Jami` at-Tirmidhi 1422
Narrated Sahl bin Abi Hatamah:
Yahya (one of the narrators) said: And I think it was from Rafi' bin Khadij - that 'Abdullah bin Sahl bin Zaid and Muhaiysah bin Mas'ud bin Zaid went out and when they reached Khaibar they separated while there. Then Muhayyisah found 'Abdullah bin Sahl murdered [so he buried him]. Then he went to the Messenger of Allah (saws) along with Huwayyisah bin Mas'ud and Abdur-Rahman bin Sahl. The youngest of the people, Abdur-Rahman, went to speak ahead of his companions. The Messenger of Allah (saws) said to him: "Let the eldest of you speak." So he was silent and two companions spoke. So he conversed with them and they mentioned to the Messenger of Allah (saws) about the murder of 'Abdullah bin Sahl. He said to them: "If fifty of you can swear an oath then you will have the right against the murderer." They said: "How can we take an oath when we did not witness it?" He said: "Then fifty of Jews can swear to clear the charge with you?" They said: "How could we accept the oaths of a disbelieving people?" So when he saw that, the Messenger of Allah (saws) paid the blood-money." (Another Chain) from Sahl bin Abi Hathman and Rafi' bin Khadij, and the meaning is similar to this Hadith.
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا اللَّيْثُ بْنُ سَعْدٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ بُشَيْرِ بْنِ يَسَارٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، قَالَ يَحْيَى وَحَسِبْتُ عَنْ رَافِعِ بْنِ خَدِيجٍ، أَنَّهُمَا قَالاَ خَرَجَ عَبْدُ اللَّهِ بْنُ سَهْلِ بْنِ زَيْدٍ وَمُحَيِّصَةُ بْنُ مَسْعُودِ بْنِ زَيْدٍ حَتَّى إِذَا كَانَا بِخَيْبَرَ تَفَرَّقَا فِي بَعْضِ مَا هُنَاكَ ثُمَّ إِنَّ مُحَيِّصَةَ وَجَدَ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَتِيلاً قَدْ قُتِلَ فَدَفَنَهُ ثُمَّ أَقْبَلَ إِلَى رَسُولِ اللَّهِ صلى الله عليه وسلم هُوَ وَحُوَيِّصَةُ بْنُ مَسْعُودٍ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَكَانَ أَصْغَرَ الْقَوْمِ ذَهَبَ عَبْدُ الرَّحْمَنِ لِيَتَكَلَّمَ قَبْلَ صَاحِبَيْهِ قَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ كَبِّرِ الْكُبْرَ ‏"‏ ‏.‏ فَصَمَتَ وَتَكَلَّمَ صَاحِبَاهُ ثُمَّ تَكَلَّمَ مَعَهُمَا فَذَكَرُوا لِرَسُولِ اللَّهِ صلى الله عليه وسلم مَقْتَلَ عَبْدِ اللَّهِ بْنِ سَهْلٍ فَقَالَ لَهُمْ ‏ "‏ أَتَحْلِفُونَ خَمْسِينَ يَمِينًا فَتَسْتَحِقُّونَ صَاحِبَكُمْ أَوْ قَاتِلَكُمْ ‏"‏ ‏.‏ قَالُوا وَكَيْفَ نَحْلِفُ وَلَمْ ...

Sunan an-Nasa'i 1704
Sufyan narrated from Habib bin Abi Thabit, from Muhammad bin Ali, from his father, from his grandfather, that:
The Prophet (SAW) got up at night and cleaned his teeth, then he prayed two rak'ahs, then he slept. Then he got up and cleaned his teeth, then he performed wudu and prayed two rak'ahs, until he had prayed six. Then he prayed witr with three rak'ahs, and prayed two rak'ahs.
أَخْبَرَنَا مُحَمَّدُ بْنُ رَافِعٍ، قَالَ حَدَّثَنَا مُعَاوِيَةُ بْنُ هِشَامٍ، قَالَ حَدَّثَنَا سُفْيَانُ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنْ مُحَمَّدِ بْنِ عَلِيٍّ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، عَنِ النَّبِيِّ صلى الله عليه وسلم أَنَّهُ قَامَ مِنَ اللَّيْلِ فَاسْتَنَّ ثُمَّ صَلَّى رَكْعَتَيْنِ ثُمَّ نَامَ ثُمَّ قَامَ فَاسْتَنَّ ثُمَّ تَوَضَّأَ فَصَلَّى رَكْعَتَيْنِ حَتَّى صَلَّى سِتًّا ثُمَّ أَوْتَرَ بِثَلاَثٍ وَصَلَّى رَكْعَتَيْنِ ‏.‏

Yahya related to me from Malik from Ibn Shihab that al-Qasim ibn Muhammad said that he had heard a man asking ibn Abbas about booty. Ibn Abbas said, "Horses are part of the booty and personal effects are as well."

Then the man repeated his question, and Ibn Abbas repeated his answer. Then the man said, "What are the spoils which He, the Blessed, the Exalted, mentioned in His Book?" He kept on asking until Ibn Abbas was on the verge of being annoyed, then Ibn Abbas said, "Do you know who this man is like? Ibn Sabigh, who was beaten by Umar ibn al-Khattab because he was notorious for asking foolish questions."

Yahya said that Malik was asked whether someone who killed one of the enemy could keep the man's effects without the permission of the Imam. He said, "No one can do that without the permission of the Imam. Only the Imam can make ijtihad. I have not heard that the Messenger of Allah, may Allah bless him and grant him peace, ever said, 'Whoever kills someone can have his effects,' on any other day than the day of Hunayn."

وَحَدَّثَنِي مَالِكٌ، عَنِ ابْنِ شِهَابٍ، عَنِ الْقَاسِمِ بْنِ مُحَمَّدٍ، أَنَّهُ قَالَ سَمِعْتُ رَجُلاً، يَسْأَلُ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ عَنِ الأَنْفَالِ، فَقَالَ ابْنُ عَبَّاسٍ الْفَرَسُ مِنَ النَّفَلِ وَالسَّلَبُ مِنَ النَّفَلِ ‏.‏ قَالَ ثُمَّ عَادَ الرَّجُلُ لِمَسْأَلَتِهِ فَقَالَ ابْنُ عَبَّاسٍ ذَلِكَ أَيْضًا ثُمَّ قَالَ الرَّجُلُ الأَنْفَالُ الَّتِي قَالَ اللَّهُ فِي كِتَابِهِ مَا هِيَ قَالَ الْقَاسِمُ فَلَمْ يَزَلْ يَسْأَلُهُ حَتَّى كَادَ أَنْ يُحْرِجَهُ ثُمَّ قَالَ ابْنُ عَبَّاسٍ أَتَدْرُونَ مَا مَثَلُ هَذَا مَثَلُ صَبِيغٍ الَّذِي ضَرَبَهُ عُمَرُ بْنُ الْخَطَّابِ ‏.‏ قَالَ وَسُئِلَ مَالِكٌ عَمَّنْ قَتَلَ قَتِيلاً مِنَ الْعَدُوِّ أَيَكُونُ لَهُ سَلَبُهُ بِغَيْرِ إِذْنِ الإِمَامِ قَالَ لاَ يَكُونُ ذَلِكَ لأَحَدٍ بِغَيْرِ إِذْنِ الإِمَامِ وَلاَ يَكُونُ ذَلِكَ مِنَ الإِمَامِ إِلاَّ عَلَى وَجْهِ الاِجْتِهَادِ وَلَمْ يَبْلُغْنِي أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ مَنْ قَتَلَ قَتِيلاً فَلَهُ سَلَبُهُ ‏"‏ ‏.‏ إِلاَّ يَوْمَ حُنَيْنٍ ‏.‏

