" أَوْتِرُوا قَبْلَ أَنْ تُصْبِحُوا " .
قَالَ مُحَمَّدُ بْنُ يَحْيَى فِي هَذَا الْحَدِيثَ دَلِيلٌ عَلَى أَنَّ حَدِيثَ عَبْدِ الرَّحْمَنِ وَاهٍ .

حَدَّثَنَا ابْنُ أَبِي عُمَرَ، قَالَ حَدَّثَنَا بِشْرُ بْنُ السَّرِيِّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ أَبِي الزُّبَيْرِ، عَنْ جَابِرٍ، قَالَ اسْتَغْفَرَ لِي رَسُولُ اللَّهِ صلى الله عليه وسلم لَيْلَةَ الْبَعِيرِ خَمْسًا وَعِشْرِينَ مَرَّةً . هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ . وَمَعْنَى قَوْلِهِ لَيْلَةَ الْبَعِيرِ مَا رُوِيَ عَنْ جَابِرٍ مِنْ غَيْرِ وَجْهٍ أَنَّهُ كَانَ مَعَ النَّبِيِّ صلى الله عليه وسلم فِي سَفَرٍ فَبَاعَ بَعِيرَهُ مِنَ النَّبِيِّ صلى الله عليه وسلم وَاشْتَرَطَ ظَهْرَهُ إِلَى الْمَدِينَةِ يَقُولُ جَابِرٌ لَيْلَةَ بِعْتُ مِنَ النَّبِيِّ صلى الله عليه وسلم الْبَعِيرَ اسْتَغْفَرَ لِي خَمْسًا وَعِشْرِينَ مَرَّةً وَكَانَ جَابِرٌ قَدْ قُتِلَ أَبُوهُ عَبْدُ اللَّهِ بْنُ عَمْرِو بْنِ حَرَامٍ يَوْمَ أُحُدٍ وَتَرَكَ بَنَاتٍ فَكَانَ جَابِرٌ يَعُولُهُنَّ وَيُنْفِقُ عَلَيْهِنَّ وَكَانَ النَّبِيُّ صلى الله عليه وسلم يَبَرُّ جَابِرًا وَيَرْحَمُهُ لِسَبَبِ ذَلِكَ هَكَذَا رُوِيَ فِي حَدِيثٍ عَنْ جَابِرٍ نَحْوُ هَذَا .

It was narrated from Abu Musa Al-Ash'ari that:
The Messenger of Allah [SAW] said: "Every intoxicant is unlawful."

(Another Chain) from Samurah that the Prophet (saws) said:
"Whoever owns a related Mahram, then he is free."
حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ الْعَمِّيُّ الْبَصْرِيُّ، وَغَيْرُ، وَاحِدٍ، قَالُوا حَدَّثَنَا مُحَمَّدُ بْنُ بَكْرٍ الْبُرْسَانِيُّ، عَنْ حَمَّادِ بْنِ سَلَمَةَ، عَنْ قَتَادَةَ، وَعَاصِمٍ الأَحْوَلِ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ " . قَالَ أَبُو عِيسَى وَلاَ نَعْلَمُ أَحَدًا ذَكَرَ فِي هَذَا الْحَدِيثِ عَاصِمًا الأَحْوَلَ عَنْ حَمَّادِ بْنِ سَلَمَةَ غَيْرَ مُحَمَّدِ بْنِ بَكْرٍ . وَالْعَمَلُ عَلَى هَذَا الْحَدِيثِ عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ . - وَقَدْ رُوِيَ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " مَنْ مَلَكَ ذَا رَحِمٍ مَحْرَمٍ فَهُوَ حُرٌّ " . رَوَاهُ ضَمْرَةُ بْنُ رَبِيعَةَ عَنِ الثَّوْرِيِّ عَنْ عَبْدِ اللَّهِ بْنِ دِينَارٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صلى الله عليه وسلم . وَلَمْ يُتَابَعْ ضَمْرَةُ عَلَى هَذَا الْحَدِيثِ وَهُوَ حَدِيثٌ خَطَأٌ عِنْدَ أَهْلِ الْحَدِيثِ .

Hisn al-Muslim 77
Aṣbaḥnā wa aṣbaḥal-mulku lillāh, walḥamdu lillāh,
lā ilāha illallāhu waḥdahu lā sharīka lah,
lahul-mulku wa lahul-ḥamd, wa huwa `alā kulli shay'in Qadīr.
