Samurah bin Jundab narrated that:
The Messenger of Allah said: "Whichever woman is given in marriage by two Wali, then her case is in accordance with the first of them, and whoever sells something to two men, then it is for the first of them."
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا غُنْدَرٌ، حَدَّثَنَا سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ بْنِ جُنْدَبٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلأَوَّلِ مِنْهُمَا وَمَنْ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلأَوَّلِ مِنْهُمَا ‏" ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ ‏.‏ وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ لاَ نَعْلَمُ بَيْنَهُمْ فِي ذَلِكَ اخْتِلاَفًا إِذَا زَوَّجَ أَحَدُ الْوَلِيَّيْنِ قَبْلَ الآخَرِ فَنِكَاحُ الأَوَّلِ جَائِزٌ وَنِكَاحُ الآخَرِ مَفْسُوخٌ وَإِذَا زَوَّجَا جَمِيعًا فَنِكَاحُهُمَا جَمِيعًا مَفْسُوخٌ ‏.‏ وَهُوَ قَوْلُ الثَّوْرِيِّ وَأَحْمَدَ وَإِسْحَاقَ ‏.‏

Narrated Anas (RA):
The Prophet (SAW) stayed three nights between Khaibar and al-Madinah when he consummated his marriage with Safiya (RA). I called the Muslims to his wedding feast which did not include bread or meat. He just ordered some leather dining sheets to be spread, and [Hais, a food made from] dates, sun-baked yogurt and butter were thrown on them. [Agreed upon: the wording is al-Bukhari's].
وَعَنْ أَنَسٍ قَالَ : { أَقَامَ اَلنَّبِيُّ ‏- صلى الله عليه وسلم ‏-بَيْنَ خَيْبَرَ وَالْمَدِينَةِ ثَلَاثَ لَيَالٍ , يُبْنَى عَلَيْهِ بِصَفِيَّةَ , فَدَعَوْتُ اَلْمُسْلِمِينَ إِلَى وَلِيمَتِهِ , فَمَا كَانَ فِيهَا مِنْ خُبْزٍ وَلَا لَحْمٍ , وَمَا كَانَ فِيهَا إِلَّا أَنْ أَمَرَ بِالْأَنْطَاعِ , فَبُسِطَتْ , فَأُلْقِيَ عَلَيْهَا اَلتَّمْرُ , وَالْأَقِطُ , وَالسَّمْنُ.‏ } مُتَّفَقٌ عَلَيْهِ , وَاللَّفْظُ لِلْبُخَارِيِّ 1‏ .‏

It was narrated from Ibn Abu Najeeh, from his father, from a man who heard ‘Ali (رضي الله عنه) say:
I wanted to propose marriage to the daughter of the Messenger of Allah (ﷺ), but I thought: I have nothing, so how could it be? Then I remembered how he upheld ties of kinship and his kindness and generosity, so I asked him for his daughter`s hand in marriage. He said: “Do you have anything”? I said: No. He said: `Where is the Hutamiyyah shield that I gave you on such and such a day?` I said: I have it. He said: `Then give it to her.`
أَنْبَأَنَا سُفْيَانُ، عَنِ ابْنِ أَبِي نَجِيحٍ، عَنْ أَبِيهِ، عَنْ رَجُلٍ، سَمِعَ عَلِيًّا، رَضِيَ اللَّهُ عَنْهُ يَقُولُ أَرَدْتُ أَنْ أَخْطُبَ إِلَى رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ابْنَتَهُ فَقُلْتُ مَا لِي مِنْ شَيْءٍ فَكَيْفَ ثُمَّ ذَكَرْتُ صِلَتَهُ وَعَائِدَتَهُ فَخَطَبْتُهَا إِلَيْهِ فَقَالَ هَلْ لَكَ مِنْ شَيْءٍ قُلْتُ لَا قَالَ فَأَيْنَ دِرْعُكَ الْحُطَمِيَّةُ الَّتِي أَعْطَيْتُكَ يَوْمَ كَذَا وَكَذَا قَالَ هِيَ عِنْدِي قَالَ فَأَعْطِهَا إِيَّاهُ‏.‏

Narrated `Aisha:

The believing women covered with their veiling sheets used to attend the Fajr prayer with Allah's Apostle, and after finishing the prayer they would return to their home and nobody could recognize them because of darkness.

حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ، قَالَ أَخْبَرَنَا اللَّيْثُ، عَنْ عُقَيْلٍ، عَنِ ابْنِ شِهَابٍ، قَالَ أَخْبَرَنِي عُرْوَةُ بْنُ الزُّبَيْرِ، أَنَّ عَائِشَةَ، أَخْبَرَتْهُ قَالَتْ، كُنَّ نِسَاءُ الْمُؤْمِنَاتِ يَشْهَدْنَ مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم صَلاَةَ الْفَجْرِ مُتَلَفِّعَاتٍ بِمُرُوطِهِنَّ، ثُمَّ يَنْقَلِبْنَ إِلَى بُيُوتِهِنَّ حِينَ يَقْضِينَ الصَّلاَةَ، لاَ يَعْرِفُهُنَّ أَحَدٌ مِنَ الْغَلَسِ‏.‏

Narrated `Urwa:

Aisha told me, "Allah's Apostle used to examine them according to this Verse: "O you who believe! When the believing women come to you, as emigrants test them . . . for Allah is Oft- Forgiving, Most Merciful." (60.10-12) Aisha said, "When any of them agreed to that condition Allah's Apostle would say to her, 'I have accepted your pledge of allegiance.' He would only say that, but, by Allah he never touched the hand of any women (i.e. never shook hands with them) while taking the pledge of allegiance and he never took their pledge of allegiance except by his words (only).

قَالَ عُرْوَةُ فَأَخْبَرَتْنِي عَائِشَةُ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَ يَمْتَحِنُهُنَّ بِهَذِهِ الآيَةِ ‏‏{‏يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا جَاءَكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ ‏}‏ إِلَى ‏‏{‏غَفُورٌ رَحِيمٌ‏}‏‏.‏ قَالَ عُرْوَةُ قَالَتْ عَائِشَةُ فَمَنْ أَقَرَّ بِهَذَا الشَّرْطِ مِنْهُنَّ قَالَ لَهَا رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ قَدْ بَايَعْتُكِ ‏"‏‏.‏ كَلاَمًا يُكَلِّمُهَا بِهِ، وَاللَّهِ مَا مَسَّتْ يَدُهُ يَدَ امْرَأَةٍ قَطُّ فِي الْمُبَايَعَةِ، وَمَا بَايَعَهُنَّ إِلاَّ بِقَوْلِهِ‏.‏

Allah's Apostle said, Whoever believes in Allah and the Last Day, should serve his guest generously. The guest's reward is: To provide him with a superior type of food for a night and a day and a guest is to be entertained with food for three days, and whatever is offered beyond that, is regarded as something given in charity. And it is not lawful for a guest to stay with his host for such a long period so as to put him in a critical position."

Narrated Malik:

Similarly as above (156) adding, "Who believes in Allah and the Last Day should talk what is good or keep quiet." (i.e. abstain from dirty and evil talk, and should think before uttering).

