Sahih Muslim 68

It is narrated on the authority of Jarir that he heard (the Holy Prophet) saying, The slave who fled from his master committed an act of infidelity as long as he would not return to him. Mansur observed:

By God, this hadith was narrated from the Apostle (may peace and blessings be upon him), but I do not like that this should be narrated on my authority here in Basra.
حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ السَّعْدِيُّ، حَدَّثَنَا إِسْمَاعِيلُ، - يَعْنِي ابْنَ عُلَيَّةَ - عَنْ مَنْصُورِ بْنِ عَبْدِ الرَّحْمَنِ، عَنِ الشَّعْبِيِّ، عَنْ جَرِيرٍ، أَنَّهُ سَمِعَهُ يَقُولُ ‏"‏ أَيُّمَا عَبْدٍ أَبَقَ مِنْ مَوَالِيهِ فَقَدْ كَفَرَ حَتَّى يَرْجِعَ إِلَيْهِمْ ‏" ‏ ‏.‏ قَالَ مَنْصُورٌ قَدْ وَاللَّهِ رُوِيَ عَنِ النَّبِيِّ صلى الله عليه وسلم وَلَكِنِّي أَكْرَهُ أَنْ يُرْوَى عَنِّي هَا هُنَا بِالْبَصْرَةِ ‏.‏

Ubayd Allah bin Umar al-Qawārīrī narrated to us, Hammād bin Zayd narrated to us, he said:
‘A man kept company with Ayyūb and listened [to Ḥadīth] from him, but then Ayyūb did not find him [one day]. [When Ayyūb asked, the people] said: ‘Oh Abā Bakr, indeed he keeps company with Amr bin Ubayd [now]’. Hammād said: ‘One day we were with Ayyūb, and we went to the market early in the morning. A man came to meet Ayyūb so he gave Salām to him, asked how he was doing, and then Ayyūb said to him: ‘It reached me that you kept company with that man’. Hammād said: ‘[Ayyūb] designated him, that is to say ‘Amr’.’ [The man] said: ‘Yes, Oh Abā Bakr. Indeed he came to us with strange things [i.e. reports]’. Ayyūb said to him: ‘Indeed we flee…’ or ‘…we fear from these strange things [transmissions]’.
وَحَدَّثَنَا عُبَيْدُ اللَّهِ بْنُ عُمَرَ الْقَوَارِيرِيُّ، حَدَّثَنَا حَمَّادُ بْنُ زَيْدٍ، قَالَ كَانَ رَجُلٌ قَدْ لَزِمَ أَيُّوبَ وَسَمِعَ مِنْهُ فَفَقَدَهُ أَيُّوبُ فَقَالُوا يَا أَبَا بَكْرٍ إِنَّهُ قَدْ لَزِمَ عَمْرَو بْنَ عُبَيْدٍ ‏.‏ قَالَ حَمَّادٌ فَبَيْنَا أَنَا يَوْمًا مَعَ أَيُّوبَ وَقَدْ بَكَّرْنَا إِلَى السُّوقِ فَاسْتَقْبَلَهُ الرَّجُلُ فَسَلَّمَ عَلَيْهِ أَيُّوبُ وَسَأَلَهُ ثُمَّ قَالَ لَهُ أَيُّوبُ بَلَغَنِي أَنَّكَ لَزِمْتَ ذَاكَ الرَّجُلَ ‏.‏ قَالَ حَمَّادٌ سَمَّاهُ ‏.‏ يَعْنِي عَمْرًا ‏.‏ قَالَ نَعَمْ يَا أَبَا بَكْرٍ إِنَّهُ يَجِيئُنَا بِأَشْيَاءَ غَرَائِبَ ‏.‏ قَالَ يَقُولُ لَهُ أَيُّوبُ إِنَّمَا نَفِرُّ أَوْ نَفْرَقُ مِنْ تِلْكَ الْغَرَائِبِ ‏.‏

Narrated Ibn Mas`ud:

The Prophet used to take care of us in preaching by selecting a suitable time, so that we might not get bored. (He abstained from pestering us with sermons and knowledge all the time).

