Narrated Ibn Juraij:

`Ata' said, "Jabir bin `Abdullah said, 'The Prophet went out on the Day of `Id-ul-Fitr and offered the prayer before delivering the Khutba, Ata told me that during the early days of Ibn Az-Zubair, Ibn `Abbas had sent a message to him telling him that the Adhan for the `Id Prayer was never pronounced (in the life time of Allah's Apostle) and the Khutba used to be delivered after the prayer. Ata told me that Ibn `Abbas and Jabir bin `Abdullah, had said, "There was no Adhan for the prayer of `Id-ul-Fitr and `Id-ul-Aqha." `Ata' said, "I heard Jabir bin `Abdullah saying, 'The Prophet stood up and started with the prayer, and after it he delivered the Khutba. When the Prophet of Allah (p.b.u.h) finished (the Khutba), he went to the women and preached to them, while he was leaning on Bilal's hand. Bilal was spreading his garment and the ladies were putting alms in it.' " I said to Ata, "Do you think it incumbent upon an Imam to go to the women and preach to them after finishing the prayer and Khutba?" `Ata' said, "No doubt it is incumbent on Imams to do so, and why should they not do so?"

It was narrated fom 'Ata from Ibn 'Umair, from Aishah, that:
The Prophet (SAW) prayed, bowing six times and prostrating four times. "I said to Mu'adh: 'Is this from the Prophet (SAW)?' He said: 'Without a doubt.'"

Sufyan narrated from Ibn Juraij, from 'Ata', from Jabir that the Messenger of Allah said:
"Do not give things on the basis of Ruqba or 'Umra. Whoever is given something on the basis of Ruqba or 'Umra, it belongs to his heirs."

Yahya related to me from Malik from Zayd ibn Aslam from Abd ar- Rahman ibn Abi Said al-Khudri from his father that the Messenger of Allah, may Allah bless him and grant him peace, said, "Do not let anyone pass in front of you when you are praying. Repel him as much as you can, and, if he refuses, fight him, for he is only a shaytan."

Yahya related to me from Malik that Abu'z-Zinad heard Sa'id ibn al-Musayyab andSulayman ibn Yasar forbid a man to sell wheat for gold on delayed terms and then to buy dried dates with the gold before he had taken delivery of the gold.

Ibn Juraij reported:

I asked 'Ata': What do you recite when you are in a state of bowing (in prayer)? He said:" Hallowed be Thou, and with Thy praise, there is no god but Thou." Son of Abd Mulaika narrated to me on the anthority of 'A'isha (who reported): I missed one night the Apostle of Allah (may peace be upon him) (from his bed). I thought that he might have gone to one of his other wives. I searched for him and then came back and (found him) in a state of bowing, or prostration, saying: Hallowed be Thou and with Thy praise; there is no god but Thou. I said: With my father mayest thou be ransomed and with my mother. I was thinking of (another) affair, whereas you are (occupied) in another one.
وَحَدَّثَنِي حَسَنُ بْنُ عَلِيٍّ الْحُلْوَانِيُّ، وَمُحَمَّدُ بْنُ رَافِعٍ، قَالاَ حَدَّثَنَا عَبْدُ الرَّزَّاقِ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، قَالَ قُلْتُ لِعَطَاءٍ كَيْفَ تَقُولُ أَنْتَ فِي الرُّكُوعِ قَالَ أَمَّا سُبْحَانَكَ وَبِحَمْدِكَ لاَ إِلَهَ إِلاَّ أَنْتَ فَأَخْبَرَنِي ابْنُ أَبِي مُلَيْكَةَ عَنْ عَائِشَةَ قَالَتِ افْتَقَدْتُ النَّبِيَّ صلى الله عليه وسلم ذَاتَ لَيْلَةٍ فَظَنَنْتُ أَنَّهُ ذَهَبَ إِلَى بَعْضِ نِسَائِهِ فَتَحَسَّسْتُ ثُمَّ رَجَعْتُ فَإِذَا هُوَ رَاكِعٌ أَوْ سَاجِدٌ يَقُولُ ‏"‏ سُبْحَانَكَ وَبِحَمْدِكَ لاَ إِلَهَ إِلاَّ أَنْتَ ‏"‏ ‏.‏ فَقُلْتُ بِأَبِي أَنْتَ وَأُمِّي إِنِّي لَفِي شَأْنٍ وَإِنَّكَ لَفِي آخَرَ ‏.‏

Yahya related to me from Malik from Ibn Shihab from Ata ibn Yazid al-Laythi from Abu Ayyub al-Ansari that the Messenger of Allah, may Allah bless him and grant him peace, said, "It is not halal for a muslim to shun his brother for more than three nights, that is they meet, and this one turns away and that one turns away. The better of the two is the one who says the greeting first."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عَطَاءِ بْنِ يَزِيدَ اللَّيْثِيِّ، عَنْ أَبِي أَيُّوبَ الأَنْصَارِيِّ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ لاَ يَحِلُّ لِمُسْلِمٍ أَنْ يُهَاجِرَ أَخَاهُ فَوْقَ ثَلاَثِ لَيَالٍ يَلْتَقِيَانِ فَيُعْرِضُ هَذَا وَيُعْرِضُ هَذَا وَخَيْرُهُمَا الَّذِي يَبْدَأُ بِالسَّلاَمِ ‏"‏ ‏.‏

Malik related to me from Yahya ibn Said that Sulayman ibn Yasar informed him that Abdullah ibn Abbas ibn Abi Rabia al-Makhzumi said, "Umar ibn al-Khattab gave me orders about the slaves of Quraysh and we flogged some of the slave-girls of the muslim lands fifty times each for fornication."

Abdullah b. Ja'a'far reported that when Allah's Messenger (may peace be upon him) came back from a journey he met us. Once he met me, Hasan or Husain, and he mounted one of us before him and the other one behind him until we entered Medina.

Narrated Qurra bin Khalid:

Once he waited for Al-Hasan and he did not show up till it was about the usual time for him to start his speech; then he came and apologized saying, "Our neighbors invited us." Then he added, "Narrated Anas, 'Once we waited for the Prophet till it was midnight or about midnight. He came and led the prayer, and after finishing it, he addressed us and said, 'All the people prayed and then slept and you had been in prayer as long as you were waiting for it." Al-Hasan said, "The people are regarded as performing good deeds as long as they are waiting for doing good deeds." Al-Hasan's statement is a portion of Anas's [??] Hadith from the Prophet .

