Yahya related to me from Malik that he had heard that receipts were given to people in the time of Marwan ibn al-Hakam for the produce of the market at al-Jar. People bought and sold the receipts among themselves before they took delivery of the goods. Zayd Thabit and one of the Companions of the Messenger of Allah, may Allah bless him and grant him peace, went to Marwan ibn al-Hakam and said, "Marwan! Do you make usury halal?" He said, "I seek refuge with Allah! What is that?" He said, "These receipts which people buy and sell before they take delivery of the goods." Marwan therefore sent a guard to follow them and to take them from people's hands and return them to their owners.

وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ ‏.‏ أَنَّ صُكُوكًا، خَرَجَتْ لِلنَّاسِ فِي زَمَانِ مَرْوَانَ بْنِ الْحَكَمِ مِنْ طَعَامِ الْجَارِ فَتَبَايَعَ النَّاسُ تِلْكَ الصُّكُوكَ بَيْنَهُمْ قَبْلَ أَنْ يَسْتَوْفُوهَا فَدَخَلَ زَيْدُ بْنُ ثَابِتٍ وَرَجُلٌ مِنْ أَصْحَابِ رَسُولِ اللَّهِ صلى الله عليه وسلم عَلَى مَرْوَانَ بْنِ الْحَكَمِ فَقَالاَ أَتُحِلُّ بَيْعَ الرِّبَا يَا مَرْوَانُ ‏.‏ فَقَالَ أَعُوذُ بِاللَّهِ وَمَا ذَاكَ فَقَالاَ هَذِهِ الصُّكُوكُ تَبَايَعَهَا النَّاسُ ثُمَّ بَاعُوهَا قَبْلَ أَنْ يَسْتَوْفُوهَا فَبَعَثَ مَرْوَانُ الْحَرَسَ يَتْبَعُونَهَا يَنْزِعُونَهَا مِنْ أَيْدِي النَّاسِ وَيَرُدُّونَهَا إِلَى أَهْلِهَا ‏.‏

Narrated `Urwa bin Az-Zubair:

Marwan bin Al-Hakam and Al-Miswar bin Makhrama told him that when the Muslims were permitted to set free the captives of Hawazin, Allah's Apostle said, "I do not know who amongst you has agreed (to it) and who has not. Go back so that your 'Urafa' may submit your decision to us." So the people returned and their 'Urafa' talked to them and then came back to Allah's Apostle and told him that the people had given their consent happily and permitted (their captives to be freed).

Narrated 'Abdullah bin 'Ubaidullah bin Abi Mulaika:
The sons of Suhaib, (Suhaib, who was the freed slave of Bani Jud'an) claimed that Allah's Messenger (saws) had given two houses and one room to Suhaib. Marwan asked, "Who will testify to your claim?" They replied that Ibn 'Umar would do so. Marwan sent for Ibn 'Umar who testified that Allah's Messenger (saws) had really given Suhaib two houses and a room. So, Marwan gave the verdict (in favour of Suhaib's sons), because of (Ibn 'Umar's) witness.

Narrated Salim bin `Abdullah:

My father said, "I heard Allah's Apostle saying, 'The period of your stay as compared to the previous nations is like the period equal to the time between the `Asr prayer and sunset. The people of the Torah were given the Torah and they acted (upon it) till midday then they were exhausted and were given one Qirat (of gold) each. And then the people of the Gospel were given the Gospel and they acted (upon it) till the `Asr prayer then they were exhausted and were! given one Qirat each. And then we were given the Qur'an and we acted (upon it) till sunset and we were given two Qirats each. On that the people of both the scriptures said, 'O our Lord! You have given them two Qirats and given us one Qirat, though we have worked more than they.' Allah said, 'Have I usurped some of your right?' They said, 'No.' Allah said: "That is my blessing I bestow upon whomsoever I wish."

حَدَّثَنَا عَبْدُ الْعَزِيزِ بْنُ عَبْدِ اللَّهِ، قَالَ حَدَّثَنِي إِبْرَاهِيمُ، عَنِ ابْنِ شِهَابٍ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ، عَنْ أَبِيهِ، أَنَّهُ أَخْبَرَهُ أَنَّهُ، سَمِعَ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏"‏ إِنَّمَا بَقَاؤُكُمْ فِيمَا سَلَفَ قَبْلَكُمْ مِنَ الأُمَمِ كَمَا بَيْنَ صَلاَةِ الْعَصْرِ إِلَى غُرُوبِ الشَّمْسِ، أُوتِيَ أَهْلُ التَّوْرَاةِ التَّوْرَاةَ فَعَمِلُوا حَتَّى إِذَا انْتَصَفَ النَّهَارُ عَجَزُوا، فَأُعْطُوا قِيرَاطًا قِيرَاطًا، ثُمَّ أُوتِيَ أَهْلُ الإِنْجِيلِ الإِنْجِيلَ فَعَمِلُوا إِلَى صَلاَةِ الْعَصْرِ، ثُمَّ عَجَزُوا، فَأُعْطُوا قِيرَاطًا قِيرَاطًا، ثُمَّ أُوتِينَا الْقُرْآنَ فَعَمِلْنَا إِلَى غُرُوبِ الشَّمْسِ، فَأُعْطِينَا قِيرَاطَيْنِ قِيرَاطَيْنِ، فَقَالَ أَهْلُ الْكِتَابَيْنِ أَىْ رَبَّنَا أَعْطَيْتَ هَؤُلاَءِ قِيرَاطَيْنِ قِيرَاطَيْنِ، وَأَعْطَيْتَنَا قِيرَاطًا قِيرَاطًا، وَنَحْنُ كُنَّا أَكْثَرَ عَمَلاً، قَالَ قَالَ اللَّهُ عَزَّ وَجَلَّ هَلْ ظَلَمْتُكُمْ مِنْ أَجْرِكُمْ مِنْ شَىْءٍ قَالُوا لاَ، قَالَ فَهْوَ فَضْلِي أُوتِيهِ مَنْ أَشَاءُ ‏"‏‏.‏

Narrated `Abdullah bin `Umar:

I heard Allah's Apostle while he was standing on the pulpit, saying, "The remaining period of your stay (on the earth) in comparison to the nations before you, is like the period between the `Asr prayer and sunset. The people of the Torah were given the Torah and they acted upon it till midday, and then they were worn out and were given for their labor, one Qirat each. Then the people of the Gospel were given the Gospel and they acted upon it till the time of the `Asr prayer, and then they were worn out and were given (for their labor), one Qirat each. Then you people were given the Qur'an and you acted upon it till sunset and so you were given two Qirats each (double the reward of the previous nations)." Then the people of the Torah said, 'O our Lord! These people have done a little labor (much less than we) but have taken a greater reward.' Allah said, 'Have I withheld anything from your reward?' They said, 'No.' Then Allah said, 'That is My Favor which I bestow on whom I wish.' "

Narrated Alqama bin Waqqas:

Marwan said to his gatekeeper, "Go to Ibn `Abbas, O Rafi`, and say, 'If everybody who rejoices in what he has done, and likes to be praised for what he has not done, will be punished, then all of us will be punished." Ibn `Abbas said, "What connection have you with this case? It was only that the Prophet called the Jews and asked them about something, and they hid the truth and told him something else, and showed him that they deserved praise for the favor of telling him the answer to his question, and they became happy with what they had concealed. Then Ibn `Abbas recited:-- "(And remember) when Allah took a Covenant from those who were given the Scripture..and those who rejoice in what they have done and love to be praised for what they have not done.' " (3.187-188)

Humaid bin `Abdur-Rahman bin `Auf narrated that Marwan had told him (the above narration).