Sunan an-Nasa'i 68
It was narrated from Kabshah bint Ka'b bin Malik that Abu Qatadah entered upon her, then she narrated the following:
"I poured some water from him for Wudu', and a cat came and drank from it, so he tilted the vessel for it to drink." Kabshah said: "He saw me looking at him and said: 'Are you surprised, O daughter of my brother?' I said: 'Yes.' He said: 'The Messenger of Allah (PBUH) said: They are not impure, rather they are among the males and females (animals) who go around among you."
أَخْبَرَنَا قُتَيْبَةُ، عَنْ مَالِكٍ، عَنْ إِسْحَاقَ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي طَلْحَةَ، عَنْ حُمَيْدَةَ بِنْتِ عُبَيْدِ بْنِ رِفَاعَةَ، عَنْ كَبْشَةَ بِنْتِ كَعْبِ بْنِ مَالِكٍ، أَنَّ أَبَا قَتَادَةَ، دَخَلَ عَلَيْهَا ثُمَّ ذَكَرَتْ كَلِمَةً مَعْنَاهَا فَسَكَبْتُ لَهُ وَضُوءًا فَجَاءَتْ هِرَّةٌ فَشَرِبَتْ مِنْهُ فَأَصْغَى لَهَا الإِنَاءَ حَتَّى شَرِبَتْ - قَالَتْ كَبْشَةُ - فَرَآنِي أَنْظُرُ إِلَيْهِ فَقَالَ أَتَعْجَبِينَ يَا ابْنَةَ أَخِي فَقُلْتُ نَعَمْ ‏.‏ قَالَ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ إِنَّهَا لَيْسَتْ بِنَجَسٍ إِنَّمَا هِيَ مِنَ الطَّوَّافِينَ عَلَيْكُمْ وَالطَّوَّافَاتِ ‏"‏ ‏.‏

Narrated Abdullah ibn Abbas:

One of the wives of the Prophet (saws) took a bath from a large bowl. The Prophet (saws) wanted to perform ablution or take from the water left over. She said to him: O Prophet of Allah, verily I was sexually defiled. The Prophet said: Water not defiled.

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا أَبُو الأَحْوَصِ، حَدَّثَنَا سِمَاكٌ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، قَالَ اغْتَسَلَ بَعْضُ أَزْوَاجِ النَّبِيِّ صلى الله عليه وسلم فِي جَفْنَةٍ فَجَاءَ النَّبِيُّ صلى الله عليه وسلم لِيَتَوَضَّأَ مِنْهَا - أَوْ يَغْتَسِلَ - فَقَالَتْ لَهُ يَا رَسُولَ اللَّهِ إِنِّي كُنْتُ جُنُبًا ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِنَّ الْمَاءَ لاَ يَجْنُبُ ‏"‏ ‏.‏

It was narrated that Abu Bakr bin Abi Zuhair said:
I was told that Abu Bakr said: O Messenger of Allah, how could we be in a good state after this verse: “It will not be in accordance with your desires (Muslims), nor those of the people of the Scripture (Jews and Christians), whosoever works evil, will have the recompense thereof` fan-Nisa' 4:123]? Will we be punished for every bad deed we do? There Messenger of Allah (ﷺ) said: `May Allah forgive you, O Abu Bakr, do you not fall sick? Do you not get exhausted? Do you not feel sad? Don't calamities befall you?` He said: Of course. He said: `That is the recompense you are given.`

It was narrated that Abu Hurairah said:
"The Messenger of Allah (SAW) said: 'By the One in whose Hand is my soul! You will not enter Paradise until you believe, and you will not (truly) believe until you love one another. Shall I not tell you of something which, if you do it, you will love one another? Spread the greetings of Salam amongst yourselves.'"