Rabbi as'aluka khayra mā fī hādha ‘l-yawmi wa khayra mā ba`dahu
wa a`ūdhu bika min sharri mā fī hātha ‘l-yawmi wa sharri mā ba`dahu,
Rabbi a`ūdhu bika minal-kasali, wa sū'il-kibar,
Rabbi a`ūdhu bika min `adhābin fin-nāri wa `adhābin fil-qabr.
We have entered a new day 1 and with it all dominion is Allah's. Praise is to Allah.
None has the right to be worshipped but Allah alone, Who has no partner.
To Allah belongs the dominion, and to Him is the praise and He is Able to do all things.
My Lord, I ask You for the goodness of this day and of the days that come after it,
and I seek refuge in You from the evil of this day and of the days that come after it.2
My Lord, I seek refuge in You from laziness and helpless old age.
My Lord, I seek refuge in You from the punishment of Hell-fire, and from the punishment of the grave.3

1 When you say this in the evening you should say Amsaynā wa amsal-mulku lillāh: "We have ended another day and with it, all dominion is Allah's.
2 When you say this in the evening you should say: Rabbi as'aluka khayra mā fī hāthihil-laylati, wa khayra mā ba`dahā, wa a`ūthu bika min sharri mā fī hāthihil-laylati wa sharri mā ba`dahā: "I ask You for the good things of this night and of the nights that come after it and I seek refuge in You from the evil of this night and of the nights that come after it."

Yahya related to me from Malik from Hisham ibn Urwa from Fatima bint al Mundhir that Asma bint Abi Bakr as-Siddiq said, "I went to A'isha, the wife of the Prophet, may Allah bless him and grant him peace, during an eclipse of the sun, and everybody was standing in prayer, and she too was standing praying. I said, 'What is everybody doing?' She pointed towards the sky with her hand and said, 'Glory be to Allah.' I said, 'A sign?' She nodded 'Yes' with her head."
She continued, "I stood until I had almost fainted, and I began to pour water over my head. The Messenger of Allah, may Allah bless him and grant him peace, praised Allah and spoke well of Him, and then said, 'There is nothing which I had previously not seen beforehand that I have not now seen while standing - even the Garden and the Fire. It has been revealed to me that you will be tried in your graves with a trial, like, or near to, the trial of the Dajjal (I do not know which one Asma said). Every one of you will have someone who comes to him and asks him, 'What do you know about this man?' A mumin, or one who has certainty (muqin) (I do not know which one Asma said), will say, 'He is Muhammad, the Messenger of Allah, may Allah bless him and grant him peace, who came to us with clear proofs and guidance, and we answered and believed and followed.' He will then be told, 'Sleep in a good state. We know now that you were a mumin.' A hypocrite, however, or one who has doubts (l do not know which one Asma said), will say, 'I do not know, I heard everybody saying something and I said it.' "
حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ فَاطِمَةَ بِنْتِ الْمُنْذِرِ، عَنْ أَسْمَاءَ بِنْتِ أَبِي بَكْرٍ الصِّدِّيقِ، أَنَّهَا قَالَتْ أَتَيْتُ عَائِشَةَ زَوْجَ النَّبِيِّ صلى الله عليه وسلم حِينَ خَسَفَتِ الشَّمْسُ فَإِذَا النَّاسُ قِيَامٌ يُصَلُّونَ وَإِذَا هِيَ قَائِمَةٌ تُصَلِّي فَقُلْتُ مَا لِلنَّاسِ فَأَشَارَتْ بِيَدِهَا نَحْوَ السَّمَاءِ وَقَالَتْ سُبْحَانَ اللَّهِ . فَقُلْتُ آيَةٌ فَأَشَارَتْ بِرَأْسِهَا أَنْ نَعَمْ . قَالَتْ فَقُمْتُ حَتَّى تَجَلاَّنِي الْغَشْىُ وَجَعَلْتُ أَصُبُّ فَوْقَ رَأْسِي الْمَاءَ فَحَمِدَ اللَّهَ رَسُولُ اللَّهِ صلى الله عليه وسلم وَأَثْنَى عَلَيْهِ ثُمَّ قَالَ " مَا مِنْ شَىْءٍ كُنْتُ لَمْ أَرَهُ إِلاَّ قَدْ رَأَيْتُهُ فِي مَقَامِي هَذَا حَتَّى الْجَنَّةُ وَالنَّارُ وَلَقَدْ أُوحِيَ إِلَىَّ أَنَّكُمْ تُفْتَنُونَ فِي الْقُبُورِ مِثْلَ - أَوْ قَرِيبًا - مِنْ فِتْنَةِ الدَّجَّالِ - لاَ أَدْرِي أَيَّتَهُمَا قَالَتْ أَسْمَاءُ - يُؤْتَى أَحَدُكُمْ فَيُقَالُ لَهُ مَا عِلْمُكَ بِهَذَا الرَّجُلِ فَأَمَّا الْمُؤْمِنُ - أَوِ الْمُوقِنُ لاَ أَدْرِي أَىَّ ذَلِكَ قَالَتْ أَسْمَاءُ - فَيَقُولُ هُوَ مُحَمَّدٌ رَسُولُ اللَّهِ جَاءَنَا بِالْبَيِّنَاتِ وَالْهُدَى فَأَجَبْنَا وَآمَنَّا وَاتَّبَعْنَا فَيُقَالُ لَهُ نَمْ صَالِحًا قَدْ عَلِمْنَا إِنْ كُنْتَ لَمُؤْمِنًا وَأَمَّا الْمُنَافِقُ - أَوِ الْمُرْتَابُ لاَ أَدْرِي أَيَّتَهُمَا قَالَتْ أَسْمَاءُ - فَيَقُولُ لاَ أَدْرِي ...