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الصَّبَّاحِ، قَالَ حَدَّثَنَا أَبُو عَلِيٍّ الْحَنَفِيُّ، حَدَّثَنَا قُرَّةُ بْنُ خَالِدٍ، قَالَ انْتَظَرْنَا الْحَسَنَ وَرَاثَ عَلَيْنَا حَتَّى قَرُبْنَا مِنْ وَقْتِ قِيَامِهِ، فَجَاءَ فَقَالَ دَعَانَا جِيرَانُنَا هَؤُلاَءِ‏.‏ ثُمَّ قَالَ قَالَ أَنَسٌ نَظَرْنَا النَّبِيَّ صلى الله عليه وسلم ذَاتَ لَيْلَةٍ حَتَّى كَانَ شَطْرُ اللَّيْلِ يَبْلُغُهُ، فَجَاءَ فَصَلَّى لَنَا، ثُمَّ خَطَبَنَا فَقَالَ ‏"‏ أَلاَ إِنَّ النَّاسَ قَدْ صَلَّوْا ثُمَّ رَقَدُوا، وَإِنَّكُمْ لَمْ تَزَالُوا فِي صَلاَةٍ مَا انْتَظَرْتُمُ الصَّلاَةَ ‏" ‏‏.‏ قَالَ الْحَسَنُ وَإِنَّ الْقَوْمَ لاَ يَزَالُونَ بِخَيْرٍ مَا انْتَظَرُوا الْخَيْرَ‏.‏ قَالَ قُرَّةُ هُوَ مِنْ حَدِيثِ أَنَسٍ عَنِ النَّبِيِّ صلى الله عليه وسلم‏.‏

Yahya related to me from Malik from Yahya ibn Said from Sulayman ibn Yasar that Muhammad ibn al-Ashath told him that he had a christian or jewish paternal aunt who died. Muhammad ibn al-Ashath mentioned that to Umar ibn al-Khattab and said to him, "Who inherits from her?" Umar ibn al-Khattab said to him, "The people of her deen inherit from her." Then he went to Uthman ibn Affan, and asked him about that. Uthman said to him, "Do you think that I have forgotten what Umar ibn al-Khattab said to you? The people.of her deen inherit from her."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ مُحَمَّدَ بْنَ الأَشْعَثِ، أَخْبَرَهُ أَنَّ عَمَّةً لَهُ يَهُودِيَّةً أَوْ نَصْرَانِيَّةً تُوُفِّيَتْ وَأَنَّ مُحَمَّدَ بْنَ الأَشْعَثِ ذَكَرَ ذَلِكَ لِعُمَرَ بْنِ الْخَطَّابِ وَقَالَ لَهُ مَنْ يَرِثُهَا فَقَالَ لَهُ عُمَرُ بْنُ الْخَطَّابِ يَرِثُهَا أَهْلُ دِينِهَا ‏.‏ ثُمَّ أَتَى عُثْمَانَ بْنَ عَفَّانَ فَسَأَلَهُ عَنْ ذَلِكَ فَقَالَ لَهُ عُثْمَانُ أَتَرَانِي نَسِيتُ مَا قَالَ لَكَ عُمَرُ بْنُ الْخَطَّابِ يَرِثُهَا أَهْلُ دِينِهَا ‏.‏

I ordered Muslim b. Yasar, the freed slave of Nafi' b. 'Abd al-Harith, while I was sitting between them, that he should ask Ibn 'Umar if he had heard anything from Allah's Messenger (may peace be upon him) pertaining to one who trails his lower garment out of pride. He said: I heard him (the Holy Prophet) as saying: Allah will not look toward him on the Day of Resurrection.

Narrated Ibn Juraij:

`Ata' said, "I heard Jabir bin `Abdullah saying, 'We never ate the meat of the Budn for more than three days of Mina. Later, the Prophet gave us permission by saying: 'Eat and take (meat) with you. So we ate (some) and took (some) with us.' " I asked `Ata', "Did Jabir say (that they went on eating the meat) till they reached Medina?" `Ata' replied, "No."

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا يَحْيَى، عَنِ ابْنِ جُرَيْجٍ، حَدَّثَنَا عَطَاءٌ، سَمِعَ جَابِرَ بْنَ عَبْدِ اللَّهِ ـ رضى الله عنهما ـ يَقُولُ كُنَّا لاَ نَأْكُلُ مِنْ لُحُومِ بُدْنِنَا فَوْقَ ثَلاَثِ مِنًى، فَرَخَّصَ لَنَا النَّبِيُّ صلى الله عليه وسلم فَقَالَ ‏"‏ كُلُوا وَتَزَوَّدُوا ‏"‏‏.‏ فَأَكَلْنَا وَتَزَوَّدْنَا‏.‏ قُلْتُ لِعَطَاءٍ أَقَالَ حَتَّى جِئْنَا الْمَدِينَةَ قَالَ لاَ‏.‏

Malik narrated from Ibn Shihab, from Abu Salamah, from Jabir that the Messenger of Allah said:
"Any man who is given a gift on the basis of 'Umra, it belongs to him and to his descendants. It belongs to the one to whom he gave it, and it cannot be taken back by the one who gave it, because he has given a gift, and it comes to the heirs of the one to whom it was given."
أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، وَالْحَارِثُ بْنُ مِسْكِينٍ، قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ، عَنِ ابْنِ الْقَاسِمِ، عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي سَلَمَةَ، عَنْ جَابِرٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَيُّمَا رَجُلٍ أُعْمِرَ عُمْرَى لَهُ وَلِعَقِبِهِ فَإِنَّهَا لِلَّذِي يُعْطَاهَا لاَ تَرْجِعُ إِلَى الَّذِي أَعْطَاهَا لأَنَّهُ أَعْطَى عَطَاءً وَقَعَتْ فِيهِ الْمَوَارِيثُ ‏"‏ ‏.‏

Ata b. Yasar said that Abu Sa'id reported God’s Messenger as saying, “When one of you is in doubt aoout his prayer and does not know how much he has prayed, three or four rak'as, he should subtract what he is doubtful about and base his prayer on what he is sure of, then perform two prostrations before giving the salutation. If he has prayed five rak'as they will make his prayer an even number for him, and if he has prayed exactly four they will be a humbling for the devil.” Muslim transmitted it, and Malik transmitted it fromAta’ in mursal form. In his version it says, “he will make it an even number by these two prostrations.”
وَعَن عَطاء بن يسَار وَعَنْ أَبِي سَعِيدٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِذَا شَكَّ أَحَدُكُمْ فِي صَلَاتِهِ فَلَمْ يَدْرِ كَمْ صَلَّى ثَلَاثًا أم أَرْبعا فليطرح الشَّك وليبن عَلَى مَا اسْتَيْقَنَ ثُمَّ يَسْجُدْ سَجْدَتَيْنِ قَبْلَ أَنْ يُسَلِّمَ فَإِنْ كَانَ صَلَّى خَمْسًا شَفَعْنَ لَهُ صَلَاتَهُ وَإِنْ كَانَ صَلَّى إِتْمَامًا لِأَرْبَعٍ كَانَتَا تَرْغِيمًا لِلشَّيْطَانِ» . رَوَاهُ مُسْلِمٌ وَرَوَاهُ مَالِكٌ عَنْ عَطَاءٍ مُرْسَلًا. وَفِي رِوَايَتِهِ: «شَفَعَهَا بِهَاتَيْنِ السَّجْدَتَيْنِ»

