Sunan an-Nasa'i 4067
It was narrated from Mus'ab bin Sa'd that his father said:
"On the day of the Conquest of Makkah, the Messenger of Allah [SAW] granted amnesty to the people, except four men and two women. He said: 'Kill them, even if you find them clinging to the covers of Ka'bah.' (They were) 'Ikrimah bin Abi Jahl, 'Abdullah bin Khatal, Miqyas bin Subabah and 'Abdullah bin Sa'd bin Abi As-Sarh. 'Abdullah bin Khatl was caught while he was clinging to the covers of Ka'bah. Sa'eed bin Huraith and 'Ammar bin Yasir both rushed toward him, but Sa'eed, who was the younger of the two, got there before 'Ammar, and he killed him. Miqyas bin Subabah was caught by the people in the marketplace, and they killed him. 'Ikrimah traveled by sea, and he was caught in a storm. The crew of the ship said: 'Turn sincerely toward Allah, for your (false) gods cannot help you at all in this situation.' 'Ikrimah said: 'By Allah, if nothing came to save me at sea except sincerity toward Allah then nothing else will save me on land. O Allah, I promise You that if You save me from this predicament I will go to Muhammad [SAW] and put my hand in his, and I am sure that I will find him generous and forgiving.' So he came, and accepted Islam. 'Abdullah (bin Sa'd) bin Abi Sarh hid in the house of 'Uthman bin 'Affan, and when the Messenger of Allah [SAW] called the people to give their Oath of Allegiance, he brought him, and made him stand before the Prophet [SAW]. He ('Uthman) said: 'O Messenger of Allah! Accept the allegiance of 'Abdullah.' He raised his head and looked at him three times, refusing his allegiance each time, then he accepted his allegiance after three times. Then he turned to his Companions and said: 'Was there not any sensible man among you who would get up when he saw me refusing to give him my hand and kill him?' They said: 'We did not know, O Messenger of Allah, what was in your heart. Why did you not gesture to us with your eyes?' He said: 'It is not befitting for a Prophet that his eyes be deceitful.'"
أَخْبَرَنَا الْقَاسِمُ بْنُ زَكَرِيَّا بْنِ دِينَارٍ، قَالَ حَدَّثَنِي أَحْمَدُ بْنُ مُفَضَّلٍ، قَالَ حَدَّثَنَا أَسْبَاطُ، قَالَ زَعَمَ السُّدِّيُّ عَنْ مُصْعَبِ بْنِ سَعْدٍ، عَنْ أَبِيهِ، قَالَ لَمَّا كَانَ يَوْمُ فَتْحِ مَكَّةَ أَمَّنَ رَسُولُ اللَّهِ صلى الله عليه وسلم النَّاسَ إِلاَّ أَرْبَعَةَ نَفَرٍ وَامْرَأَتَيْنِ وَقَالَ ‏"‏ اقْتُلُوهُمْ وَإِنْ وَجَدْتُمُوهُمْ مُتَعَلِّقِينَ بِأَسْتَارِ الْكَعْبَةِ ‏"‏ ‏.‏ عِكْرِمَةُ بْنُ أَبِي جَهْلٍ وَعَبْدُ اللَّهِ بْنُ خَطَلٍ وَمِقْيَسُ بْنُ صُبَابَةَ وَعَبْدُ اللَّهِ بْنُ سَعْدِ بْنِ أَبِي السَّرْحِ فَأَمَّا عَبْدُ اللَّهِ بْنُ خَطَلٍ فَأُدْرِكَ وَهُوَ مُتَعَلِّقٌ بِأَسْتَارِ الْكَعْبَةِ فَاسْتَبَقَ إِلَيْهِ سَعِيدُ بْنُ حُرَيْثٍ وَعَمَّارُ بْنُ يَاسِرٍ فَسَبَقَ سَعِيدٌ عَمَّارًا - وَكَانَ أَشَبَّ الرَّجُلَيْنِ - فَقَتَلَهُ وَأَمَّا مِقْيَسُ بْنُ صُبَابَةَ فَأَدْرَكَهُ النَّاسُ فِي السُّوقِ فَقَتَلُوهُ وَأَمَّا عِكْرِمَةُ فَرَكِبَ الْبَحْرَ فَأَصَابَتْهُمْ عَاصِفٌ فَقَالَ أَصْحَابُ السَّفِينَةِ أَخْلِصُوا فَإِنَّ آلِهَتَكُمْ لاَ تُغْنِي عَنْكُمْ شَيْئًا هَا هُنَا ‏.‏ فَقَالَ عِكْرِمَةُ وَاللَّهِ لَئِنْ لَمْ يُنَجِّنِي مِنَ الْبَحْرِ إِلاَّ الإِخْلاَصُ لاَ يُنَجِّينِي فِي الْبَرِّ غَيْرُهُ اللَّهُمَّ إِنَّ لَكَ عَلَىَّ عَهْدًا إِنْ أَنْتَ عَافَيْتَنِي مِمَّا أَنَا فِيهِ أَنْ آتِيَ مُحَمَّدًا صلى الله عليه وسلم حَتَّى أَضَعَ يَدِي فِي يَدِهِ فَلأَجِدَنَّهُ عَفُوًّا كَرِيمًا ‏.‏ فَجَاءَ فَأَسْلَمَ وَأَمَّا عَبْدُ اللَّهِ بْنُ سَعْدِ بْنِ أَبِي السَّرْحِ فَإِنَّهُ اخْتَبَأَ عِنْدَ عُثْمَانَ بْنِ عَفَّانَ فَلَمَّا دَعَا رَسُولُ اللَّهِ صلى الله عليه وسلم النَّاسَ إِلَى الْبَيْعَةِ جَاءَ بِهِ حَتَّى أَوْقَفَهُ عَلَى النَّبِيِّ صلى الله عليه وسلم قَالَ يَا رَسُولَ اللَّهِ بَايِعْ عَبْدَ اللَّهِ ‏.‏ قَالَ فَرَفَعَ رَأْسَهُ فَنَظَرَ إِلَيْهِ ثَلاَثًا كُلَّ ذَلِكَ يَأْبَى فَبَايَعَهُ بَعْدَ ثَلاَثٍ ثُمَّ أَقْبَلَ عَلَى أَصْحَابِهِ فَقَالَ ‏"‏ أَمَا كَانَ فِيكُمْ رَجُلٌ رَشِيدٌ يَقُومُ إِلَى هَذَا حَيْثُ رَآنِي كَفَفْتُ يَدِي عَنْ بَيْعَتِهِ فَيَقْتُلَهُ ‏"‏ ‏.‏ فَقَالُوا وَمَا يُدْرِينَا يَا رَسُولَ اللَّهِ مَا فِي نَفْسِكَ هَلاَّ أَوْمَأْتَ إِلَيْنَا بِعَيْنِكَ ‏.‏ قَالَ ‏"‏ إِنَّهُ لاَ يَنْبَغِي لِنَبِيٍّ أَنْ يَكُونَ لَهُ خَائِنَةُ أَعْيُنٍ ‏"‏ ‏.‏