Yahya related to me from Malik from Abdullah ibn Abdullah ibn Jabir ibn Atik that Atik ibn al-Harith, the grandfather of Abdullah ibn Abdullah ibn Jabir on his mother's side, told him that Jabir ibn Atik had told him that the Messenger of Allah, may Allah bless him and grant him peace, came to visit Abdullah ibn Thabit and found him in his death-throes. He called to him but he did not reply. The Messenger of Allah, may Allah bless him and grant him peace, said, "We belong to Allah, and to Him we are returning," and added, "You are being taken from us, Abur-Rabi`." The women cried out and wept, and Jabir began to silence them. The Messenger of Allah, may Allah bless him and grant him peace, said, "Leave them, and when the necessary time comes, none of the women should cry." They said, "Messenger of Allah, what is the necessary time?" and he replied, "When he dies." The dying man's daughter said, "By Allah, I hope that you will be a martyr, for you have completed your preparations for battle," and the Messenger of Allah, may Allah bless him and grant him peace, said, "Allah has made his reward fall according to his intention. What do you consider dying a martyr to be?" They said, "Death in the way of Allah." The Messenger of Allah, may Allah bless him and grant him peace, said, "There are seven kinds of martyr other than those killed in the way of Allah. Someone who is killed by the plague is a martyr, someone who drowns is a martyr, someone who dies of pleurisy is a martyr, someone who dies of a disease of the belly is a martyr, someone who dies by fire is a martyr, someone who dies under a falling building is a martyr and a woman who dies in childbirth is a martyr."
حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ عَبْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ جَابِرِ بْنِ عَتِيكٍ، عَنْ عَتِيكِ بْنِ الْحَارِثِ، - وَهُوَ جَدُّ عَبْدِ اللَّهِ بْنِ عَبْدِ اللَّهِ بْنِ جَابِرٍ أَبُو أُمِّهِ - أَنَّهُ أَخْبَرَهُ أَنَّ جَابِرَ بْنَ عَتِيكٍ أَخْبَرَهُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم جَاءَ يَعُودُ عَبْدَ اللَّهِ بْنَ ثَابِتٍ فَوَجَدَهُ قَدْ غُلِبَ عَلَيْهِ فَصَاحَ بِهِ فَلَمْ يُجِبْهُ فَاسْتَرْجَعَ رَسُولُ اللَّهِ صلى الله عليه وسلم وَقَالَ " غُلِبْنَا عَلَيْكَ يَا أَبَا الرَّبِيعِ " . فَصَاحَ النِّسْوَةُ وَبَكَيْنَ فَجَعَلَ جَابِرٌ يُسَكِّتُهُنَّ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " دَعْهُنَّ فَإِذَا وَجَبَ فَلاَ تَبْكِيَنَّ بَاكِيَةٌ " . قَالُوا يَا رَسُولَ اللَّهِ وَمَا الْوُجُوبُ قَالَ " إِذَا مَاتَ " . فَقَالَتِ ابْنَتُهُ وَاللَّهِ إِنْ كُنْتُ لأَرْجُو أَنْ تَكُونَ شَهِيدًا فَإِنَّكَ كُنْتَ قَدْ قَضَيْتَ جِهَازَكَ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " إِنَّ اللَّهَ قَدْ أَوْقَعَ أَجْرَهُ عَلَى قَدْرِ نِيَّتِهِ وَمَا تَعُدُّونَ الشَّهَادَةَ " . قَالُوا الْقَتْلُ فِي سَبِيلِ اللَّهِ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " الشُّهَدَاءُ سَبْعَةٌ سِوَى الْقَتْلِ فِي سَبِيلِ اللَّهِ الْمَطْعُونُ شَهِيدٌ وَالْغَرِقُ شَهِيدٌ وَصَاحِبُ ذَاتِ الْجَنْبِ شَهِيدٌ وَالْمَبْطُونُ شَهِيدٌ وَالْحَرِقُ شَهِيدٌ وَالَّذِي يَمُوتُ تَحْتَ الْهَدْمِ شَهِيدٌ ...

