Sunan an-Nasa'i 4736
It was narrated from Samurah that the Messenger of Allah said:
"Whoever kills his slave, we will kill him: whoever mutilates (his slave). We will mutilate him, and whoever castrates (his slave), we will castrate him."
أَخْبَرَنَا مَحْمُودُ بْنُ غَيْلاَنَ، - هُوَ الْمَرْوَزِيُّ - قَالَ حَدَّثَنَا أَبُو دَاوُدَ الطَّيَالِسِيُّ، قَالَ حَدَّثَنَا هِشَامٌ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَهُ جَدَعْنَاهُ وَمَنْ أَخْصَاهُ أَخْصَيْنَاهُ ‏"‏ ‏.‏

Al-Hasan, on Samura’s authority, quoted God’s Messenger as saying, “If anyone kills his slave we will kill him, and if anyone maims his slave we will maim him.” Tirmidhi, Abu Dawud, Ibn Majah and Darimi transmitted it, and Nasa’i added in another version, “If anyone castrates his slave we will castrate him.”
وَعَن الْحسن عَن سَمُرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ قَتَلَ عَبْدَهُ قَتَلْنَاهُ وَمَنْ جَدَعَ عَبْدَهُ جَدَعْنَاهُ» . رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُدَ وَابْنُ مَاجَهْ وَالدَّارِمِيُّ وَزَادَ النَّسَائِيُّ فِي رِوَايَةٍ أُخْرَى: «وَمن خصى عَبده خصيناه»

Narrated Samurah:

The Prophet (saws) Said: If anyone kills his slave, we shall kill him, and if anyone cuts off the nose of his slave, we shall cut off his nose.

Samurah (RAA) narrated that The Messenger of Allah (P.B.U.H.) said, “Whoever kills his slave we shall kill him, and whoever cuts the nose of his slave we shall cut off his nose.” Related by Ahmad and the four lmams. At-Tirmidhi graded it as Hasan. Abu Dawud and An-Nasa’i added the following, “and whoever castrates his slave we shall castrate him.” Al-Hakim graded this addition as Sahih.

Narrated Sa`id bin Jubair:

`AbdurRahman bin Abza said, "Ask Ibn `Abbas about these two Qur'anic Verses: 'Nor kill such life as Allah has made sacred, Except for just cause.' (25.168) "And whoever kills a believer intentionally, his recompense is Hell. (4.93) So I asked Ibn `Abbas who said, "When the Verse that is in Sura-al-Furqan was revealed, the pagans of Mecca said, 'But we have slain such life as Allah has made sacred, and we have invoked other gods along with Allah, and we have also committed fornication.' So Allah revealed:-- 'Except those who repent, believe, and do good-- (25.70) So this Verse was concerned with those people. As for the Verse in Surat-an-Nisa (4-93), it means that if a man, after understanding Islam and its laws and obligations, murders somebody, then his punishment is to dwell in the (Hell) Fire forever." Then I mentioned this to Mujahid who said, "Except the one who regrets (one's crime) . "

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا جَرِيرٌ، عَنْ مَنْصُورٍ، حَدَّثَنِي سَعِيدُ بْنُ جُبَيْرٍ، أَوْ قَالَ حَدَّثَنِي الْحَكَمُ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، قَالَ أَمَرَنِي عَبْدُ الرَّحْمَنِ بْنُ أَبْزَى قَالَ سَلِ ابْنَ عَبَّاسٍ عَنْ هَاتَيْنِ الآيَتَيْنِ، مَا أَمْرُهُمَا ‏‏{‏وَلاَ تَقْتُلُوا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ ‏}‏ ‏‏{‏وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا‏}‏ فَسَأَلْتُ ابْنَ عَبَّاسٍ فَقَالَ لَمَّا أُنْزِلَتِ الَّتِي فِي الْفُرْقَانِ قَالَ مُشْرِكُو أَهْلِ مَكَّةَ فَقَدْ قَتَلْنَا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ، وَدَعَوْنَا مَعَ اللَّهِ إِلَهًا آخَرَ، وَقَدْ أَتَيْنَا الْفَوَاحِشَ‏.‏ فَأَنْزَلَ اللَّهُ ‏‏{‏إِلاَّ مَنْ تَابَ وَآمَنَ‏}‏ الآيَةَ فَهَذِهِ لأُولَئِكَ وَأَمَّا الَّتِي فِي النِّسَاءِ الرَّجُلُ إِذَا عَرَفَ الإِسْلاَمَ وَشَرَائِعَهُ، ثُمَّ قَتَلَ فَجَزَاؤُهُ جَهَنَّمُ‏.‏ فَذَكَرْتُهُ لِمُجَاهِدٍ فَقَالَ إِلاَّ مَنْ نَدِمَ‏.‏

Sa'id bin Jubair said:
I asked Ibn 'Abbas (about the verse relating to intentional homicide in Surat An-Nisa') He said: When the verse "Those who invoke not with Allah any other god, nor slay such life as Allah had made sacred, except for just cause" was revealed, the polytheists of Mecca said: We have killed the soul prohibited by Allah, invoked another god along with Allah for worship, and committed shameful deeds. So Allah revealed the verse "unless he repents, believes, and works righteous deeds, for Allah will change the evil of such persons into good." This is meant for them. As regards the verse "if a man kills a believer intentionally, his recompense is Hell" He said: If a man knows the command of Islam and intentionally kills a believer, his repentance wil not be accepted. I then mentioned it to Mujahid. He said: "Except the one who is ashamed (of his sin)."

