Mishkat al-Masabih 3633
‘Umar reported God’s Messenger as saying, “When you find a man has been unfaithful about spoil in God’s path, burn his goods and beat him.” Tirmidhi and Abu Dawud transmitted it, Tirmidhi saying this is a gharib tradition.
وَعَنْ عُمَرَ رَضِيَ اللَّهُ عَنْهُ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِذَا وَجَدْتُمُ الرَّجُلَ قَدْ غَلَّ فِي سَبِيلِ اللَّهِ فَاحْرُقُوا مَتَاعَهُ وَاضْرِبُوهُ» . رَوَاهُ التِّرْمِذِيُّ وَأَبُو دَاوُدَ وَقَالَ التِّرْمِذِيُّ: هَذَا حَدِيث غَرِيب هَذَا الْبَاب خَال من الْفَصْل الثَّالِث

'A’isha said that when God’s Messenger was asked about bit’, which is the nabidh* from honey, he replied, “Every liquor which intoxicates is forbidden.” (Bukhari and Muslim.) * Nabidh is a drink made from dates, raisins, honey, wheat, barley, etc. The ingredients were steeped in water in a vessel, and provided the drink was used before fermentation took place it was lawful.
وَعَنْ عَائِشَةَ قَالَتْ: سُئِلَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنِ الْبِتْعِ وَهُوَ نَبِيذُ الْعَسَلِ فَقَالَ: «كُلُّ شَرَابٍ أَسْكَرَ فَهُوَ حَرَامٌ»

Ibn ‘Umar reported God’s Messenger as saying, “Every intoxicant is khamr and every intoxicant is forbidden. He who drinks wine in this world and dies when he is addicted to it, not having repented, will not drink it in the next.” Muslim transmitted it.

Anas told that the Prophet was asked about wine which was turned into vinegar* and forbade it. Muslim transmitted it. * This is said to have been done by putting onions or salt in it, or by placing it in the sun.

Wa’il al-Hadrami said that Tariq b. Suwaid asked the Prophet about wine and he forbade him. When he told him that he made it only as a medicine he replied, “It is not a medicine, but is a disease.” Muslim transmitted it.
وَعَنْ وَائِلٍ الْحَضْرَمِيِّ أَنَّ طَارِقَ بْنَ سُوَيْدٍ سَأَلَ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ عَنْ الْخَمْرِ فَنَهَاهُ. فَقَالَ: إِنَّمَا أَصْنَعُهَا لِلدَّوَاءِ فَقَالَ: «إِنَّهُ لَيْسَ بِدَوَاءٍ وَلَكِنَّهُ دَاءٌ» . رَوَاهُ مُسْلِمٌ

‘Abdallah b. ‘Umar reported God’s Messenger as saying, “If anyone drinks wine God will not accept prayer from him for forty days,* but if he repents God will forgive him. If he repeats the offence God will not accept prayer from him for forty days, but if he repents God will forgive him. If he again repeats the offence God will not accept prayer from him for forty days, but if he repents God will forgive him. If he repeats it a fourth time God will not accept prayer from him for forty days, and if he repents God will not forgive him,, but will give him to drink of the river of the fluid flowing from the inhabitants of hell.” Tirmidhi transmitted it, and Nasa’i, Ibn Majah and Darimi transmitted it on the authority of ‘Abdallah b. ‘Amr. * Literally, 'mornings.'
عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم: «مَنْ شَرِبَ الْخَمْرَ لَمْ يَقْبَلِ اللَّهُ لَهُ صَلَاةَ أَرْبَعِينَ صَبَاحًا فَإِنْ تَابَ تَابَ اللَّهُ عَلَيْهِ. فَإِن عَاد لم يقبل الله لَهُ صَلَاة أَرْبَعِينَ صَبَاحًا فَإِنْ تَابَ تَابَ اللَّهُ عَلَيْهِ فَإِن عَاد لم يقبل الله لَهُ صَلَاة أَرْبَعِينَ صَبَاحًا فَإِنْ تَابَ تَابَ اللَّهُ عَلَيْهِ فَإِنْ عَادَ فِي الرَّابِعَةِ لَمْ يَقْبَلِ اللَّهُ لَهُ صَلَاة أَرْبَعِينَ صباحا فَإِن تَابَ لم يَتُبِ اللَّهُ عَلَيْهِ وَسَقَاهُ مِنْ نَهْرِ الْخَبَالِ» . رَوَاهُ التِّرْمِذِيّ

‘A’isha reported God’s Messenger as saying, “If a faraq of anything causes intoxication, a handful of it is forbidden.”* Ahmad, Tirmidhi and Abu Dawud transmitted it. * To drink as much as a faraq (see p. 577) would be almost impossible, so the point of the tradition is to forbid anything which might in any conceivable circumstances cause intoxication.