Allah’s Messenger said (Allah bless him and give him peace): “You should acquire white clothes, so that your living ones may wear them, and you can shroud your deceased in them, for they are among the best of your clothes.”

'Abdullah ibn 'Amr reported that the Prophet, may Allah bless him and grant him peace, said, "The one who maintains ties of kinship is not the one who reciprocates. The one who maintains ties of kinship is the one who, when his relatives cut him off, maintains ties of kinship."

Narrated ‘Aisha (rad):
Fatima bint Abu Hubaish came to the Prophet (saw) and said, “O Messenger of Allah, I am a woman whose blood keeps flowing (even after the menstruation). I am never purified; should I, therefore, stop praying?” He (the Prophet) said, “No, for that is only a vein, and is not menstruation. So when the menstruation comes, abstain from prayers, and when it ends wash the blood from yourself and then pray”. [Agreed upon].
وَعَنْ عَائِشَةَ رَضِيَ اَللَّهُ عَنْهَا قَالَتْ: { جَاءَتْ فَاطِمَةُ بِنْتُ أَبِي حُبَيْشٍ إِلَى اَلنَّبِيِّ ‏- صلى الله عليه وسلم ‏-فَقَالَتْ: يَا رَسُولَ اَللَّهِ! إِنِّي اِمْرَأَةٌ أُسْتَحَاضُ فَلَا أَطْهُرُ, أَفَأَدَعُ اَلصَّلَاةَ? قَالَ: "لَا.‏ إِنَّمَا ذَلِكَ عِرْقٌ, وَلَيْسَ بِحَيْضٍ, فَإِذَا أَقْبَلَتْ حَيْضَتُكِ فَدَعِي اَلصَّلَاةَ, وَإِذَا أَدْبَرَتْ فَاغْسِلِي عَنْكِ اَلدَّمَ, ثُمَّ صَلِّي } مُتَّفَقٌ عَلَيْه ِ 1‏ .‏

Lā 'ilāha 'illallāh, waḥdahu lā sharīka lah, lahul-mulku, wa lahul-ḥamd, wa huwa `alā kulli shay'in qadīr. Lā ḥawla wa lā quwwata 'illā billāh, lā 'ilāha 'illallāh, wa lā na`budu 'illā 'iyyāh, lahun-ni`matu wa lahul-faḍl, wa lahuth-thanā'ul-ḥasan, lā 'ilāha 'illallāh, mukhliṣīna lahud-dīn, wa law karihal-kāfirūn. None has the right to be worshipped but Allah alone, He has no partner, His is the dominion and His is the praise and He is Able to do all things. There is no power and no might except by Allah. None has the right to be worshipped but Allah, and we do not worship any other besides Him. His is grace, and His is bounty, and to Him belongs the most excellent praise. None has the right to be worshipped but Allah. (We are) sincere in making our religious devotion to Him, even though the disbelievers may dislike it. Reference: Muslim 1/415.

Abu Shuraih al-Ka'bi reported God’s Messenger as saying, “Then you, Khuza’a, have killed this man of Hudhail, but I swear by God that I will pay his blood wit. If anyone kills a man hereafter his people will have a choice, to kill him if they wish, or to accept blood wit if they wish." Tirmidhi and Shafi‘i transmitted it. It occurs in Sharh as-sunna with his isnad, but it states clearly that it does not occur in the two Sahihs on the authority of Abu Shuraih, saying that they rendered it from Abu Huraira’s version, meaning something similar.* *In Masabih as-sunna the tradition is given among the sound ones without any reference to its source. Here Sharh as-sunna is quoted to the effect that the above tradition is not given by Bukhari or Muslim, but that they give something similar on Abu Huraira’s authority. Section 1 is normally confined to traditions from Bukhari or Muslim, or from both, so it is strange to find that a tradition from another source is here preferred to theirs.
وَعَن أبي شُرَيحٍ الكعبيِّ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " ثُمَّ أَنْتُمْ يَا خُزَاعَةُ قَدْ قَتَلْتُمْ هَذَا الْقَتِيلَ مِنْ هُذَيْلٍ وَأَنَا وَاللَّهِ عَاقِلُهُ مَنْ قَتَلَ بَعْدَهُ قَتِيلًا فَأَهْلُهُ بَيْنَ خِيرَتَيْنِ: عَن أَحبُّوا قتلوا وَإِن أَحبُّوا أخذا العقلَ ". رَوَاهُ الترمذيُّ وَالشَّافِعِيّ. وَفِي شرح السنَّة بإِسنادِه وَصَرَّحَ: بِأَنَّهُ لَيْسَ فِي الصَّحِيحَيْنِ عَنْ أَبِي شُرَيْح وَقَالَ:

And as for this verse:" And they who call not upon another god with Allah and slay not the soul which Allah has forbidden, except in the cause of justice" (xxv. 68), he (Ibn Abbas) said: This has been revealed in regard to the polytheists."

Narrated Al-Bara' bin 'Azib:

That the Messenger of Allah (saws) said: "Bring me a shoulder blade or tablet." Then he wrote: Not equal are those of believers who sit. 'Amr bin Umm Maktum who was behind him said: "Is there an exemption for me?" So the following was revealed: Except those who are disabled.

There are narrations on this topic from Ibn 'Abbas, Jabir and Zaid bin Thabit.

This Hadith is Hasan Sahih and it is a Hadith that is Gharib from the narration of Sulaiman At-Taimi from Abu Ishaq.

And Shu'bah and Ath-Thawri reported this Hadith from Abu Ishaq.

He said: "Then a believer who stays in one of the mountains path out of Taqwa for his Lord, leaving the people secure from his evil."

حَدَّثَنَا أَبُو عَمَّارٍ، حَدَّثَنَا الْوَلِيدُ بْنُ مُسْلِمٍ، عَنِ الأَوْزَاعِيِّ، حَدَّثَنَا الزُّهْرِيُّ، عَنْ عَطَاءِ بْنِ يَزِيدَ اللَّيْثِيِّ، عَنْ أَبِي سَعِيدٍ الْخُدْرِيِّ، قَالَ سُئِلَ رَسُولُ اللَّهِ صلى الله عليه وسلم أَىُّ النَّاسِ أَفْضَلُ قَالَ ‏ "‏ رَجُلٌ يُجَاهِدُ فِي سَبِيلِ اللَّهِ ‏"‏ ‏.‏ قَالُوا ثُمَّ مَنْ قَالَ ‏"‏ ثُمَّ مُؤْمِنٌ فِي شِعْبٍ مِنَ الشِّعَابِ يَتَّقِي رَبَّهُ وَيَدَعُ النَّاسَ مِنْ شَرِّهِ ‏" ‏ ‏.‏ قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏

Narrated Mu’adh bin Jabal :

That the Prophet (saws) said: "Whoever fought in the cause of Allah - a Muslim man - for the time it takes for two milkings of a camel, then Paradise is obligatory for him. And whoever suffered a wound in the cause of Allah, or he suffers from an injury, then he will come on the Day of Resurrection while (his blood will be) more copius that it ever was, its color the color of saffron, and its scent like that of musk."

This Hadith is Sahih.

حَدَّثَنَا أَحْمَدُ بْنُ مَنِيعٍ، حَدَّثَنَا رَوْحُ بْنُ عُبَادَةَ، حَدَّثَنَا ابْنُ جُرَيْجٍ، عَنْ سُلَيْمَانَ بْنِ مُوسَى، عَنْ مَالِكِ بْنِ يُخَامِرَ، عَنْ مُعَاذِ بْنِ جَبَلٍ، عَنِ النَّبِيِّ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ قَاتَلَ فِي سَبِيلِ اللَّهِ مِنْ رَجُلٍ مُسْلِمٍ فُوَاقَ نَاقَةٍ وَجَبَتْ لَهُ الْجَنَّةُ وَمَنْ جُرِحَ جُرْحًا فِي سَبِيلِ اللَّهِ أَوْ نُكِبَ نَكْبَةً فَإِنَّهَا تَجِئُ يَوْمَ الْقِيَامَةِ كَأَغْزَرِ مَا كَانَتْ لَوْنُهَا الزَّعْفَرَانُ وَرِيحُهَا كَالْمِسْكِ ‏" ‏ ‏.‏ هَذَا حَدِيثٌ صَحِيحٌ ‏.‏

Narrated Ibn 'Umar:

That the Messenger of Allah (saws) said: "Hearing and obeying is required from every Muslim man - in what he like and what he dislikes - as long as he is not ordered with disobedience. If he is ordered with disobedience, then no hearing or obeying is required of him."

[Abu 'Eisa said:] There are narrations on this topic from 'Ali, 'Imran bin Husain, and Al-Hakam bin 'Amr Al-Ghifari. This Hadith is Hasan Sahih.

حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ السَّمْعُ وَالطَّاعَةُ عَلَى الْمَرْءِ الْمُسْلِمِ فِيمَا أَحَبَّ وَكَرِهَ مَا لَمْ يُؤْمَرْ بِمَعْصِيَةٍ فَإِنْ أُمِرَ بِمَعْصِيَةٍ فَلاَ سَمْعَ عَلَيْهِ وَلاَ طَاعَةَ ‏" ‏ ‏.‏ قَالَ أَبُو عِيسَى وَفِي الْبَابِ عَنْ عَلِيٍّ وَعِمْرَانَ بْنِ حُصَيْنٍ وَالْحَكَمِ بْنِ عَمْرٍو الْغِفَارِيِّ ‏.‏ وَهَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏

‘Abd ar-Rahmin b. Samura said:
During the lifetime of God’s Messenger was shooting some of my arrows in Medina when an eclipse of the sun took place. I therefore threw them away and said, “I swear by God that I must see how God’s Messenger acts in a solar eclipse.” When I came to him he was standing in prayer raising his hands. He then began to glorify God, to acknowledge that He is the only God, to declare His greatness, to express His praise and make supplication till the eclipse came to an end. When the eclipse was over he recited two suras and prayed two rak'as. Muslim transmitted it in his Sahih from 'Abd ar-Rahman b. Samura, and the same occurs in Sharh as-sunna, on his authority, but in the copies of al-Masabih it is given on the authority of Jabir b. Samura.
وَعَنْ عَبْدِ الرَّحْمَنِ بْنِ سَمُرَةَ قَالَ: كُنْتُ أرتمي بأسهم لي بالمدين فِي حَيَاةَ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ إِذْ كُسِفَتِ الشَّمْسُ فَنَبَذْتُهَا. فَقُلْتُ: وَاللَّهِ لَأَنْظُرَنَّ إِلَى مَا حَدَثَ لِرَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فِي كُسُوفِ الشَّمْسِ. قَالَ: فَأَتَيْتُهُ وَهُوَ قَائِمٌ فِي الصَّلَاةِ رَافِعٌ يَدَيْهِ فَجعل يسبح ويهلل وَيكبر ويحمد وَيَدْعُو حَتَّى حَسَرَ عَنْهَا فَلَمَّا حَسَرَ عَنْهَا قَرَأَ سُورَتَيْنِ وَصَلَّى رَكْعَتَيْنِ. رَوَاهُ مُسْلِمٌ فِي صَحِيحِهِ عَنْ عَبْدِ الرَّحْمَنِ بْنِ سَمُرَةَ وَكَذَا فِي شَرْحِ السُّنَّةِ عَنْهُ وَفِي نُسَخِ الْمَصَابِيحِ عَنْ جَابِرِ بن سَمُرَة

Narrated Simak Abu Rumail Al-Hanafi:

"I heard Ibn 'Abbas saying: 'Umar bin Al-Khattab narrated to me that he said: "It was said: 'O Messenger of Allah! So-and-so has been martyred.' He said: "No! I saw him in the fire of garment he pilfered from the spoils of war.' He said: 'Stand up O 'Umar! Call out that no one enters paradise except the believers.' Three times."