It was narrated from Ibn 'Abbas, who attributed it to the Prophet (SAW):
“Whoever kills out of folly or for tribal motives, using a rock, a whip, or a stick; he must pay the blood money for killing by mistake. Whoever kills deliberately, he is to be killed in retaliation. Whoever tries to prevent that, upon him is the curse of Allah, the angels and all the people, and no change nor equitable exchange will be accepted from him.”

"Whoever kills himself with (an instrument of)iron, he will come on the Day Of Judgment with his iron in his hand, to continually stab himself in his stomach with it, in the fire of Jahannam, dwelling in that state eternally. And whoever kills himself with poison, then his poison will be in his hand, to continually take it in the Fire of Jahannam, dwelling in that state eternally."
حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، قال حَدَّثَنَا عَبِيدَةُ بْنُ حُمَيْدٍ، عَنِ الأَعْمَشِ، عَنْ أَبِي صَالِحٍ، عَنْ أَبِي هُرَيْرَةَ، أُرَاهُ رَفَعَهُ قَالَ ‏ "‏ مَنْ قَتَلَ نَفْسَهُ بِحَدِيدَةٍ جَاءَ يَوْمَ الْقِيَامَةِ وَحَدِيدَتُهُ فِي يَدِهِ يَتَوَجَّأُ بِهَا فِي بَطْنِهِ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا أَبَدًا وَمَنْ قَتَلَ نَفْسَهُ بِسُمٍّ فَسُمُّهُ فِي يَدِهِ يَتَحَسَّاهُ فِي نَارِ جَهَنَّمَ خَالِدًا مُخَلَّدًا أَبَدًا ‏"‏ ‏.‏

Ibn 'Abbas said:

This verse was revealed in Mecca:" And they who call not upon another god with Allah and slay not the soul which Allah has forbidden except in the cause of justice" up to the word Muhdana (abased). Thereupon the polytheists said: Islam is of no avail to us for we have made peer with Allah and we killed the soul which Allah had forbidden to do and we committed debauchery, and it was (on this occasion) that Allah, the Exalted and Glorious, revealed this verse:" Except him who repents and believes and does good deeds" up to the end Ibn 'Abbis says: He who enters the fold of Islam and understands its command and then kills the soul there is no repentance for him.

The Prophet said, "When Khosrau perishes, there will be no more Khosrau a after him, and when Caesar perishes, there will be no more Caesar after him," The Prophet also said, "You will spend the treasures of both of them in Allah's Cause."

Abu Laila 'Abdullah b. 'Abd al-Rahman b. Sahl reported that the elderly persons of (the tribe) had informed Sahl b. Abu Hathma that 'Abdullah b. Sahl and Muhayyisa went out to Khaibar under some distress which had afflicted them. Muhayyisa came and informed that Abdutlah b. Sahl had been killed, and (his dead body) had been thrown in a well or in a ditch. He came to the Jews and said:

By Allah, it is you who have killed him. They said: By Allah, we have not killed him. He then came to his people, and made mention of that to them. Then came he and his brother Huwayyisa, and he was older than he, and 'Abd al-Rahman b. Sahl. Then Muhayyisa went to speak, and it was he who had accompanied ('Abdullah) to Khaibar, whereupon Allah's Messenger (may peace be upon him) said to Muhayyisa: Observe greatness of the great (he meant the seniority of age). Then Huwayyisa spoke and then Muhayyisa also spoke. Thereupon Allah's Messenger (may peace be upon him) said: They should either pay blood-wit for your companion, or be prepared for war. Allah's Messenger (may peace be upon him) wrote about it to them (to the Jews). They wrote: Verily, by Allah, we have not killed him. Thereupon Allah's Messenger (may peace be upon him) said to Huwayyisa and Muhayyisa and Abd al-Rahman: Are you prepared to take oath in order to entitle yourselves for the blood-wit of your companion? They said: No. He (the Holy Prophet) said: Then the Jews will take oath (of their innocence). They said: They are not Muslims. Allah's Messenger (may peace be upon him), however, himself paid the blood-wit to them and sent to them one hundred camels until they entered into their houses, Sahl said: One red she-camel among them kicked me.
حَدَّثَنِي إِسْحَاقُ بْنُ مَنْصُورٍ، أَخْبَرَنَا بِشْرُ بْنُ عُمَرَ، قَالَ سَمِعْتُ مَالِكَ بْنَ أَنَسٍ، يَقُولُ حَدَّثَنِي أَبُو لَيْلَى بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ سَهْلٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، أَنَّهُ أَخْبَرَهُ عَنْ رِجَالٍ، مِنْ كُبَرَاءِ قَوْمِهِ أَنَّ عَبْدَ، اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ خَرَجَا إِلَى خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمْ فَأَتَى مُحَيِّصَةُ فَأَخْبَرَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي عَيْنٍ أَوْ فَقِيرٍ فَأَتَى يَهُودَ فَقَالَ أَنْتُمْ وَاللَّهِ قَتَلْتُمُوهُ ‏.‏ قَالُوا وَاللَّهِ مَا قَتَلْنَاهُ ‏.‏ ثُمَّ أَقْبَلَ حَتَّى قَدِمَ عَلَى قَوْمِهِ فَذَكَرَ لَهُمْ ذَلِكَ ثُمَّ أَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَهُوَ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَكَلَّمَ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِمُحَيِّصَةَ ‏"‏ كَبِّرْ كَبِّرْ ‏"‏ ‏.‏ يُرِيدُ السِّنَّ فَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِمَّا أَنْ يَدُوا صَاحِبَكُمْ وَإِمَّا أَنْ يُؤْذِنُوا بِحَرْبٍ ‏"‏ ‏.‏ فَكَتَبَ رَسُولُ اللَّهِ صلى الله عليه وسلم إِلَيْهِمْ فِي ذَلِكَ فَكَتَبُوا إِنَّا وَاللَّهِ مَا قَتَلْنَاهُ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ ‏"‏ أَتَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ ‏"‏ ‏.‏ قَالُوا لاَ ‏.‏ قَالَ ‏"‏ فَتَحْلِفُ لَكُمْ يَهُودُ ‏"‏ ‏.‏ قَالُوا لَيْسُوا بِمُسْلِمِينَ ‏.‏ فَوَدَاهُ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ رَسُولُ اللَّهِ صلى الله عليه وسلم مِائَةَ نَاقَةٍ حَتَّى أُدْخِلَتْ عَلَيْهِمُ الدَّارَ ‏.‏ فَقَالَ سَهْلٌ فَلَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ ‏.‏