Asma’ daughter of ‘Umais said she told God’s messenger that Fatima daughter of Abu Hubaish had had a flow of blood for a certain period and had not prayed. God’s messenger said, “Glory be to God! This comes from the devil. She should sit in a tub, and when she sees yellowness appearing on the top of the water she should wash once for the noon and afternoon prayer, once for the sunset and night prayer, once for the dawn prayer, and in between times she should perform ablution.” Abu Dawud transmitted it, saying Mujahid transmitted from Ibn ‘Abbas that when the washing became too much for her be ordered her to combine the two prayers.
عَن أَسمَاء بنت عُمَيْس قَالَتْ: قُلْتُ يَا رَسُولَ اللَّهِ إِنَّ فَاطِمَةَ بِنْتَ أَبِي حُبَيْشٍ اسْتُحِيضَتْ مُنْذُ كَذَا وَكَذَا فَلَمْ تُصَلِّ فَقَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «سُبْحَانَ اللَّهِ إِنَّ هَذَا مِنَ الشَّيْطَانِ لِتَجْلِسَ فِي مِرْكَنٍ فَإِذَا رَأَتْ صُفَارَةً فَوْقَ الْمَاءِ فَلْتَغْتَسِلْ لِلظُّهْرِ وَالْعَصْرِ غُسْلًا وَاحِدًا وَتَغْتَسِلْ لِلْمَغْرِبِ وَالْعِشَاءِ غُسْلًا وَاحِدًا وَتَغْتَسِلْ لِلْفَجْرِ غُسْلًا وَاحِدًا وَتَوَضَّأُ فِيمَا بَيْنَ ذَلِكَ» . رَوَاهُ أَبُو دَاوُد وَقَالَ:

رَوَى مُجَاهِدٌ عَنِ ابْنِ عَبَّاسٍ: لَمَّا اشْتَدَّ عَلَيْهَا الْغُسْلُ أَمَرَهَا أَنْ تَجْمَعَ بَيْنَ الصَّلَاتَيْنِ

Muslim bin Yasar and 'Abdullah bin 'Ubaid said:
"Ubadah bin As-Samit and Muawiyah met at a stopping place on the road. 'Ubadah said: 'The Messenger of Allah forbade us to sell gold for gold, silver for silver, wheat for wheat, barley for barley, dates for dates"' - one of them said: "salt for salt, " but the other did not say "unless it was equal amount for equal amount, like for like." One of them said: "Whoever gives more or takes more has engaged in Riba," but the other one did not say it. "And the commanded us to sell gold for silver and silver for gold, and wheat for barley and barley for wheat, hand to hand, however we wanted.' News of this hadith reached Muawiyah and he stood up and said: 'What is the matter with men who narrate Hadiths from the Messenger of Allah when we accompanied him and we never heard him say it? News of that reached 'Ubadah bin As-Samit and he stood up and repeated the Hadith, then he said: 'We will narrate what we heard from the Messenger of Allah, whether Muawiyah likes it or not."' Qatadah contradicted him, he reported it from Muslim bin Yasar, from Abu Al-=Ashath, from 'Ubadah.

Ibn Juraij narrated from 'Ata':
"Habib bin Abi Thabit informed us from Ibn 'Umar, that the Messenger of Allah said: 'There is no 'Umra and no Ruqba. Whoever is given something on the basis of 'Umra or Ruqba, it belongs to him for the rest of his life and after he dies.'"

Yahya related to me from Malik from Zayd ibn Aslam from Ata ibn Yasar that Abdullah ibn Abbas said, "There was an eclipse of the sun and the Messenger of Allah, may Allah bless him and grant him peace, prayed, and the people prayed with him. He stood for a long time, nearly as long as (it takes to recite) Surat al-Baqara (Sura 2), and then went into ruku for a long time. Then he rose and stood for a long time, though less than the first time.Then he went into ruku for a long time, though less than the first time. Then he went down into sajda. Then he stood for a long time, though less than the first time. Then he went into ruku for a long time, though less than the first time. Then he rose and stood for a long time, though less than the firsttime. Then he went into ruku for a long time, though less than the first time. Then he went down into sajda, and by the time he had finished the sun had appeared. Then he said, 'The sun and the moon are two of Allah's signs. They do not eclipse for anyone's death nor for anyone's life. When you see an eclipse, remember Allah.' They said, 'Messenger of Allah, we saw you reach out for something while you were standing here and then we saw you withdraw.' He said, 'I saw the Garden and I reached out for a bunch of grapes from it, and if I had taken it you would have been able to eat from it for as long as this world lasted. Then I saw the Fire - and I have never seen anything more hideous than what I saw today - and I saw that most of its people were women.' They said, 'Why, Messenger of Allah?' He said, 'Because of their ungratefulness (kufr).' Someone said, 'Are they ungrateful toAllah?' He said, 'They are ungrateful to their husbands and they are ungrateful for good behaviour (towards them) . Even if you were to behave well towards one of them for a whole lifetime and then she were to see you do something (that she did not like) she would say that she had never seen anything good from you.' "

Narrated Salama bin Al-Akwa`:

Once I went (from Medina) towards (Al-Ghaba) before the first Adhan of the Fajr Prayer. The shecamels of Allah's Apostle used to graze at a place called Dhi-Qarad. A slave of `Abdur-Rahman bin `Auf met me (on the way) and said, "The she-camels of Allah's Apostle had been taken away by force." I asked, "Who had taken them?" He replied "(The people of) Ghatafan." I made three loud cries (to the people of Medina) saying, "O Sabahah!" I made the people between the two mountains of Medina hear me. Then I rushed onward and caught up with the robbers while they were watering the camels. I started throwing arrows at them as I was a good archer and I was saying, "I am the son of Al-Akwa`, and today will perish the wicked people." I kept on saying like that till I restored the shecamels (of the Prophet), I also snatched thirty Burda (i.e. garments) from them. Then the Prophet and the other people came there, and I said, "O Allah's Prophet! I have stopped the people (of Ghatafan) from taking water and they are thirsty now. So send (some people) after them now." On that the Prophet said, "O the son of Al-Akwa`! You have over-powered them, so forgive them." Then we all came back and Allah's Apostle seated me behind him on his she-camel till we entered Medina.