[Abu 'Eisa said:] This Hadith is Hasan Sahih Gharib.

That Ibn Juraij commented on Allah's saying: Obey Allah and obey the Messenger, and those in authority among you. He said: "Abdullah bin Hudhafah bin Qais bin 'Adi As-Sahmi was sent by the Messenger of Allah (saws) over a military expedition. I was informed of that by Ya'la bin Muslim, from Sa'eed bin Jubair, from Ibn 'Abbas.

[Abu 'Eisa said:] This Hadith is Hasan Sahih Gharib. We do not know if it except as a narration of Ibn Juraij.

Zaid b. Khalid reported God’s messenger as saying, ‘He who gives one who has been fasting something with which to break his fast, or who equips a fighter will have a reward equivalent to his.” Baihaqi transmitted it in Shu'ab al-iman, and Muhyi as-sunna, who said it is sahih, in Sharh as-sunna.

Narrated Abu Al-Waddak:

That Abu Sa'eed said: "We had some wine that belonged to an orphan. When Al-Ma'idah was revealed I asked the Messenger of Allah (saws) about it, I said: 'It belongs to an orphan.' He said: 'Spill it out.'"

[He said:] There is something on this topic from Anas bin Malik.

[Abu 'Eisa said:] The Hadith of Abu Sa'eed is a Hasan [Sahih] Hadith. Similar to this has been reported through other routes from the Prophet (saws). Some of the people of knowledge stated according to this, they dislike the usage of wine for making vinegar. And the only thing that they disliked about it, and Allah knows best, is for a Muslim to have wine in his house until it becomes vinegar. Abu Al-Waddak's name is Jabr bin Nawf.

حَدَّثَنَا عَلِيُّ بْنُ خَشْرَمٍ، أَخْبَرَنَا عِيسَى بْنُ يُونُسَ، عَنْ مُجَالِدٍ، عَنْ أَبِي الْوَدَّاكِ، عَنْ أَبِي سَعِيدٍ، قَالَ كَانَ عِنْدَنَا خَمْرٌ لِيَتِيمٍ فَلَمَّا نَزَلَتِ الْمَائِدَةُ سَأَلْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم عَنْهُ وَقُلْتُ إِنَّهُ لِيَتِيمٍ ‏.‏ فَقَالَ ‏"‏ أَهْرِيقُوهُ ‏" ‏ ‏.‏ قَالَ وَفِي الْبَابِ عَنْ أَنَسِ بْنِ مَالِكٍ ‏.‏ قَالَ أَبُو عِيسَى حَدِيثُ أَبِي سَعِيدٍ حَدِيثٌ حَسَنٌ وَقَدْ رُوِيَ مِنْ غَيْرِ وَجْهٍ عَنِ النَّبِيِّ صلى الله عليه وسلم نَحْوُ هَذَا ‏.‏ وَقَالَ بِهَذَا بَعْضُ أَهْلِ الْعِلْمِ وَكَرِهُوا أَنْ تُتَّخَذَ الْخَمْرُ خَلاًّ وَإِنَّمَا كُرِهَ مِنْ ذَلِكَ وَاللَّهُ أَعْلَمُ أَنْ يَكُونَ الْمُسْلِمُ فِي بَيْتِهِ خَمْرٌ حَتَّى يَصِيرَ خَلاًّ ‏.‏ وَرَخَّصَ بَعْضُهُمْ فِي خَلِّ الْخَمْرِ إِذَا وُجِدَ قَدْ صَارَ خَلاًّ ‏.‏ أَبُو الْوَدَّاكِ اسْمُهُ جَبْرُ بْنُ نَوْفٍ ‏.‏

Narrated 'Aishah:

"The Prophet (saws) judged that the produce is produce is for the responsible one."