Abu Sa'id al-Khudri reported that the Messenger of Allah (may peace be upon him) used to go out on the day of Adha and on the day of Fitr and commenced the prayer. And after having observed his prayer and pronounced the salutation, he stood up facing people as they were seated at their places of worship. And if he intended to send out an army he made mention of it to the people, and if he intended any other thing besides it, he commanded them (to do that). He used to say (to the people):

Give alms, give alms, give alms, and the majority that gave alms was of women. He then returned and this (practice) remained (in vogue) till Marwan b. al- Hakam (came into power). I went out hand in hand with Marwan till we came to the place of worship and there Kathir b. Salt had built a pulpit of clay and brick. Marwan began to tug me with his hand as though he were pulling me towards the pulpit, while I was pulling him towards the prayer. When I saw him doing that I said: What has happened to the practice of beginning with prayer? He said: No, Abu Sa'id, what you are familiar with has been abandoned. I thereupon said (three times and went back): By no means, by Him in Whose hand my life is, you are not doing anything better than what I am familiar with.

Narrated Rafi' ibn Khadij:

Muhammad ibn Yahya ibn Hibban said: A slave stole a plant of a palm-tree from the orchard of a man and planted it in the orchard of his master. The owner of the plant went out in search of the plant and he found it. He solicited help against the slave from Marwan ibn al-Hakam who was the Governor of Medina at that time. Marwan confined the slave and intended to cut off his hand. The slave's master went to Rafi' ibn Khadij and asked him about it.

He told him that he had heard the Messenger of Allah (saws) say: The hand is not to be cut off for taking fruit or the pith of the palm-tree.

The man then said: Marwan has seized my slave and wants to cut off his hand. I wish you to go with me to him and tell him that which you have heard from the Messenger of Allah (saws). So Rafi' ibn Khadij went with him and came to Marwan ibn al-Hakam.

Rafi' said to him: I heard the Messenger of Allah (saws) say: The hand is not to be cut off for taking fruit or the pith of the palm-tree. So Marwan gave orders to release the slave and then he was released.

Abu Dawud said: Kathar means pith of the palm-tree.

Narrated Qasim bin Muhammad and Sulaiman bin Yasar:

that Yahya bin Sa`id bin Al-`As divorced the daughter of `Abdur-Rahman bin Al-Hakarn. `Abdur- Rahman took her to his house. On that `Aisha sent a message to Marwan bin Al-Hakam who was the ruler of Medina, saying, "Fear Allah, and urge your brother) to return her to her house." Marwan (in Sulaiman's version) said, "Abdur-Rahman bin Al-Hakam did not obey me (or had a convincing argument)." (In Al-Qasim's versions Marwan said, "Have you not heard of the case of Fatima bint Qais?" Aisha said, "The case of Fatima bint Qais is not in your favor.' Marwan bin Al-Hakam said to `Aisha, "The reason that made Fatima bint Qais go to her father's house is just applicable to the daughter of `Abdur-Rahman."

حَدَّثَنَا إِسْمَاعِيلُ، حَدَّثَنَا مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، أَنَّهُ سَمِعَهُ يَذْكُرُ، أَنَّ يَحْيَى بْنَ سَعِيدِ بْنِ الْعَاصِ، طَلَّقَ بِنْتَ عَبْدِ الرَّحْمَنِ بْنِ الْحَكَمِ، فَانْتَقَلَهَا عَبْدُ الرَّحْمَنِ، فَأَرْسَلَتْ عَائِشَةُ أُمُّ الْمُؤْمِنِينَ إِلَى مَرْوَانَ وَهْوَ أَمِيرُ الْمَدِينَةِ اتَّقِ اللَّهَ وَارْدُدْهَا إِلَى بَيْتِهَا‏.‏ قَالَ مَرْوَانُ فِي حَدِيثِ سُلَيْمَانَ إِنَّ عَبْدَ الرَّحْمَنِ بْنَ الْحَكَمِ غَلَبَنِي‏.‏ وَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ أَوَمَا بَلَغَكِ شَأْنُ فَاطِمَةَ بِنْتِ قَيْسٍ قَالَتْ لاَ يَضُرُّكَ أَنْ لاَ تَذْكُرَ حَدِيثَ فَاطِمَةَ‏.‏ فَقَالَ مَرْوَانُ بْنُ الْحَكَمِ إِنْ كَانَ بِكِ شَرٌّ فَحَسْبُكِ مَا بَيْنَ هَذَيْنِ مِنَ الشَّرِّ‏.‏

Abu Qaza'ah reported that while Abd al-Malik b. Marwan was circumambulating the Ka'ba he said:

May Allah ruin Ibn Zubair that he lies in attributing to the Mother of the Faithful, as he says: I heard her stating that Allah's Messenger (may'peace be upon him) had said: 'A'isha, if your people had not been new converts to Islam, I would have demolished the House and would have added (in it area) from the Hijr for your people have reduced the area from its foundations. Harith b. 'Abdullah b. Abu Rabi'a (Allah be pleased with him) said: Commander of the Faithful, don't say that, for I heard the Mother of the Faithful saying this, whereupon he said: If I had heard this before demolishing it, I would have left it in the state in which Ibn Zabair had built it.

Abu Sa'id al-Khudri said:
God's Messenger used to go out on the day of sacrifice and the day of the breaking of the fast, first of all pray, and when he had prayed stand up facing the people while they were seated in their place of prayer. If he had cause to send out an expedition he mentioned it to the people, or if he required anything else he gave them commands about it, and he would say, “Give alms, give alms, give alms." Those who gave most were the women. Then he would go away. This practice went on till the time of Marwan b. al-Hakam.* I went out hand in hand with Marwan, and when we came to the place of prayer we saw that Kathir b. as Salt had built a pulpit of clay and brick. Marwan began to tug me with his hand as though he were pulling me towards the pulpit, while I was pulling him towards the prayer. When I saw what he was doing I said, “What has happened to the practice of beginning with prayer?" He replied, “No, Abu Sa'id, what you are familiar with has been abandoned." I thereupon said three times, “By no means, by Him in whose hand my soul is, you are not doing something better than what I am familiar with." Then he went away. *Ummayyad Caliph, 64-65 A.H. Muslim transmitted it.
وَعَنْ أَبِي سَعِيدٍ الْخُدْرِيُّ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ كَانَ يَخْرُجُ يَوْمَ الْأَضْحَى ويم الْفِطْرِ فَيَبْدَأُ بِالصَّلَاةِ فَإِذَا صَلَّى صَلَاتَهُ قَامَ فَأقبل عل النَّاسِ وَهُمْ جُلُوسٌ فِي مُصَلَّاهُمْ فَإِنْ كَانَتْ لَهُ حَاجَة ببعث ذِكْرَهُ لِلنَّاسِ أَوْ كَانَتْ لَهُ حَاجَةٌ بِغَيْرِ ذَلِكَ أَمَرَهُمْ بِهَا وَكَانَ يَقُولُ: «تَصَدَّقُوا تَصَدَّقُوا تَصَدَّقُوا» . وَكَانَ أَكْثَرَ مَنْ يَتَصَدَّقُ النِّسَاءُ ثُمَّ ينْصَرف فَلم يزل كَذَلِك حَتَّى كَانَ مَرْوَان ابْن الْحَكَمِ فَخَرَجْتُ مُخَاصِرًا مَرْوَانَ حَتَّى أَتَيْنَا الْمُصَلَّى فَإِذَا كَثِيرُ بْنُ الصَّلْتِ قَدْ بَنَى مِنْبَرًا مِنْ طِينٍ وَلَبِنٍ فَإِذَا مَرْوَانُ يُنَازِعُنِي يَدَهُ كَأَنَّهُ يَجُرُّنِي نَحْوَ الْمِنْبَرِ وَأَنَا أَجُرُّهُ نَحْوَ الصَّلَاة فَلَمَّا رَأَيْت ذَلِكَ مِنْهُ قُلْتُ: أَيْنَ الِابْتِدَاءُ بِالصَّلَاةِ؟ فَقَالَ: لَا يَا أَبَا سَعِيدٍ قَدْ تُرِكَ مَا تَعْلَمُ قُلْتُ: كَلَّا وَالَّذِي نَفْسِي بِيَدِهِ لَا تأتون بِخَير مِمَّا أعلم ثَلَاث مَرَّات ثمَّ انْصَرف. رَوَاهُ مُسلم

Narrated Yusuf bin Mahak:

Marwan had been appointed as the governor of Hijaz by Muawiya. He delivered a sermon and mentioned Yazid bin Muawiya so that the people might take the oath of allegiance to him as the successor of his father (Muawiya). Then `Abdur Rahman bin Abu Bakr told him something whereupon Marwan ordered that he be arrested. But `Abdur-Rahman entered `Aisha's house and they could not arrest him. Marwan said, "It is he (`AbdurRahman) about whom Allah revealed this Verse:-- 'And the one who says to his parents: 'Fie on you! Do you hold out the promise to me..?'" On that, `Aisha said from behind a screen, "Allah did not reveal anything from the Qur'an about us except what was connected with the declaration of my innocence (of the slander).

حَدَّثَنَا مُوسَى بْنُ إِسْمَاعِيلَ، حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ يُوسُفَ بْنِ مَاهَكَ، قَالَ كَانَ مَرْوَانُ عَلَى الْحِجَازِ اسْتَعْمَلَهُ مُعَاوِيَةُ، فَخَطَبَ فَجَعَلَ يَذْكُرُ يَزِيدَ بْنَ مُعَاوِيَةَ، لِكَىْ يُبَايِعَ لَهُ بَعْدَ أَبِيهِ، فَقَالَ لَهُ عَبْدُ الرَّحْمَنِ بْنُ أَبِي بَكْرٍ شَيْئًا، فَقَالَ خُذُوهُ‏.‏ فَدَخَلَ بَيْتَ عَائِشَةَ فَلَمْ يَقْدِرُوا ‏{‏عَلَيْهِ‏}‏ فَقَالَ مَرْوَانُ إِنَّ هَذَا الَّذِي أَنْزَلَ اللَّهُ فِيهِ ‏‏{‏وَالَّذِي قَالَ لِوَالِدَيْهِ أُفٍّ لَكُمَا أَتَعِدَانِنِي‏}‏‏.‏ فَقَالَتْ عَائِشَةُ مِنْ وَرَاءِ الْحِجَابِ مَا أَنْزَلَ اللَّهُ فِينَا شَيْئًا مِنَ الْقُرْآنِ إِلاَّ أَنَّ اللَّهَ أَنْزَلَ عُذْرِي‏.‏

'Urwah bin Az-Zubair said:
"When he was the governor of Al-Madinah, Marwan mentioned that a man should perform Wudu' after touching his penis, if he touches it iwth his hand. I did not like that and I said: 'The one who touches it does not have to perform Wudu'.' Marwan said: 'Busrah bint Safwan told me that she heard the Messenger of Allah (PBUH) mention the things for which Wudu' should be performed, and the Messenger of Allah (PBUH) said: 'Wudu' should be performed after touching the penis.' 'Urwah said: 'I continued to argue with Marwan until he called one of his guards and sent him to Busrah to ask her about what Marwan had narrated, and Busrah sent word saying something like that which Marwan had narrated to me from her."

Narrated Anas:

Some (of the Ansar) used to present date palm trees to the Prophet till Banu Quraiza and Banu An- Nadir were conquered (then he returned to the people their date palms). My people ordered me to ask the Prophet to return some or all the date palms they had given to him, but the Prophet had given those trees to Um Aiman. On that, Um Aiman came and put the garment around my neck and said, "No, by Him except Whom none has the right to be worshipped, he will not return those trees to you as he (i.e. the Prophet ) has given them to me." The Prophet go said (to her), "Return those trees and I will give you so much (instead of them)." But she kept on refusing, saying, "No, by Allah," till he gave her ten times the number of her date palms.

حَدَّثَنَا ابْنُ أَبِي الأَسْوَدِ، حَدَّثَنَا مُعْتَمِرٌ، وَحَدَّثَنِي خَلِيفَةُ، حَدَّثَنَا مُعْتَمِرٌ، قَالَ سَمِعْتُ أَبِي، عَنْ أَنَسٍ ـ رضى الله عنه ـ قَالَ كَانَ الرَّجُلُ يَجْعَلُ لِلنَّبِيِّ صلى الله عليه وسلم النَّخَلاَتِ حَتَّى افْتَتَحَ قُرَيْظَةَ وَالنَّضِيرَ، وَإِنَّ أَهْلِي أَمَرُونِي أَنْ آتِيَ النَّبِيَّ صلى الله عليه وسلم فَأَسْأَلَهُ الَّذِينَ كَانُوا أَعْطَوْهُ أَوْ بَعْضَهُ‏.‏ وَكَانَ النَّبِيُّ صلى الله عليه وسلم قَدْ أَعْطَاهُ أُمَّ أَيْمَنَ، فَجَاءَتْ أُمُّ أَيْمَنَ فَجَعَلَتِ الثَّوْبَ فِي عُنُقِي تَقُولُ كَلاَّ وَالَّذِي لاَ إِلَهَ إِلاَّ هُوَ لاَ يُعْطِيكَهُمْ وَقَدْ أَعْطَانِيهَا، أَوْ كَمَا قَالَتْ، وَالنَّبِيُّ صلى الله عليه وسلم يَقُولُ ‏"‏ لَكِ كَذَا ‏"‏‏.‏ وَتَقُولُ كَلاَّ وَاللَّهِ‏.‏ حَتَّى أَعْطَاهَا، حَسِبْتُ أَنَّهُ قَالَ ‏"‏ عَشَرَةَ أَمْثَالِهِ ‏"‏‏.‏ أَوْ كَمَا قَالَ‏.‏

Narrated Umar ibn AbdulAziz:

Al-Mughirah (ibn Shu'bah) said: Umar ibn AbdulAziz gathered the family of Marwan when he was made caliph, and he said: Fadak belonged to the Messenger of Allah (saws), and he made contributions from it, showing repeated kindness to the poor of the Banu Hashim from it, and supplying from it the cost of marriage for those who were unmarried. Fatimah asked him to give it to her, but he refused. That is how matters stood during the lifetime of the Messenger of Allah (saws) till he passed on (i.e. died).

When AbuBakr was made ruler he administered it as the Prophet (saws) had done in his lifetime till he passed on. Then when Umar ibn al-Khattab was made ruler he administered it as they had done till he passed on. Then it was given to Marwan as a fief, and it afterwards came to Umar ibn AbdulAziz.

Umar ibn AbdulAziz said: I consider I have no right to something which the Messenger of Allah (saws) refused to Fatimah, and I call you to witness that I have restored it to its former condition; meaning in the time of the Messenger of Allah (saws).

Abu Dawud said: When 'Umar b. 'Abd al-'Aziz was made caliph its revenue was forty thousand dinars, and when he died its revenue was four hundred dinars. Had he remained alive, it would have been less than it.