It was narrated that Abu Salih, the freed slave of `Uthman bin `Affan (رضي الله عنه) said:
I heard `Uthman (رضي الله عنه) say on the minbar: O people, I concealed from you a hadeeth that I heard from the Messenger of Allah (ﷺ) for fear that you would scatter away from me, then I thought that I should tell it to you, and let each one choose for himself what he thinks is best. I heard the Messenger of Allah (ﷺ) say: `Guarding the border for one day for the sake of Allah is better than a thousand other days doing other deeds.” `Abdullah bin ‘Abdur-Rahman bin Abi Dhubab narrated... Abu Hazim added:
An-Nu`man bin Abi `Aiyash, on hearing me, said. "Did you hear this from Sahl?" I said, "Yes." He said, " I bear witness that I heard Abu Sa`id Al-Khudri saying the same, adding that the Prophet said: 'I will say: They are of me (i.e. my followers). It will be said, 'You do not know what they innovated (new things) in the religion after you left'. I will say, 'Far removed, far removed (from mercy), those who changed (their religion) after me."
قَالَ أَبُو حَازِمٍ فَسَمِعَنِي النُّعْمَانُ بْنُ أَبِي عَيَّاشٍ، فَقَالَ هَكَذَا سَمِعْتَ مِنْ، سَهْلٍ فَقُلْتُ نَعَمْ‏.‏ فَقَالَ أَشْهَدُ عَلَى أَبِي سَعِيدٍ الْخُدْرِيِّ لَسَمِعْتُهُ وَهْوَ يَزِيدُ فِيهَا ‏"‏ فَأَقُولُ إِنَّهُمْ مِنِّي‏.‏ فَيُقَالُ إِنَّكَ لاَ تَدْرِي مَا أَحْدَثُوا بَعْدَكَ‏.‏ فَأَقُولُ سُحْقًا سُحْقًا لِمَنْ غَيَّرَ بَعْدِي ‏"‏‏.‏ وَقَالَ ابْنُ عَبَّاسٍ سُحْقًا بُعْدًا، يُقَالُ سَحِيقٌ بَعِيدٌ، وَأَسْحَقَهُ أَبْعَدَهُ‏.‏

Sunan Abi Dawud 734

‘Abbas b. Sahl. Said:

Abu Humaid, Abu Usaid, Sahl. B Sa’d and Muhammad b. Maslamah (once) got together and discussed how the Messenger of Allah(saws) used to offer his prayer. Abu Humaid said: I am more informed than any of you regarding the prayer offered by the Messenger of Allah (saws). Then he mentioned a part of it, and said: He then bowed and placed his hands upon his knees as if he caught hold of them; and bent them, keeping (his arms) away from his sides. He them prostrated himself and placed his nose and forehead (on the ground); and kept his arms away from his side, and placed his palms (on the ground opposite his shoulders; he then raised his head that every bone returned to its proper place; (he then prostrated twice) until he finished this prostrations). Then he sat down and spread out his left foot, putting forward the front of his right foot towards the qiblah placing the palm of his right hand on his right knee, and the palm of his left hand on his left knee, and he pointed with his finger.

Abu Dawud said: This tradition has been narrated by Ibn al-Mubarak from Fulaih who heard ‘Abbas . Sahl narrating it; but I do not remember it. I think he made the mention of ‘Isa b. ‘Abd Allah who heard ‘Abbas b. Sahl saying: I accompanied Abu Humaid al-Sa’idi.

حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا عَبْدُ الْمَلِكِ بْنُ عَمْرٍو، أَخْبَرَنِي فُلَيْحٌ، حَدَّثَنِي عَبَّاسُ بْنُ سَهْلٍ، قَالَ اجْتَمَعَ أَبُو حُمَيْدٍ وَأَبُو أُسَيْدٍ وَسَهْلُ بْنُ سَعْدٍ وَمُحَمَّدُ بْنُ مَسْلَمَةَ فَذَكَرُوا صَلاَةَ رَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ أَبُو حُمَيْدٍ أَنَا أَعْلَمُكُمْ بِصَلاَةِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَذَكَرَ بَعْضَ هَذَا قَالَ ثُمَّ رَكَعَ فَوَضَعَ يَدَيْهِ عَلَى رُكْبَتَيْهِ كَأَنَّهُ قَابِضٌ عَلَيْهِمَا وَوَتَّرَ يَدَيْهِ فَتَجَافَى عَنْ جَنْبَيْهِ قَالَ ثُمَّ سَجَدَ فَأَمْكَنَ أَنْفَهُ وَجَبْهَتَهُ وَنَحَّى يَدَيْهِ عَنْ جَنْبَيْهِ وَوَضَعَ كَفَّيْهِ حَذْوَ مَنْكِبَيْهِ ثُمَّ رَفَعَ رَأْسَهُ حَتَّى رَجَعَ كُلُّ عَظْمٍ فِي مَوْضِعِهِ حَتَّى فَرَغَ ثُمَّ جَلَسَ فَافْتَرَشَ رِجْلَهُ الْيُسْرَى وَأَقْبَلَ بِصَدْرِ الْيُمْنَى عَلَى قِبْلَتِهِ وَوَضَعَ كَفَّهُ الْيُمْنَى عَلَى رُكْبَتِهِ الْيُمْنَى وَكَفَّهُ الْيُسْرَى عَلَى رُكْبَتِهِ الْيُسْرَى وَأَشَارَ بِأُصْبُعِهِ ‏.‏ قَالَ أَبُو دَاوُدَ رَوَى هَذَا الْحَدِيثَ عُتْبَةُ بْنُ أَبِي حَكِيمٍ عَنْ عَبْدِ اللَّهِ بْنِ عِيسَى عَنِ الْعَبَّاسِ ...

Yahya related to me from Malik from Muhammad ibn Abi Bakr ibn Muhammad ibn Amribn Hazm that Abdar-Rahman ibn Hanthala az-Zurqi was informed by a mawla of Quraysh,who used to be known as Ibn Mursi, that he was sitting with Umar ibn al-Khattab, and when they had prayed dhuhr, he said, "Yarfa! Bring that letter! (a letter which he had written about the paternal aunt.) We asked about her and asked for information about her." Yarfa brought it to him. He called for a small vessel or a drinking-bowl in which there was water. He erased the letter in it. Then he said, "Had Allah approved of you as an heir, we would have confirmed you. Had Allah approved of you, we would have confirmed you."

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ مُحَمَّدِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ حَنْظَلَةَ الزُّرَقِيِّ، أَنَّهُ أَخْبَرَهُ عَنْ مَوْلًى، لِقُرَيْشٍ كَانَ قَدِيمًا يُقَالُ لَهُ ابْنُ مِرْسَى أَنَّهُ قَالَ كُنْتُ جَالِسًا عِنْدَ عُمَرَ بْنِ الْخَطَّابِ فَلَمَّا صَلَّى الظُّهْرَ قَالَ يَا يَرْفَا هَلُمَّ ذَلِكَ الْكِتَابَ - لِكِتَابٍ كَتَبَهُ فِي شَأْنِ الْعَمَّةِ - فَنَسْأَلَ عَنْهَا وَنَسْتَخْبِرَ فِيهَا ‏.‏ فَأَتَاهُ بِهِ يَرْفَا فَدَعَا بِتَوْرٍ أَوْ قَدَحٍ فِيهِ مَاءٌ فَمَحَا ذَلِكَ الْكِتَابَ فِيهِ ثُمَّ قَالَ لَوْ رَضِيَكِ اللَّهُ وَارِثَةً أَقَرَّكِ لَوْ رَضِيَكِ اللَّهُ أَقَرَّكِ ‏.‏

Abu Hurairah reported the Messenger of Allah (May peace be upon him) as saying:

Call yourselves by my name, but do not use my KUNYAH (surname).

Abu Dawud said : Abu Salih has transmitted it in a similar way from Abu Hurairah, and similar are the traditions of Abu Sufyan from Jabir, of Salim b. Abl al-Ja’d from Jabir, of Sulaiman al-Yashkuri from Jabir, and of Ibn al-Munkadir from Jabir and similar others and Anas b. Malik.

It was narrated from Dawud bin Salih Al Madani that his father said:
I heard Abu Sa'eed Al-Khudri say: "The Messenger of Allah (SAW) said: 'Transactions may only be done by mutual consent."'