Sahih Muslim 1277 c
'Urwa b. Zabair reported:
I said to 'A'isha, the wife of Allah's Apostle (may peace be upon him): I do not see any (fault) in one who does not circumambl" te between al-Safa' and al-Marwa, and I do not mind if I do not circumambulate between them, whereupon she said: O, the son of my sister, what you say is wrong. Allah's Messenger (may peace be upon him) observed Sa'i and so did the Muslims. So it is a Sunnah (of the Prophet). And it was a common practice (with the pagan Arabs) that those who pronounced Talbiya for the wretched al-Manat, situated at Mushalla, did not observe Sa'i between al-Safa' and al-Marwa. With the advent of Islam, we asked Allah's Apostle (may peace be upon him) about this practice, and (it was on this occasion) that Allah, the Exalted and Majestic, revealed this verse:" Verily al-Safa' and al-Marwa are among the Signs of Allah" ; so he who performed Hajj or 'Umra it is no sin on him if he circumambulates them. And if it were as you state, (then the wording would have been):" There is no harm for him, that he should not circumambulate round them." Zuhri said: I made a mention of that to Abu Bakr b. 'Abd al- Rahman b. al-Harith b. Hisham; he was impressed by that and said: This is what is called knowledge. And I have heard many a scholar saying: Many of the Arabs who did not circumambulate between al-Safa' and al-Marwa caid: Our circumambulation between these two hills is an act of ignorance; whereas others among the Ansar said: We have been commanded to circumambulate the House, and not Commanded to run between al-Safa' and al-Marwa. So Allah, the Exalted and Majestic, revealed thia verse:" Verily al-Safa' and al-Marwa are among the Signs of Allah." Abu Bakr b. 'Abd al-Rahman said: I think that this (verse) has been revealed for such and such (persons).
حَدَّثَنَا عَمْرٌو النَّاقِدُ، وَابْنُ أَبِي عُمَرَ، جَمِيعًا عَنِ ابْنِ عُيَيْنَةَ، - قَالَ ابْنُ أَبِي عُمَرَ حَدَّثَنَا سُفْيَانُ، - قَالَ سَمِعْتُ الزُّهْرِيَّ، يُحَدِّثُ عَنْ عُرْوَةَ بْنِ الزُّبَيْرِ، قَالَ قُلْتُ لِعَائِشَةَ زَوْجِ النَّبِيِّ صلى الله عليه وسلم مَا أَرَى عَلَى أَحَدٍ لَمْ يَطُفْ بَيْنَ الصَّفَا وَالْمَرْوَةِ شَيْئًا وَمَا أُبَالِي أَنْ لاَ أَطُوفَ بَيْنَهُمَا . قَالَتْ بِئْسَ مَا قُلْتَ يَا ابْنَ أُخْتِي طَافَ رَسُولُ اللَّهِ صلى الله عليه وسلم وَطَافَ الْمُسْلِمُونَ فَكَانَتْ سُنَّةً وَإِنَّمَا كَانَ مَنْ أَهَلَّ لِمَنَاةَ الطَّاغِيَةِ الَّتِي بِالْمُشَلَّلِ لاَ يَطُوفُونَ بَيْنَ الصَّفَا وَالْمَرْوَةِ فَلَمَّا كَانَ الإِسْلاَمُ سَأَلْنَا النَّبِيَّ صلى الله عليه وسلم عَنْ ذَلِكَ فَأَنْزَلَ اللَّهُ عَزَّ وَجَلَّ { إِنَّ الصَّفَا وَالْمَرْوَةَ مِنْ شَعَائِرِ اللَّهِ فَمَنْ حَجَّ الْبَيْتَ أَوِ اعْتَمَرَ فَلاَ جُنَاحَ عَلَيْهِ أَنْ يَطَّوَّفَ بِهِمَا} وَلَوْ كَانَتْ كَمَا تَقُولُ لَكَانَتْ فَلاَ جُنَاحَ عَلَيْهِ أَنْ لاَ يَطَّوَّفَ بِهِمَا . قَالَ الزُّهْرِيُّ فَذَكَرْتُ ذَلِكَ لأَبِي بَكْرِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ فَأَعْجَبَهُ ذَلِكَ . وَقَالَ إِنَّ هَذَا الْعِلْمُ . وَلَقَدْ سَمِعْتُ رِجَالاً مِنْ أَهْلِ الْعِلْمِ يَقُولُونَ إِنَّمَا كَانَ مَنْ لاَ يَطُوفُ بَيْنَ الصَّفَا وَالْمَرْوَةِ مِنَ الْعَرَبِ يَقُولُونَ ...