حَدَّثَنَا عَبْدُ اللَّهِ بْنُ الْجَرَّاحِ، حَدَّثَنَا جَرِيرٌ، عَنِ الْمُغِيرَةِ، قَالَ جَمَعَ عُمَرُ بْنُ عَبْدِ الْعَزِيزِ بَنِي مَرْوَانَ حِينَ اسْتُخْلِفَ فَقَالَ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَتْ لَهُ فَدَكُ فَكَانَ يُنْفِقُ مِنْهَا وَيَعُودُ مِنْهَا عَلَى صَغِيرِ بَنِي هَاشِمٍ وَيُزَوِّجُ مِنْهَا أَيِّمَهُمْ وَإِنَّ فَاطِمَةَ سَأَلَتْهُ أَنْ يَجْعَلَهَا لَهَا فَأَبَى فَكَانَتْ كَذَلِكَ فِي حَيَاةِ رَسُولِ اللَّهِ صلى الله عليه وسلم حَتَّى مَضَى لِسَبِيلِهِ فَلَمَّا أَنْ وَلِيَ أَبُو بَكْرٍ رضى الله عنه عَمِلَ فِيهَا بِمَا عَمِلَ النَّبِيُّ صلى الله عليه وسلم فِي حَيَاتِهِ حَتَّى مَضَى لِسَبِيلِهِ فَلَمَّا أَنْ وَلِيَ عُمَرُ عَمِلَ فِيهَا بِمِثْلِ مَا عَمِلاَ حَتَّى مَضَى لِسَبِيلِهِ ثُمَّ أَقْطَعَهَا مَرْوَانُ ثُمَّ صَارَتْ لِعُمَرَ بْنِ عَبْدِ الْعَزِيزِ قَالَ - يَعْنِي عُمَرَ بْنَ عَبْدِ الْعَزِيزِ - فَرَأَيْتُ أَمْرًا مَنَعَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم فَاطِمَةَ عَلَيْهَا السَّلاَمُ لَيْسَ لِي بِحَقٍّ وَأَنَا أُشْهِدُكُمْ أَنِّي قَدْ رَدَدْتُهَا عَلَى مَا كَانَتْ يَعْنِي عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏.‏ قَالَ أَبُو دَاوُدَ وَلِيَ عُمَرُ ...

Yahya related to me from Malik that Abdullah ibn Abi Bakr ibn Muhammad ibn Amr ibn Hazim heard Urwa ibn az-Zubayr saying, "I went to see Marwan ibn al-Hakam and we talked about what you had to do wudu for, and Marwan said, 'You have to do wudu if you touch your penis.' Urwa said, 'I didn't know that.' Marwan ibn al-Hakam said that Busra bint Safwan had told him that she heard the Messenger of Allah, may Allah bless him and grant him peace, say, 'If any of you touches his penis he should do wudu.' "

Narrated 'Ata:

One night the Prophet delayed the `Isha' prayer whereupon `Umar went to him and said, "The prayer, O Allah's Apostle! The women and children had slept." The Prophet came out with water dropping from his head, and said, "Were I not afraid that it would be hard for my followers (or for the people), I would order them to pray `Isha prayer at this time." (Various versions of this Hadith are given by the narrators with slight differences in expression but not in content).

Humaid b. 'Abd al-Rahman b. 'Auf reported that Marwan said to Rafi', his chamberlain, that he should go to Ibn 'Abbas and ask him:

If every one of us be punished for his being happy upon his deed and for his being praised for what he has not done, nobody would be saved from the torment. Ibn 'Abbas said: What you have to do with this verse? It has been in fact revealed in connection with the people of the Book." Then Ibn Abbas recited this verse:" When Allah took a covenant from those who had been given the Book: You shall explain it to people and shall not conceal this" (iii. 186), and then Ibn 'Abbas recited this verse:" Think not that those who exult in what they have done and love to be praised for what they have not done" (iii. 186). Ibn 'Abbas (further) said: Allah's Apostle (may peace be upon him) asked them about something and then they concealed that and they told him something else and they went out and they thought that they had informed him as lie had asked them and they felt happy of what they had concealed.

Abu Salih al-Samman reported:

I narrate to you what I heard and saw from Abu Sa'id al-Khudri: One day I was with Abu Sa'id and he was saying prayer on Friday turning to a thing which concealed him from the people when a young man from Banu Mu'ait came there and he tried to pass in front of him; he turned him back by striking his chest. He looked about but finding no other way to pass except in front of Abu Sa'id, made a second attempt. He (Abu Sa'id) turned him away by Striking his chest more vigorously than the first stroke. He stood up and had a scuffle with Abu Sa'id. Then the people gathered there He came out and went to Marwan and complained to him what had happened to him. Abu Sa'id too came to Marwan. Marwin said to him: What has happened to you and the son of your brother that he came to complain against you? Abu Sa'id said: I heard from the Messenger of Allah (may peace be upon him) saying: When any one of you prays facing something which conceals him from people and anyone tries to pass in front of him, he should be turned away, but if he refuses, he should be forcibly restrained from it, for he is a devil.

That Arwa sued him before Marwan for a right, which she claimed, he had deprived her of. On that Sa`id said, "How should I deprive her of her right? I testify that I heard Allah's Apostle saying, 'If anyone takes a span of land unjustly, his neck will be encircled with it down seven earths on the Day of Resurrection."

Yahya related to me from Malik from Sumayy, the mawla of Abu Bakr ibn Abd ar-Rahman ibn al-Harith ibn Hisham that he heard Abu Bakr ibn Abd ar-Rahman ibn al-Harith ibn Hisham say, "My father and I were with Marwan ibn al Hakam at the time when he was amir of Madina, and someone mentioned to him that Abu Hurayra used to say, 'If someone begins the morning junub, he has broken the fast for that day.' Marwan said, 'I swear to you, Abdar-Rahman, you must go to the two umm al muminin, A'isha and Umm Salama, and ask them about it.'

''Abd ar-Rahman went to visit A'isha and I accompanied him. He greeted her and then said, 'Umm al-muminin, we were with Marwan ibn al Hakam and someone mentioned to him that Abu Hurayra used to say that if some one had begun the morning junub, he had broken the fast for that day.' A'isha said, 'It is not as Abu Hurayra says Abd ar-Rahman. Do you dislike what the Messenger of Allah, may Allah bless him and grant him peace, used to do?', and Abd ar-Rahman said, 'No, by Allah.' A'isha said, 'I bear witness that the Messenger of Allah, may Allah bless him and grant him peace, used to get up in the morning junub from intercourse, not a dream, and would then fast for that day.' "

He continued, "Then we went and visited Umm Salama, and Abd ar- Rahman asked her about the same matter and she said the same as A'isha had said. Then we went off until we came to Marwan ibn al-Hakam Abd ar-Rahman told him what they had both said and Marwan said, 'I swear to you, Abu Muhammad, you must use the mount which is at the door, and go to Abu Hurayra, who is on his land at al Aqiq, and tell him this.' So Abd ar-Rahman rode off, and I went with him, until we came to Abu Hurayra. Abd ar-Rahman talked with him for a while, and then mentioned the matter to him, and Abu Hurayra said, 'I don't know anything about it. I was just told that by someone.'"

Ibn Umar was informed about the statement of Aisha that a part of al-Hijr is included in the magnitude of the Ka'bah. Ibn Umar said:

By Allah, I think that she must have heard it from the Messenger of Allah (saws). I think that the Messenger of Allah (saws) had not given up touching both of them but for the reason that they were not on the foundation of the House (the Ka'bah), nor did the people circumambulate (the House) beyond al-Hijr for this reason.

Yahya related to me from Malik that Yahya ibn Said heard Jamil ibn Abd ar-Rahman the Muadhdhin say to Said ibn al-Musayyab, "I am a man who buys whatever Allah wills of the receipts for the provisions which people are offered at al-Jar. I want to take payment for goods that I guarantee to deliver at a future date." Said said to him, "Do you intend to settle these things with receipts for provisions you have bought?" He said, "Yes." So he forbade that.

Malik said, "The generally agreed on way of doing things among us in which there is no dispute, about buying food - wheat, barley, durra-sorghum, pearl millet, or any pulse or anything resembling pulses on which zakat is obliged, or condiments of any sort - oil, ghee, honey, vinegar, cheese, sesame oil, milk and so on, is that the buyer should not re- sell any of that until he has taken possession and complete delivery of it.

