Sunan Abi Dawud 3988

Narrated Farwah ibn Musayk al-Ghutayfi:

I came to the Prophet (saws). He then narrated the rest of the tradition.

A man from the people said: "Messenger of Allah! tell us about Saba'; what is it: land or woman? He replied: It is neither land nor woman; it is a man to whom ten children of the Arabs were born: six of them lived in the Yemen and four lived in Syria.

The narrator Uthman said al-Ghatafani instead of al-Ghutayfi. He said: It has been transmitted to us by al-Hasan ibn al-Hakam an-Nakha'i.

Salim bin ’Abdullah narrated on the authority of his father (RAA) that the Messenger of Allah (P.B.U.H.) said, “A tithe is due as Zakah, on every plant watered by heaven (rain water), springs, or underground water (i.e. watered without effort). While half a tithe is paid on what is watered by irrigation (i.e. machines are used).” Related by Al-Bukhari. Abu Dawud added in his narration, “When it is watered by underground water (close to the surface and keeping the land wet), a tithe is paid, but half a tithe is paid when the land is watered by wheels or animals.”

It was narrated that Mus'ab bin Sa'd said:
"Sa'd had many grapevines and he had someone looking after them for him. (The vines) bore many grapes, and that man wrote to him (saying): 'I am afraid that the grapes will be wasted; what do you think if I squeeze them to make juice? Sa'd wrote to him (saying): 'When this letter of mine reaches you, leave my land, for by Allah I cannot trust you with anything ever agin.' So he made him leave his land."

Rafi bin Khadij told Abdullah bin Umar that his paternal uncles went to the Messenger of Allah, then they came back and told them that the Messenger of Allah had forbidden leasing arable land. Abdullah said:
"We knew that he owned some arable land that he leased at the time of the Messenger of Allah in return for whatever grew on the banks of the streams of water, and for a certain amount of straw, I do not know how much it was." Ibn Awn reported it from Nafi but he said: "From some of his paternal uncles."

The Messenger of Allah said: "When someone whose religion and character you are pleased with comes to you then marry (her to) him. If you do not do so, then there will be turmoil (Fitnah) in the land and discord (Fasad). If you do not do so, then there will be turmoil (Fitnah) in the land and discord (Fasad)." He then maintained that, one of his uncles came to him and said: The Messenger of Allah (saws) forbade us from a work which beneficial to us. He should not rent it for a third or a quarter (of the produce) or for specified among of produce.

Musnad Ahmad 555
It was narrated that Thumamah bin Hazn al-Qushairi said:
I was present at the house (of `Uthman) on the day `Uthman (رضي الله عنه) was killed. He looked out at them and said: Call for me your two companions who incited you against me. They were called for him and he said: I adjure you by Allah, do you know that when the Messenger of Allah (ﷺ) came to Madinah, the mosque got too crowded for its people and he said: “Who will buy this piece of land with his own wealth and use it like the rest of the Muslims (i.e., donate it to the Muslims and share it with them) and he will have something better than it in Paradise?” So I bought it with my own wealth and donated it to the Muslims, but now you are preventing me from praying two rak’ahs in it! Then he said: I adjure you by Allah, do you know that when the Messenger of Allah (ﷺ) came to Madinah, there was no well good for drinking from except (the well of) Roomah. The Messenger of Allah (ﷺ) said: `Who will buy it with his own wealth and his bucket will be like that of the Muslims (i.e., donate the well to the Muslims and share it with them) and he will have something better than it in Paradise.” So I bought it with my own wealth, but now you are preventing me from drinking from it. Then he said: Do you know that I am the one who equipped the army of hardship (i.e., the army that went on the campaign of Tabook)? They said: By Allah, yes.

Zaynab said, "I heard my mother, Umm Salama, the wife of the Prophet, may Allah bless him and grant him peace, say that a woman came to the Messenger of Allah, may Allah bless him and grant him peace, and said, 'Messenger of Allah! My daughter's husband died, and her eyes are troubling her, can she put kohl on them?' The Messenger of Allah, may Allah bless him and grant him peace, said, 'No' two or three times. Then he said, 'It is only four months and ten days. In the Jahiliyya, none of you threw away the piece of dung until a year had passed.' "

Humayd ibn Nafi said, "I asked Zaynab to explain what 'throwing away the piece of dung at the end of a year' meant. Zaynab said, 'In the Jahiliyya when a woman's husband died, she went into a small tent and dressed in the worst of clothes. She did not touch perfume or anything until a year had passed. Then she was brought an animal - a donkey, a sheep, or a bird, and she would break her idda with it, by rubbing her body against it (taftaddu). Rarely did she break her idda with anything (by rubbing herself against it) but that it died. Then she would come out and would be given a piece of dung. She would throw it away and then return to whatever she wished of perfumes or whatever.' "

Malik explained, 'Taftaddu' means to wipe her skin with it in the same way as with a healing charm."

A client of ‘Uthman said that Umm Salama was presented with a piece of meat, and because the Prophet liked meat she told the servant to put it in the house as the Prophet might perhaps eat it. She put it in the window ledge in the house. A beggar came and stood at the door and said, “Give alms, may God bless you," and when they replied, “God bless you,"* the beggar went away. Then the Prophet entered and asked Umm Salama whether she had anything for him to eat. She replied that she had, and told the servant to go and bring God's messenger that meat, but when she went she found only a piece of flint in the window ledge. The Prophet then said, “That meat changed into flint because you did not give it to the beggar." It was narrated from Usaid bin Zuhair, the paternal nephew of Rafi' bin Khdij, that Rafi' bin Khadij said:
“If one of us did not need his land, he would give it (to someone else to cultivate) in return for one third, or one half of the yield , and he would stipulate (that the should receive) the produce grows on the banks of three streams, and the grains that remain in the ear after threshing, and the produce irrigated by a stream. Life at that time was hard, and he would work (the land) with iron and whatever Allah (SWT) willed, and he would benefit from it. Then Rafi bin Khadij came to us and said: ‘The Messenger of Allah (SAW) forbade you to do something that may seem beneficial to you, but obedience to Allah and obedience to His Messenger are more beneficial for you. The Messenger of Allah (SAW) forbade Haq for you, and he said: “Whoever has no need of his land, let him give it to his brother (to cultivate) or let him leave it (uncultivated).”

Hudhaifa b. Usaid reported:

Allah's Apostle (may peace be upon him) was in an apartment and we were beneath that, that he peeped in and said to us: What are you discussing about? We said: (We are discussing about the Last) Hour. Thereupon he said: The Last Hour would not come until the ten signs appear: land-sliding in the east, and land-sliding in the west, and land-sliding in the peninsula of Arabia, the smoke, the Dajjal, the beast of the earth, Gog and Magog, the rising of the sun from the west and the fire which would emit from the lower part of 'Adan. Shu'ba said that 'Abd al-'Aziz b. Rufai' reported on the authority of Abu Tufail who reported on the authority of Abu Sariha a hadith like this that Allah's Apostle (may peace be upon him) did not make a mention of (the tenth sign) but he said that out of the ten one was the descent of Jesus, son of Mary (peace be upon him), and in another version it is the blowing of the violent gale which would drive the people to the ocean.

Narrated Abu Burda:

That the Prophet sent his (i.e. Abu Burda's) grandfather, Abu Musa and Mu`adh to Yemen and said to both of them "Facilitate things for the people (Be kind and lenient) and do not make things difficult (for people), and give them good tidings, and do not repulse them and both of you should obey each other." Abu Musa said, "O Allah's Prophet! In our land there is an alcoholic drink (prepared) from barley called Al-Mizr, and another (prepared) from honey, called Al-Bit"' The Prophet said, "All intoxicants are prohibited." Then both of them proceeded and Mu`adh asked Abu Musa, "How do you recite the Qur'an?" Abu Musa replied, "I recite it while I am standing, sitting or riding my riding animals, at intervals and piecemeal." Mu`adh said, "But I sleep and then get up. I sleep and hope for Allah's Reward for my sleep as I seek His Reward for my night prayer." Then he (i.e. Mu`adh) pitched a tent and they started visiting each other. Once Mu`adh paid a visit to Abu Musa and saw a chained man. Mu`adh asked, "What is this?" Abu Musa said, "(He was) a Jew who embraced Islam and has now turned apostate." Mu`adh said, "I will surely chop off his neck!"

Malik related to me from Abu Ubayd, the mawla of Sulayman ibn Abd al-Malik from Khalid ibn Madan who attributed it to the Prophet, may Allah bless him and grant him peace, "Allah, the Blessed and Exalted is kind and loves kindness. Travel by night, because the land is travelled faster at night than it is during the day. Beware of pitching tents on the road, for it is the path of animals and the abode of snakes."

Jabir reported:

Allah's Messenger (may peace he upon him) sent us (on an expedition) and appointed Abu 'Ubaida our chief that we might intercept a caravan of the Quraish and provided us with a bag of dates. And he found for us nothing besides it. Abu Ubaida gave each of us one date (everyday). I (Abu Zubair, one of the narrators) said: What did you do with that? He said: We sucked that just as a baby sucks and then drank water over that, and it sufficed us for the day until night. We beat off leaves with the help of our staffs, then drenched them with water and ate them. We then went to the coast of the sea, and there rose before us on the coast of the sea something like a big mound. We came near that and we found that it was a beast, called al-'Anbar (spermaceti whale). Abu 'Ubaida said. It is dead. He then said: No (but it does not matter), we have been sent by the Messenger of Allah (may peace be upon him) in the path of Allah and you are hard pressed (on account of the scarcity of food), so you eat that. We three hundred in number stayed there for a month, until we grew bulky. He (Jabir) said: I saw how we extracted pitcher after pitcher full of fat from the cavity of its eye, and sliced from it compact piece of meat equal to a bull or like a bull. Abu 'Ubaida called forth thirteen men from us and he made them sit in the cavity of its eye, and he took hold of one of the ribs of its chest and made it stand and then saddled the biggest of the camels we had with us and it passed under it (the arched rib), and we provided ourselves with pieces of boiled meat (especially for use in our journey). When we came back to Medina, we went to Allah's Messenger (may peace be upon him) and made a mention of that to him, whereupon he said: That was a provision which Allah had brought forth for you. Abu Huraira reported Allah's Messenger (may peace be upon him) as saying:

A person had been driving an ox loaded with luggage. The ox looked towards him and said: I have not been created for this but for lands (i. e. for ploughing the land and for drawing out water from the wells for the purpose of irrigating the lands). The people said with surprise and awe: Hallowed be Allah, does the ox speak? Allah's Messenger (may peace be upon him) said: I believe it and so do Abu Bakr and 'Umar. Abu Huraira reported Allah's Messenger (may peace be upon him) as saying: A shepherd was tendirig the flock when a wolf came there and took away one goat. Tile shepherd pursued it (the wolf) and rescued it (the goat) from that (wolf). The wolf looked towards him and said: Who would save it on the day when there will be no shepherd except me? Thereupon people said: Hallowed be Allah I Thereupon Allah's Messenger (may peace be upon him) said: I believe in it and so do Abu Bakr and Umar believe.

Ibn ‘Umar told that ‘Umar b. al-Khattab deported the Jews and the Christians from the land of the Hijaz and when God’s Messenger got supremacy over the people of Khaibar he intended to expel the Jews from it, for when the land was conquered it belonged to God, His Messenger and the Muslims. But the Jews asked God’s Messenger to leave them on condition that they should do all the cultivation and have half the produce, and he replied, “We shall confirm you on that condition as long as we wish.” So they were confirmed till ‘Umar deported them during his period of rule to Taima and Jericho. (Bukhari and Muslim.)

Abud Darda’ reported God’s Messenger as saying, “He who gets land on which tax is due 1 has sought to rescind his emigration,2 and he who takes an infidel’s lowliness from his neck and puts it on his own 3 has turned his back on Islam.” Abu Dawud transmitted it. 1. The word for "tax" here is jizya. Eventually a distinction was made between jizya and kharaj, the former being used for poll-tax and the latter for land-tax. 2. i.e. to make himself like a dhimmi. 3. i.e. undertakes the responsibility of paying his tax for him.

'Abdullah b. Umar (Allah be pleased with them) reported that when Khaibar had been conquered, the Jews asked Allah's Messenger (may peace be upon him) to let them continue (cultivation in those lands) on half of the share of yield in fruits and crop, whereupon Allah's Messenger (may peace be upon him) said:

I will allow you to continue here, so long as we would desire. The rest of the hadith is the same, but with this addition:" The fruit would be distributed equal to the half of Khaibar. And out of hall of the produce of the land, Allah's Apostle (may peace be be upon him) got the fifth part."

It was narrated from Abu Sukainah, a man from among the Muharririn,[1] that a man among the Companions of the the Prophet (PBUH) said:
"When the Prophet (PBUH) commanded them to dig the trench (Al-Khandaq), there was a rock in their way preventing them from digging. The Messenger of Allah (PBUH) stood, picked up a pickaxe, put his Rida' (upper garment) at the edge of the ditch and said: 'And the Word of your Lord has been fulfilled in truth and in justice. None can change His Words. And He is the All-Hearer, the All-Knower.' [1] One-third of the rock broke off while Salman Al-Farisi was standing there watching, and there was a flash of light when the Messenger of Allah (PBUH)struck (the rock). Then he struck it again and said: 'And the Word of your Lord has been fulfilled in truth and in justice. Nonce can change His Words. Ans He is the All-Hearer, the All-Knower' And another third of the rock broke off and there was another flash of light, which Salman saw. Then he struck (the rock) a third time and said: 'And the Word of your Lord has been fulfilled in truth and in justice. None can change His Words. And He is the All-Hearer, the All-Knower.' The last third fell, and the Messenger of Allah (PBUH) came out, picked up his Rida' and sat down. Salman said: 'O Messenger of Allah, Each time you struck the rock there was a flash of light.' The Messenger of Allah (PBUH) said to him: 'O Salman, did you see that?' He said: 'Yes, by the One Who sent you with the truth, O Messenger of Allah.' He said: 'When I struck the first blow, the cities of Kisra and their environs were shown to me, and many other cities, and I saw them with my own eyes.' Those of his Companions who were present said: 'O Messenger of Allah, pray to Allah to grant us victory and to give us their land as spoils of war, and to destroy their lands at our hands.' So the Messenger of Allah (PBUH) prayed for that. (Then he said:) 'Then I struck the second blow and the cities of Caesar and their environs were shown to me, and I saw them with my own eyes.' They said: 'O Messenger of Allah, pray to Allah to grant us victory and to give us their lands as spoils of war, and to destroy their lands at our hands.' So the Messenger of Allah (PBUH) prayed for that. (Then he said:) 'Then I struck the third blow and the cities of Ethiopia were shown to me, and the villages around them, and I saw them with my own eyes.' But the Messenger of Allah (PBUH) said at that point: 'Leave the Ethiopians alone so long as they leave you alone, and leave the Turks alone so long as they leave you alone.'" [1] An-An'am 6:115.
