" ثُمَّ لْيَبِعْهَا فِي الرَّابِعَةِ " .

" تَعْلَمُنَّ وَاللَّهِ وَالَّذِي نَفْسِي بِيَدِهِ لاَ يَأْخُذُ أَحَدُكُمْ مِنْهَا شَيْئًا " . وَزَادَ فِي حَدِيثِ سُفْيَانَ قَالَ بَصُرَ عَيْنِي وَسَمِعَ أُذُنَاىَ . وَسَلُوا زَيْدَ بْنَ ثَابِتٍ فَإِنَّهُ كَانَ حَاضِرًا مَعِي .

Allah's Messenger said: "What is between the east and the west is Qiblah."
حَدَّثَنَا الْحَسَنُ بْنُ بَكْرٍ الْمَرْوَزِيُّ، حَدَّثَنَا الْمُعَلَّى بْنُ مَنْصُورٍ، حَدَّثَنَا عَبْدُ اللَّهِ بْنُ جَعْفَرٍ الْمَخْرَمِيُّ، عَنْ عُثْمَانَ بْنِ مُحَمَّدٍ الأَخْنَسِيِّ، عَنْ سَعِيدٍ الْمَقْبُرِيِّ، عَنْ أَبِي هُرَيْرَةَ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ " مَا بَيْنَ الْمَشْرِقِ وَالْمَغْرِبِ قِبْلَةٌ " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ . وَإِنَّمَا قِيلَ عَبْدُ اللَّهِ بْنُ جَعْفَرٍ الْمَخْرَمِيُّ لأَنَّهُ مِنْ وَلَدِ الْمِسْوَرِ بْنِ مَخْرَمَةَ . وَقَدْ رُوِيَ عَنْ غَيْرِ وَاحِدٍ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم " مَا بَيْنَ الْمَشْرِقِ وَالْمَغْرِبِ قِبْلَةٌ " . مِنْهُمْ عُمَرُ بْنُ الْخَطَّابِ وَعَلِيُّ بْنُ أَبِي طَالِبٍ وَابْنُ عَبَّاسٍ . وَقَالَ ابْنُ عُمَرَ إِذَا جَعَلْتَ الْمَغْرِبَ عَنْ يَمِينِكَ وَالْمَشْرِقَ عَنْ يَسَارِكَ فَمَا بَيْنَهُمَا قِبْلَةٌ إِذَا اسْتَقْبَلْتَ الْقِبْلَةَ . وَقَالَ ابْنُ الْمُبَارَكِ " مَا بَيْنَ الْمَشْرِقِ وَالْمَغْرِبِ قِبْلَةٌ " . هَذَا لأَهْلِ الْمَشْرِقِ . وَاخْتَارَ عَبْدُ اللَّهِ بْنُ الْمُبَارَكِ التَّيَاسُرَ لأَهْلِ مَرْوٍ .

حَدَّثَنَا هَنَّادٌ، حَدَّثَنَا عَبْدَةُ، وَوَكِيعٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، أَنَّ النَّبِيَّ صلى الله عليه وسلم أَمَرَ فَذَكَرَ نَحْوَهُ . قَالَ أَبُو عِيسَى وَهَذَا أَصَحُّ مِنَ الْحَدِيثِ الأَوَّلِ .

حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، حَدَّثَنَا سُفْيَانُ، وَشُعْبَةُ، وَمَالِكُ بْنُ أَنَسٍ، عَنْ عَمْرِو بْنِ يَحْيَى، عَنْ أَبِيهِ، عَنْ أَبِي سَعِيدٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَ حَدِيثِ عَبْدِ الْعَزِيزِ عَنْ عَمْرِو بْنِ يَحْيَى . قَالَ أَبُو عِيسَى حَدِيثُ أَبِي سَعِيدٍ حَدِيثٌ حَسَنٌ صَحِيحٌ وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ عَنْهُ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ أَنْ لَيْسَ فِيمَا دُونَ خَمْسَةِ أَوْسُقٍ صَدَقَةٌ . وَالْوَسْقُ سِتُّونَ صَاعًا وَخَمْسَةُ أَوْسُقٍ ثَلاَثُمِائَةِ صَاعٍ وَصَاعُ النَّبِيِّ صلى الله عليه وسلم خَمْسَةُ أَرْطَالٍ وَثُلُثٌ وَصَاعُ أَهْلِ الْكُوفَةِ ثَمَانِيَةُ أَرْطَالٍ . وَلَيْسَ فِيمَا دُونَ خَمْسِ أَوَاقٍ صَدَقَةٌ وَالأُوقِيَّةُ أَرْبَعُونَ دِرْهَمًا وَخَمْسُ أَوَاقٍ مِائَتَا دِرْهَمٍ . وَلَيْسَ فِيمَا دُونَ خَمْسِ ذَوْدٍ صَدَقَةٌ يَعْنِي لَيْسَ فِيمَا دُونَ خَمْسٍ مِنَ الإِبِلِ صَدَقَةٌ فَإِذَا بَلَغَتْ خَمْسًا وَعِشْرِينَ مِنَ الإِبِلِ فَفِيهَا بِنْتُ مَخَاضٍ وَفِيمَا دُونَ خَمْسٍ وَعِشْرِينَ مِنَ الإِبِلِ فِي كُلِّ خَمْسٍ مِنَ الإِبِلِ شَاةٌ .

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا قَزَعَةُ بْنُ سُوَيْدٍ الْبَاهِلِيُّ، عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوَهُ . يَعْنِي حَدِيثَ مُحَمَّدِ بْنِ طَرِيفٍ . قَالَ أَبُو عِيسَى وَقَدْ رُوِيَ عَنْ مُحَمَّدِ بْنِ الْمُنْكَدِرِ عَنِ النَّبِيِّ صلى الله عليه وسلم مُرْسَلاً . وَقَدْ أَجْمَعَ أَهْلُ الْعِلْمِ أَنَّ الصَّبِيَّ إِذَا حَجَّ قَبْلَ أَنْ يُدْرِكَ فَعَلَيْهِ الْحَجُّ إِذَا أَدْرَكَ لاَ تُجْزِئُ عَنْهُ تِلْكَ الْحَجَّةُ عَنْ حَجَّةِ الإِسْلاَمِ وَكَذَلِكَ الْمَمْلُوكُ إِذَا حَجَّ فِي رِقِّهِ ثُمَّ أُعْتِقَ فَعَلَيْهِ الْحَجُّ إِذَا وَجَدَ إِلَى ذَلِكَ سَبِيلاً وَلاَ يُجْزِئُ عَنْهُ مَا حَجَّ فِي حَالِ رِقِّهِ . وَهُوَ قَوْلُ سُفْيَانَ الثَّوْرِيِّ وَالشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ .