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ سَمِعَ جَمِيلَ بْنَ عَبْدِ الرَّحْمَنِ الْمُؤَذِّنَ، يَقُولُ لِسَعِيدِ بْنِ الْمُسَيَّبِ إِنِّي رَجُلٌ أَبْتَاعُ مِنَ الأَرْزَاقِ الَّتِي تُعْطَى النَّاسُ بِالْجَارِ مَا شَاءَ اللَّهُ ثُمَّ أُرِيدُ أَنْ أَبِيعَ الطَّعَامَ الْمَضْمُونَ عَلَىَّ إِلَى أَجَلٍ ‏.‏ فَقَالَ لَهُ سَعِيدٌ أَتُرِيدُ أَنْ تُوَفِّيَهُمْ مِنْ تِلْكَ الأَرْزَاقِ الَّتِي ابْتَعْتَ فَقَالَ نَعَمْ ‏.‏ فَنَهَاهُ عَنْ ذَلِكَ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا الَّذِي لاَ اخْتِلاَفَ فِيهِ أَنَّهُ مَنِ اشْتَرَى طَعَامًا بُرًّا أَوْ شَعِيرًا أَوْ سُلْتًا أَوْ ذُرَةً أَوْ دُخْنًا أَوْ شَيْئًا مِنَ الْحُبُوبِ الْقِطْنِيَّةِ أَوْ شَيْئًا مِمَّا يُشْبِهُ الْقِطْنِيَّةَ مِمَّا تَجِبُ فِيهِ الزَّكَاةُ أَوْ شَيْئًا مِنَ الأُدْمِ كُلِّهَا الزَّيْتِ وَالسَّمْنِ وَالْعَسَلِ وَالْخَلِّ وَالْجُبْنِ وَالشَّبْرَقِ وَاللَّبَنِ وَمَا أَشْبَهَ ذَلِكَ مِنَ الأُدْمِ فَإِنَّ الْمُبْتَاعَ لاَ يَبِيعُ شَيْئًا مِنْ ذَلِكَ حَتَّى يَقْبِضَهُ وَيَسْتَوْفِيَهُ ‏.‏

Yahya related to me from Malik that Muhammad ibn Abdullah ibn Abi Maryam asked Said ibn al-Musayyab's advice. "I am a man who buys food with receipts from al-Jar. Perhaps I will buy something for a dinar and half a dirham, and will be given food for a half." Said said, "No. You give a dirham, and take the rest in food." (A half dirham did not exist as a coin.)

Yahya said that Malik had said from Da'ud ibn al-Husayn that he heard Abu Ghatafan ibn Tarif al-Muriyi say, "Zayd ibn Thabit al-Ansari and Ibn Muti had a dispute about a house which they shared. They went to Marwan ibn al-Hakam who was the Amir of Madina. Marwan decided that Zayd ibn Thabit must take an oath on the mimbar. Zayd ibn Thabit said, 'I swear to it where I am.' Marwan said, 'No, by Allah! only in the place of sorting out claims (i.e. the mimbar).' Zayd ibn Thabit began to take an oath that his right was true, and he refused to take an oath near the mimbar. Marwan ibn al-Hakam began to wonder at that."

Malik said, "I do not think that anyone should be made to take an oath near the mimbar for less than a fourth of a dinar, and that is three dirhams."

Sa'id b. 'Abd al- `Aziz said:
During the days of the battle of the harra[*] neither the call to prayer nor the declaration that the time for prayer had come was made for three days at the Prophet's Mosque. Sa'id b. al-Musayyib did not leave the mosque, and the only means by which he knew the time for prayer was a whinnying he heard coming from the Prophet's grave. *When the people of Medina rebelled against the Umayyad Caliph Yazid he sent an army under Muslim b. 'Uqba al-Murri towards the end of 63 A.H. The Medina troops were defeated in a battle known by the name given above. Darimi transmitted it.

Narrated 'Ubaidullah bin 'Abdullah bin 'Utbah:
It was narrated from 'Ubaidullah bin 'Abdullah bin 'Utbah that during the reign of Marwan, 'Abdullah bin 'Amr bin 'Uthman, who was a young man, issued a final divorce to the daughter of Sa'eed bin Zaid, whose mother was Bint Qais. Her maternal aunt, Fatimah bint Qais, sent word to her telling her to move from the house of 'Abdullah bin 'Amr. Marwan heard of that and he sent word to the daughter of Sa'eed, telling her to go back to her home, and asking her why she had moved from her home before her 'Iddah was over? She sent word to him telling him that her maternal aunt had told her to do that. Fatimah bint Qais said that she had been married to Abu 'Amr bin Hafs, and when the Messenger of Allah appointed 'Ali bin Abi Talib as governor of Yemen, he went out with him and sent word to her that she was divorced with the third Talaq. He told Al-Harith bin Hisham and 'Ayyash bin Abi Rai'ah to spend on her. She sent word to Al-Harith and 'Ayyash asking them what her husband had told them to spend on her, and they said: 'By Allah, she has no right to any maintenance from us, unless she is pregnant, and she cannot come into our home without our permission.' She said that she came to the Messenger of Allah and told him about that, and he stated that they were correct. Fatimah said: 'Where should I move to, O Messenger of Allah?' He said: 'Move to the home of Ibn Umm Maktum, the blind man whom Allah, the Mighty and Sublime, named in His Book.' Fatimah said: 'So I observed my 'Iddah there. He was a man who has lost his sight, so I used to take off my garments in his house, until the Messenger of Allah married me to Usamah bin Zaid.' Marwan criticized her for that and said: 'I have never heard this Hadith from anyone before you. I will continue to follow the ruling that the people have been following.'"

'Ata' reported:

The House was burnt during the time of Yazid b. Muawiya when the people of Syria had fought (in Mecca). And it happened with it (the Ka'ba) what was (in store for it). Ibn Zubair (Allah be pleased with him) felt it (in the same state) until the people came in the season (of Hajj). (The idea behind was) that he wanted to exhort them or incite them (to war) against the people of Syria. When the people had arrived he said to them: O people, advise me about the Ka'ba. Should I demolish it and then build it from its very foundation, or should I repair whatever has been damaged of it? Ibn 'Abbas said: An idea has occurred to me according to which I think that you should only repair (the portion which has been) damaged, and leave the House (in that very state in which) people embraced Islam (and leave those very stones in the same state) when people embraced Islam, and over which Allah's Apostle (may peace be upon him) had raised it. Thereupon Ibn Zubair said: It the house of any one of you is burnt, he would not be contented until he had reconstructed it, then what about the House of your Lord (which is far more Important than your house)? I would seek good advice from my Lord thrice and then I would make up (my mind) about this affair. After seeking good advice thrice, he made up his mind to demolish it. The people apprehended that calamity might fall from heaven on those persons who would be first to climb (over the building for the purpose of demolishing it), till one (took up courage, and ascended the roof), and threw down one of its stones. When the people saw no calamity befalling him, they followed him, demolished it until it was razed to the ground. Then Ibn Zubair erected pillars and hung cartains on them (in order to provide facilities to the people for observing the time of its construction). And the walls were raised; and Ibn Zubair said: I heard 'A'isha (Allah be pleased with her) say that Allah's Apostle (may peace be upon him) had observed: If the people had Rot recently (abandoned) unbelief, find I had means enough to reconstruct it, which I had not, I would have definitely excompassed in it five cubits of area from Hijr. And I would also have constructed a door for the people to enter, and a door for their exit. I today have (the means to spend) and I entertain no fearfrom the side of people (that they would protest against this change). So he added five cubits of area from the side of Hatim to it that there appeared (the old) foundation (upon which Hadrat Ibrahim had built the Ka'ba). and the people saw that and it was upon this foundation that the wall was raised. The length of the Ka'ba was eighteen cubits. when addition was made to it (which was in its breadth), then naturally the length appears to be) small (as compared with its breadth). Then addition of ten cubits (of area) was made in its length (also). Two doors were also constructed, one of which (was meant) for entrance and the other one for exit. When Ibn Zubair (Allah be pleased with him) was killed, Hajjaj wrote to 'Abd al-Malik (b. Marwan) informing him about it, and telling him that Ibn Zubair (Allah be pleased with him) had built (the Ka'ba) on those very foundations (which were laid by Ibrahim) and which reliable persons among the Meccans had seen. 'Abd al-Malik wrote to him: We are not concerned with the censuring of Ibn Zubair in anything. Keep intact the addition made by him in the side of length, and whatever he has added frem the side of Hijr revert to (its previous) foundation, and wall up the door which he had opened. Thus Hajjaj at the command of Abd al-Malik) demolished it (that portion) and rebuilt it on (its previous) foundations.