Yahya related to me from Malik from Jafar ibn Muhammad from his father that Ali ibn Abi Talib said, "When a man takes a vow to abstain from intercourse, divorce does not occur immediately. If four months pass, he must declare his intent and either he is divorced or he revokes his vow . "

Malik said, "That is what is done among us."

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ عَلِيِّ بْنِ أَبِي طَالِبٍ، أَنَّهُ كَانَ يَقُولُ إِذَا آلَى الرَّجُلُ مِنِ امْرَأَتِهِ لَمْ يَقَعْ عَلَيْهِ طَلاَقٌ وَإِنْ مَضَتِ الأَرْبَعَةُ الأَشْهُرِ حَتَّى يُوقَفَ فَإِمَّا أَنْ يُطَلِّقَ وَإِمَّا أَنْ يَفِيءَ ‏.‏ قَالَ مَالِكٌ وَذَلِكَ الأَمْرُ عِنْدَنَا ‏.‏

Narrated Sahl bin Abi Hathma:

`Abdullah bin Sahl and Muhaiyisa bin Mas`ud bin Zaid set out to Khaibar, the inhabitants of which had a peace treaty with the Muslims at that time. They parted and later on Muhaiyisa came upon `Abdullah bin Sah! and found him murdered agitating in his blood. He buried him and returned to Medina. `Abdur Rahman bin Sahl, Muhaiyisa and Huwaiuisa, the sons of Mas`ud came to the Prophet and `Abdur Rahman intended to talk, but the Prophet said (to him), "Let the eldest of you speak." as `Abdur-Rahman was the youngest:. `Abdur-Rahman kept silent and the other two spoke. The Prophet said, "If you swear as to who has committed the murder, you will have the right to take your right from the murderer." They said, "How should we swear if we did not witness the murder or see the murderer?" The Prophet said, "Then the Jews can clear themselves from the charge by taking Alaska (an oath taken by men that it was not they who committed the murder)." The!y said, "How should we believe in the oaths of infidels?" So, the Prophet himself paid the blood money (of `Abdullah). (See Hadith No. 36 Vol. 9.)

حَدَّثَنَا مُسَدَّدٌ، حَدَّثَنَا بِشْرٌ ـ هُوَ ابْنُ الْمُفَضَّلِ ـ حَدَّثَنَا يَحْيَى، عَنْ بُشَيْرِ بْنِ يَسَارٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، قَالَ انْطَلَقَ عَبْدُ اللَّهِ بْنُ سَهْلٍ وَمُحَيِّصَةُ بْنُ مَسْعُودِ بْنِ زَيْدٍ إِلَى خَيْبَرَ، وَهْىَ يَوْمَئِذٍ صُلْحٌ، فَتَفَرَّقَا، فَأَتَى مُحَيِّصَةُ إِلَى عَبْدِ اللَّهِ بْنِ سَهْلٍ وَهْوَ يَتَشَحَّطُ فِي دَمٍ قَتِيلاً، فَدَفَنَهُ ثُمَّ قَدِمَ الْمَدِينَةَ، فَانْطَلَقَ عَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ وَمُحَيِّصَةُ وَحُوَيِّصَةُ ابْنَا مَسْعُودٍ إِلَى النَّبِيِّ صلى الله عليه وسلم، فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ فَقَالَ ‏"‏ كَبِّرْ كَبِّرْ ‏"‏‏.‏ وَهْوَ أَحْدَثُ الْقَوْمِ، فَسَكَتَ فَتَكَلَّمَا فَقَالَ ‏"‏ أَتَحْلِفُونَ وَتَسْتَحِقُّونَ قَاتِلَكُمْ أَوْ صَاحِبَكُمْ ‏"‏‏.‏ قَالُوا وَكَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَرَ قَالَ ‏"‏ فَتُبْرِيكُمْ يَهُودُ بِخَمْسِينَ ‏"‏‏.‏ فَقَالُوا كَيْفَ نَأْخُذُ أَيْمَانَ قَوْمٍ كُفَّارٍ فَعَقَلَهُ النَّبِيُّ صلى الله عليه وسلم مِنْ عِنْدِهِ‏.‏

"I saw Ibn Rafi' [and he is 'Ubaidullah bin Abi Rafi', the freed slave of the Messenger of Allah (saws) - and Aslam was the name of Ibn Abi Rafi] wearing a ring on his right, so I asked him about that. He said, 'I saw 'Abdullah bin Ja'far wearing a ring on his right hand, and he ['Abdullah bin Ja'far] said: "The Messenger of Allah (saws) wore a ring on his right hand."

He said: Muhammad [bin Isma'il] said: "This is the most correct thing related from the Prophet (saws) on this topic."

Abū Bakr ibn in-Naḍr bin Abīn-Naḍr narrated to me, he said Abūn-Naḍr Hāshim bin ul-Qāsim narrated to me, Abū Aqīl, companion of Buhayyah, narrated to us, he said:
‘I was sitting near al-Qāsim bin Ubayd Allah and Yahyā bin Sa’īd [bin Qays al-Madanī al-Qāḍī], when Yahyā said to al-Qāsim: ‘Oh Abā Muhammad! Indeed it is gravely harmful for the likes of you to be asked about something from the affair of this Dīn, and then knowledge of it is not found with you, and no relief [in the form of an answer]’ -or- ‘…knowledge and no articulation’. So al-Qāsim said [to Yahyā bin Sa’īd]: ‘Where did that come from?’ [Yahyā] said: ‘It is because you are the son of two Imāms of guidance- a descendent of Abu Bakr and Umar.’ [al-Qāsim] said to him: ‘More harmful than that- according to whoever reflects about Allah- is to speak without knowledge or to take [Ḥadīth] from someone who is not trustworthy’. [Abū Aqīl] said: ‘So [Yahyā bin Sa’īd] was quiet and did not respond to him’.

That the Messenger of Allah (saws) said: "Whatever a lot of it intoxicates, a little of it is unlawful."

Yahya related to me from Malik from Muhammad ibn Abi Bakr ibn Amr ibn Hazm from his father from Abu'n-Nadr as-Salami that the Messenger of Allah, may Allah bless him and grant him peace, said, "If three of a muslim's children die, and he remains content with that, they will be a protection for him from the Fire." A woman who was with the Messenger of Allah, may Allah bless him and grant him peace, said, "Or two, Messengerof Allah?", and he said, "Or two."

It was narrated that Muhammad said:
"I was sitting with some people in Al-Kufah in a large gathering of the Ansar, among whom was 'Abdur-Rahman bin Abi Laila. They spoke about the story of Subai'ah and I mentioned what 'Abdullah bin 'Utbah bin Mas'ud had said in meaning." (One of the narrators) Ibn 'Awn's saying was: "when she gives birth." Ibn Abi Layla said: 'But his (paternal) uncle did not say that.' I raised my voice and said: 'Would I dare to tell lies about 'Abdullah bin 'Utbah when he is in the vicinity of Al-Kufah?'" He said: "Then I met Malik and said: 'What did Ibn Mas'ud say about the story of Subai'ah?' He said: 'He said: "Are you going to be too strict with her and not allow her the concession (with regard to the 'Iddah)? The shorter Surah about women (At-Talaq) was revealed after the longer one (Al-Baqarah)."'"