Ibn Abza said to me, "Ask Ibn `Abbas regarding the Statement of Allah: 'And whoever murders a believer intentionally, his recompense is Hell.' (4.69) And also His Statement: '...nor kill such life as Allah has forbidden, except for a just cause .....except those who repent, believe, and do good deeds.' " (25.68-70) So I asked Ibn `Abbas and he said, "When this (25.68-69) was revealed, the people of Mecca said, "We have invoked other gods with Allah, and we have murdered such lives which Allah has made sacred, and we have committed illegal sexual intercourse. So Allah revealed: 'Except those who repent, believe, and do good deeds and Allah is Oft-Forgiving, Most Merciful.' (25.70)

Narrated Sahl bin Abi Hathma:

(a man from the Ansar) that a number of people from his tribe went to Khaibar and dispersed, and then they found one of them murdered. They said to the people with whom the corpse had been found, "You have killed our companion!" Those people said, "Neither have we killed him, nor do we know his killer." The bereaved group went to the Prophet and said, "O Allah's Apostle! We went to Khaibar and found one of us murdered." The Prophet said, "Let the older among you come forward and speak." Then the Prophet said, to them, "Bring your proof against the killer." They said "We have no proof." The Prophet said, "Then they (the defendants) will take an oath." They said, "We do not accept the oaths of the Jews." Allah's Apostle did not like that the Blood-money of the killed one be lost without compensation, so he paid one-hundred camels out of the camels of Zakat (to the relatives of the deceased) as Diya (Blood-money).

حَدَّثَنَا أَبُو نُعَيْمٍ، حَدَّثَنَا سَعِيدُ بْنُ عُبَيْدٍ، عَنْ بُشَيْرِ بْنِ يَسَارٍ، زَعَمَ أَنَّ رَجُلاً، مِنَ الأَنْصَارِ يُقَالُ لَهُ سَهْلُ بْنُ أَبِي حَثْمَةَ أَخْبَرَهُ أَنَّ نَفَرًا مِنْ قَوْمِهِ انْطَلَقُوا إِلَى خَيْبَرَ فَتَفَرَّقُوا فِيهَا، وَوَجَدُوا أَحَدَهُمْ قَتِيلاً، وَقَالُوا لِلَّذِي وُجِدَ فِيهِمْ قَتَلْتُمْ صَاحِبَنَا‏.‏ قَالُوا مَا قَتَلْنَا وَلاَ عَلِمْنَا قَاتِلاً‏.‏ فَانْطَلَقُوا إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَالُوا يَا رَسُولَ اللَّهِ انْطَلَقْنَا إِلَى خَيْبَرَ فَوَجَدْنَا أَحَدَنَا قَتِيلاً‏.‏ فَقَالَ ‏"‏ الْكُبْرَ الْكُبْرَ ‏"‏‏.‏ فَقَالَ لَهُمْ ‏"‏ تَأْتُونَ بِالْبَيِّنَةِ عَلَى مَنْ قَتَلَهُ ‏"‏‏.‏ قَالُوا مَا لَنَا بَيِّنَةٌ‏.‏ قَالَ ‏"‏ فَيَحْلِفُونَ ‏"‏‏.‏ قَالُوا لاَ نَرْضَى بِأَيْمَانِ الْيَهُودِ‏.‏ فَكَرِهَ رَسُولُ اللَّهِ صلى الله عليه وسلم أَنْ يُبْطِلَ دَمَهُ، فَوَدَاهُ مِائَةً مِنْ إِبِلِ الصَّدَقَةِ‏.‏

