Takhrīj: Musnad Aḥmad, vol. 3, p. 99; Risāla ed. no. 11957. Recorded by al-Bukhārī, Ṣaḥīḥ, Kitāb al-Nikāḥ, no. 5086, and by Muslim, Ṣaḥīḥ, Kitāb al-Nikāḥ, no. 1365, both from Anas ibn Mālik. Ṣafiyyah bint Ḥuyayy ibn Akhṭab, of Banū al-Naḍīr, was taken captive at Khaybar in 7 AH; the Prophet ﷺ freed her and married her, her freedom itself standing in place of the dower. The report is the principal basis for the position of Aḥmad and Isḥāq that a man may manumit his slave woman and make that manumission her ṣadāq, while the majority of the jurists hold that a separate dower must be named. While this one form of slavery existed historically, it undoubtedly does not apply nor is permitted in the world today as Islamic law was revealed to gradually remove the structure that existed.