Narrated `Ali:

Allah's Apostle sent me, Az-Zubair and Al-Miqdad saying, "Proceed till you reach Rawdat Khakh where there is a lady carrying a letter, and take that (letter) from her." So we proceeded on our way with our horses galloping till we reached the Rawda, and there we found the lady and said to her, "Take out the letter." She said, "I have no letter." We said, "Take out the letter, or else we will take off your clothes." So she took it out of her braid, and we brought the letter to Allah's Apostle . The letter was addressed from Hatib, bin Abi Balta'a to some pagans of Mecca, telling them about what Allah's Apostle intended to do. Allah's Apostle said, "O Hatib! What is this?" Hatib replied, "O Allah's Apostle! Do not make a hasty decision about me. I was a person not belonging to Quraish but I was an ally to them from outside and had no blood relation with them, and all the Emigrants who were with you, have got their kinsmen (in Mecca) who can protect their families and properties. So I liked to do them a favor so that they might protect my relatives as I have no blood relation with them. I did not do this to renegade from my religion (i.e. Islam) nor did I do it to choose Heathenism after Islam." Allah's Apostle said to his companions." As regards him, he (i.e. Hatib) has told you the truth." `Umar said, "O Allah's Apostle! Allow me to chop off the head of this hypocrite!" The Prophet said, "He (i.e. Hatib) has witnessed the Badr battle (i.e. fought in it) and what could tell you, perhaps Allah looked at those who witnessed Badr and said, "O the people of Badr (i.e. Badr Muslim warriors), do what you like, for I have forgiven you. "Then Allah revealed the Surah: "O you who believe! Take not my enemies And your enemies as friends offering them (Your) love even though they have disbelieved in that Truth (i.e. Allah, Prophet Muhammad and this Qur'an) which has come to you ....(to the end of Verse)....(And whosoever of you (Muslims) does that, then indeed he has gone (far) astray (away) from the Straight Path." (Quran 60.1)

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، قَالَ أَخْبَرَنِي الْحَسَنُ بْنُ مُحَمَّدٍ، أَنَّهُ سَمِعَ عُبَيْدَ اللَّهِ بْنَ أَبِي رَافِعٍ، يَقُولُ سَمِعْتُ عَلِيًّا ـ رضى الله عنه ـ يَقُولُ بَعَثَنِي رَسُولُ اللَّهِ صلى الله عليه وسلم أَنَا وَالزُّبَيْرَ وَالْمِقْدَادَ فَقَالَ ‏"‏ انْطَلِقُوا حَتَّى تَأْتُوا رَوْضَةَ خَاخٍ، فَإِنَّ بِهَا ظَعِينَةً مَعَهَا كِتَابٌ، فَخُذُوا مِنْهَا ‏"‏‏.‏ قَالَ فَانْطَلَقْنَا تَعَادَى بِنَا خَيْلُنَا حَتَّى أَتَيْنَا الرَّوْضَةَ، فَإِذَا نَحْنُ بِالظَّعِينَةِ قُلْنَا لَهَا أَخْرِجِي الْكِتَابَ‏.‏ قَالَتْ مَا مَعِي كِتَابٌ‏.‏ فَقُلْنَا لَتُخْرِجِنَّ الْكِتَابَ أَوْ لَنُلْقِيَنَّ الثِّيَابَ، قَالَ فَأَخْرَجَتْهُ مِنْ عِقَاصِهَا، فَأَتَيْنَا بِهِ رَسُولَ اللَّهِ صلى الله عليه وسلم فَإِذَا فِيهِ مِنْ حَاطِبِ بْنِ أَبِي بَلْتَعَةَ إِلَى نَاسٍ بِمَكَّةَ مِنَ الْمُشْرِكِينَ، يُخْبِرُهُمْ بِبَعْضِ أَمْرِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ يَا حَاطِبُ مَا هَذَا ‏"‏‏.‏ قَالَ يَا رَسُولَ اللَّهِ ...

It was narrated from Masruq that:
Abdullah was asked about a man who married a woman and died without having consummated the marriage with her, nor stipulating the dowry. Abdullah said: “The dowry is hers, and the inheritance is hers and she has to observe the waiting period.” Ma'qil bin Sinan Al-Ashja'i said: “I saw the Messenger of Allah (saws) pass a similar ruling concerning Birwa' bint Washiq.” (Sahih) Another chain from 'Alqamah, from Abdullah, with similar wording. It was narrated from Masruq that: Abdullah was asked about a man who married a woman and died without having consummated the marriage with her, nor stipulating the dowry. Narrated Ibn `Abbas:

When the Prophet got up at night to offer the Tahajjud prayer, he used to say: Allahumma lakal-hamd. Anta qaiyyimus-samawati wal-ard wa man fihinna. Walakal-hamd, Laka mulkus-samawati wal-ard wa man fihinna. Walakal-hamd, anta nurus-samawati wal-ard. Wa lakal-hamd, anta-l-haq wa wa'duka-lhaq, wa liqa'uka Haq, wa qauluka Haq, wal-jannatu Han wan-naru Haq wannabiyuna Haq. Wa Muhammadun, sallal-lahu'alaihi wasallam, Haq, was-sa'atu Haq. Allahumma aslamtu Laka wabika amantu, wa 'Alaika tawakkaltu, wa ilaika anabtu wa bika khasamtu, wa ilaika hakamtu faghfir li ma qaddamtu wama akh-khartu wama as-rartu wama'a lantu, anta-l-muqaddim wa anta-l-mu akh-khir, la ilaha illa anta (or la ilaha ghairuka). (O Allah! All the praises are for you, You are the Holder of the Heavens and the Earth, And whatever is in them. All the praises are for You; You have the possession of the Heavens and the Earth And whatever is in them. Sufyan said that `Abdul Karim Abu Umaiya added to the above, 'Wala haula Wala quwata illa billah' (There is neither might nor power except with Allah).

Narrated Anas:

My uncle Anas bin An-Nadr was absent from the Battle of Badr. He said, "O Allah's Apostle! I was absent from the first battle you fought against the pagans. (By Allah) if Allah gives me a chance to fight the pagans, no doubt. Allah will see how (bravely) I will fight." On the day of Uhud when the Muslims turned their backs and fled, he said, "O Allah! I apologize to You for what these (i.e. his companions) have done, and I denounce what these (i.e. the pagans) have done." Then he advanced and Sa`d bin Mu`adh met him. He said "O Sa`d bin Mu`adh ! By the Lord of An-Nadr, Paradise! I am smelling its aroma coming from before (the mountain of) Uhud," Later on Sa`d said, "O Allah's Apostle! I cannot achieve or do what he (i.e. Anas bin An-Nadr) did. We found more than eighty wounds by swords and arrows on his body. We found him dead and his body was mutilated so badly that none except his sister could recognize him by his fingers." We used to think that the following Verse was revealed concerning him and other men of his sort: "Among the believers are men who have been true to their covenant with Allah.........." (33.23) His sister Ar-Rubbaya' broke a front tooth of a woman and Allah's Apostle ordered for retaliation. On that Anas (bin An-Nadr) said, "O Allah's Apostle! By Him Who has sent you with the Truth, my sister's tooth shall not be broken." Then the opponents of Anas's sister accepted the compensation and gave up the claim of retaliation. So Allah's Apostle said, "There are some people amongst Allah's slaves whose oaths are fulfilled by Allah when they take them."

Narrated Abu Qatada:

We set out in the company of Allah's Apostle on the day (of the battle) of Hunain. When we faced the enemy, the Muslims retreated and I saw a pagan throwing himself over a Muslim. I turned around and came upon him from behind and hit him on the shoulder with the sword He (i.e. the pagan) came towards me and seized me so violently that I felt as if it were death itself, but death overtook him and he released me. I followed `Umar bin Al Khattab and asked (him), "What is wrong with the people (fleeing)?" He replied, "This is the Will of Allah," After the people returned, the Prophet sat and said, "Anyone who has killed an enemy and has a proof of that, will posses his spoils." I got up and said, "Who will be a witness for me?" and then sat down. The Prophet again said, "Anyone who has killed an enemy and has proof of that, will possess his spoils." I (again) got up and said, "Who will be a witness for me?" and sat down. Then the Prophet said the same for the third time. I again got up, and Allah's Apostle said, "O Abu Qatada! What is your story?" Then I narrated the whole story to him. A man (got up and) said, "O Allah's Apostle! He is speaking the truth, and the spoils of the killed man are with me. So please compensate him on my behalf." On that Abu Bakr As-Siddiq said, "No, by Allah, he (i.e. Allah's Apostle ) will not agree to give you the spoils gained by one of Allah's Lions who fights on the behalf of Allah and His Apostle." The Prophet said, "Abu Bakr has spoken the truth." So, Allah's Apostle gave the spoils to me. I sold that armor (i.e. the spoils) and with its price I bought a garden at Bani Salima, and this was my first property which I gained after my conversion to Islam.