Once the Prophet offered the `Asr prayer and then hurriedly went to his house and returned immediately. I (or somebody else) asked him (as to what was the matter) and he said, "I left at home a piece of gold which was from the charity and I disliked to let it remain a night in my house, so I got it distributed . "

'Ata' reported from Ibn Abbas (Allah be pleased with them):

Allah's Messenger (may peace be upon him) sent me from Muzdalifa along with his luggage (in the very early part of @he dawn). I (Ibn Juraij, one of the narrators) said (to 'Ati'): Has this (news) reached you that Ibn 'Abbas (Allah be pleased with them) had said:" He (Allah's Messenger) had sent me in the latter part of the night"? Thereupon he said: No, it was the dawn. I (again) said to him: (Did you hear) Ibn 'Abbas (Allah be pleased with them) having said this (too):" We stoned al-Jamra before the dawn prayer"? So where did he observe the dawn prayer? He said: No. But he said only so much (as described above).
وَحَدَّثَنَا عَبْدُ بْنُ حُمَيْدٍ، أَخْبَرَنَا مُحَمَّدُ بْنُ بَكْرٍ، أَخْبَرَنَا ابْنُ جُرَيْجٍ، أَخْبَرَنِي عَطَاءٌ، أَنَّ ابْنَ عَبَّاسٍ، قَالَ بَعَثَ بِي رَسُولُ اللَّهِ صلى الله عليه وسلم بِسَحَرٍ مِنْ جَمْعٍ فِي ثَقَلِ نَبِيِّ اللَّهِ صلى الله عليه وسلم ‏.‏ قُلْتُ أَبَلَغَكَ أَنَّ ابْنَ عَبَّاسٍ قَالَ بَعَثَ بِي بِلَيْلٍ طَوِيلٍ قَالَ لاَ إِلاَّ كَذَلِكَ بِسَحَرٍ ‏.‏ قُلْتُ لَهُ فَقَالَ ابْنُ عَبَّاسٍ رَمَيْنَا الْجَمْرَةَ قَبْلَ الْفَجْرِ ‏.‏ وَأَيْنَ صَلَّى الْفَجْرَ قَالَ لاَ إِلاَّ كَذَلِكَ ‏.‏

Abdullah bin `Ata, the son of Ibraheem the freed slave of azZubair narrated that his mother and his grandmother Umm ‘Ata said:
By Allah, it is as if we can see az-Zubair bin al-`Awwam (رضي الله عنه) when he came to us on a white mule of his and said: “O Umm ‘Ata, the Messenger of Allah (ﷺ) has forbidden the Muslims to eat from the meat of their sacrifices after three days.” I said: “May my father be sacrificed for you! What should we do with that which has been given to us?” He said: “As for what has been given to you, it is up to you.”
حَدَّثَنَا يَعْقُوبُ، حَدَّثَنَا أَبِي، عَنْ مُحَمَّدِ بْنِ إِسْحَاقَ، حَدَّثَنِي عَبْدُ اللَّهِ بْنُ عَطَاءِ بْنِ إِبْرَاهِيمَ، مَوْلَى الزُّبَيْرِ عَنْ أُمِّهِ، وَجَدَّتِهِ أُمِّ عَطَاءٍ، قَالَتَا وَاللَّهِ لَكَأَنَّنَا نَنْظُرُ إِلَى الزُّبَيْرِ بْنِ الْعَوَّامِ رَضِيَ اللَّهُ عَنْهُ حِينَ أَتَانَا عَلَى بَغْلَةٍ لَهُ بَيْضَاءَ فَقَالَ يَا أُمَّ عَطَاءٍ إِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَدْ نَهَى الْمُسْلِمِينَ أَنْ يَأْكُلُوا مِنْ لُحُومِ نُسُكِهِمْ فَوْقَ ثَلَاثٍ قَالَ فَقُلْتُ بِأَبِي أَنْتَ فَكَيْفَ نَصْنَعُ بِمَا أُهْدِيَ لَنَا فَقَالَ أَمَّا مَا أُهْدِيَ لَكُنَّ فَشَأْنَكُنَّ بِهِ‏.‏

It was narrated that Ibn Juraij said:
"I said to 'Ata': 'What is the best time you think I should pray Al-'Atamah, either in congregation or on my own?' He said: 'I heard Ibn 'Abbas say: "The Messenger of Allah (PBUH) delayed Al-'Atamah one night until the people had slept and woken up, then slept and woken up again. Then 'Umar got up and said: 'The prayer, the prayer!'" 'Ata' said: 'Ibn 'Abbas said: "The Messenger of Allah (PBUH) came out, and it is as if I can see him now, with water dripping from his head, putting his hand on the side of his head. [He said: "And he indicated (how)"].'" I checked with 'Ata' how the Prophet (PBUH) put his hand on his head, and he showed me the same way as Ibn 'Abbas had done. 'Ata' spread his fingers a little, then placed them with the tips of his fingers on his forehead, then he drew his fingers together on his head until his thumb touched the edge of the ear that is next to the face, then moved it to his temple and forehead, then he said: 'Were it not that I would impose too much difficulty for my Ummah, I would have commanded them to offer this prayer only at this time.'"

Yahya related to me from Malik from Ibn Shihab from Ata ibn Yazid al-Laythi that Ubaydullah ibn Adi ibnal-Khiyar said, "Once when the Messenger of Allah, may Allah bless him and grant him peace, was sitting with some people, a man came to him and spoke secretly to him. Nobody knew what he had said until the Messenger of Allah, may Allah bless him and grant him peace, disclosed that he had asked for permission to kill one of the hypocrites. When he disclosed this, the Messenger of Allah, may Allah bless him and grant him peace, said, 'Doesn't he testify that there is no god but Allah and that Muhammad is the Messenger of Allah?' The man replied, 'Of course, but he hasn't really done so.' He said, 'Doesn't he do the prayer?' and the man replied, 'Of course, but he doesn't really do the prayer.' He said, may Allah bless him and grant him peace, 'Those are the ones whom Allah has forbidden me (to kill).' "

Narrated Al-Hasan:
from Ma'qil bin Yasar that he married his sister to a man among the Muslims during the time of the Messenger of Allah (SAW). She remained with him as long as she did, then he divorced her once without taking her back until her 'Iddah elapsed, but they desired each other again. He (Ma'qil) said to him: 'You ingrate! I honored you by marrying her to you, then you divorced her. By Allah! She will never be returned to you again.' Allah knew of his heed for her and her need for a husband, so Allah, Blessed and Most High, revealed: 'And when you have divorced women and they have fulfilled the term of their prescribed period...' up to His saying: '... and you do not know (2:232).' So when Ma'qil heard that he said: 'I heard my Lord and obey.' Then he called for him and said: 'I marry you, and honor you.'"