Al-Ahnaf said:
"I came to Al-Madinah, and I was performing Hajj, and while we were in our camping place unloading our mounts, someone came to us and said: 'The people have gathered in the Masjid.' I looked and found the people gathered, and in the midst of them was a group; there I saw 'Ali bin Abi Talib, Az-Zubair, Talhah and Sa'd bin Abi Waqqas, may Allah have mercy on them. When I got there, it was said that 'Uthman bin 'Affan had come. He came, wearing a yellowish cloak. I said to my companion: Stay where you are until I find out what is happening. 'Uthman said: Is 'Ali here? Is Az-Zubair here? Is Talhah here? Is Sa'd here? They said: Yes. He said: I adjure you by Allah, beside Whom there is none worthy of worship, are you aware that the Messenger of Allah said: Whoever buys the Mirbad of Banu so and so, Allah will forgive him, and I bought it, then I came to the Messenger of Allah and told him, and he said: Add it to our Masjid and the reward for it will be yours? They said: Yes. He said: I adjure you by Allah, beside Whom there is none worthy of worship, are you aware that the Messenger of Allah said: Whoever buys the well of Rumah, Allah will forgive him, so I came to the Messenger of Allah and said: I have bought the well of Rumah. He said: Give it to provide water for the Muslims, and the reward for it will be yours? They said: Yes. He said: 'I adjure you by Allah, beside Whom there is none worthy of worship, are you aware that the Messenger of Allah said: Whoever equips the army of Al-'Usrah (i.e. Tabuk), Allah will forgive him, so I equipped them until they were not lacking even a rope or a bridle?' They said: Yes. He said: O Allah, bear witness, O Allah, bear witness, O Allah, bear witness."
أَخْبَرَنَا إِسْحَاقُ بْنُ إِبْرَاهِيمَ، قَالَ أَنْبَأَنَا الْمُعْتَمِرُ بْنُ سُلَيْمَانَ، قَالَ سَمِعْتُ أَبِي يُحَدِّثُ، عَنْ حُصَيْنِ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ عَمْرِو بْنِ جَاوَانَ، - رَجُلٌ مِنْ بَنِي تَمِيمٍ - وَذَاكَ أَنِّي قُلْتُ لَهُ أَرَأَيْتَ اعْتِزَالَ الأَحْنَفِ بْنِ قَيْسٍ مَا كَانَ قَالَ سَمِعْتُ الأَحْنَفَ يَقُولُ أَتَيْتُ الْمَدِينَةَ وَأَنَا حَاجٌّ فَبَيْنَا نَحْنُ فِي مَنَازِلِنَا نَضَعُ رِحَالَنَا إِذْ أَتَى آتٍ فَقَالَ قَدِ اجْتَمَعَ النَّاسُ فِي الْمَسْجِدِ فَاطَّلَعْتُ فَإِذَا يَعْنِي النَّاسَ مُجْتَمِعُونَ وَإِذَا بَيْنَ أَظْهُرِهِمْ نَفَرٌ قُعُودٌ فَإِذَا هُوَ عَلِيُّ بْنُ أَبِي طَالِبٍ وَالزُّبَيْرُ وَطَلْحَةُ وَسَعْدُ بْنُ أَبِي وَقَّاصٍ رَحْمَةُ اللَّهِ عَلَيْهِمْ فَلَمَّا قُمْتُ عَلَيْهِمْ قِيلَ هَذَا عُثْمَانُ بْنُ عَفَّانَ قَدْ جَاءَ - قَالَ - فَجَاءَ وَعَلَيْهِ مُلَيَّةٌ صَفْرَاءُ فَقُلْتُ لِصَاحِبِي كَمَا أَنْتَ حَتَّى أَنْظُرَ مَا جَاءَ بِهِ ‏.‏ فَقَالَ عُثْمَانُ أَهَا هُنَا عَلِيٌّ أَهَا هُنَا الزُّبَيْرُ أَهَا هُنَا طَلْحَةُ أَهَا هُنَا سَعْدٌ قَالُوا نَعَمْ ‏.‏ قَالَ فَأَنْشُدُكُمْ بِاللَّهِ الَّذِي لاَ إِلَهَ إِلاَّ هُوَ أَتَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ مَنْ يَبْتَاعُ مِرْبَدَ بَنِي فُلاَنٍ غَفَرَ اللَّهُ لَهُ ‏"‏ ‏.‏ فَابْتَعْتُهُ فَأَتَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقُلْتُ إِنِّي ابْتَعْتُ مِرْبَدَ بَنِي فُلاَنٍ ‏.‏ قَالَ ‏"‏ فَاجْعَلْهُ فِي مَسْجِدِنَا وَأَجْرُهُ لَكَ ‏"‏ ‏.‏ قَالُوا نَعَمْ ‏.‏ قَالَ فَأَنْشُدُكُمْ بِاللَّهِ الَّذِي لاَ إِلَهَ إِلاَّ هُوَ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ مَنْ يَبْتَاعُ بِئْرَ رُومَةَ غَفَرَ اللَّهُ لَهُ ‏"‏ ‏.‏ فَأَتَيْتُ رَسُولَ اللَّهِ صلى الله عليه وسلم فَقُلْتُ قَدِ ابْتَعْتُ بِئْرَ رُومَةَ ‏.‏ قَالَ ‏"‏ فَاجْعَلْهَا سِقَايَةً لِلْمُسْلِمِينَ وَأَجْرُهَا لَكَ ‏"‏ ‏.‏ قَالُوا نَعَمْ ‏.‏ قَالَ فَأَنْشُدُكُمْ بِاللَّهِ الَّذِي لاَ إِلَهَ إِلاَّ هُوَ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ مَنْ يُجَهِّزْ جَيْشَ الْعُسْرَةِ غَفَرَ اللَّهُ لَهُ ‏"‏ ‏.‏ فَجَهَّزْتُهُمْ حَتَّى مَا يَفْقِدُونَ عِقَالاً وَلاَ خِطَامًا ‏.‏ قَالُوا نَعَمْ ‏.‏ قَالَ اللَّهُمَّ اشْهَدِ اللَّهُمَّ اشْهَدِ اللَّهُمَّ اشْهَدْ ‏.‏

Narrated Az-Zuhri:
from Anas who said: "Hudhaifah bin Al-Yaman came to 'Uthman, at the time when the people of Ash-Sham and the people of Al-'Iraq were waging war to conquer Arminiyah and Adharbijan. Hudhaifah saw their (the people of Ash-Sham and Al-'Iraq) different forms of recitation of the Qur'an. So he said to 'Uthman: 'O Commander of the Believers! Save this nation before they differ about the Book as the Jews and the Christians did before them.' So he ('Uthman) sent a message to Hafsah (saying): 'Send us the manuscripts so that we may copy them in the Musahif (plural of Mushaf: a written copy of the Qur'an) then we shall return it to you.' So Hafsah sent the manuscripts to 'Uthman bin 'Affan. 'Uthman then sent order for Zaid bin Thabit, Sa'eed bin Al-'As, 'Abdur-Rahman bin Al-Harith bin Hisham, and 'Abdullah bin Az-Zubair to copy the manuscripts in the Musahif. 'Uthman said to the three Quraish men: 'In case you disagree with Zaid bin Thabit on any point in the (recitation dialect of the) Qur'an, then write it in the dialect of Quraish for it was in their tongue.' So when they had copied the manuscripts, 'Uthman sent one Mushaf from those Musahif that they had copied to every province." Az-Zuhri said: "Kharijah bin Zaid [bin Thabit] narrated to me that Zaid bin Thabit said: 'I missed an Ayah of Surat Al-Ahzab that I heard the Messenger of Allah (SAW) reciting: Among the believers are men who have been true to their covenant with Allah, of them some have fulfilled their obligations, and some of them are still waiting (33:23) - so I searched for it and found it with Khuzaimah bin Thabit, or Abu Khuzaimah, so I put it in its Surah.'" Az-Zuhri said: "They differed then with At-Tabut and At-Tabuh. The Quraish said: At-Tabut while Zaid said: At-Tabuh. Their disagreement was brought to 'Uthman, so he said: 'Write it as At-Tabut, for it was revealed in the tongue of the Quraish.'" Az-Zuhri said: "'Ubaidullah bin 'Abdullah bin 'Utbah informed me that 'Abdullah bin Mas'ud disliked Zaid bin Thabit copying the Musahif, and he said: 'O you Muslim people! I am removed from recording the transcription of the Mushaf and it is overseen by a man, by Allah, when I accepted Islam he was but in the loins of a disbelieving man' - meaning Zaid bin Thabit - and it was regarding this that 'Abdullah bin Mas'ud said: 'O people of Al-'Iraq! Keep the Musahif that are with you, and conceal them. For indeed Allah said: And whoever conceals something, he shall come with what he concealed ...
حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا عَبْدُ الرَّحْمَنِ بْنُ مَهْدِيٍّ، حَدَّثَنَا إِبْرَاهِيمُ بْنُ سَعْدٍ، عَنِ الزُّهْرِيِّ، عَنْ أَنَسٍ، أَنَّ حُذَيْفَةَ، قَدِمَ عَلَى عُثْمَانَ بْنِ عَفَّانَ وَكَانَ يُغَازِي أَهْلَ الشَّامِ فِي فَتْحِ أَرْمِينِيَّةَ وَأَذْرَبِيجَانَ مَعَ أَهْلِ الْعِرَاقِ فَرَأَى حُذَيْفَةُ اخْتِلاَفَهُمْ فِي الْقُرْآنِ فَقَالَ لِعُثْمَانَ بْنِ عَفَّانَ يَا أَمِيرَ الْمُؤْمِنِينَ أَدْرِكْ هَذِهِ الأُمَّةَ قَبْلَ أَنْ يَخْتَلِفُوا فِي الْكِتَابِ كَمَا اخْتَلَفَتِ الْيَهُودُ وَالنَّصَارَى فَأَرْسَلَ إِلَى حَفْصَةَ أَنْ أَرْسِلِي إِلَيْنَا بِالصُّحُفِ نَنْسَخُهَا فِي الْمَصَاحِفِ ثُمَّ نَرُدُّهَا إِلَيْكِ فَأَرْسَلَتْ حَفْصَةُ إِلَى عُثْمَانَ بِالصُّحُفِ فَأَرْسَلَ عُثْمَانُ إِلَى زَيْدِ بْنِ ثَابِتٍ وَسَعِيدِ بْنِ الْعَاصِي وَعَبْدِ الرَّحْمَنِ بْنِ الْحَارِثِ بْنِ هِشَامٍ وَعَبْدِ اللَّهِ بْنِ الزُّبَيْرِ أَنِ انْسَخُوا الصُّحُفَ فِي الْمَصَاحِفِ وَقَالَ لِلرَّهْطِ الْقُرَشِيِّينَ الثَّلاَثَةِ مَا اخْتَلَفْتُمْ فِيهِ أَنْتُمْ وَزَيْدُ بْنُ ثَابِتٍ فَاكْتُبُوهُ بِلِسَانِ قُرَيْشٍ فَإِنَّمَا نَزَلَ بِلِسَانِهِمْ ‏.‏ حَتَّى نَسَخُوا الصُّحُفَ فِي الْمَصَاحِفِ بَعَثَ عُثْمَانُ إِلَى كُلِّ أُفُقٍ بِمُصْحَفٍ مِنْ تِلْكَ الْمَصَاحِفِ الَّتِي نَسَخُوا ‏.‏ قَالَ الزُّهْرِيُّ وَحَدَّثَنِي خَارِجَةُ بْنُ زَيْدِ بْنِ ثَابِتٍ أَنَّ زَيْدَ بْنَ ثَابِتٍ قَالَ فَقَدْتُ آيَةً مِنْ سُورَةِ الأَحْزَابِ كُنْتُ أَسْمَعُ رَسُولَ اللَّهِ صلى الله عليه وسلم يَقْرَؤُهَا ‏:‏ ‏(‏ مِنَ الْمُؤْمِنِينَ رِجَالٌ صَدَقُوا مَا عَاهَدُوا اللَّهَ عَلَيْهِ فَمِنْهُمْ مَنْ قَضَى نَحْبَهُ ‏)‏ فَالْتَمَسْتُهَا فَوَجَدْتُهَا مَعَ خُزَيْمَةَ بْنِ ثَابِتٍ أَوْ أَبِي خُزَيْمَةَ فَأَلْحَقْتُهَا فِي سُورَتِهَا ‏.‏ قَالَ الزُّهْرِيُّ فَاخْتَلَفُوا يَوْمَئِذٍ فِي التَّابُوتِ وَالتَّابُوهِ فَقَالَ الْقُرَشِيُّونَ التَّابُوتُ ‏.‏ وَقَالَ زَيْدٌ التَّابُوهُ ‏.‏ فَرُفِعَ اخْتِلاَفُهُمْ إِلَى عُثْمَانَ فَقَالَ اكْتُبُوهُ التَّابُوتُ فَإِنَّهُ نَزَلَ بِلِسَانِ قُرَيْشٍ ‏.‏ قَالَ الزُّهْرِيُّ فَأَخْبَرَنِي عُبَيْدُ اللَّهِ بْنُ عَبْدِ اللَّهِ بْنِ عُتْبَةَ أَنَّ عَبْدَ اللَّهِ بْنَ مَسْعُودٍ كَرِهَ لِزَيْدِ بْنِ ثَابِتٍ نَسْخَ الْمَصَاحِفِ وَقَالَ يَا مَعْشَرَ الْمُسْلِمِينَ أُعْزَلُ عَنْ نَسْخِ كِتَابَةِ الْمُصْحَفِ وَيَتَوَلاَّهَا رَجُلٌ وَاللَّهِ لَقَدْ أَسْلَمْتُ وَإِنَّهُ لَفِي صُلْبِ رَجُلٍ كَافِرٍ يُرِيدُ زَيْدَ بْنَ ثَابِتٍ وَلِذَلِكَ قَالَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ يَا أَهْلَ الْعِرَاقِ اكْتُمُوا الْمَصَاحِفَ الَّتِي عِنْدَكُمْ وَغُلُّوهَا فَإِنَّ اللَّهَ يَقُولُ ‏:‏ ‏(‏ وَمَنْ يَغْلُلْ يَأْتِ بِمَا غَلَّ يَوْمَ الْقِيَامَةِ ‏)‏ فَالْقُوا اللَّهَ بِالْمَصَاحِفِ ‏.‏ قَالَ الزُّهْرِيُّ فَبَلَغَنِي أَنَّ ذَلِكَ كَرِهَهُ مِنْ مَقَالَةِ ابْنِ مَسْعُودٍ رِجَالٌ مِنْ أَفَاضِلِ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم ‏.‏ قَالَ هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ ‏.‏ وَهُوَ حَدِيثُ الزُّهْرِيِّ لاَ نَعْرِفُهُ إِلاَّ مِنْ حَدِيثِهِ ‏.‏

Abu Musa Al-Ash'ari (May Allah be pleased with him) reported:
One day, I performed my Wudu' in my house and then set forth with the determination that I would stick to Messenger of Allah (PBUH) and spend the whole day with him. I came to the mosque and asked about him. The Companions told that he (PBUH) had gone in a certain direction. Abu Musa added: I followed him inquiring until I came to Bi'r Aris (a well in the suburb of Al-Madinah). (There) I sat down at the door till he (PBUH) had relieved himself and performed Wudu'. Then I went to him and saw him sitting on the platform of the well with his shanks uncovered and his legs dangling in the well. I greeted him and returned to the door of the garden, saying to myself, "I will be the doorkeeper of the Messenger of Allah today." Abu Bakr (May Allah be pleased with him) came and knocked at the door. I said; "Who is that?" He said: "Abu Bakr." I said, "Wait a moment." Then I went to the Messenger of Allah (PBUH) and said, "O Messenger of Allah! Abu Bakr is at the door seeking permission to enter." He said, "Admit him and give him the glad tidings of Jannah." I returned and said to Abu Bakr (May Allah be pleased with him): "You may enter and Messenger of Allah (PBUH) has given you the glad tidings of (entering) Jannah." Abu Bakr (May Allah be pleased with him) came in and sat down on the right side of Messenger of Allah (PBUH) and suspended his legs into the well and uncovered his shanks, as the Messenger of Allah had done. I returned to the door and sat down. I had left my brother at home while he was performing Wudu' and intending to join me. I said to myself: "If Allah intends good for him (i.e., to be blessed to come at this time and receive the glad tidings of entering Jannah), He will bring him here." Someone knocked at the door and I said, "Who is it?" He said, "Umar bin Al-Khattab." I said, "Wait a moment." Then I proceeded towards Messenger of Allah (PBUH). I greeted him and said, "Umar is at the door, seeking permission to enter. He said, "Let him in and give him the glad tidings of entering Jannah." I went back to 'Umar (May Allah be pleased with him) and said to him, "Messenger of Allah has given you permission as well as glad tidings of entering Jannah." وعن أبي موسى الأشعري رضي الله عنه ، أنه توضأ في بيته، ثم خرج فقال‏:‏ لألزمن رسول الله صلى الله عليه وسلم ، ولأكونن معه يومي هذا، فجاء المسجد، فسأل عن النبي صلى الله عليه وسلم الله عليه وسلم ، فقالوا‏:‏ وجه ههنا، قال‏:‏ فخرجت على أثره أسأل عنه ، حتى دخل بئر أريس، فجلست عند الباب حتى قضى رسول الله صلى الله عليه وسلم حاجته وتوضأ، فقمت إليه، فإذا هو قد جلس على بئر أريس وتوسط قفها، وكشف عن ساقيه ودلاهما في البئر، فسلمت عليه ثم انصرفت، فجلست عند الباب فقلت‏:‏ لأكونن بواب رسول الله صلى الله عليه وسلم اليوم، فجاء أبو بكر رضي الله عنه فدفع الباب فقلت‏:‏ من هذا‏؟‏ فقال‏:‏ أبو بكر، فقلت على رسلك، ثم ذهبت فقلت‏:‏ يا رسول الله هذا أبو بكر يستأذن، فقال‏:‏ ‏"‏ائذن له وبشره بالجنة‏"‏ فأقلبت حتى قلت لأبي بكر‏:‏ ادخل ورسول الله يبشرك بالجنة، فدخل أبو بكر حتى جلس عن يمين النبي صلى الله عليه وسلمى الله عليه وسلم معه في القف، ودلى رجليه في البئر كما صنع رسول الله صلى الله عليه وسلم ، وكشف عن ساقيه، ثم رجعت وجلست، وقد تركت أخي يتوضأ ويلحقني ، فقلت‏:‏ إن يرد الله بفلان -يرد أخاه- خيراً يأت به، فإذا إنسان يحرك الباب، فقلت‏:‏ من هذا‏؟‏ فقال‏:‏ عمر بن الخطاب‏:‏ فقلت‏:‏ على رسلك ، ثم جئت إلى رسول الله صلى الله عليه وسلم ، فسلمت عليه وقلت‏:‏ هذا عمر يستأذن‏؟‏ فقال‏:‏”ائذن له وبشره بالجنة‏"‏ فجئت عمر، فقلت‏:‏ أذن ويبشرك رسول الله صلى الله عليه وسلم بالجنة، فدخل فجلس مع رسول الله صلى الله عليه وسلم في القف عن يساره، ودلى رجليه في البئر، ثم رجعت فجلست فقلت‏:‏ إن يرد الله بفلان خيراً -يعني أخاه- يأت به، فجاء إنسان فحرك الباب‏.‏ فقلت‏:‏ من هذا ‏؟‏ فقال‏:‏ عثمان بن عفان فقلت‏:‏ على رسلك، وجئت النبي صلى الله عليه وسلم الله عليه وسلم ، فأخبرته فقال‏:‏ ‏"‏ائذن له وبشره بالجنة مع بلوى تصيبه‏"‏ فجئت فقلت له‏:‏ ادخل ويبشرك رسول الله صلى الله عليه وسلم بالجنة مع بلوى تصيبك، فدخل فوجد القف قد ملئ، فجلس وجاههم من الشق الآخر‏.‏ قال سعيد بن المسيب‏:‏ فأولتها قبورهم ‏.‏ ‏(‏‏(‏متفق عليه‏)‏‏)‏ ‏.‏