Abu Laila 'Abdullah b. 'Abd al-Rahman b. Sahl reported that the elderly persons of (the tribe) had informed Sahl b. Abu Hathma that 'Abdullah b. Sahl and Muhayyisa went out to Khaibar under some distress which had afflicted them. Muhayyisa came and informed that Abdutlah b. Sahl had been killed, and (his dead body) had been thrown in a well or in a ditch. He came to the Jews and said:
By Allah, it is you who have killed him. They said: By Allah, we have not killed him. He then came to his people, and made mention of that to them. Then came he and his brother Huwayyisa, and he was older than he, and 'Abd al-Rahman b. Sahl. Then Muhayyisa went to speak, and it was he who had accompanied ('Abdullah) to Khaibar, whereupon Allah's Messenger (may peace be upon him) said to Muhayyisa: Observe greatness of the great (he meant the seniority of age). Then Huwayyisa spoke and then Muhayyisa also spoke. Thereupon Allah's Messenger (may peace be upon him) said: They should either pay blood-wit for your companion, or be prepared for war. Allah's Messenger (may peace be upon him) wrote about it to them (to the Jews). They wrote: Verily, by Allah, we have not killed him. Thereupon Allah's Messenger (may peace be upon him) said to Huwayyisa and Muhayyisa and Abd al-Rahman: Are you prepared to take oath in order to entitle yourselves for the blood-wit of your companion? They said: No. He (the Holy Prophet) said: Then the Jews will take oath (of their innocence). They said: They are not Muslims. Allah's Messenger (may peace be upon him), however, himself paid the blood-wit to them and sent to them one hundred camels until they entered into their houses, Sahl said: One red she-camel among them kicked me.
حَدَّثَنِي إِسْحَاقُ بْنُ مَنْصُورٍ، أَخْبَرَنَا بِشْرُ بْنُ عُمَرَ، قَالَ سَمِعْتُ مَالِكَ بْنَ أَنَسٍ، يَقُولُ حَدَّثَنِي أَبُو لَيْلَى بْنُ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ سَهْلٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، أَنَّهُ أَخْبَرَهُ عَنْ رِجَالٍ، مِنْ كُبَرَاءِ قَوْمِهِ أَنَّ عَبْدَ، اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ خَرَجَا إِلَى خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمْ فَأَتَى مُحَيِّصَةُ فَأَخْبَرَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي عَيْنٍ أَوْ فَقِيرٍ فَأَتَى يَهُودَ فَقَالَ أَنْتُمْ وَاللَّهِ قَتَلْتُمُوهُ . قَالُوا وَاللَّهِ مَا قَتَلْنَاهُ . ثُمَّ أَقْبَلَ حَتَّى قَدِمَ عَلَى قَوْمِهِ فَذَكَرَ لَهُمْ ذَلِكَ ثُمَّ أَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَهُوَ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَكَلَّمَ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِمُحَيِّصَةَ " كَبِّرْ كَبِّرْ " . يُرِيدُ السِّنَّ فَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم " إِمَّا أَنْ يَدُوا صَاحِبَكُمْ وَإِمَّا أَنْ يُؤْذِنُوا بِحَرْبٍ " . فَكَتَبَ رَسُولُ اللَّهِ صلى الله عليه وسلم إِلَيْهِمْ فِي ذَلِكَ فَكَتَبُوا إِنَّا وَاللَّهِ مَا قَتَلْنَاهُ . فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِحُوَيِّصَةَ وَمُحَيِّصَةَ وَعَبْدِ الرَّحْمَنِ " أَتَحْلِفُونَ وَتَسْتَحِقُّونَ ...