Yahya related to me from Malik that Abdullah ibn Abi Bakr ibn Muhammad ibn Amr ibn Hazim heard Urwa ibn az-Zubayr saying, "I went to see Marwan ibn al-Hakam and we talked about what you had to do wudu for, and Marwan said, 'You have to do wudu if you touch your penis.' Urwa said, 'I didn't know that.' Marwan ibn al-Hakam said that Busra bint Safwan had told him that she heard the Messenger of Allah, may Allah bless him and grant him peace, say, 'If any of you touches his penis he should do wudu.' "

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، أَنَّهُ سَمِعَ عُرْوَةَ بْنَ الزُّبَيْرِ، يَقُولُ دَخَلْتُ عَلَى مَرْوَانَ بْنِ الْحَكَمِ فَتَذَاكَرْنَا مَا يَكُونُ مِنْهُ الْوُضُوءُ فَقَالَ مَرْوَانُ وَمِنْ مَسِّ الذَّكَرِ الْوُضُوءُ ‏.‏ فَقَالَ عُرْوَةُ مَا عَلِمْتُ هَذَا ‏.‏ فَقَالَ مَرْوَانُ بْنُ الْحَكَمِ أَخْبَرَتْنِي بُسْرَةُ بِنْتُ صَفْوَانَ أَنَّهَا سَمِعَتْ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ إِذَا مَسَّ أَحَدُكُمْ ذَكَرَهُ فَلْيَتَوَضَّأْ ‏"‏ ‏.‏

Yahya related to me from Malik from Abdullah ibn Abi Bakr ibn Muhammad ibn Amr ibn Hazm that he heard that the Messenger of Allah, may Allah bless him and grant him peace, said about the flood-channels of Mahzur and Mudhaynib (in Madina), "Dam them systematically, so that the water is diverted into each property in turn up to ankle level, starting upstream."

I asked Aba Salama bin `Abdur-Rahman about the first Sura revealed of the Qur'an. He replied "O you, wrapped-up (i.e. Al Muddaththir)." I said, "They say it was, 'Read, in the Name of your Lord Who created,' (i.e. Surat Al-`Alaq (the Clot)." On that, Abu Salama said, "I asked Jabir bin `Abdullah about that, saying the same as you have said, whereupon he said, 'I will not tell you except what Allah's Apostle had told us. Allah's Apostle said, "I was in seclusion in the cave of Hiram', and after I completed the limited period of my seclusion. I came down (from the cave) and heard a voice calling me. I looked to my right, but saw nothing. Then I looked up and saw something. So I went to Khadija (the Prophet's wife) and told her to wrap me up and pour cold water on me. So they wrapped me up and poured cold water on me." Then, 'O you, (Muhammad) wrapped up! Arise and warn,' (Surat Al Muddaththir) was revealed." (74.1)

Narrated Ibn `Umar:

When the people of Khaibar dislocated `Abdullah bin `Umar's hands and feet, `Umar got up delivering a sermon saying, "No doubt, Allah's Apostle made a contract with the Jews concerning their properties, and said to them, 'We allow you (to stand in your land) as long as Allah allows you.' Now `Abdullah bin `Umar went to his land and was attacked at night, and his hands and feet were dislocated, and as we have no enemies there except those Jews, they are our enemies and the only people whom we suspect, I have made up my mind to exile them." When `Umar decided to carry out his decision, a son of Abu Al-Haqiq's came and addressed `Umar, "O chief of the believers, will you exile us although Muhammad allowed us to stay at our places, and made a contract with us about our properties, and accepted the condition of our residence in our land?" `Umar said, "Do you think that I have forgotten the statement of Allah's Apostle, i.e.: What will your condition be when you are expelled from Khaibar and your camel will be carrying you night after night?" The Jew replied, "That was joke from Abul-Qasim." `Umar said, "O the enemy of Allah! You are telling a lie." `Umar then drove them out and paid them the price of their properties in the form of fruits, money, camel saddles and ropes, etc."

حَدَّثَنَا أَبُو أَحْمَدَ، حَدَّثَنَا مُحَمَّدُ بْنُ يَحْيَى أَبُو غَسَّانَ الْكِنَانِيُّ، أَخْبَرَنَا مَالِكٌ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ ـ رضى الله عنهما ـ قَالَ لَمَّا فَدَعَ أَهْلُ خَيْبَرَ عَبْدَ اللَّهِ بْنَ عُمَرَ، قَامَ عُمَرُ خَطِيبًا فَقَالَ إِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم كَانَ عَامَلَ يَهُودَ خَيْبَرَ عَلَى أَمْوَالِهِمْ، وَقَالَ ‏"‏ نُقِرُّكُمْ مَا أَقَرَّكُمُ اللَّهُ ‏"‏‏.‏ وَإِنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ خَرَجَ إِلَى مَالِهِ هُنَاكَ فَعُدِيَ عَلَيْهِ مِنَ اللَّيْلِ، فَفُدِعَتْ يَدَاهُ وَرِجْلاَهُ، وَلَيْسَ لَنَا هُنَاكَ عَدُوٌّ غَيْرُهُمْ، هُمْ عَدُوُّنَا وَتُهَمَتُنَا، وَقَدْ رَأَيْتُ إِجْلاَءَهُمْ، فَلَمَّا أَجْمَعَ عُمَرُ عَلَى ذَلِكَ أَتَاهُ أَحَدُ بَنِي أَبِي الْحُقَيْقِ، فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ، أَتُخْرِجُنَا وَقَدْ أَقَرَّنَا مُحَمَّدٌ صلى الله عليه وسلم وَعَامَلَنَا عَلَى الأَمْوَالِ، وَشَرَطَ ذَلِكَ لَنَا فَقَالَ عُمَرُ أَظَنَنْتَ أَنِّي نَسِيتُ قَوْلَ رَسُولِ اللَّهِ صلى الله عليه وسلم ‏"‏ كَيْفَ بِكَ إِذَا أُخْرِجْتَ مِنْ خَيْبَرَ تَعْدُو بِكَ قَلُوصُكَ، لَيْلَةً بَعْدَ لَيْلَةٍ ‏"‏‏.‏ ...

Narrated Al-Qasim bin Abi Bazza:

That he asked Sa`id bin Jubair, "Is there any repentance of the one who has murdered a believer intentionally?" Then I recited to him:-- "Nor kill such life as Allah has forbidden except for a just cause." Sa`id said, "I recited this very Verse before Ibn `Abbas as you have recited it before me. Ibn `Abbas said, 'This Verse was revealed in Mecca and it has been abrogated by a Verse in Surat-An-Nisa which was later revealed in Medina."

Narrated Al-Qasim ibn Muhammad ibn AbuBakr:

I said to Aisha! Mother, show me the grave of the Messenger of Allah (saws) and his two Companions (Allah be pleased with them). She showed me three graves which were neither high nor low, but were spread with soft red pebbles in an open space.

Abu 'Ali said: It is said that the Messenger of Allah (saws) is forward, Abu Bakr is near his head and 'Umar is near is feet. His head is at the feet of the Messenger of Allah (saws).

Malik related to me from Suhayl ibn Abi Salih from his father from Abu Hurayra that the Messenger of Allah, may Allah bless him and grant him peace, said, "Allah is pleased with three things from you, and He is angry with three things from you. He is pleased that you worship Him and do not associate anything with Him, and that you take hold of the rope of Allah altogether, and that you give good counsel to the one to whom Allah gives command over you. He is angry with you for gossip, squandering property, and asking too many questions."

Abu Rabiah binAl-Harith said to 'Abdul-Muttalib bin Rabi'ah bin Al-Harith and Al-Fadl bin 'Abbas bin 'Abdul-Muttalib:
"Go to the Messenger of Allah and say to him: 'O Messenger of Allah, appoint us to collect the Sadaqat!' 'Ali bin Abi Talib came along when we were like that, and he said to them: "The Messenger of Allah will not appoint any of you to collect the Sadaqah."' 'Abdul-Muttalib said: "So I went with Al-Fadl until we came to the Messenger of Allah and he said to us: "This Zakah is the dirt of the people, and it is not permissible for Muhammad or for the family of Muhammad."'

It was narrated from Sahl bin Abi Hathamah that the Prophet forbade selling fruits before their condition was known, but he granted a concession allowing 'Araya sales by estimate, so its people could eat fresh dates.

Yahya related to me from Malik, from Jafar ibn Muhammad, from his father, that al-Miqdad ibn al-Aswad once went to see AIi ibn Abi Talibat as-Suqya, where he was feeding some young camels of his with a mash of meal and leaves, and he said to him, "This man Uthman ibn Affan is telling people that they cannot do hajj and umra together."