وزاد في رواية‏:‏ “وأمرني رسول الله صلى الله عليه وسلم بحفظ الباب‏.‏ وفيها أن عثمان حين بشره حمد الله تعالى، ثم قال‏:‏ الله المستعان‏.‏

It was narrated that `Abdullah bin Abi Mulaikah said:
I was sitting beside Ibn ‘Umar, and we were waiting for the funeral of Umm Aban bint `Uthman bin `Affan. `Amr bin `Uthman was also present. Ibn ‘Abbas came, led by a guide, who told him where Ibn ‘Umar was. He came and sat beside me, so I was between them, and we heard a voice from inside the house, Ibn `Umar said: I heard the Messenger of Allah (ﷺ) say: `The deceased is tormented because of the crying of his family.` He said: And `Abdullah understood it as general in meaning. Ibn `Abbas said: We were with Ameer al-Muʼmineen ‘Umar until we came to some arid land, where we found a man who had halted in the shade of a tree. He said to me: Go and find out for me who that man is, I went and found that it was Suhaib. I came back to him and said: You told me to find out for you who that man is; it is Suhaib. He said: Tell him to join us. I said: He has his family with him. He said: Even if he has his family with him [and perhaps Ayyoob said on one occasion:Tell him to join us). When we came to Madinah, it was not long before Ameer al Muʼmineen [ʼUmar} was attacked. Suhaib came, saying O my brother, O my friend! `Umar said: Do you not know, or have you not heard, that the Messenger of Allah (ﷺ) said: `The deceased is tormented because of some of his family`s crying.” “Abdullah understood it as general in meaning, but ‘Umar said: some of [their] weeping. I went to `A`ishah, and I told her what Ibn `Umar had said. She said: No, by Allah, the Messenger of Allah (ﷺ) did not say, “The deceased is tormented because of the weeping of anyone.” Rather he said: “Allah increases the torment of the kafir because of his family`s weeping, and that it is He (Allah) Who makes (whom He wills) laugh, and makes (whom He wills) weep, “And no bearer of burdens shall bear another`s burden` [Al Anʼam 6:164].” Ayyoob said: Ibn Abu Mulaikah said: al-Qasim bin Muhammad told me: When `Aʼishah heard what ʼUmar and Ibn `Umar had said, she said. You are narrating to me from two who are not liars and are not to be suspected of being liars, but one may mishear.

`Abdullah bin Abi Mulaikah narrated… and he mentioned a hadeeth similar to that of Ayyoob, except that he said: ibn `Umar said to `Amr bin `Uthman, when he was facing him: Why don`t you tell them not to weep? For the Messenger of Allah (ﷺ) said: `The deceased is tormented because of his family`s weeping for him.`

حَدَّثَنَا عَبْدُ الرَّزَّاقِ أَنْبَأَنَا ابْنُ جُرَيْجٍ أَخْبَرَنِي عَبْدُ اللَّهِ بْنُ أَبِي مُلَيْكَةَ فَذَكَرَ مَعْنَى حَدِيثِ أَيُّوبَ إِلَّا أَنَّهُ قَالَ فَقَالَ ابْنُ عُمَرَ لِعَمْرِو بْنِ عُثْمَانَ وَهُوَ مُوَاجِهُهُ أَلَا تَنْهَى عَنْ الْبُكَاءِ فَإِنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ إِنَّ الْمَيِّتَ لَيُعَذَّبُ بِبُكَاءِ أَهْلِهِ عَلَيْهِ

Yahya related to me from Malik from Yahya ibn Said from Salim ibn Abdullah that Abdullah ibn Umar sold one of his slaves for eight hundred dirhams with the stipulation that he was not responsible for defects. The person who bought the slave complained to Abdullah ibn Umar that the slave had a disease which he had not told him about. They argued and went to Uthman ibn Affan for a decision . The man said, "He sold me a slave with a disease which he did not tell me about." Abdullah said, "I sold to him with the stipulation that I was not responsible." Uthman ibn Affan decided that Abdullah ibn Umar should take an oath that he had sold the slave without knowing that he had any disease. Abdullah ibn Umar refused to take the oath, so the slave was returned to him and recovered his health in his possession. Abdullah sold him afterwards for 1500 dirhams.

Malik said, "The generally agreed upon way of doing things among us about a man who buys a female slave and she becomes pregnant, or who buys a slave and then frees him, or if there is any other such matter which has already happened so that he cannot return his purchase, and a clear proof is established that there was a fault in that purchase when it was in the hands of the seller or the fault is admitted by the seller or someone else, is that the slave or slave-girl is assessed for its value with the fault it is found to have had on the day of purchase and the buyer is refunded,from what he paid,the difference between the price of a slave who is sound and a slave with such a defect.