Sunan an-Nasa'i 4711
It was narrated from Abu Laila bin 'Abdullah bin 'Abdur-Rahman bin Sahl, from Sahl bin Abi Hathmah, that:
he informed him, ans some men among the elders of his people, that "Abdullah bin Sahl and Muhayysah set out for Khaibar because of some problem that had arisen. Someone came to Muhayysah, and he told him that 'Abdullah bin Sahl had been killed and thrown into a pit or well. He came to the Jews and said: "By Allah, you killed him." They said: "By Allah, we did not kill him." Then he went baack to his people and told them about that. Then he and his brother Huwayysah, who was older than him, and 'Abdur-Rahman bin Sahl, came (to the prophet). Muhayysah, who was the one who had been at Khaibar, bnegan to speak, but the Messenger of Allah said: "Let the elder speak first." So Huwayysah spoke, then Muhayysah spoke. The Messenger of Allah said: "Either (the Jews) will pay the Diyah for your companion, or war will be declared on them." The Messenger of Allah sent a letter to that effect (to the Jews) and they wrote back saying: "By Allah, we did not kill him." The Messenger of Allah and 'Abdur-Rahman: "Will you swear an oath establishing your claim to the blood money of your companion?" They said: "No." He said: "Should the Jews swear an oath for you?" They said: "They are not Muslims." So the Messenger of Allah paid it himself, and he sent one hundred she-camels to their abodes. Sahl said: "A red she-camel from among them kicked me."
أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، قَالَ أَنْبَأَنَا ابْنُ الْقَاسِمِ، قَالَ حَدَّثَنِي مَالِكٌ، عَنْ أَبِي لَيْلَى بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ سَهْلٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، أَنَّهُ أَخْبَرَهُ وَرِجَالٌ، مِنْ كُبَرَاءِ قَوْمِهِ أَنَّ عَبْدَ، اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ خَرَجَا إِلَى خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمْ فَأُتِيَ مُحَيِّصَةُ فَأُخْبِرَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي فَقِيرٍ أَوْ عَيْنٍ فَأَتَى يَهُودَ وَقَالَ أَنْتُمْ وَاللَّهِ قَتَلْتُمُوهُ قَالُوا وَاللَّهِ مَا قَتَلْنَاهُ ‏.‏ فَأَقْبَلَ حَتَّى قَدِمَ عَلَى قَوْمِهِ فَذَكَرَ لَهُمْ ثُمَّ أَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَهُوَ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَكَلَّمَ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِمُحَيِّصَةَ ‏"‏ كَبِّرْ كَبِّرْ ‏"‏ ‏.‏ يُرِيدُ السِّنَّ فَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِمَّا أَنْ يَدُوا صَاحِبَكُمْ وَإِمَّا أَنْ يُؤْذَنُوا بِحَرْبٍ ‏"‏ ‏.‏ فَكَتَبَ إِلَيْهِمْ رَسُولُ اللَّهِ صلى الله عليه وسلم فِي ذَلِكَ فَكَتَبُوا إِنَّا وَاللَّهِ مَا قَتَلْنَاهُ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ ‏ "‏ أَتَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ ‏"‏ ‏.‏ قَالُوا لاَ ‏.‏ قَالَ ‏"‏ فَتَحْلِفُ لَكُمْ يَهُودُ ‏"‏ ‏.‏ قَالُوا لَيْسُوا بِمُسْلِمِينَ ‏.‏ فَوَدَاهُ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّى أُدْخِلَتْ عَلَيْهِمُ الدَّارَ ‏.‏ قَالَ سَهْلٌ لَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ ‏.‏

Sunan Abi Dawud 4521
Sahl b. Abi Hathmah and some senior men of the tribe told that 'Abd Allah b. Abi Sahl and Muhayyasah came to Khaibar on account of the calamity (i.e. famine) that befall them. Muhayyasah came and told the 'Abd Allah b. Sahl had been killed and thrown in a well or stream. He hen came to the Jews and said:
I swear by Allah, you have killed him. They said: We swear by Allah, we have not killed him. He then proceeded and came to his tribe and mentioned this to them. Then he, his brother Huwayyasah, who was older to him, and 'Abd al-Rahman b. Sahl came forward (to the Prophet). Muhayyasah began to speak. It was he who was at Khaibar. The Messenger of Allah (saws) then said to him: Let the eldest (speak), let the eldest (speak), meaning age. So Huwayyasah spoke, and after him Muhayyasah spoke. The Messenger of Allah (saws) then said: They should either pay the bloodwit for you friend or they should be prepared for war. So the Messenger of Allah (saws) wrote to them about it. They wrote (in reply): We swear by Allah, we have not killed him. The Messenger of Allah (saws) then said to Huwayyasah, Muhayyasah and 'Abd al-Rahman: Will you take an oath and thus have the claim to the blood of your friend ? They said: No. He (the Prophet) said: The Jews will then take an oath. They said: They are not Muslims. Then the Messenger of Allah (saws) himself paid the bloodwit. The Messenger of Allah (saws) then sent on one hundred she-camels and they were entered in their house. Sahl said: A red she-camel of them gave me a kick.