It has been narrated by 'Urwa b Zubair on the authority of 'A'isha, wife of the Holy Prophet (may peace be upon him), that Fatima, daughter of the Messenger of Allah (may peace be upon him), requested Abu Bakr, after the death of the Messenger of Allah (may peace he upon him), that he should set apart her share from what the Messenger of Allah (may peace be upon him) had left from the properties that God had bestowed upon him. Abu Bakr said to her:
The Messenger of Allah (may peace be upon him) said:" We do not have any heirs; what we leave behind is Sadaqa (charity)." The narrator said: She (Fatima) lived six months after the death of the Messenger of Allah (may peace be upon him) and she used to demand from Abu Bakr her share from the legacy of the Messenger of Allah (may peace be upon him) from Khaibar, Fadak and his charitable endowments at Medina. Abu Bakr refused to give her this, and said: I am not going to give up doing anything which the Messenger of Allah (may peace be upon him) used to do. I am afraid that it I go against his instructions in any matter I shall deviate from the right course. So far as the charitable endowments at Medina were concerned, 'Umar handed them over to 'Ali and Abbas, but 'Ali got the better of him (and kept the property under his exclusive possession). And as far as Khaibar and Fadak were concerned 'Umar kept them with him, and said: These are the endowments of the Messenger of Allah (may peace be upon him) (to the Umma). Their income was spent on the discharge of the responsibilities that devolved upon him on the emergencies he had to meet. And their management was to be in the hands of one who managed the affairs (of the Islamic State). The narrator said: They have been managed as such up to this day.
وَحَدَّثَنَا ابْنُ نُمَيْرٍ، حَدَّثَنَا يَعْقُوبُ بْنُ إِبْرَاهِيمَ، حَدَّثَنَا أَبِي ح، وَحَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ، وَالْحَسَنُ بْنُ عَلِيٍّ الْحُلْوَانِيُّ قَالاَ حَدَّثَنَا يَعْقُوبُ، - وَهُوَ ابْنُ إِبْرَاهِيمَ - حَدَّثَنَا أَبِي، عَنْ صَالِحٍ، عَنِ ابْنِ شِهَابٍ، أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ، أَنَّ عَائِشَةَ، زَوْجَ النَّبِيِّ صلى الله عليه وسلم أَخْبَرَتْهُ أَنَّ فَاطِمَةَ بِنْتَ رَسُولِ اللَّهِ صلى الله عليه وسلم سَأَلَتْ أَبَا بَكْرٍ بَعْدَ وَفَاةِ رَسُولِ اللَّهِ صلى الله عليه وسلم أَنْ يَقْسِمَ لَهَا مِيرَاثَهَا مِمَّا تَرَكَ رَسُولُ اللَّهِ صلى الله عليه وسلم مِمَّا أَفَاءَ اللَّهُ عَلَيْهِ . فَقَالَ لَهَا أَبُو بَكْرٍ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ
" لاَ نُورَثُ مَا تَرَكْنَا صَدَقَةٌ " . قَالَ وَعَاشَتْ بَعْدَ رَسُولِ اللَّهِ صلى الله عليه وسلم سِتَّةَ أَشْهُرٍ وَكَانَتْ فَاطِمَةُ تَسْأَلُ أَبَا بَكْرٍ نَصِيبَهَا مِمَّا تَرَكَ رَسُولُ اللَّهِ صلى الله عليه وسلم مِنْ خَيْبَرَ وَفَدَكٍ وَصَدَقَتِهِ بِالْمَدِينَةِ فَأَبَى أَبُو بَكْرٍ عَلَيْهَا ذَلِكَ وَقَالَ لَسْتُ تَارِكًا شَيْئًا كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَعْمَلُ بِهِ إِلاَّ عَمِلْتُ بِهِ إِنِّي أَخْشَى إِنْ تَرَكْتُ شَيْئًا مِنْ أَمْرِهِ أَنْ أَزِيغَ فَأَمَّا صَدَقَتُهُ بِالْمَدِينَةِ فَدَفَعَهَا عُمَرُ إِلَى عَلِيٍّ وَعَبَّاسٍ فَغَلَبَهُ عَلَيْهَا عَلِيٌّ وَأَمَّا خَيْبَرُ وَفَدَكُ فَأَمْسَكَهُمَا ...