Malik said, "The generally agreed upon way of doing things among us regarding a man who buys a slave and then finds out that the slave has a defect for which he can be returned and meanwhile another defect has happened to the slave whilst in his possession, is that if the defect which occurred to the slave in his possession has harmed him, like loss of a limb, loss of an eye, or something similar, then he has a choice. If he wants, he can have the price of the slave reduced commensurate with the defect (he bought him with ) according to the prices on the day he bought him, or if he likes, he can pay compensation for the defect which the slave has suffered in his possession and return him. The choice is up to him. If the slave dies in his possession, the slave is valued with the defect which he had on the day of his purchase. It is seen what his price would really have been. حَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَالِمِ بْنِ عَبْدِ اللَّهِ، أَنَّ عَبْدَ اللَّهِ بْنَ عُمَرَ، بَاعَ غُلاَمًا لَهُ بِثَمَانِمِائَةِ دِرْهَمٍ وَبَاعَهُ بِالْبَرَاءَةِ فَقَالَ الَّذِي ابْتَاعَهُ لِعَبْدِ اللَّهِ بْنِ عُمَرَ بِالْغُلاَمِ دَاءٌ لَمْ تُسَمِّهِ لِي ‏.‏ فَاخْتَصَمَا إِلَى عُثْمَانَ بْنِ عَفَّانَ ‏.‏ فَقَالَ الرَّجُلُ بَاعَنِي عَبْدًا وَبِهِ دَاءٌ لَمْ يَعْلَمُهُ فَأَبَى عَبْدُ اللَّهِ أَنْ يَحْلِفَ وَارْتَجَعَ الْعَبْدَ فَصَحَّ عِنْدَهُ فَبَاعَهُ عَبْدُ اللَّهِ بَعْدَ ذَلِكَ بِأَلْفٍ وَخَمْسِمِائَةِ دِرْهَمٍ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّ كُلَّ مَنِ ابْتَاعَ وَلِيدَةً فَحَمَلَتْ أَوْ عَبْدًا فَأَعْتَقَهُ وَكُلَّ أَمْرٍ دَخَلَهُ الْفَوْتُ حَتَّى لاَ يُسْتَطَاعَ رَدُّهُ فَقَامَتِ الْبَيِّنَةُ إِنَّهُ قَدْ كَانَ بِهِ عَيْبٌ عِنْدَ الَّذِي بَاعَهُ أَوْ عُلِمَ ذَلِكَ بِاعْتِرَافٍ مِنَ الْبَائِعِ أَوْ غَيْرِهِ فَإِنَّ الْعَبْدَ أَوِ الْوَلِيدَةَ يُقَوَّمُ وَبِهِ الْعَيْبُ الَّذِي كَانَ بِهِ يَوْمَ اشْتَرَاهُ فَيُرَدُّ مِنَ الثَّمَنِ قَدْرُ مَا بَيْنَ قِيمَتِهِ صَحِيحًا وَقِيمَتِهِ وَبِهِ ذَلِكَ الْعَيْبُ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا فِي الرَّجُلِ يَشْتَرِي الْعَبْدَ ثُمَّ يَظْهَرُ مِنْهُ عَلَى عَيْبٍ يَرُدُّهُ مِنْهُ وَقَدْ حَدَثَ بِهِ عِنْدَ الْمُشْتَرِي عَيْبٌ آخَرُ إِنَّهُ إِذَا كَانَ الْعَيْبُ الَّذِي حَدَثَ بِهِ مُفْسِدًا مِثْلُ الْقَطْعِ أَوِ الْعَوَرِ أَوْ مَا أَشْبَهَ ذَلِكَ مِنَ الْعُيُوبِ الْمُفْسِدَةِ فَإِنَّ الَّذِي اشْتَرَى الْعَبْدَ بِخَيْرِ النَّظَرَيْنِ إِنْ أَحَبَّ أَنْ يُوضَعَ عَنْهُ مِنْ ثَمَنِ الْعَبْدِ بِقَدْرِ الْعَيْبِ الَّذِي كَانَ بِالْعَبْدِ يَوْمَ اشْتَرَاهُ وُضِعَ عَنْهُ وَإِنْ أَحَبَّ أَنْ يَغْرَمَ قَدْرَ مَا أَصَابَ الْعَبْدَ مِنَ الْعَيْبِ عِنْدَهُ ثُمَّ يَرُدُّ الْعَبْدَ فَذَلِكَ لَهُ وَإِنْ مَاتَ الْعَبْدُ عِنْدَ الَّذِي اشْتَرَاهُ أُقِيمَ الْعَبْدُ وَبِهِ الْعَيْبُ الَّذِي كَانَ بِهِ يَوْمَ اشْتَرَاهُ فَيُنْظَرُ كَمْ ثَمَنُهُ فَإِنْ كَانَتْ قِيمَةُ الْعَبْدِ يَوْمَ اشْتَرَاهُ بِغَيْرِ عَيْبٍ مِائَةَ دِينَارٍ وَقِيمَتُهُ يَوْمَ اشْتَرَاهُ وَبِهِ الْعَيْبُ ثَمَانُونَ دِينَارًا وُضِعَ عَنِ الْمُشْتَرِي مَا بَيْنَ الْقِيمَتَيْنِ وَإِنَّمَا تَكُونُ الْقِيمَةُ يَوْمَ اشْتُرِيَ الْعَبْدُ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّ مَنْ رَدَّ وَلِيدَةً مِنْ عَيْبٍ وَجَدَهُ بِهَا وَكَانَ قَدْ أَصَابَهَا أَنَّهَا إِنْ كَانَتْ بِكْرًا فَعَلَيْهِ مَا نَقَصَ مِنْ ثَمَنِهَا وَإِنْ كَانَتْ ثَيِّبًا فَلَيْسَ عَلَيْهِ فِي إِصَابَتِهِ إِيَّاهَا شَىْءٌ لأَنَّهُ كَانَ ضَامِنًا لَهَا ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا فِيمَنْ بَاعَ عَبْدًا أَوْ وَلِيدَةً أَوْ حَيَوَانًا بِالْبَرَاءَةِ مِنْ أَهْلِ الْمِيرَاثِ أَوْ غَيْرِهِمْ فَقَدْ بَرِئَ مِنْ كُلِّ عَيْبٍ فِيمَا بَاعَ إِلاَّ أَنْ يَكُونَ عَلِمَ فِي ذَلِكَ عَيْبًا فَكَتَمَهُ فَإِنْ كَانَ عَلِمَ عَيْبًا فَكَتَمَهُ لَمْ تَنْفَعْهُ تَبْرِئَتُهُ وَكَانَ مَا بَاعَ مَرْدُودًا عَلَيْهِ ‏.‏ قَالَ مَالِكٌ فِي الْجَارِيَةِ تُبَاعُ بِالْجَارِيَتَيْنِ ثُمَّ يُوجَدُ بِإِحْدَى الْجَارِيَتَيْنِ عَيْبٌ تُرَدُّ مِنْهُ قَالَ تُقَامُ الْجَارِيَةُ الَّتِي كَانَتْ قِيمَةَ الْجَارِيَتَيْنِ فَيُنْظَرُ كَمْ ثَمَنُهَا ثُمَّ تُقَامُ الْجَارِيَتَانِ بِغَيْرِ الْعَيْبِ الَّذِي وُجِدَ بِإِحْدَاهُمَا تُقَامَانِ صَحِيحَتَيْنِ سَالِمَتَيْنِ ثُمَّ يُقْسَمُ ثَمَنُ الْجَارِيَةِ الَّتِي بِيعَتْ بِالْجَارِيَتَيْنِ عَلَيْهِمَا بِقَدْرِ ثَمَنِهِمَا حَتَّى يَقَعَ عَلَى كُلِّ وَاحِدَةٍ مِنْهُمَا حِصَّتُهَا مِنْ ذَلِكَ عَلَى الْمُرْتَفِعَةِ بِقَدْرِ ارْتِفَاعِهَا وَعَلَى الأُخْرَى بِقَدْرِهَا ثُمَّ يُنْظَرُ إِلَى الَّتِي بِهَا الْعَيْبُ فَيُرَدُّ بِقَدْرِ الَّذِي وَقَعَ عَلَيْهَا مِنْ تِلْكَ الْحِصَّةِ إِنْ كَانَتْ كَثِيرَةً أَوْ قَلِيلَةً وَإِنَّمَا تَكُونُ قِيمَةُ الْجَارِيَتَيْنِ عَلَيْهِ يَوْمَ قَبْضِهِمَا ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يَشْتَرِي الْعَبْدَ فَيُؤَاجِرُهُ بِالإِجَارَةِ الْعَظِيمَةِ أَوِ الْغَلَّةِ الْقَلِيلَةِ ثُمَّ يَجِدُ بِهِ عَيْبًا يُرَدُّ مِنْهُ إِنَّهُ يَرُدُّهُ بِذَلِكَ الْعَيْبِ وَتَكُونُ لَهُ إِجَارَتُهُ وَغَلَّتُهُ وَهَذَا الأَمْرُ الَّذِي كَانَتْ عَلَيْهِ الْجَمَاعَةُ بِبَلَدِنَا وَذَلِكَ لَوْ أَنَّ رَجُلاً ابْتَاعَ عَبْدًا فَبَنَى لَهُ دَارًا قِيمَةُ بِنَائِهَا ثَمَنُ الْعَبْدِ أَضْعَافًا ثُمَّ وَجَدَ بِهِ عَيْبًا يُرَدُّ مِنْهُ رَدَّهُ وَلاَ يُحْسَبُ لِلْعَبْدِ عَلَيْهِ إِجَارَةٌ فِيمَا عَمِلَ لَهُ فَكَذَلِكَ تَكُونُ لَهُ إِجَارَتُهُ إِذَا آجَرَهُ مِنْ غَيْرِهِ لأَنَّهُ ضَامِنٌ لَهُ وَهَذَا الأَمْرُ عِنْدَنَا ‏.‏ قَالَ مَالِكٌ الأَمْرُ عِنْدَنَا فِيمَنِ ابْتَاعَ رَقِيقًا فِي صَفْقَةٍ وَاحِدَةٍ فَوَجَدَ فِي ذَلِكَ الرَّقِيقِ عَبْدًا مَسْرُوقًا أَوْ وَجَدَ بِعَبْدٍ مِنْهُمْ عَيْبًا أَنَّهُ يُنْظَرُ فِيمَا وُجِدَ مَسْرُوقًا أَوْ وَجَدَ بِهِ عَيْبًا فَإِنْ كَانَ هُوَ وَجْهَ ذَلِكَ الرَّقِيقِ أَوْ أَكْثَرَهُ ثَمَنًا أَوْ مِنْ أَجْلِهِ اشْتَرَى وَهُوَ الَّذِي فِيهِ الْفَضْلُ فِيمَا يَرَى النَّاسُ كَانَ ذَلِكَ الْبَيْعُ مَرْدُودًا كُلُّهُ وَإِنْ كَانَ الَّذِي وُجِدَ مَسْرُوقًا أَوْ وُجِدَ بِهِ الْعَيْبُ مِنْ ذَلِكَ الرَّقِيقِ فِي الشَّىْءِ الْيَسِيرِ مِنْهُ لَيْسَ هُوَ وَجْهَ ذَلِكَ الرَّقِيقِ وَلاَ مِنْ أَجْلِهِ اشْتُرِيَ وَلاَ فِيهِ Abu Musa Ash'ari reported that he performed ablution in his house and then came out saying:

I would remain with Allah's Messenger (may peace be upon him) the whole day long. He came to the mosque, and asked about Allah's Apostle (may peace be upon him). They (his Companions) said: He has gone in this direction. He (Abu Musa Ash'ari) said: I followed his steps asking about him until I came to Bi'r Aris (it is a well in the suburb of Medina). I sat by its wooden door until Allah's Messenger (may peace be upon him) had relieved himself and then performed ablution. I went to him and he was sitting with his shanks uncovered hp to the knees and his legs dangl- ing in that well. I offered him salutations. I then came back and sat at the door as if I had been a chamberlain at the door of Allah's Messenger (may peace be upon him) that day. There came Abu Bakr and knocked the door and I said: Who is it? He said: This is Abu Bakr. I said: Wait, please. I went and said: Allah's Messenger, here is Abu Bakr seeking permission. Thereupon he said: Admit him and give him glad tidings of Paradise. I came and I said to Abu Bakr to get in (and also told him) that Allah's Messenger (may peace be upon him) was giving him the glad tidings of Paradise. Abu Bakr got in and sat on the right side of Allah's Messenger (may peace be upon him) and dangled his feet in the well as Allah's Messenger (may peace be upon him) had done, and he uncovered his shanks. I then returned and sat there and I had left my brother as he had been performing ablution and he was to meet me and I said: If Allah would intend goodness for such and such he would intend goodness for his brother and He would bring him. I was thinking this that a person stirred the door. I said: Who is it. He said: This is Umar b., Khattab. I said: Wait. Then I came to Allah's Messenger (may peace be upon him), greeted him and said: Here is 'Umar seeking your. permission to get in. Thereupon he said: Let him come in and give him glad tid- ings of Paradise. I came to Umar and said: There is permission for you and glad tidings for you from Allah's Messenger (may peace be upon him) for Paradise. He got in and sat on the left side of Allah's Messenger (may peace be upon him) with his feet dangling in the well. I then returned and sat and said: If Allah would intend goodness for such and such (that is for his brother), He would bring him. Yahya related to me from Malik that he had heard that Sulayman ibn Yasar said, ''Umar ibn al-Khattab, Uthman ibn Affan, andZayd ibn Thabit gave the grandfather a third with full siblings". Malik said, "The generally agreed on way of doing things among us and what I have seen the people of knowledge in our city doing is that the paternal grandfather does not inherit anything at all with the father. He is given a sixth as a fixed share with the son and the grandson through a son. Other than that, when the deceased does not leave a mother or a paternal aunt, one begins with whoever has a fixed share, and they are given their shares. If there is a sixth of the property left over, the grandfather is given a sixth as a fixed share."

Malik said, "When someone shares with the grandfather and the full siblings in a specified share, one begins with whoever shares with them of the people of fixed shares. They are given their shares. What is left over after that belongs to the grandfather and the full siblings. Then one sees which is the more favourable of two alternatives for the portion of the grandfather. Either a third is allotted to him and the siblings to divide between them, and he gets a share as if he were one of the siblings, or else he takes a sixth from all the capital. Whichever is the best portion for the grandfather is given to him. What is left after that, goes to the full siblings. The male gets the portion of two females except in one particular case. The division in this case is different from the preceding one. This case is when a woman dies and leaves a husband, mother, full sister and grandfather. The husband gets a half, the mother gets a third, the grandfather gets a sixth, and the full sister gets a half. The sixth of the grandfather and the half of the sister are joined and divided into thirds. The male gets the share of two females. Therefore, the grandfather has two thirds, and the sister has one third."

Malik said, "The inheritance of the half-siblings by the father with the grandfather when there are no full siblings with them, is like the inheritance of the full siblings (in the same situation). The males are the same as their males and the females are the same as their females. When there are both full siblings and half-siblings by the father, the full siblings include in their number the number of half-siblings by the father, to limit the inheritance of the grandfather, i.e., if there was only one full sibling with ...

Yahya said that Malik related from Muhammad ibn Umara from Abu Bakr ibn Hazm that Uthman ibn Affan said, "When boundaries are fixed in land, there is no pre-emption in it. There is no pre-emption in a well or in male palm trees. "

Malik said, "This is what is done in our community."

Malik said, "There is no pre-emption in a road, whether or not it is practical to divide it."

Malik said, "What is done in our community is that there is no pre- emption in the courtyard of a house, whether or not it is practical to divide it."

Malik spoke about a man who bought into a shared property provided that he had the option of withdrawal and the partners of the seller wanted to take what their partner was selling by pre-emption before the buyer had exercised his option. Malik said, "They cannot do that until the buyer has taken possession and the sale is confirmed for him. When the sale is confirmed, they have the right of pre-emption."

Malik spoke about a man who bought land and it remained in his hands for some time. Then a man came and saw that he had a share of the land by inheritance. Malik said, "If the man's right of inheritance is established, he also has a right of preemption. If the land has produced a crop, the crop belongs to the buyer until the day when the right of the other is established, because he has tended what was planted against being destroyed or being carried away by a flood."

Malik continued, "If the time has been long, or the witnesses are dead or the seller has died, or the buyer has died, or they are both alive and the basis of the sale and purchase has been forgotten because of the length of time, pre- emption is discontinued. A man only takes his right by inheritance which has been established for him. If his situation differs from this, because the sale transaction is recent and he sees that the seller has concealed the price in order to sever his right of pre- emption, the value of the land is estimated, and he buys the land for that price by his right of pre-emption. Then the buildings, plants, or structures which are extra to the land are looked at, so he is in the position of some one who bought the land for a known price, and then after that built on it and planted. The owner of pre-emption takes possession after that is included."