Yahya related to me from Malik that he had heard that the people of knowledge did not disapprove of people fasting using tooth-sticks at any hour of the day in Ramadan, whether at the beginning or the end, nor had he heard any of the people of knowledge disapproving of or forbidding the practice.

Yahya said that he heard Malik say, about fasting for six days after breaking the fast at the end of Ramadan, that he had never seen any of the people of knowledge and fiqh fasting them. He said, "I have not heard that any of our predecessors used to do that, and the people of knowledge disapprove of it and they are afraid that it might become a bida and that common and ignorant people might join to Ramadan what does not belong to it, if they were to think that the people of knowledge had given permission for that to be done and were seen doing it.

Yahya said that he heard Malik say, "I have never heard any of the people of knowledge and fiqh and those whom people take as an example forbidding fasting on the day of jumua. Fasting on it is good, and I have seen one of the people of knowledge fasting it, and it seemed to me that he was keen to do so."

Hisham b. Urwa reported on the authority of his father (Allah be pleased with him) that Arwa bint Uwais disputed with Sa'id b. Zaid that he had seized some of the land belonging to her. She brought this dispute before Marwan b. al-Hakam. Sa'id said:

How could I take a part of her land, after what I heard from Allah's Messenger (may peace be upon'him)? He (Marwan) said: What did you hear from Allah's Messenger (may peace be upon him)? He said: I heard Allah's Messenger (may peace be upon him) say: He who wrongly took a span of land would be made to wear around his neck seven earths. Marwan said: I do not ask any evidence from you after this. He (Sa'id) said: O Allah, make her blind if she has told a lie and kill her in her own land. He (the narrator) said: She did not die until she had lost her eyesight, and (one day) as she was walking in her land, she fell down into a pit and died.

Narrated Ibn `Umar:

Allah's Apostle said, "Your stay (in this world) in comparison to the stay of the nations preceding you, is like the period between `Asr prayer and the sun set (in comparison to a whole day). The people of the Torah were given the Torah and they acted on it till midday and then they were unable to carry on. And they were given (a reward equal to) one Qirat each. Then the people of the Gospel were given the Gospel and they acted on it till `Asr Prayer and then they were unable to carry on, so they were given la reward equal to) one Qirat each. Then you were given the Qur'an and you acted on it till sunset, therefore you were given (a reward equal to) two Qirats each. On that, the people of the Scriptures said, 'These people (Muslims) did less work than we but they took a bigger reward.' Allah said (to them). 'Have I done any oppression to you as regards your rights?' They said, "No." Then Allah said, 'That is My Blessing which I grant to whomsoever I will.' "

Yahya related to me from Malik from Abd ar-Rahman ibn al-Qasim from his father that a man of Thaqif gave his wife command over herself, and she said, "You are divorced." He was silent. She said, "You are divorced." He said, "May a stone be in your mouth." She said, "You are divorced." He said, "May a stone be in your mouth." They argued and went to Marwan ibn al-Hakam. He took an oath that he had only given her control over one pronouncement, and then she returned to him.

Malik said that Abd ar-Rahman declared that this decision had amazed al-Qasim, who thought it the best that he had heard on the subject.

Malik added, "That is also the best of what I have heard on the subject."

Abu Zur'a reported that three persons amongst Muslims had been sitting in Medina in the presence of Marwan b. Hakam and they heard him narrate these signs from him and the first amongst them was the appearance of the Dajjal. 'Abdullah b. 'Amr reported that Marwin said nothing (particular in this connection). I, however, heard a hadith from Allah's Messenger (may peace be upon him) and I did not forget that after I had heard that from Allah's Apostle (may peace be upon him) and he reported a hadith like the foregoing.

that Marwan bin Al-Hakam said: "Go O Rafi' - who was his gate-keeper - "to Ibn 'Abbas and say to him: 'If every person who rejoices with what he has done, and loves to be praised for what he has not done, will be punished, then we will all be punished.' So Ibn 'Abbas said: 'This Ayah has got nothing to do with you. This was only revealed about the People of the Book.' Then Ibn 'Abbas recited: "When Allah took a covenant from those who were given the Scripture to make it known and clear to mankind... (3:187)" and he recited: "Think not that those who rejoice in what they have done, and love to be praised for what they have not done... (3:188)" Ibn 'Abbas said: 'The Prophet (SAW) asked them about something, and they concealed it, and told him about something else. So they left wanting him to think that they informed him about what he asked them, and wanting to be praised for that by him, and they were rejoicing over what they had concealed, and the fact that they were asked about it."

Narrated Abu Al-Minhal:

When Ibn Ziyad and Marwan were in Sham and Ibn Az-Zubair took over the authority in Mecca and Qurra' (the Kharijites) revolted in Basra, I went out with my father to Abu Barza Al-Aslami till we entered upon him in his house while he was sitting in the shade of a room built of cane. So we sat with him and my father started talking to him saying, "O Abu Barza! Don't you see in what dilemma the people has fallen?" The first thing heard him saying "I seek reward from Allah for myself because of being angry and scornful at the Quraish tribe. O you Arabs! You know very well that you were in misery and were few in number and misguided, and that Allah has brought you out of all that with Islam and with Muhammad till He brought you to this state (of prosperity and happiness) which you see now; and it is this worldly wealth and pleasures which has caused mischief to appear among you. The one who is in Sham (i.e., Marwan), by Allah, is not fighting except for the sake of worldly gain: and those who are among you, by Allah, are not fighting except for the sake of worldly gain; and that one who is in Mecca (i.e., Ibn Az-Zubair) by Allah, is not fighting except for the sake of worldly gain."

Narrated Nafi`:

The people used to say that Ibn `Umar had embraced Islam before `Umar. This is not true. What happened is that `Umar sent `Abdullah to bring his horse from an Ansari man so as to fight on it. At that time the people were giving the Pledge of allegiance to Allah's Apostle near the Tree, and `Umar was not aware of that. So `Abdullah (bin `Umar) gave the Pledge of Allegiance (to the Prophet) and went to take the horse and brought it to `Umar. While `Umar was putting on the armor to get ready for fighting, `Abdullah informed him that the people were giving the Pledge of allegiance to Allah's Apostle beneath the Tree. So `Umar set out and `Abdullah accompanied him till he gave the Pledge of allegiance to Allah's Apostle, and it was this event that made people say that Ibn `Umar had embraced Islam before `Umar.