[Abu 'Eisa said:] This Hadith is Hasan Sahih. It has been reported through other routes from AlHasan, and that is reported from Hasan is Gharib. And in this Hadtth, there is proof that marriage is not allowed without a Wali, because Ma'qil bin Yasãr's sister was not a virgin, so if the matter was up to her, not her Wali, then she could have married herself, and she would have had no need for Ma'qil bin Yasãr to act as the Wali for her. And Allah only addressed the Wali in this Ayah, saying: Do not prevent them from marrying their (former) husbands. - so in this Ayah is the evidence that the authority is with the Wali in marrying (women) with their consent.
حَدَّثَنَا عَبْدُ بْنُ حُمَيْدٍ، حَدَّثَنَا هِشَامُ بْنُ الْقَاسِمِ، عَنِ الْمُبَارَكِ بْنِ فَضَالَةَ، عَنِ الْحَسَنِ، عَنْ مَعْقِلِ بْنِ يَسَارٍ، أَنَّهُ زَوَّجَ أُخْتَهُ رَجُلاً مِنَ الْمُسْلِمِينَ عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَكَانَتْ عِنْدَهُ مَا كَانَتْ ثُمَّ طَلَّقَهَا تَطْلِيقَةً لَمْ يُرَاجِعْهَا حَتَّى انْقَضَتِ الْعِدَّةُ فَهَوِيَهَا وَهَوِيَتْهُ ثُمَّ خَطَبَهَا مَعَ الْخُطَّابِ فَقَالَ لَهُ يَا لُكَعُ أَكْرَمْتُكَ بِهَا وَزَوَّجْتُكَهَا فَطَلَّقْتَهَا وَاللَّهِ لاَ تَرْجِعُ إِلَيْكَ أَبَدًا آخِرُ مَا عَلَيْكَ قَالَ فَعَلِمَ اللَّهُ حَاجَتَهُ إِلَيْهَا وَحَاجَتَهَا إِلَى بَعْلِهَا فَأَنْزَلَ اللَّهُ ‏‏(‏ وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ ‏)‏ إِلَى قَوْلِهِ ‏:‏‏‏(‏ وَأَنْتُمْ لاَ تَعْلَمُونَ ‏)‏ فَلَمَّا سَمِعَهَا مَعْقِلٌ قَالَ سَمْعًا لِرَبِّي وَطَاعَةً ثُمَّ دَعَاهُ فَقَالَ أُزَوِّجُكَ وَأُكْرِمُكَ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏

It was narrated from Zaid bin Aslam, from his father who said:
I heard `Umar bin al-Khattab say: Why are we running now and uncovering our shoulders (in tawaf) when Allah has caused Islam to prevail and has eliminated kufr and its people? Whatever the case, we will never give up something that we did at the time of the Messenger of Allah (ﷺ).

Yahya related to me from Malik that he had heard that a man asked al-Qasim ibn Muhammad and Sulayman ibn Yasar about a man who pronounced dhihar from his wife before he had married her. They said, "If he marries her, he must not touch her until he has done the kaffara for pronouncing dhihar."

Narrated Abdullah ibn Umar:

The Prophet (saws) said: (The standard) weight is the weight of the people of Mecca, and the (standard) measure is the measure of the people of Medina.

Abu Dawud said: Al-Firyabi and Abu Ahmad have also transmitted from Sufyan in a similar way, and he (Ibn Dukain) agreed with them on the text. The version of Abu Ahmad has: "from Ibn 'Abbas" instead of Ibn 'Umar. It has also been transmitted by al-Walid b. Muslim from Hanzalah. This version has: "the weight of Medina and the measure of Mecca."

Abu Dawud said: There is a variation in the text of the version of this tradition narrated by Malik b. Dinar from 'Ata' from the Prophet (saws).

Yahya related to me from Malik from Ismail ibn Abi Hakim from Sulayman ibn Yasar that Umar ibn al-Khattab went out early in the morning to his land in al-Juruf and found semen on his garment. He said, "I have been tried with wet dreams since I have been entrusted with governing the people." He did ghusl and washed his garment of what he saw of the semen, and then prayed after the sun had risen.

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي حَكِيمٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، غَدَا إِلَى أَرْضِهِ بِالْجُرُفِ فَوَجَدَ فِي ثَوْبِهِ احْتِلاَمًا فَقَالَ لَقَدِ ابْتُلِيتُ بِالاِحْتِلاَمِ مُنْذُ وُلِّيتُ أَمْرَ النَّاسِ ‏.‏ فَاغْتَسَلَ وَغَسَلَ مَا رَأَى فِي ثَوْبِهِ مِنَ الاِحْتِلاَمِ ثُمَّ صَلَّى بَعْدَ أَنْ طَلَعَتِ الشَّمْسُ ‏.‏

I heard the Prophet (ﷺ) say: “If you truly put your trust in Allah, He would provide for you as He provides for the birds: they go out with empty stomachs and come back with full stomachs.`

Yahya related to me from Malik from Yazid ibn Khusayfa that he had asked Sulayman ibn Yasar whether zakat was due from a man who had wealth in hand but also owed a debt for the same amount, and he replied, "No."

Malik said, "The position that we are agreed upon concerning a debt is that the lender of it does not pay zakat on it until he gets it back. Even if it stays with the borrower for a number of years before the lender collects it, the lender only has to pay zakat on it once. If he collects an amount of the debt which is not zakatable, and has other wealth which is zakatable, then what he has collected of the debt is added to the rest of his wealth and he pays zakat on the total sum."

Malik continued, "If he has no ready money other than that which he has collected from his debt, and that does not reach a zakatable amount, then he does not have to pay any zakat. He must, however, keep a record of the amount that he has collected and if, later, he collects another amount which, when added to what he has already collected, brings zakat into effect, then he has to pay zakat on it."

Malik continued, "Zakat is due on this first amount, together with what he has further collected of the debt owed to him, regardless of whether or not he has used up what he first collected. If what he takes back reaches twenty dinars of gold, or two hundred dirhams of silver he pays zakat on it. He pays zakat on anything else he takes back afte rthat, whether it be a large or small amount, according to the amount."

Malik said, "What shows that zakat is only taken once from a debt which is out of hand for some years before it is recovered is that if goods remain with a man for trading purposes for some years before he sells them, he only has to pay zakat on their prices once. This is because the one who is owed the debt, or owns the goods, should not have to take the zakat on the debt, or the goods, from anything else, since the zakat on anything is only taken from the thing itself, and not from anything else."

Malik said, "Our position regarding some onewho owes a debt, and has goods which are worth enough to pay off the debt, and also has an amount of ready money which is zakatable, is that he pays the zakat on the ready money which he has to hand. If, however, he only has enough goods and ready money to pay off the debt, then he does not have to pay any zakat. But if the ready money that he has reaches a zakatable amount over and above the amount of the debt that he owes, then he must pay zakat on it."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَزِيدَ بْنِ خُصَيْفَةَ، أَنَّهُ سَأَلَ سُلَيْمَانَ بْنَ يَسَارٍ عَنْ رَجُلٍ، لَهُ مَالٌ وَعَلَيْهِ دَيْنٌ مِثْلُهُ أَعَلَيْهِ زَكَاةٌ فَقَالَ لاَ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الَّذِي لاَ اخْتِلاَفَ فِيهِ عِنْدَنَا فِي الدَّيْنِ أَنَّ صَاحِبَهُ لاَ يُزَكِّيهِ حَتَّى يَقْبِضَهُ وَإِنْ أَقَامَ عِنْدَ الَّذِي هُوَ عَلَيْهِ سِنِينَ ذَوَاتِ عَدَدٍ ثُمَّ قَبَضَهُ صَاحِبُهُ لَمْ تَجِبْ عَلَيْهِ إِلاَّ زَكَاةٌ وَاحِدَةٌ فَإِنْ قَبَضَ مِنْهُ شَيْئًا لاَ تَجِبُ فِيهِ الزَّكَاةُ فَإِنَّهُ إِنْ كَانَ لَهُ مَالٌ سِوَى الَّذِي قُبِضَ تَجِبُ فِيهِ الزَّكَاةُ فَإِنَّهُ يُزَكَّى مَعَ مَا قَبَضَ مِنْ دَيْنِهِ ذَلِكَ ‏.‏ قَالَ وَإِنْ لَمْ يَكُنْ لَهُ نَاضٌّ غَيْرُ الَّذِي اقْتَضَى مِنْ دَيْنِهِ وَكَانَ الَّذِي اقْتَضَى مِنْ دَيْنِهِ لاَ تَجِبُ فِيهِ الزَّكَاةُ فَلاَ زَكَاةَ عَلَيْهِ فِيهِ وَلَكِنْ لِيَحْفَظْ عَدَدَ مَا اقْتَضَى فَإِنِ اقْتَضَى بَعْدَ ذَلِكَ عَدَدَ مَا تَتِمُّ بِهِ الزَّكَاةُ مَعَ مَا قَبَضَ قَبْلَ ذَلِكَ فَعَلَيْهِ فِيهِ الزَّكَاةُ ‏.‏ قَالَ فَإِنْ كَانَ قَدِ اسْتَهْلَكَ مَا اقْتَضَى أَوَّلاً أَوْ لَمْ يَسْتَهْلِكْهُ فَالزَّكَاةُ وَاجِبَةٌ عَلَيْهِ مَعَ مَا اقْتَضَى مِنْ دَيْنِهِ فَإِذَا بَلَغَ مَا اقْتَضَى عِشْرِينَ دِينَارًا عَيْنًا أَوْ مِائَتَىْ دِرْهَمٍ فَعَلَيْهِ فِيهِ الزَّكَاةُ ثُمَّ مَا اقْتَضَى بَعْدَ ذَلِكَ مِنْ قَلِيلٍ أَوْ كَثِيرٍ فَعَلَيْهِ الزَّكَاةُ بِحَسَبِ ذَلِكَ ‏.‏ قَالَ ...

Narrated `Abdullah bin Hunain:

`Abdullah bin Al-Abbas and Al-Miswar bin Makhrama differed at Al-Abwa'; Ibn `Abbas said that a Muhrim could wash his head; while Al-Miswar maintained that he should not do so. `Abdullah bin `Abbas sent me to Abu Aiyub Al-Ansari and I found him bathing between the two wooden posts (of the well) and was screened with a sheet of cloth. I greeted him and he asked who I was. I replied, "I am `Abdullah bin Hunain and I have been sent to you by Ibn `Abbas to ask you how Allah's Apostle used to wash his head while in the state of lhram." Abu Aiyub Al-Ansari caught hold of the sheet of cloth and lowered it till his head appeared before me, and then told somebody to pour water on his head. He poured water on his head, and he (Abu Aiyub) rubbed his head with his hands by bringing them from back to front and from front to back and said, "I saw the Prophet doing like this."

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ يُوسُفَ، أَخْبَرَنَا مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، عَنْ إِبْرَاهِيمَ بْنِ عَبْدِ اللَّهِ بْنِ حُنَيْنٍ، عَنْ أَبِيهِ، أَنَّ عَبْدَ اللَّهِ بْنَ الْعَبَّاسِ، وَالْمِسْوَرَ بْنَ مَخْرَمَةَ، اخْتَلَفَا بِالأَبْوَاءِ، فَقَالَ عَبْدُ اللَّهِ بْنُ عَبَّاسٍ يَغْسِلُ الْمُحْرِمُ رَأْسَهُ‏.‏ وَقَالَ الْمِسْوَرُ لاَ يَغْسِلُ الْمُحْرِمُ رَأْسَهُ‏.‏ فَأَرْسَلَنِي عَبْدُ اللَّهِ بْنُ الْعَبَّاسِ إِلَى أَبِي أَيُّوبَ الأَنْصَارِيِّ، فَوَجَدْتُهُ يَغْتَسِلُ بَيْنَ الْقَرْنَيْنِ، وَهُوَ يُسْتَرُ بِثَوْبٍ، فَسَلَّمْتُ عَلَيْهِ فَقَالَ مَنْ هَذَا فَقُلْتُ أَنَا عَبْدُ اللَّهِ بْنُ حُنَيْنٍ، أَرْسَلَنِي إِلَيْكَ عَبْدُ اللَّهِ بْنُ الْعَبَّاسِ، أَسْأَلُكَ كَيْفَ كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَغْسِلُ رَأْسَهُ، وَهُوَ مُحْرِمٌ، فَوَضَعَ أَبُو أَيُّوبَ يَدَهُ عَلَى الثَّوْبِ، فَطَأْطَأَهُ حَتَّى بَدَا لِي رَأْسُهُ ثُمَّ قَالَ لإِنْسَانٍ يَصُبُّ عَلَيْهِ اصْبُبْ‏.‏ فَصَبَّ عَلَى رَأْسِهِ، ثُمَّ حَرَّكَ رَأْسَهُ بِيَدَيْهِ فَأَقْبَلَ بِهِمَا وَأَدْبَرَ وَقَالَ هَكَذَا ...