قَالَ يَحْيَى قَالَ مَالِكٌ عَنْ مُحَمَّدِ بْنِ عُمَارَةَ، عَنْ أَبِي بَكْرِ بْنِ حَزْمٍ، أَنَّ عُثْمَانَ بْنَ عَفَّانَ، قَالَ إِذَا وَقَعَتِ الْحُدُودُ فِي الأَرْضِ فَلاَ شُفْعَةَ فِيهَا وَلاَ شُفْعَةَ فِي بِئْرٍ وَلاَ فِي فَحْلِ النَّخْلِ ‏.‏ قَالَ مَالِكٌ وَعَلَى هَذَا الأَمْرُ عِنْدَنَا ‏.‏ قَالَ مَالِكٌ وَلاَ شُفْعَةَ فِي طَرِيقٍ صَلُحَ الْقَسْمُ فِيهَا أَوْ لَمْ يَصْلُحْ ‏.‏ قَالَ مَالِكٌ وَالأَمْرُ عِنْدَنَا أَنَّهُ لاَ شُفْعَةَ فِي عَرْصَةِ دَارٍ صَلُحَ الْقَسْمُ فِيهَا أَوْ لَمْ يَصْلُحْ ‏.‏ قَالَ مَالِكٌ فِي رَجُلٍ اشْتَرَى شِقْصًا مِنْ أَرْضٍ مُشْتَرَكَةٍ عَلَى أَنَّهُ فِيهَا بِالْخِيَارِ فَأَرَادَ شُرَكَاءُ الْبَائِعِ أَنْ يَأْخُذُوا مَا بَاعَ شَرِيكُهُمْ بِالشُّفْعَةِ قَبْلَ أَنْ يَخْتَارَ الْمُشْتَرِي إِنَّ ذَلِكَ لاَ يَكُونُ لَهُمْ حَتَّى يَأْخُذَ الْمُشْتَرِي وَيَثْبُتَ لَهُ الْبَيْعُ فَإِذَا وَجَبَ لَهُ الْبَيْعُ فَلَهُمُ الشُّفْعَةُ ‏.‏ وَقَالَ مَالِكٌ فِي الرَّجُلِ يَشْتَرِي أَرْضًا فَتَمْكُثُ فِي يَدَيْهِ حِينًا ثُمَّ يَأْتِي رَجُلٌ فَيُدْرِكُ فِيهَا حَقًّا بِمِيرَاثٍ إِنَّ لَهُ الشُّفْعَةَ إِنْ ثَبَتَ حَقُّهُ وَإِنَّ مَا أَغَلَّتِ الأَرْضُ مِنْ غَلَّةٍ فَهِيَ لِلْمُشْتَرِي الأَوَّلِ إِلَى يَوْمِ يَثْبُتُ حَقُّ الآخَرِ لأَنَّهُ قَدْ كَانَ ضَمِنَهَا لَوْ هَلَكَ مَا كَانَ فِيهَا مِنْ غِرَاسٍ أَوْ ذَهَبَ بِهِ سَيْلٌ ‏.‏ قَالَ فَإِنْ طَالَ الزَّمَانُ أَوْ هَلَكَ الشُّهُودُ أَوْ مَاتَ الْبَائِعُ أَوِ الْمُشْتَرِي أَوْ هُمَا حَيَّانِ فَنُسِيَ أَصْلُ الْبَيْعِ وَالاِشْتِرَاءِ لِطُولِ الزَّمَانِ فَإِنَّ الشُّفْعَةَ تَنْقَطِعُ وَيَأْخُذُ حَقَّهُ الَّذِي ثَبَتَ لَهُ وَإِنْ كَانَ أَمْرُهُ عَلَى غَيْرِ هَذَا الْوَجْهِ فِي حَدَاثَةِ الْعَهْدِ وَقُرْبِهِ وَأَنَّهُ يَرَى أَنَّ الْبَائِعَ غَيَّبَ الثَّمَنَ وَأَخْفَاهُ لِيَقْطَعَ بِذَلِكَ حَقَّ صَاحِبِ الشُّفْعَةِ قُوِّمَتِ الأَرْضُ عَلَى قَدْرِ مَا يُرَى أَنَّهُ ثَمَنُهَا فَيَصِيرُ ثَمَنُهَا إِلَى ذَلِكَ ثُمَّ يُنْظَرُ إِلَى مَا زَادَ فِي الأَرْضِ مِنْ بِنَاءٍ أَوْ غِرَاسٍ أَوْ عِمَارَةٍ فَيَكُونُ عَلَى مَا يَكُونُ عَلَيْهِ مَنِ ابْتَاعَ الأَرْضَ بِثَمَنٍ مَعْلُومٍ ثُمَّ بَنَى فِيهَا وَغَرَسَ ثُمَّ أَخَذَهَا صَاحِبُ الشُّفْعَةِ بَعْدَ ذَلِكَ ‏.‏ قَالَ مَالِكٌ وَالشُّفْعَةُ ثَابِتَةٌ فِي مَالِ الْمَيِّتِ كَمَا هِيَ فِي مَالِ الْحَىِّ فَإِنْ خَشِيَ أَهْلُ الْمَيِّتِ أَنْ يَنْكَسِرَ مَالُ الْمَيِّتِ قَسَمُوهُ ثُمَّ بَاعُوهُ فَلَيْسَ عَلَيْهِمْ فِيهِ شُفْعَةٌ ‏.‏ قَالَ مَالِكٌ وَلاَ شُفْعَةَ عِنْدَنَا فِي عَبْدٍ وَلاَ وَلِيدَةٍ وَلاَ بَعِيرٍ وَلاَ بَقَرَةٍ وَلاَ شَاةٍ وَلاَ فِي شَىْءٍ مِنَ الْحَيَوَانِ وَلاَ فِي ثَوْبٍ وَلاَ فِي بِئْرٍ لَيْسَ لَهَا بَيَاضٌ إِنَّمَا الشُّفْعَةُ فِيمَا يَصْلُحُ أَنَّهُ يَنْقَسِمُ وَتَقَعُ فِيهِ الْحُدُودُ مِنَ الأَرْضِ فَأَمَّا مَا لاَ يَصْلُحُ فِيهِ الْقَسْمُ فَلاَ شُفْعَةَ فِيهِ ‏.‏ قَالَ مَالِكٌ وَمَنِ اشْتَرَى أَرْضًا فِيهَا شُفْعَةٌ لِنَاسٍ حُضُورٍ فَلْيَرْفَعْهُمْ إِلَى السُّلْطَانِ فَإِمَّا أَنْ يَسْتَحِقُّوا وَإِمَّا أَنْ يُسَلِّمَ لَهُ السُّلْطَانُ فَإِنْ تَرَكَهُمْ فَلَمْ يَرْفَعْ أَمْرَهُمْ إِلَى السُّلْطَانِ وَقَدْ عَلِمُوا بِاشْتِرَائِهِ فَتَرَكُوا ذَلِكَ حَتَّى طَالَ زَمَانُهُ ثُمَّ جَاءُوا يَطْلُبُونَ شُفْعَتَهُمْ فَلاَ أَرَى ذَلِكَ لَهُمْ ‏.‏

Narrated Malik b. Aws b. Al-Hadathan:

'Umar sent for me when the day rose high. I found him sitting on a couch without cover. When I entered upon him, he said: Malik, some people of you tribe gradually came here, and I have ordered to give them something, so distribute it among them. I said: If you assigned this (work) to some other person, (it would be better). He said: Take it. Then Yarfa' came to him and said: Commander of the Faithful, will you permit 'Uthman b. 'Affan, 'Abd al-Rahman b. 'Awf, al-Zubair b. al-'Awwam, and Sa'd b, Abi Waqqas (to enter) ? He said: Yes. So he permitted them and they entered. Yarfa' again came to him and said: Commander of the Faithful, would you permit al-'Abbas and 'Ali ? He said: Yes. He then permitted them and they entered. Al-'Abbas said: Commander of Faithful, decide between me and this, referring to 'Ali. Some of them said: Yes, Commander of the Faithful, decide between them and give them comfort. Malik b. Aws said: It occurred to me that both of them brought the other people for this. 'Umar said: Show patience (do not make haste). He then turned towards those people and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that Messenger of Allah (saws) said: We are not inherited whatever we leave is sadaqah (alms). They said: Yes. He then turned towards 'Ali and al-'Abbas and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that Messenger of Allah (saws) said: We are not inherited whatever we leave is sadaqah (alms). They said: Yes. He then said: Allah has appointed for the Messenger of Allah (saws) a special portion (in the booty) which he did not do for anyone. Allah, Most High, said: What Allah has bestowed on His Apostle (and taken away) from them - for this ye made no expedition with either cavalry or camelry. But Allah gives power to His apostles over any He pleases ; and Allah has power over all things". Allah bestowed (the property of) Banu al-Nadir on His Apostle. I swear by Allah, he did not reserve it for himself, nor did he take it over and above you. The Messenger of Allah (saws) used to his share for his maintenance annually, or used to take his contribution and give his family their annual contribution (from this property), then take what remained and deal with it as he did with Allah's property. He then turned towards those people and said: I adjure you by Allah by Whose order the heaven and earth stand. Do you know that ? They said: ...