The Messenger of Allah (saws) saw the trace of yellow on 'Abd al-Rahman b. 'Awf. The Prophet (saws) said: What is this ? He replied: Messenger of Allah, I have married a woman. Narrated Abu Huraira:

Allah's Apostle sent a Sariya of ten men as spies under the leadership of `Asim bin Thabit al-Ansari, the grandfather of `Asim bin `Umar Al-Khattab. They proceeded till they reached Hadaa, a place between 'Usfan, and Mecca, and their news reached a branch of the tribe of Hudhail called Bani Lihyan. About two-hundred men, who were all archers, hurried to follow their tracks till they found the place where they had eaten dates they had brought with them from Medina. They said, "These are the dates of Yathrib (i.e. Medina), "and continued following their tracks When `Asim and his companions saw their pursuers, they went up a high place and the infidels circled them. The infidels said to them, "Come down and surrender, and we promise and guarantee you that we will not kill any one of you" `Asim bin Thabit; the leader of the Sariya said, "By Allah! I will not come down to be under the protection of infidels. O Allah! Convey our news to Your Prophet. Then the infidels threw arrows at them till they martyred `Asim along with six other men, and three men came down accepting their promise and convention, and they were Khubaib-al-Ansari and Ibn Dathina and another man So, when the infidels captured them, they undid the strings of their bows and tied them. Then the third (of the captives) said, "This is the first betrayal. By Allah! I will not go with you. No doubt these, namely the martyred, have set a good example to us." So, they dragged him and tried to compel him to accompany them, but as he refused, they killed him. They took Khubaid and Ibn Dathina with them and sold them (as slaves) in Mecca (and all that took place) after the battle of Badr. Khubaib was bought by the sons of Al-Harith bin 'Amir bin Naufal bin `Abd Manaf. It was Khubaib who had killed Al-Harith bin 'Amir on the day (of the battle of) Badr. So, Khubaib remained a prisoner with those people. Narrated Az-Zuhri: 'Ubaidullah bin 'Iyyad said that the daughter of Al-Harith had told him, "When those people gathered (to kill Khubaib) he borrowed a razor from me to shave his pubes and I gave it to him. Then he took a son of mine while I was unaware when he came upon him. I saw him placing my son on his thigh and the razor was in his hand. I got scared so much that Khubaib noticed the agitation on my face and said, 'Are you afraid that I will kill him? No, I will never do so.' By Allah, I never saw a prisoner better than Khubaib. By Allah, one day I saw him eating of a bunch of grapes in his hand while he was chained in irons, and there was no fruit at that time in Mecca." The daughter of Al-Harith used to say, "It was a boon Allah bestowed upon Khubaib." When they took him out of the Sanctuary (of Mecca) to kill him outside its boundaries, Khubaib requested them to let him offer two rak`at (prayer). They allowed him and he offered Two rak`at and then said, "Hadn't I been afraid that you would think that I was afraid (of being killed), I would have prolonged the prayer. O Allah, kill them all with no exception." (He then recited the poetic verse):-- "I being martyred as a Muslim, Do not mind how I am killed in Allah's Cause, For my killing is for Allah's Sake, And if Allah wishes, He will bless the amputated parts of a torn body" Then the son of Al Harith killed him. So, it was Khubaib who set the tradition for any Muslim sentenced to death in captivity, to offer a two-rak`at prayer (before being killed). Allah fulfilled the invocation of `Asim bin Thabit on that very day on which he was martyred. The Prophet informed his companions of their news and what had happened to them. Later on when some infidels from Quraish were informed that `Asim had been killed, they sent some people to fetch a part of his body (i.e. his head) by which he would be recognized. (That was because) `Asim had killed one of their chiefs on the day (of the battle) of Badr. So, a swarm of wasps, resembling a shady cloud, were sent to hover over `Asim and protect him from their messenger and thus they could not cut off anything from his flesh.

حَدَّثَنَا أَبُو الْيَمَانِ، أَخْبَرَنَا شُعَيْبٌ، عَنِ الزُّهْرِيِّ، قَالَ أَخْبَرَنِي عَمْرُو بْنُ أَبِي سُفْيَانَ بْنِ أَسِيدِ بْنِ جَارِيَةَ الثَّقَفِيُّ ـ وَهْوَ حَلِيفٌ لِبَنِي زُهْرَةَ وَكَانَ مِنْ أَصْحَابِ أَبِي هُرَيْرَةَ ـ أَنَّ أَبَا هُرَيْرَةَ ـ رضى الله عنه ـ قَالَ بَعَثَ رَسُولُ اللَّهِ صلى الله عليه وسلم عَشَرَةَ رَهْطٍ سَرِيَّةً عَيْنًا، وَأَمَّرَ عَلَيْهِمْ عَاصِمَ بْنَ ثَابِتٍ الأَنْصَارِيَّ جَدَّ عَاصِمِ بْنِ عُمَرَ، فَانْطَلَقُوا حَتَّى إِذَا كَانُوا بِالْهَدَأَةِ وَهْوَ بَيْنَ عُسْفَانَ وَمَكَّةَ ذُكِرُوا لِحَىٍّ مِنْ هُذَيْلٍ يُقَالُ لَهُمْ بَنُو لِحْيَانَ، فَنَفَرُوا لَهُمْ قَرِيبًا مِنْ مِائَتَىْ رَجُلٍ، كُلُّهُمْ رَامٍ، فَاقْتَصُّوا آثَارَهُمْ حَتَّى وَجَدُوا مَأْكَلَهُمْ تَمْرًا تَزَوَّدُوهُ مِنَ الْمَدِينَةِ فَقَالُوا هَذَا تَمْرُ يَثْرِبَ‏.‏ فَاقْتَصُّوا آثَارَهُمْ، فَلَمَّا رَآهُمْ عَاصِمٌ وَأَصْحَابُهُ لَجَئُوا إِلَى فَدْفَدٍ، وَأَحَاطَ بِهِمُ الْقَوْمُ فَقَالُوا لَهُمُ انْزِلُوا وَأَعْطُونَا بِأَيْدِيكُمْ، وَلَكُمُ الْعَهْدُ وَالْمِيثَاقُ، وَلاَ نَقْتُلُ مِنْكُمْ أَحَدًا‏.‏ قَالَ ...

Allah's Apostle used to offer the Fajr prayer when it was still dark and the believing women used to return (after finishing their prayer) and nobody could recognize them owing to darkness, or they could not recognize one another.

Abu Hurairah narrated that:
The Messenger of Allah said: "An orphan is to be consulted about herself, then if she is silent that is her permission, and if she refuses, then do not authorize it (the marriage) for her" (meaning: when she attains the age of puberty and refuses it.)

Yahya related to me from Malik from Yahya ibn Said from Said ibn al-Musayyab that Umar ibn al-Khattab said, "The woman who loses her husband and does not know where he is, waits for four years, then she does idda for four months, and then she is free to marry."

Malik said, "If she marries after her idda is over, regardless of whether the new husband has consummated the marriage or not, her first husband has no means of access to her."

Malik said, "That is what is done among us and if her husband reaches her before she has remarried, he is more entitled to her."

Malik said that he had seen people disapproving of someone who said that one of the people (of knowledge) attributed to Umar ibn al-Khattab that he said, "Her first husband chooses when he comes either her bride-price or his wife."

Malik said, "I have heard that Umar ibn al-Khattab, speaking about a woman whose husband divorced her while he was absent from her, and then he took her back and the news of his taking her back had not reached her, while the news of his divorcing her had, and so she had married again, said, 'Her first husband who divorced her has no means of access to her whether or not the new husband has consummated the marriage.' "

Malik said, "This is what I like the best of what I heard about the missing man."