Al-Miqdad said, "Ali ibn Abi Talib went off with bits of meal and leaves on his forearms - and I shall never forget the sight of the meal and the leaves on his arms - and went to see Uthman ibn Affan and asked him, 'Are you saying then that people cannot do hajj and umra together?' Uthman replied, 'That is my opinion.' Whereupon AIi got angry and went out saying, 'I am at your service, O Allah, I am at your service for a hajj and an umra together.' "

Malik said, "Our position (here in Madina) is that someone who does hajj and umra together should not remove any of his hair, nor should he come out of ihram in any way until he has sacrificed an animal, if he has one. He should come out of ihram at Mina, on the day of the sacrifice."

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، أَنَّ الْمِقْدَادَ بْنَ الأَسْوَدِ، دَخَلَ عَلَى عَلِيِّ بْنِ أَبِي طَالِبٍ بِالسُّقْيَا وَهُوَ يَنْجَعُ بَكَرَاتٍ لَهُ دَقِيقًا وَخَبَطًا فَقَالَ هَذَا عُثْمَانُ بْنُ عَفَّانَ يَنْهَى عَنْ أَنْ يُقْرَنَ بَيْنَ الْحَجِّ وَالْعُمْرَةِ ‏.‏ فَخَرَجَ عَلِيُّ بْنُ أَبِي طَالِبٍ وَعَلَى يَدَيْهِ أَثَرُ الدَّقِيقِ وَالْخَبَطِ - فَمَا أَنْسَى أَثَرَ الدَّقِيقِ وَالْخَبَطِ عَلَى ذِرَاعَيْهِ - حَتَّى دَخَلَ عَلَى عُثْمَانَ بْنِ عَفَّانَ فَقَالَ أَنْتَ تَنْهَى عَنْ أَنْ يُقْرَنَ بَيْنَ الْحَجِّ وَالْعُمْرَةِ فَقَالَ عُثْمَانُ ذَلِكَ رَأْيِي ‏.‏ فَخَرَجَ عَلِيٌّ مُغْضَبًا وَهُوَ يَقُولُ لَبَّيْكَ اللَّهُمَّ لَبَّيْكَ بِحَجَّةٍ وَعُمْرَةٍ مَعًا ‏.‏ قَالَ مَالِكٌ الأَمْرُ عِنْدَنَا أَنَّ مَنْ قَرَنَ الْحَجَّ وَالْعُمْرَةَ لَمْ يَأْخُذْ مِنْ شَعَرِهِ شَيْئًا وَلَمْ يَحْلِلْ مِنْ شَىْءٍ حَتَّى يَنْحَرَ هَدْيًا إِنْ كَانَ مَعَهُ وَيَحِلُّ بِمِنًى يَوْمَ النَّحْرِ ‏.‏

It was narrated that Qatadah said:
"Sulaiman bin Hisham asked me about a lifelong gift. I said: 'Muhammad bin Sirin narrated that Shuraih said: "The Prophet of Allah ruled that a lifelong gift is permissible."'" Qatadah said: "I said: 'And An-Nadr bin Anas narrated to me, from Bashir bin Nahik, from Abu Hurairah, that the Prophet of Allah said: "A lifelong gift is permissible."'" Qatadah said: "I said: 'Al-Hasan used to say: "A lifelong gift is permissible."'" Qatadah said: "Az-Zuhri said: 'A lifelong gift is when it is stipulated that it is for the one to whom it is given and his descendants, but if his descendants were not mentioned then the condition is valid (and it reverts to the one who gave it).'" Qatadah said: "So 'Ata' bin Abi Rabah was asked, and he said: 'Jabir bin Abdullah narrated to me that Allah's Messenger said: "Umra is permissible."'" Qatadah said: "Az-Zuhri said: 'The Caliphs (Khulafa') did not rule according to this.'" 'Ata' said: "Abdul-Malik bin Marwan ruled according to this."

It was narrated from Sahl bin Abi Hathmah that:
'Abdullah bin Sahi Al-Anasri and Muhayysah bin Mas'ud went out to Khaibar and went their separate ways to go about their business. 'Abdullah bin Sahl Al-Anasari was killed and Muhayysah. 'Abdur-Rahman, who was the brother of the victim, and Huwayysah, came to the Messenger of Allah. 'Abdur-Rahman started to speak, but the prophert said to him: "Let the elders speak first." So Muhayysah and Huwayysah spoke and told him about the case of 'Abdullah bin Sahl. The Messenger of Allah said: "Will you swear fifty oaths, then you will receive compensation or be entitled to retaliate?" They said: "How can we swear an oath when we did not witness (what happened) and we were not there?" The Messenger of Allah said: "Then can the Jews swear fifty oaths declaring their innocence?" They said: "O Messenger of Allah, how can we accept the oath of a disbelieving people?" So the Messenger of Allah paid the blood money himself. (One of the narrators) Bushair said: 'One of those camels kicked me in a Mirbad of ours."'
أَخْبَرَنَا مُحَمَّدُ بْنُ بَشَّارٍ، قَالَ حَدَّثَنَا عَبْدُ الْوَهَّابِ، قَالَ سَمِعْتُ يَحْيَى بْنَ سَعِيدٍ، يَقُولُ أَخْبَرَنِي بُشَيْرُ بْنُ يَسَارٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ الأَنْصَارِيَّ، وَمُحَيِّصَةَ بْنَ مَسْعُودٍ، خَرَجَا إِلَى خَيْبَرَ فَتَفَرَّقَا فِي حَاجَتِهِمَا فَقُتِلَ عَبْدُ اللَّهِ بْنُ سَهْلٍ الأَنْصَارِيُّ فَجَاءَ مُحَيِّصَةُ وَعَبْدُ الرَّحْمَنِ أَخُو الْمَقْتُولِ وَحُوَيِّصَةُ بْنُ مَسْعُودٍ حَتَّى أَتَوْا رَسُولَ اللَّهِ صلى الله عليه وسلم فَذَهَبَ عَبْدُ الرَّحْمَنِ يَتَكَلَّمُ فَقَالَ لَهُ النَّبِيُّ صلى الله عليه وسلم ‏"‏ الْكُبْرَ الْكُبْرَ ‏"‏ ‏.‏ فَتَكَلَّمَ مُحَيِّصَةُ وَحُوَيِّصَةُ فَذَكَرُوا شَأْنَ عَبْدِ اللَّهِ بْنِ سَهْلٍ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ تَحْلِفُونَ خَمْسِينَ يَمِينًا فَتَسْتَحِقُّونَ قَاتِلَكُمْ ‏"‏ ‏.‏ قَالُوا كَيْفَ نَحْلِفُ وَلَمْ نَشْهَدْ وَلَمْ نَحْضُرْ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ فَتُبَرِّئُكُمْ يَهُودُ بِخَمْسِينَ يَمِينًا ‏"‏ ‏.‏ قَالُوا يَا رَسُولَ اللَّهِ كَيْفَ نَقْبَلُ أَيْمَانَ قَوْمٍ كُفَّارٍ ...

Al-Qasim used to walk in front of the funeral procession. He used not to get up for the funeral procession (in case it passed by him). And he narrated from `Aisha that she said, "The people of the pre-lslamic period of ignorance used to stand up for the funeral procession. When they saw it they used to say twice: 'You were noble in your family. What are you now?"

Yahya related to me from Malik from Ayyub ibn Abi Tamima as- Sakhtayani from Muhammad ibn Sirin that Umm Atiyya al-Ansariyya said, "The Messenger of Allah, may Allah bless him and grant him peace, came to us when his daughter died and said, 'Wash her three times, or five, or more than that if you think it necessary, with water and lotus leaves, and at the end put on some camphor, or a little camphor, and when you have finished let me know.' When we finished we told him, and he gave us his waist-wrapper and said, 'Shroud her with this.' "

Narrated Abu Sa`id Al-Khudri:

When `Ali was in Yemen, he sent some gold in its ore to the Prophet. The Prophet distributed it among Al-Aqra' bin H`Abis Al-Hanzali who belonged to Bani Mujashi, 'Uyaina bin Badr Al-Fazari, 'Alqama bin 'Ulatha Al-`Amiri, who belonged to the Bani Kilab tribe and Zaid AI-Khail at-Ta'i who belonged to Bani Nabhan. So the Quraish and the Ansar became angry and said, "He gives to the chiefs of Najd and leaves us!" The Prophet said, "I just wanted to attract and unite their hearts (make them firm in Islam)." Then there came a man with sunken eyes, bulging forehead, thick beard, fat raised cheeks, and clean-shaven head, and said, "O Muhammad! Be afraid of Allah! " The Prophet said, "Who would obey Allah if I disobeyed Him? (Allah). He trusts me over the people of the earth, but you do not trust me?" A man from the people (present then), who, I think, was Khalid bin Al- Walid, asked for permission to kill him, but the Prophet prevented him. When the man went away, the Prophet said, "Out of the offspring of this man, there will be people who will recite the Qur'an but it will not go beyond their throats, and they will go out of Islam as an arrow goes out through the game, and they will kill the Muslims and leave the idolators. Should I live till they appear, I would kill them as the Killing of the nation of 'Ad."