An-Nu‘man b. Bashir reported God’s Messenger as saying, “From wheat wine is made, from barley wine is made, from dried dates wine is made, from raisins wine is made, and from honey wine is made.” Tirmidhi, Abu Dawud and Ibn Majah transmitted it, Tirmidhi saying this is a gharib tradition.

Anas quoted Abu Talha as saying he told God’s Prophet he had bought wine for orphans who were in his charge, and he replied, “Pour out the wine and break the wine-jars.” Tirmidhi transmitted it, but declared it weak. In Abu Dawud’s version it says he asked the Prophet about orphans who had inherited wine and he said, “Pour it out.” He asked if he might not make vinegar of it and he told him he must not. Abu Dawud

‘Abdallah b. ‘Amr told that the Prophet forbade wine, maisir, the kuba and ghubaira,* saying, “Every intoxicant is prohibited.” Abd Dawud transmitted it. *This is a comprehensive tradition not exclusively dealing with intoxicants, although the Prophet’s words might suggest that it does. Maisir was a game of chance and the kuba was a kind of drum wide at the ends and narrow in the middle which was looked on with disapproval. The parts which refer to intoxicants are the wine (khamr) and the ghubaira' which was an intoxicant made by Abyssinians from millet.
وَعَنْ عَبْدِ اللَّهِ بْنِ عَمْرٍو: أَنَّ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ الْخَمْرِ وَالْمَيْسِرِ وَالْكُوبَةِ وَالْغُبَيْرَاءِ وَقَالَ: «كُلُّ مُسْكِرٍ حَرَامٌ» . رَوَاهُ أَبُو دَاوُد

He reported the Prophet as saying, “An undutiful son, a gambler, one who casts up what lie has given, and one who is addicted to wine will not enter paradise.” Darimi transmitted it. A version of his has a bastard instead of a gambler.

Anas reported God’s Messenger as saying, “Listen and obey, even if an Abyssinian slave with a head like a raisin* is made governor over you.” Bukhari transmitted it. * This is said to refer to the head being small, or to the hair being crisp and curly, or short.

Ibn ‘Umar reported God’s Messenger as saying, “Hearing and obeying are the duty of a Muslim man both regarding what he likes and what he dislikes, as long as he is not commanded to perform an act of disobedience to God, in which case he must neither hear nor obey.” (Bukhari and Muslim.)

Abu Huraira told that he heard God’s Messenger say, “He who abandons obedience and separates from the community and then dies, will die like those of pre-Islamic times; he who fights under a banner of ignorance* showing anger in support of party spirit, or summoning people to party spirit, or helping party spirit, and then is killed will be killed like those of pre-Islamic times; and he who goes out against my people with his sword smiting the virtuous and the reprobate, not keeping away from those who are believers or observing covenants which have been made, has nothing to do with me and I have nothing to do with him.” Muslim transmitted it. *'Immiya, or 'ummiya, meaning either pride or error. I have translated it as ‘‘ignorance, for it is explained as being here used of people who fight without considering whether they are in the right or not.
وَعَنْ أَبِي هُرَيْرَةَ رَضِيَ اللَّهُ عَنْهُ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «مَنْ خَرَجَ مِنَ الطَّاعَةِ وَفَارَقَ الْجَمَاعَةَ فَمَاتَ مَاتَ مِيتَةً جَاهِلِيَّةً وَمَنْ قَاتَلَ تَحْتَ رَايَةٍ عِمِّيَّةٍ يَغْضَبُ لِعَصَبِيَّةٍ أَوْ يَدْعُو لِعَصَبِيَّةٍ أَوْ يَنْصُرُ عَصَبِيَّةً فَقُتِلَ فَقِتْلَةٌ جَاهِلِيَّةٌ وَمَنْ خَرَجَ عَلَى أُمَّتِي بِسَيْفِهِ يَضْرِبُ بَرَّهَا وَفَاجِرَهَا وَلَا يَتَحَاشَى مِنْ مُؤْمِنِهَا وَلَا يَفِي لِذِي عَهْدٍ عَهْدَهُ فَلَيْسَ مِنِّي وَلَسْتُ مِنْهُ» . رَوَاهُ مُسلم

‘Auf b. Malik al-Ashja‘i reported God's Messenger as saying, “Your best imams are those whom you like and who like you, on whom you invoke blessings and who invoke blessings on you; and your worst imams are those whom you hate and who hate you, whom you curse and who curse you.” They asked God's Messenger whether in that event they should not depose them, but he replied, “No, as long as they observe the prayer among you; no, as long as they observe the prayer among you. If anyone has a governor whom he sees doing anything which is an act of disobedience to God, he must disapprove of the disobedience to God which he commits, but must never withdraw from obedience.” Muslim transmitted it.
وَعَنْ عَوْفِ بْنِ مَالِكٍ الْأَشْجَعِيِّ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «خِيَارُ أئمتكم الَّذين يحبونهم وَيُحِبُّونَكُمْ وَتُصَلُّونَ عَلَيْهِمْ وَيُصَلُّونَ عَلَيْكُمْ وَشِرَارُ أَئِمَّتِكُمُ الَّذِي تبغضونهم ويبغضونكم وتلعنوهم ويلعنوكم» قَالَ: قُلْنَا: يَا رَسُولَ اللَّهِ أَفَلَا نُنَابِذُهُمْ عِنْدَ ذَلِكَ؟ قَالَ: «لَا مَا أَقَامُوا فِيكُمُ الصَّلَاةَ لَا مَا أَقَامُوا فِيكُمُ الصَّلَاةَ أَلَا مَنْ وُلِّيَ عَلَيْهِ وَالٍ فَرَآهُ يَأْتِي شَيْئًا مِنْ مَعْصِيَةِ اللَّهِ فَلْيَكْرَهْ مَا يَأْتِي مِنْ مَعْصِيَةِ اللَّهِ وَلَا يَنْزِعَنَّ يَدًا مِنْ طَاعَةٍ» . رَوَاهُ مُسلم

Abu Sa'id al-Khudri reported God’s Messenger as saying, “When allegiance is sworn to two caliphs kill the second of them.* Muslim transmitted it. * Some interpret ‘kill’ here as meaning to fight with. The tradition is directed against the possibility of two Caliphs holding power at the same time, even though the areas might be quite distinct.
وَعَنْ أَبِي سَعِيدٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِذَا بُويِعَ لِخَلِيفَتَيْنِ فاقتُلوا الآخِرَ منهُما» . رَوَاهُ مُسلم

‘Arfaja told that he heard God’s Messenger say, “Various corruptions will arise, so strike with the sword him who tries to cause separation in this people when they are united, whoever he be.” Muslim transmitted it.
وَعَنْ عَرْفَجَةَ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «إِنَّهُ سَيَكُونُ هَنَاتٌ وَهَنَاتٌ فَمَنْ أَرَادَ أَنْ يُفَرِّقَ أَمْرَ هَذِهِ الْأُمَّةِ وَهِيَ جَمِيعٌ فَاضْرِبُوهُ بِالسَّيْفِ كَائِنًا مَنْ كانَ» . رَوَاهُ مُسلم

Mishkat al-Masabih 3681
Abu Huraira reported the Prophet as saying, “You will be eager for the office of commander, but it will become a cause of regret on the day of resurrection. It is a good suckler but an evil weaner.”* Bukhari transmitted it. *In the beginning it causes pleasure, but later such pleasures are cut off. The idea is that one gladly undertakes high office, but later finds it to be a cause of grief.
وَعَنْ أَبِي هُرَيْرَةَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِنَّكُمْ سَتَحْرِصُونَ عَلَى الْإِمَارَةِ وَسَتَكُونُ نَدَامَةً يَوْمَ الْقِيَامَةِ فَنِعْمَ الْمُرْضِعَةُ وَبِئْسَتِ الفاطمةُ» . رَوَاهُ البُخَارِيّ

Abu Dharr told that he asked God’s Messenger to make him a governor, but he struck him on his shoulder with his hand and said, “You are weak, Abu Dharr, and it is a trust which will be a cause of shame and regret on the day of resurrection except for him who undertakes it as it ought to be undertaken and fulfils his duty in it.” In a version he said to him, “I see that you are weak, Abu Dharr, and I wish for you what I wish for myself. Do not accept rule over two people and do not become guardian of an orphan’s property.” Muslim transmitted it.
وَعَنْ أَبِي ذَرٍّ قَالَ: قُلْتُ: يَا رَسُولَ اللَّهِ أَلَا تَسْتَعْمِلُنِي؟ قَالَ: فَضَرَبَ بِيَدِهِ عَلَى مَنْكِبِي ثُمَّ قَالَ: «يَا أَبَا ذَرٍّ إِنَّكَ ضَعِيفٌ وَإِنَّهَا أَمَانَةٌ وَإِنَّهَا يَوْمَ الْقِيَامَةِ خِزْيٌ وَنَدَامَةٌ إِلَّا مَنْ أَخَذَهَا بِحَقِّهَا وَأَدَّى الَّذِي عَلَيْهِ فِيهَا» . وَفِي رِوَايَةٍ: قَالَ لَهُ: «يَا أَبَا ذَرٍّ إِنِّي أَرَاكَ ضَعِيفًا وَإِنِّي أُحِبُّ لَكَ مَا أُحِبُّ لِنَفْسِي لَا تَأَمَّرَنَّ عَلَى اثْنَيْنِ وَلَا تَوَلَّيَنَّ مَالَ يَتِيمٍ» . رَوَاهُ مُسْلِمٌ

Mishkat al-Masabih 3684
Abu Huraira reported God’s Messenger as saying, “You will find among the best people those who have the strongest dislike of this command till they fall into it.”* (Bukhari and Muslim.) *This is explained as meaning either they cease to dislike having authority and so cease to be among the best people, or they find that God helps them. Preference is given to the first explanation, but the remark is made that whichever explanation is correct, in the end these people do not object to having authority.

The imam who is over the people is a shepherd and is responsible for his flock; a man is a shepherd in charge of the inhabitants of his household and he is responsible for his flock; a woman is a shepherdess in charge of her husband’s house and children and she is responsible for them; and a man’s slave is a shepherd in charge of his master’s property and he is responsible for it. So each of you is a shepherd and each of you is responsible for his flock.” (Bukhari and Muslim.)

‘Abdallah b. ‘Amr b. al-‘As reported God’s Messenger as saying, “Those who act justly will be with God on pulpits of light* at the right hand of the Compassionate One, and both His hands are right. They are those who are just in their jurisdiction, towards their people and what is under their charge.” Muslim transmitted it. *This phrase is explained either in a literal sense, or as indicating their high station.

Abu Sa'id reported God's Messenger as saying, “No prophet is sent by God and no caliph succeeds another without having two close associates, one who commands and urges him to do what is reputable and one who commands and urges him to do what is evil. The one who is protected is he whom God protects.” Bukhari transmitted it.

Abu Huraira reported God’s Messenger as saying, “He who has been ruler over ten people will be brought on the day of resurrection shackled till justice loosens his chains or tyranny brings him to destruction.”* Darimi transmitted it. *The reference is to the justice or tyranny he has displayed in the administration of his office.

He reported God’s Messenger as saying, “Woe to the governors, woe to the chiefs, woe to the superintendents! On the day of resurrection people will wish that their forelocks were tied to the Pleiades, that they were swinging between heaven and earth, and that they had never exercised any rule.”* It is transmitted in Sharh as-sunna. Ahmad transmitted it, his version saying, “that their flowing hair were tied to the Pleiades, that they were dangling between heaven and earth, and that they had never been made governors over anything.” * The idea of their swinging between heaven and earth is that they will wish they had been far removed from the world during their lifetime so that they would not have exercised rule.
وَعَنْهُ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «وَيْلٌ لِلْأُمَرَاءِ وَيْلٌ لِلْعُرَفَاءِ وَيْلٌ لِلْأُمَنَاءِ لَيَتَمَنَّيَنَّ أَقْوَامٌ يَوْمَ الْقِيَامَةِ أَنَّ نَوَاصِيَهُمْ مُعَلَّقَةٌ بِالثُّرَيَّا يَتَجَلْجَلُونَ بَيْنَ السَّمَاءِ وَالْأَرْضِ وَأَنَّهُمْ لَمْ يَلُوا عَمَلًا» . رَوَاهُ فِي «شَرْحِ السُّنَّةِ» وَرَوَاهُ أَحْمد وَفِي رِوَايَته: «أنَّ ذوائِبَهُم كَانَتْ مُعَلَّقَةً بِالثُّرَيَّا يَتَذَبْذَبُونَ بَيْنَ السَّمَاءِ وَالْأَرْضِ ولَمْ يَكُونُوا عُمِّلوا على شَيْء»

Ghalib al-Qattan quoted a man who stated on the authority of his father that his grandfather reported God’s Messenger as saying, “The office of a chief is necessary, for people must have chiefs, but the chiefs will go to hell.”* Abu Dawud transmitted it. * Mirqat. iv, 133 says this means those who are unjust, or is a warning against the temptations to injustice arising from their office.
وَعَنْ غَالِبٍ الْقَطَّانِ عَنْ رَجُلٍ عَنْ أَبِيهِ عَنْ جَدِّهِ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم: «إِن العرافة حق ولابد لِلنَّاسِ مِنْ عُرَفَاءَ وَلَكِنَّ الْعُرْفَاءَ فِي النَّارِ» . رَوَاهُ أَبُو دَاوُد

Ka'b b. ‘Ujra told that God's Messenger said to him, “I commend you to God to protect you from the ruler ship of the foolish.” He asked what that was, and God’s Messenger replied, “After my time governors will arise whose falsehood will be believed and who will be assisted in their oppression by those who enter their presence. They have nothing to do with me and I have nothing to do with them, and they will never come down to me at the Pond. But they who do not enter their presence, believe their falsehood and help them in their oppression, those belong to me and I belong to them, and those ones will come down to me at the Pond.”* Tirmidhi and Nasa’i transmitted it. * This is the tank or pool at which believers will drink on the day of resurrection.
وَعَنْ كَعْبِ بْنِ عُجْرَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «أُعِيذُكَ بِاللَّهِ مِنْ إِمَارَةِ السُّفَهَاءِ» . قَالَ: وَمَا ذَاكَ يَا رَسُولَ اللَّهِ؟ قَالَ: «أُمَرَاءُ سَيَكُونُونَ مِنْ بَعْدِي مَنْ دَخَلَ عَلَيْهِمْ فَصَدَّقَهُمْ بِكَذِبِهِمْ وَأَعَانَهُمْ عَلَى ظُلْمِهِمْ فَلَيْسُوا مِنِّي وَلَسْتُ مِنْهُمْ وَلَنْ يَرِدُوا عليَّ الحوضَ وَمَنْ لَمْ يَدْخُلْ عَلَيْهِمْ وَلَمْ يُصَدِّقْهُمْ بِكَذِبِهِمْ وَلَمْ يُعِنْهُمْ عَلَى ظُلْمِهِمْ فَأُولَئِكَ مِنِّي وَأَنَا مِنْهُمْ وَأُولَئِكَ يَرِدُونَ عَلَيَّ الْحَوْضَ» . رَوَاهُ التِّرْمِذِيُّ وَالنَّسَائِيّ

Ibn ‘Abbas reported the Prophet as saying, “He who lives in the desert will become rough, he who follows the chase will become negligent, and he who goes to a ruler will be led astray.” Ahmad, Tirmidhi and Nasa’i transmitted it. Abu Dawud’s version has, “He who attaches himself to a ruler will be led astray, and the nearer a man comes to a ruler the farther he goes from God.”
وَعَنِ ابْنِ عَبَّاسٍ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «مَنْ سَكَنَ الْبَادِيَةَ جَفَا وَمَنِ اتَّبَعَ الصَّيْدَ غَفَلَ وَمَنْ أَتَى السُّلْطَانَ افْتُتِنَ» . رَوَاهُ أَحْمَدُ وَالتِّرْمِذِيُّ وَالنَّسَائِيُّ وَفِي رِوَايَةِ أَبِي دَاوُدَ: «مَنْ لَزِمَ السُّلْطَانَ افْتُتِنَ وَمَا ازْدَادَ عَبْدٌ مِنَ السُّلْطَانِ دُنُوًّا إِلَّا ازْدَادَ من اللَّهِ بُعداً»

Al-Miqdam b. Ma'dikarib told that God’s Messenger struck him on his shoulders and then said, “You will attain success, Qudaim,* if you die without having been a ruler, a secretary, or a chief.” Abu Dawud transmitted it. * This form is used as a diminutive of Miqdam, the diminutive being used as an affectionate form of address.
وَعَن المقدامِ بن معْدي كِربَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ ضَرَبَ عَلَى مَنْكِبَيْهِ ثُمَّ قَالَ: «أَفْلَحْتَ يَا قُدَيْمُ إِنْ مُتَّ وَلَمْ تَكُنْ أَمِيرًا وَلَا كَاتبا وَلَا عريفا» . رَوَاهُ أَبُو دَاوُد

Mu'awiya told that he heard God’s Messenger say,” When you look into people’s secrets you corrupt them.”* Baihaqi transmitted it in Shu'ab al-iman. * This is a prohibition of delving into other people’s affairs and disclosing things which should not be disclosed, as this makes life difficult for them. It is the same idea as in the previous tradition.
وَعَنْ مُعَاوِيَةَ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَقُولُ: «إِنَّكَ إِذَا اتَّبَعْتَ عَوْرَاتِ النَّاسِ أَفْسَدْتَهُمْ» . رَوَاهُ الْبَيْهَقِيُّ فِي «شُعَبِ الْإِيمَان»

Abu Dharr reported God's Messenger as saying, “How will you deal with imams after my death who appropriate to themselves this booty?” He replied, “I swear by Him who sent you with the truth that I shall put my sword on my shoulder and smite with it till I meet you.” He said, “Shall I not guide you to something better than that? You must show endurance till you meet me.” Abu Dawud transmitted it.
وَعَنْ أَبِي ذَرٍّ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «كَيْفَ أَنْتُمْ وَأَئِمَّةً مِنْ بَعْدِي يَسْتَأْثِرُونَ بِهَذَا الْفَيْءِ؟» . قُلْتُ: أَمَا وَالَّذِي بَعَثَكَ بِالْحَقِّ أَضَعُ سَيْفِي عَلَى عَاتِقِي ثُمَّ أَضْرِبُ بِهِ حَتَّى أَلْقَاكَ قَالَ: «أَوَلَا أَدُلُّكَ عَلَى خَيْرٍ مِنْ ذَلِكَ؟ تَصْبِرُ حَتَّى تَلقانِي» . رَوَاهُ أَبُو دَاوُد

Jabir b. Samura told that he heard God’s Messenger say, “There are three things I fear for my people:
seeking rain by the stars,*the injustice of the ruler, and denial of God's decree.” Ahmad. *This is a reference to the pre-Islamic habit of attributing rain to certain seasons and saying the rain came to them because of a certain star, whereas Muslims ought to recognize that rain comes by God’s favour.
وَعَنْ جَابِرِ بْنِ سَمُرَةَ قَالَ: سَمِعْتُ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسلم يَقُول: " ثلاثةٌ أَخَافُ عَلَى أُمَّتِي: الِاسْتِسْقَاءُ بِالْأَنْوَاءِ وَحَيْفُ السُّلْطَانِ وَتَكْذيب الْقدر "

Abu Dharr told that God’s Messenger said to him for six days, “Comprehend, Abu Dharr, what will be said to you afterwards.” Then when the seventh day came he said, “I counsel you to observe fear of God both secretly and openly; when you do wrong do a good deed; do not ask anyone for anything, even if your whip falls;* do not accept a trust; and do not give a decision between two people.” Ahmad. * This means that help is to be asked only from God and that one should not ask another human being for even the smallest help.
وَعَنْ أَبِي ذَرٍّ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «سِتَّةَ أَيَّامٍ اعْقِلْ يَا أَبَا ذَرٍّ مَا يُقَالُ لَكَ بَعْدُ» فَلَمَّا كَانَ الْيَوْمُ السَّابِعُ قَالَ: «أُوصِيكَ بِتَقْوَى اللَّهِ فِي سِرِّ أَمْرِكَ وَعَلَانِيَتِهِ وَإِذَا أَسَأْتَ فَأَحْسِنْ وَلَا تَسْأَلَنَّ أَحَدًا شَيْئًا وَإِنْ سَقَطَ سَوْطُكَ وَلَا تَقْبِضْ أَمَانَةً وَلَا تَقْضِ بَيْنَ اثْنَيْنِ»