It was narrated that Samurah said:
"The Messenger of Allah (SAW) said: 'Whoever performs wudu' on Friday, that is all well and good, but whoever performs Ghusl, the Ghusl is better.'"
أَخْبَرَنَا أَبُو الأَشْعَثِ، عَنْ يَزِيدَ بْنِ زُرَيْعٍ، قَالَ حَدَّثَنَا شُعْبَةُ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ مَنْ تَوَضَّأَ يَوْمَ الْجُمُعَةِ فَبِهَا وَنِعْمَتْ وَمَنِ اغْتَسَلَ فَالْغُسْلُ أَفْضَلُ ‏" ‏ ‏.‏ قَالَ أَبُو عَبْدِ الرَّحْمَنِ الْحَسَنُ عَنْ سَمُرَةَ كِتَابًا وَلَمْ يَسْمَعِ الْحَسَنُ مِنْ سَمُرَةَ إِلاَّ حَدِيثَ الْعَقِيقَةِ وَاللَّهُ تَعَالَى أَعْلَمُ ‏.‏

It was narrated that Sa'eed bin Zaid said:
"The Messenger of Allah [SAW] said: 'Whoever is killed protecting his wealth, he is a martyr. Whoever is killed protecting his family, he is a martyr. Whoever is killed protecting his religion, he is a martyr. Whoever is killed protecting himself, he is a martyr.'"

أَخْبَرَنَا أَبُو زَكَرِيَّا يَحْيَى بْنُ مُحَمَّدٍ الْعَنْبَرِيُّ ، ثنا مُحَمَّدُ بْنُ عَبْدِ السَّلامِ ، ثنا إِسْحَاقُ بْنُ إِبْرَاهِيمَ ، أَنْبَأَ جَرِيرٌ ، عَنْ مَنْصُورِ بْنِ الْمُعْتَمِرِ ، حَدَّثَنِي سَعِيدُ بْنُ جُبَيْرٍ ، قَالَ : أَمَرَنِي عَبْدُ الرَّحْمَنِ بْنُ أَبْزَى أَنْ أَسْأَلَ ابْنَ عَبَّاسٍ عَنْ هَاتَيْنِ الآيَتَيْنِ مَا أَمْرُهُمَا الَّتِي فِي سُورَةِ الْفُرْقَانِ : ‏ وَالَّذِينَ لا يَدْعُونَ مَعَ اللَّهِ إِلَهًا آخَرَ وَلا يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلا بِالْحَقِّ سورة الفرقان آية 68 ، وَالَّتِي فِي سُورَةِ النِّسَاءِ ‏ وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمُ سورة النساء آية 93 ، قَالَ : فَسَأَلْتُ ابْنَ عَبَّاسٍ عَنْ ذَلِكَ ، قَالَ : " لَمَّا أَنْزَلَ الَّتِي فِي سُورَةِ الْفُرْقَانِ , قَالَ مُشْرِكُوا أَهْلِ مَكَّةَ قَدْ قَتَلْنَا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ بِغَيْرِ الْحَقِّ وَدَعَوْنَا مَعَ اللَّهِ إِلَهًا آخَرَ وَأَتَيْنَا الْفَوَاحِشَ ، قَالَ : فَنَزَلَتْ ‏ إِلا مَنْ تَابَ وَآمَنَ وَعَمِلَ عَمَلا صَالِحًا سورة الفرقان آية 70 " ، قَالَ : فَهَؤُلاءِ لأُولَئِكَ ، قَالَ : وَأَمَّا الَّتِي فِي سُورَةِ النِّسَاءِ ‏ وَمَنْ يَقْتُلْ مُؤْمِنًا مُتَعَمِّدًا سورة النساء آية 93 , " فَهُوَ الرَّجُلُ الَّذِي قَدْ عَرَفَ الإِسْلامَ وَعَمِلَ عَمَلَ الإِسْلامِ ، ثُمَّ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا فَجَزَاؤُهُ جَهَنَّمَ لا تَوْبَةَ لَهُ " ، قَالَ : فَذَكَرْتُ ذَلِكَ لِمُجَاهِدٍ ، فَقَالَ : " إِلا مَنْ نَدِمَ " , صَحِيحٌ عَلَى شَرْطِ الشَّيْخَيْنِ وَلَمْ يُخْرِجَاهُ

Abu Huraira reported Allah's Messenger (may peace be upon him) as saying:

He who killed a gecko with the first stroke for him is such and such a reward, and he who killed it with a second stroke for him is such and such reward less than the first one, and he who killed it with the third stroke for him is such and such a reward less than the second one.
وَحَدَّثَنَا يَحْيَى بْنُ يَحْيَى، أَخْبَرَنَا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ سُهَيْلٍ، عَنْ أَبِيهِ، عَنْ أَبِي، هُرَيْرَةَ قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ مَنْ قَتَلَ وَزَغَةً فِي أَوَّلِ ضَرْبَةٍ فَلَهُ كَذَا وَكَذَا حَسَنَةً وَمَنْ قَتَلَهَا فِي الضَّرْبَةِ الثَّانِيَةِ فَلَهُ كَذَا وَكَذَا حَسَنَةً لِدُونِ الأُولَى وَإِنْ قَتَلَهَا فِي الضَّرْبَةِ الثَّالِثَةِ فَلَهُ كَذَا وَكَذَا حَسَنَةً لِدُونِ الثَّانِيَةِ ‏" ‏ ‏.‏

Yahya related to me from Malik from Abu Layla ibn Abdullah ibn Abd ar-Rahman ibn Sahl from Sahl ibn Abi Hathma that some of the great men of his people informed him that Abdullah ibn Sahl and Muhayyisa went out to Khaybar because extreme poverty had overtaken them. Muhayyisa returned and said that Abdullah ibn Sahl had been killed and thrown in a shallow well or spring. The jews came and he said, "By Allah! You have killed him." They said, "By Allah! We have not killed him!" Then he made for his people and mentioned that to them. Then he, his brother Huwayyisa, who was older than him, and Abd ar-Rahman, set out. Muhayyisa began to speak, as he had been at Khaybar. The Messenger of Allah, may Allah bless him and grant him peace, said to him, "The greater first, the greater first," meaning in age. So Huwayyisa spoke and then Muhayyisa spoke. The Messenger of Allah, may Allah bless him and grant him peace, said, "Either they pay your companion's blood-money or we will declare war against them." The Messenger of Allah, may Allah bless him and grant him peace, wrote that to them and they wrote, "By Allah, we did not kill him!" The Messenger of Allah, may Allah bless him and grant him peace, said to Huwayyisa, Muhayyisa, and Abd ar-Rahman, "Do you swear and claim the blood of your companion?" They said, "No." He said, "Shall the jews swear to you?" They said, "But they are not muslims." The Messenger of Allah, may Allah bless him and grant him peace, gave blood-money from his own property, and sent them one hundred camels to their house.

Sahl added, "A red camel among them kicked me."

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ أَبِي لَيْلَى بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ سَهْلٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، أَنَّهُ أَخْبَرَهُ رِجَالٌ، مِنْ كُبَرَاءِ قَوْمِهِ أَنَّ عَبْدَ، اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ خَرَجَا إِلَى خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمْ فَأُتِيَ مُحَيِّصَةُ فَأُخْبِرَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي فَقِيرِ بِئْرٍ أَوْ عَيْنٍ فَأَتَى يَهُودَ فَقَالَ أَنْتُمْ وَاللَّهِ قَتَلْتُمُوهُ ‏.‏ فَقَالُوا وَاللَّهِ مَا قَتَلْنَاهُ ‏.‏ فَأَقْبَلَ حَتَّى قَدِمَ عَلَى قَوْمِهِ فَذَكَرَ لَهُمْ ذَلِكَ ثُمَّ أَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَهُوَ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ فَذَهَبَ مُحَيِّصَةُ لِيَتَكَلَّمَ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ فَقَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ كَبِّرْ كَبِّرْ ‏"‏ يُرِيدُ السِّنَّ فَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِمَّا أَنْ يَدُوا صَاحِبَكُمْ وَإِمَّا أَنْ يُؤْذِنُوا بِحَرْبٍ ‏"‏ ‏.‏ فَكَتَبَ إِلَيْهِمْ رَسُولُ اللَّهِ صلى الله عليه وسلم فِي ذَلِكَ فَكَتَبُوا إِنَّا وَاللَّهِ مَا قَتَلْنَاهُ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ ‏"‏ أَتَحْلِفُونَ وَتَسْتَحِقُّونَ دَمَ صَاحِبِكُمْ ‏"‏ ‏.‏ فَقَالُوا لاَ ‏.‏ قَالَ ‏"‏ أَفَتَحْلِفُ لَكُمْ يَهُودُ ‏"‏ قَالُوا لَيْسُوا بِمُسْلِمِينَ ‏.‏ فَوَدَاهُ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْ عِنْدِهِ فَبَعَثَ إِلَيْهِمْ بِمِائَةِ نَاقَةٍ حَتَّى أُدْخِلَتْ عَلَيْهِمُ الدَّارَ ‏.‏ قَالَ سَهْلٌ لَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ ‏.‏

Narrated Abdullah ibn Abbas:

The Jews came to the Prophet (saws) and said: We eat which we kill but we do not eat which Allah kills? So Allah revealed: "Eat not of (meats) on which Allah's name hath not been pronounced." to the end of the verse.

حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عِمْرَانُ بْنُ عُيَيْنَةَ، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ جَاءَتِ الْيَهُودُ إِلَى النَّبِيِّ صلى الله عليه وسلم فَقَالُوا نَأْكُلُ مِمَّا قَتَلْنَا وَلاَ نَأْكُلُ مِمَّا قَتَلَ اللَّهُ فَأَنْزَلَ اللَّهُ ‏‏{‏ وَلاَ تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْهِ ‏}‏ إِلَى آخِرِ الآيَةِ ‏.‏
  صحيح لكن ذكر اليهود فيه منكر والمحفوظ أنهم المشركون   (الألباني) حكم   :

Narrated Abu Laila bin `Abdullah bin `Abdur-Rahman bin Sahl:

Sahl bin Abi Hathma and some great men of his tribe said, `Abdullah bin 'Sahl and Muhaiyisa went out to Khaibar as they were struck with poverty and difficult living conditions. Then Muhaiyisa was informed that `Abdullah had been killed and thrown in a pit or a spring. Muhaiyisa went to the Jews and said, "By Allah, you have killed my companion." The Jews said, "By Allah, we have not killed him." Muhaiyisa then came back to his people and told them the story. He, his elder brother Huwaiyisa and `Abdur-Rahman bin Sahl came (to the Prophet) and he who had been at Khaibar, proceeded to speak, but the Prophet said to Muhaiyisa, "The eldest! The eldest!" meaning, "Let the eldest of you speak." So Huwaiyisa spoke first and then Muhaiyisa. Allah's Apostle said, "The Jews should either pay the blood money of your (deceased) companion or be ready for war." After that Allah's Apostle wrote a letter to the Jews in that respect, and they wrote that they had not killed him. Then Allah's Apostle said to Huwaiyisa, Muhaiyisa and `Abdur-Rahman, "Can you take an oath by which you will be entitled to take the blood money?" They said, "No." He said (to them), "Shall we ask the Jews to take an oath before you?" They replied, "But the Jews are not Muslims." So Allah's Apostle gave them one-hundred she-camels as blood money from himself. Sahl added: When those she-camels were made to enter the house, one of them kicked me with its leg.

Sahl bin Abi Khaithamah (RAA) narrated on the authority of some honored men from his people that 'Abdullah bin Sahl and Muhaiysah bin Mas'ud, went out to Khaibar because of a hardship they were undergoing. Muhaiysah came and told them that 'Abdullah bin Sahl had been killed and thrown into a well. He came to the Jews and said to them, ‘I swear by Allah that you have killed him.’ They replied, ‘We swear by Allah that we have not killed him.' Then Muhaiysah came along with his brother Huwaiysah and 'Abdur Rahman bin Sahl to the Prophet (P.B.U.H.) and Muhaiysah started to talk. The Messenger of Allah (P.B.U.H.) said to him, “Let an older one speak (take charge of this matter).” So Huwaiysah narrated what happened and then Muhaiysah spoke. The Messenger of Allah (P.B.U.H.) said, “Either they pay the Diyah of your companion or be ready for war.” The Messenger of Allah (P.B.U.H.) wrote to them about this and they wrote back saying, ‘By Allah, we have not killed him.’ The Messenger of Allah (P.B.U.H.) then said to Huwaiysah, Muhaiysah and 'Abdur Rahman bin Sahl, “Would you take an oath (that they killed him) and then you will be entitled to the Diyah of your companion” 'They answered, ‘No (as they did not witness the crime).’The Messenger of Allah then said, “Then the Jews should take an oath (that they are innocent).” They said, ‘They are not Muslims.’ The Messenger of Allah (P.B.U.H.) thereupon paid the Diyah of the victim himself and sent them 100 camels. Sahl commented, ‘A red she-camel (of these 100 camels) kicked me.’ Agreed upon.
عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ, عَنْ رِجَالٍ مِنْ كُبَرَاءِ قَوْمِهِ, أَنَّ عَبْدَ اَللَّهِ بْنَ سَهْلٍ ومُحَيِّصَةَ بْنَ مَسْعُودٍ خَرَجَا إِلَى خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمْ, فَأُتِيَ مَحَيِّصَةُ فَأُخْبِرَ أَنَّ عَبْدَ اَللَّهِ بْنِ سَهْلِ قَدْ قُتِلَ, وَطُرِحَ فِي عَيْنٍ, فَأَتَى يَهُودَ, فَقَالَ: أَنْتُمْ وَاَللَّهِ قَتَلْتُمُوهُ.‏ قَالُوا: وَاَللَّهِ مَا قَتَلْنَاهُ, فَأَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَعَبْدُ اَلرَّحْمَنِ بْنُ سَهْلٍ, فَذَهَبَ مُحَيِّصَةُ لَيَتَكَلَّمَ, فَقَالَ رَسُولُ اَللَّهِ ‏- صلى الله عليه وسلم ‏-{ "كَبِّرْ كَبِّرْ" يُرِيدُ: اَلسِّنَّ, فَتَكَلَّمَ حُوَيِّصَةُ, ثُمَّ تَكَلَّمَ مُحَيِّصَةُ, فَقَالَ رَسُولُ اَللَّهِ ‏- صلى الله عليه وسلم ‏-"إِمَّا أَنْ يَدُوا صَاحِبَكُمْ, وَإِمَّا أَنْ يَأْذَنُوا بِحَرْبٍ".‏ فَكَتَبَ إِلَيْهِمْ فِي ذَلِكَ [كِتَابًا].‏ فَكَتَبُوا: إِنَّا وَاَللَّهِ مَا قَتَلْنَاهُ, فَقَالَ لِحُوَيِّصَةَ, وَمُحَيِّصَةُ, وَعَبْدِ اَلرَّحْمَنِ بْنَ سَهْلٍ: "أَتَحْلِفُونَ, وَتَسْتَحِقُّونَ دَمَ صَاحِبَكُمْ?" قَالُوا: لَا.‏ قَالَ: "فَتَحْلِفُ لَكُمْ يَهُودُ?" قَالُوا: لَيْسُوا مُسْلِمِينَ فَوَدَاهُ رَسُولَ اَللَّهِ ‏- صلى الله عليه وسلم ‏-مِنْ عِنْدِهِ, فَبَعَثَ إِلَيْهِمْ مَائَةَ نَاقَةٍ.‏ قَالَ سَهْلٌ: فَلَقَدْ رَكَضَتْنِي مِنْهَا نَاقَةٌ حَمْرَاءُ } مُتَّفَقٌ عَلَيْهِ.‏ 1‏ .‏