He went away, and when he had bathed he came with his head dripping and led them in prayer. Then when he finished he said, “I was defiled by a seminal emission and forgot to bathe.” Ahmad transmitted it, and Malik transmitted it fromAta’ b. Yasar in mursal form.
عَنْ أَبِي هُرَيْرَةَ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَرَجَ إِلَى الصَّلَاةِ فَلَمَّا كَبَّرَ انْصَرَفَ وَأَوْمَأَ إِلَيْهِمْ أَنْ كَمَا كُنْتُمْ. ثُمَّ خَرَجَ فَاغْتَسَلَ ثُمَّ جَاءَ وَرَأَسُهُ يَقْطُرُ فَصَلَّى بِهِمْ. فَلَمَّا صَلَّى قَالَ: «إِنِّي كُنْتُ جُنُبًا فنسيت أَن أَغْتَسِل» . رَوَاهُ أَحْمد

Ata’ b. Yasar reported in mursal form that God’s messenger said, ''Sadaqa may not be given to a rich man, with the exception of five classes:
one who fights in God’s path, or one who collects it, or a debtor, a man who buys it with his money, or a man who has a poor neighbour a no has been given sadaqa and gives a present to the rich man.” Malik and Abu Dawud transmitted it. A version by Abu Dawud from Abu Sa'id has ‘‘or a traveller.”
وَعَنْ عَطَاءِ بْنِ يَسَارٍ مُرْسَلًا قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم: " لَا تَحِلُّ الصَّدَقَةُ لِغَنِيٍّ إِلَّا لِخَمْسَةٍ: لِغَازٍ فِي سَبِيلِ اللَّهِ أَوْ لِعَامِلٍ عَلَيْهَا أَوْ لِغَارِمٍ أَوْ لِرَجُلٍ اشْتَرَاهَا بِمَالِهِ أَوْ لِرَجُلٍ كَانَ لَهُ جَارٌ مِسْكِينٌ فَتَصَدَّقَ عَلَى الْمِسْكِينِ فَأَهْدَى الْمِسْكِين للغني ". رَوَاهُ مَالك وَأَبُو دَاوُد

Narrated Al-Hasan:

The sister of Ma'qil bin Yasar was married to a man and then that man divorced her and remained away from her till her period of the 'Iddah expired. Then he demanded for her hand in marriage, but Ma'qil got angry out of pride and haughtiness and said, "He kept away from her when he could still retain her, and now he demands her hand again?" So Ma'qil disagreed to remarry her to him. Then Allah revealed: 'When you have divorced women and they have fulfilled the term of their prescribed period, do not prevent them from marrying their (former) husbands.' (2.232) So the Prophet sent for Ma'qil and recited to him (Allah's order) and consequently Ma'qil gave up his pride and haughtiness and yielded to Allah's order.

وَحَدَّثَنِي مُحَمَّدُ بْنُ الْمُثَنَّى، حَدَّثَنَا عَبْدُ الأَعْلَى، حَدَّثَنَا سَعِيدٌ، عَنْ قَتَادَةَ، حَدَّثَنَا الْحَسَنُ، أَنَّ مَعْقِلَ بْنَ يَسَارٍ، كَانَتْ أُخْتُهُ تَحْتَ رَجُلٍ فَطَلَّقَهَا، ثُمَّ خَلَّى عَنْهَا حَتَّى انْقَضَتْ عِدَّتُهَا، ثُمَّ خَطَبَهَا فَحَمِيَ مَعْقِلٌ مِنَ ذَلِكَ أَنَفًا فَقَالَ خَلَّى عَنْهَا وَهْوَ يَقْدِرُ عَلَيْهَا، ثُمَّ يَخْطُبُهَا فَحَالَ بَيْنَهُ وَبَيْنَهَا، فَأَنْزَلَ اللَّهُ ‏‏{‏وَإِذَا طَلَّقْتُمُ النِّسَاءَ فَبَلَغْنَ أَجَلَهُنَّ فَلاَ تَعْضُلُوهُنَّ‏}‏ إِلَى آخِرِ الآيَةِ، فَدَعَاهُ رَسُولُ اللَّهِ صلى الله عليه وسلم فَقَرَأَ عَلَيْهِ، فَتَرَكَ الْحَمِيَّةَ وَاسْتَقَادَ لأَمْرِ اللَّهِ‏.‏

It was narrated from 'Umar ibn Al-Khattab that the Prophet(SAW) said:
"If I live- if Allah wills - I will forbid the names Rabah(profit), Najih(saved), Aflah (Successful), Nafi (beneficial) and Yasar(prosperity)."

Yahya related to me from Malik from Yahya ibn Said from Sulayman ibn Yasar that Umar ibn al-Khattab led the people in the subh prayer and then went out to his land in Juruf and found semen on his clothes. He said, "Since we have been eating rich meat our veins have become fulsome." He did ghusl, washed the semen from his clothing, and did his prayer again.

Narrated Az-Zubair bin Al-`Awwam:

The Prophet (p.b.u.h) said, "It is better for anyone of you to take a rope (and cut) and bring a bundle of wood (from the forest) over his back and sell it and Allah will save his face (from the Hell-Fire) because of that, rather than to ask the people who may give him or not."

I was travelling along with Ibn 'Umar on the way to Mecca. Sa'id said: When I apprehended dawn, I dismounted (the ride) and observed Witr prayer and then again joined him. Ibn 'Umar said to me: Where were you? I said: I apprehended the appearance of dawn, so I dismounted and observed Witr prayer. Upon this 'Abdullah said: Is there not a model pattern for you in the Messenger of Allah (may peace be upon him)? I said: Yes, by Allah, and (then) he said: The Messenger of Allah (may peace be upon him) used to observe Witr prayer on the camel's back.
وَحَدَّثَنَا يَحْيَى بْنُ يَحْيَى، قَالَ قَرَأْتُ عَلَى مَالِكٍ عَنْ أَبِي بَكْرِ بْنِ عُمَرَ بْنِ عَبْدِ الرَّحْمَنِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ بْنِ الْخَطَّابِ، عَنْ سَعِيدِ بْنِ يَسَارٍ، أَنَّهُ قَالَ كُنْتُ أَسِيرُ مَعَ ابْنِ عُمَرَ بِطَرِيقِ مَكَّةَ - قَالَ سَعِيدٌ - فَلَمَّا خَشِيتُ الصُّبْحَ نَزَلْتُ فَأَوْتَرْتُ ثُمَّ أَدْرَكْتُهُ فَقَالَ لِي ابْنُ عُمَرَ أَيْنَ كُنْتَ فَقُلْتُ لَهُ خَشِيتُ الْفَجْرَ فَنَزَلْتُ فَأَوْتَرْتُ ‏.‏ فَقَالَ عَبْدُ اللَّهِ أَلَيْسَ لَكَ فِي رَسُولِ اللَّهِ صلى الله عليه وسلم أُسْوَةٌ فَقُلْتُ بَلَى وَاللَّهِ ‏.‏ قَالَ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَ يُوتِرُ عَلَى الْبَعِيرِ ‏.‏

Narrated `Urwa:

Az-Zubair said, "I met Ubaida bin Sa`id bin Al-As on the day (of the battle) of Badr and he was covered with armor; so much that only his eyes were visible. He was surnamed Abu Dhat-al-Karish. He said (proudly), 'I am Abu-al-Karish.' I attacked him with the spear and pierced his eye and he died. I put my foot over his body to pull (that spear) out, but even then I had to use a great force to take it out as its both ends were bent." `Urwa said, "Later on Allah's Apostle asked Az-Zubair for the spear and he gave it to him. When Allah's Apostle died, Az-Zubair took it back. After that Abu Bakr demanded it and he gave it to him, and when Abu Bakr died, Az-Zubair took it back. `Umar then demanded it from him and he gave it to him. When `Umar died, Az-Zubair took it back, and then `Uthman demanded it from him and he gave it to him. When `Uthman was martyred, the spear remained with `Ali's offspring. Then `Abdullah bin Az-Zubair demanded it back, and it remained with him till he was martyred.

حَدَّثَنِي عُبَيْدُ بْنُ إِسْمَاعِيلَ، حَدَّثَنَا أَبُو أُسَامَةَ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، قَالَ قَالَ الزُّبَيْرُ لَقِيتُ يَوْمَ بَدْرٍ عُبَيْدَةَ بْنَ سَعِيدِ بْنِ الْعَاصِ وَهْوَ مُدَجَّجٌ لاَ يُرَى مِنْهُ إِلاَّ عَيْنَاهُ، وَهْوَ يُكْنَى أَبُو ذَاتِ الْكَرِشِ، فَقَالَ أَنَا أَبُو ذَاتِ الْكَرِشِ‏.‏ فَحَمَلْتُ عَلَيْهِ بِالْعَنَزَةِ، فَطَعَنْتُهُ فِي عَيْنِهِ فَمَاتَ‏.‏ قَالَ هِشَامٌ فَأُخْبِرْتُ أَنَّ الزُّبَيْرَ قَالَ لَقَدْ وَضَعْتُ رِجْلِي عَلَيْهِ ثُمَّ تَمَطَّأْتُ، فَكَانَ الْجَهْدَ أَنْ نَزَعْتُهَا وَقَدِ انْثَنَى طَرَفَاهَا‏.‏ قَالَ عُرْوَةُ فَسَأَلَهُ إِيَّاهَا رَسُولُ اللَّهِ صلى الله عليه وسلم فَأَعْطَاهُ، فَلَمَّا قُبِضَ رَسُولُ اللَّهِ صلى الله عليه وسلم أَخَذَهَا، ثُمَّ طَلَبَهَا أَبُو بَكْرٍ فَأَعْطَاهُ، فَلَمَّا قُبِضَ أَبُو بَكْرٍ سَأَلَهَا إِيَّاهُ عُمَرُ فَأَعْطَاهُ إِيَّاهَا، فَلَمَّا قُبِضَ عُمَرُ أَخَذَهَا، ثُمَّ طَلَبَهَا عُثْمَانُ مِنْهُ فَأَعْطَاهُ إِيَّاهَا، فَلَمَّا قُتِلَ عُثْمَانُ وَقَعَتْ عِنْدَ آلِ عَلِيٍّ، فَطَلَبَهَا عَبْدُ اللَّهِ بْنُ الزُّبَيْرِ، فَكَانَتْ عِنْدَهُ حَتَّى قُتِلَ‏.‏

Narrated Aqra' ibn Habib:

Ibn Abbas said: Aqra' ibn Habis asked the Prophet (saws) saying: Messenger of Allah hajj is to be performed annually or only once? He replied: Only once, and if anyone performs it more often, he performs a supererogatory act.

Abu Dawud said: The narrator Abu Sinan is Abu Sinan al-Du'wail. The same has been reported by both 'Abd al-Jalil bin Humaid and Sulaiman bin Kathir from al-Zuhri. The narrator 'Uqail reported the name "Sinan".

حَدَّثَنَا زُهَيْرُ بْنُ حَرْبٍ، وَعُثْمَانُ بْنُ أَبِي شَيْبَةَ الْمَعْنَى، قَالاَ حَدَّثَنَا يَزِيدُ بْنُ هَارُونَ، عَنْ سُفْيَانَ بْنِ حُسَيْنٍ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سِنَانٍ، عَنِ ابْنِ عَبَّاسٍ، أَنَّ الأَقْرَعَ بْنَ حَابِسٍ، سَأَلَ النَّبِيَّ صلى الله عليه وسلم فَقَالَ يَا رَسُولَ اللَّهِ الْحَجُّ فِي كُلِّ سَنَةٍ أَوْ مَرَّةً وَاحِدَةً قَالَ ‏"‏ بَلْ مَرَّةً وَاحِدَةً فَمَنْ زَادَ فَهُوَ تَطَوُّعٌ ‏" ‏ ‏.‏ قَالَ أَبُو دَاوُدَ هُوَ أَبُو سِنَانٍ الدُّؤَلِيُّ كَذَا قَالَ عَبْدُ الْجَلِيلِ بْنُ حُمَيْدٍ وَسُلَيْمَانُ بْنُ كَثِيرٍ جَمِيعًا عَنِ الزُّهْرِيِّ وَقَالَ عُقَيْلٌ عَنْ سِنَانٍ ‏.‏