حَدَّثَنِي شُجَاعُ بْنُ الْوَلِيدِ، سَمِعَ النَّضْرَ بْنَ مُحَمَّدٍ، حَدَّثَنَا صَخْرٌ، عَنْ نَافِعٍ، قَالَ إِنَّ النَّاسَ يَتَحَدَّثُونَ أَنَّ ابْنَ عُمَرَ، أَسْلَمَ قَبْلَ عُمَرَ، وَلَيْسَ كَذَلِكَ، وَلَكِنْ عُمَرُ يَوْمَ الْحُدَيْبِيَةِ أَرْسَلَ عَبْدَ اللَّهِ إِلَى فَرَسٍ لَهُ عِنْدَ رَجُلٍ مِنَ الأَنْصَارِ يَأْتِي بِهِ لِيُقَاتِلَ عَلَيْهِ، وَرَسُولُ اللَّهِ صلى الله عليه وسلم يُبَايِعُ عِنْدَ الشَّجَرَةِ، وَعُمَرُ لاَ يَدْرِي بِذَلِكَ، فَبَايَعَهُ عَبْدُ اللَّهِ، ثُمَّ ذَهَبَ إِلَى الْفَرَسِ، فَجَاءَ بِهِ إِلَى عُمَرَ، وَعُمَرُ يَسْتَلْئِمُ لِلْقِتَالِ، فَأَخْبَرَهُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم يُبَايِعُ تَحْتَ الشَّجَرَةِ ـ قَالَ ـ فَانْطَلَقَ فَذَهَبَ مَعَهُ حَتَّى بَايَعَ رَسُولَ اللَّهِ صلى الله عليه وسلم، فَهِيَ الَّتِي يَتَحَدَّثُ النَّاسُ أَنَّ ابْنَ عُمَرَ أَسْلَمَ قَبْلَ عُمَرَ‏ .‏

'A'isha reported:

The Apostle of Allah (may peace be upon him) one night delayed (observing the 'Isya' prayer) till a great part of the night was over and the people in the mosque had gone to sleep. He (the Holy Prophet) then came out and observed prayer and said: This is the proper time for it; were it not that I would impose a burden on my people (I would normally pray at this time). In the hadith transmitters by 'Abd al-Razzaq (the words are):" Were it not that it would impose burden on my people."

I saw the Messenger of Allah (may peace be upon him) reciting Surah Fath on his camel on the day of the Conquest of Mecca. He (the narrator) said: Ibn Mughaffal recited it and repeated it. Mu'awiya said: Had there been (no crowed of) people, I would have given a practical demonstration of that which Ibn Mughaffal had mentioned from the Apostle of Allah (may peace be upon him).

Anas bin Malik said, "Once the time of the prayer became due and the people whose houses were close to the Mosque went to their houses to perform ablution, while the others remained (sitting there). A stone pot containing water was brought to the Prophet, who wanted to put his hand in it, but It was too small for him to spread his hand in it, and so he had to bring his fingers together before putting his hand in the pot. Then all the people performed the ablution (with that water)." I asked Anas, "How many persons were they." He replied, "There were eighty men."

Narrated Ibn Juraij:

`Ata' told me that he had heard Jabir bin `Abdullah saying, "The Prophet stood up to offer the prayer of the `Id ul Fitr. He first offered the prayer and then delivered the Khutba. After finishing it he got down (from the pulpit) and went towards the women and advised them while he was leaning on Bilal's hand. Bilal was spreading out his garment where the women were putting their alms." I asked `Ata' whether it was the Zakat of `Id ul Fitr. He said, "No, it was just alms given at that time. Some lady put her finger ring and the others would do the same." I said, (to `Ata'), "Do you think that it is incumbent upon the Imam to give advice to the women (on `Id day)?" He said, "No doubt, it is incumbent upon the Imams to do so and why should they not do so?"

Abu Zur'a reported:

I visited the house of Marwan in the company of Abu Huraira and he found pictures there. whereupon he said: I heard Allah's Messenger (may peace be upon him) as saying: Allah, the Glorious and Exalted, said: Who is a more wrongdoer than one who tries to create creation like Mine creation. Let him create an atom or a grain of wheat or that of barley. This hadith has been transmitted on the authority of Abu Zur'a and he said: Abu Huraira went to the house of Sa'ld or Marwan which they had built in Medina and he (Abu Huraira) saw a painter who had been painting pictures in his house, whereupon he told that Allah's Messenger (may peace be upon him) had said like this, but he made no mention of the words:" Let him create the grain of barley."

Sunan an-Nasa'i 2771
It was narrated that Al-Miswar bin Makhramah and Marwan bin Al-Hakam said:
"The Messenger of Allah went out during the time of Al-Hudabiyah with between one-thousand and three-hundred, and one-thousand and five-hundred of his Companions. Then, when they were in Dhul-Hulaifah, he garlanded and marked the Hadi and began the Talbiyah for 'Umrah (Abridged).

Narrated Marwan bin Al-Hakam and Al-Miswar bin Makhrama:

When the delegates of the tribe of Hawazin came to the Prophet they requested him to return their property and their captives. He said to them, "This concerns also other people along with me as you see, and the best statement to me is the true one, so you may choose one of two alternatives; either the captives or the property and (I have not distributed the booty for) I have been waiting for you." When the Prophet had returned from Ta'if, he waited for them for more than ten nights. When they came to know that the Prophet would not return except one of the two, they chose their captives. The Prophet then stood up amongst the Muslims, Glorified and Praised Allah as He deserved, and then said, "Then after: These brothers of yours have come to you with repentance and I see it proper to return their captives, so whoever amongst you likes to do that as a favor, then he can do it, and whoever of you wants to stick to his share till we pay him from the very first Fai (i.e. war booty) which Allah will give us, then he can do so." The people said, "We return (the captives) to them willingly as a favor, O Allah's Apostle!" The Prophet said, "I do not know who of you has given his consent and who has not; so go back and your leaders may present your decision to me." The people went away, and their leaders discussed the matter with them, and then came to the Prophet to tell him that all of them had given their consent (to return the captives) willingly. (Az-Zuhn, the sub-narrator said, "This is what we know about the captives, of Hawazin.")

حَدَّثَنَا يَحْيَى بْنُ بُكَيْرٍ، حَدَّثَنَا اللَّيْثُ، عَنْ عُقَيْلٍ، عَنِ ابْنِ شِهَابٍ، عَنْ عُرْوَةَ، أَنَّ مَرْوَانَ بْنَ الْحَكَمِ، وَالْمِسْوَرَ بْنَ مَخْرَمَةَ، أَخْبَرَاهُ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ حِينَ جَاءَهُ وَفْدُ هَوَازِنَ مُسْلِمِينَ، فَسَأَلُوهُ أَنْ يَرُدَّ إِلَيْهِمْ أَمْوَالَهُمْ وَسَبْيَهُمْ فَقَالَ لَهُمْ ‏"‏ مَعِي مَنْ تَرَوْنَ، وَأَحَبُّ الْحَدِيثِ إِلَىَّ أَصْدَقُهُ، فَاخْتَارُوا إِحْدَى الطَّائِفَتَيْنِ إِمَّا السَّبْىَ وَإِمَّا الْمَالَ، وَقَدْ كُنْتُ اسْتَأْنَيْتُ ‏"‏‏.‏ وَكَانَ النَّبِيُّ صلى الله عليه وسلم انْتَظَرَهُمْ بِضْعَ عَشْرَةَ لَيْلَةً حِينَ قَفَلَ مِنَ الطَّائِفِ، فَلَمَّا تَبَيَّنَ لَهُمْ أَنَّ النَّبِيَّ صلى الله عليه وسلم غَيْرُ رَادٍّ إِلَيْهِمْ إِلاَّ إِحْدَى الطَّائِفَتَيْنِ قَالُوا فَإِنَّا نَخْتَارُ سَبْيَنَا‏.‏ فَقَامَ فِي الْمُسْلِمِينَ فَأَثْنَى عَلَى اللَّهِ بِمَا هُوَ أَهْلُهُ ثُمَّ قَالَ ‏"‏ أَمَّا بَعْدُ فَإِنَّ إِخْوَانَكُمْ هَؤُلاَءِ جَاءُونَا تَائِبِينَ، وَإِنِّي رَأَيْتُ أَنْ ...