قَالَ مَالِكٌ وَبَلَغَنِي أَنَّ عُمَرَ بْنَ الْخَطَّابِ قَالَ فِي الْمَرْأَةِ يُطَلِّقُهَا زَوْجُهَا وَهُوَ غَائِبٌ عَنْهَا ثُمَّ يُرَاجِعُهَا فَلاَ يَبْلُغُهَا رَجْعَتُهُ وَقَدْ بَلَغَهَا طَلاَقُهُ إِيَّاهَا فَتَزَوَّجَتْ أَنَّهُ إِنْ دَخَلَ بِهَا زَوْجُهَا الآخَرُ أَوْ لَمْ يَدْخُلْ بِهَا فَلاَ سَبِيلَ لِزَوْجِهَا الأَوَّلِ الَّذِي كَانَ طَلَّقَهَا إِلَيْهَا ‏.‏ قَالَ مَالِكٌ وَهَذَا أَحَبُّ مَا سَمِعْتُ إِلَىَّ فِي هَذَا وَفِي الْمَفْقُودِ ‏.‏

'Abdullah bin 'Umar (May Allah be pleased with them) reported:
My father 'Umar (May Allah be pleased with him) said: When (his daughter) Hafsah (May Allah be pleased with her) became a widow, I met 'Uthman bin 'Affan (May Allah be pleased with him) and offered Hafsah for marriage to him. 'Uthman said: "I shall think over the matter." I waited for a few days and then 'Uthman met me and said: "It occurred to me that I should not marry at present." Then I met Abu Bakr (May Allah be pleased with him) and said to him: "If you are willing, I shall marry my daughter Hafsah to you." Abu Bakr (May Allah be pleased with him) remained silent and did not utter any word to me in reply. I grew more angry with him than with 'Uthman. I had waited for only a few days when Messenger of Allah (PBUH) asked for her hand in marriage and I married her to him. Thereafter, I met Abu Bakr (May Allah be pleased with him) who said, "Perhaps you were angry with me when you offered Hafsah to me and I said nothing in reply." I said, "Yes, that is so." He said, "Nothing stopped me to respond to your offer except that I knew that Messenger of Allah (PBUH) had mentioned her and I could not disclose the secret of Messenger of Allah (PBUH). Had Messenger of Allah (PBUH) left her, I would have accepted her."

وعن عبد الله بن عمر رضي الله عنهما أن عمر رضي الله عنه حين تأيمت بنته حفصة قال‏:‏ لقيت عثمان بن عفان رضي الله عنه ، فعرضت عليه حفصة فقلت‏:‏ إن شئت أنكحتك حفصة بنت عمر‏؟‏ قال‏:‏ سأنظر في أمري‏.‏ فلبثت ليالي، ثم لقيني فقال ‎‏:‏ قد بدا لي أن لا أتزوج يومي هذا‏.‏ فلقيت أبا بكر الصديق رضي الله عنه، فلم يرجع إلى شيئاً‏!‏ فكنت عليه أوجد مني على عثمان، فلبثت ليالي، ثم خطبها النبي صلى الله عليه وسلم، فأنكحتها إياه‏.‏ فلقيني أبو بكر فقال‏:‏ لعلك وجدت حين عرضت على حفصة فلم أرجع إليك شيئاً‏؟‏ فقلت‏:‏ نعم‏.‏ قال‏:‏ فإنه لم يمنعني أن أرجع إليك فيما عرضت على إلا أني كنت علمت أن النبي صلى الله عليه وسلم ذكرها، فلم أكن لأفشي سر رسول الله صلى الله عليه وسلم، ولوتركها النبى صلى الله عليه وسلم لقبلتها ‏.‏ ‏(‏‏(‏رواه البخارى‏)‏‏)‏‏.‏

Narrated `Ali:

Allah's Apostle sent me, Az-Zubair bin Al-Awwam and Abu Marthad Al-Ghanawi, and all of us were horsemen, and he said, "Proceed till you reach Rawdat Khakh, where there is a woman from the pagans carrying a letter sent by Hatib bin Abi Balta'a to the pagans (of Mecca)." So we overtook her while she was proceeding on her camel at the same place as Allah's Apostle told us. We said (to her) "Where is the letter which is with you?" She said, "I have no letter with me." So we made her camel kneel down and searched her mount (baggage etc) but could not find anything. My two companions said, "We do not see any letter." I said, "I know that Allah's Apostle did not tell a lie. By Allah, if you (the lady) do not bring out the letter, I will strip you of your clothes' When she noticed that I was serious, she put her hand into the knot of her waist sheet, for she was tying a sheet round herself, and brought out the letter. So we proceeded to Allah's Apostle with the letter. The Prophet said (to Habib), "What made you o what you have done, O Hatib?" Hatib replied, "I have done nothing except that I believe in Allah and His Apostle, and I have not changed or altered (my religion). But I wanted to do the favor to the people (pagans of Mecca) through which Allah might protect my family and my property, as there is none among your companions but has someone in Mecca through whom Allah protects his property (against harm). The Prophet said, "Habib has told you the truth, so do not say to him (anything) but good." `Umar bin Al-Khattab said, "Verily he has betrayed Allah, His Apostle, and the believers! Allow me to chop his neck off!" The Prophet said, "O `Umar! What do you know; perhaps Allah looked upon the Badr warriors and said, 'Do whatever you like, for I have ordained that you will be in Paradise.'" On that `Umar wept and said, "Allah and His Apostle know best."

Yahya related to me from Malik, from Nafi, from Nubayh ibn Wahb, who was from the tribe of Bani Abd ad-Dar, that Umar ibn Ubaydullah sent a message to Aban ibn Uthman (who was amir of the hajj at the time), while both of them were in ihram, saying, "I want to marry Bint Shayba ibn Jubayr to Talha ibn Umar and I want you to be present." Aban told him that he should not do that and said, "I heard Uthman ibn Affan say that the Messenger of Allah, may Allah bless him and grant him peace, said, 'A man in ihram should not marry, or give in marriage, or get betrothed.' "

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، عَنْ نُبَيْهِ بْنِ وَهْبٍ، أَخِي بَنِي عَبْدِ الدَّارِ أَنَّ عُمَرَ بْنَ عُبَيْدِ اللَّهِ، أَرْسَلَ إِلَى أَبَانَ بْنِ عُثْمَانَ - وَأَبَانُ يَوْمَئِذٍ أَمِيرُ الْحَاجِّ وَهُمَا مُحْرِمَانِ - إِنِّي قَدْ أَرَدْتُ أَنْ أُنْكِحَ طَلْحَةَ بْنَ عُمَرَ بِنْتَ شَيْبَةَ بْنِ جُبَيْرٍ وَأَرَدْتُ أَنْ تَحْضُرَ ‏.‏ فَأَنْكَرَ ذَلِكَ عَلَيْهِ أَبَانُ وَقَالَ سَمِعْتُ عُثْمَانَ بْنَ عَفَّانَ يَقُولُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ لاَ يَنْكِحِ الْمُحْرِمُ وَلاَ يُنْكِحْ وَلاَ يَخْطُبْ ‏"‏ ‏.‏

Yahya related to me from Malik from Nafi that the daughter of Ubaydullah ibn Umar whose mother was the daughter of Zayd ibn al- Khattab, married the son of Abdullah ibn Umar. He died and had not yet consummated the marriage or specified her bride-price. Her mother wanted the bride-price, and Abdullah ibn Umar said, "She is not entitled to a bride-price. Had she been entitled to a bride-price, we would not have kept it and we would not do her an injustice. "The mother refused to accept that. Zayd ibn Thabit was brought to adjudicate between them and he decided that she had no bride-price, but that she did inherit.