Abu Umama reported the Prophet as saying, “No one will rule ten people or more without coming to God who is great and glorious on the day of resurrection with his hand chained to his neck and being set free by his goodness, or brought to destruction by his sin. The beginning of it merits blame, its middle produces regret, and its end is disgrace on the day of resurrection.” Ahmad.
وَعَنْ أَبِي أُمَامَةَ عَنِ النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنَّهُ قَالَ: «مَا مِنْ رَجُلٍ يَلِي أَمْرَ عَشَرَةٍ فَمَا فَوْقَ ذَلِكَ إِلَّا أتاهُ اللَّهُ عزَّ وجلَّ مغلولاً يومَ القيامةِ يَدُهُ إِلَى عُنُقِهِ فَكَّهُ بِرُّهُ أَوْ أَوْبَقَهُ إِثْمُهُ أَوَّلُهَا مَلَامَةٌ وَأَوْسَطُهَا نَدَامَةٌ وَآخِرُهَا خِزْيٌ يومَ القيامةِ»

Abu Burda* told that when the Prophet sent his grandfather Abu Musa and Mu'adh to the Yemen he said, “Make things easy and do not make them difficult; gladden and do not scare; comply with one another and do not disagree.” (Bukhari and Muslim.) * This should be Sa'id b. Abu Burda on his father’s authority. C f. Bukhari, Maghazi, 60.
وَعَن ابنِ أَبِي بُرْدَةَ قَالَ: بَعَثَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ جَدَّهُ أَبَا مُوسَى وَمُعَاذًا إِلَى الْيَمَنِ فَقَالَ: «يَسِّرَا وَلَا تُعَسِّرَا وَبَشِّرَا وَلَا تُنَفِّرَا وَتَطَاوَعَا وَلَا تَخْتَلِفَا»

وَعَنِ ابْنِ عُمَرَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: " إِنَّ الْغَادِرَ يُنْصَبُ لَهُ لِوَاءٌ يَوْمَ الْقِيَامَةِ فَيُقَالُ: هَذِهِ غَدْرَةُ فُلَانِ بْنِ فُلَانٍ "

Abu Huraira reported God’s Messenger as saying, “He who has been appointed a qadi among the people has been killed without a knife.”* Ahmad, Tirmidhi, Abu Dawud and Ibn Majah transmitted it. *This phrase has troubled commentators. Perhaps the best explanation is that he will have reason to repent of his manner of life, for there are many traditions which express disapproval of undertaking such an office. A somewhat ingenious explanation is that his evil characteristics must be cut away, this being a kind of slaughter.

Anas reported God’s Messenger as saying, “If anyone desires and asks for the office of qadi he will be left to his own devices, but if anyone is forced to accept it God will send down an angle who will direct him aright.” Tirmidhi, Abu Dawud and Ibn Majah transmitted it.

‘Abdallah b. Mas'ud reported God’s Messenger as saying, “No judge who pronounces judgment among men will fail to come on the day of resurrection with an angel holding the back of his neck. He* will then raise his head to heaven, and if God gives orders to cast him down, he will cast him into an abyss forty years deep." Ahmad, Ibn Majah, and Baihaqi in Shu'ab al-lman transmitted it. *i.e. the angel.
عَنْ عَبْدِ اللَّهِ بْنِ مَسْعُودٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: " مَا مِنْ حَاكِمٍ يَحْكُمُ بَيْنَ النَّاسِ إِلَّا جَاءَ يَوْمَ الْقِيَامَةِ وَمَلَكٌ آخِذٌ بِقَفَاهُ ثُمَّ يَرْفَعُ رَأْسَهُ إِلَى السَّمَاءِ فَإِنْ قَالَ: أَلْقِهْ أَلْقَاهُ فِي مَهْوَاةٍ أَرْبَعِينَ خَرِيفًا ". رَوَاهُ أَحْمَدُ وَابْنُ مَاجَهْ والْبَيْهَقِيُّ فِي شُعَبِ الْإِيمَان

‘A’isha reported God's Messenger as saying, “The day of resurrection will come to the just qadi and he will wish he had never given judgment between two men about a single date.”* Ahmad transmitted it. * He will wish he had never given judgment even about the most insignificant matters.
وَعَنْ عَائِشَةَ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ قَالَ: «لَيَأْتِيَنَّ عَلَى الْقَاضِي الْعَدْلِ يومُ القيامةِ يَتَمَنَّى أَنَّهُ لَمْ يَقْضِ بَيْنَ اثْنَيْنِ فِي تَمْرَة قطّ» . رَوَاهُ أَحْمد