'Urwa b. az-Zubair told that Arwa daughter of Aus brought a dispute with Sa'id b. Zaid b. `Amr b. Nufail before Marwan b. al-Hakam claiming he had taken some of her land. Sa'id said, "Would I take any of her land after what I heard from God's messenger?" He was asked what he had heard from God's messenger and replied that he had heard him say, "If anyone takes a span of land wrongfully it will be tied round him like a necklace to a depth of seven earths." Marwan said he would ask him for no proof after that, and Sa'id said, "0 God, if she is lying make her blind and kill her in her land." Urwa said she did not die till after she had lost her eyesight. And while she was walking on her land she fell into a hole and died. (Bukhari and Muslim.) Something to the same effect is given in a version by Muslim on the authority of Muhammad b. Zaid b. `Abdallah b. `Umar who said he had seen her blind, feeling for walls, and saying she had been smitten by Sa'id's curse; and that she had come past a well in the region about which she had disputed with him and fallen into it, and it was her grave. عَن عُرْوَة بن الزبير أَنَّ سَعِيدُ بْنُ زَيْدِ بْنِ عَمْرِو بْنِ نُفَيْلٍ خاصمته أروى بنت أويس إِلَى مَرْوَانَ بْنِ الْحَكَمِ وَادَّعَتْ أَنَّهُ أَخَذَ شَيْئًا مِنْ أَرْضِهَا فَقَالَ سَعِيدٌ أَنَا كُنْتُ آخُذُ مِنْ أَرْضِهَا شَيْئًا بَعْدَ الَّذِي سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ وماذا سَمِعْتُ مِنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ مَنْ أَخَذَ شِبْرًا مِنَ الْأَرْضِ ظُلْمًا طُوِّقَهُ إِلَى سَبْعِ أَرَضِينَ فَقَالَ لَهُ مَرْوَانُ لَا أَسْأَلُكَ بَيِّنَةً بَعْدَ هَذَا فَقَالَ اللَّهُمَّ إِن كَانَت كَاذِبَة فَعم بَصَرَهَا وَاقْتُلْهَا فِي أَرْضِهَا قَالَ فَمَا مَاتَتْ حَتَّى ذهب بصرها ثمَّ بَينا هِيَ تَمْشِي فِي أَرْضِهَا إِذْ وَقَعَتْ فِي حُفْرَةٍ فَمَاتَتْ. مُتَّفَقٌ عَلَيْهِ وَفِي رِوَايَةٍ لِمُسْلِمٍ عَنْ مُحَمَّدِ بْنِ زَيْدِ بْنِ عَبْدِ اللَّهِ بْنِ عُمَرَ بِمَعْنَاهُ وَأَنَّهُ رَآهَا عَمْيَاءَ تَلْتَمِسُ الْجُدُرَ تَقُولُ: أَصَابَتْنِي دَعْوَةُ سَعِيدٍ وَأَنَّهَا مَرَّتْ على بئرٍ فِي الدَّار الَّتِي خاصمته فَوَقَعت فِيهَا فَكَانَت قبرها

Narrated Abu Sa`id Al-Khudri:

While I was present in one of the gatherings of the Ansar, Abu Musa came as if he was scared, and said, "I asked permission to enter upon `Umar three times, but I was not given the permission, so I returned." (When `Umar came to know about it) he said to Abu Musa, "Why did you not enter?'. Abu Musa replied, "I asked permission three times, and I was not given it, so I returned, for Allah's Apostle said, "If anyone of you asks the permission to enter thrice, and the permission is not given, then he should return.' " `Umar said, "By Allah! We will ask Abu Musa to bring witnesses for it." (Abu Musa went to a gathering of the Ansar and said). "Did anyone of you hear this from the Prophet ?" Ubai bin Ka`b said, "By Allah, none will go with you but the youngest of the people (as a witness)." (Abu Sa`id) was the youngest of them, so I went with Abu Musa and informed `Umar that the Prophet had said so. (See Hadith No. 277, Vol. 3)

حَدَّثَنَا عَلِيُّ بْنُ عَبْدِ اللَّهِ، حَدَّثَنَا سُفْيَانُ، حَدَّثَنَا يَزِيدُ بْنُ خُصَيْفَةَ، عَنْ بُسْرِ بْنِ سَعِيدٍ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، قَالَ كُنْتُ فِي مَجْلِسٍ مِنْ مَجَالِسِ الأَنْصَارِ إِذْ جَاءَ أَبُو مُوسَى كَأَنَّهُ مَذْعُورٌ فَقَالَ اسْتَأْذَنْتُ عَلَى عُمَرَ ثَلاَثًا، فَلَمْ يُؤْذَنْ لِي فَرَجَعْتُ فَقَالَ مَا مَنَعَكَ قُلْتُ اسْتَأْذَنْتُ ثَلاَثًا، فَلَمْ يُؤْذَنْ لِي فَرَجَعْتُ، وَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِذَا اسْتَأْذَنَ أَحَدُكُمْ ثَلاَثًا فَلَمْ يُؤْذَنْ لَهُ، فَلْيَرْجِعْ ‏" ‏‏.‏ فَقَالَ وَاللَّهِ لَتُقِيمَنَّ عَلَيْهِ بِبَيِّنَةٍ‏.‏ أَمِنْكُمْ أَحَدٌ سَمِعَهُ مِنَ النَّبِيِّ صلى الله عليه وسلم فَقَالَ أُبَىُّ بْنُ كَعْبٍ وَاللَّهِ لاَ يَقُومُ مَعَكَ إِلاَّ أَصْغَرُ الْقَوْمِ، فَكُنْتُ أَصْغَرَ الْقَوْمِ، فَقُمْتُ مَعَهُ فَأَخْبَرْتُ عُمَرَ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ذَلِكَ‏.‏ وَقَالَ ابْنُ الْمُبَارَكِ أَخْبَرَنِي ابْنُ عُيَيْنَةَ ...

Narrated Haritha bin Wahab:

I heard the Prophet saying, "O people! Give in charity as a time will come upon you when a person will wander about with his object of charity and will not find anybody to accept it, and one (who will be requested to take it) will say, "If you had brought it yesterday, would have taken it, but today I am not in need of it."

حَدَّثَنَا آدَمُ، حَدَّثَنَا شُعْبَةُ، حَدَّثَنَا مَعْبَدُ بْنُ خَالِدٍ، قَالَ سَمِعْتُ حَارِثَةَ بْنَ وَهْبٍ، قَالَ سَمِعْتُ النَّبِيَّ صلى الله عليه وسلم يَقُولُ ‏"‏ تَصَدَّقُوا فَإِنَّهُ يَأْتِي عَلَيْكُمْ زَمَانٌ يَمْشِي الرَّجُلُ بِصَدَقَتِهِ، فَلاَ يَجِدُ مَنْ يَقْبَلُهَا يَقُولُ الرَّجُلُ لَوْ جِئْتَ بِهَا بِالأَمْسِ لَقَبِلْتُهَا، فَأَمَّا الْيَوْمَ فَلاَ حَاجَةَ لِي بِهَا ‏"‏‏.‏

Malik related to me that he heard Ibn Shihab say, "The stray camels in the time of Umar ibn al-Khattab were numerous and left alone. No one touched them until the time of Uthman ibn Affan. He ordered that they be publicised and then sold, and if the owner came afterwards, he was given their price."

وَحَدَّثَنِي مَالِكٌ، أَنَّهُ سَمِعَ ابْنَ شِهَابٍ، يَقُولُ كَانَتْ ضَوَالُّ الإِبِلِ فِي زَمَانِ عُمَرَ بْنِ الْخَطَّابِ إِبِلاً مُؤَبَّلَةً تَنَاتَجُ لاَ يَمَسُّهَا أَحَدٌ حَتَّى إِذَا كَانَ زَمَانُ عُثْمَانَ بْنِ عَفَّانَ أَمَرَ بِتَعْرِيفِهَا ثُمَّ تُبَاعُ فَإِذَا جَاءَ صَاحِبُهَا أُعْطِيَ ثَمَنَهَا ‏.‏