[He said:] This Hadith is Hasan Sahih, Gharib as a Hadith of Hisham bin 'Urwah (a narrator).

[Abu 'Eisa said:] Muslim bin Khalid Az-Zanji reported this Hadith from Hisham, from 'Urwah. Jarir reported it from Hisham as well. It is said that the narration of Jarir has Tadlis in in it, that Jarir committed the Tadlis, he did not hear it from Hisham bin 'Urwah.

As for the meaning of "the produce is for the responsible one," he is the man who purchased the slave then the slave produced for him, and he found some defect in him so he returned him to the seller. Then the produce (of his work) is the purchaser's. In cases similar to this, the produce is for the responsible one.

[Abu 'Eisa said:] Muhammad bin Isma'il called this Hadith Gharib, as a narration of 'Umar bin 'Ali (one of the narrators). I said: "Do you think that he committed Tadlis?" He said:"No".

حَدَّثَنَا أَبُو سَلَمَةَ، يَحْيَى بْنُ خَلَفٍ أَخْبَرَنَا عُمَرُ بْنُ عَلِيٍّ الْمُقَدَّمِيُّ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنْ عَائِشَةَ، أَنَّ النَّبِيَّ صلى الله عليه وسلم قَضَى أَنَّ الْخَرَاجَ بِالضَّمَانِ ‏ .‏ قَالَ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ غَرِيبٌ مِنْ حَدِيثِ هِشَامِ بْنِ عُرْوَةَ ‏. قَالَ أَبُو عِيسَى وَقَدْ رَوَى مُسْلِمُ بْنُ خَالِدٍ الزَّنْجِيُّ هَذَا الْحَدِيثَ عَنْ هِشَامِ بْنِ عُرْوَةَ وَرَوَاهُ جَرِيرٌ عَنْ هِشَامٍ أَيْضًا ‏.‏ وَحَدِيثُ جَرِيرٍ يُقَالُ تَدْلِيسٌ دَلَّسَ فِيهِ جَرِيرٌ ‏.‏ لَمْ يَسْمَعْهُ مِنْ هِشَامِ بْنِ عُرْوَةَ ‏.‏ وَتَفْسِيرُ الْخَرَاجِ بِالضَّمَانِ هُوَ الرَّجُلُ يَشْتَرِي الْعَبْدَ فَيَسْتَغِلُّهُ ثُمَّ يَجِدُ بِهِ عَيْبًا فَيَرُدُّهُ عَلَى الْبَائِعِ فَالْغَلَّةُ لِلْمُشْتَرِي لأَنَّ الْعَبْدَ لَوْ هَلَكَ هَلَكَ مِنْ مَالِ الْمُشْتَرِي ‏.‏ وَنَحْوُ هَذَا مِنَ الْمَسَائِلِ يَكُونُ فِيهِ الْخَرَاجُ ...

Ibn 'Umar (RAA) narrated that The Messenger of Allah (P.B.U.H.) said, “The Wala’ (of a manumitted slave) is considered as one’s lineage, not to be sold or donated (refer to hadith no. 984).” Related by Ash-Shafi’i. Ibn Hibban and Al-Hakim graded it as Sahih. It is also related by Al-Bukhari and Muslim with different wording

Tariq b. Shihab reported God’s Messenger as saying, “The Friday paryer in congregation is a necessary duty for every Muslim, with four exceptions:
a slave, a woman, a boy, or an invalid.” Abu Dawud transmitted it. In Sharh as-sunna it occurs with the same wording as in al-Masabih from a man of the B. Wa’il.