'Abdallah b. Abu Aufa reported God’s Messenger as saying, “God is with the qadi as long as he is not tyrannical, but when he is He departs from him and the devil attaches himself to him.” A version has, “When he is tyrannical He leaves him to his own devices.” Tirmidhi and Ibn Majah transmitted it.
وَعَنْ عَبْدُ اللَّهِ بْنِ أَبِي أَوْفَى قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «إِنَّ اللَّهَ مَعَ الْقَاضِي مَا لَمْ يَجُرْ فَإِذَا جَارَ تَخَلَّى عَنْهُ وَلَزِمَهُ الشَّيْطَانُ» . رَوَاهُ التِّرْمِذِيُّ وَابْنُ مَاجَهْ وَفِي رِوَايَةٍ: «فَإِذَا جارَ وَكله إِلَى نَفسه»

Ibn Mas'ud reported God’s Messenger as saying, “If anyone swears a firm oath, 1 acting wickedly thereby, and appropriates by it property belonging to a Muslim, God will be angry when he meets Him on the day of resurrection.” And God has sent down the verification of that, “Those who barter for a small price God's covenant and their oaths”2. وَعَنِ ابْنِ مَسْعُودٍ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنْ حَلَفَ عَلَى يَمِينِ صَبْرٍ وَهُوَ فِيهَا فَاجِرٌ يَقْتَطِعُ بِهَا مَالَ امْرِئٍ مُسْلِمٍ لَقِيَ اللَّهَ يَوْمَ الْقِيَامَةِ وَهُوَ عَلَيْهِ غَضْبَانُ» فَأَنْزَلَ اللَّهُ تَصْدِيقَ ذَلِكَ: (إِنَّ الَّذِينَ يشترونَ بعهدِ اللَّهِ وأيمانِهمْ ثمنا قَلِيلا) إِلَى آخر الْآيَة

Abu Umama reported God’s Messenger as saying, “If anyone appropriates by his oath what rightly belongs to a Muslim, God has made hell necessary for him and deprived him of paradise.” A man asked God’s Messenger whether that applied even if it were a small amount, and he replied, “Even if it were a stick from an arak tree.” Muslim transmitted it.
وَعَنْ أَبِي أُمَامَةَ قَالَ: قَالَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «مَنِ اقْتَطَعَ حَقَّ امْرِئٍ مُسْلِمٍ بِيَمِينِهِ فَقَدْ أَوْجَبَ اللَّهُ لَهُ النَّارَ وَحَرَّمَ اللَّهُ عَلَيْهِ الْجَنَّةَ» فَقَالَ لَهُ رَجُلٌ: وَإِنْ كَانَ شَيْئا يسير يَا رَسُولَ اللَّهِ؟ قَالَ: «وَإِنْ كَانَ قَضِيبًا من أَرَاك» . رَوَاهُ مُسلم

Mishkat al-Masabih 3772
Abu Musa al-Ash'ari told that two men laid claim to a camel in the time of God’s Messenger and both of them sent two witnesses, so the Prophet divided it in halves between them.* Abu Dawud transmitted it. A version by Nasa’i, Ibn Majah and him says that two men laid claim to a camel, but as neither of them could produce proof the Prophet declared they should share it equally. * I have kept closely to the Arabic in this translation because the alternative version follows immediately afterwards. The meaning of both versions is the same, viz. that both men were to have equal use of the camel.
وَعَن أبي مُوسَى الأشعريِّ: أَنَّ رَجُلَيْنِ ادَّعَيَا بَعِيرًا عَلَى عَهْدِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ فَبَعَثَ كُلُّ وَاحِدٍ مِنْهُمَا شَاهِدَيْنَ فَقَسَّمَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَهُمَا نِصْفَيْنِ. رَوَاهُ أَبُو دَاوُدَ وَفِي رِوَايَةٍ لَهُ وَلِلنَّسَائِيِّ وَابْنِ مَاجَهْ: أَنَّ رَجُلَيْنِ ادَّعَيَا بَعِيرًا لَيْسَتْ لِوَاحِدٍ مِنْهُمَا بَيِّنَةٌ فَجَعَلَهُ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ بَيْنَهُمَا

Abu Huraira told that two men disputed about an animal but could produce no proof, so the Prophet said, “Cast lots about the oath.” Abu Dawud and Ibn Majah transmitted it.
