Narrated Abu Tha`laba:

Allah's Apostle forbade the eating of the meat of beasts having fangs.

It was narrated from ‘Ali (رضي الله عنه) that the Prophet (ﷺ) forbade every wild animal that has fangs and every bird that has talons, the price of dead meat, the flesh of donkeys, the wages of a prostitute, the stud fee of the stallion and purple saddle cloths.
حَدَّثَنَا عَبْد اللَّهِ، حَدَّثَنِي مُحَمَّدُ بْنُ يَحْيَى، عَنْ عَبْدِ الصَّمَدِ، حَدَّثَنِي أَبِي، حَدَّثَنَا حَسَنُ بْنُ ذَكْوَانَ، عَنْ حَبِيبِ بْنِ أَبِي ثَابِتٍ، عَنْ عَاصِمِ بْنِ ضَمْرَةَ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى عَنْ كُلِّ ذِي نَابٍ مِنْ السَّبُعِ وَكُلِّ ذِي مِخْلَبٍ مِنْ الطَّيْرِ وَعَنْ ثَمَنِ الْمَيْتَةِ وَعَنْ لَحْمِ الْحُمُرِ الْأَهْلِيَّةِ وَعَنْ مَهْرِ الْبَغِيِّ وَعَنْ عَسْبِ الْفَحْلِ وَعَنْ الْمَيَاثِرِ الْأُرْجُوَانِ‏.‏

Yahya related to me from Malik from Ibn Shibab from Abu Idris al- Khawlani from Abu Tha~laba al-Khushani that the Messenger of Allah, may Allah bless him and grant him peace, said, "It is haram to eat animals with fangs "

Narrated al-Miqdam bin Ma'dikarib (RA):
Allah's Messenger (SAW) said, "A beast of prey with a fang, a domestic donkey, and a lost item from the property of a Mu'ahid (a disbeliever who has been given a covenant) - unless it is something worthless - are not lawful." [Reported by Abu Dawud].
وَعَنْ اَلْمِقْدَامِ بْنِ مَعْدِي كَرِبَ ‏- رضى الله عنه ‏- قَالَ : قَالَ رَسُولُ اَللَّهِ ‏- صلى الله عليه وسلم ‏-{ أَلَا لَا يَحِلُّ ذُو نَابٍ مِنَ السِّبَاعِ , وَلَا اَلْحِمَارُ اَلْأَهْلِيُّ , وَلَا اَللُّقَطَةُ مِنْ 57 مَالِ مُعَاهَدٍ , إِلَّا أَنْ يَسْتَغْنِيَ عَنْهَا } رَوَاهُ أَبُو دَاوُدَ 1‏ .‏

Abu Tha'laba al-Khushani reported that Allah's Messenger (may peace be upon him) prohibited the eating of all fanged beasts. Ibn Shihab said:

I did not bear of this from our 'Ulama' in the Hijaz, until Abu Idris narrated that to me and he was one of the jurists of Syria.
وَحَدَّثَنِي حَرْمَلَةُ بْنُ يَحْيَى، أَخْبَرَنَا ابْنُ وَهْبٍ، أَخْبَرَنِي يُونُسُ، عَنِ ابْنِ شِهَابٍ، عَنْ أَبِي إِدْرِيسَ الْخَوْلاَنِيِّ، أَنَّهُ سَمِعَ أَبَا ثَعْلَبَةَ الْخُشَنِيَّ، يَقُولُ نَهَى رَسُولُ اللَّهِ صلى الله عليه وسلم عَنْ أَكْلِ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ ‏.‏ قَالَ ابْنُ شِهَابٍ وَلَمْ أَسْمَعْ ذَلِكَ مِنْ عُلَمَائِنَا بِالْحِجَازِ حَتَّى حَدَّثَنِي أَبُو إِدْرِيسَ وَكَانَ مِنْ فُقَهَاءِ أَهْلِ الشَّامِ ‏.‏

Narrated Abu Tha`laba Al-Khushani:

The Prophet forbade the eating of wild animals having fangs. (Az-Zuhri said: I did not hear this narration except when I went to Sham.) Al-Laith said: Narrated Yunus: I asked Ibn Shihab, "May we perform the ablution with the milk of she-asses or drink it, or drink the bile of wild animals or urine of camels?" He replied, "The Muslims used to treat themselves with that and did not see any harm in it. As for the milk of she-asses, we have learnt that Allah's Apostle forbade the eating of their meat, but we have not received any information whether drinking of their milk is allowed or forbidden." As for the bile of wild animals, Ibn Shihab said, "Abu Idris Al-Khaulani told me that Allah's Apostle forbade the eating of the flesh of every wild beast having fangs . "

Yahya related to me from Malik from Ismail ibn Abi Hakim from Abiyda ibn Sufyan al-Hadrami from Abu Hurayra that the Messenger of Allah, may Allah bless him and grant him peace, said, "Eating animals with fangs is haram. "

Malik said, "This is the custom among us."

وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ إِسْمَاعِيلَ بْنِ أَبِي حَكِيمٍ، عَنْ عَبِيدَةَ بْنِ سُفْيَانَ الْحَضْرَمِيِّ، عَنْ أَبِي هُرَيْرَةَ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ ‏ "‏ أَكْلُ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ حَرَامٌ ‏"‏ ‏.‏

Narrated Khalid ibn al-Walid:

I went with the Messenger of Allah (saws) to fight at the battle of Khaybar, and the Jews came and complained that the people had hastened to take their protected property (as a booty), so the Messenger of Allah (saws) said: The property of those who have been given a mules, every fanged beast of prey, and every bird with a talon are forbidden for you.

حَدَّثَنَا عَمْرُو بْنُ عُثْمَانَ، حَدَّثَنَا مُحَمَّدُ بْنُ حَرْبٍ، حَدَّثَنِي أَبُو سَلَمَةَ، سُلَيْمَانُ بْنُ سُلَيْمٍ عَنْ صَالِحِ بْنِ يَحْيَى بْنِ الْمِقْدَامِ، عَنْ جَدِّهِ الْمِقْدَامِ بْنِ مَعْدِيكَرِبَ، عَنْ خَالِدِ بْنِ الْوَلِيدِ، قَالَ غَزَوْتُ مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم خَيْبَرَ فَأَتَتِ الْيَهُودُ فَشَكَوْا أَنَّ النَّاسَ قَدْ أَسْرَعُوا إِلَى حَظَائِرِهِمْ فَقَالَ رَسُولُ اللَّهِ صلى الله عليه وسلم ‏ "‏ أَلاَ لاَ تَحِلُّ أَمْوَالُ الْمُعَاهِدِينَ إِلاَّ بِحَقِّهَا وَحَرَامٌ عَلَيْكُمْ حُمُرُ الأَهْلِيَّةِ وَخَيْلُهَا وَبِغَالُهَا وَكُلُّ ذِي نَابٍ مِنَ السِّبَاعِ وَكُلُّ ذِي مِخْلَبٍ مِنَ الطَّيْرِ ‏"‏ ‏.‏

Narrated Al-Miqdam ibn Ma'dikarib:

The Prophet (saws) said: Beware, the fanged beast of prey is not lawful, nor the domestic asses, nor the find from the property of a man with whom treaty has been concluded, except that he did not need it. If anyone is a guest of people who provide no hospitality for him, he is entitled to take from them the equivalent of the hospitality due to him.

Abu Huraira told that God's messenger used to come to the house of some of the Ansar, but that near it was a house which he never visited. That distressed the people, so they said, “Messenger of God, you visit so and so’s house, but you never visit ours.” The Prophet replied, “It is because there is a dog in your house. ” They said, “There is a cat in their house,” and he replied, “A cat is a beast of prey.” (The explanation given is that a cat uses its fangs to kill its prey and is not unclean whereas the dog eats filth and is considered unclean.) Daraqutni transmitted it.
وَعَنْ أَبِي هُرَيْرَةَ قَالَ: كَانَ رَسُولُ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ يَأْتِي دَارَ قَوْمٍ مِنَ الْأَنْصَارِ وَدُونَهُمْ دَارٌ فَشَقَّ ذَلِكَ عَلَيْهِمْ فَقَالُوا: يَا رَسُولَ اللَّهِ تَأْتِي دَارَ فُلَانٍ وَلَا تَأْتِي دَارَنَا. فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «لِأَنَّ فِي دَارِكُمْ كَلْبًا» . قَالُوا: إِنَّ فِي دَارِهِمْ سِنَّوْرًا فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ: «السِّنَّوْرُ سَبْعٌ» . رَوَاهُ الدَّارَقُطْنِيُّ

Yahya related to me from Malik that he had heard some of the people of knowledge say that when falcons, eagles, and hawks and their like, understood as trained dogs understood, there was no harm in eating what they had killed in the course of hunting, if the name of Allah had been mentioned when they were sent out.

Malik said, "The best of what I have heard about retrieving game from the falcon's talons or from the dog's fangs and then waiting until it dies, is that it is not halal to eat it."

Malik said, "The same applies to anything which could have been slaughtered by the hunter when it was in the talons of the falcon or the fangs of the dog. If the hunter leaves it until the falcon or dog has killed it, it is not halal to eat it either". He continued, "The same thing applies to any game hit by a hunter and caught while still alive, which he neglects to slaughter before it dies."

Malik said, "It is generally agreed among us that it is halal to eat the game that a hunting-dog belonging to magians hunts or kills, if it is sent out by a muslim and the animal is trained. There is no harm in it even if the muslim does not actually slaughter it.

It is the same as a muslim using a magian's knife to slaughter with or using his bow and arrows to shoot and kill with. The game he shot and the animal he slaughters are halal. There is no harm in eating them. If a magian sends out a muslim's hunting dog for game, and it catches it, the game is not to be eaten unless it is slaughtered by a muslim. That is like a magian using a muslim's bow and arrow to hunt game with, or like his using a muslim's knife to slaughter with. It is not halal to eat anything killed like that.

.‏ وَحَدَّثَنِي عَنْ مَالِكٍ أَنَّهُ سَمِعَ بَعْضَ أَهْلِ الْعِلْمِ يَقُولُونَ فِي الْبَازِي وَالْعُقَابِ وَالصَّقْرِ وَمَا أَشْبَهَ ذَلِكَ أَنَّهُ إِذَا كَانَ يَفْقَهُ كَمَا تَفْقَهُ الْكِلاَبُ الْمُعَلَّمَةُ فَلاَ بَأْسَ بِأَكْلِ مَا قَتَلَتْ مِمَّا صَادَتْ إِذَا ذُكِرَ اسْمُ اللَّهِ عَلَى إِرْسَالِهَا ‏.‏ قَالَ مَالِكٌ وَأَحْسَنُ مَا سَمِعْتُ فِي الَّذِي يَتَخَلَّصُ الصَّيْدَ مِنْ مَخَالِبِ الْبَازِي أَوْ مِنَ الْكَلْبِ ثُمَّ يَتَرَبَّصُ بِهِ فَيَمُوتُ أَنَّهُ لاَ يَحِلُّ أَكْلُهُ ‏.‏ قَالَ مَالِكٌ وَكَذَلِكَ كُلُّ مَا قُدِرَ عَلَى ذَبْحِهِ وَهُوَ فِي مَخَالِبِ الْبَازِي أَوْ فِي الْكَلْبِ فَيَتْرُكُهُ صَاحِبُهُ وَهُوَ قَادِرٌ عَلَى ذَبْحِهِ حَتَّى يَقْتُلَهُ الْبَازِي أَوِ الْكَلْبُ فَإِنَّهُ لاَ يَحِلُّ أَكْلُهُ ‏.‏ قَالَ مَالِكٌ وَكَذَلِكَ الَّذِي يَرْمِي الصَّيْدَ فَيَنَالُهُ وَهُوَ حَىٌّ فَيُفَرِّطُ فِي ذَبْحِهِ حَتَّى يَمُوتَ فَإِنَّهُ لاَ يَحِلُّ أَكْلُهُ ‏.‏ قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّ الْمُسْلِمَ إِذَا أَرْسَلَ كَلْبَ الْمَجُوسِيِّ الضَّارِيَ فَصَادَ أَوْ قَتَلَ إِنَّهُ إِذَا كَانَ مُعَلَّمًا فَأَكْلُ ذَلِكَ الصَّيْدِ حَلاَلٌ لاَ بَأْسَ بِهِ وَإِنْ لَمْ يُذَكِّهِ الْمُسْلِمُ وَإِنَّمَا مَثَلُ ذَلِكَ مَثَلُ الْمُسْلِمِ يَذْبَحُ بِشَفْرَةِ الْمَجُوسِيِّ أَوْ يَرْمِي بِقَوْسِهِ أَوْ بِنَبْلِهِ فَيَقْتُلُ بِهَا فَصَيْدُهُ ذَلِكَ وَذَبِيحَتُهُ حَلاَلٌ لاَ بَأْسَ بِأَكْلِهِ ...

Narrated Al-Miqdam ibn Ma'dikarib:

The Prophet (saws) said: Beware! I have been given the Qur'an and something like it, yet the time is coming when a man replete on his couch will say: Keep to the Qur'an; what you find in it to be permissible treat as permissible, and what you find in it to be prohibited treat as prohibited. Beware! The domestic ass, beasts of prey with fangs, a find belonging to confederate, unless its owner does not want it, are not permissible to you If anyone comes to some people, they must entertain him, but if they do not, he has a right to mulct them to an amount equivalent to his entertainment.

حَدَّثَنَا عَبْدُ الْوَهَّابِ بْنُ نَجْدَةَ، حَدَّثَنَا أَبُو عَمْرِو بْنُ كَثِيرِ بْنِ دِينَارٍ، عَنْ حَرِيزِ بْنِ عُثْمَانَ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ أَبِي عَوْفٍ، عَنِ الْمِقْدَامِ بْنِ مَعْدِيكَرِبَ، عَنْ رَسُولِ اللَّهِ صلى الله عليه وسلم أَنَّهُ قَالَ ‏ "‏ أَلاَ إِنِّي أُوتِيتُ الْكِتَابَ وَمِثْلَهُ مَعَهُ أَلاَ يُوشِكُ رَجُلٌ شَبْعَانُ عَلَى أَرِيكَتِهِ يَقُولُ عَلَيْكُمْ بِهَذَا الْقُرْآنِ فَمَا وَجَدْتُمْ فِيهِ مِنْ حَلاَلٍ فَأَحِلُّوهُ وَمَا وَجَدْتُمْ فِيهِ مِنْ حَرَامٍ فَحَرِّمُوهُ أَلاَ لاَ يَحِلُّ لَكُمْ لَحْمُ الْحِمَارِ الأَهْلِيِّ وَلاَ كُلُّ ذِي نَابٍ مِنَ السَّبُعِ وَلاَ لُقَطَةُ مُعَاهِدٍ إِلاَّ أَنْ يَسْتَغْنِيَ عَنْهَا صَاحِبُهَا وَمَنْ نَزَلَ بِقَوْمٍ فَعَلَيْهِمْ أَنْ يَقْرُوهُ فَإِنْ لَمْ يَقْرُوهُ فَلَهُ أَنْ يُعْقِبَهُمْ بِمِثْلِ قِرَاهُ ‏"‏ ‏.‏

Narrated Khalid ibn al-Walid:

The Messenger of Allah (saws) forbade us to eat horse-flesh, the flesh of mules and of asses. The narrator Haywah added: Every beast of prey with a fang.

Abu Dawud said: This view is held by Malik.

Abu Dawud said: There is no harm in (eating) horse-flesh and this tradition is not practised.

Abu Dawud said: This tradition has been abrogated. A body of Companions of the Prophet (saws) had eaten horse-flesh. OF them are: Ibn al-Zubair, Fudalah bin 'Ubaid, Anas bin Malik, Asma' daughter of Abu Bakr, Suwaid bin Ghaflah, 'Alqamah; the Quraish used to slaughter them (horses) during the time of the Messenger of Allah (saws).

حَدَّثَنَا سَعِيدُ بْنُ شَبِيبٍ، وَحَيْوَةُ بْنُ شُرَيْحٍ الْحِمْصِيُّ، قَالَ حَيْوَةُ حَدَّثَنَا بَقِيَّةُ، عَنْ ثَوْرِ بْنِ يَزِيدَ، عَنْ صَالِحِ بْنِ يَحْيَى بْنِ الْمِقْدَامِ بْنِ مَعْدِيكَرِبَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، عَنْ خَالِدِ بْنِ الْوَلِيدِ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم نَهَى عَنْ أَكْلِ لُحُومِ الْخَيْلِ وَالْبِغَالِ وَالْحَمِيرِ - زَادَ حَيْوَةُ - وَكُلِّ ذِي نَابٍ مِنَ السِّبَاعِ ‏.‏ قَالَ أَبُو دَاوُدَ وَهُوَ قَوْلُ مَالِكٍ ‏.‏ قَالَ أَبُو دَاوُدَ لاَ بَأْسَ بِلُحُومِ الْخَيْلِ وَلَيْسَ الْعَمَلُ عَلَيْهِ ‏.‏ قَالَ أَبُو دَاوُدَ وَهَذَا مَنْسُوخٌ قَدْ أَكَلَ لُحُومَ الْخَيْلِ جَمَاعَةٌ مِنْ أَصْحَابِ النَّبِيِّ صلى الله عليه وسلم مِنْهُمُ ابْنُ الزُّبَيْرِ وَفَضَالَةُ بْنُ عُبَيْدٍ وَأَنَسُ بْنُ مَالِكٍ وَأَسْمَاءُ ابْنَةُ أَبِي بَكْرٍ وَسُوَيْدُ بْنُ غَفَلَةَ وَعَلْقَمَةُ وَكَانَتْ قُرَيْشٌ فِي عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم تَذْبَحُهَا ‏.‏