It has been narrated on the authority of Abu Huraira (through another chain of transmitters) that the Messenger of Allah (may peace be upon him) said:

Whom do you consider to be a martyr among you? They (the Companions) said: Messenger, of Allah, one who is slain in the way of Allah is a martyr. He said: Then (if this is the definition of a martyr) the martyrs of my Umma will be small in number. They asked: Messenger of Allah, who are they? He said: One who is slain in the way of Allah is a martyr; one who dies in the way of Allah, is a martyr; one who dies of plague is a martyr; one who dies of cholera is a martyr. Ibn Miqsam said: I testify the truth of your father's statement (with regard to this tradition) that the Holy Prophet (may peace be upon him) said: One who is drowned is a martyr.
وَحَدَّثَنِي زُهَيْرُ بْنُ حَرْبٍ، حَدَّثَنَا جَرِيرٌ، عَنْ سُهَيْلٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ مَا تَعُدُّونَ الشَّهِيدَ فِيكُمْ ‏"‏ ‏.‏ قَالُوا يَا رَسُولَ اللَّهِ مَنْ قُتِلَ فِي سَبِيلِ اللَّهِ فَهُوَ شَهِيدٌ قَالَ ‏"‏ إِنَّ شُهَدَاءَ أُمَّتِي إِذًا لَقَلِيلٌ ‏"‏ ‏.‏ قَالُوا فَمَنْ هُمْ يَا رَسُولَ اللَّهِ قَالَ ‏"‏ مَنْ قُتِلَ فِي سَبِيلِ اللَّهِ فَهُوَ شَهِيدٌ وَمَنْ مَاتَ فِي سَبِيلِ اللَّهِ فَهُوَ شَهِيدٌ وَمَنْ مَاتَ فِي الطَّاعُونِ فَهُوَ شَهِيدٌ وَمَنْ مَاتَ فِي الْبَطْنِ فَهُوَ شَهِيدٌ ‏" ‏ ‏.‏ قَالَ ابْنُ مِقْسَمٍ أَشْهَدُ عَلَى أَبِيكَ فِي هَذَا الْحَدِيثِ أَنَّهُ قَالَ ‏"‏ وَالْغَرِيقُ شَهِيدٌ ‏"‏ ‏.‏

This Hadith is Hasan Sahih. Abu Muhammad is Nafi' the freed slave of Abu Qatadah.

This is acted upon according to some of the people of knowledge among the Companions of the Prophet (saw) and others. It is the view of Al-Awza'i, Ash-Shafi'i and Ahmad.

Some of the people of knowledge said that the Imam takes Khumus from those goods. Ath-Thawri said:

"The Nafl is when the Imam says: 'Whoever got something, then it is his. And whoever killed a fighter, then his goods are his.' So it is allowed, and there is no Khumus taken from it." Ishaq said: "The goods are for the one who did the killing, unless it is something that is a large amount." So he saw that the Imam could take the Khumus from that, just as 'Umar bin Al-Khattab did.

Narrated `Abdullah:

The Prophet said, "Near the establishment of the Hour, there will be the days of Al-Harj, and the religious knowledge will be taken away (vanish i.e. by the death of Religious scholars) and general ignorance will spread." Abu Musa said, "Al-Harj, in the Ethiopian language, means killing."

Sunan Abi Dawud 4523
Narrated Bashir b. Yasar:
That a man of the Ansar called Sahl b. Abi Hathmah told him that some people of his tribe went to Khaibar and separated there. They found one of them slain. They said to those with whom they had found him: You have killed our friend. They replied: We did not kill him, nor do we know the slayer. We (the people of the slain) then went to the Prophet of Allah (saws). He said to them: Bring proof against the one who has slain him. They replied: We have no proof. He said: Then they will take an oath for you. They said: We do not accept the oaths of the Jews. The Messenger of Allah (saws) did not like no responsibility should be fixed for his blood. So he himself paid his bloodwit consisting of one hundred camels of sadaqah (i.e. camels sent to the Prophet as zakat).

that he heard the Messenger of Allah (saws) saying: "Whoever is killed over his wealth then he is a martyr, and whoever is killed over his religion, then he is a martyr, and whoever is killed over his blood, then he is martyr, and whoever is killed over his family, then he is martyr."