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ نَافِعٍ، أَنَّ ابْنَةَ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، - وَأُمُّهَا بِنْتُ زَيْدِ بْنِ الْخَطَّابِ - كَانَتْ تَحْتَ ابْنٍ لِعَبْدِ اللَّهِ بْنِ عُمَرَ فَمَاتَ وَلَمْ يَدْخُلْ بِهَا وَلَمْ يُسَمِّ لَهَا صَدَاقًا فَابْتَغَتْ أُمُّهَا صَدَاقَهَا فَقَالَ عَبْدُ اللَّهِ بْنُ عُمَرَ لَيْسَ لَهَا صَدَاقٌ وَلَوْ كَانَ لَهَا صَدَاقٌ لَمْ نُمْسِكْهُ وَلَمْ نَظْلِمْهَا ‏.‏ فَأَبَتْ أُمُّهَا أَنْ تَقْبَلَ ذَلِكَ فَجَعَلُوا بَيْنَهُمْ زَيْدَ بْنَ ثَابِتٍ فَقَضَى أَنْ لاَ صَدَاقَ لَهَا وَلَهَا الْمِيرَاثُ ‏.‏

It was narrated that Abu `Abdur-Rahman as-Sulami said:
`Ali (رضي الله عنه )addressed us and said: O people, carry out the hadd punishments on your slaves, both those who have been married and those who have not been married, for a slave woman of the Messenger of Allah (ﷺ) committed zina and the Messenger of Allah (ﷺ) ordered me to carry out the hadd Punishment on her. I went to her and found that she was still bleeding following childbirth, and I was afraid that if I flogged her she would die So I went to the Messenger of Allah (ﷺ) and told him about that, and he said: “You have done well.”
حَدَّثَنَا سُلَيْمَانُ بْنُ دَاوُدَ، أَنْبَأَنَا زَائِدَةُ، عَنِ السُّدِّيِّ، عَنْ سَعْدِ بْنِ عُبَيْدَةَ، عَنْ أَبِي عَبْدِ الرَّحْمَنِ السُّلَمِيِّ، قَالَ خَطَبَنَا عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ قَالَ يَا أَيُّهَا النَّاسُ أَقِيمُوا عَلَى أَرِقَّائِكُمْ الْحُدُودَ مَنْ أُحْصِنَ مِنْهُمْ وَمَنْ لَمْ يُحْصَنْ فَإِنَّ أَمَةً لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ زَنَتْ فَأَمَرَنِي رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنْ أُقِيمَ عَلَيْهَا الْحَدَّ فَأَتَيْتُهَا فَإِذَا هِيَ حَدِيثُ عَهْدٍ بِنِفَاسٍ فَخَشِيتُ إِنْ أَنَا جَلَدْتُهَا أَنْ تَمُوتَ فَأَتَيْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَذَكَرْتُ ذَلِكَ لَهُ فَقَالَ أَحْسَنْتَ‏.‏

Narrated Abu Qilaba:

That he was sitting behind `Umar bin `Abdul `Aziz and the people mentioned and mentioned (about at-Qasama) and they said (various things), and said that the Caliphs had permitted it. `Umar bin `Abdul `Aziz turned towards Abu Qilaba who was behind him and said. "What do you say, O `Abdullah bin Zaid?" or said, "What do you say, O Abu Qilaba?" Abu Qilaba said, "I do not know that killing a person is lawful in Islam except in three cases: a married person committing illegal sexual intercourse, one who has murdered somebody unlawfully, or one who wages war against Allah and His Apostle." 'Anbasa said, "Anas narrated to us such-and-such." Abu Qilaba said, "Anas narrated to me in this concern, saying, some people came to the Prophet and they spoke to him saying, 'The climate of this land does not suit us.' The Prophet said, 'These are camels belonging to us, and they are to be taken out to the pasture. So take them out and drink of their milk and urine.' So they took them and set out and drank of their urine and milk, and having recovered, they attacked the shepherd, killed him and drove away the camels.' Why should there be any delay in punishing them as they murdered (a person) and waged war against Allah and His Apostle and frightened Allah's Apostle ?" Anbasa said, "I testify the uniqueness of Allah!" Abu Qilaba said, "Do you suspect me?" 'Anbasa said, "No, Anas narrated that (Hadith) to us." Then 'Anbasa added, "O the people of such-and-such (country), you will remain in good state as long as Allah keeps this (man) and the like of this (man) amongst you."

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا مُحَمَّدُ بْنُ عَبْدِ اللَّهِ الأَنْصَارِيُّ، حَدَّثَنَا ابْنُ عَوْنٍ، قَالَ حَدَّثَنِي سَلْمَانُ أَبُو رَجَاءٍ، مَوْلَى أَبِي قِلاَبَةَ عَنْ أَبِي قِلاَبَةَ، أَنَّهُ كَانَ جَالِسًا خَلْفَ عُمَرَ بْنِ عَبْدِ الْعَزِيزِ، فَذَكَرُوا وَذَكَرُوا فَقَالُوا وَقَالُوا قَدْ أَقَادَتْ بِهَا الْخُلَفَاءُ، فَالْتَفَتَ إِلَى أَبِي قِلاَبَةَ وَهْوَ خَلْفَ ظَهْرِهِ، فَقَالَ مَا تَقُولُ يَا عَبْدَ اللَّهِ بْنَ زَيْدٍ أَوْ قَالَ مَا تَقُولُ يَا أَبَا قِلاَبَةَ قُلْتُ مَا عَلِمْتُ نَفْسًا حَلَّ قَتْلُهَا فِي الإِسْلاَمِ إِلاَّ رَجُلٌ زَنَى بَعْدَ إِحْصَانٍ، أَوْ قَتَلَ نَفْسًا بِغَيْرِ نَفْسٍ، أَوْ حَارَبَ اللَّهَ وَرَسُولَهُ صلى الله عليه وسلم‏.‏ فَقَالَ عَنْبَسَةُ حَدَّثَنَا أَنَسٌ بِكَذَا وَكَذَا‏.‏ قُلْتُ إِيَّاىَ حَدَّثَ أَنَسٌ قَالَ قَدِمَ قَوْمٌ عَلَى النَّبِيِّ صلى الله عليه وسلم فَكَلَّمُوهُ فَقَالُوا قَدِ اسْتَوْخَمْنَا هَذِهِ الأَرْضَ‏.‏ فَقَالَ ‏"‏ هَذِهِ نَعَمٌ لَنَا تَخْرُجُ، فَاخْرُجُوا فِيهَا، فَاشْرَبُوا مِنْ أَلْبَانِهَا ...

It was narrated from Humaid At-Tawil that he heard Anas say:
"The Messenger of Allah established the bond of brotherhood between (some of) the Quraish and (some of) the Ansar, and he established the bond of brotherhood between Sa'd bin Ar-Rabi' and 'Abdur-Rahman bin 'Awf. Sa'd said to him: 'I have wealth, which I will share equally between you and me. And I have two wives, so look and see which one you like better, and I will divorce her, and when her 'Iddah is over you can marry her.' He said: 'May Allah bless your family and your wealth for you. Show me -i.e., where the market is.' And he did not come back until he brought some ghee, and cottage cheese that he had left over. He said: 'The Messenger of Allah saw traces of yellow perfume on me and he said: 'What is this for?' I said: 'I have married a woman from among the Ansar.' He said: 'Give a Walimah (wedding feast) even if it is with one sheep.'"
أَخْبَرَنَا أَحْمَدُ بْنُ يَحْيَى بْنِ الْوَزِيرِ، قَالَ حَدَّثَنَا سَعِيدُ بْنُ كَثِيرِ بْنِ عُفَيْرٍ، قَالَ أَخْبَرَنِي سُلَيْمَانُ بْنُ بِلاَلٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ حُمَيْدٍ الطَّوِيلِ، عَنْ أَنَسٍ، أَنَّهُ سَمِعَهُ يَقُولُ آخَى رَسُولُ اللَّهِ صلى الله عليه وسلم بَيْنَ قُرَيْشٍ وَالأَنْصَارِ فَآخَى بَيْنَ سَعْدِ بْنِ الرَّبِيعِ وَعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ فَقَالَ لَهُ سَعْدٌ إِنَّ لِي مَالاً فَهُوَ بَيْنِي وَبَيْنَكَ شَطْرَانِ وَلِي امْرَأَتَانِ فَانْظُرْ أَيُّهُمَا أَحَبُّ إِلَيْكَ فَأَنَا أُطَلِّقُهَا فَإِذَا حَلَّتْ فَتَزَوَّجْهَا ‏.‏ قَالَ بَارَكَ اللَّهُ لَكَ فِي أَهْلِكَ وَمَالِكَ دُلُّونِي - أَىْ - عَلَى السُّوقِ ‏.‏ فَلَمْ يَرْجِعْ حَتَّى رَجَعَ بِسَمْنٍ وَأَقِطٍ قَدْ أَفْضَلَهُ ‏.‏ قَالَ وَرَأَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَلَىَّ أَثَرَ صُفْرَةٍ فَقَالَ ‏"‏ مَهْيَمْ ‏"‏ ‏.‏ فَقُلْتُ تَزَوَّجْتُ امْرَأَةً مِنَ الأَنْصَارِ ‏.‏ فَقَالَ ‏ "‏ أَوْلِمْ وَلَوْ بِشَاةٍ ‏"‏ ‏.‏

'Umar b. al-Khattab said:
Do not go to extremes in giving women their dower, for if it represented honour in this world and piety in Gods sight, the one of you most entitled to do so would have been God's Prophet. I am not aware of God’s Messenger marrying any of his wives or giving any of his daughters in marriage for more than twelve uqiyas. Ahmad, Tirmidhi, Abu Dawud, Nasa’i, Ibn Majah and Darimi transmitted it.
عَنْ عُمَرَ بْنِ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ قَالَ: أَلَا لَا تُغَالُوا صَدُقَةَ النِّسَاءِ فَإِنَّهَا لَوْ كَانَتْ مَكْرُمَةً فِي الدُّنْيَا وَتَقْوَى عِنْدَ اللَّهِ لَكَانَ أَوْلَاكُمْ بِهَا نَبِيُّ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَا عَلِمْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَكَحَ شَيْئًا مِنْ نِسَائِهِ وَلَا أَنْكَحَ شَيْئًا مِنْ بَنَاتِهِ عَلَى أَكْثَرَ مِنَ اثْنَتَيْ عَشْرَةَ أُوقِيَّةً. رَوَاهُ أَحْمَدُ وَالتِّرْمِذِيُّ وَأَبُو دَاوُدَ وَالنَّسَائِيُّ وَابْنُ مَاجَهْ وَالدَّارِمِيُّ

Narrated `Abdullah bin `Umar:

I never heard `Umar saying about something that he thought it would be so-and-so, but he was quite right. Once, while `Umar was sitting, a handsome man passed by him, `Umar said, "If I am not wrong, this person is still on his religion of the pre-lslamic period of ignorance or he was their foreteller. Call the man to me." When the man was called to him, he told him of his thought. The man said, "I have never seen such a day on which a Muslim is faced with such an accusation." `Umar said, "I am determined that you should tell me the truth." He said, "I was a foreteller in the pre-lslamic period of ignorance." Then `Umar said, "Tell me the most astonishing thing your female Jinn has told you of." He said, "One-day while I was in the market, she came to me scared and said, 'Haven't you seen the Jinns and their despair and they were overthrown after their defeat (and prevented from listening to the news of the heaven) so that they (stopped going to the sky and) kept following camel-riders (i.e. 'Arabs)?" `Umar said, "He is right." and added, "One day while I was near their idols, there came a man with a calf and slaughtered it as a sacrifice (for the idols). An (unseen) creature shouted at him, and I have never heard harsher than his voice. He was crying, 'O you bold evil-doer! A matter of success! An eloquent man is saying: None has the right to be worshipped except you (O Allah).' On that the people fled, but I said, 'I shall not go away till I know what is behind this.' Then the cry came again: 'O you bold evil-doer! A matter of success! An eloquent man is saying: None has the right to be worshipped except Allah.' I then went away and a few days later it was said, "A prophet has appeared."

حَدَّثَنَا يَحْيَى بْنُ سُلَيْمَانَ، قَالَ حَدَّثَنِي ابْنُ وَهْبٍ، قَالَ حَدَّثَنِي عُمَرُ، أَنَّ سَالِمًا، حَدَّثَهُ عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، قَالَ مَا سَمِعْتُ عُمَرَ، لِشَىْءٍ قَطُّ يَقُولُ إِنِّي لأَظُنُّهُ كَذَا‏.‏ إِلاَّ كَانَ كَمَا يَظُنُّ، بَيْنَمَا عُمَرُ جَالِسٌ إِذْ مَرَّ بِهِ رَجُلٌ جَمِيلٌ فَقَالَ لَقَدْ أَخْطَأَ ظَنِّي، أَوْ إِنَّ هَذَا عَلَى دِينِهِ فِي الْجَاهِلِيَّةِ، أَوْ لَقَدْ كَانَ كَاهِنَهُمْ، عَلَىَّ الرَّجُلَ، فَدُعِيَ لَهُ، فَقَالَ لَهُ ذَلِكَ، فَقَالَ مَا رَأَيْتُ كَالْيَوْمِ اسْتُقْبِلَ بِهِ رَجُلٌ مُسْلِمٌ، قَالَ فَإِنِّي أَعْزِمُ عَلَيْكَ إِلاَّ مَا أَخْبَرْتَنِي‏.‏ قَالَ كُنْتُ كَاهِنَهُمْ فِي الْجَاهِلِيَّةِ‏.‏ قَالَ فَمَا أَعْجَبُ مَا جَاءَتْكَ بِهِ جِنِّيَّتُكَ قَالَ بَيْنَمَا أَنَا يَوْمًا فِي السُّوقِ جَاءَتْنِي أَعْرِفُ فِيهَا الْفَزَعَ، فَقَالَتْ أَلَمْ تَرَ الْجِنَّ وَإِبْلاَسَهَا وَيَأْسَهَا مِنْ بَعْدِ إِنْكَاسِهَا وَلُحُوقَهَا بِالْقِلاَصِ وَأَحْلاَسِهَا قَالَ عُمَرُ صَدَقَ، بَيْنَمَا أَنَا عِنْدَ آلِهَتِهِمْ إِذْ جَاءَ رَجُلٌ بِعِجْلٍ فَذَبَحَهُ ، فَصَرَخَ ...

Narrated Masruq:

We came upon `Abdullah bin Mas`ud and he said "O people! If somebody knows something, he can say it, but if he does not know it, he should say, "Allah knows better,' for it is a sign of having knowledge to say about something which one does not know, 'Allah knows better.' Allah said to His Prophet: 'Say (O Muhammad ! ) No wage do I ask of You for this (Qur'an) nor am I one of the pretenders (a person who pretends things which do not exist).' (38.86) Now I will tell you about Ad- Dukhan (the smoke), Allah's Apostle invited the Quraish to embrace Islam, but they delayed their response. So he said, "O Allah! Help me against them by sending on them seven years of famine similar to the seven years of famine of Joseph." So the famine year overtook them and everything was destroyed till they ate dead animals and skins. People started imagining to see smoke between them and the sky because of severe hunger. Allah said: 'Then watch you for the Day that the sky will bring forth a kind of smoke plainly visible, covering the people. . . This is painful torment.' (44.10-11) (So they invoked Allah) "Our Lord! Remove the punishment from us really we are believers." How can there be an (effectual) reminder for them when an Apostle, explaining things clearly, has already come to them? Then they had turned away from him and said: 'One taught (by a human being), a madman?' 'We shall indeed remove punishment for a while, but truly, you will revert (to disbelief).' (44.12-15) Will the punishment be removed on the Day of Resurrection?" `Abdullah added, "The punishment was removed from them for a while but they reverted to disbelief, so Allah destroyed them on the Day of Badr. Allah said: 'The day We shall seize you with a mighty grasp. We will indeed (then) exact retribution." (44.16)

