مُسْنَدُ أَبِي حَمْزَةَ أَنَسِ بْنِ مَالِكٍ الْأَنْصَارِيِّ خَادِمِ رَسُولِ اللَّهِ ﷺ
Three-Narrator Ahadith 202
Anas ibn Mālik (may Allah be pleased with him) reported:
al-Rubayyi’, the paternal aunt of Anas ibn Mālik, broke one of the front teeth of a young girl. The relatives of al-Rubayyi’ asked for pardon but the girl’s family refused. They went to the Messenger of Allah ﷺ, who said, “[The ruling of Allah’s Book is] retribution.” Anas ibn al-Naḍr said, “O Messenger of Allah, should the tooth of so-and-so be broken?” The Messenger of Allah ﷺ replied, “O Anas, Allah’s Book decrees retribution.” He said, “By the One Who sent you with the truth, her tooth shall not be broken.” Thereafter the girl’s family agreed, forgave the offender, and waived retribution. The Messenger of Allah ﷺ then said, “There are among the servants of Allah those who, if they were to swear by Allah concerning something, He would fulfil their oath.”

حَدَّثَنَا ابْنُ أَبِي عَدِيٍّ، عَنْ حُمَيْدٍ، عَنْ أَنَسٍ، أَنَّ الرُّبَيِّعَ عَمَّةَ أَنَسٍ كَسَرَتْ ثَنِيَّةَ جَارِيَةٍ، فَطَلَبُوا إِلَى الْقَوْمِ الْعَفْوَ فَأَبَوْا، فَأَتَوْا رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَقَالَ: «الْقِصَاصُ». قَالَ أَنَسُ بْنُ النَّضْرِ: يَا رَسُولَ اللَّهِ، أَتُكْسَرُ ثَنِيَّةُ فُلَانَةَ؟ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «يَا أَنَسُ، كِتَابُ اللَّهِ الْقِصَاصُ». قَالَ: فَقَالَ: وَالَّذِي بَعَثَكَ بِالْحَقِّ لَا تُكْسَرُ ثَنِيَّةُ فُلَانَةَ. قَالَ: فَرَضِيَ الْقَوْمُ، فَعَفَوْا وَتَرَكُوا الْقِصَاصَ. فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ مِنْ عِبَادِ اللَّهِ مَنْ لَوْ أَقْسَمَ عَلَى اللَّهِ أَبَرَّهُ».

Chain: Aḥmad → Ibn Abī ʿAdī → Ḥumayd al-Ṭawīl → Anas → the Prophet ﷺ. Rijāl: (1) Ibn Abī ʿAdī: Muḥammad ibn Ibrāhīm ibn Abī ʿAdī al-Baṣrī (d. 194 AH); thiqa ḥujjah. (2) Ḥumayd al-Ṭawīl: Ḥumayd ibn Abī Ḥumayd al-Ṭawīl al-Baṣrī (d. 142 AH); thiqa. (3) Anas ibn Mālik: Companion (Ṣaḥābī); the Prophet's ﷺ servant for ten years; d. 93 AH. Takhrīj: Aḥmad (3/128); al-Bukhārī in Kitāb al-Ṣulḥ (2703) and Kitāb al-Diyāt (6894) from Anas, with the addition that the family ultimately accepted financial compensation; Muslim in Kitāb al-Qasāmah (1675). Anas ibn al-Naḍr, the brother of al-Rubayyi’, is different from Anas ibn Mālik the narrator; he died a martyr at Uḥud. His oath did not contest the Prophet’s ruling—rather, his intent was that he himself would never countenance al-Rubayyi’ being subjected to qiṣāṣ. His resolve so moved the injured family that they pardoned the offence voluntarily.