Mishkat al-Masabih 4089
Al-Irbad b. Sariya told that on the day of Khaibar God's messenger forbade every carnivorous beast which had a fang, every bird which had a claw, the flesh of domestic asses, the mujaththama, the khalisa, and sexual intercourse with pregnant wbmen till they have given birth to a child. Muhammad b. Yahya* said that Abu ‘Asim was asked about the mujaththama and said it meant a bird or something else being set up and shot at. He was asked about the khalisa and said it was an animal taken from a wolf or a beast of prey by a man who has caught up on it, but which dies in his hand before he can slaughter it. *Tirmidhi’s immediate authority. Tirmidhi transmitted it.
وَعَنِ الْعِرْبَاضِ بْنِ سَارِيَةَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ نَهَى يَوْمَ خَيْبَرَ عَنْ كُلِّ ذِي نَابٍ مِنَ السِّبَاعِ وَعَنْ كُلِّ ذِي مِخْلَبٍ مِنَ الطَّيْرِ وَعَنْ لُحُومِ الْحُمُرِ الْأَهْلِيَّةِ وَعَنِ الْمُجَثَّمَةِ وَعَنِ الْخَلِيسَةِ وَأَنْ تُوطَأَ الْحَبَالَى حَتَّى يَضَعْنَ مَا فِي بُطُونِهِنَّ قَالَ مُحَمَّدُ بْنُ يَحْيَى: سُئِلَ أَبُو عَاصِمٍ عَنِ الْمُجَثَّمَةِ فَقَالَ: أَنْ يُنْصَبَ الطَّيْرُ أَوِ الشَّيْءُ فَيُرْمَى وَسُئِلَ عَنِ الْخَلِيسَةِ فَقَالَ: الذِّئْبُ أَوِ السَّبُعُ يُدْرِكُهُ الرَّجُلُ فَيَأْخُذُ مِنْهُ فَيَمُوتُ فِي يَدِهِ قَبْلَ أَنْ يذكيها. رَوَاهُ التِّرْمِذِيّ

Al-Miqdam b. Ma'dikarib reported God’s messenger as saying, “I have indeed been brought the Qur’an and something like it along with it, yet the time is coming when a man replete on his couch will say, ‘Keep to this Qur’an; what you find in it to be permissible treat as permissible, and what you find in it to be prohibited treat as prohibited.’ But what God’s messenger has prohibited is like what God has prohibited. The domestic ass, beasts of prey with fangs, a find belonging to a confederate, unless its owner does not want it, are not permissible to you. If anyone comes to some people they must entertain him, but if they do not, he has a right to mulct them to an amount equivalent to his entertainment.” Abu Dawud transmitted it, and Darimi transmitted something similar. Ibn Majah transmitted the same up to “like what God has prohibited.”
وَعَن الْمِقْدَام بن معدي كرب عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ أَنه قَالَ: «أَلا إِنِّي أُوتيت الْكتاب وَمِثْلَهُ مَعَهُ أَلَا يُوشِكُ رَجُلٌ شَبْعَانٌ عَلَى أَرِيكَتِهِ يَقُولُ عَلَيْكُمْ بِهَذَا الْقُرْآنِ فَمَا وَجَدْتُمْ فِيهِ مِنْ حَلَالٍ فَأَحِلُّوهُ وَمَا وَجَدْتُمْ فِيهِ مِنْ حَرَامٍ فَحَرِّمُوهُ وَإِنَّ مَا حَرَّمَ رَسُولُ الله كَمَا حَرَّمَ اللَّهُ أَلَا لَا يَحِلُّ لَكُمُ لحم الْحِمَارُ الْأَهْلِيُّ وَلَا كُلُّ ذِي نَابٍ مِنَ السَّبع وَلَا لُقَطَةُ مُعَاهَدٍ إِلَّا أَنْ يَسْتَغْنِيَ عَنْهَا صَاحِبُهَا وَمَنْ نَزَلَ بِقَوْمٍ فَعَلَيْهِمْ أَنْ يُقْرُوهُ فَإِنْ لَمْ يَقْرُوهُ فَلَهُ أَنْ يُعْقِبَهُمْ بِمِثْلِ قِرَاهُ» رَوَاهُ أَبُو دَاوُدَ وَرَوَى الدَّارِمِيُّ نَحْوَهُ وَكَذَا ابْنُ مَاجَهْ إِلَى قَوْلِهِ: «كَمَا حَرَّمَ الله»