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا جَرِيرٌ، عَنِ الأَعْمَشِ، عَنْ أَبِي الضُّحَى، عَنْ مَسْرُوقٍ، قَالَ دَخَلْنَا عَلَى عَبْدِ اللَّهِ بْنِ مَسْعُودٍ، قَالَ يَا أَيُّهَا النَّاسُ مَنْ عَلِمَ شَيْئًا فَلْيَقُلْ بِهِ، وَمَنْ لَمْ يَعْلَمْ فَلْيَقُلِ اللَّهُ أَعْلَمُ، فَإِنَّ مِنَ الْعِلْمِ أَنْ يَقُولَ لِمَا لاَ يَعْلَمُ اللَّهُ أَعْلَمُ، قَالَ اللَّهُ عَزَّ وَجَلَّ لِنَبِيِّهِ صلى الله عليه وسلم ‏‏{‏قُلْ مَا أَسْأَلُكُمْ عَلَيْهِ مِنْ أَجْرٍ وَمَا أَنَا مِنَ الْمُتَكَلِّفِينَ‏}‏ وَسَأُحَدِّثُكُمْ عَنِ الدُّخَانِ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم دَعَا قُرَيْشًا إِلَى الإِسْلاَمِ فَأَبْطَئُوا عَلَيْهِ فَقَالَ ‏"‏ اللَّهُمَّ أَعِنِّي عَلَيْهِمْ بِسَبْعٍ كَسَبْعِ يُوسُفَ ‏" ‏، فَأَخَذَتْهُمْ سَنَةٌ فَحَصَّتْ كُلَّ شَىْءٍ حَتَّى أَكَلُوا الْمَيْتَةَ وَالْجُلُودَ حَتَّى جَعَلَ الرَّجُلُ يَرَى بَيْنَهُ وَبَيْنَ السَّمَاءِ دُخَانًا مِنَ الْجُوعِ، قَالَ اللَّهُ عَزَّ وَجَلَّ ‏‏{‏فَارْتَقِبْ يَوْمَ تَأْتِي السَّمَاءُ بِدُخَانٍ مُبِينٍ ...

It was narrated from 'Aishah:
"A girl came to her and said: 'My father married me to his brother's son so that he might raise his own status thereby, and I was unwilling.' She said: 'Sit here until the Prophet comes.' Then the Messenger of Allah came, and I told him (what she had said). He sent word to her father, calling him, and he left the matter up to her. She said: 'O Messenger of Allah, I accept what my father did, but I wanted to know whether women have any say in the matter.'"
أَخْبَرَنَا زِيَادُ بْنُ أَيُّوبَ، قَالَ حَدَّثَنَا عَلِيُّ بْنُ غُرَابٍ، قَالَ حَدَّثَنَا كَهْمَسُ بْنُ الْحَسَنِ، عَنْ عَبْدِ اللَّهِ بْنِ بُرَيْدَةَ، عَنْ عَائِشَةَ، أَنَّ فَتَاةً، دَخَلَتْ عَلَيْهَا فَقَالَتْ إِنَّ أَبِي زَوَّجَنِي ابْنَ أَخِيهِ لِيَرْفَعَ بِي خَسِيسَتَهُ وَأَنَا كَارِهَةٌ ‏.‏ قَالَتِ اجْلِسِي حَتَّى يَأْتِيَ النَّبِيُّ صلى الله عليه وسلم فَجَاءَ رَسُولُ اللَّهِ صلى الله عليه وسلم فَأَخْبَرَتْهُ فَأَرْسَلَ إِلَى أَبِيهَا فَدَعَاهُ فَجَعَلَ الأَمْرَ إِلَيْهَا فَقَالَتْ يَا رَسُولَ اللَّهِ قَدْ أَجَزْتُ مَا صَنَعَ أَبِي وَلَكِنْ أَرَدْتُ أَنْ أَعْلَمَ أَلِلنِّسَاءِ مِنَ الأَمْرِ شَىْءٌ

Narrated Mutarrif ibn Abdullah:

Imran ibn Husayn was asked about a person who divorces his wife, and then has intercourse with her, but he does not call any witness to her divorce nor to her restoration. He said: You divorced against the sunnah and took her back against the sunnah. Call someone to bear witness to her divorce, and to her return in marriage, and do not repeat it.

Narrated Abdullah ibn Abbas:

Divorced women shall wait concerning themselves for three monthly periods. Nor is it lawful for them to hide what Allah hath created in their wombs. This means that if a man divorced his wife he had the right to take her back in marriage though he had divorced her by three pronouncements. This was then repealed (by a Qur'anic verse). Divorce is only permissible twice.

حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدٍ الْمَرْوَزِيُّ، حَدَّثَنِي عَلِيُّ بْنُ حُسَيْنِ بْنِ وَاقِدٍ، عَنْ أَبِيهِ، عَنْ يَزِيدَ النَّحْوِيِّ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ ‏‏{‏ وَالْمُطَلَّقَاتُ يَتَرَبَّصْنَ بِأَنْفُسِهِنَّ ثَلاَثَةَ قُرُوءٍ وَلاَ يَحِلُّ لَهُنَّ أَنْ يَكْتُمْنَ مَا خَلَقَ اللَّهُ فِي أَرْحَامِهِنَّ ‏} الآيَةَ وَذَلِكَ أَنَّ الرَّجُلَ كَانَ إِذَا طَلَّقَ امْرَأَتَهُ فَهُوَ أَحَقُّ بِرَجْعَتِهَا وَإِنْ طَلَّقَهَا ثَلاَثًا فَنُسِخَ ذَلِكَ وَقَالَ ‏‏{‏ الطَّلاَقُ مَرَّتَانِ ‏}‏ ‏.‏

Narrated Abdullah ibn Abbas:

A woman embraced Islam during the time of the Messenger of Allah (saws); she then married. Her (former) husband then came to the Prophet (saws) and said: Messenger of Allah, I have already embraced Islam, and she had the knowledge about my Islam. The Messenger of Allah (saws) took her away from her latter husband and restored her to her former husband.

Anas bin Malik said “Whenever the Apostle of Allaah(saws) went to Quba, he used to visit Umm Haram daughter of Milhan who was married to ‘Ubadah bin Al Samit. One day when he visited her she gave him food an sat clearing his head of lice. The narrator narrated the rest of the tradition.

Abu Dawud said “Daughter of Milhan died in Cyprus”.

Jabir said that a man committed fornication with a woman and the Prophet gave command that he be given the appropriate beating, but on being told afterwards that the man was married he gave command that he should be stoned to death. Abu Dawud transmitted it.
وَعَنْ جَابِرٍ: أَنَّ رَجُلًا زَنَى بِامْرَأَةٍ فَأَمَرَ بِهِ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَجُلِدَ الْحَدَّ ثُمَّ أُخْبِرَ أَنَّهُ مُحْصَنٌ فَأَمَرَ بِهِ فرجم. رَوَاهُ أَبُو دَاوُد

Abu Rafi‘ said:
God’s messenger married Maimuna when he was not in the sacred state and cohabited with her when he was not in the sacred state, and I was the messenger between them. Ahmad and Tirmidhi transmitted it, the latter saying that this is a hasan tradition.
قَالَ: تَزَوَّجَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ مَيْمُونَةَ وَهُوَ حَلَالٌ وَبَنَى بِهَا وَهُوَ حَلَالٌ وَكُنْتُ أَنَا الرَّسُولَ بَيْنَهُمَا. رَوَاهُ أَحْمَدُ وَالتِّرْمِذِيُّ وَقَالَ: هَذَا حَدِيثٌ حَسَنٌ

Narrated Abu Huraira:

Allah's Apostle sent out ten spies under the command of `Asim bin Thabit Al-Ansari, the grand-father of `Asim bin `Umar Al-Khattab. When they reached (a place called) Al-Hadah between 'Usfan and Mecca, their presence was made known to a sub-tribe of Hudhail called Banu Lihyan. So they sent about one hundred archers after them. The archers traced the footsteps (of the Muslims) till they found the traces of dates which they had eaten at one of their camping places. The archers said, "These dates are of Yathrib (i.e. Medina)," and went on tracing the Muslims' footsteps. When `Asim and his companions became aware of them, they took refuge in a (high) place. But the enemy encircled them and said, "Come down and surrender. We give you a solemn promise and covenant that we will not kill anyone of you." `Asim bin Thabit said, "O people! As for myself, I will never get down to be under the protection of an infidel. O Allah! Inform your Prophet about us." So the archers threw their arrows at them and martyred `Asim. Three of them came down and surrendered to them, accepting their promise and covenant and they were Khubaib, Zaid bin Ad-Dathina and another man. When the archers got hold of them, they untied the strings of the arrow bows and tied their captives with them. The third man said, "This is the first proof of treachery! By Allah, I will not go with you for I follow the example of these." He meant the martyred companions. The archers dragged him and struggled with him (till they martyred him). Then Khubaib and Zaid bin Ad-Dathina were taken away by them and later on they sold them as slaves in Mecca after the event of the Badr battle. The sons of Al-Harit bin `Amr bin Naufal bought Khubaib for he was a person who had killed (their father) Al-Hari bin `Amr on the day (of the battle) of Badr. Khubaib remained imprisoned by them till they decided unanimously to kill him. One day Khubaib borrowed from a daughter of Al-Harith, a razor for shaving his pubic hair, and she lent it to him. By chance, while she was inattentive, a little son of hers went to him (i.e. Khubaib) and she saw that Khubaib had seated him on his thigh while the razor was in his hand. She was so much terrified that Khubaib noticed her fear and said, "Are you afraid that I will kill him? Never would I do such a thing." Later on (while narrating the story) she said, "By Allah, I had never seen a better captive than Khubaib. By Allah, one day I saw him eating from a bunch of grapes in his hand while he was fettered with iron chains and (at that time) there was no fruit in Mecca." She used to say," It was food Allah had provided Khubaib with." When they took him to Al-Hil out of Mecca sanctuary to martyr him, Khubaib requested them. "Allow me to offer a two-rak`at prayer." They allowed him and he prayed two rak`at and then said, "By Allah! Had I not been afraid that you would think I was worried, I would have prayed more." Then he (invoked evil upon them) saying, "O Allah! Count them and kill them one by one, and do not leave anyone of them"' Then he recited: "As I am martyred as a Muslim, I do not care in what way I receive my death for Allah's Sake, for this is for the Cause of Allah. If He wishes, He will bless the cut limbs of my body." Then Abu Sarva, 'Ubqa bin Al-Harith went up to him and killed him. It was Khubaib who set the tradition of praying for any Muslim to be martyred in captivity (before he is executed). The Prophet told his companions of what had happened (to those ten spies) on the same day they were martyred. Some Quraish people, being informed of `Asim bin Thabit's death, sent some messengers to bring a part of his body so that his death might be known for certain, for he had previously killed one of their leaders (in the battle of Badr). But Allah sent a swarm of wasps to protect the dead body of `Asim, and they shielded him from the messengers who could not cut anything from his body.

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا إِبْرَاهِيمُ، أَخْبَرَنَا ابْنُ شِهَابٍ، قَالَ أَخْبَرَنِي عُمَرُ بْنُ أَسِيدِ بْنِ جَارِيَةَ الثَّقَفِيُّ، حَلِيفُ بَنِي زُهْرَةَ ـ وَكَانَ مِنْ أَصْحَابِ أَبِي هُرَيْرَةَ ـ عَنْ أَبِي هُرَيْرَةَ ـ رضى الله عنه ـ قَالَ بَعَثَ رَسُولُ اللَّهِ صلى الله عليه وسلم عَشَرَةً عَيْنًا، وَأَمَّرَ عَلَيْهِمْ عَاصِمَ بْنَ ثَابِتٍ الأَنْصَارِيَّ، جَدَّ عَاصِمِ بْنِ عُمَرَ بْنِ الْخَطَّابِ، حَتَّى إِذَا كَانُوا بِالْهَدَةِ بَيْنَ عُسْفَانَ وَمَكَّةَ ذُكِرُوا لِحَىٍّ مِنْ هُذَيْلٍ يُقَالُ لَهُمْ بَنُو لِحْيَانَ، فَنَفَرُوا لَهُمْ بِقَرِيبٍ مِنْ مِائَةِ رَجُلٍ رَامٍ، فَاقْتَصُّوا آثَارَهُمْ حَتَّى وَجَدُوا مَأْكَلَهُمُ التَّمْرَ فِي مَنْزِلٍ نَزَلُوهُ فَقَالُوا تَمْرُ يَثْرِبَ‏.‏ فَاتَّبَعُوا آثَارَهُمْ، فَلَمَّا حَسَّ بِهِمْ عَاصِمٌ وَأَصْحَابُهُ لَجَئُوا إِلَى مَوْضِعٍ، فَأَحَاطَ بِهِمُ الْقَوْمُ، فَقَالُوا لَهُمْ انْزِلُوا فَأَعْطُوا بِأَيْدِيكُمْ وَلَكُمُ الْعَهْدُ وَالْمِيثَاقُ أَنْ لاَ نَقْتُلَ مِنْكُمْ أَحَدًا‏.‏ فَقَالَ عَاصِمُ بْنُ ثَابِتٍ أَيُّهَا الْقَوْمُ، أَمَّا أَنَا فَلاَ أَنْزِلُ ...

It was narrated that:
Mughirah bin Shubah said: “I came to the Prophet and told him of a woman to whom I had to propose marriage. He said: 'Go and look at her, for that is more likely to create love between you.' So I went to a woman among the Ansar and proposed marriage through her parents. I told them what the Prophet had said, and it was as if they did not like that. Then I heard that woman, behind her curtain, say: 'If the Messenger of Allah has told you to do that, then do it, otherwise I adjure you by Allah (not to do so)'. And it was as if she regarded that as a serious matter. So I looked at her and married her.” And he mentioned how well he got along with her.
حَدَّثَنَا الْحَسَنُ بْنُ أَبِي الرَّبِيعِ، أَنْبَأَنَا عَبْدُ الرَّزَّاقِ، عَنْ مَعْمَرٍ، عَنْ ثَابِتٍ الْبُنَانِيِّ، عَنْ بَكْرِ بْنِ عَبْدِ اللَّهِ الْمُزَنِيِّ، عَنِ الْمُغِيرَةِ بْنِ شُعْبَةَ، قَالَ أَتَيْتُ النَّبِيَّ ـ صلى الله عليه وسلم ـ فَذَكَرْتُ لَهُ امْرَأَةً أَخْطُبُهَا فَقَالَ ‏ "‏ اذْهَبْ فَانْظُرْ إِلَيْهَا فَإِنَّهُ أَجْدَرُ أَنْ يُؤْدَمَ بَيْنَكُمَا ‏"‏ ‏.‏ فَأَتَيْتُ امْرَأَةً مِنَ الأَنْصَارِ فَخَطَبْتُهَا إِلَى أَبَوَيْهَا وَأَخْبَرْتُهُمَا بِقَوْلِ النَّبِيِّ ـ صلى الله عليه وسلم ـ ‏.‏ فَكَأَنَّهُمَا كَرِهَا ذَلِكَ ‏.‏ قَالَ فَسَمِعَتْ ذَلِكَ الْمَرْأَةُ وَهِيَ فِي خِدْرِهَا فَقَالَتْ إِنْ كَانَ رَسُولُ اللَّهِ ـ صلى الله عليه وسلم ـ أَمَرَكَ أَنْ تَنْظُرَ فَانْظُرْ ‏.‏ وَإِلاَّ فَإِنِّي أَنْشُدُكَ كَأَنَّهَا أَعْظَمَتْ ذَلِكَ ‏.‏ قَالَ فَنَظَرْتُ إِلَيْهَا فَتَزَوَّجْتُهَا ‏.‏ فَذَكَرَ مِنْ مُوَافَقَتِهَا ‏.‏
