فَهُوَ وَقِيذٌ ‏"‏ ‏.‏ وَسَأَلْتُهُ عَنْ صَيْدِ الْكَلْبِ فَقَالَ ‏"‏ مَا أَمْسَكَ عَلَيْكَ وَلَمْ يَأْكُلْ مِنْهُ فَكُلْهُ فَإِنَّ ذَكَاتَهُ أَخْذُهُ فَإِنْ وَجَدْتَ عِنْدَهُ كَلْبًا آخَرَ فَخَشِيتَ أَنْ يَكُونَ أَخَذَهُ مَعَهُ وَقَدْ قَتَلَهُ فَلاَ تَأْكُلْ إِنَّمَا ذَكَرْتَ اسْمَ اللَّهِ عَلَى كَلْبِكَ وَلَمْ تَذْكُرْهُ عَلَى غَيْرِهِ ‏" ‏ ‏.‏

Abu Musa reported Allah's Messenger (may peace be upon him) as saying:

The similitude of mine and of that with which Allah sent me is that of a person who came to us and said: O people, I have seen an army with my eyes and I am a plain warner (and issue you warning) that you should immediately manage to find an escape. A group of people from amongst them paying heed (to his warning) fled to a place of protection and a group amongst them belied him and the morning overtook them in their houses and the army attacked them and killed them and they were routed. And that is the similitude of the one who obeyed me, followed with which I had been sent and the similitude of the other is of one who disobeyed and belied me and the Truth with which I have been sent.

Uqba b. 'Amir reported Allah's Messenger (may peace be upon him) as saying:

Allah's Messenger offered prayer over those who had fallen matyrs at Uhud. He then climbed the pulpit as if someone is saying good-bye to the living and the dead, and then said: I shall be there as your predecesor on the Cistern before you, and it is as wide as the distance between Aila and Juhfa (Aila is at the top of the gulf of 'Aqaba). I am not afraid that you would associate anything with Allah after me, but I am afraid that you may be (allured) by the world and (vie) with one another (in possessing material wealth) and begin killing one another, and you would be destroyed as were destroyed those who had gone before you. 'Uqba said that that was the last occasion that he saw Allah's Massenger on the pulpit.
وَحَدَّثَنَا مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا وَهْبٌ، - يَعْنِي ابْنَ جَرِيرٍ - حَدَّثَنَا أَبِي قَالَ، سَمِعْتُ يَحْيَى بْنَ أَيُّوبَ، يُحَدِّثُ عَنْ يَزِيدَ بْنِ أَبِي حَبِيبٍ، عَنْ مَرْثَدٍ، عَنْ عُقْبَةَ بْنِ عَامِرٍ، قَالَ صَلَّى رَسُولُ اللَّهِ صلى الله عليه وسلم عَلَى قَتْلَى أُحُدٍ ثُمَّ صَعِدَ الْمِنْبَرَ كَالْمُوَدِّعِ لِلأَحْيَاءِ وَالأَمْوَاتِ فَقَالَ ‏"‏ إِنِّي فَرَطُكُمْ عَلَى الْحَوْضِ وَإِنَّ عَرْضَهُ كَمَا بَيْنَ أَيْلَةَ إِلَى الْجُحْفَةِ إِنِّي لَسْتُ أَخْشَى عَلَيْكُمْ أَنْ تُشْرِكُوا بَعْدِي وَلَكِنِّي أَخْشَى عَلَيْكُمُ الدُّنْيَا أَنْ تَنَافَسُوا فِيهَا وَتَقْتَتِلُوا فَتَهْلِكُوا كَمَا هَلَكَ مَنْ كَانَ قَبْلَكُمْ ‏" ‏ ‏.‏ قَالَ عُقْبَةُ فَكَانَتْ آخِرَ مَا رَأَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَلَى الْمِنْبَرِ ‏.‏