حَدَّثَنَا الْحَسَنُ بْنُ عَلِيٍّ، وَمُحَمَّدُ بْنُ يَحْيَى بْنِ فَارِسٍ الْمَعْنَى، قَالاَ حَدَّثَنَا بِشْرُ بْنُ عُمَرَ الزَّهْرَانِيُّ، حَدَّثَنِي مَالِكُ بْنُ أَنَسٍ، عَنِ ابْنِ شِهَابٍ، عَنْ مَالِكِ بْنِ أَوْسِ بْنِ الْحَدَثَانِ، قَالَ أَرْسَلَ إِلَىَّ عُمَرُ حِينَ تَعَالَى النَّهَارُ فَجِئْتُهُ فَوَجَدْتُهُ جَالِسًا عَلَى سَرِيرٍ مُفْضِيًا إِلَى رِمَالِهِ فَقَالَ حِينَ دَخَلْتُ عَلَيْهِ يَا مَالُ إِنَّهُ قَدْ دَفَّ أَهْلُ أَبْيَاتٍ مِنْ قَوْمِكَ وَإِنِّي قَدْ أَمَرْتُ فِيهِمْ بِشَىْءٍ فَاقْسِمْ فِيهِمْ ‏.‏ قُلْتُ لَوْ أَمَرْتَ غَيْرِي بِذَلِكَ ‏.‏ فَقَالَ خُذْهُ ‏.‏ فَجَاءَهُ يَرْفَأُ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي عُثْمَانَ بْنِ عَفَّانَ وَعَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ وَالزُّبَيْرِ بْنِ الْعَوَّامِ وَسَعْدِ بْنِ أَبِي وَقَّاصٍ قَالَ نَعَمْ ‏.‏ فَأَذِنَ لَهُمْ فَدَخَلُوا ثُمَّ جَاءَهُ يَرْفَأُ فَقَالَ يَا أَمِيرَ الْمُؤْمِنِينَ هَلْ لَكَ فِي الْعَبَّاسِ وَعَلِيٍّ قَالَ نَعَمْ ‏.‏ فَأَذِنَ لَهُمْ فَدَخَلُوا فَقَالَ الْعَبَّاسُ يَا أَمِيرَ الْمُؤْمِنِينَ اقْضِ بَيْنِي وَبَيْنَ هَذَا - يَعْنِي عَلِيًّا - فَقَالَ بَعْضُهُمْ أَجَلْ يَا أَمِيرَ الْمُؤْمِنِينَ اقْضِ بَيْنَهُمَا وَارْحَمْهُمَا ‏.‏ قَالَ مَالِكُ بْنُ أَوْسٍ خُيِّلَ إِلَىَّ أَنَّهُمَا قَدَّمَا أُولَئِكَ النَّفَرَ لِذَلِكَ ‏.‏ فَقَالَ عُمَرُ رَحِمَهُ اللَّهُ اتَّئِدَا ‏.‏ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللَّهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالأَرْضُ هَلْ تَعْلَمُونَ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ لاَ نُورَثُ مَا تَرَكْنَا صَدَقَةٌ ‏"‏ ‏.‏ قَالُوا نَعَمْ ‏.‏ ثُمَّ أَقْبَلَ عَلَى عَلِيٍّ وَالْعَبَّاسِ رضى الله عنهما فَقَالَ أَنْشُدُكُمَا بِاللَّهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالأَرْضُ هَلْ تَعْلَمَانِ أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏"‏ لاَ نُورَثُ مَا تَرَكْنَا صَدَقَةٌ ‏"‏ ‏.‏ فَقَالاَ نَعَمْ ‏.‏ قَالَ فَإِنَّ اللَّهَ خَصَّ رَسُولَهُ صلى الله عليه وسلم بِخَاصَّةٍ لَمْ يَخُصَّ بِهَا أَحَدًا مِنَ النَّاسِ فَقَالَ اللَّهُ تَعَالَى ‏{‏ وَمَا أَفَاءَ اللَّهُ عَلَى رَسُولِهِ مِنْهُمْ فَمَا أَوْجَفْتُمْ عَلَيْهِ مِنْ خَيْلٍ وَلاَ رِكَابٍ وَلَكِنَّ اللَّهَ يُسَلِّطُ رُسُلَهُ عَلَى مَنْ يَشَاءُ وَاللَّهُ عَلَى كُلِّ شَىْءٍ قَدِيرٌ ‏}‏ وَكَانَ اللَّهُ أَفَاءَ عَلَى رَسُولِهِ بَنِي النَّضِيرِ فَوَاللَّهِ مَا اسْتَأْثَرَ بِهَا عَلَيْكُمْ وَلاَ أَخَذَهَا دُونَكُمْ فَكَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَأْخُذُ مِنْهَا نَفَقَةَ سَنَةٍ أَوْ نَفَقَتَهُ وَنَفَقَةَ أَهْلِهِ سَنَةً وَيَجْعَلُ مَا بَقِيَ أُسْوَةَ الْمَالِ ‏.‏ ثُمَّ أَقْبَلَ عَلَى أُولَئِكَ الرَّهْطِ فَقَالَ أَنْشُدُكُمْ بِاللَّهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالأَرْضُ هَلْ تَعْلَمُونَ ذَلِكَ قَالُوا نَعَمْ ‏.‏ ثُمَّ أَقْبَلَ عَلَى الْعَبَّاسِ وَعَلِيٍّ رضى الله عنهما فَقَالَ أَنْشُدُكُمَا بِاللَّهِ الَّذِي بِإِذْنِهِ تَقُومُ السَّمَاءُ وَالأَرْضُ هَلْ تَعْلَمَانِ ذَلِكَ قَالاَ نَعَمْ ‏.‏ فَلَمَّا تُوُفِّيَ رَسُولُ اللَّهِ صلى الله عليه وسلم قَالَ أَبُو بَكْرٍ أَنَا وَلِيُّ رَسُولِ اللَّهِ صلى الله عليه وسلم فَجِئْتَ أَنْتَ وَهَذَا إِلَى أَبِي بَكْرٍ تَطْلُبُ أَنْتَ مِيرَاثَكَ مِنِ ابْنِ أَخِيكَ وَيَطْلُبُ هَذَا مِيرَاثَ امْرَأَتِهِ مِنْ أَبِيهَا فَقَالَ أَبُو بَكْرٍ رَحِمَهُ اللَّهُ قَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏"‏ لاَ نُورَثُ مَا تَرَكْنَا صَدَقَةٌ ‏"‏ ‏.‏ وَاللَّهُ يَعْلَمُ إِنَّهُ لَصَادِقٌ بَارٌّ رَاشِدٌ تَابِعٌ لِلْحَقِّ فَوَلِيَهَا أَبُو بَكْرٍ فَلَمَّا تُوُفِّيَ أَبُو بَكْرٍ قُلْتُ أَنَا وَلِيُّ رَسُولِ اللَّهِ صلى الله عليه وسلم وَوَلِيُّ أَبِي بَكْرٍ فَوَلِيتُهَا مَا شَاءَ اللَّهُ أَنْ أَلِيَهَا فَجِئْتَ أَنْتَ وَهَذَا وَأَنْتُمَا جَمِيعٌ وَأَمْرُكُمَا وَاحِدٌ فَسَأَلْتُمَانِيهَا فَقُلْتُ إِنْ شِئْتُمَا أَنْ أَدْفَعَهَا إِلَيْكُمَا عَلَى أَنَّ عَلَيْكُمَا عَهْدَ اللَّهِ أَنْ تَلِيَاهَا بِالَّذِي كَانَ رَسُولُ اللَّهِ صلى الله عليه وسلم يَلِيهَا فَأَخَذْتُمَاهَا مِنِّي عَلَى ذَلِكَ ثُمَّ جِئْتُمَانِي لأَقْضِيَ بَيْنَكُمَا بِغَيْرِ ذَلِكَ وَاللَّهِ لاَ أَقْضِي بَيْنَكُمَا بِغَيْرِ ذَلِكَ حَتَّى تَقُومَ السَّاعَةُ فَإِنْ عَجَزْتُمَا عَنْهَا فَرُدَّاهَا إِلَىَّ ‏.‏ قَالَ أَبُو دَاوُدَ إِنَّمَا سَأَلاَهُ أَنْ يَكُونَ يُصَيِّرُهُ بَيْنَهُمَا نِصْفَيْنِ لاَ أَنَّهُمَا جَهِلاَ أَنَّ النَّبِيَّ صلى الله عليه وسلم قَالَ ‏"‏ لاَ نُورَثُ مَا تَرَكْنَا صَدَقَةٌ ‏"‏ ‏.‏ فَإِنَّهُمَا كَانَا لاَ يَطْلُبَانِ إِلاَّ الصَّوَابَ ‏.‏ فَقَالَ عُمَرُ لاَ أُوقِعُ عَلَيْهِ اسْمَ الْقَسْمِ أَدَعُهُ عَلَى مَا هُوَ عَلَيْهِ ‏.‏