Ka`b bin Ujrah met me and said, "Shall I not give you a present I got from the Prophet?" `Abdur- Rahman said, "Yes, give it to me." I said, "We asked Allah's Apostle saying, 'O Allah's Apostle! How should one (ask Allah to) send blessings on you, the members of the family, for Allah has taught us how to salute you (in the prayer)?' He said, 'Say: O Allah! Send Your Mercy on Muhammad and on the family of Muhammad, as You sent Your Mercy on Abraham and on the family of Abraham, for You are the Most Praise-worthy, the Most Glorious. O Allah! Narrated Hisham's father from Al-Mughira bin Shu'ba:

'Umar consulted the companions about the case of a woman's abortion (caused by somebody else). Al-Mughira said: The Prophet gave the verdict that a male or female slave should be given (as a Diya). Then Muhammad bin Maslama testified that he had witnessed the Prophet giving such a verdict.

Malik related to me from Yazid ibn Abdullah ibn al-Hadi from Muhammad ibn Ibrahim ibn al-Harith at-Taymi from Sulayman ibn Yasar from Abdullah ibn Abi Umayya that a woman's husband died, and she did the idda of four months and ten days. Then she married when she was free to marry. She stayed with her husband for four and a half months, then gave birth to a fully developed child. Her husband went to Umar ibn al-Khattab and mentioned that to him, so Umar called some of the old women of the Jahiliyya and asked them about that. One of the women said, "I will tell you what happened with this woman. When her husband died, she was pregnant by him, but then the blood flowed from her because of his death and the child became dry in her womb. When her new husband had intercourse with her and the water reached the child, the child moved in the womb and grew." Umar ibn al-Khattab believed her and separated them (until she had completed her idda). Umar said, "Only good has reached me about you two," and he connected the child to the first husband.

وَحَدَّثَنِي مَالِكٌ، عَنْ يَزِيدَ بْنِ عَبْدِ اللَّهِ بْنِ الْهَادِي، عَنْ مُحَمَّدِ بْنِ إِبْرَاهِيمَ بْنِ الْحَارِثِ التَّيْمِيِّ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي أُمَيَّةَ، أَنَّ امْرَأَةً، هَلَكَ عَنْهَا زَوْجُهَا فَاعْتَدَّتْ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ثُمَّ تَزَوَّجَتْ حِينَ حَلَّتْ فَمَكَثَتْ عِنْدَ زَوْجِهَا أَرْبَعَةَ أَشْهُرٍ وَنِصْفَ شَهْرٍ ثُمَّ وَلَدَتْ وَلَدًا تَامًّا فَجَاءَ زَوْجُهَا إِلَى عُمَرَ بْنِ الْخَطَّابِ فَذَكَرَ ذَلِكَ لَهُ فَدَعَا عُمَرُ نِسْوَةً مِنْ نِسَاءِ الْجَاهِلِيَّةِ قُدَمَاءَ فَسَأَلَهُنَّ عَنْ ذَلِكَ فَقَالَتِ امْرَأَةٌ مِنْهُنَّ أَنَا أُخْبِرُكَ عَنْ هَذِهِ الْمَرْأَةِ هَلَكَ عَنْهَا زَوْجُهَا حِينَ حَمَلَتْ مِنْهُ فَأُهْرِيقَتْ عَلَيْهِ الدِّمَاءُ فَحَشَّ وَلَدُهَا فِي بَطْنِهَا فَلَمَّا أَصَابَهَا زَوْجُهَا الَّذِي نَكَحَهَا وَأَصَابَ الْوَلَدَ الْمَاءُ تَحَرَّكَ الْوَلَدُ فِي بَطْنِهَا وَكَبِرَ ‏.‏ فَصَدَّقَهَا عُمَرُ بْنُ الْخَطَّابِ وَفَرَّقَ بَيْنَهُمَا وَقَالَ عُمَرُ أَمَا إِنَّهُ لَمْ يَبْلُغْنِي عَنْكُمَا إِلاَّ خَيْرٌ وَأَلْحَقَ الْوَلَدَ بِالأَوَّلِ ‏.‏

This is more correct. [Abu 'Eisa said:] This is how it was reported by Sufyan Ath-Thawri and others, from 'Abdur-Rahman bin Al-Qasim, in Mawquf form, and this is more correct.

Narrated Salih bin Khawwat on the authority of one who offered the Fear prayer with Allah's Messenger (SAW) at the battle of Dhatur-Riqa' that a group (of the army) formed a line along with him and a group faced the enemy. He (SAW) led the group which was with him in a Rak'ah, and then remained standing while they finished their prayer by themselves. They then departed and lined up facing the enemy, and the other party came. He led them in the remaining Rak'a (of his prayer), after which he remained sitting while they finished their prayer by themselves. He then led them in uttering the Taslim (salutation). [Agreed upon; and this is the wording of Muslim].
عَنْ صَالِحِ بْنِ خَوَّاتٍ, { عَمَّنْ صَلَّى مَعَ رَسُولِ اَللَّهِ ‏- صلى الله عليه وسلم ‏-يَوْمَ ذَاتِ اَلرِّقَاعِ صَلَاةَ اَلْخَوْفِ: أَنَّ طَائِفَةً صَلَّتْ 1‏ مَعَهُ وَطَائِفَةٌ وِجَاهَ اَلْعَدُوِّ, فَصَلَّى بِاَلَّذِينَ مَعَهُ رَكْعَةً, ثُمَّ ثَبَتَ قَائِمًا وَأَتَمُّوا لِأَنْفُسِهِمْ, ثُمَّ اِنْصَرَفُوا فَصَفُّوا وِجَاهَ اَلْعَدُوِّ, وَجَاءَتِ اَلطَّائِفَةُ اَلْأُخْرَى, فَصَلَّى بِهِمْ اَلرَّكْعَةَ اَلَّتِي بَقِيَتْ, ثُمَّ ثَبَتَ جَالِسًا وَأَتَمُّوا لِأَنْفُسِهِمْ, ثُمَّ سَلَّمَ بِهِمْ } مُتَّفَقٌ عَلَيْهِ, وَهَذَا لَفْظُ مُسْلِمٍ 2‏ .‏

Yahya related to me from Malik that Muhammad ibn Abdullah ibn Abi Sasaca said that he heard Abu'l-Hubab Said ibn Yasar say that he had heard Abu Hurayra say, "The Messenger of Allah, may Allah bless him and grant him peace, said, 'Allah afflicts the one for whom He desires good.'"