I was standing along with Ubayy b. Ka`b and he said: The opinions of the people differ in regard to the achievement of worldly ends. I said: Yes, of course. Thereupon he said: I heard Allah's Messenger (may peace be upon him) as saying: The Euphrates would soon uncover a mountain of gold and when the people would bear of it they would flock towards it but the people who would possess that (treasure) (would say): If we allow these persons to take out of it they would take away the whole of it. So they would fight and ninety-nine out of one hundred would be killed. Abu Kamil in his narration said: I and Ubayy b. Ka`b stood under the shade of the battlement of Hassan.
حَدَّثَنَا أَبُو كَامِلٍ، فُضَيْلُ بْنُ حُسَيْنٍ وَأَبُو مَعْنٍ الرَّقَاشِيُّ - وَاللَّفْظُ لأَبِي مَعْنٍ - قَالاَ حَدَّثَنَا خَالِدُ بْنُ الْحَارِثِ، حَدَّثَنَا عَبْدُ الْحَمِيدِ بْنُ جَعْفَرٍ، أَخْبَرَنِي أَبِي، عَنْ سُلَيْمَانَ بْنِ، يَسَارٍ عَنْ عَبْدِ اللَّهِ بْنِ الْحَارِثِ بْنِ نَوْفَلٍ، قَالَ كُنْتُ وَاقِفًا مَعَ أُبَىِّ بْنِ كَعْبٍ فَقَالَ لاَ يَزَالُ النَّاسُ مُخْتَلِفَةً أَعْنَاقُهُمْ فِي طَلَبِ الدُّنْيَا ‏.‏ قُلْتُ أَجَلْ ‏.‏ قَالَ إِنِّي سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏"‏ يُوشِكُ الْفُرَاتُ أَنْ يَحْسِرَ عَنْ جَبَلٍ مِنْ ذَهَبٍ فَإِذَا سَمِعَ بِهِ النَّاسُ سَارُوا إِلَيْهِ فَيَقُولُ مَنْ عِنْدَهُ لَئِنْ تَرَكْنَا النَّاسَ يَأْخُذُونَ مِنْهُ لَيُذْهَبَنَّ بِهِ كُلِّهِ قَالَ فَيَقْتَتِلُونَ عَلَيْهِ فَيُقْتَلُ مِنْ كُلِّ مِائَةٍ تِسْعَةٌ وَتِسْعُونَ ‏" ‏ ‏.‏ قَالَ أَبُو كَامِلٍ فِي حَدِيثِهِ قَالَ وَقَفْتُ أَنَا وَأُبَىُّ بْنُ كَعْبٍ فِي ظِلِّ ...

Sunan Ibn Majah 2635
It was narrated from Ibn 'Abbas, who attributed it to the Prophet (SAW):
“Whoever kills out of folly or for tribal motives, using a rock, a whip, or a stick; he must pay the blood money for killing by mistake. Whoever kills deliberately, he is to be killed in retaliation. Whoever tries to prevent that, upon him is the curse of Allah, the angels and all the people, and no change nor equitable exchange will be accepted from him.”
حَدَّثَنَا مُحَمَّدُ بْنُ مَعْمَرٍ، حَدَّثَنَا مُحَمَّدُ بْنُ كَثِيرٍ، حَدَّثَنَا سُلَيْمَانُ بْنُ كَثِيرٍ، عَنْ عَمْرِو بْنِ دِينَارٍ، عَنْ طَاوُسٍ، عَنِ ابْنِ عَبَّاسٍ، رَفَعَهُ إِلَى النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ قَتَلَ فِي عِمِّيَّةٍ أَوْ عَصَبِيَّةٍ بِحَجَرٍ أَوْ سَوْطٍ أَوْ عَصًا فَعَلَيْهِ عَقْلُ الْخَطَإِ وَمَنْ قَتَلَ عَمْدًا فَهُوَ قَوَدٌ وَمَنْ حَالَ بَيْنَهُ وَبَيْنَهُ فَعَلَيْهِ لَعْنَةُ اللَّهِ وَالْمَلاَئِكَةِ وَالنَّاسِ أَجْمَعِينَ لاَ يُقْبَلُ مِنْهُ صَرْفٌ وَلاَ عَدْلٌ ‏"‏ ‏.‏

Yahya related to me from Malik that he had heard that Marwan ibn al-Hakam wrote to Muawiya ibn Abi Sufyan to mention to him that a drunkard was brought to him who had killed a man. Muawiya wrote to him to kill him in retaliation for the dead man.

Yahya said that Malik said, "The best of what I have heard on the interpretation of this ayat, the word of Allah, the Blessed, the Exalted, 'The free man for the free man and the slave for the slave - these are men and the woman for the woman,' (Sura 2 ayat 178) is that retaliation is between women as it is between men. The free woman is killed for the free woman as the free man is killed for the free man. The slave-girl is slain for the slave-girl as the slave is slain for the slave. Retaliation is between women as it is between men. That is because Allah, the Blessed, the Exalted, said in His Book, 'We have written for them in it that it is a life for a life and an eye for an eye, a nose for a nose, and an ear for an ear, and a tooth for a tooth, and for wounds there is retaliation.' (Sura 5 ayat 48) Allah, the Blessed, the Exalted, mentioned that it is a life for a life. It is the life of a free woman for the life of a free man, and her injury for his injury."

Malik said about a man who held a man fast for another man to hit, and he died on the spot, "If he held him and he thought that he meant to kill him, the two of them are both killed for him. If he held him and he thought that he meant to beat him as people sometimes do, and he did not think that he meant to kill him, the murderer is slain and the one who held him is punished with a very severe punishment and jailed for a year. There is no killing against him."