وَحَدَّثَنِي مَالِكٌ، عَنْ مُحَمَّدِ بْنِ عَبْدِ اللَّهِ بْنِ أَبِي صَعْصَعَةَ، أَنَّهُ قَالَ سَمِعْتُ أَبَا الْحُبَابِ، سَعِيدَ بْنَ يَسَارٍ يَقُولُ سَمِعْتُ أَبَا هُرَيْرَةَ، يَقُولُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ مَنْ يُرِدِ اللَّهُ بِهِ خَيْرًا يُصِبْ مِنْهُ ‏"‏ ‏.‏

It was narrated from Abu Laila bin 'Abdullah bin 'Abdur-Rahman bin Sahl, from Sahl bin Abi Hathmah, that:
he informed him, ans some men among the elders of his people, that "Abdullah bin Sahl and Muhayysah set out for Khaibar because of some problem that had arisen. Someone came to Muhayysah, and he told him that 'Abdullah bin Sahl had been killed and thrown into a pit or well. He came to the Jews and said: "By Allah, you killed him." They said: "By Allah, we did not kill him." Then he went baack to his people and told them about that. Then he and his brother Huwayysah, who was older than him, and 'Abdur-Rahman bin Sahl, came (to the prophet). Muhayysah, who was the one who had been at Khaibar, bnegan to speak, but the Messenger of Allah said: "Let the elder speak first." So Huwayysah spoke, then Muhayysah spoke. The Messenger of Allah said: "Either (the Jews) will pay the Diyah for your companion, or war will be declared on them." The Messenger of Allah sent a letter to that effect (to the Jews) and they wrote back saying: "By Allah, we did not kill him." The Messenger of Allah and 'Abdur-Rahman: "Will you swear an oath establishing your claim to the blood money of your companion?" They said: "No." He said: "Should the Jews swear an oath for you?" They said: "They are not Muslims." So the Messenger of Allah paid it himself, and he sent one hundred she-camels to their abodes. Sahl said: "A red she-camel from among them kicked me."
أَخْبَرَنَا مُحَمَّدُ بْنُ سَلَمَةَ، قَالَ أَنْبَأَنَا ابْنُ الْقَاسِمِ، قَالَ حَدَّثَنِي مَالِكٌ، عَنْ أَبِي لَيْلَى بْنِ عَبْدِ اللَّهِ بْنِ عَبْدِ الرَّحْمَنِ بْنِ سَهْلٍ، عَنْ سَهْلِ بْنِ أَبِي حَثْمَةَ، أَنَّهُ أَخْبَرَهُ وَرِجَالٌ، مِنْ كُبَرَاءِ قَوْمِهِ أَنَّ عَبْدَ، اللَّهِ بْنَ سَهْلٍ وَمُحَيِّصَةَ خَرَجَا إِلَى خَيْبَرَ مِنْ جَهْدٍ أَصَابَهُمْ فَأُتِيَ مُحَيِّصَةُ فَأُخْبِرَ أَنَّ عَبْدَ اللَّهِ بْنَ سَهْلٍ قَدْ قُتِلَ وَطُرِحَ فِي فَقِيرٍ أَوْ عَيْنٍ فَأَتَى يَهُودَ وَقَالَ أَنْتُمْ وَاللَّهِ قَتَلْتُمُوهُ قَالُوا وَاللَّهِ مَا قَتَلْنَاهُ ‏.‏ فَأَقْبَلَ حَتَّى قَدِمَ عَلَى قَوْمِهِ فَذَكَرَ لَهُمْ ثُمَّ أَقْبَلَ هُوَ وَأَخُوهُ حُوَيِّصَةُ وَهُوَ أَكْبَرُ مِنْهُ وَعَبْدُ الرَّحْمَنِ بْنُ سَهْلٍ فَذَهَبَ مُحَيِّصَةُ لِيَتَكَلَّمَ وَهُوَ الَّذِي كَانَ بِخَيْبَرَ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم لِمُحَيِّصَةَ ‏"‏ كَبِّرْ كَبِّرْ ‏"‏ ‏.‏ يُرِيدُ السِّنَّ فَتَكَلَّمَ حُوَيِّصَةُ ثُمَّ تَكَلَّمَ مُحَيِّصَةُ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ إِمَّا أَنْ يَدُوا صَاحِبَكُمْ وَإِمَّا أَنْ يُؤْذَنُوا بِحَرْبٍ ...

It was narrated from' Abdullah bin Abi Bakr bin Muhammad bin 'Amr bin Hazm that his rather said:
"The letter which the Messenger of Allah wrote to 'Amr bin Hazm concerning blood money: 'For a soul, one hundred camels; for the nose if it is cut off completely, one hundred camels, for a blow to thread that reaches the brain, one third of the Diyah for a soul; for a stab wound that penetrates deeply, likewise; for a hand fifty; for an eye, fifty, for a foot, fifty; for every fingers, Ten camels for a tooth, five; and for a wound that exposes the bone, five.
قَالَ الْحَارِثُ بْنُ مِسْكِينٍ قِرَاءَةً عَلَيْهِ وَأَنَا أَسْمَعُ، عَنِ ابْنِ الْقَاسِمِ، قَالَ حَدَّثَنِي مَالِكٌ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ أَبِيهِ، قَالَ الْكِتَابُ الَّذِي كَتَبَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم لِعَمْرِو بْنِ حَزْمٍ فِي الْعُقُولِ ‏"‏ إِنَّ فِي النَّفْسِ مِائَةً مِنَ الإِبِلِ وَفِي الأَنْفِ إِذَا أُوعِيَ جَدْعًا مِائَةً مِنَ الإِبِلِ وَفِي الْمَأْمُومَةِ ثُلُثُ النَّفْسِ وَفِي الْجَائِفَةِ مِثْلُهَا وَفِي الْيَدِ خَمْسُونَ وَفِي الْعَيْنِ خَمْسُونَ وَفِي الرِّجْلِ خَمْسُونَ وَفِي كُلِّ إِصْبَعٍ مِمَّا هُنَالِكَ عَشْرٌ مِنَ الإِبِلِ وَفِي السِّنِّ خَمْسٌ وَفِي الْمُوضِحَةِ خَمْسٌ ‏"‏ ‏.‏

Narrated Rafi` 'bin Khadij and Sahl bin Abi Hathma:

Allah's Apostle forbade the sale of Muzabana, i.e. selling of fruits for fruits, except in the case of 'Araya; he allowed the owners of 'Araya such kind of sale.

حَدَّثَنَا زَكَرِيَّاءُ بْنُ يَحْيَى، أَخْبَرَنَا أَبُو أُسَامَةَ، قَالَ أَخْبَرَنِي الْوَلِيدُ بْنُ كَثِيرٍ، قَالَ أَخْبَرَنِي بُشَيْرُ بْنُ يَسَارٍ، مَوْلَى بَنِي حَارِثَةَ أَنَّ رَافِعَ بْنَ خَدِيجٍ، وَسَهْلَ بْنَ أَبِي حَثْمَةَ، حَدَّثَاهُ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم نَهَى عَنِ الْمُزَابَنَةِ بَيْعِ الثَّمَرِ بِالتَّمْرِ، إِلاَّ أَصْحَابَ الْعَرَايَا فَإِنَّهُ أَذِنَ لَهُمْ‏ .‏ قَالَ أَبُو عَبْدِ اللَّهِ وَقَالَ ابْنُ إِسْحَاقَ حَدَّثَنِي بُشَيْرٌ مِثْلَهُ‏.‏

Yahya related to me from Malik from Yahya ibn Said that Muhammad ibn Yahya ibn Habban said, "My grandfather Habban had two wives, one from the Hashimites and one from the Ansars. He divorced the Ansariyya while she was nursing, and a year passed and he died and she had still not yet menstruated. She said, 'I inherit from him. I have not menstruated yet.' The wives quarrelled and went to Uthman ibn Affan. He decided that she did inherit, and the Hashimiyya rebuked Uthman. He said, 'This is the practice of the son of your paternal uncle. He pointed this out to us.' He meant Ali ibn Abi Talib."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ مُحَمَّدِ بْنِ يَحْيَى بْنِ حَبَّانَ، قَالَ كَانَتْ عِنْدَ جَدِّي حَبَّانَ امْرَأَتَانِ هَاشِمِيَّةٌ وَأَنْصَارِيَّةٌ فَطَلَّقَ الأَنْصَارِيَّةَ وَهِيَ تُرْضِعُ فَمَرَّتْ بِهَا سَنَةٌ ثُمَّ هَلَكَ عَنْهَا وَلَمْ تَحِضْ فَقَالَتْ أَنَا أَرِثُهُ لَمْ أَحِضْ فَاخْتَصَمَتَا إِلَى عُثْمَانَ بْنِ عَفَّانَ فَقَضَى لَهَا بِالْمِيرَاثِ فَلاَمَتِ الْهَاشِمِيَّةُ عُثْمَانَ فَقَالَ هَذَا عَمَلُ ابْنِ عَمِّكِ هُوَ أَشَارَ عَلَيْنَا بِهَذَا يَعْنِي عَلِيَّ بْنَ أَبِي طَالِبٍ ‏.‏