Malik said about a man who murdered a man intentionally or gouged out his eye intentionally, and then was slain or had his eye gouged out himself before retaliation was inflicted on him, "There is no blood-money nor retaliation against him. The right of the one who was killed or had his eye gouged out goes when the thing which he is claiming as retaliation goes. It is the same with a man who murders another man intentionally and then the murderer dies. When the murderer dies, the one seeking blood-revenge has nothing of blood- money or anything else. That is by the word of Allah, the Blessed the Exalted, 'Retaliation is written for you in killing. The free man for the free man and the slave for the slave.' "

Malik said, "He only has retaliation against the one who killed him. If the man who murdered him dies, he has no retaliation or blood-money."

Malik said, "There is no retaliation held against a free man by a slave for any injury. The slave is killed for the free man when he intentionally murders him. The free man is not slain for the slave, even if he murders him intentionally. It is the best of what I have heard."

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ مَرْوَانَ بْنَ الْحَكَمِ، كَتَبَ إِلَى مُعَاوِيَةَ بْنِ أَبِي سُفْيَانَ يَذْكُرُ أَنَّهُ أُتِيَ بِسَكْرَانَ قَدْ قَتَلَ رَجُلاً فَكَتَبَ إِلَيْهِ مُعَاوِيَةُ أَنِ اقْتُلْهُ بِهِ ‏.‏ قَالَ يَحْيَى قَالَ مَالِكٌ أَحْسَنُ مَا سَمِعْتُ فِي تَأْوِيلِ هَذِهِ الآيَةِ قَوْلِ اللَّهِ تَبَارَكَ وَتَعَالَى ‏{‏الْحُرُّ بِالْحُرِّ وَالْعَبْدُ بِالْعَبْدِ ‏}‏ فَهَؤُلاَءِ الذُّكُورُ ‏{‏وَالأُنْثَى بِالأُنْثَى‏}‏ أَنَّ الْقِصَاصَ يَكُونُ بَيْنَ الإِنَاثِ كَمَا يَكُونُ بَيْنَ الذُّكُورِ وَالْمَرْأَةُ الْحُرَّةُ تُقْتَلُ بِالْمَرْأَةِ الْحُرَّةِ كَمَا يُقْتَلُ الْحُرُّ بِالْحُرِّ وَالأَمَةُ تُقْتَلُ بِالأَمَةِ كَمَا يُقْتَلُ الْعَبْدُ بِالْعَبْدِ وَالْقِصَاصُ يَكُونُ بَيْنَ النِّسَاءِ كَمَا يَكُونُ بَيْنَ الرِّجَالِ وَالْقِصَاصُ أَيْضًا يَكُونُ بَيْنَ الرِّجَالِ وَالنِّسَاءِ وَذَلِكَ أَنَّ اللَّهَ تَبَارَكَ وَتَعَالَى قَالَ فِي كِتَابِهِ ‏{‏وَكَتَبْنَا عَلَيْهِمْ فِيهَا أَنَّ النَّفْسَ بِالنَّفْسِ وَالْعَيْنَ بِالْعَيْنِ وَالأَنْفَ بِالأَنْفِ وَالأُذُنَ بِالأُذُنِ وَالسِّنَّ بِالسِّنِّ وَالْجُرُوحَ قِصَاصٌ ‏}‏ فَذَكَرَ اللَّهُ تَبَارَكَ وَتَعَالَى أَنَّ النَّفْسَ ...

It was narrated from Anas bin Malik that:
A Jewish man killed an Ansari girl for her jewelry, and threw her in an empty well, and crushed her head with a rock. He was caught and the Messenger of Allah [SAW] ordered that he be stoned to death.
أَخْبَرَنَا أَحْمَدُ بْنُ عَمْرِو بْنِ السَّرْحِ، وَالْحَارِثُ بْنُ مِسْكِينٍ، قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ، قَالَ حَدَّثَنَا ابْنُ وَهْبٍ، قَالَ أَخْبَرَنِي مُحَمَّدُ بْنُ عَمْرٍو، عَنِ ابْنِ جُرَيْجٍ، عَنْ أَيُّوبَ، عَنْ أَبِي قِلاَبَةَ، عَنْ أَنَسِ بْنِ مَالِكٍ، أَنَّ رَجُلاً، مِنَ الْيَهُودِ قَتَلَ جَارِيَةً مِنَ الأَنْصَارِ عَلَى حُلِيٍّ لَهَا وَأَلْقَاهَا فِي قَلِيبٍ وَرَضَخَ رَأْسَهَا بِالْحِجَارَةِ فَأُخِذَ فَأَمَرَ بِهِ رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ يُرْجَمَ حَتَّى يَمُوتَ ‏.‏