Yahya related to me from Malik from Abdullah ibn Abi Bakr ibn Muhammad ibn Amr ibn Hazm from Humayd ibn Nafi that Zaynab bint Abi Salama related these three traditions to him. Zaynab said, "I visited Umm Habiba, the wife of the Prophet, may Allah bless him and grant him peace, when her father Abu Sufyan ibn Harb had died. Umm Habiba called for a yellowy perfume perhaps khaluq or something else. She rubbed the perfume first on a slave-girl and she then wiped it on the sides of her face and said, 'By Allah! I have no need of perfume but I heard the Messenger of Allah, may Allah bless him and grant him peace, say, 'It is not halal for a woman who trusts in Allah and the Last Day to abstain from adornment in mourning for someone who has died, for more than three nights, except for four months and ten days for a husband.' "

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ عَبْدِ اللَّهِ بْنِ أَبِي بَكْرِ بْنِ مُحَمَّدِ بْنِ عَمْرِو بْنِ حَزْمٍ، عَنْ حُمَيْدِ بْنِ نَافِعٍ، عَنْ زَيْنَبَ بِنْتِ أَبِي سَلَمَةَ، أَنَّهَا أَخْبَرَتْهُ هَذِهِ الأَحَادِيثَ الثَّلاَثَةَ، قَالَتْ زَيْنَبُ دَخَلْتُ عَلَى أُمِّ حَبِيبَةَ زَوْجِ النَّبِيِّ صلى الله عليه وسلم حِينَ تُوُفِّيَ أَبُوهَا أَبُو سُفْيَانَ بْنُ حَرْبٍ فَدَعَتْ أُمُّ حَبِيبَةَ بِطِيبٍ فِيهِ صُفْرَةٌ خَلُوقٌ أَوْ غَيْرُهُ فَدَهَنَتْ بِهِ جَارِيَةً ثُمَّ مَسَحَتْ بِعَارِضَيْهَا ثُمَّ قَالَتْ وَاللَّهِ مَا لِي بِالطِّيبِ مِنْ حَاجَةٍ غَيْرَ أَنِّي سَمِعْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقُولُ ‏ "‏ لاَ يَحِلُّ لاِمْرَأَةٍ تُؤْمِنُ بِاللَّهِ وَالْيَوْمِ الآخِرِ أَنْ تُحِدَّ عَلَى مَيْتٍ فَوْقَ ثَلاَثِ لَيَالٍ إِلاَّ عَلَى زَوْجٍ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا ‏"‏ ‏.‏

Yahya related to me from Malik from Suhayl ibn Abi Salih from his father from Abu Hurayra that a man of the Aslam tribe said, "I did not sleep last night." The Messenger of Allah, may Allah bless him and grant him peace, said to him, "For what reason?" He said, "A scorpion bit me." The Messenger of Allah, may Allah bless him and grant him peace, said, "Had you said in the evening, 'I seek refuge with the complete words of Allah from the evil of what He has created, 'it would not have happened."

Audhu bi kalimati'llahi't-tammati min sharri ma khalaq .

وَحَدَّثَنِي مَالِكٌ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَجُلاً، مِنْ أَسْلَمَ قَالَ مَا نِمْتُ هَذِهِ اللَّيْلَةَ ‏.‏ فَقَالَ لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ مِنْ أَىِّ شَىْءٍ ‏"‏ ‏.‏ فَقَالَ لَدَغَتْنِي عَقْرَبٌ ‏.‏ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ أَمَا إِنَّكَ لَوْ قُلْتَ حِينَ أَمْسَيْتَ أَعُوذُ بِكَلِمَاتِ اللَّهِ التَّامَّاتِ مِنْ شَرِّ مَا خَلَقَ ‏.‏ لَمْ تَضُرَّكَ ‏"‏ ‏.‏

Yahya related to me from Malik from Said ibn Sulayman ibn Zayd ibn Thabit that Kharija ibn Zayd ibn Thabit told him that he was sitting with Zayd ibn Thabit when Muhammad ibn Abi Atiq came to him with his eyes brimming with tears. Zayd asked him what the matter was. He said, "I gave my wife command of herself, and she separated from me." Zayd said to him, "What made you do that?" He said, "The Decree." Zayd said, "Return to her if you wish for it is only one pronouncement, and you have access to her."

حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ سَعِيدِ بْنِ سُلَيْمَانَ بْنِ زَيْدِ بْنِ ثَابِتٍ، عَنْ خَارِجَةَ بْنِ زَيْدِ بْنِ ثَابِتٍ، أَنَّهُ أَخْبَرَهُ أَنَّهُ، كَانَ جَالِسًا عِنْدَ زَيْدِ بْنِ ثَابِتٍ فَأَتَاهُ مُحَمَّدُ بْنُ أَبِي عَتِيقٍ وَعَيْنَاهُ تَدْمَعَانِ فَقَالَ لَهُ زَيْدٌ مَا شَأْنُكَ فَقَالَ مَلَّكْتُ امْرَأَتِي أَمْرَهَا فَفَارَقَتْنِي ‏.‏ فَقَالَ لَهُ زَيْدٌ مَا حَمَلَكَ عَلَى ذَلِكَ قَالَ الْقَدَرُ ‏.‏ فَقَالَ زَيْدٌ ارْتَجِعْهَا إِنْ شِئْتَ فَإِنَّمَا هِيَ وَاحِدَةٌ وَأَنْتَ أَمْلَكُ بِهَا ‏.‏

Yahya related to me from Malik from Suhayl ibn Abi Salih from his father from Abu Hurayra that the Messenger of Allah, may Allah bless him and grant him peace, said, "If Allah loves a slave, he says to Jibril, 'I love so-and-so, so love him,' so Jibril loves him and then calls out to the people of heaven, 'Allah loves so-and-so, so love him,' and the people of heaven love him, and then acceptance is placed in the Earth for him." When Allah is angry with a slave, Malik said, "I consider that he says the like of that about His anger."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ سُهَيْلِ بْنِ أَبِي صَالِحٍ، عَنْ أَبِيهِ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ إِذَا أَحَبَّ اللَّهُ الْعَبْدَ قَالَ لِجِبْرِيلَ قَدْ أَحْبَبْتُ فُلاَنًا فَأَحِبَّهُ ‏.‏ فَيُحِبُّهُ جِبْرِيلُ ثُمَّ يُنَادِي فِي أَهْلِ السَّمَاءِ إِنَّ اللَّهَ قَدْ أَحَبَّ فُلاَنًا فَأَحِبُّوهُ ‏.‏ فَيُحِبُّهُ أَهْلُ السَّمَاءِ ثُمَّ يُوضَعُ لَهُ الْقَبُولُ فِي الأَرْضِ ‏.‏ وَإِذَا أَبْغَضَ اللَّهُ الْعَبْدَ ‏"‏ ‏.‏ قَالَ مَالِكٌ لاَ أَحْسِبُهُ إِلاَّ أَنَّهُ قَالَ فِي الْبُغْضِ مِثْلَ ذَلِكَ ‏.‏

أَخْبَرَنَا هَارُونُ بْنُ عَبْدِ اللَّهِ، قَالَ حَدَّثَنَا قُرَيْشُ بْنُ أَنَسٍ، عَنْ حَبِيبِ بْنِ الشَّهِيدِ، قَالَ لِي مُحَمَّدُ بْنُ سِيرِينَ سَلِ الْحَسَنَ مِمَّنْ سَمِعَ حَدِيثَهُ، فِي الْعَقِيقَةِ ‏.‏ فَسَأَلْتُهُ عَنْ ذَلِكَ، فَقَالَ سَمِعْتُهُ مِنْ، سَمُرَةَ ‏.‏
